for fall and another pending winter. Like the seasons, our association has changed with another Board Election and a new Board President. I am humbled, yet excited, to serve my neighbors and friends as this year’s Board President. I certainly have large shoes to fill. Past President John Gonzales and the last Board did an outstanding job steering our association through several hurdles and I want to thank them for their many volunteer hours and hard work. SEPTEMBER 20TH – ANNUAL MEETING OF THE BOARD OF DIRECTORS BOARD ACTIONS • Rescinded the August 30th, 2019 motion appointing Dennis Daniel as the President Pro-Temp. • Appointed Joe Sherry as President Pro-Temp for the September 20th and September 21st Board meetings. • Removed John Gonzales from the Waterways Usage Committee and Lighthouse Shores Mediation Board Subcommittee. • Appointed Joe Sherry to the Lighthouse Shores Mediation Board Subcommittee. • Disbanded the Disciplinary Board Subcommittee.

SEPTEMBER 20TH – BOARD OF DIRECTORS ORIENTATION BOARD ACTIONS • Reviewed five legal matters including ongoing issues with the Tahoe Keys Marina and Yacht Club (TKM&YC) with TKPOA legal counsel.

Igniting Your Sense of Purpose By Nancy Laurenson, MSc., NBC-HWC LIVING IN ALIGNMENT WITH A SENSE OF PURPOSE gives our lives a solid

foundation and allows for true meaning and joy to emerge. One of the pillars of wellness is pursuing a sense of purpose and unlocking what it means to you can greatly improve your well-being. As important as having a sense of purpose is for our mental and physical health, finding it can be difficult due to the distractions of our daily lives and routines. Here are my suggestions to discover what ignites your passion and can help you live a purpose-driven life:

FINDING FLOW

Determining what brings meaning to your life is the first and most critical step. What has meaning helps define importance, and builds the foundation from which we live our lives. If you volunteer, have a hobby or an activity that you enjoy, then you have already found a passion. Invest time in this passion as often as possible and start sharing your experience and insights with the world. If you still haven’t found a passion or purpose, perhaps it is time to explore this concept and take time for reflection. Look carefully everywhere around you. Go back to your childhood pleasures. Where do you get ‘into a flow” or lose track of time? Has your calling been somewhere close, but you were too distracted to connect with it? Volunteering or giving a helping hand to be of service can also aid self-exploration.

SEEK CLARITY

It helps to have clarity around your desires, aspirations or dreams. Our vision for passion and purpose usually takes time to unfold and often changes over the years. Seeking clarity and allowing for exploration to find your passion or purpose is part of life’s traveled path. Sometimes we stumble; other times the

path seems more straightforward or may have accompanied us for years. Always, it is about questioning and allowing new ideas to shape and define who we are or what we truly want. Ask yourself, what do you love doing? Where does your heart feel contentment? When does your best self appear? We each have unique gifts to share with the world, from raising a child to caring for the sick, building a bridge or bringing laughter to others. What are your unique gifts? Where does compassion, civic calling and meaning intersect in your life?

LEAVE YOUR COMFORT ZONE

To ignite your sense of purpose, you may need to get outside of your comfort zone to do something that you’ve always wanted to do, but never had the courage or opportunity to do so. Perhaps, take more risks. Go on an adventure without planning. Jump into a big decision and make the most of it. Have fun exploring the meaning in your life beyond the day-to-day routine. Cove Advisors Needed for Bavarian Isle, Aloha Isle, Mount Tallac Village III, and Cove 2 It is important that all TKPOA subdivisions are represented by a property owner living within their subdivision. Per the Advisor rules, any owner in good standing may volunteer to serve as the Advisor to their Subdivision or Cove. Otherwise the property owners may nominate themselves or another owner within that subdivision, confirmed by a vote of the Board of Directors. Each Cove Advisor is responsible for handling the general affairs of the cove including unit/common area facilities; report maintenance, repair and other property owners issues to TKPOA management and follow-up in keeping those property owners up to date with current events, general affairs of projects happening within the Keys, and manage the cove’s budget. Board Term Accomplishments By Kirk J. Wooldridge, General Manager BOARD OF DIRECTORS 2018–2019: The Board of Directors

is charged with the ultimate responsibility and authority for operation of the Tahoe Keys Property Owners Association (TKPOA) on behalf of the Property Owners. It is the role of the Board of Directors to guide the setting of the policies, standards, procedures, programs and budgets for the Association. I would like to recognize some of these accomplishments that occurred during the September 2018 to September 2019 Board Term. The accomplishments listed below involved Board of Directors direction and support, and individual Board Members efforts.

2018–2019 Board Accomplishments

• Completed 2019 Operating Budget Planning and Approval Process. • Completed 2018 Annual Financial Audit with Gilbert & Associates, LLP CPA’s to complete Full Audit of TKPOA Year End Financial Records for 2018. • Continued Seven Days a Week Front Desk staffing at the TKPOA Pavilion Office 8:30 a.m.–4:30 p.m. Fourth Year. • Approval of 2018–2019 – Insurance Package – General Liability, Property, Directors and Officers/EPLI (D&O), Difference in Conditions, General Liability – Water, Professional Liability, and Auto Liability, Marine Operator, General Liability – Security Guards, Umbrella, Crime, and Cyber– Hayes Companies Brokers to achieve a savings.

John was presented with the TKPOA Sailboat Plaque to commemorate his volunteered time to serve the Association. The Gonzales’ will be greatly missed.

TKPOA “CONTEMPT OF COURT ORDER” CASE —

TKM&YC vs TKPOA (SLTL-4914) Abstract Judgement Recorded against the Tahoe Keys Marina & Yacht Club, LLC By Kirk Wooldridge, General Manager

ON AUGUST 6TH, 2019 the Tahoe Keys Property Owners Association (TKPOA) recorded an Abstract of Judgement – Civil and Small Claims against the Tahoe Keys Marina & Yacht Club LLC (TKM&YC) with El Dorado County Recorder DOC-2019-0031185-00.

This Abstract of Judgement is the result of three years of legal action against the TKM&YC for the ““Contempt of Court Order” Case - TKM&YC vs TKPOA (SLTL-4914) [TKPOA vs Horton], filed in the Superior Court of California - County of El Dorado – Cameron Park, California. The amount of this Abstract of Judgement to be collected from the TKM&YC is $98,006.92 for legal fees incurred by the TKPOA in pursing this legal action and the two court hearings on August 30th, 2017 and October 10th, 2018. Art Zorio - Attorney and the Law Firm Brownstein Hyatt Farber Schreck, LLP (BHFS) representing the TKPOA originally filed for a motion for Legal Fee reimbursement for the amount of $181,466. In January 2019 the Superior Court of California - County of El Dorado – Cameron Park ruled that the amount of $98,006.92 would be allowed for this case. The TKM&YC Management has been notified of the recorded Abstract of Judgement DOC2019-0031185-00, and the TKPOA has requested payment. The TKPOA Board of Directors and TKPOA Staff will continue to monitor this legal action to determine the next steps.

Announces Opening Night Film NORTH LAKE TAHOE — Tahoe Film Fest is pleased to announce their Opening Night Film for the 5th annual film festival event. Marriage Story, starring Adam Driver, Scarlett Johansson and directed by Academy Award nominee Noah Baumbach. This highly anticipated film will open the festival on Thursday evening, December 5th, at the Incline Village Cinemas. Writer-director Noah Baumbach offers another alternately funny and deeply moving snapshot of a marriage in its final stages. Davis Stirling Civil Code § 4041 – PROPERTY OWNERS MAILING ADDRESS INFORMATION By Kirk Wooldridge, General Manager & Don Havard, Accounting Manager

WITH THE UPCOMING 2020 ANNUAL DISCLOSURE mailing will be the request for all Tahoe

Keys Property Owners Association (TKPOA) to provide the Davis Stirling Civil Code § 4041 information. As of January 1st, 2017, every California community association has been required to ask its members to provide their contact information and property status. Civil Code § 4041 has required, starting January 1st, 2017, that each association must solicit the following information from its members and an owner of a separate interest shall, on an annual basis, provide written notice to the association of all of the following: 1. The address or addresses to which notices from the association are to be delivered. 2. An alternate or secondary address to which notices from the association are to be delivered. 3. The name and address of the owner’s legal representative, if any, including any person with power of attorney or other person who can be contacted in the event of the owner’s extended absence from the separate interest. 4. Whether the separate interest is owner-occupied, is rented out, if the parcel is developed but vacant, or if the parcel is undeveloped land. Although the statute does not mention how often an association must solicit this information, it does state that each member is responsible for providing this information to the association on an annual basis. The association shall solicit these annual notices of each owner and, at least 30 days prior to making its own required “Annual Disclosure”. If a Property Owner fails to provide the notices set forth in requirements (1) and (2) above, the last address provided in writing by the owner or, if none, the property address shall be deemed to be the address to which notices are to be delivered. It’s important to note that as long as the Association requests all of the contact information above, Civil Code § 4041 places the responsibility on the Property Owners to provide their correct and current contact information. Requiring members to provide this information should aid associations in giving notice of meetings or for other required notices as well as with the collection of delinquent assessments as it should help negate the argument that a notice was sent to the wrong address in the future. Meetings and Approvals

At the September 21st, 2019 Open Board meeting, the TKPOA Board of Directors approved July Financial Statements, reviewed homeowner delinquent accounts and scheduled disciplinary hearings on delinquent accounts. There were no approvals for lien notices for delinquent homeowners to review. Disciplinary hearings are generally held when a homeowner is delinquent on two quarterly assessments. At the August 27th, 2019 Finance Committee meeting, the 2nd draft of the proposed 2020 budgets for Common, Water Company, and Water Quality were reviewed. The committee discussed increasing the Vacation Home Rental fee to $550, directed staff to report on the effect of revising the front desk staff for being closed on Sundays during non-summer months, to report on the effect of revising Water Quality weed harvesting hours Keys Breeze

in November, reviewed options A, B, and C for the Water Quality operating budget, and recommended that the TKPOA Board of Directors eliminate, or delay further, the Ala Wai Tennis Court restroom project and the Ala Wai Median project. At the September 5th, 2019 Finance Committee meeting, the third draft of the 2020 Budget was reviewed. The Committee voted to recommend to the TKPOA Board of Directors to maintain Water Quality dues to landlocked homeowners at the same rate as all other TKPOA homeowners on the basis that the maintenance and quality of the lagoons is a benefit to every homeowner in the Keys and to increase the Water Quality manager to full-time status. As a reminder, the Budget meetings, the Board meetings, and the Finance Committee meetings, and are open to members of the TKPOA (meeting dates are subject to change).

TKPOA Projects Status By James Brooks, TKPOA Project / Property Manager This article is intended to keep Tahoe Keys Property Owners Association (TKPOA) Property Owners informed of the current status of the various Common Area, Channels & Lagoons, Water Company, Water Quality and Townhome projects completed and in development for the 2019 fiscal year and construction season.

Street Light Replacement with LED Fixtures – [COMMON AREA] Phase 2 included 30 Contempo LED Street light fixtures 3000K LED 240V at $750.00 per light for $22,500. 2. Water Lateral Replacement Phase I – [WATER COMPANY] Design for this project on Danube, Morrow, for the replacement of 23 double water service laterals from the street mains to 52 homes has been completed. The Association owned portion of the water service laterals that have galvanized pipe are slated for replacement due to age, condition and current leak repairs. Project awarded to Haen Constructors. 3. Cove 2 Replace Asphalt Walkways with Pavers – Awarded to Earth and Stone Landscaping for $38,925. 4. Cove 3C Bulkhead design – Reno Tahoe Geo Associates Engineering for $62,900. 5. Cove 3A Bay Windows Roof Eyebrows Replacement Project – Awarded to Amundson roofing for $18,900. 6. Light House Shores – Lot A Rock Revetment Bulkhead Repair Engineering Design Light House Shores Lot A owned by TKPOA - Rock Revetment Bulkhead has failed and repairs are needed. Ala Wai Tennis Court Bathroom – [COMMON AREA] Plans completed and land coverage approved with building permit approved. Request for Proposal and bidding process conducted with RFP’s sent to 15 contractors. Received four (4) bids for project. Project is currently on hold with for Board of Directors consideration. 12. Water Quality Ramp Replacements – [WATER QUALITY] TRPA permit approved, approvals from other agencies pending. LRWQCB has required lake bed mitigation conditions for approval of this project. Project on hold due to current high lake level 13. Pavilion Pier Painting Project – Approved August 31st, 2019, Kaczmar Painting

14. East Channel Bulkhead Replacement – [COMMON AREA] Design for the replacement of the East Channel East Bulkhead. The project coordination is anticipated to take two years: 2019 — final design and permitting, 2020 –Working to coordinate with California Tahoe Conservancy (CTC) with their planned Truckee Marsh Wetland Restoration Project at the Cove sailing lagoon which is also planned for 2020. Noble Consultants – G.E.C., Inc. has been contracted for the design, the same firm that completed the 2015 Bulkhead Assessment Study. Susan Simon Environmental contracted for permitting. Under the 1991 Stipulation for Entry of Judgment the TKPOA has the authority to proceed as the lead agency and is working with the Tahoe Keys Marina and Yacht Club (TKM&YC) and Tahoe Keys Beach and Harbor Association (TKB&HA) on design. Per the Judgment: • TKPOA is responsible for 30% of replacement costs. • TKB&HA is responsible for 30% of replacement costs. • TKM&YC is responsible for 40% of replacement costs. 15. Cove 3A Bulkhead Replacement Reaches 8 & 9 – Design for the replacement of the 3A Bulkhead is moving forward in conjunction with East Channel Bulkhead Project work performed by Noble Consultants – G.E.C., Inc. Susan Simon Environmental contracted for permitting. 16. Cove 3C Bulkhead Replacement Design – Awarded to Reno Tahoe Geo Associates.

Corporation Yard Project – [COMMON AREA] Contracted David Goldman Environmental Architecture to develop conceptual plans and analysis of land usage. • Mechanical, Electrical, and Plumbing Engineered drawings awarded to Sugarpine Engineering. • Civil Engineering awarded to Tieslau Civil Engineering • Structural Engineering Calculations awarded to Tahoe Engineering Inc. • Agencies Permits by Simon Environmental Planning • Request for Proposal (RFP) sent out on August 23, 2019. Bids due September 19, 2019 18. Sea Bins – [WATER QUALITY] The Seabin is a floating collection bin that will be located in the West Channel and be used in conjunction with the Bubble Curtain. The Seabin moves up and down with the range of tide collecting all floating debris. Water is sucked in from the surface and passes through a catch bag inside the Seabin, with a submersible water pump capable of displacing 25.000 LPH (liters per hour), plugged directly into 110/220 V outlet. The water is then pumped back into the lagoons leaving litter and debris trapped in the catch bag to be disposed of properly. The Seabin also has the potential to collect a percentage of oils and pollutants floating on the water surface. 19. Tahoe Keys Lagoon Restoration Project – [WATER QUALITY] an Application for Approval to Reduce Aquatic Invasive and Nuisance Plant Species - Tahoe Regional Planning Agency (TRPA) Project Description and Application for the Environmental Impact Report (EIR) for California Environmental Quality Act, (CEQA) or Environmental Impact Statement (EIS) for National Environmental Policy Act (NEPA) is required for any action that is taken by the government or that gets governmental funding. When projects require approvals under both CEQA and NEPA, a joint EIR/EIS is prepared. Application has been submitted and EIS/EIR Stakeholder Committee and Stakeholder Consultation Circle meetings are being held. Process is funded through grants obtained by the TRPA through the U.S. Army Corp of Engineers.

Completed Projects:

1. Security Truck Replacement – [COMMON AREA] During a snowstorm on January 6th 2019, a tree fell on top of the Security GMC truck while it was parked at the Pavilion Office parking lot. TKPOA's insurance company deemed the vehicle a total loss. A used 2010 Chevrolet Silverado 1500 4x4 Truck was approved for purchase for $25,437. 2. Laminar Flow – [WATER QUALITY] Laminar flow aeration (LFA) is a technology used for improving water quality in waterbodies where there is consistently low dissolved oxygen and buildup of fine organic sediment. The technology uses microporous ceramic disks that are placed throughout the area to be aerated. These disks Keys Breeze

are connected by self-sinking hoses connected to an air compressor. Air is pumped through the system creating an abundance of bubbles that rise and create laminar flow and provide oxygenation to the bottom of the water column where dissolved oxygen is typically the lowest. The LFA system will be installed and monitored to determine the ability of the system to do the following: • Increase the dissolved oxygen (DO) levels at the sediment/water interface. • Reduce the percent Organic Matter (OM) in the sediments under which the LFA system is deployed. • Promote circulation in the water column and decrease the amount of algae present, potentially preventing harmful algal blooms. • Increase bottom hardness by reducing OM content. Pipestone 3 East Community Dock Replacement – This project is a required a special assessment vote of the Five Property Owners a new dock with improved dock materials and has been installed by Shoreline Engineering for $59,753. 4. Bavarian Isle Bulkhead Emergency Repairs/ Replacement Project – Plans and analysis for collapsed bulkhead at 1975, 1979 Garmish Court and TKPOA Water Quality ramp at 1981 Garmish Court, awarded to Noble Consultants-G.E.C., Inc. Project awarded to Tahoe Marine and Excavating for estimated Total 209.8 ft. at $2,161/ft. = $453,440. 5. Islanders 2 – Siding Repairs and Staining Project Building 1 & 2 awarded to Kaczmar Painting for $116,930. 6. Outdoor Pool Kitchen and Bathrooms Water Heater Replacement Project – Awarded to Lake Tahoe Plumbing and Heating for $3,960. 7. Cove 1 Parking Lot Replacement Project – Awarded to Blacktop Paving for $85,359. 8. Cove 1 Parking Lot Striping – Awarded to Western Paving for $1,302. 9. Cove 2 Parking Lot Sealing and Striping Project – Awarded to Alcorn Engineering for $8,510. 10. Cove 2A Parking Lot Striping Project – Awarded to Western Paving for $1,029. 11. THE TKPOA ARCHITECTURAL CONTROL DEPARTMENT (ACD) would like to remind you of a few

tips for keeping your home and family protected now that the cold weather has arrived.

• When you are not at your home, keep your thermostat on 55 degrees. Broken pipes are common this time of year. • Sprinklers and any landscape irrigation should be shut off. • Carefully check all windows and doors before leaving your home. High winds may cause a window to blow open. • Be sure your crawl space is sealed off and secure. Bears are looking for a cozy spot under your house to hibernate. Pine Sol is the best deterrent. • Please keep your friends, family and pets off the ice in the lagoons. It may seem thick enough to walk on, but with fluctuating temperatures it’s not. • If you are leaving a boat in the water all winter, please winterize and adequately secure your boat to the dock. Sinking and/or drifting boats are not uncommon this time of year. Also, only white shrink-wrap is allowed if the boats are to remain docked. • If you are going to be gone for an extended period of time, please fill out a vacation check form. This information alerts the Security Department to pay special attention to your property. Pavilion Beach Shoreline Protection Railing – [COMMON AREA] This project is to protect Pavilion Beach to reduce loss of property due to ongoing erosion during periods of high lake levels. Additional railing at pier at pavilion installed awarded to Alpine Metals for $7,487. Landscaping at the pavilion completed by TKPOA Staff. 32. Pavilion Parking Lot Striping – Awarded to Western Paving for $1,175. focus on improving water quality within our waterways, rising staff and insurance cost, providing safe drinking water, and maintaining our aging infrastructure. The Board of Directors understands and appreciates these challenges and know we have to manage our resources prudently. Our Association needs your help in achieving our goals. Firstly, I urge you to get involved, attend a Finance Committee Meeting, Water Quality Meeting, or a Board Meeting. Our community is made up of extremely intelligent and gifted individuals, of many professions, and our committees and our Board need your expertise and ideas. Second, without feedback and dialogue from its members, no Board can be successful. I encourage you to reach out to a Board Member, or our TKPOA Staff, and let us know what direction you would like to see our Association take and where you would like to see improvements.
