NOTICE OF MOTION PLEASE TAKE NOTICE that the applicants intend to apply to the Constitutional Court for direct access, as a Pauperis Propria Persona / Litigant in Person; for a [I] writ of Habeus Mentem [A] and [II] writ of Certiorari/Review [B]-[E]:

[I] WRIT OF HABEUS MENTEM: [A]

A writ of Habeus Mentem – the right of a wo/man to their own mind and culture -- is invoked in accordance with the Constitutional rights to invoking1 cultural law2 in S. 15

1 Ex parte Minister of Native Affairs: In re Yako v Beyi 1948 (1) SA 388 (A) at 397: Appellate Division held that neither common nor customary law was prima facie applicable. Courts had to consider all the circumstances of a case, and, without any preconceived view about the applicability of one or other legal system, select the appropriate law on the basis of its inquiry. 2 SALC, Sept 1999: Report on Conflicts of law: P.22: ‘1.58. The Constitution now provides an entitlement for invoking customary law in legal suits. Because ss 30 and 31 specifically guarantee an individual and a group's right to pursue a culture of choice, it could be argued that application of customary law has become a constitutional right. Previously, the state had assumed complete discretion in deciding whether and to what extent customary law should be recognized, an attitude typical of colonial thinking, for Africans were subject to


(3), 30, 31, and 185, and psychological integrity in Section 12; the former which may require the application of choice of law rules. NOTE ON HABEUS MENTEM: The title of the writ -- Habeus Mentem - is borrowed from Aldous Huxley’s A Brave New World Revisited; where he describes the insidious conspiracy to manipulate the masses by propaganda and lies, so as to make them controllable under the “steadily increasing pressures of over-population and of the over-organization imposed by growing numbers and advancing technology” It is perfectly possible for a man to be out of prison, and yet not free -- to be under no physical constraint and yet to be a psychological captive, compelled to think, feel and act as the representatives of the national State, or of some private interest within the nation, want him to think, feel and act. There will never be such a thing as a writ of habeas mentem; for no sheriff or jailer can bring an illegally imprisoned mind into court, and no person whose mind had been made captive by the methods outlined in earlier articles would be in a position to complain of his captivity. The nature of psychological compulsion is such that those who act under constraint remain under the impression that they are acting on their own initiative. The victim of mind-manipulation does not know that he is a victim. To him, the walls of his prison are invisible, and he believes himself to be free. That he is not free is apparent only to other people. His servitude is strictly objective.

[II] A WRIT OF CERTIORARI / REVIEW OF: [B]

South African Press Council and SA Press Appeals Panel (SAPAP) [1] lack of transparent administrative decision-making, and secrecy of complaints statistics; [2] 24 June 2009 ruling by Ombudsman: Joe Thloloe, [3] 11 October, 3 and 4 November 2010 rulings by Deputy Ombudsman: Johan Retief, and [4] 17 and 24 November 2010 rulings by SA Press Appeals Panel Judge Ralph Zulman; and

SA Media and Journalists Respondents (“SA Media”) endorse: (a) Media Corruption and legal, political and cultural persecution of minorities, and (b) Media “Rainbow-Rule-ofLaw3 Reasonableness4” Intellectual Incompetence5; and preference for propaganda

whatever policies the conquering state chose to impose on them. Now, however, the state has a duty to allow people to participate in the culture they choose, implicit in this duty is a responsibility to uphold the institutions on which that culture is based.’ 3 In Bolam v. Friern Hospital Management Committee , Judge McNair’s judgement dealt with the application of the common law reasonableness test in regards to negligence, where the ‘reasonableness test’ circumstance involved a special skill or competence. 4 In Affidavit of Brad Blanton, Ph.D, evidencing the legal, psychological, and socio-political ‘citizens privilege’, Nuremberg Principles skills and competencies of Individual Responsibility, required for acts of civil disobedience to perceived illegitimate authority; and their application to the common law ‘reasonableness test’ filed as Expert Witness Affidavit in High Court, W.C. # 19963-09; Dr. Blanton explains what happens in cultures of ideological obedience; how and why studies show that 92% of citizens lack the psychological and emotional – sincere forgiveness -- skills for non-violent disobedience. In Practicing Radical Honesty, Dr. Blanton describes the importance of sincere forgiveness to changing the statistics of the Stanley Milgram studies of Obedience, which proved that 92% of humans are as culturally, racially, ideologically or religiously obedient, and unquestioning to their beliefs as Adolf Eichmann was to Nazism. In a clash between their ideology and scientific evidentiary truth, their obedience to their ideology, causes them to consign the truth to the collateral damage refuse bin. Individuals who practice sincere forgiveness, and who are not obedient to ideology, but to scientific truth, always side in favour of scientific truth. 5 Put simply the Dunning & Kruger effect “is a cognitive bias in which an unskilled person makes poor decisions and reaches erroneous conclusions, but their incompetence denies them the metacognitive ability to realize their mistakes.”

Michael Maher’s study: How and Why Journalists Avoid Population – Environment connection8; and Dr. Brad Blanton’s Radical Honesty About Anger and Forgiveness9 expert witness affidavit as to how sincere forgiveness vs fake forgiveness affects the common law ‘reasonable reader’; as per orders applied for as set out below.

First and Second Respondent are members of the Radical Honesty culture11, who provided Respondents with the opportunity to resolve these matters, out of court, upon the Truth and Forgiveness Social Contract: Being Specific About Anger and Forgiveness12; as excerpted from: Practicing Radical Honesty13.

Radical Honesty SA is founded on Radical Honesty Social Contract and Ecolaw14 principles: (a) A psychological integrity environment of philosophical courageous truth searching honesty and sincere forgiveness is a sine qua non15 for healthy, transparent relationships that result in the co-creation of a code of conduct that enables non-violent honest sincere resolutions to disagreements;

(b) A healthy

ecological environment, with due regard for carrying capacity laws of sustainability is a sine qua non16 for all other constitutional rights17. [d]

Radical Honesty SA’s working hypothesis: First to Eighty-Eighth Respondents are imprisoned in their minds distorted and only partly conscious maps, but who are too psychologically incompetently unconscious – Dunning and Kruger Effect18 - to be aware of their mind-slavery. They are mind enslaved/imprisoned by their fragile ego’s, which are under the false impression that they act on their own initiative, but who are emotional and psychological slaves to their suppressed anger, resentments and politically correct ideologies. Their minds maps of reality are distorted by their repressed anger and resentment, their fake forgiveness and fake relationships, marketing character19 shame20; the greater the amount of suppressed anger, resentments and sincerity, the greater their distorted view of reality. Honesty SA invites all respondents to liberate themselves from their Flat Earth intellectual, psychological and legal ego prisons of political correctness and denial. [e]

Radical Honesty SA definitions of the word ‘Kaffir’, relevant to this matter: [i] ‘Kaffir Behaviour’: Cultural Beliefs and Procreation Behaviour Definition: Individuals who either independently or as a result of their cultural value systems, are incapable of, or unwilling to, practice sexual restraint and procreation responsibility; who consequently breed cockroach-prolifically without personal financial or psychological responsibility to, or emotional concern for, their offspring; and/or who abuse women and children as sexual or economic slaves procreated for such purpose; and/or whose cultural ideal of manhood endorses non-consensual sex (rape) as their sexual slavery entitlement, etc. [ii] ‘Kaffir Etymology’: Original Etymological Definition for ‘Kaffir’: The word kāfir is the active participle of the Semitic root K-F-R “to cover”. As a preIslamic term it described farmers burying seeds in the ground, covering them with soil while planting; as they till the earth and “cover up” the seeds; which is why earth tillers are referred to as “Kuffar.” Thus, the word kāfir implies the meaning “a person who hides or covers”; To conceal, deny, hide or cover the truth. [iii] ‘Kaffir Legislation’ = Inalienable Right to Breed’ Poverty, Misery and War legislation; pretending it advocates for ‘peace’ and ‘human rights’. Kaffir Law/Legislation provides citizens with the Inalienable ‘Right to Breed’, but demands that Citizens need a Licence to Own a Gun, a Licence to Drive a Car, a Licence to Practice Law, a television licence, a credit licence, a licence to earn a living, a university exemption licence, a licence to fish, a licence to hunt, a liquor licence, a business licence, a marriage licence, etc, etc. Kaffir Legislation covers up that an ‘Inalienable Right to Breed/laissez-faire birth control policy + No Social Welfare policies or practices provides for an equilibrium carrying capacity; whereas Inalienable Right to Breed/laissez-faire birth control within a welfare state, results in Runaway Growth, and ultimately greater misery, poverty and war21.

[“SANEF SECRECY” REVIEW] A Review of SANEF established SA Press Council and SA Press Appeals Panel administrative procedures, in regards to commitment to transparency, accurate record keeping, scientific journalism and public accountability. 1.

That the SA Press Council is ordered to (A) provide the following documentation to the Constitutional Court, in these proceedings: A.

The Names of all Complainants whose complaints were dismissed by the Ombudsman, prior to any hearing or negotiation with publications; i.e. where the Ombudsman refused to accept their complaint for hearing, for whatever reason, in the following format: a.

Complainants One page summary of their complaint

b.

Ombudsman’s written reasons for dismissal of complaint, without any hearing

c.

If the Ombudsman required the complainant to file a written waiver, prior to informing the complainant of the Ombudsman’s refusal of their complaint; such written waiver.

d.

Where such waiver was required by the Ombudsman, prior to the denial of any hearing, the SA Press Council’s written notification to such complainants that their waiver has been declared null and void by the Press Council, as a result of the refusal by the Ombudsman to provide the complainant with a hearing, regarding their complaint.

B.

The names of all Complainants who filed Applications for Appeal and/or Review to the Press Appeals Panel, whose applications were denied, prior to any Appeal/Review hearing, in the following format: a.

The Complainants Application for Appeal/Review;

b.

The Press Appeals Panel Decision denying the Application for Appeal/Review.

2.

If an impartial analysis of such statistics demonstrates that common SA citizens, who are not members of the SA elite, receive arbitrary, vague, and grossly irregular biased decision making by the Press Ombudsman in favour of SANEF editors and publications; to issue an advisory ruling in support of the establishment of an Impartial Media Appeals Tribunal which conducts its decisionmaking transparently and impartially, in the public interest of all;

Alternatively to [2], to issue an order:


A.

Requiring the Press Council to give all complainants a reference case number; and that all Ombudsman decisions and Press Appeals Panel rulings include reference to such case number.

B.

Requiring the Press Council to publicize the information about all cases filed with the Press Council, including all cases refused a hearing by the Ombudsman, and/or refused appeals by the Press Council Appeals Panel (for past and future decisions), to be made publicly and transparently available on the Press Council website.

In addition to [2] and [3], to issue an advisory ruling, with expert witness input from Wikileaks and/or OpenLeaks ‘scientific journalism’ experts, in support of a clear classification system of ‘media corporations’; similar to Hotel Star Ratings and Smoking Label warnings. For example: (a) Three Star Media Corporations practice unbiased and politically incorrect scientific journalism; (b) Two Star media corporations practice left or right ideological propaganda when it contradicts scientific journalism truths, and withhold from their readers access to the original documents they are reporting their bias upon; (c) One Star gutter yellow smear propaganda journalism, which has no interest whatsoever in scientific truthful reporting, only profiting from spreading gossip and malice. All media corporations are required to publish their ‘scientific journalism’ hierarchical star status, in a designated space on their front page, clarifying their Star Status, and what that start status means regarding the scientific journalism or not quality of factual information being sold to the reader.

[“SAPA LIES” REVIEW] Review of Press Ombudsman: Joe Thloloe’s ruling22, dated 24 June 2009 denying Johnstone’s complaints23, filed with the SA Press Ombudsman on 11 and 17 June 2009; and issuing the following Orders: 1.

That Ombudsman Thloloe’s denial of Johnstone’s complaint was grossly irregular.

2.

That SAPA’s article fits the Press Code of Conduct description of “serious critical reportage”, which requires that the newspaper should seek the views of the subject; which SAPA did not do; thereby violating the Press Code of Professional Conduct 1.5;

Furthermore when SAPA was subsequently provided with the views of Johnstone, including evidentiary information contradicting SAPA’s report; SAPA refused to make an impartial enquiry or to publish Johnstone’s perspective on the subject; thereby again violating the Press Code of Professional Conduct 1.5 and additionally 1.1, 1.2, 1.3, 1.4 and 1.6.

In the absence of SAPA providing the court with evidence for their statements presented to readers as alleged facts of an alleged ‘legal arrest’ and the evidence for the ‘alleged referral for psychiatric observation’ in their report: Woman defies Court over Rude De Lille SMS’s24, SAPA is required to publish the following corrections: A.

SAPA were informed in Request to SAPA: News Article: 19 July 2007: (II) and Honourable Transparency RSA Media Enquiry25, dated 05 June 2009, of the following information, with a request to SAPA to correct the errors in the original article; that: a.

Johnstone was illegally arrested by SAPS Inspector Christian on 18 July 2007, in the absence of any legal valid arrest warrant.

b.

SAPS Inspector Christian lied to Johnstone implying that there were two alleged outstanding arrest warrants, one in Pietermaritzburg and one in Port Elizabeth, which he refused to provide Johnstone with a copy of, to this day.

B.

Johnstone was coerced and forced by the SAPS to see Dr. Theo Dahms. Dr. Theo Dahms refused to provide Johnstone with any of the following documentation, justifying his alleged legal authority to demand she answer any of his questions or the SAPS legal authority to detain her against her will: a.

a copy of the alleged valid arrest warrant authorising her alleged legal arrest on 18 July 2007, and consequent detention;

b.

a copy of any valid documentary evidence proving that she had been legally referred to his office, to answer any questions in accordance to required statutory requirements S 77 – 79 of the Criminal Procedure Act (Accused: Capacity to Understand Proceedings: Mental Illness and Criminal Responsibility) and/or the Criminal Matters Amendment Act, No 68 of 1998; and

the required statute that granted Dr. Theo Dahms supreme rule-of-law authority to nullify an accused’s constitutional rights to remain silent, or to refuse to answer questions; granting Dr. Dahms the authority to institutionalize anyone who insists on their constitutional rights as (i) unworthy of such constitutional rights and (ii) worthy of referral for psychological observation.

C.

Johnstone filed a complaint with the National Prosecuting Authority Senior Prosecutor Jacobs [2008-12-28: For the Record: State v. Johnstone: ‘Crimen Injuria’: Incomplete Further Particulars26], wherein she requested the Prosecutor’s Office to provide the alleged legal arrest warrant and the alleged psychological referral documentation; the court irregularly and illegally ignored Johnstone’s complaint.

D.

Neither the SAPS, nor the National Prosecuting Authority, nor the court, nor SAPA, have ever provided any evidence that Johnstone was legally arrested on 18 July 2007, with a valid arrest warrant, or that any legal or valid psychological referral proceedings were ever instigated against Johnstone on 19 July 2007, or at any other time, ever.
