Permission Granted For
Jersey Oyster Co Expansion The Planning Applications Committee has granted permission for the Jersey Oyster Company to expand its processing unit and to build facilities that will allow it to develop its export business. The scheme seeks to improve aquaculture facilities for oyster breeding, production & packaging, close to the shore. The company applied to build a single-storey extension, a salt water lagoon, 12 salt water purification ponds and a pumping house in Grouville.
The nursery ponds will be used to cultivate seed oysters, which means that the business will not have to import young oysters and will be able to restock the oyster beds when needed.

f e i r B n I s w e N Fisherman Prosecuted For Groundlines A fisherman has been fined £300 for not complying with fishing laws by setting groundlines on the beach at Grouville outside of the season. The Department of the Environment is reminding fishermen to ensure that fishing gear set on beaches and at sea complies with the law. Groundlines (also known as trots or trot lines) are baited hooks attached to a line which often rests on the sand and can’t be set on the beach from 1 April to 15 October in any year. Marine Resources assistant director Greg Morel said “People use our beaches for many different activities and pastimes. At this time of year in particular, there are a lot of children and dogs on the beaches and it is important users are respectful of others and comply with regulations.”

New Sea Bass Restrictions New restrictions on catching sea bass in Jersey's waters have been proposed. Commercial and recreational fishermen could have limits imposed in an attempt to preserve stocks. If the measures are approved, trawling in the winter will be banned, and recreational fishermen will be limited to 3 sea bass a day. A monthly limit on commercial vessels and an increase in the minimum size of fish caught have also been recommended. Deputy Steve Luce, the Assistant Minister for Economic Development with responsibility for fisheries, published the proposed measures to protect bass stocks following advice about the sustainability of the species. fishermen are about this iconic species and I hope the mix of measures that will impact He said bass was an important stock and on all those catching bass will show that it is it was vital the right measures were put in important we all work together to ensure its place to protect it. sustainability," he said.

Academic Excellence Achieved at JCG Carl Howarth, Principal, stated: ‘Once again, our students have achieved academic excellence. With nearly two thirds of students achieving 5 or more A* or A grades and 90% of all students achieving 5 or more GCSEs grades A* - B, they have demonstrated that with hard work, good teaching and aspiration, nothing is impossible. However, whilst these headline figures are very pleasing they don’t reveal the many individual successes. It is wonderful to see students who have aspired and worked so hard to significantly outperform their targets based on their CATs data. This positive difference is the value that they, their teachers and the College as a whole have added to their education and we are so proud of them. I would like to thank their teachers and their parents for all the help and care they have given along the way.’

Recycling Robot On The Move From 1st September, Mr Robot will be standing down from his duty of welcoming customers to the Household Recycling Centre at Gate 4 Bellozanne.
Seaweed Issue The growth of sea lettuce occurs in shallow sandy bays throughout the world in the warmer months. It is a global issue – not one which is unique to Jersey. During the summer season, TTS endeavours to keep the top part of the beach, where people sit and play, clear of litter and seaweed/sea lettuce, especially near the slipways, beach concessions and cafés. It uses a specialist machine but removal is limited to early mornings – and then only when the tide is low enough. TTS can compost small volumes of weed, however the limited space available at La Collette and the high cost, makes it unrealistic and unviable for large quantities of weed. The only realistic option is to take it back to the low water mark, but the tidal and weather conditions mean that the sea lettuce will return to beaches very quickly. The department will continue to keep the top of the priority beaches as clean as it can and only remove heavier deposits of sea lettuce from the same areas if they become a public nuisance, and then only after the top of a spring tide so that the next high tide doesn’t undo this work.

Proposal To Heighten The Sea Wall at Gunsite A proposal to raise the sea wall at the Gunsite to reduce the risk of flooding is being put forward by the States. TTS want to raise the wall between the Gunsite slip and Le Perquage Car Park by just under 1ft. It would reduce the risk to the Beaumont area, which has flooded during high tide and stormy conditions causing damage to properties in the area. The use of extra-large sand bags and an inflatable barrier to prevent flooding has had limited success in the past.

Specialist Automotive Website Aimed Solely At Channel Islands Motorists A new website selling the largest selection com is also keen to offer a range of value of used vehicles in the Channel Islands added tools and guidance to help the car buyer make better, more informed choices. was recently launched in June. AutoExchangeCI.com is the brainchild of Gordon Bush who offers over 30-years experience from the automotive sector within the UK and Europe and is a well-known figure within the automotive community. Gordon explained his vision for the site; “As a motorist I was frustrated that if you wanted to look for a car in the Channel Islands you had to look at the individual website of every dealer assuming you knew the name of them all. In the UK, sites like ‘AutoTrader’ provide potential car buyers and people wishing to sell their car privately one place to go with a simple to use site. Therefore whether you are a motor dealer or a private individual looking to sell your car, we have created a website that offers you a platform to sell your car successfully. For car buyers, we are offering one place to view every vehicle that meets your requirements that is currently for sale across the Channel Islands. If it is not available you can tell us what you are looking for and with our motor dealership relationships we can help you find it.”
Their value-added services, which are unique to the website, include Value my Vehicle; a free and no-obligation valuation service to instantly find out how the market values your vehicle. And Calculate my Settlement; a feature that allows customers, with an outstanding balance of motor finance, the ability to ascertain the settlement due on their current car. Whether they are looking to sell their vehicle privately or part-exchange it in a dealership, these are useful tools to calculate what they can afford.
The site also includes Dealer Directory an easy way to find the details of all of the motor dealerships and automotive related companies. The Auto Info section provides a news feed on the latest updates from the industry and even the latest statistics on new vehicle registrations in Jersey & Guernsey. There is also an event calendar highlighting any motor related event in the Channel Islands. AutoExchangeCI.com are also involved in running child car seat safety events in conjunction with Mothercare; Co-Op; Drivers and local Police Safety Officer Philip Blake and Unlike the other online classified sites there is a section to explain why this is so found locally, AutoExchangeCI.com is the important for parents along with dates for only website purely dedicated to buying their next event. and selling cars. Sea Weed or Swamp?
It’s that time of year again! Yes, you either love it or hate it! Or you just don’t care about it, but then again your other half probably loves it so you have to put up with it either way! Unfortunately, The X Factor will be back on our TV’s again very soon, and I am not looking forward to it!
6 Hour or 36 Hour Parking? Free parking in town is limited at the best of times, but it is made increasingly difficult to find a spot when the same cars repeatedly “hog” the spaces. The parking discs allow you to park for 2, 3 or 6 hours in certain places, however, on Commercial Road there have been several cars in the past week that haven’t moved an inch! Considering how parking wardens love to issue tickets, I’m surprised they have got away with it! I parked in the 3 hour bays the other day, and admittedly I added another 3 hours on once my disc had finished, however, there were 5/6 free spaces available. When I returned to my car (only one hour later!) I had been issued with a parking ticket for the very offense I mention above! When I got back to the car, the same spaces were still available which makes it even more frustrating as I wasn’t preventing anybody else from parking.
UK Hotter Than... I’m quite fed up of the national papers having a headline, followed by a dull story about the UK being hotter than... Wherever in Spain or Greece has a lower temperature than the hottest place in the UK. It’s the same every year. They really can’t resist. It really irritates me and I know it probably doesn’t bother anybody else but I just wanted to air my opinion on the matter. Thanks.
Luckily we haven’t had much of a summer this year so people haven’t had to spend too much time down at West Mount beach. I have spotted a few trucks attempting to clear up the ‘Sea Lettuce’ as they call it, but unfortunately the tide just brings it straight back in. The question is, how can we stop this from happening every summer? It’s not just the fact it isn’t a pretty sight but it also stinks.

Clearing Out Your Property?
14
By Stephen Cohu
Chucking your money away?! The task of clearing a property, especially that of a deceased relative or friend or of an elderly relative going into full time care, can at first sight appear an overwhelming one. Don’t despair; there are professionals out there who are more than willing and able to assist you in the task.
The Initial Reaction You open the front door of the house, there is stuff everywhere and most of it looks like junk. It appears nothing has been thrown away since the Occupation. Much of it is dirty or seems to be in poor condition. Often the first thought when tasked with clearing a property is “Where do I start?”. The second thought is often to get in a skip or two and clear out the whole lot without seeking the advice or guidance of someone actually in the business of clearing properties. If you have a water leak you call a plumber, you generally wouldn’t try and fix it yourself. Even if the contents of the property look like rubbish, some valuable items are likely to be present.
The Dos and Don’ts Do not go to the yellow pages and call rubbish clearer. All properties will contain items of value that may be overlooked. Also don’t go around the property like a whirlwind, armed with bin liners and rubbish sacks and just pile everything into the bags just to get the job done as quickly as possible. People are often embarrassed that their relative has been living in a less than tidy property and may have let the condition of the premises go into decline. They are ashamed to let someone inspect the contents before they have helpfully cleared all the rubbish, leaving only the items they thought of value present. Generally what they have done is thrown out all the items of interest or value and kept the low value items to be looked at. Do not dispose of anything until you have had it thoroughly checked by a professional who will be able to identify and assess items of value that many may just overlook. It may well be mostly rubbish that can be disregarded. It is much easier to find items of interest and value if everything is left in situ, just exactly as you found it. Millions of pounds worth of valuables are thrown away every year by people who undertake clearing a property without seeking advice first. Don’t make this mistake.
rummaging around in other people’s junk looking for treasure! You may well have already obtained a valuation of the contents for probate purposes but it is always worth getting a second opinion. Sometimes a professional probate valuation has not been obtained because the Executor believes that nothing of any value is present. If this is the case it is even more important to get the contents looked at before a clearance is undertaken.
Clearing The Property
Once the contents of the property have been assessed and all items of value identified, that is the time to start thinking about undertaking the clearance. The items of higher value can be disposed of, either by being retained by the family or friends, or by being sold to a reputable antiques dealer or through auction. This will leave a large quantity of items remaining, many of which will have some use or value somewhere. If there are antique items of lower value or clean second hand goods, you may be able to get the property cleared for nothing. Where contents Before touching anything, call a reputable professional who have been purchased, house clearance professionals will will be only too happy to look around a property, generally often undertake clearing the entire property for free, for free because there is nothing we enjoy more than effectively exchanging their time and work for the value in
the remaining contents. Where there is a significant quantity of rubbish, this may not be possible due to time costs and dumping charges, especially of non burnable items. Many people undertake clearing a property themselves but in the long run it is usually cheaper and certainly quicker to employ the services of a trusted professional.
The Remainder When clearing a property, environmental and social responsibilities should also be considered. There are many charities that could benefit from the items that would otherwise be thrown away. The contents of a garage or shed will often include tools that could be sent to Africa or Romania. Clean clothing, furniture, bric-abrac and so on could be donated to one of many of the charity shops in the Island, often they will even collect the items for free. Simply incinerating items for which a use can be found elsewhere is not environmentally or socially responsible. Certainly my own company ensures all items that can be salvaged are put to good use resulting in hardly anything being thrown away.

Can We Preempt Delays?
When I joined First Choice a few months back, I had been away from the business for a while, we had been through the “crash” and the banks had tightened their purse strings considerably. Finding a mortgage was difficult, coming up with the increased deposit level was even harder, and everyone involved in the process was more scared of lending than they had ever been. However, that was necessary and is some way behind us now. Lessons have been learnt, and a new era and attitude to lending and borrowing is now with us.
In saying that, have we really moved past being terrified? In the process of the average house sale and purchase, the lender will require a survey of the property, this may take a number of forms, from a valuation survey where fundamentally the lender wants to know that the property is not going to fall down, and if they would get their money back if anything drastic was to befall
the borrower. Then through a more detailed exploration of the property to give both buyer and lender a bit more information, up to a full survey of as many nooks and crannies as the surveyor can reach, plus some.
Each level of survey has its merits for the buyer as well as the lender, and a choice has to be made on a case by case basis as to which one is the most appropriate, there is of course a cost implication to each. With the decision made as to what survey to commission, a surveyor is appointed and the job undertaken. This, through no fault of any particular individual, may take some time to arrange after the offer was accepted and parties inform lawyers. So by the time the surveyor gets their instruction, you may only be days from the intended court date and almost no matter how hard they try, by the time they have scheduled the visit, written up their report and distributed it, the lender has almost no time to consider the
implications of any comments they make, so guess what? We have a delay. OK, there is little we can do about that, but….a little more concerning is that increasingly surveyors are recommending additional reports are produced. This may be for possible damp issues, insect and wood boring issues, asbestos presence, drainage or a number of other factors. If they do find something that raises their suspicions, then they obviously have an obligation to bring it to the attention of the lender and the buyer, but the production of further examination reports by other specialists raises the probability of further delays.
not the basics of damp, insect, HARRY is getting fed up with the summer. He is hot, asbestos and drainage. uncomfortable and not able to I know there are many properties have as many trips to the beach that do not need a great deal of as he likes (not between 10:30 and information provided as they 18:00 anyway). Apart from that, he are relatively new, or have been is looking forward to his holiday in extensively refurbished or similar, the next couple of weeks to some but from talking to the local big open spaces to run around in businesses that are asked to and meeting some new people to provide these reports, they are lick to death! saying they are inundated with the requirement to produce reports Till next month... on properties they would not have been asked to until recently. A service they provided in the past as part of good customer relations for free, has now got them having to consider making a charge as their staff are almost permanently visiting properties carrying out such undertakings. The Occasional visit can be free, regular cannot be sustained by any business for free.
So to my point: Is it time we should consider having the vendor provide basic information, in report format, BEFORE the property is placed on the market? They have a similar system in the UK (TA6), but that is more extensive covering Keep an eye on this space boundary’s and energy efficiency because I think this may among many other things, but run and run for a while.

Networking in Business “This is akin to blaming the washing machine for poor results when you forgot to put the powder in!” The word “Networking” is without doubt an over-used and certainly commonly misunderstood term and there should be no surprise to hear that some people think it is to do with the fishing industry. Actually that’s not too far off the mark if you consider a business networker is perhaps simply “fishing for new business”? There is however an art to doing it well. To ‘network’ means something slightly different for each group of professionals but despite the various thinking, there is in my view a simple first principle: if you seek new work or need new services and you accept the premise that most people prefer to do business with people they like, then you are going to have to become ‘likable’. (If you think you are already there – read on, there’s more!) Having to be likeable is of course not a rule cast in iron, some people have been in successful businesses for years and have been publicly loathed for decades but generally - the supposition holds. To achieve ‘likeability’ you have to find a way for people to get to know you so that all the reasons why you should be liked, trusted and respected can be demonstrated. There are many ways to get to know people. Historically we probably started with invitations to lunch, trade shows, a few drinks after work, organised golf events,
away days, cocktail receptions etc. as its organiser: • Acting like a host and making Today we do all this as well as useful introductions sophisticated conferences with • Demonstrating consideration for speed matching and CQ (Seek others You) satellite driven technology, • Providing useful information LinkedIn promotions to e-meet, • Listening and responding reinvention launches and profile helpfully building presentations, continuous • Following up those promises to professional development events answer questions or provide and sponsored functions (and a further information host of other cool initiatives which • Exercising that ear for humour I don’t understand because I and a sense of humility. flounder even with Facebook and Twitter). You might notice that most of the people we know who display all, The problem most people or many of these attributes, are encounter (and this is why some actually rather likeable in any will fail to network well) is that case. As well as being effective they think just organising the networkers? networking event is enough. You will hear them say for example “I Let’s take these in order and see have arranged 8 events this year how we can improve upon being and hosted over 500 guests but merely an event organiser (which we never got any business – it’s a incidentally is also an art!). waste of time!” and they are right. Of course it is a waste of time if Good hosts do so many things all you merely organise events. This at once and are forever vigilant of is akin to blaming the washing what is going on around whilst machine for poor results when you still paying attention to the forgot to put the powder in! conversation or matter in hand. They are constantly alert and great Actually I would be surprised multitaskers. They remember if merely organising the events names and where they met you. yielded nothing at all but certainly They effect introductions like without the ‘powder’ it won’t be matchmaking was their sole trade very effective. So what’s in the knowing full well how useful it can ‘powder’? be to join two specific people. No There is no magic potion for task is too small nor too great when successful networking events but it comes to making certain your if there was, it would comprise at guests are catered for and content. least some of the following in you It isn’t easy. Who said it was?
This brings us on nicely to consideration for others. This is not just about providing vegetarian options when food is served or meeting visitors at the airport to bring them to your town offices. This is a far more significant area in which to excel, for example – who ever thought to bring along mobile chargers to an end of day reception for visitors from off Island? This is precisely what some of them will really need after a day of meetings in Jersey and no sight of their hotel until later! Not because they will use their mobiles throughout your function but because they need to briefly touch base with children, loved ones and so on. Anything you can do to improve the experience will be appreciated and remembered.
it isn’t easy and we have to focus on getting it right. Those that do; stand out and they get results. And finally… Humour. I have no advice to offer here other than “be yourself ”, every time! If you are naturally amusing then great but never try to entertain. Your hosted guests will always see through it and this will ruin any previous good work. Some people are blessed with cheerful dispositions and possessed of never ending entertaining anecdotes and quips. You will see them at these events holding court with the ease of a seasoned raconteur. That’s all fine but it isn’t the whole story.
So here’s the thing, if you already think you have all these skills flawlessly honed and that you Next, providing useful informa- are indeed ‘most likeable’… are tion. This is tough. What is useful you missing that last ingredient: to one is only fire lighting material humility? to another. So keep it brief, impactful and small in size. Add this to your make-up and - to be fair - you probably do have it Fourth; good networkers probably cracked… spend only 20% of their time talking, they are excellent Words By Vernon Breese listeners. The principle here is simple, if you want to learn about or get know other people - there is little point in you doing the talking. Good listeners have to do a number of things but two are key: listen well enough to actually hear and understand what is being said then respond appropriately and add something interesting. Sounds ridiculously easy doesn’t it? Well, it is as easy as keeping those little promises to follow up or meet later and some of us do fail at this from time to time. Clearly

The New Joiners... Jill Le Brocq
John Medcalf
Geoff Pike
Jill joined Lumiere Wealth in June having previously worked in Retail Banking with NatWest for over 33 years, most recently as a Senior Premium Banking Manager with responsibility for a portfolio of High Net Worth Local Clients.
John joined Lumiere Wealth after nearly 11 years working for RBS International where he held a number of roles including offering financial advice to clients, managing a Sales Team within the Wealth Management Services Department and also acting as Training and Competency Manager.
Geoff brings 17 years of experience from within the Private Medical Insurance (PMI) arena and a wealth of life experience. He started as a PMI Provider and attained the position of National Director at Western Provident Association (WPA) where he managed the Field Services of the UK sales force from 2006 to 2012.
However, it is the creating of individual strategies on all aspects of Financial Planning for Jersey residents and companies that John specialises in and why he has returned to this position. He is committed to providing a personalised service for his clients in order for them to meet their individual objectives.
Geoff started researching Private Medical Insurance in Jersey in 2012. During the time researching the PMI market, Geoff came across several customers who had been on a policy that had not been reviewed in many years, some had a broker that had not reviewed their policy and were paying more in premiums than was necessary! Some people were down still as smokers who had ceased smoking and could have had a lesser premium!
Senior Client Relationship Manager
Although Jill’s primary responsibility was that involving her client’s banking arrangements, her role also involved identifying customers’ investment needs, if appropriate, and subsequent referrals to Wealth Management for investment advice. This part of her role was of great interest to her, ensuring clients received the most appropriate advice in relation to their circumstances and that their needs were met accordingly. Jill saw working at Lumiere Wealth as an opportunity to expand on this. Jill has undertaken the position as Senior Client Relationship Manager and is responsible for the day to day management of existing clients as well as developing new relationships primarily within the local market. She is dedicated to giving a World Class customer service and building long and trusting relationships with clients alongside Lumiere’s Wealth Managers. Jill says “I previously worked very closely with both Chris and John during their time as Financial Advisers at NatWest and RBS International and appreciate their commitment to Customer Service, an approach that also reflects my own approach and am excited at the opportunity to help develop the business.” Jill would welcome the opportunity to meet up with previous clients, who could well benefit from the services of Lumiere Wealth as well as welcoming new clients.
Independent Wealth Manager
John says ‘With so many changes over the past 10 years, it’s sometimes difficult for customers to be aware that policies that were fit and proper for their circumstances 10 years ago may now not be so advantageous. With a number of companies closing their Financial Advice service, effectively discarding their clients, it then becomes even more important for customers to seek the appropriate advice so they are comfortable that their objectives are still being met. The investment, protection and pension world is forever evolving so it’s important that we maintain the principle of putting customers first and this needs to be achieved by working as a partnership with our clients in a disciplined and professional manner.’ John currently holds the Diploma in Financial Planning Qualification and is currently working towards the Private Client and Investment Management qualification with the Chartered Institute for Securities and Investment.
Private Medical Insurance Specialist
Geoff ’s traditional values always put the client’s needs to the forefront of his exceptional service, constantly seeking to find the best solution for the individual and corporate policies. Now with the opportunity to review the whole PMI market Geoff can offer the best value PMI / CASH PLANS / DENTAL PLANS to maximise the benefits for his customer. Since 2012 Geoff ’s new business is usually referred from customers who recommend him to their personal friends and corporate colleagues. Geoff also works with great flexibility meeting customers at times and locations that suit them best. Each year a review is done on the market to make sure the best policy at an affordable amount is achieved.

The Importance of Networking by Claire Boscq-Scott #TheBQB
Networking with Confidence
“
“
The key to talking to new people is finding something you have in common.
Contrary to common belief, no one person is born with a lack of self-confidence. However, some people have, over time, lost their self-confidence.
A child might fall hundreds of times before he or she learns how to walk properly. In order to gain self-confidence again you must be open to the idea of rebuilding your confidence and the best way to do this is to start one step at a time.
Confidence, admittedly, isn’t always easy to summon; especially when you’re trying to network with strangers. You want to banish those butterflies and remove fear? You must remember that people are only people.
Most of us will stick within our comfort zone even though, in the back of our minds, we know that it is limiting us severely. So, networking with confidence is like taking baby steps. Why not start by going to an event with friends or colleagues and
see how you get on. You might be surprised and make sure you pat yourself on the back for having the courage to go in the first place. Build on your newfound confidence by attending yet another event, but this time on your own, without colleagues or friends. Once you’ve managed to walk into a room of strangers, introduce yourself and talk confidently about what it is that you do, you will have made big steps in successfully rebuilding your confidence again.
The key to talking to new people is finding something you have in common. For example, if you were in Jersey and sat on the bus with someone next to you that you didn’t know, you are most likely not to speak with them. But if you were on holiday in Paris and sat next to someone wearing an “I love Jersey” t-shirt, you would most likely strike up a conversation with them because you have a common interest, and will suddenly become your best friend! So, when you are in an environment in which you
“If you exude confidence, people will be drawn to you not the other way around.”
don’t feel comfortable, look for something you can share with the people around you; find a common ground.
Being confident is also about being you. I am one of those people who would like to please everyone. I want everyone to like me, but I have come to realise that this cannot happen. I can try to please everyone, but I will never succeed because not everyone is the same. Some people simply can’t be pleased no matter what you do. But
the important thing is, whatever happens, you stick to who you are and to what your values are and what you believe in. The things that you say and do are a reflection of who you are; authenticity matters. You have to say and do the things in which you actually believe because these are symbols of who you are really. If you do this then you will build your tribe and surround yourself with people who believe in what you believe; these people will also help build your confidence.
If you exude confidence, people will be drawn to you - not the other way around. When you put yourself out there with confidence, each of your efforts will be more effective because your aura says: “Hey, I’m worth something. I mean business here. I have something important to say, I’m worth listening to, come and listen to me”.

34 jobs going at Santander Private Bank in Jersey Santander Private Bank in Jersey has announced it is cutting 34 jobs, following the recent restructuring of Santander's operations on the island. It means the current workforce of 102 will be reduced to 68. The bank said that says some employees will have 'their job roles matched in the proposed new structure however, as the number of roles has reduced, this may lead to a number of redundancies.'

Recruitment and Employment Law – What’s the deal? Jersey has been making strong strides in the legislation tables lately… Employment Law has been amended to include Maternity, Paternity and Flexible Working rights. 2014 saw the introduction of Discrimination Law (Jersey) 2013, a landmark occasion for the Island which previously had no legislation to deal with discrimination in the workplace or otherwise. But it doesn’t stop there, the 1st September will see secondary protective characteristics come into play and the expectation is that year on year more will follow. JACS reported that in 2013, 22 clients were recorded with discrimination related issues and a whopping 89 in relation to maternity.
treatment’, as a business, you could be at risk of complaint. The big discussion point at present is ‘Office Banter’ and there are very many different views on this. I read last week that the culture of office banter could ‘be used as a defence’ for employers that have always existed under that culture. Others say, no more, it’s too risky. My personal opinion is that where some banter can be friendly and create a ‘fun’ working environment, it is important that the difference between fun and discriminatory is understood. This is where we need to remember that the perception of the subject is largely taken into account. To that end, I would be greatly surprised if the defence of office banter is passed when someone had suffered discomfort.
The new legislation created a buzz of media hype, a newspaper headline in 2013 predicted that ‘’Discrimination laws could cripple firms’’ and the general consensus Maternity legislation, Parental rights and from those reading that article was they were Flexible working create another obstacle for employers who now have several pages of right. legislation to work with when managing a So my question is – what impact does request. It is this ‘increased paperwork’ that often causes the problem, especially for recruiting strategies. small businesses. The age old saying goes ‘if you are not doing anything wrong, then you have nothing The impact of this is likely to be less to worry about’ of course, it is entirely recruiting, specifically for the small to plausible that, as a business, you may medium sized business. Discrimination Law genuinely not be aware that you are in employment covers everything from stage operating in the grey and this is where so one advertising to the employees working many get caught out. “I read last week that the culture of office banter could ‘be used as a defence’ for employers that have always existed under that culture.”
In a recent market research report (UK based, however Jersey has a close alignment with UK employment Legislation) ran by Citrus HR some staggering stats came to light. It showed that of all businesses surveyed: • 39% said they would take on more staff if employment law was made simpler • 25% said it was unacceptable in its current state • 75% of businesses said it is draining to keep up with current legislation The resounding consensus from this report was that businesses are not the happiest, worst affected are the small to medium size businesses we should be encouraging to grow, but instead are averse to recruiting at present and this is having an overall impact on the job market. Where larger organisations often count on the in-house HR function, smaller organisations lack this support which now makes employment a tricky area to tackle for anyone who is not up-to-date with employer responsibilities. For recruitment agencies I predict minimal change, the pre-selection process for any position is largely driven by employer statements which, so long as they do
not fall foul of the discrimination law, can be adhered to. We are stronger together.
