Will’s triple challenge for Brighter Futures

Local man Will Le Quelenec has set himself three personal challenges in aid of Brighter Futures. The first was the 25 mile Guernsey Round Island rowing race that took place last month on Saturday 10th August. He also aims to complete the Jersey Round Island rowing race in September and the Jersey Marathon in October. But he isn’t doing it completely alone. His mother Frankie, who has been rowing for over 20 years, will be joining him as part of the mixed pairs category in the two races. Will, who is 23, has only been rowing for 2 years but has already completed the Sark to Jersey race in July coming in 15th out of 50 boats. This was a 16 and half-mile race. Will and Frankie were the first mother and son pair to ever complete the race. Will is hoping to raise between £2500 – £3000 in sponsorship. He says “I really want to make a difference to at least one family so I am hoping to raise more than £2500, which is what

it costs to support one family on the Brighter Futures programme for one year”. It isn’t going to be an easy challenge as Will has never attempted a round island race before. He won’t be using his own boat for the Guernsey race either as that will remain in Jersey. On top of that he only started running this year, which will make his marathon run something of a personal achievement. Will originally visited Brighter Futures as part of a Community Day in his previous employment and helped with painting the outdoor furniture that was in dire need of attention. “After I visited The Bridge and saw the fantastic work that the Brighter Futures staff were doing with the families I decided I wanted to do something meaningful for the charity. Equiom passes inspection for ‘Seafarer Recruitment and Placement Agency’ Equiom Marine and Aviation Services (Jersey) Limited (EMAS) is delighted to announce that the company recently passed the Lloyds Inspection for Seafarer Recruitment and Placement. Charing Cross planning application refused The Co-op application to develop its Charing Cross site has been refused by the Planning Applications Panel. The Co-op applied to demolish its Charing Cross site, retain two of the six listed buildings, and construct a four-storey building comprising of retail units, office space on the ground floor, basement parking, with office and residential accommodation above. An earlier proposal to demolish all the listed buildings was withdrawn in June, before it was due to be reviewed by the Planning Applications Panel. The Co-op subsequently submitted a revised proposal retaining two of the six listed buildings, 5 and 6 Pitt Street, commonly known as the Foote buildings. Principal Planner, John Nicholson, said: “We would like to see this site regenerated, particularly the neglected and dilapidated buildings on Pitt Street and Dumaresq Street. While the latest scheme retained 2 of the listed buildings and would have delivered tangible benefits to the

town centre, the proposal conflicts with policies which seek to preserve and protect listed buildings. The Panel considered too much of the heritage was being taken in this scheme.” The Planning Department had recommended refusal of the application to the Planning Applications Panel following full consideration of the latest scheme and comments received from the public and interested groups. The Island Plan, adopted by the States in 2011, seeks to protect the Island’s natural and historic environment, including historic buildings, structures and places, which contribute to and define its unique character and identify. The panel considered that, taken as a whole, the group of listed buildings on this site provides perhaps the best surviving example of early-mid 18th century townscape in St Helier, as well as demonstrating the change of style and scale of urban building which took place in the early 19th century.

A tall ship designed and built to enable people of all physical abilities to sail side by side as equals is coming to Jersey. Tenacious will be docked in Pontoon 5 and open to the public from 2pm to 4pm on Saturday 14 September. The afternoon has been organised to appeal to families – children will be able to see what it would be like on board a pirate’s ship with treasure and stocks. As well as looking around, Islanders will be able to find out how they can sign up to become crew. Tenacious and Lord Nelson, the world’s only two tall ships designed to have a crew of mixed physical ability, are both owned and operated by the Jubilee Sailing Trust. The trust’s mission is: •to overcome prejudices and misconceptions about disability amongst able-bodied people • to enable people with a disability to show to themselves and to others what they are really capable of when the environment is designed to be inclusive. The Jersey Branch raises money to enable the charity to continue and to encourage islanders of all physical abilities to get involved Tom Hill, chairman of the trust’s Jersey branch, said: “We hope that people come along, donate a little money and have a great

look around, but we also hope to inspire people to think about becoming crew. “Thanks to the fantastic financial support that we receive, particularly from the Lloyds TSB Foundation for the Channel Islands, we are able to help Islanders become crew on voyages that are lifechanging experiences for many people. I hope that people come along and talk to us about how they can get involved.” The Jersey branch of the charity was involved in raising a significant proportion of the funds needed to deck out Tenacious when she was first built, and continues to raise funds to support the charity and Islanders who want to sail. The Lloyds TSB Foundation is legally independent of the Lloyds TSB Group and an independent board of trustees determines the policies. The Chairman of the local foundation is Jurat Stephen Jones and the Executive Director is John Hutchins. Mr Hutchins said: “I hope that people of all physical abilities are inspired to get involved. The Jubilee Sailing Trust gives people an opportunity to do something extraordinary, and I am delighted that the Lloyds TSB Foundation for the Channel Islands can help people take a step towards achieving that.”

First UK tour of Tony Award-winning musical comedy ‘Spelling Bee’ to visit Jersey

Darren Day and Niki Evans are set to star in the first UK tour of William Finn’s Tony Award-winning musical comedy – ‘The 25th Annual Putnam County Spelling Bee’, which plays at the Opera House, St Helier on 24-26 October. ‘Spelling Bee’ is a musical comedy that centres on the lives of six quirky adolescents who have entered into the ‘Bee’, a competition that asks the contestants to spell a variety of words, usually with a broad degree of difficulty, which is run by three equally as quirky grown-ups. Clear guidelines will make zero hour contracts more effective, says Collas Crill employment specialist Channel Island employers should consider introducing clearer guidelines on zero hours contracts to ensure they work effectively for both employers and employees says a Guernsey employment law specialist. A recent Chartered Institute of Personnel Development survey suggested that almost one in five UK employers retained staff on zero-hour contracts. Collas Crill’s Emma Parr said: “Zero-hour contracts are typically drafted to maximise flexibility for the employee and the employer. Used appropriately, zero-hour contracts are an efficient way for employers to manage their staff and time respectively.” But they are also open to exploitation, she says. “Worryingly, an increasing number of employers have jumped onto the zero hours bandwagon. Some critics feel that the use of zero-hour contracts is simply just another way of re-classifying the unemployed and adjusting the unemployment statistics. The insecurity and lack of stability is just too

much worry for some and prevents ordinary people from being able to plan for the future and there has also been recent debate surrounding the rates of pay. “But the are disadvantages in zero hours contracts for employers, too – they must consider at what point a zero-hour contract begins to entitle the employee to more than just the option to work. For example, when does an employer become legally or contractually responsible for the employee in terms of health care, maternity, sick leave and holiday entitlement; all of the usual entitlements that most employees take for granted?” In response to calls across the Channel Islands for an abolition of zero hours contracts entirely, to remove the potential for their abuse, Emma said: “I believe the trade unions and politicians in Guernsey and Jersey should concentrate on making the present situation clearer rather than undo it altogether.”


Long-term care scheme published The Minister for Social Security has published a report on the new scheme that will help support people with the cost of care delivered in their own home or in a care home. Subject to States approval, the new long-term care scheme will start in July 2014. The Minister for Social Security, Senator Francis Le Gresley, said: “I am pleased to set out in detail how the new long-term care scheme will work. This scheme will particularly help people who currently face having to pay for all or much of their care themselves. Such costs can run into thousands of pounds a month, especially hitting hardworking Jersey families who have bought their own home, been careful with their finances and are looking to pass something on to family members. ” Under the proposed arrangements, Islanders will be protected in two ways: A £50,000 cap on the level of lifetime care costs. This “care costs cap” of £50,000 will protect people who stay in care for a long time from bearing care costs that can run into hundreds of thousands of pounds. Once someone reaches the cap, they will receive the new long-term care benefit. Assets of £419,000 will be exempt from any means-testing calculation so that many more people will be able to access means-tested support to help pay their care fees. For many people this means that the value of the family home will be taken out of the equation altogether, while for those living in highervalue properties a major proportion of the value will be secure. Non-homeowners with high levels of savings will also benefit because the same asset disregard will apply to them. Aside from the costs of care, fees levied by care homes include the costs of accommodation and other day to day living costs. Those people living in a care home will be expected to make a co-payment of at least £300 a week towards these costs. Those receiving care in their own home will already be covering these living costs and will continue to do so and therefore will not need to pay the co-payment. Meanstested support will be available for those who need help with the copayment. As far as possible, people with long-term care needs will be able to choose whether they have the care delivered at home or in a care home. The Minister for Social Security also commented: “Since my previous statement in June, I’ve held discussions with ministerial colleagues and have received a detailed report from the Economic Advisor. With the support of the Treasury

and Resources Minister and Chief Minister, I am now pleased to announce that additional funding for the scheme in 2014 and 2015 will come from existing States resources. This allows the benefit to be launched in July 2014 as planned, while acknowledging the challenging economic times that the Island still faces. “From January 2015, Islanders will pay a new long-term care contribution of 0.5% of their taxable income into a ring-fenced long-term care fund. In 2016 this contribution will be set at 1%. The intention is to keep it at this level for at least three years.” ”I believe that these proposals share the responsibility for care costs fairly between individuals who are receiving care and the wider community. The scheme I am proposing is based on firm financial principles and will be sustainable into the future, balancing the benefits it provides for those who need care against the costs it imposes on the population as a whole.” The Chief Minister, Senator Ian Gorst, who as Social Security Minister took the framework long-term care law through the States in July 2011, welcomed the proposals:”I think the proposals offer a workable, enduring and affordable solution to the challenge of an ageing population and rising long-term care costs. These proposals make the financial aspects of moving into care more certain and less worrying for families. At the same time I know that people wish to remain in their own home for as long as possible and the scheme will encourage this.” In supporting the scheme, the Treasury and Resources Minister, Senator Philip Ozouf, said: “I recognise the importance of this scheme to Islanders and the Treasury is therefore making available resources so it can start as planned next year. Reallocating existing Social Security budgets avoids the need to introduce a 1% contribution in 2014 and prevents money being taken out of the economy whilst it is still under pressure. This is a significant new scheme for the Island and we will undertake a full actuarial review at the end of 2016 to ensure that both contributions and benefits are set at sustainable levels. ” The Minister for Health and Social Services, Deputy Anne Pryke, also backed the scheme. She said: ”These plans dovetail well with the proposals in our ‘Caring for each other…caring for ourselves’ White Paper in supporting people to remain independent in their own homes and within the community.” The existing Income Support residential care scheme will continue while these new arrangements are being put in place.

Awards keep rolling in for Town Park A plaque has been erected in the Millennium Town Park to mark the winning of a Civic Trust Award for 2013. Civic Trust awards are given to projects that make an outstanding contribution to the quality and appearance of the environment. The Town Park was one of 263 national and international entries, with 86 projects being recognised for commendation. Health and Safety at Work (Jersey) Law, 1989. Consultation on Safety in the Use of Machinery Approved Code of Practice Senator Francis Le Gresley, Minister for Social Security, intends to give approval to a new Code of Practice on Safety in the Use of Machinery, under Article 10 of the Health and Safety at Work (Jersey) Law, 1989. The Approved Code of Practice (ACoP) will apply to all machinery used in the Aworkplace, with the exception of woodworking machinery which was the subject of ACoP 9, The Safe Use of Woodworking Machinery. The use of machinery at work can give rise to a number of risks to health and safety which should be considered at all stages in the life of a machine, from its manufacture, commissioning, installation and use in the workplace, through to its eventual disposal and dismantling. General legal duties, which cover the safety of machinery, are set out in Part 2 of the Health and Safety at Work (Jersey) Law, 1989, but it is recognised that the existing prescriptive Regulations for the safety of machinery, the Safeguarding of Workers (Machinery and Woodworking Machines)(Jersey) Regulations, 1967, are outdated and do not reflect current standards. It is intended that the introduction of

the new ACoP, together with ACoP 9, will enable the revocation of these Regulations. An ACoP has a special legal status and is admissible in legal proceedings under the Health and Safety at Work (Jersey) Law, 1989, and health and safety Regulations. The Court may regard an ACoP as evidence of what is known about a hazard, risk or control and rely on the ACoP in determining whether the requirements of the Law and Regulations have been met in the circumstances to which the ACoP relates. Compliance with the Law may be achieved by following an alternative method, such as a technical or industry standard, if it provides an equivalent or higher standard of health and safety than the ACoP. The Minister has a duty to consult with such persons as he considers will be affected, or representatives of such persons, before he formally approves and issues Codes of Practice made under Article 10. Comments are therefore being sought on the draft ACoP. We are seeking views on the complete publication, i.e. the manner in which the publication is struc-

tured and the advice that is provided. We would welcome comments on these proposals which should be received by the Health and Safety at Work Inspectorate, either in writing or by e-mail to hsi@ gov.je no later than Friday 29th November, 2013. Olivier Award-winning actor Adrian Lester (Henry V at the National Theatre, BBC’s Hustle) takes the title role. Playing opposite him as the duplicitous Iago is fellow Olivier Award-winner Rory Kinnear (The Last of the Haussmans, James Bond: Skyfall), who is reunited with director Nicholas Hytner (Timon of Athens, One Man, Two Guvnors) following their acclaimed collaboration on the National Theatre’s recent production of Hamlet. Othello, newly married to Desdemona – who is half his age – is appointed leader of a major military operation. Iago, passed over for promotion by Othello in favour of the young Cassio, persuades Othello that Cassio and Desdemona are having an affair.

The Grouville Autumn Fayre takes place at Les Prés Manor, the wonderful ancient manor farm located deep in Grouville. International Air Display

The skies above Jersey come alive today to the sights and sounds of arguably one of the largest free air displays in Europe. Spice ‘Treasures & Trade’

This fantastic event will bring together a variety of local artists & craft workers from the Channel Islands, featuring musicians and therapists all within the unique setting of hand made Mongolian Yurts. Talented artisans will be creating and selling their work and offering exciting workshops for all ages. Genuine Jersey caterers and authentic food and entertainment for kids will also be featured. Les Prairies Horse Trials

A new addition to the Jersey equestrian events calendar, Les Prairies Horse Trials has been designed to showcase the best of Jersey’s riders and horses. Spectators will be able to view all aspects of the competition across the weekend and will have full access to the ‘Event Village’ comprising of an array of caterers, crafts stands, Genuine Jersey produce and family entertainment including face painting, pony rides and our acoustic stage. Jersey cocktail whizzes, Rojos, will be catering for our VIP ticket holders, bringing with them their famous ‘Cube’ that will be situated overlooking the most exciting of our cross country fences; the V&V Builders Water Jump. All monies raised from the event will go directly to Jersey Hospice Care, assisting in their on-going work providing specialist palliative nursing service, free of charge, for patients with cancer and motor neurone disease. Weekend tickets are also available at a cost of £7 for adults, £4 for children and £18 for a family. VIP tickets range from £50 - £135. Helier Morris Men

Come along to the park to see the Helier Morris Men dance, Britain’s most southerly Morris dancing side.
