CATT HITS THE 15 YEAR MILESTONE
C
ATT members love parties and CATT’s 15th Anniversary provided a great reason to celebrate! The party was held on Friday afternoon, August 16, at Truckee River Regional Park. Party Chairman Mark Tanner, Vice Chair Gerald Wallace, and the committee worked for many months planning this public event that offered free lunch, a trade show, live concert, and even anniversary cake! Radio and newspaper ads promoted the party and the event was placed on numerous electronic calendars and bulletin boards. Additionally, NTBA, Truckee Donner and North Lake Tahoe Chambers helped publicize the party as did the Tahoe Sierra Board of Realtors and TTEA. Three large banners were hung at various locations around Truckee and verbal announcements were made at several public events. n Saturday, September 28, at 9:00 AM the Remodel Committee will hold a Sporting Clay Shotgun Tournament at Capitol City Gun Club in Carson City. The cost is $125 a shooter. The cost includes clays, ammo, and lunch. Put together a team of five or just come out on your own. Prizes will be awarded to top shooters in three classes. The top shooter and overall team will also get prizes. O
n August 16th, CATT celebrated its 15th year serving the local construction industry and the Truckee-Tahoe community. The event, held at the Truckee River Regional Park, was very well attended with over 300 guests. Thank you to all who attended and a big thank you to the chairman, Mark Tanner of Mark Tanner Construction. Mark and all of his volunteers rocked this event. I also want to recognize Dennis Schlumpf this month. Dennis was a founder of CATT in 1998 and has served on the Board of Directors for 15 years. He was the President of the Association in 2010 and has acted as the Parliamentarian for several years now. In August, Dennis stepped down as a Director for the Association. His wisdom and knowledge will be difficult to replace. Thank you Dennis for your many years of service.

dog lunch. The list of lunch goers included elected officials, business leaders, CATT members, and others. The Trade Show attracted 33 vendors with an assortment of product exhibits. Truckee-Tahoe Lumber generously donated the lumber for the Carpentry Skills Contest as well as the $500 cash prize for the 1st place teams. The Carpentry Skills Contest was ultimately cancelled but may be re-organized as a winter-time event when work crews are not so busy. 124 people ordered the BBQ dinner. “Angele and the Wildwood Band” entertained the dinner crowd and then all eyes were on Charlie Riley (Truckee Hometown Sears Store) and Jeff Ridgel (The Office Boss). These two CATT members gave Mark Tanner the “Keep it Local, Do Business with a CATT Member” Award—complete with large display board and $100 gift certificate from Sears. The success of this event depended on the time and commitment of many members. Issues and Local Government Affairs Committee Schedule CATT Policy on AB 1600 Mitigation Fees
CATT Executive Director Pat Davison compiled a two page summary explaining CATT’s generic policy on AB 1600 Mitigation Fees. These fees are usually imposed on new residential and/or commercial construction when a building permit application is submitted (after entitlement or land use approval is given). The fees are a way for local government to collect additional monies to offset the impacts related to new growth and development. These fees cannot be used for personnel and they cannot be used to remedy an existing deficiency. Many government jurisdictions in the Truckee area have these fees as do jurisdictions on the CA side of Lake Tahoe. Fees vary by jurisdiction and are based on desired equipment, vehicle, or facility needs to accommodate new growth. For a single family residence, mitigation fees range from $0.68 per SF (Truckee Fire Protection District) to $2.63 per SF (Tahoe Truckee Unified School District). The CATT Board made Mitigation Fees one of two priorities for Pat’s time in 2013. Alpine Springs County Water District AB 1600 Fire Mitigation Fees
The Alpine Springs County Water District (ASCWD) Board of Directors voted on June 14 to raise mitigation fees to be paid by new construction so the District could purchase a Type I fire engine. Land Use Residential Commercial Office Industrial

The Fee Study used a 1.5% annual growth rate projection for 22 years (2013-2035). Although the ASCWD Board chose not to delay the decision to allow more discussion to occur between CATT and the District about the 1.5% growth rate, the Board did agree with CATT’s request to phase in the increases over two years. The fee increases go to the Placer County Board of Supervisors for approval, most likely in October. The increases are effective 60 days after the Board of Supervisors approves them.
North Tahoe Fire Protection District AB 1600 Fire Mitigation Fees
The North Tahoe Fire Protection District (NTFPD) Board of Directors voted on August 21 to raise mitigation fees to be paid by new construction so the District could re-construct the Homewood and Kings Beach fire stations as well as purchase a Type I fire engine and related equipment. As was the case for Alpine Springs, the Fee Study projected a 1.5% growth rate. To put the growth rate in perspective, it means that District full time population increased by 160 people in 2011, 163 people in 2012, and 165 people in 2013. Thank you Placer County!
Thanks to the Placer County Building Department and especially Chief Building Official Tim Wegner and Supervising Building Inspector Kirk Smith for their cooperative attitude in working with area contractors on the issue of fencing around pools and spas. CATT brought this issue to Placer County in May, after Jim Smith of Mark Tanner Construction raised questions about interpretation. Based on a request from CATT for reconsideration of County policy, Tim and Kirk researched the code in question and checked surrounding jurisdictions. In July, they decided to revise the interpretation, now excluding spa tubs from the fencing requirement. County staff will be changing the informational handout to reflect what is and is not required. CATT is very appreciative of the County’s collaborative approach and willingness to listen. Truckee AB 1600 Traffic Mitigation Fees and 3rd Tahoe Donner Connector
The Town collects AB 1600 traffic mitigation fees from almost every applicant seeking a building permit for new construction. These fees are based on a laundry list of projects identified by Town documents as necessary to offset traffic problems caused by new growth. The single largest project on the list is the 3rd Tahoe Donner connector, coming in at $23 million. The connector will be needed in the future to carry traffic that cannot be accommodated efficiently on Donner Pass Road. There is no timeframe for this connector to be built. The Town, according to its own definition, states that Donner Pass Road is currently operating at an acceptable level of service. 100% of the cost share responsibility to build this connector is assigned to new growth (new construction). CATT has consistently complained about the inequity of new growth being the sole source of funding for this huge project. CATT has also questioned the determination that Donner Pass Road is operating at an acceptable level of service even though it has known and predictable periods of congestion. AB 1600 fees cannot be used to remedy an existing deficiency. Because the Town says there is no deficiency today with Donner Pass Road, they can collect the fees for a future 3rd Tahoe Donner connector. On August 13, Town staff gave the Town Council a lengthy presentation on the Fee program. CATT Executive Director Pat Davison focused on the 3rd Tahoe Donner Connector and mentioned CATT’s desire to revisit the determination of “level of service” and definition of “deficiency.” Pat also asked for an updated traffic volume count of Donner Pass Road and supported Town staff’s proposal for an update to the Fee Study. Lastly, Pat asked that the 100% cost share for the 3rd Tahoe Donner connector be reduced to some placeholder status until more information and discussion could occur. The Council seemed supportive of updating the traffic fee study and that hopefully will be added to the Fiscal Year 2014/2015 Budget. No action took place on the request for a reduced percentage cost share or dollar amount as placeholder. The NTFPD included language in their Capital Facilities Plan acknowledging our concern about using the 1.5% growth rate and indicated that annual reports on permit totals by square footage would be given as additional information for Board and public knowledge. CATT asked for a delay of the decision to allow an independent consultant to review the Fee Study. CATT’s concern is that the engine and equipment purchase remedies an existing deficiency and is not a legal use of the fees. The NTFPD Board did not delay the decision. www.ca-tt.com
Thanks to the generosity of several CATT members, an independent consultant has been hired to scrutinize the Fee Study and address the “deficiency” question. If the Study stands as is, the NTFPD increases will probably go to the Placer County Board of Supervisors in October with the ASCWD increases. Stay tuned for more details!

he Town of Truckee Municipal Code Section 15.03.160, amends the grading thresholds of Appendix J of the 2010 CBC to require a grading permit when an area of 500 square feet or when more than 20 cubic yards of earth disturbance occurs. This includes landscaping projects, except as listed in the exemptions within section 15.03.160 of the Municipal Code. andymen need to remember the scope and limits of their work or they might find themselves ‘a dollar’ over the line and on the wrong side of the law. Licensed contractors also face significant penalties when projects go astray, including revocation of their license number. Wrapping it up we help settle a ‘buddy’ bet that offers an important reminder about knowledge and power… Q: I am a licensed contractor and I regularly read your Q&A’s. I came across one recently regarding Handymen performing work under $500. I have never understood this rule completely. Is that per job, per customer or what are the criteria? A: A handyman is permitted to perform work that is under $500 per job and, important to remember, that includes labor and materials. Q: You helped me obtain my license recently and I am getting ready to make new contracts but I’m getting confused when looking at the CSLB’s website regarding the Mechanics Lien law. Am I supposed to put the notice on the contract itself? A: It’s nice to hear from you again. A Mechanics Lien Warning is required to be part of a Home Improvement Contract or New Residential Contract. This applies to every contract or changes in a contract and it can be incorporated within the contract or as an attachment. The specific wording for the notice that is required is outlined in B&P Code section 7164. Or, if it remains unclear call my office for more help. Q: I recently had my license revoked because of a judgment and I’ve been getting conflicting information regarding the repercussions of having a revoked license. Does this mean that I will never be able to get a contractor’s license again in the future?

A: Not necessarily. It really depends on the specifics of your situation. Many times if you can prove that the judgment that resulted in the license revocation has been satisfied then you can in fact obtain a contractor license again in the future. When you apply the CSLB will review your situation and make a case-by-case determination. Q: I’m hoping that you can settle a disagreement with a buddy who is also a licensed contractor. Can a “B” General Building contractor perform part of the work necessary for pool construction? It is my understanding that a “B” contractor can do anything as long as two unrelated trades are involved on the same project. Is that a good bet? A: No, that is not correct; a General Building contractor cannot do “anything” as long as two unrelated trades are involved. There are many trades that are not covered within the General Building classification. In fact, pool construction is one of them! Even though the project involves two unrelated trades, the appropriate classification would be the “C-53” Swimming Pool license. According to the State’s definition of the “B” classification, “a General Building contractor is a contractor whose principal contracting business is in connection with any structure built, being built, or to be built, for the support, shelter, and enclosure of persons, animals, chattels, or movable property of any kind, requiring in its construction the use of at least two unrelated building trades or crafts, or to do or superintend the whole or any part thereof.” Sorry, but you lose that bet!
