he Vendor Mixer on September 28 at the CATT office looked like a carnival had come to town, with popup canopies, games, balloons, food from Dan’s Dogs, drinks, music and fun prizes for the lucky raffle winners.

our CATT Board of Directors was delighted to be hosted by the NCCA (Nevada County Contractors Association) for an evening of fun and fellowship. The NCCA is our sister association located down the hill in Grass Valley. They were established in 1958 and very instrumental in helping CATT get started way back when. Knowing we have similar concerns, issues and lifestyles, we thought it might be a good idea to have an agenda-less, fun dinner to get acquainted and see how we can help each other, create a synergism.

The evening started with the NCCA Executive Director Barbara Bashall giving us mountaintop people a tour of their very own building.

That’s right, they have their own building, built with donations of time, money, materials and labor. It was explained to us how they had a few competing sub-contractors working together for the common cause. It worked, they have new friends and a beautiful building which gave us CATT directors something to look forward to in the future.

After a yummy dinner (they have a kitchen and large conference room) we started talking about the challenges we all face as contractors in our areas, from employee housing, dealing with inspectors and building departments, to what services association members like to see as benefits of their membership.

All in all, it was a good time and a relaxing experience, with both groups walking away with some great ideas as we head into a new year. Keep a watch for new ways for us to communicate to you our revered members and the public in general.

oting for the coveted CATT Individual Awards opened October 26 and closes Monday, November 21. Voting is done via the CATT website: www.ca-tt.com. All member companies can vote in this contest (one ballot per company). There are six categories for Individual awards: Builder; Sub-Contractor; Professional; Vendor/ Supplier; Volunteer; and New Member. We received 22 nominations covering the six categories. Photos of all nominees are shown on a continuous powerpoint loop before the Christmas Holiday Party and nominee names are listed in the party program and January newsletter. he next LGAC meeting is Monday, November 14, 4:00 p.m., here at the CATT office. THIS IS A DATE CHANGE. The meeting was moved from the third Monday to the second Monday to avoid the Thanksgiving holiday.

The November 14 guest speaker is John Falk with the Tahoe Sierra Board of Realtors (TSBOR) and Nevada County Association of Realtors (NCAOR). TSBOR is a CATT reciprocal member. John will be making a presentation on Prop 90, a CA measure passed decades ago allowing a one-time exemption from property tax reassessment for retirees who are downsizing. Nevada and Placer Counties do not currently have a Prop 90 exemption on the books. TSBOR and NCAOR are asking CATT to support a change so both counties adopt a Prop 90 property tax exemption. The connection to the building industry is the economic surge that occurs with a home purchase as improvements or construction is done.

The other important part of the November 14 LGAC agenda is the discussion on renaming and promoting the Legal Defense Fund plus updating the LGAC Mission Statement. News on a variety of issues will also be provided i.e. TSD Codebook revisions, North Tahoe Fire Code amendments, Placer County 10/15 deadline, etc.

Placer County News

I

t’s been a busy year for the Placer County Community Development Resource Agency (CDRA) office in Tahoe City and we are looking ahead to several process improvements that we think you’ll appreciate. Here are a few highlights: On Sep. 20, Placer County rolled out a new program called Over-the-Counter Tuesdays, modeled after a similar program in the Town of Truckee. A plan checker and other CDRA staff are available on Tuesdays to review simple building permits that do not require TRPA permits, such as kitchen or bath remodels or decks. A plan checker from North Tahoe Fire Protection District is also usually available to review the plans. Applicants can make greenline changes to plans to receive their permits that day; they can later go to the utility districts (or fire district if necessary) to get sign-offs. So far, the Tahoe CDRA office has issued 30 permits over-the-counter, and some projects, like decks, have already been inspected.

On Nov. 17, the Planning Commission will consider the Placer County Tahoe Basin Area Plan.

The plan covers all the areas in the Tahoe Basin and implements the TRPA Regional Plan. A few key elements include concentrating development in the town centers of Kings Beach and Tahoe City to create compact, walkable communities and limit sprawl. If approved, the plan would allow increased height and density in the town centers to incentivize development, revised parking regulations, introduce mixed use zoning and allow limited conversion of commercial floor area to tourist accommodation units.

Finally, Tahoe CDRA staff is working on a variety of process improvements. These include partnering with TRPA and other local jurisdictions to clarify the permitting process in the Tahoe Basin, reviewing and revising building submittal checklists and inspection requirements, aligning building requirements with the new building code, and focusing on staff education and training to better serve applicants and the public.

As the Tahoe CDRA office and Placer County make adjustments to its processes, we would appreciate CATT’s input and feedback as an important stakeholder.

Nate Farnell Goes to Washington

I

n September, I was invited to Washington, D.C. on behalf of a life insurance company (and the public) to ask congressional offices to uphold the tax-exempt treatment of life insurance death benefits in the upcoming 2017 tax reform proposals. A discussion in Washington has begun on whether or not the federal government should allow beneficiaries of a life insurance payout to continue to receive those funds tax free or instead, to begin taxing those funds as ordinary income for the beneficiary.

It was the first time in my life I had ever been to Washington. The trip was unique in the sense that I was “involved in the process” while I was there. We went in for meetings with congressional staff in the Senate office building and the House office building. Eventually I got to sit in on a session of the House. Initially, there was “shock and awe,” but it wore off as I began to realize that our country is administered by human beings just like you and me. Their personal worldviews end up becoming the policies and laws that you and I must live by.

Please vote this November. Many Americans have come before you in this country to preserve your right to vote. It is the least you can do to honor the immense sacrifices that have been made for the freedoms and liberties you currently enjoy.

SENIORS BREAKFAST NEEDS CATT VOLUNTEERS

C

alling all CATT members! The Sierra Senior Services fundraiser breakfast is coming up! The breakfast is Sunday, December 4.

The breakfast is held at the Truckee Senior Center by the Rodeo Grounds off Brockway Road. CATT members will be chefs for the day, flipping pancakes and frying eggs. CATT volunteers set the tables and bring plates to the breakfast diners. Cleanup is also part of the routine. First shift is from 7:00 to 9:30 a.m. and the second shift is from 9:00 a.m. to 12 Noon.

Thanks to new member Eric Saathoff (PFM Industrial Finishes), Michael Bernard (MHD Studio Design & Construction), Audrey Smith (True Green Roofing Solutions), and Sean Barry (Andersen Windows) for already volunteering to help!

The monthly fundraiser breakfast is always the first Sunday of the month and is open to the public for a nominal fee. The seniors collect the fee at the door and use the money to support the “Meals on Wheels” program. Twelve organizations provide the kitchen crew for the 12 breakfasts of the year. These organizations also encourage their members to eat breakfast on their designated Sunday at the Senior Center. The record to beat is 200+ breakfasts prepared by Truckee Noon Rotary Club in January 2014.

December 4 is CATT’s designated day to cook and serve. CATT members can help in two ways: 1) Volunteer for the kitchen crew (let us know what shift is best); 2) Or, bring your family in for breakfast—that generates revenue for the Sierra Senior Services.

he general rule is that new work must meet the new code.

Normally, existing work can remain as long as it met the code in effect at the time of original construction and it is maintained safe.

The following are correction issues that Truckee Building and Safety has seen on more than one occasion: 1. Provide smoke detectors in all bedrooms or sleeping areas, on each floor with living area, and centrally located outside of each bedroom or sleeping area. The California Building Code requires that smoke detectors are installed when the valuation of the work is greater than $1,000 and a permit is required. In new construction, smoke detectors shall be hard wired with battery backup and shall be interconnected so that when one sounds they all sound. In existing buildings smoke detectors may be battery operated.

2. Provide arc fault protection for new outlets in bedrooms. If wiring for a new duplex receptacle, light or smoke detector is added, the requirement applies. If an existing receptacle, light or smoke detector is being replaced the arc fault requirement does not apply.

3. New lighting shall meet the current energy code requirement (2010 California Energy Code). This provision applies if new lighting is added or if fixtures are replaced. New lighting is normally high efficacy or specially switched. The rules vary depending upon whether it is kitchen, bath, utility, garage, living space or exterior lighting.

4. When changing a tub to a shower, the drain may need to be upsized.

California Plumbing Code requires only a 1 ½ inch drain for a tub or tub/shower combination. It requires a two inch drain for a shower.

5. When adding a tub or tub/shower combination assure that the maximum delivered water temperature is 120ºF. The water heater may not be used to limit the temperature.

6. Provide a “grippable” stairway handrail. The handrail height is the same now as it has been for years, 34 to 38 inches above the nose of treads to the top of the rail. The requirement for the rail profile has changed. Most of the acorn shapes and notched 2x4s and 2x6s no longer work. The code requires either a round section, 1 ¼ to 2 inches in diameter or an equivalent gripping surface defined as perimeter between 4.25 and six inches and no dimension greater than 2.25 inches.

7. The gap between residential open riser stair treads cannot exceed four inches.

8. Permits are required for all new decks regardless of height above grade.

Q&A for Contractors

or us this is an historic day! What began as a first step to assist contractors with our first column in April 1996 has become 1000 columns down the road and twenty years later! Nearly every week of each year, Capitol Services, Inc. founder and original author David Kalb answered questions from individual contractors who ran into problems with the complex rules and regulations. That ‘capitol connection’ helped many others who read the answer avoid the same pitfall. In 2012, current Capitol Services, Inc. owner and President Shauna Krause carried on the dialogue after Mr. Kalb’s retirement. Thanks for reading the Q/A in this column, coauthored by David and Shauna. From Column One to Column 1000 that you are reading now, the mission has been to assist contractors across the west save time, money and problems. We hope it’s become part of your history and has been helpful to you in past, present and will be a valued resource in the future!

Q: We spoke on the phone a few months ago about the CSLB not accepting our business name for the “B” and “C-10” classifications. You recommended that we write a letter to the Registrar of Contractors asking for a review of this decision. I never wrote to her but just received an official attached letter, which makes no sense. I’ve located a dozen licensed contractors with the same “non-descriptive” word in their business name, so I don’t understand why the Board’s creating a problem for my business.

I would like to engage legal counsel on this matter. Do you have any opinion to share?

A: After we talked I spoke with Shauna Krause of Capitol Services who deals with the CSLB on a daily basis. She indicated that generic words are no longer being allowed for new contractors and the CSLB is requiring dba’s with more descriptive words. Apparently, the Board is even making companies who apply

with initials in their business name give an explanation of what the letters stand for (I can tell you they never used to have this requirement).

The likely reason you were able to locate a number of licensed contractors, with the same word in their name, was because the Board will rarely retroactively require businesses to change their name after they’ve been approved (although I have seen it happen).

Back in the day, the CSLB allowed a wide variety of business names with little need to explain what they meant. There of course were restrictions, such as a contractor wanting to use the word Plumbing when they held an Electrical license or using the word “Incorporated” when they in fact were a Partnership. Over the years, the Board gradually clamped down on business name styles. This included allowing only “A” and “B” contractors to use the word “construction” unless there was a descriptive like “electrical construction” for a “C-10” or “Concrete construction” for a C-8. They decided to only allow the word Solar in the business name if the company held a C-46, even though a General building (“B”’) can do all aspects of this work.

For many years, a corporation with a person’s name (i.e. Smith Construction”) was sold to someone named “Jones”, the Board would allow use of the old name if the new contractor wrote a letter explaining why it was important to keep the original name intact (usually because the old name was well known which was why it was purchased in the first place). Today, I’m not sure what the CSLB would decide. Please contact Shauna Krause at Capitol Services if you need added assistance.

In my opinion, I don’t believe hiring a lawyer will help resolve your problem.

Again, my best recommendation is to write to the Registrar asking for a review of your specific situation and general explanation regarding the Boards current business name policy.
