With the completion of the 2021 Fiscal Year and the completion of the required tasks, it is time to report on the final status of the 2020 Water Quality Revised 2nd Payment of the Special Assessment. This will serve as the official notification of the implementation and expense of this special assessment. In 2017, the Tahoe Keys Property Owners Association (TKPOA) received a positive majority vote on RESOLUTION TKPOA #2017-001 for the “Authorization to Pursue Regulatory Approvals for the Use of Aquatic Herbicides to Control Aquatic Invasive Weeds in the Tahoe Keys Lagoons, and the Water Quality Special Assessment”. This positive vote authorized the Board of Directors to approve a Special Assessment of no more than $1,600 per property to fund the actions necessary to obtain regulatory approvals for the use aquatic herbicides. This positive vote allowed the Board of Directors to collect and bill for the “First Payment of the Special Assessment” of $400 in June 2017. This “First Payment” generated approximately $611,600 in funding for this project. On April 4th, 2020 Board of Directors approved RESOLUTION TKPOA No. #2019-0087 to authorize replacement the “Second Payment” of the Approved 2017 Water Quality Special Assessment for “The Authorization to Pursue Regulatory Approvals for the Use of Aquatic Herbicides to Control Aquatic Invasive Weeds in the Tahoe Keys Lagoons”. STRENGTH TRAIN FOR A HEALTHIER HEART

Can a short, four-minute workout be as effective as 30 minutes of cardio? While it may sound too good to be true, according to a recent study published in the Journal of Applied Physiology, Nutrition, and Metabolism, you’ll be happy to hear it’s true. Researchers tested traditional treadmill cardio against a fast-paced bodyweight workout, and while improvements in cardiovascular fitness were produced by both, whole-body resistance training presented an added benefit of improved muscle endurance. Meaning fast-paced bodyweight training can improve cardiovascular fitness just as well as running on a treadmill, plus it also provides improvements in muscle endurance. The training method, Peripheral Heart Action Training, is similar to circuit training. It keeps you moving from one exercise to another with minimal to no rest between exercises, while focusing on alternating, non-competing exercises. Keys Breeze

For example, start a strength circuit with a squat followed by an overhead press, then move immediately into a plank. The heart must push the blood from the lower body, to the upper body, and finally into the core. This systematic exercise selection increases the demands on your cardiovascular system, while also challenging more muscle groups than traditional cardiovascular exercise. This style of strength training has become the preferred method for athletes, as the bodyweight workout is more dynamic and enjoyable, so on average, they continue the training program longer than treadmill running alone. Total body movements should be the foundation for any fitness program, whether the goal is fat loss, athletic improvement, or gaining size and strength. While traditional cardiovascular exercise can provide many benefits, improve aerobic fitness and save time with resistance training exercises!

DISPLAYS AND HOLIDAY DECORATIONS MAY BE ERECTED TEMPORARILY WITHOUT A PERMIT.

HOLIDAY LIGHTS CHRISTMAS LIGHTS CANNOT REMAIN on the residence year round. Lights

should be removed after the holiday, weather permitting.

According to the Architectural Control Rules (ACR), Section 15, Misc. Provisions for Exterior Grounds, Storage and Structures, Item 15.14 reads as follows: Holiday and Traditional Displays vary widely. Displays and holiday decorations may be erected temporarily without a permit. Holiday decorations may be displayed no more than 30 days before or 14 days after a holiday (weather permitting). Decorations for personal events (birthdays, weddings, homecomings, etc.) may be displayed no more than three days before and three days after the event. All other displays require ACC approval and must be in harmony with the requisite occasion (as appropriate) and surrounding structures and neighborhood. Lights may not shine so brightly as to be an unreasonable disturbance to neighbors or drivers and no sound devices are permitted for any decoration. All lighted displays must be turned off by 11 pm. No display may obstruct the views from any other property. Keys Breeze

NOTICE OF CHANGE IN OPERATING RULES TEXT OF PROPOSED CHANGES (Deletions are shown in strikethrough type and additions in boldface underlined type)

On January 19th, 2022, the TKPOA Board of Directors approved the following Proposed changes to TKPOA Operating Rules for a 28 day membership review period. These rules will be considered for adoption at the March 16th, 2022 Board of Directors Meeting. If you would like to provide any feedback to the Board prior to approval, please email your comments to Heather Blumenthal, Operations Manager at hblumenthal@tahoekeyspoa.org, or submit them in person at the TKPOA Pavilion Office. Purpose and Effect of Proposed Rule Change To further clarify and update Parking Rules for Single Family Home, Townhome Subdivision, and Common Areas to be in conformance with current use of vehicles General Parking Rules The streets within the Tahoe Keys are owned by the City of South Lake Tahoe; all city ordinances and traffic laws apply. Parking enforcement on city streets is the responsibility of the South Lake Tahoe Police Department however TKPOA Security Officers are responsible for enforcing TKPOA parking rules and regulations throughout the Tahoe Keys.

Not more than one motor vehicle bearing advertising or otherwise pertaining to this use shall be parked on or about the above described premises. Vehicles bearing an advertising sign, commercial trucks, commercial vans, all such vehicles of more than 2 ½ tons, or of such length to inhibit safe parking, are prohibited from parking in the unassigned parking spaces of TKPOA except in performing their commercial duty and function requiring limited time-period parking. City parking ordinances on street parking apply. House trailers, motor homes, boats, campers, and recreational vehicles may only be parked or stored within the TKPOA within an enclosed garage, except for the purposes of loading and unloading. Pickup trucks with campers installed in the truck bed and sprinter vans may be parked within a property’s driveway, however, may not be parked along the street, other than for brief periods of loading and unloading, in order to prevent blocking of roadways and views of pedestrians and bicyclists. Truck bed campers and sprinter vans must reasonably fit within the driveway and may not be utilized for overnight accommodations and may not be stored (i.e. must be utilized as a frequent driver vehicle).

TKPOA assumes no responsibility for damage, theft, vandalism, or liability done to a vehicle visiting or parked on TKPOA grounds. All vehicles are subject to tow-away for violation of these rules. Vehicles parked in the fire lanes will be towed away without notice.

Major vehicle repair, auto repair and maintenance for pay, or extraordinary vehicle maintenance shall not be carried out on Association property. Vehicles shall not be in a state of disrepair or severe damage, nor be allowed to drip excessive amounts of engine or transmission fluids on the streets or alleyways of TKPOA.

All vehicles, motorcycles, ATVs, mopeds, etc., operated or parked on the private streets and alleyways of Tahoe Keys shall display current licenses and be maintained in a proper, legal operating condition so as not to be a hazard or nuisance by noise, exhaust emissions, or appearance.

Single Family Home Parking Areas Each resident’s single family home is considered to have parking spaces in the garage, driveways, and in immediate street parking areas near their properties. Additional vehicles shall not be stored, kept, or

parked in TKPOA common or townhome parking areas. Townhome Subdivisions Parking Areas Townhouses with a garage shall utilize the garage for parking of passenger vehicles only. Each townhouse unit may have only two (2) vehicles in its designated parking area at a time. Each vehicle parked within townhome subdivision lots must have either a TKPOA parking sticker or hangtag displayed. No vehicle shall be parked except within their garage or paint-designated parking space. No parking on landscaped areas or off pavement. All townhouse streets and alleyways are fire lanes and are so marked. Parking in these areas is prohibited at all times, except for 15 minutes loading and unloading, while the vehicle is attended. No vehicle shall be left in an unassigned-designated parking space in a non-operative condition or with an expired registration. Any vehicle not moved for a period of two weeks is considered a stored vehicle. Vehicles will be towed away at owners’ expense. Keys Breeze

NEW 2022 BOARD ADVISORY COMMITTEES By Heather Blumenthal, Operations Manager

The TKPOA Board of Directors have approved Board Advisory Committee Charters for three new committees: The Water Conservation “Ad Hoc” Committee, the Boating and Waterways “Ad Hoc” Committee, and the Tahoe Keys Water Company (TKWC) “Ad Hoc” Committee . Now that these Committee Charters have been approved we are now looking for TKPOA Property Owners to become volunteer members of these “Ad Hoc” committees. The Water Conservation – “Ad Hoc” Committee: The purpose of the Committee is assisting the Board of Directors and TKPOA Staff in the development and enforcement of Water Conservation programs throughout the TKPOA. The Board of Directors is looking for TKPOA Property Owners who have strong organizational skills and/or possess experience in communication of Association: Operating Rules, BYLAWS, CC&R’s, Architectural Control Rules, and Tahoe Planning Agency (TRPA) Guidelines. In addition to these recommended requirements experience in landscaping design, a certified Master Gardener, irrigation system design and monitoring are given preference in appointment to the Committee. Directors and their immediate family members are not eligible for appointment. Coowners of a property and immediate family members may not serve simultaneously on the Committee. The Board approves appointments to the Committee. The Boating and Waterways – “Ad Hoc’ Committee: The purpose of the Committee is assisting the Board of Directors and TKPOA Staff in the analysis of use and costs related to Boat and Boat Dock ownership in the TKPOA and how this relates to the Water Quality costs to maintain the water quality in waterways, lagoons and Lake Tallac. Coowners of a property may not serve simultaneously on the Committee. The Board approves appointments to the Committee. Committee Appointments: Any member of the Association who is in good standing, who has a positive interest in improving the TKPOA within the greater South Lake Tahoe community, who is prepared to invest the necessary time, and who does not present a conflict of interest, is eligible to apply for appointment as a member of the Committee. The committee will be composed of members who can make a minimum 1-year commitment to its work. Directors and their immediate family members are not eligible for appointment. Co-owners of a property and immediate family members may not serve simultaneously on the Committee. The Board approves appointments to the Committee. In general Members are expected to stay abreast of significant issues at TKPOA using all reasonable means available. THE TKPOA APPLICATION FOR THE CONTROL METHODS TEST (CMT) HAS BEEN UNANIMOUSLY APPROVED BY THE TAHOE REGIONAL PLANNING AGENCY (TRPA) GOVERNING BOARD AND LAHONTAN REGIONAL WATER QUALITY CONTROL BOARD By: Kirk Wooldridge (TKPOA General Manager), Gregory J Hoover ( TKPOA Water Quality Manager / AIS Management Coordinator), Moire Breslin (TKPOA Water Quality AIS Technician) After many years of extensive research, planning, scientific testing, and collaboration with numerous stakeholders, the Tahoe Keys Lagoons Aquatic Weed Control Methods Test (CMT) has been approved by both the Lahontan Regional Water Quality Control Board (LRWQCB) and Tahoe Regional Planning Agency (TRPA). This is a historical step in the forward movement to combat the aquatic invasive species problem in the Tahoe Keys Lagoons and potentially Lake Tahoe at large. On January 13th, 2022, the LRWQCB unanimously approved the issuance of Tahoe Keys Lagoons Aquatic Weed Control Methods Test - National Pollution Discharge Elimination System Permit, the Certification of Final Environmental Impact Report (EIR) and Adoption of Resolution Granting an Exemption to the Aquatic Pesticide Discharge Prohibition, and Adoption of Mitigation Monitoring and Reporting Program. According to the LRWQCB Meeting Agenda, the Board approved the following: “Approved: Resolution for Certification of the California Environmental Quality Act (CEQA) Final EIR for the Tahoe Keys Lagoons Aquatic Weed Control Methods Test the Water Board approved adopting a resolution certifying a Final Environmental Impact Report. The Final EIR is required in order for the LRWQCB to consider granting an exemption to a waste discharge prohibition contained in the Water Quality Control Plan for the Lahontan Region. Approved: Granting an Exemption to the Aquatic Pesticide Discharge Prohibition in the Water Quality Control Plan for the Lahontan Region for the Tahoe Keys Lagoons Aquatic Weed Control Methods Test. The LRWQCB approved adopting a resolution granting an exemption to the aquatic pesticide discharge prohibition contained in the Water Quality Control Plan for the Lahontan Region. Those approvals are the culmination of more than a decade of work by the Water Quality Department, Environmental Consultants, and the countless volunteer hours dedicated by TKPOA Property Owners on Water Quality Committee (WQC), and Board of Directors. The TKPOA would like to thank all the consultants and stakeholders for all their commitment, hard work, and support in the approval of the application for the Control Methods Test (CMT). Their dedication has been and continues to be invaluable. We thank all the consultants who include - Sierra Ecosystems Associates, Inc., EMKO Environmental, Inc., Dr. Lars Anderson and Weidinger Public Relations. We would also like to thank the various stakeholders who include - Tahoe Water Suppliers Association (TWSA), Zephyr Collaboration, League to Save Lake Tahoe (LTSLT), and Tahoe Resource Conservation District (TRCD). The approval of the CMT permit, by both agencies, does trigger the “Third Payment” of the Water Quality Special Assessment for “The Authorization to Pursue Regulatory Approvals for the Use of Aquatic Herbicides to Control Aquatic Invasive Weeds in the Tahoe Keys Lagoons” [RESOLUTION TKPOA #2017-0001] voted on in 2017 and re-voted on in 2020 [RESOLUTION TKPOA #2019-0087]. The Third Assessment is $600 per property and is planned to be processed by midFebruary. • Group A methods are herbicide and non-herbicide treatments to achieve extensive reduction in target aquatic weeds (targeting at least 75 percent reduction) within test sites. The Proposed Project tests standalone treatments using Environmental Protection Agency (EPA) and State of California approved aquatic herbicides, ultraviolet light, and laminar flow aeration (LFA), as well as combined herbicide and ultraviolet light treatments. Group A herbicide methods would be tested only in the initial year of the test project. Non-herbicide Group A treatments (i.e., ultraviolet light [UV-C], and LFA) may be extended to additional years if monitoring indicates further treatment may be useful. For example, UV-C light may be repeated for a second year, while LFA testing is planned to extend over several years. • Group B methods are non-herbicide maintenance treatments that are applied locally to follow up Group A treatments and control residual target aquatic weeds. Group B methods are intended to be long-term, sustainable control methods capable of maintaining aquatic weed control after initial Group A treatments have been applied to “knock down” the abundant target aquatic weeds in the Lagoons. For example, following a Group A herbicide treatment that achieves at least a 75% reduction in targeted aquatic weeds, Group B methods would be used to further control aquatic weeds and in no case would repeated use of herbicides be permitted as part of the project. Group B methods may include such actions as spot treatments with ultraviolet light, bottom barriers, diver-assisted suction, and diver hand pulling techniques. Use of Group B methods would be implemented in years 2-3, following Group A methods in year 1. Final test sites and proposed test methods for each site may change depending on Spring 2022 conditions and final agency approvals/permits.

The TKPOA Consultants and Water Quality Department are doing everything they can to keep the CMT on track for this spring. The window of application for the herbicides is dependent on water temperature and hydrology but must fall between May 1st and June 15th. There are a couple important gates remaining before we can begin the CMT this spring. • The scientists on the CMT Monitoring Work Group will make an assessment of projected water levels and flows in mid-February • The TKPOA Board of Directors will review the proposed budget, the project permit, and assess our overall readiness to proceed for this spring on or before the February 16th, 2022 Regular Board Meeting at 5PM.

Assuming we can proceed with the CMT as planned, there will be a significant impact on boating in the West Lagoon from as early as the beginning of May to as late as mid-July. After the installation of the multiple turbidity curtains, residents and boaters will experience issues with travel, for a minimum of 21 days after installation. There will be absolutely no traffic in or out of the West Lagoon for those behind the turbidity curtains. We will identify and report a more detailed plan in the coming weeks. TKPOA will also provide a map with the locations of where the turbidity curtains will be installed. All homeowners will be thoroughly informed with the rules and regulations of this process. We urge residents to attend the WQC - Town Hall Forum where more information will be provided. It is scheduled February 24th, 2022 from 6PM-8PM to give an update on the CMT project and an outline of the boating restrictions. TKPOA MISSION AND VISION STATEMENTS By Heather Blumenthal, Operations Manager

At the January 19th, 2022 Board of Directors meeting, the TKPOA Vision Ad Hoc Subcommittee presented the Board with a draft revised Mission Statement and Vision Statement for the Tahoe Keys Property Owners Association. Why is a Vision and Mission Statement Important? It is easy to think that a Vision and Mission Statement are interchangeable, however, they are not. An organization’s Vision Statement looks forward and creates the image of the ideal state and objectives that the organization wants to achieve in the future whereas a Mission Statement, summarizes the goals and values of the organization. Having these two important business statements assists an organization, such as the TKPOA, in decision-making, setting goals, and attracting future job candidates and homeowners. What is the Vision Ad Hoc Committee? In late 2020, the Board of Directors established the Vision

Ad Hoc Committee to assist the Board with TKPOA’s re-boot and charting of a new course in a post-pandemic world. The Committee was tasked with creating TKPOA’s new vision through an updated Mission Statement, Vision, and Values and with determining methods of communication to provide this new Vision to the TKPOA Property Owners and the greater community. Committee members have included Peter Grant (2020-current), Joy Curry Norem (2020-current), Connie Haverty (2020-current), Sean Ward (2020), Arlene Olson (2020), Nate Summer (2020), Keiron McCammon (2020-current), and Steve Shepherd (2020-current). The Committee’s January 19th, 2022 presentation was a culmination of the Committee’s hard work with support from Staff in the last year to create and new vision for the Tahoe Keys. After the Committee’s presentation, the Board voted to unanimously approve TKPOA’s new Vision and Mission Statements

At the January 19th, 2022 Board Meeting, the TKPOA Board of Directors did not hold any Disciplinary Hearings for delinquent accounts. Disciplinary hearings are generally held when a homeowner is delinquent on 2 quarterly assessments. The November Financial Statements were also approved. At the Finance Committee on January 25th, 2022, the November Financial Statements were approved and the Preliminary FYE December 2021 were reviewed. Other items approved included: 1). Water Company Winterization/un-Winterization Equipment and Installation be classified to the Emergency Assessment Contingency, 2). A review of the upcoming 2021 Audit Schedule, 3). A review of members delinquent over 90 days, 4). the status of collecting the Emergency Assessment billed October 15th, 2021, and 5). Discussed Goals and Objectives presented by the Treasurer. The next meeting of the Finance Committee will be on March 2nd, 2022 at 10:00 AM.

COVE ADVISORS NEEDED COVE ADVISORS NEEDED FOR ISLANDERS II, BAVARIAN ISLE, ALOHA ISLE, ST. MORITZ, AND MOUNT TALLAC VILLAGE III It is important that all TKPOA subdivisions are represented by a property owner living within their subdivision. Per the Advisor rules, any owner in good standing may volunteer to serve as the Advisor to their subdivision or cove. Otherwise the property owners may nominate themselves or another owner within that subdivision, confirmed by a vote of the Board of Directors. Each Cove Advisor is responsible for handling the general affairs of the cove including unit/common area facilities; report maintenance, repair and other property owners issues to TKPOA management and follow-up in keeping those property owners up to date with current events, general affairs of projects happening within the Keys, and manage the cove’s budget. If you want to volunteer or nominate a fellow owner please complete the “Request to be Appointed” form, which can be found on the TKPOA website, www.tkpoa. com, under Documents in the Cove Advisors folder. Birding In and Around the Tahoe Keys The Tahoe Keys offers the best birding opportunities found in Lake Tahoe, with its coves and lagoons, surrounding marshes, and sandbars along the lake’s shoreline. My husband and I have lived in the Keys since 2010 but didn’t start birding until 2015 when we participated in the Tahoe Big Year birding contest, where participants try to record their greatest number of bird species in a single year. We quickly became hooked on birding. In the 2021 Tahoe Big Year contest, I recorded 231 bird species, and for the Christmas Bird Count on December 15th, 2021, I was assigned to cover the Tahoe Keys area, and recorded 1,243 birds-- in a single day! These events are hosted by Tahoe Institute of Natural Sciences (TINS). The coves and large water channels in the Keys attract many types of waterfowl, especially in the winter. Some of these species include Canvasback, Redhead, Scaup, Bufflehead, Gadwall, Northern Shovelers, Teals, Grebes, Coots, Wood Ducks, and Mergansers. We frequently see the Osprey diving for fish in the summer, and sometimes the Bald Eagle trying to steal the Osprey’s fish away. Bald Eagles will also make repetitive passes over American Coots and Grebes, tiring them out before making the final grab. Our huge Cottonwood trees provide perches and cover for predators such as the Red-Shouldered Hawk, Red-Tailed Hawk, Cooper’s Hawk, and Sharp-Shinned Hawk. Also, you may catch a glimpse of the small but powerful Merlin or Pygmy Owl chasing a songbird. At Cove East, watch for the low-flying Northern Harrier, or the hovering American Kestrel and Osprey in the marsh. I’ve seen a number of owls there as well, including the Barn Owl, Pygmy Owl, Long-eared Owl, Great Horned Owl, and Saw-whet Owl. When near the river, look for Black-crowned Night Herons and Egrets along the muddy bank. Many birds reside in Lake Tahoe all year long and can often be seen in the Keys, including the Song Sparrow, Dark-eyed Junco, Stellar’s Jay, Nuthatches, Woodpeckers, Black-billed Magpies, and Mountain Chickadees. Other birds only visit during the summer, such as Warblers, Swallows, Wrens, Bluebirds, Flycatchers, and the beautiful Western Tanager. The birds that amaze me the most are those that migrate a long distance, often resting and feeding here for a few days in the Keys before continuing their long journey. The tiny Rufous Hummingbird travels 2,000 miles, Phalaropes 4,000 miles, and Black-Bellied Plover 5,000 miles! My favorite birding is at Cove East during the Spring and late Summer/Fall migrations, when migratory birds drop down to forage on the sand and mud along the lake’s edge: Ibis, Black-Necked Stilts, Sandpipers, Godwits, Curlew, Avocets, and Plovers. Out on the lake, you might see Tundra Swans, Scoters, and Loons. I marvel at how fragile birds appear and how they can survive migration and such harsh mountain conditions here. It fills me with joy to see them thriving here in the Keys. The sighting of a rare bird will take my breath away. Last spring, a White Wagtail (a resident of Southeast Asia & Europe!), landed on the beach for a brief couple of minutes, before moving on. It may have been looking for a safe place to feed and rest. Please keep birds in mind when walking your dogs. Keep them close, as many resident birds breed here, on the sand and in the marsh, and migratory birds rely on these places, even if it is for a brief period of time. A dog chasing these birds can disrupt the critical time needed for nesting, rest, and feeding.
