Cross Defendant – the Tahoe Keys Marina and Yacht Club LLC (TKM&YC) in court against the Defendant/Cross Claimant – the Tahoe Keys Property Owners Association (TKPOA) Attorney – Art Zoiro - Brownstein Hyatt Farber Schreck, LLP (BHFS) in the Superior Court of the State of California, County of El Dorado, South Lake Tahoe, California, in Case No SC2017-140. Honorable Judge Michael J. McLaughlin ruled in favor of the TKPOA awarding $104,958 in outstanding Water Quality Control System and East Cove water maintenance costs owed by the TKM&YC , and compensation for recovery of costs and attorney’s fees. Prior to the legal proceeding Attorney Robert P. Huckaby provided a statement introducing Chris Plencner attending the trial, is not an owner or officer of the TKM&YC, is not the general manager of the TKM&YC and is attending the trial today only as an observer. Kim Plencner, President and CEO of Royce Realty & Management Inc., could not make the trial today due to a medical procedure on Sunday. For this trial Robert Huckaby provided no witnesses and no exhibits on behalf of the TKM&YC. Attorney Art Zorio for the TKPOA provided 85 exhibits, and three witnesses for the trial which included: Greg Hoover, TKPOA Water Quality Manager/Aquatic Invasive Species (AIS) Program Coordinator; Don Havard, TKPOA Accounting Manager; and Jim Siegfried, TKPOA Finance Committee Member and Past Board Treasurer. This bench trial was originally scheduled for four days but was concluded in one day. The TKM&YC is the successor of interest to the real property identified in the 1991 Superior Court of California – Stipulation Agreement No: 1225. The land occupied by the TKM&YC, is APN 022-210-32-100, having acquired that property by deed recorded December 11th, 2008. The TKM&YC is subject to CONTINUED ON PAGE 13

Summertime

Summertime living is easy—but for your heart, and

with Tahoe daytime temperatures nearing 100 degrees lately, the warmest season of the year can be a challenge. Dehydration, heat exhaustion and heatstroke can be a concern for people with heart trouble—especially heart failure. That’s because your heart may have difficulty pumping blood to your skin, where heat is released. Sweating helps you cool off, but your medication may make it harder to sweat, too. As the thermometer remains high, keep these tips in mind for hearthealthy living this summer. Hydrate with healthy drinks. While a cold soda sounds refreshing when the sun is shining, soda can be dehydrating. Consider healthier options such as lemon water, unsweetened iced tea, fruit smoothies, and non-alcoholic versions of your favorite drinks. Sweat it out. It only takes 30 minutes a day to lower your blood pressure. With the long days, plan outdoor activities like hiking, swimming, tennis, or golf for early morning or late evening. When the heat is unbearable, opt for indoor activities like the treadmill, spin bike or yoga. Refresh your diet with produce. Many fruits and vegetables—from bell peppers and blueberries to strawberries and sugar snap peas—are in season during the summer, meaning they’re often more fresh and affordable than at other times of year. They can also leave you feeling light and refreshed when the days are hot. Visit your grocery store or a local farmers market and incorporate these healthy foods into summer recipes. Keep your cool. High levels of stress can lead to temporary but dramatic increases in blood pressure. Traffic delays, overcrowded beaches and long lines often trigger stress. Find ways to manage stress with meditation or laughter with friends and family. Keep your body cool by showering, bathing or sponging yourself off with cool water when you are feeling overly hot. Wear loose, lightweight, light-colored clothes to reflect heat and opt for a hat to reduce sun exposure. If you have a history of heart problems, be sure to check with your health care provider about what you can do to beat the heat this summer.

ARCHITECTURAL CONTROL

APPLICATION SUBMITTAL PROCESS

By Linda Callahan, Architectural Control Department Manager WE HAVE MANY NEW OWNERS IN THE TAHOE KEYS. WELCOME!

I want to reach out to remind old, and new owners alike; we live in a homeowner’s association and have Architectural Control rules in place to abide by. If you are planning to do improvements to your property, be advised, all exterior modifications must be submitted to the Architectural Control Committee (ACC) in the form of an application for review. Work cannot commence until you have received approval for your project from the ACC. ACC applications are available at the front desk and on the TKPOA website www.tkpoa.com . You may also call the office at (530) 542-6444 and we will be happy to email an application to you. Applications can be submitted via email to lcallahan@tahoekeyspoa.org or dropped off at the TKPOA pavilion front desk. Staff will contact you if additional information is required for committee consideration. The following is an outline of the submittal process. 1. Application is submitted to the ACC for consideration. 2. TKPOA staff collects all necessary review fees and compliance deposits and confirms that all necessary documents are signed by the property owner. 3. Architectural Control Department (ACD) staff conducts a field inspection and photographic records are taken to include with the submittal. 4. The proposed project is then added to the ACC meeting agenda. 5. After ACC has reviewed the application during a regularly scheduled meeting, staff generates an approval/denial letter. 6. A digital copy of the processed application is recorded and the original application including all related documents is then filed in the owner’s property lot file. The City of South Lake Tahoe (CSLT) Building Department requires approval from TKPOA for issuance of a building permit. During the construction season (May–October) the ACC meets bi-monthly. JULY 21ST – EXECUTIVE SESSION BOARD ACTIONS • Reviewed nine personnel matters. • Reviewed four member disciplinary matters. • Reviewed 20 legal matters, including ongoing issues with the Tahoe Keys Marina and Yacht Club (TKM&YC). • Reviewed 16 contracts, no new contracts were approved.

JULY 21ST – BOARD OF DIRECTORS MEETING BOARD ACTIONS • Rescinded the May 19th, 2021 Approval of the Reserve Expenditure Request (RER) for the Cove 2A Mansard Shingle Siding Project. • Approved drip irrigation for trees and plants overnight using the updated irrigation schedule provided by the Long-term Facilities Oversight Committee starting July 26th, 2021, and to host an Emergency Board Meeting immediately after the filtration systems have been permitted. • Approved the GB General Engineering Contractor Inc. presented Change Orders #2 20205-319 and #3 20205-320 for the Jacobi Carbon Installation at Well #3 and Well #2 for a total of $19,639.30, plus and contingency of $4,360.70 for a total of $24,000 to be expensed to the Water Company Reserve Fund Account #69000. This expense will become a component of a future Water Company Special Assessment for TKPOA property owners. [These expenses are allocated per Vessel Installation at Well #3 (4) and Well #2 (2)]. • Approved the Eastern Sierra Engineering Contract Amendment No. 1 for Well #3 and Well #2 Permitting Requirements for $13,955.50, plus a contingency of $2,445.50 for a total of $16,000 to be expensed to the Water Keys Breeze

This expense will become a component of a future Water Company Special Assessment for TKPOA property owners. • Approved the Well #3 Baker Tank Rental from June 11th, 2021 until July 31st, 2021 for $12,200 plus contingency of $200 for a total of $12,200 to be expensed to the Water Company Reserve Fund Account #69000. This expense will become a component of a future Water Company Special Assessment for TKPOA property owners. • Approved the Well #3 Blending Bypass Monitoring and Control Devices for $7,893.79 plus contingency of $506.21 for a total of $8,400 to be expensed to the Water Company Reserve Fund Account #69000. the 1991 Superior Court of California – Stipulation Agreement No: 1225 TKPOA PREVAILS AGAIN... CONTINUED FROM PAGE 4 (September 6th, 1991) judgment, that was entered in the case titled TKPOA versus Horton. El Dorado County Superior Court Case No: SLT4914. As known as the “1991 Stipulated Judgment”. The “1991 Stipulated Judgment” does set forth and require the TKM&YC to pay for a share of Water Quality Control System and East Cove Water Maintenance costs as defined in the agreement which includes without limitation the cost of Water Quality Control Systems operated by the TKPOA designed to recirculate, maintain, and purify the waters of the channels of the lagoons including the waters of the East Cove, which include a reasonable amount each year for reserves for replacement. Also includes the cost of removing contaminants and pollutants, certainly the mechanical harvesting of invasive plants, skimming operations, the various surveys and studies, in the Court’s opinion fall within the costs that the TKM&YC is obligated to pay. The “1991 Stipulated Judgment” requires that the TKM&YC pay all East Cove Water Maintenance Costs incurred each year by TKPOA and 20 percent of the Water Quality Control System Costs incurred each year by TKPOA. The TKM&YC has failed to pay and has caused damages to the TKPOA in sum of $104,958 with interest at the annual rate of 10 percent from the date of entry of this judgment until fully paid. Board of Directors ELECTION

Currently the TKPOA is still seeking TKPOA volunteers to assist the Inspector of Election for this ballot count on September 15th, 2021.

FOR THE 2021–2023 BOARD OF DIRECTORS ELECTION, there are three board positions up for election. For this election we have seven candidates that will be placed on the voting ballot: Joy Curry Norem, Ken Silveira, Michelle Pandori, Michael McGinnis, Joby Cefalu, Melvin Meyers, and Robert Meyers. The Voting and Election Rules that were adopted by the Board of Directors of Tahoe Keys Property Owners’ Association on May 22nd, 2015 comply with the requirements of the Davis Stirling Civil Code section 5105(a). Section 2. Qualifications for Candidacy and Election to the Board: Candidates for the Board must be members in good standing and must meet any other qualification or restrictions set forth in the Bylaws. “Member” means a person who holds legal title to the property (i.e., is named in the deed for the property). Voting Ballots were mailed out no later than July 11th, 2021. You can view each candidates’ self-nomination form “Statement of Candidacy” on the TKPOA website at tkpoa.com, and they will be included in the Ballot package you receive. These Board members are eligible to rerun for the Board for another term and Director’s and Melvin Meyers has submitted a self-nomination forms for reelection for the 2021–2023 term. Board Members who still have one year left on their two-year term are Dave Peterson, President; Keiron McCammon, Treasurer; Bonnie Halleran, Director; and Stephen Shepherd, Director. Their terms end in 2022. The record date for this Annual Election will be set by Board motion for July 6th. The TKWC is issuing an Emergency Rule Change to allow landscape irrigation for all water serviced properties and commercial customers. This includes Tahoe Keys Property Owners Association (TKPOA) common areas, all Cove townhome landscaping, all single-family home landscaping, and commercial water customer properties landscaping. SECTION 10 WATER CONSERVATION RULES 10.1 Irrigation Limits. Irrigation shall be calibrated and scheduled to deliver no more than the following: March 20 – June 30 and September 1 – November 30: 1.5 inches per week July 1 – August 31: 2.0 inches per week 10.2 Irrigation Scheduling. Subject to the exemptions below, landscape irrigation is permitted only on designated irrigation days, as designated in Schedule A (page 18): 10.3 Exemptions from Irrigation Schedule. No exceptions to irrigation schedule for new plant material (including new turf). 10.4 Prohibited Activities. No owner, nor an owner’s tenant, contractor, employee or agent may engage in any of the following activities: Irrigation is prohibited on Memorial Day Weekend, July Fourth Weekend, and Labor Day Weekend. • Allowing water to flow over the ground surface or from sprinklers onto surfaces that are not able to absorb water or onto neighboring properties. • Use of a hose without an automatic shut-off nozzle. • Use of water to wash sidewalks, driveways, parking areas, tennis courts, decks, patios, or other improved areas. • Any activity prohibited by federal, state, or local law or regulation. These rules will be considered for adoption at the September 15th, 2021 Board of Directors Meeting. Purpose and Effect of Proposed Rule Change To further clarify Architectural Control Rules Section 14 - Exterior Lighting The primary intent of rules for exterior lighting in the TKPOA is to: a) Protect property owners from annoyance and obtrusive glare; b) enhance safety, security, and usability of the properties; c) provide for installation and maintenance of subtle, low-intensity lighting, which enhances landscaping, and d) all outdoor lighting shall be designed, located, installed, directed downward or toward structures, fully shielded, and maintained in order to prevent glare, light trespass, and light pollution and away from adjoining properties and public rights of way, so that no light fixture directly illuminates an area outside of the property lines. 14.03 Accent decorative and landscape lighting should be soft, low intensity and not offensive to neighbors or to traffic. All exterior lighting must be extinguished after 10:00 p.m. No rope or string lights except as provided in section 15.14. (holiday lights)

14.04 Dock, Ramp, and Over Water Platform (OWP) lighting 14.04a Light colors are limited to: warm white and pale blue. 14.06a Soffit lights: Generally used to illuminate building sidewalls, entryways and exits. Soffit lights are recessed pointing downward from the underside of an architectural structure such as an arch, a balcony, or overhanging eaves. They may not be less than 8 feet apart. The depth of the recess must be sufficient to conceal the lighting filaments so as not to project light directly to neighboring properties or the street. 14.07 Front Porch Lights: May stay on all night, but must be screened, shaded, or aimed downward so as to not annoy or disturb neighbors. 14.07a Illuminated street addresses: Usually positioned on or near the front porch/entry. Only required on new construction of the primary residences. May stay on all night. May be added to existing residence structures. Street addresses may be illuminated from low intensity, front porch lights, or independently by low intensity lights. 14.08 Rear Property Lights: Can include temporary use of floodlights (see floodlighting 14.02) and temporary use yard lights that facilitate use of the property (outdoor parties, games, etc.). Rear Property Lights must be aimed downward, screened, shielded, or constructed so filaments are not visible from adjacent lots or common areas, and must not be positioned (aimed) to reflect off water surfaces.

The Notice to Proceed has been issued for Arizona Pipeline to replace gas lines throughout the Tahoe Keys Property Owners Association SOME ROADS WILL HAVE CONSTRUCTION WORKERS AND EQUIPMENT IN THE AREA AND TRAFFIC DELAYS MAY OCCUR THROUGH THE MIDDLE OF OCTOBER, 2021 PROJECT OPERATIONS STAGING, STORAGE AND ACCESS Arizona Pipeline, in conjunction with Southwest Gas Company, has been given the approval to replace several old steel gas service lines throughout the Tahoe Keys Property Owners Association with new Polyethylene pipe.The workers will have equipment and staging signs in designated areas where work is being performed. Traffic delays may occur when workers are needing to access the entirety of the road. Excavation will be needed on some private properties. Arizona Pipeline will be notifying these property owners 48 hours prior to performing work. The properties will be put back to original state after work is completed. This project is being managed by Southwest Gas Company and funded by the City of South Lake Tahoe.

Purpose and Effect of Proposed Rule Change To further clarify Architectural Control Rules Section 9 – Fences 09.03 Height: Fences must not be higher than six feet (6’) along the side of the house, or higher than three four feet in front of the house or four feet (4’) in the rear of the house. Front fences must comply with the 5 foot setback from the curb requirement. Section 9A – Revetments, Bulkheads, and Landscape Walls 9A.01 Landscape walls less than 3 feet high and not within 1 foot of the high water line are exempt from City permit requirements. 9A.03 Any landscape wall four three feet or higher, at or facing the high water line, and changes the natural slope or gradient of the lot, will require a City Permit.

13.17 Over Water Platforms (OWPs) - The maximum width, parallel to the high waterline, is limited to 25% of that measurement. Under no circumstances can the width, as measured parallel to the high waterline, be more than twenty feet (20’). Height limitations not to exceed twelve inches (12”) above the bulkhead and no more than three feet (3’) above high water where there is riprap. 13.24 Maintenance and Cleaning are recurring activities not requiring ACC approval. They are associated with maintaining accessory structures in a good condition. They include tasks such as washing, painting (same colors) and replacement of lighting fixtures, hardware, bumpers (in kind) and resetting of pilings. Resetting of pilings means to drive existing piles back down to original depth, in the original position. Section 15- Misc. Provisions for exterior grounds, storage, and structures

RECENTLY, NATURALLY OCCURRING URANIUM in our

groundwater has begun exceeding drinking water quality standards. PCE (a cleaning solvent) pollution of the groundwater also has been increasing due to migration of contaminated groundwater from nowclosed businesses in the South Lake Tahoe “Y” area and the Highway 50 corridor. Both South Tahoe PUD and Lukins Brothers Water Company (Lukins) have similar challenges with the uranium and PCE and have had to either treat or close many of their wells. The Tahoe Keys Water Company (TKWC) is developing a long-term plan to ensure safe drinking water, improve supply reliability, and increase water use efficiency. The long-term plan is expected to be completed this year and implemented over the next two years. However, in the interim, water use must be on a restricted basis until all wells are online and our long term water facilities plan has been implemented. As TKWC develops its long-term plan for uranium and PCE, a key objective is to increase the efficiency of both the overall water system and water use by its customers. Studies of indoor and outdoor water use show that significant reductions (30–50 percent) in total water use can be made, especially in landscape irrigation management. Additionally, any reductions in water use will translate to lower energy usage and treatment costs, thereby reducing future homeowner quarterly assessment amounts. As these wells come back online, it is critical that all homeowners, renters, and third-party contractors comply with water-use restrictions. In addition, it is essential that these parties comply with the nophosphorus fertilizer requirement within the Tahoe Keys, as these fertilizers contribute to invasive plant growth within the Keys. Lake Tahoe soils contain plenty of phosphorus naturally. Excess “P” in fertilizer will run off your property and end up in Lake Tahoe, fueling plant growth. Summer is not the appropriate time to utilize fertilizer. It is recommended that if you have not been using a landscape contractor during water use restrictions, it is advisable to delay watering until the fall season so that grasses may become more easily established and fertilizer use does not contribute to aquatic invasive species growth. • TKPOA is working closely with TRPA to provide TKPOA PROPOSED INITIAL IRRIGATION RESTART PLAN CONTINUED FROM PAGE 23

to native plants or hardscaping, there are also several options that are available and resources are located at the end of this document. As the TKWC is able to bring additional pumping capacity back online, we plan to resume very limited irrigation (hand, drip or spray) within The Keys. It is critical to first improve landscape irrigation efficiencies by including the following actions:

• TKPOA is installing water meters on all sprinkler

systems in TKPOA’s common areas and townhouse complexes, which use roughly one third of all outdoor irrigation water in the Keys. Thirty-three (33) meters with state-of-the-art, real-time monitoring were recently purchased and are now being installed on all TKPOA-owned properties. • TKPOA has designed an irrigation schedule for homeowners and commercial customers to better time water use and balance irrigation demands across the community. We have prepared a community irrigation schedule (attached) which divides the community into eight (8) groups. Irrigation will now be limited to three days a week within a specified 2-hour window for each group. Your irrigation group is determined by what street you live on. For instance, all homeowners on Venice Drive are part of Group 1 and may irrigate from 1 am to 3 am on Sunday, Tuesday and Thursday. It is critical that these irrigation windows are followed by all TKWC customers as we are in the process of building back our water system capacity and resilience. Our water supply cannot support a return to the “old ways” of irrigating without limits. TKPOA security will be making rounds within the community to confirm homeowner compliance with the required irrigation schedule. Noncompliance with the irrigation schedule will overtax the system and irrigation may need to be ceased should this schedule not be followed. • TKPOA is also designing an irrigation program for homeowners and commercial customers to install Water Sense sprinkler controllers and irrigation flow meters at reduced costs to increase water conservation and only apply the amounts of water needed based on weather conditions. These sprinkler systems will use local weather data to maximize landscape water use efficiency. Keys Breeze

You may also request a water-wise consultation from the South Tahoe Public Utility District. • Finally, we are committed to increasing homeowner, landscape contractor, and other water manager education and awareness of opportunities for improving water use efficiencies, including working with local and regional resource agencies on technical support and education materials for water smart landscaping that will further promote efficient water use in The Keys. Should you need additional materials for your irrigators, please do not hesitate to contact the TKPOA front desk. The following water conservation measures and improved irrigation water use efficiencies will yield many benefits to TKWC water customers, the region’s communities, and the environment, not the least being our Keys lagoons.

• Reduction in Non-Point Sources of Pollution to

The Keys Lagoons: Reduced landscape irrigation runoff into storm drains will decrease pollutant runoff into the lagoons. • Reduction of Nutrients for Aquatic Invasive Plants: Reduced nutrient runoff for invasive plant growth in The Keys Lagoons will improve water quality, reduce non-native aquatic plant growth, and support aquatic ecosystem health. Reduced nutrient runoff will also help prevent the harmful summer algal blooms, which can be toxic to human and animal health. • Compliance with City of South Lake Tahoe Municipal Water Efficiency Landscape Ordinance: Decreases in landscape irrigation will contribute to goals set for improved community water conservation by State legislation and water conservation agencies. Efficiencies may also allow TKPOA to apply for additional efficiency grants to further reduce costs for TKWC customers. • Decreased Pumping, Water Treatment, and Energy Use: Decreased pumping and treatment of groundwater will reduce energy use, decrease costs for water customers and TKWC, extend the life of well and water pumping facilities, and reduce TKPOA’s carbon footprint. • Enhanced Fire Suppression Capacity for Public

Safety: Improved water delivery capabilities with storage, well treatment, and system reliability enhancements will increase public safety and protection of properties. • Reduction of Pumping from Tahoe Valley South Groundwater Basin: Increased water use efficiencies will decrease groundwater pumping that is contributing to accelerated migration of the PCE pollutant plume, which is the focus of ongoing South Tahoe PUD-led studies to identify feasible solutions for the eventual clean-up of the plume.

Meetings and Approvals

At the July 21st, 2021 Regular Board Meeting, the TKPOA Board of Directors: Reviewed homeowner delinquent accounts. There were not any disciplinary hearings for delinquent accounts. Disciplinary hearings are generally held when a homeowner is delinquent on two quarterly assessments.

At the August 3rd, 2021 the Finance Committee meeting, the TKPOA Finance Committee members: Reviewed and approved the May 2021 Financial Statements, received a report and update on the Tahoe Keys Water Co. (TKWC) short-term and intermediateterm plan, received a report on the status for the East Channel Bulkhead project, reviewed Legal Expenses, and reviewed the second draft of the 2022 TKPOA Operating Budget submitted by the 2022 Budget Sub-committee. The next meeting for the Finance Committee is scheduled for Tuesday, August 10th, 2021 to review the 2022 Budget. As a reminder, the Budget meetings, the Board meetings, and the Finance Committee meetings, and are open to members of the TKPOA (meeting dates are subject to change).

Is Your Lawn Too Far Gone? Tips for lawn recovery after drought

ASSESS THE DAMAGE. Grass species can withstand three to four weeks of dormancy and still survive. Inspect closely. Look at your grass at the crown — that is the base of the plant, just above the roots, where the individual blades emerge. If the crown is whitish and the new blades are green, the plant is still living. If everything is brown, then the plant is dead, and no amount of watering or fertilizer will bring it back. To restore your lawn, you will have to resod or reseed the area, which is only recommended in the fall.

AERATE. Core aeration allows water, air and nutrients to access the roots of the lawn. But don’t aerate a lawn if it is dormant or completely brown. Use this method on green lawns, and follow with regular watering. FERTILIZE CAREFULLY WHEN ADDITIONAL WATER COMES BACK ONLINE, which is only recommended in the fall. Just as you want your grass to focus on healthy roots and water absorption during the drought, the same goes for after periods of water shortage. Follow directions on fertilizing and avoid too-rapid growth and burning. Remember, phosphorus-based fertilizers are prohibited.

DON’T OVER-WATER. Too much water can be just as damaging as too little water. Follow a schedule and water accordingly.

MULCH ESTABLISHED AREAS. Once your grass is healthy, mow and mulch your grass clippings into the lawn to help retain water and build a strong root system. Continue to mow high, and stop mowing if you notice the lawn is under stress. MAKE A RENOVATION PLAN. Come up with a plan for overseeding dead or struggling patches of lawn. Add compost where necessary, rethink the choice of grass or grass seed mix, and select one that is drought-resistant. The right choice of grass on your new lawn may help it withstand water restrictions.

CONSIDER DROUGHT-TOLERANT LANDSCAPING, including drought-tolerant grasses or xeriscaping/hardscaping to save on water and fertilizer.

A green lawn is nice, but a blue lake is nicer. Conserve water and use fertilizer wisely to Keep Tahoe Blue. Keys Breeze
