W

ow—what a party! Was it the massive ice sculpture that set the tone for this year’s Christmas Holiday Party? Or maybe it was the photo booth where facial expressions and poses became a form of amusement all by itself? Or maybe it was the Blues Monsters rockin’ the ballroom for two hours after dinner and awards? What ever it was, the party and show delivered a good time as promised.

Dinner reservations the week before the party were at 297 and by the time the party got underway on December 7, 336 dinner reservations had been made. The tables were decked out with wine and goodies from generous sponsors, the silent auction items yielded bargains galore, and the live auction was entertaining not only for the lively floor bidding but also due to the voice-activated “flashing lights” on Auctioneer Josh Root’s hat!

Big thanks to PrimeSource Building Products and USP for their generous title sponsorship of this event. As fundraisers go, this was a huge success. Profitable fundraisers help keep dues low. New California Building Codes

C

alifornia is presently in the process of conducting public hearings, drafting and adopting the 2013 set of Title 24 building codes. These new codes will become effective on January 1, 2014. They are scheduled for publication on July 1, 2013.

Specifically, the 2013 California Energy Code will cause buildings to become more energy efficient. California is on track to require zero net energy usage homes by 2020. The 2013 code will cause new buildings to be approximately 30% more energy efficient than the current code. Some significant new residential energy requirements in our climate zone (16) include the following. z New building energy forms will be registered with the California Energy Commission via a web server. CF-1R forms will be uploaded to the HERS provider for registration and signatures. z For new residential buildings, the prescriptive glazing U factor will be reduced from 0.40 to 0.32. The prescriptive maximum solar heat gain coefficient (SHGC) will be 0.25. The prescriptive maximum west area glazing will be 5%. Both the SHGC and west area glazing prescriptive requirements will be new with this code. For additions and alterations where the amount of new glazing is less than 75 square feet, the maximum U factor will be 0.40 and SHGC is 0.35.

z Mandatory ceiling insulation increases from R-19 to R-30 and mandatory floor insulation increases from R-13 to R-19. z For new subdivisions, homes will need to be designed to accommodate solar panels, both orientation and dead load. z New and replacement furnace installations must include duct testing unless all ducts are located within conditioned space. New duct installations will require maximum 6% leakage and existing duct systems, 15% leakage or maximum 10% house leakage with blower door testing.

The minimum prescriptive duct insulation is R-8. z For possible future instantaneous water heater installations, new water heater gas piping must be sized for 200,000 btu capacity. All hot water pipes 3/4 inch or larger shall be insulated. Electric resistance hot water heat will not be permitted unless natural gas is not available in the street. z For lighting, a minimum of one high efficacy light will be required in each bathroom. All other low efficacy lighting in the bathroom will be controlled by vacancy sensors. All hardwired lighting installed in garages, laundry rooms and utility rooms will be high efficacy and controlled by vacancy sensor. z Indoor air quality requirements have been clarified to include additions.

All additions will require energy code compliant local ventilation.

Additionally, HERS testing will be required for whole house fan systems.

Q&A Resource for Contractors

I

f you are reading this now and are unlicensed, a resolution to become a licensed contractor is a good choice in 2013. While most of us have been working to make (and keep!) New Year’s resolutions, the CSLB has been hard at work implementing new laws and regulations for contractors…

First, contractors should be aware that employee-reporting laws have been strengthened by the passage of Assembly Bill 1794. The new law, which took effect January 1, 2013, authorizes the Employment Development Department (EDD) to share new-hire employee information with agencies in the state’s Joint Enforcement Strike Force on the Underground Economy (of which the CSLB is a member) and the State Compensation Insurance Fund. This new practice of information sharing among state offices will ensure that employers are accurately reporting their employee payroll to their insurance carrier for establishing their Worker’s Compensation premium.

Contractors are currently required to carry adequate Worker’s Comp insurance for employees or submit an exemption or Certificate of Self-Insurance. However, a CSLB study revealed that nearly half of licensed contractors either claim an exemption based on having no employees or maintain a minimum policy under which no employees are reported to their insurance carrier.

“This landmark legislation benefits consumers, contractors, and employees,” said CSLB Registrar Steve Sands. “When employers properly report and insure employees, consumers are protected by Workers’ Compensation insurance coverage if an accident occurs on their property, businesses pay less in insurance premiums, and employees are eligible for unemployment insurance when they’re properly listed on the payroll.”

the term “consultant” as it relates to building and construction work. The new law states that anyone who provides or oversees bids for construction, arranges for subcontractor work and schedules, and/or has oversight for a project is, in fact, acting in the capacity of a contractor and must be state-licensed. In California, a state contractor license is required for any project that is $500 or more in combined labor and material costs.

Another CSLB-sponsored bill strengthens enforcement authority over contractors who violate state contracting laws. AB 2554 amends Business and Professions Code sections 7011.4 and 7106.5 to enable the CSLB Enforcement division and its representatives to issue notices to appear in court related to disciplinary actions against a license.

Several other laws affecting consumers, contractors, and the construction industry took effect as the new calendar arrived: AB 2219 indefinitely extends the requirement that all C-39 Roofing contractors obtain workers’ compensation insurance coverage, even if they certify that they have no employees. The bill also extends, indefinitely, the requirement that insurers conduct annual audits, and requires that these audits be conducted in person to verify the accuracy of the reported number of employees.

AB 2114 enacts new construction permit requirements for swimming pools, spas, or public wading pools.

AB 2339 requires state regulators and those involved in the heat pump and geothermal heating and cooling industries to evaluate policies and develop infrastructure for wider use of these technologies.

SB 1576 allows the CSLB to take administrative action if a licensee files a false complaint again another licensee.
