Lake Tallac
The Board completed the purchase of Lake Tallac over two years ago and since that time we have been working to legally separate the “lake property” from the Lot on Dover Ct. By separating Lot 1, we could then annex the remaining “lake property” to our Water Company property located on Texas Street. This would simultaneously free up Lot 1 for use by the HOA as either common area development potential or for sale to a 3rd party to recoup a portion of our purchase expenses, this is a choice that would be subject to a member’s vote. If the HOA retained Lot 1, we could develop it as a community park with amenities for members to use. We could also install some storage racks for members to rent for storage of their kayaks or paddle boards, which would be a stream of revenue for the HOA. And I expect that there will be many options suggested in the future. Hopefully this will be going out for a vote soon. We have had some delays that were out of our control. Look for this in the near future.
CTC Land Exchange
We seem to be just about on schedule to get this property exchange closed before my term ends. After that it will be up to other board members to move it forward with the planning and construction on the site which could include, in addition to our maintenance and landscape staff’s needs, but also a building to accommodate some of our current staff personnel offices. This, in turn, could lead to the redesign/replacement of the Pavilion to increase its

Learning Funds Donated
n behalf of the Tahoe Chamber’s Leadership Lake Tahoe Class (LLTC) of 2018, I am proud to announce we have raised over $10,000 in donated funds from the local South Lake Tahoe Community. The LLTC held a successful fundraising campaign and event on Thursday May 10th at Lake Tahoe AleWorX with a kid-friendly event, that featured a raffle, live music, and S.T.E.A.M. activities. I would personally like to thank those Tahoe Keys Property Owners Association (TKPOA) property owners, TKPOA staff and related contractors that donated to the program. Thank yous go out to: Bonnie Halleran, Kirt Willard, Susan Chandler, Pat and Chris Disney, Andy Kopania, Dr. Lars Anderson, Don Havard, Heather Houston, Lisa Suela, Tom Callahan and Linda Callahan. With these donations the TKPOA property owners, TKPOA staff and related contractors represented the largest group donation calculated. Each year, the LLTC must complete a group project aimed at benefiting the local community. The 2018 LLTC decided to raise funds to elevate S.T.E.A.M. in LTUSD Elementary Schools, working with the Lake Tahoe Education Foundation! S.T.E.A.M. is an educational approach to learning that uses Science, Technology, Engineering, the Arts and Mathematics as access points for guiding student inquiry, dialogue, and critical thinking. The LLTC raised over $10,000 in donated funds for new microscopes to advance K-5 S.T.E.A.M education in our community!

WATER QUALITY SPECIAL ASSESSMENT Forecasted Year End for 2018

S
ince the Tahoe Keys Property Owners Association (TKPOA) positive majority vote on RESOLUTION TKPOA #2017-001 for the “Authorization to Pursue Regulatory Approvals for the Use of Aquatic Herbicides to Control Aquatic Invasive Weeds in the Tahoe Keys Lagoons, and the Water Quality Special Assessment”, the TKPOA Water Quality Committee (WQC), TKPOA staff and contracted consultants have been hard at work on moving this process forward. This positive vote authorized the Board of Directors to approve a Special Assessment of not more than $1,600 per property to fund the actions necessary to obtain regulatory approvals to use aquatic herbicides. This positive vote allowed the Board of Directors to collect and bill for the “First Payment of the Special Assessment” of $400 in June 2017. This “First Payment” generated $611,600 in funding for this project. To report and account for this Special Assessment
funding through the end of the fiscal year end as of December 31st, 2017, an article was provided in the April 2018 issue of Keys Breeze. As reported on December 31st, 2017, there is a balance of $208,574 of the Special Assessment funds still available for this project. Based on these remaining funds or “Carry Over” funds the Water Quality Committee determined the best utilization of funds for 2018 with the work and projects at hand and in the near future. Based on the TKPOA property owners voting for this, these funds should be spent for planning and activities related to the pursuit of the Small-Scale Herbicide Test permit as required. The following table documents the commitment of these “Carry Over” funds for the remainder of the 2018 Fiscal year with approved contracts with Sierra Ecosystem Associates (SEA), Freshtracks and Dr. Lars Anderson. All of these scopes of work and related contracts have been reviewed by the Water Quality Committee, TKPOA staff and approved by the Board of Directors. These contractual commitments will exhaust the 2017 Water Quality Special Assessment first payment.

THIS POSITIVE VOTE AUTHORIZED THE BOARD OF DIRECTORS TO APPROVE A SPECIAL ASSESSMENT OF NOT MORE THAN $1,600 PER PROPERTY TO FUND THE ACTIONS NECESSARY TO OBTAIN REGULATORY APPROVALS TO USE AQUATIC HERBICIDES.
As reported in the May 2018 issue of Keys Breeze, the Tahoe Regional Planning Agency (TRPA) has secured more than $1 million in federal funding to cover the cost of a detailed environmental review and for stakeholder facilitation related to TKPOA’s application to test herbicides to eradicate the aquatic weeds in our waterways. The contracts with SEA, Freshtracks, and Dr. Lars Anderson will enhance the technical components of our application, expand the approach to include full-scale herbicide application throughout the lagoons, and provide close coordination with TRPA and other agencies to help expedite and focus the permitting process. Consistent with the ballot language for the Special Assessment, the “Second Payment” would not be billed until TKPOA receives approval from the regulatory agencies to
commence with the herbicide testing. The status of these Water Quality Special Assessment funds is reported on each month as part of the Water Quality Financial Statements for the TKPOA and these statements are posted on the TKPOA website at www.tkpoa.com. These financial statements are discussed, reviewed and approved each month at the Finance Committee Meeting, and Board of Directors Regular Meeting and both meetings are open to property owners. T
he ACC rule regarding boat dock size states in the TKPOA Boat Dock Application (Form 13) page 2, under Dock Guidelines: For new construction, various dock configurations and dimensions can be considered, but will not exceed 225 sf. Height: 18 inches above water level or high water mark. Fascia will extend from decking to not less than 8” above the water line. All pilings must be contained within the dock. The height of all pilings must not exceed 3 ft. above the high water line (HWL). Dock pilings must be a minimum of 2 ½” in diameter. Proposed and replacement dock plans must conform to the 225 sf rule even if the existing dock is larger than 225 sf. This rule is supported by the Tahoe Keys Property Owners Association (TKPOA) CC&R’s Article VII Section 14 Nonconforming Use of Properties, paragraph c Nonconforming Structures (i) (ii) (iii) pages 36 & 37 and reads as follows:
Repair and Maintenance
(i) Repair and Maintenance. A nonconforming residence, out building or other structure or portion thereof (collectively, “structure”) may be maintained or repaired without the necessity of complying with the Governing Documents, so long as during, any period of 12 consecutive months such repair and maintenance does not exceed percent of the current replacement cost of the nonconforming structure. Any repair or maintenance of the structure or maintenance of the structure which exceed 25 percent of the current replacement cost of the structure shall conform to the Governing Documents as then in effect.

(ii) (ii) Enlargements. A structure nonconforming as to use, may not be added to or enlarged unless such nonconforming structure, and the additions and enlargements thereto and the use thereof, are all made to conform to the Governing Documents as then in effect. (iii) Restoration. A nonconforming structure which is damaged or partially destroyed by any reason to the extent of not more than 50 percent of its value at that time, may be restored to the occupancy or use of such structure or part thereof, which existed at the time of such partial destruction, may be continued or resumed, provided the total cost of such restoration does not exceed 50 percent of the value of the structure at the time of such damage and that such restoration is started within a period of one year and is diligently prosecuted to completion. In the event such damage or destruction exceeds 50 percent of the value of such nonconforming structure, no repair or reconstruction shall be made unless every portion of such structure is made to conform to all Governing Document regulations for new structures of similar nature. The value shall be made by the Architectural Control Committee, in its sole discretion, although the owner of the affected lot shall be entitled to submit to the Committee evidence on the valuation issue. This rule also conforms to the Tahoe Keys Property Owners Association Dock and Over-Water Platform Matrix provided to the ACC by TKPOA legal counsel. he Water Quality Committee and the Water Quality Staff have been proactive in the planning and preparation of our waterways since last year’s Harmful Algae Bloom (HAB). Water quality sampling and monitoring has already begun for this season. Unfortunately, the TKPOA is at the infancy stages of experiencing another algae bloom for this season in the West Channel, East Channel and Lake Tallac. Our sampling results show that the bloom is a type of cyanobacteria that is primarily composed of Dolichospermum. This cyanobacteria is capable of producing toxins, but only low levels of Anotoxin-A have been detected. TKPOA has contacted the appropriate authorities, including the Lahontan Regional Water Quality Control Board (LRWQCB).

LRWQCB has recommended the placement of signs around the Tahoe Keys (see below) and regular monitoring of the bloom.

4 Avoid contact with algae or scum in the water. 4 Keep children away from algae or scum. 4 Fish caught in these waters should be cleaned with tap or bottled water. Guts should be thrown away. 4 Do not let pets come into contact with algae/scum, drink the water or eat the scum on the shore. 4 Do not drink lagoon water or use for cooking. 4 Do not eat shellfish from the lagoons. NOTICE OF CHANGE IN ASSOCIATION RULES

(The entire text of the proposed Rules for Cove Advisors and Cove Advisor’s Committee Changes are new additions to Association Operating Rules)
O
n May 19th, 2018, the TKPOA Board of Directors approved the following changes to the Rules of the Cove Advisors and Cove Advisor’s Committee for a 30 day membership review period. These rules will be considered for adoption at the July 21st, 2018 Board of Directors Meeting. If you would like to provide any feedback to the Board prior to approval, please email your comments to Heather Houston, Operations Manager at HHouston@tahoekeyspoa.org, or submit them in person at the TKPOA Pavilion Office. PURPOSE AND EFFECT OF PROPOSED RULE CHANGE To further clarify rules of the Cove Advisors and Cove Advisor’s Committee The following text includes rules that have been enforced for several years by the Tahoe Keys Property Owners Association (TKPOA). The Board of Directors has approved these rules to go through the 30 day member review period to ensure the proper rule change procedure has been followed. The Advisor’s Committee is a standing Committee, established by the TKPOA Bylaws, Article X, Section 1 (c). The Committee shall serve the Board of Directors and is comprised of community volunteers. Due to the diversity of architectural designs, competing property use demands and other local concerns within the various subdivisions comprising Tahoe Keys, the Board shall be served by a Committee of subdivision advisors, with each subdivision represented by no more than two advisors who shall be property owners within the subdivision they represent. The duties, authority, and responsibilities of the advisors shall be as set forth in the Association Rules. 1. The Committee shall have no more than two advisors per subdivision. Owners must meet the following criteria to serve as an advisor: a. Must be an owner of record in the subdivision they represent b. Must be an Association member in good standing c. Must be able to commit to the time necessary to fulfill advisors duties as set out in these rules d. Must be approved by the TKPOA Board of Directors by motion at a regular Board Meeting 2. If a subdivision has more than one advisor, one shall be appointed as the Key Advisor and shall be the only advisor entitled to vote from their subdivision. may, in the Key Advisor’s absence, function as the Key Advisor at meetings. 3. An advisor may be removed by majority vote of the owners of their subdivision or by a petition signed by more than 50% of the owners of record of the subdivision or by Board motion at a regularly scheduled Board meeting. 4. Advisors Committee vacancies can be filled by a subdivision owner volunteer or by nomination. Criteria outlined above must be met. 5. Meetings for the TKPOA Advisor’s Committee shall be: a. Held quarterly at times set forth by the Committee Chair and Co-Chair at the Pavilion Office b. Special meetings of the Advisor’s Committee may be held by majority vote c. Open to all TKPOA members 6. The Chair and Co-Chair of the Advisor’s Committee shall be appointed by majority vote of the Committee during the July Committee meeting and shall serve two year terms. Nomination and voting for the Chair and Co-Chair shall be completed at the same meeting. a. The Chairperson’s duties shall include: 1. Prepare meeting agendas 2. Conduct meetings 3. Prepare reports of actions and recommendations to the Board of Directors 4. Take minutes of the meetings or supervise the recording of the minutes b. The Co-Chairperson’s duties shall include: 1. Assist the Chair as needed 2. Take over duties in the absence of the Chair 3. Take minutes of the meetings or supervise the recording of the minutes 7. Voting on all issues brought before the Advisors Committee shall be by subdivision. One vote may be cast per subdivision by the Key Advisor. The CoAdvisor may cast a vote in the absence of the Key Advisor. 8. Subcommittees, if required, shall be appointed by a majority vote of the Advisors Committee. 9. All proposed or requested actions approved by the majority of the subdivisions represented at the Advisors Committee meeting shall be reported to the Board of Directors for their review and action as they deem appropriate. 10. The Advisors Committee and the individual advisors shall follow and adhere to the TKPOA Governing Documents, Board Policies, and Association Rules as they are amended and approved.
11. Minutes shall be taken at every Advisors Committee meeting and copies furnished to the TKPOA Administrative Assistant for inclusion in records and Board meeting packets. 12. Duties and responsibilities of advisors include: a. Communicate with subdivision owners a minimum of once per quarter on current events, projects, updates, etc. in the subdivisions b. Solicit input from subdivision owners on items of concern c. Call meetings of subdivision owners when necessary d. Report maintenance, repair, or other property issues to the attention of the General Manager, Maintenance Manager, Board, or other TKPOA Committees as appropriate e. Consult with Accounting Manager on available funds prior to starting any repair or maintenance project f. Complete and approve work orders for required maintenance and repairs within the subdivision g. Forward projects requiring Architectural Control Committee (ACC) approval to the ACC with properly completed applications, plans, etc. h. Conduct poll or vote of subdivision owners on proposed aesthetic changes to building exterior or Subdivision grounds as required by the TKPOA governing documents i. Review and approve subdivision project change orders and modifications j. Approve and renew on-going operational contracts such as snow removal, landscape, and painting that are covered under the subdivision’s budget and do not require additional assessments within the subdivision 13. Advisors are prohibited from the following: a. Contracting or committing the subdivision to an expenditure over $2,500 without prior Board approval b. Directing the work of Association employees c. Making approved contract or plan changes for projects over the $2,500 limit without prior Board approval d. Approving changes or modifications to Common Area property without prior Board or ACC approval 14. Changes or amendments to these rules may be recommended by Advisors to the Committee for consideration. Final review and approval is required by the Board of Directors, who may also make necessary changes at any time pursuant to the rule making authority provided in the TKPOA governing documents.

ACC Rule of the Month:
Vehicle, Boat, Trailer and Parking Restrictions By Linda Callahan, Architectural Control Department Manager
T
his is the time of year when summer preparations are in full swing. As stated in the TKPOA CC&Rs Article VIII, Section 12, Vehicle, Boat, Trailer and Parking Restrictions, the following restrictions shall apply to the use, storage or parking of boats, trailers and vehicles within the properties: (a) House trailers, motor homes, boats, campers recreational vehicles, commercial vehicles, vehicles having a gross weight in excess of one ton, motorcycles, bicycles, vehicles undergoing repairs and trailers may only be parked or stored within the properties in an enclosed garage except that such equipment may be parked for periods of short duration for purposes of loading and unloading and the Association shall be entitled to implement a guest or visitor pass system to permit owners or tenants and the guests and visitors of owners or tenants to park campers or motor homes within the Properties for periods not to exceed seven days. (b) Garages are to be used for the parking of cars, boats, trailers or similar items for storage purposes, and for no other purpose. Garages are not to be converted for any type of living space or utilized in any way which prevents the parking of vehicles in the garage space. (c) The guest parking areas within any subdivision are to remain open for guest parking for the benefit of guests of owners within the subdivision and are not to be used for the parking of boats, trailers, campers, or other recreational vehicles. No house trailers, campers, motor homes, vans, privately owned passenger trucks of any size or design, boats, or boat trailers shall be parked or maintained outdoors on any lot. Keys Breeze

(d) Except as otherwise provided in section 12 all vehicles (including 2- wheel vehicles) are to be parked within designated parking areas, driveways, carports or garages. Any vehicle parked within the properties shall be in running condition. (e) No motor vehicle shall be constructed or reconstructed within the properties and dilapidated or inoperable vehicle including vehicles without wheel(s) or an engine, shall be stored on the properties; provided, however, that the provisions of this subparagraph shall not apply to expeditious vehicle repairs or routine tune-up maintenance performed within a garage. (f) No parking of any vehicles or trailers shall be allowed on unimproved lots, unpaved areas or dirt areas, except as approved by the Board and authorized in the Association Rules. (g) The Association Board shall be entitled to adopt uniform rules, not inconsistent herewith, to further regulate and define the use and parking of vehicles within the properties or within particular subdivisions. Without limiting the foregoing, said rules can impose a schedule of fines and a towing policy for vehicles parked in violation of these restrictions or any duly enacted Association Rule. If you have been or were planning to store your boat in the Keys, you will need to make arrangements for boat storage off property. If we discover a boat stored on any property, we will begin the violation process which can lead to fines until the boat is removed. Water Quality Committee Members Needed
T
he Tahoe Keys Property Owners Association Water Quality Committee (WQC) is seeking additional members. This volunteer committee drives strategy and recommends to the board actions pertaining to water quality in the Tahoe Keys— predominantly weed management and the PCE plume. Ideal candidates would have interest or expertise in environmental sciences, experience with local agencies or other scientific background. Commitment includes a monthly Committee meeting, the review of technical documents and potential attendance of key local agency meetings when Tahoe Keys related items are up for decision. Average commitment 6–10 hours a month. To date the Committee has been responsible for managing consultants and Association staff regarding weed harvesting, landscaping and irrigation rules to improve water quality, developing and implementing agency-required plans for aquatic invasive plants and water quality, and the PCE plume. The work of the Committee is entering a critical phase in navigating numerous agencies toward potential approval, with an end-goal of a weed management plan that will greatly reduce the infestation, improving our water ways, recreation and enjoyment of the Tahoe Keys. NOTICE OF CHANGE IN ASSOCIATION RULES

O
n May 19th, 2018 the TKPOA Board of Directors approved the following changes to the Owner, Renter, and Vacation Renter Policy, Rules, and Regulations for a 30 day membership review period. These rules will be considered for adoption at the July 21st, 2018 Board of Directors Meeting. Purpose and Effect of Proposed Rule Change To further clarify the Owner, Renter, and Vacation Renter Policy, Rules and Regulations Whereas, the Tahoe Keys is a private family-oriented, residential community that is located in a scenic and quiet environment. The close proximity of the residences in the Tahoe Keys increases the likelihood that disruptive behavior will impact other residents; and Whereas, the Tahoe Keys is administered and managed by a Property Owner’s Association, herein referred to as ‘TKPOA’; and Whereas, a large number of properties within the Tahoe Keys are offered as short term vacation rentals through Vacation Rental Agencies and/or Vacation Rentals by owner or through other agencies or by other methods; and Whereas, the City of South Lake Tahoe has a Vacation Rental Ordinance as set forth in Article XIII of Chapter 28A of the City of South Lake Tahoe Code. This ordinance is intended to address problems involving excessive noise, disorderly conduct, vandalism; overcrowding, traffic, congestion, illegal vehicle parking and accumulation of refuse at vacation home rentals and some of these problems have impacted Tahoe Keys. Anyone who leases Keys Breeze

their property in the City for short-term rentals is required to register and obtain a license from the City and must comply with the following regulations ("Vacation Rental Restrictions"): • No more than two people per bedroom plus four additional people are allowed to remain overnight [unless as otherwise restricted by Cove rules]; • The number of parked vehicles is controlled and signage inside and outside the home must be posted setting for the parking requirements; • The owner or the owner's agent must be available for immediate contact; • The property may not be used for commercial activities such as weddings, receptions or large parties; • Licenses must be reviewed annually. Violation of the City of South Lake Tahoe Vacation Rental Restrictions may subject the owner to penalties and fines; and Whereas, the TKPOA Governing Documents provide TKPOA with the authority to fine and impose other disciplinary actions on property owners for violation of the TKPOA governing documents by themselves, their tenants and vacation renters; and JUNE 2018

Whereas, the TKPOA CC&Rs prohibit conduct, which violates statutes, ordinances and laws, which includes the Vacation Rental Restrictions imposed by the City of South Lake Tahoe; and Whereas, the activities of owners, renters, and vacation renters frequently interfere with the quiet enjoyment of nearby residents in the community; and Whereas, the goal of implementing this policy, and rules and regulations, is not to punish owners that are using their properties as rentals, but rather, it is intended to modify the behavior of the renters to be more respectful of the TKPOA's community, to observe the rules and regulations, and to create a peaceful environment; and Whereas, TKPOA incurs substantial costs in dealing with monitoring and enforcement of TKPOA governing documents; Now Therefore, TKPOA hereby adopts the following Policies, Rules and Regulations: 1. All owners of short-term vacation rentals in Tahoe Keys must register with the TKPOA administrative office and secure an annual “TKPOA Rental Permit” for their property in order to operate a vacation rental property within the Tahoe Keys. The permit, which has an annual fee, must be displayed in a front window of the rental property. Permits are not transferable. Nuisance violations will be tracked on a rolling 24 month period. Failure to register a vacation rental with the TKPOA administrative office is a violation, and subject to potential member discipline and fines. 2. All owners, renters, and vacation renters in Tahoe Keys must comply with the City's Vacation Rental Ordinance. 3. All owners, renters, and vacation renters must comply with the TKPOA governing documents including provisions which prohibit "nuisance" behavior and set forth rules concerning vehicles, boats, trailers, parking and use of docks and lagoons; 4. Each vacation rental shall have and display a Rental Placard which may be obtained from the City of South Lake Tahoe; 5. No home may be rented to nor used by more than two (2) people per bedroom plus four (4) additional people [unless otherwise restricted by Cove Rules]; 6. The number of vehicles shall not exceed the number set forth in the City of South Lake Tahoe Rental Placard and shall only be parked in spaces designed for the unit being rented; 7. Trash Disposal: a. Townhouse dumpsters are for the exclusive use of the townhouse owners and their authorized renters. Only household trash can be placed in the Townhouse
dumpsters, no large items may be disposed of in these dumpsters. b. Owners of single family homes are reminded that curbside trash is on Fridays and are responsible for informing their renters and guests to not place trash at the curb prior to the scheduled pick-up day. Trash containers may not be placed at the curb until 6:00am Friday morning. Owners will be financially responsible for any trash left out early that has to be picked-up by Association Staff at the current rate of $75.00. Owners may also be subject to a fine of $250.00 for violation of trash pick-up rules. c. Owners may place two bags of household trash per week in the dumpsters located in the parking lot of the Pavilion Office. Rental and cleaning agencies hired by homeowners may not utilize these or the townhouse dumpsters. No large or construction debris may be placed into or left next to the Pavilion dumpsters. Owners may be subject to a fine of $500.00 for improper or prohibited use of Association dumpsters. 8. Tahoe Keys has adopted this Policy for enforcement of following our Rules and Regulations; the following conduct is prohibited: a. Excessive, disruptive or objectionable noise including noise levels in excess of what is permitted by applicable laws after 10:00 p.m. on weekdays and weekends; b. Use of pools, spas, and hot tubs with the use of jets, blowers, and other mechanical elements that produce noise are prohibited between the hours of 10:00 p.m. and 7:00 a.m.; c. Speeding in excess of 5 miles per hour (mph) or causing a wake which could cause damage to adjacent properties while in a TKPOA lagoon or waterway; d. Loud music from a watercraft while in the TKPOA lagoon or waterway; e. Indecent exposure; f. Trespassing, including but not limited to boat docks; g. Drunk or disorderly conduct; h. Destruction of private property; i. Harassment of residents or TKPOA staff or other conduct that is an unreasonable annoyance to the neighborhood; j. Allowing dogs to be "off leash" and failure to pick up and properly dispose of pet waste. 9. In the event TKPOA determines that a potential violation of this Policy has occurred, the owner and if applicable the tenant will receive a notice of hearing as provided in the TKPOA governing documents – and as more specifically described in the attached.

A
s summer is approaching we would like to remind all property owners of the rules associated with the use of the gate at Lighthouse Shores (LHS) Lot C, and Lot A. Through recent Tahoe Keys Property Owners Association (TKPOA) Security Patrols there have been numerous violations of this Superior Court Case SV-92-0066 Judgement of TKPOA Property Owners and their guests in violation of the following: • Bringing dogs or other pets into LHS Lot C and Lot A on or off leash. • Allowing guests or vacation renters to use their TKPOA Member Photo ID card for access to LHS Lot C and Lot A without the immediate presence of the TKPOA Member. • Trespassing on the adjacent LHS Properties, by walking past posted “No Trespassing” Signs.
The Rules
The rules are straightforward TKPOA Members should observe the following provisions pursuant to Superior Court Case SV-92-0066: • TKPOA Members with a valid TKPOA Member Photo ID card and guests in the immediate presence of their sponsoring member will be permitted access. Access is only permitted to TKPOA property owners using the photo Member Access card issued by TKPOA. This card is not transferrable; it is not to be loaned or used by anyone other than the property owner to whom it is issued. If you have lost your card or wish to have another one issued, please visit our office. • There are no dogs, or other pets or bicycles allowed, no exceptions. This is clearly posted on the gate and there are bike racks inside the gate. • Access through this gate is allowed from 7:00 a.m.–9:00 p.m. except during the summer, during which time the hours will be extend to 10:00 p.m.

No Dogs or other pets allowed in LHS. Based on TKPOA Security Patrols and pedestrian gate Member Card reader identification system, the TKPOA has issued warning notices to those members that have accessed the LHS pedestrian gate with dogs. The TKPOA Board of Directors will continue to utilize the Member Discipline process in accordance with Civil Code Section 5855 and TKPOA Bylaws Article VI, Membership Rights Section 5, Article IX, Duties and Powers of the Board Section 1(r), and TKPOA Declaration of Covenants, Conditions and Restrictions (CC&R’s) Article XII, Breach or Default, Section 6 (a-f), to enforce this Superior Court Case SV92-0066 Judgement, related governing documents and rules. Please remember dogs must be on leashes throughout the TKPOA per El Dorado County Ordinance Title 6 – Animals, Chapter 6.04. General Provisions, Section 9.46.600. No Tresspassing
When entering through the LHS pedestrian gate, you are on Lot C which is a narrow lot with Pope Marsh on the left and private residences on the right. TKPOA does not own the properties to the right of Lot C. This is private property and No Trespassing per California Penal Code 602PC. The City of South Lake Tahoe Police Department will be called for trespassing on these properties. The TKPOA has clearly marked the property lines on the right of the lot. The left side of the lot has a chain link fence all the way down to the beach on the Pope Marsh side. Lot C can be used to access Pope Marsh on the left, however access to the beach on the right is prohibited as this is private property and to do so is considered trespassing (CA 602PC). Access to the right is also a dead end at the West Channel Bulkhead. During Lake Tahoe high water events like we are currently experiencing there is typically no Public Trust beach access. To access Lot A at the end of the LHS roadway at the West Channel Bulkhead, you should walk down the LHS paved roadway. The TKPOA is requesting that all property owners please respect these rules so that we can all enjoy this privilege of accessing Lot C and Lot A. Continued
violations and flagrant abuse of these rules could result in legal claims against the TKPOA and potential gate closures. Pursuant to the Superior Court Case SV-92-0066 Judgement the TKPOA is responsible for the maintenance and security obligations in enforcing this judgement, and at this time the enforcement of these violations including trespassing violations on the adjacent LHS property will be pursued. The LHS pedestrian and vehicle gate are under continuous surveillance and all TKPOA Member Photo ID Card access is recorded so it is easy to track any violations. Once the violations are identified with the responsible Property Owners through the Member Discipline Hearing process, TKPOA Property Owners could face their individual and property Member Photo ID card access privileges suspended, Member Photo ID Cards confiscated, and potential fines. NO Phosphorus Fertilizers By Linda Callahan, Architectural Control Department Manager
I
n 2015, the Tahoe Keys Property Owners Association (TKPOA) adopted new restrictions for the use of landscape fertilizers in the Keys. On December 18, 2015, the Board of Directors voted to adopt these changes. The additional language was added in order to restrict the use of fertilizers that are phosphorous based as recommended by the TKPOA Water Quality Committee. These fertilizers are partially responsible for the escalated growth of invasive aquatic weeds in our lagoons. Section 10 Item 10.15 of the Architectural Control Rules Brochure reads as follows: Do not over water or fertilize. Under no circumstances may phosphorous based fertilizers be used. (The middle number on bags of fertilizers must be zero.) Homeowners are responsible for the products used by their landscapers. The following are Tahoe Regional Planning Agency’s fertilizer guidelines. The Tahoe Regional Planning Agency (TRPA) recommends the use of phosphorus-free fertilizer except when establishing new turf from seed. Tahoe soils have adequate phosphorus for turf for many years. The label on a fertilizer bag shows the percentage of the primary plant nutrients as a string of three numbers. These numbers indicate the percent by weight of nitrogen (N), phosphorus (P) and potassium (K). Look for a fertilizer in which the middle number is 0. t the April 21st, 2018 Executive Session the Tahoe Keys Property Owners Association (TKPOA) Board of Directors decided to adjust the Regular Board Meeting start time to 3:00 p.m. for the Board meeting schedule for the remainder of the 2017–2018 Board Term that ends September 2nd, 2018. By moving this start time, the Board of Directors will be allowed more time for Executive Session. The plan is to conduct these Executive Session meetings from 9:00 a.m. until 3:00 p.m., to end prior to the start of the Open Board Meeting at 3:00 p.m. The revised schedule is as follows:

I
n accordance with the Bylaws of the Tahoe Keys Property Owners Association (TKPOA), the 55th, Annual Meeting will be held on Sunday September 2nd, 2018 at 9:00 a.m. at the TKPOA Pavilion, in South Lake Tahoe. The TKPOA Board of Directors for the 2018–2019 Fiscal Year will be seated at the meeting. The TKPOA is always looking for Association Director Candidates to run for election. To be an effective homeowners association the TKPOA needs a strong Board of Directors that understands its role and pursues it with passion and a concise mission in mind. Do you have what it takes to be a TKPOA Association Director? Members of the TKPOA Board of Directors serve without compensation: They are Volunteers. They are Members in good standing which means an Association Member in good standing whose rights have not been suspended by the Board for the failure of a person to comply with Association rules, the Bylaws or the CC&Rs, including, but not limited to, the failure to pay delinquent Association general and special assessments or fines. To form an effective TKPOA Board, Directors must have a clear understanding of the strengths and weaknesses of this Association, its history and what is to be accomplished. The TKPOA Board of Directors is responsible for its assets as well as its operation in accordance with standards established by state and federal law, local ordinances, and the governing documents upon which its was created on November 20th, 1963. In general terms, the TKPOA as functioning homeowners association is the cornerstone of this planned residential community. It brings continuity and order to the community, it preserves the architectural integrity (Architectural Control Committee (ACC)) and it maintains the common elements (including the various amenities). Properly run, this Association promotes the concept of “community” and protects the neighborhood's property values. The TKPOA collectively makes available recreational amenities and other facilities that might not otherwise be affordable or available to homeowners and residents on an individual basis by operating as a homeowner’s association. Along with property ownership comes membership in the TKPOA Association that requires financial responsibilities, individual property maintenance obligations, and a commitment to abide Keys Breeze

The Board of Directors
The Association has responsibilities for its common elements as well as the management and operation of the Association's business affairs all in accordance with standards established by the Governing Documents. To the extent that an association (in our case a non-profit 501 (c) (4) corporation) has such authority and control, it is its Board of Directors that carries out these duties and responsibilities. The TKPOA’s responsibilities include on-going maintenance functions, upkeep of the common elements, and to provide and direct TKPOA Management and Staff. The TKPOA Board's authority includes all of the powers and duties enumerated in general law, as long as these powers are not inconsistent with the provisions of the Governing Documents of the Association. To be successful, the TKPOA Board of Directors must uniformly and fairly govern the community, and it must have a reasonable level of participation by each of its Members over time.
RESPONSIBILITIES OF BOARD OFFICERS President
The President shall be elected by the Board from among the directors. He or she shall be the Chief Executive Officer of the Association and shall, subject to the control of the Board, have general supervision, direction and control of the affairs and officers of the Association. The President shall preside at all meetings of the Board, and shall have the general powers and duties of management usually vested in the office of the President of a corporation, together with such other powers and duties as may be prescribed by the Board or the Bylaws. The President will execute contracts, orders and other documents in the name of the Association as its agent. The President also assumes general charge of the day-to-day administration of the Association working with the TKPOA Management Staff and has the authority to order specific actions in furtherance of the Board's policies. The President serves as spokesperson for the Board of Directors in most matters relating to general Association business. Like all officers of the Association, the President has an affirmative duty to carry out the responsibilities of the office in the best interests of the Association. Unless otherwise specified in governing documents, the President serves at the will of the Board of Directors and can be removed with or without cause at any time. JUNE 2018

Vice President
In the absence or disability of the President, the VicePresident shall perform all the duties of the President, and when so acting shall have all the powers of, and be subject to all the restrictions upon, the President. The Vice President has such other powers and performs such other duties as from time to time may be prescribed by the Board or the Bylaws.
Secretary
The Secretary shall keep or cause to be kept at the principal office or such other place as the Board may order, a book or minutes of all meetings of directors and Members, with the time and place of holding same, whether regular or special, and if special, how authorized, the notice thereof given, the names of those present at directors’ meetings, the number of Members present in person or by proxy at Members’ meetings, and the proceedings thereof. The Secretary shall keep, or cause to be kept, appropriate current records showing the Members of the Association, together with their addresses. He or she shall give, or cause to be given, notice of all meetings of the Board required by the Bylaws or by law to be given and he shall keep the seal of the Association in safe custody, and shall perform such other duties as may be prescribed by the Board or by the Bylaws. The TKPOA Secretary Position works closely with TKPOA Staff Members assigned to assist TKPOA Board Secretary clerical responsibilities.
Treasurer
The Chief Financial Officer, who shall be known as the Treasurer, shall keep and maintain, or cause to be kept and maintained, adequate and correct accounts of the properties and business transactions of the Association, including accounts of its assets, liabilities, receipts, disbursements, gains, losses, capital, retained earnings and other matters customarily included in financial statements. The books and records shall at all reasonable times be open
to inspection by any directors or Member. The Treasurer shall deposit, or cause to be deposited, all monies and other valuables in the name and to the credit of the Association with such depositaries as may be designated by the Board. He or she shall disburse, or cause to be disbursed, the funds of the Association as may be ordered by the Board, shall render to the President and directors whenever they request it, an account of all of his/her transactions as Treasurer and of the financial condition of the Association, and shall have such other duties as may be prescribed by the Board or the Bylaws. If required by the Board, the Treasurer shall give the Association a bond in the amount requested, and with the surety or sureties specified, by the Board for faithful performance of the duties of his office and for restoration to the Association of all its books, papers, vouchers, money, and other property of every kind in his possession or under his control on his death, resignation, retirement, or removal from office. The TKPOA Treasurer works closely with and oversees the TKPOA Management Staff to insure that the financial records and reports are properly kept and maintained. The Treasurer is responsible for coordinating the development of the proposed annual budget and for preparing and giving the annual financial report on the financial status of the Association. The TKPOA Board of Directors, Secretary, and Treasurer do not have to perform the day-to-day record keeping functions of the Association. This responsibility is transferred to TKPOA Management and Staff, but the Treasurer will ultimately be responsible for insuring that the financial records of the Association have been maintained properly in accordance with sound accounting practices.
Fiduciary Relationship and Responsibility
The TKPOA Board of Directors and each officer of the Association have a fiduciary relationship with the Members of the Association. This fiduciary relationship imposes obligations of trust and confidence in favor of the corporation and its Members. It requires the Members

of the Board to act in good faith and in the best interests of the Members of the Association. It means that Board Members must exercise due care and diligence when acting for the community, and it requires them to act within the scope of their authority. The fact that the Association is a not-for-profit corporation, or that the Members of the Board are volunteers and unpaid, does not relieve them from the high standards of trust and responsibility that the fiduciary relationship requires. When a Member accepts a position on the Board of Directors, he or she is presumed to have knowledge of the duties and responsibilities of a Board Member. Board Members cannot be excused from improper action on the grounds of ignorance or inexperience and liability of Board Members for negligence and mismanagement exists in favor of the Association and the property owners. Each Board Member must recognize the fiduciary relationship and the responsibilities that the Board has to the Association and each of its Members. The Board's duties must be performed with the care and responsibility that an ordinary prudent person would exercise under similar circumstances.
A TKPOA Board Member's Role:

Operating the TKPOA as a homeowner association carries with it many of the very same duties and responsibilities as overseeing any other business. Serving as a Board Member is a valuable and rewarding experience that should be undertaken by those who see it as an opportunity to serve their fellow neighbors while protecting and enhancing the assets of this community. It is serious business, but also a task worth doing well in order to safeguard the investments of all. As a TKPOA property owner, you will be receiving a letter from the TKPOA Nominating Committee inviting you to consider candidacy as a TKPOA Board Member...Ask yourself...Do I have what it takes to be a TKPOA Association Director? I hope this helps explain roles and responsibility of the Officers of the Association, and the TKPOA Management and support staff that assists them while performing these roles. We invite your candidacy as an Association Director for the coming Fiscal Year 2018–2020 Two Year Term. The successful operation of our Association is dependent on a qualified and dedicated Board of Directors. The Board meets based on an agreed upon yearly schedule each month at the TKPOA Pavilion to conduct Association affairs and provide Members an opportunity to express their views and offer suggestions. In accordance with the Bylaws of the Tahoe Keys Property Owners Association, the Annual Membership Meeting will be held on Sunday September 2nd, 2018 at 9:00 a.m. at the Tahoe Keys Pavilion. Association Directors for the 2018–2020 terms will be seated at this meeting, and Board meeting dates scheduled. The Annual Election Voting period ends on Friday August 31st, 2018 at 3:00 p.m. On Saturday September 1st, 2018 an Open Board Meeting will be held and the ballots will be counted by the Inspector of Elections. At 1:00 p.m. on Saturday September 1st, 2018 the Director Election Results will be announced and during this Board meeting the Directors may be seated. JUNE 2018

The Finance Committee monthly meeting was not held on May 15th, 2018, due to the lack of a quorum. On May 19th, the 2017 Final Audit Report was presented to the Board of Directors, during the open board meeting, by the outside CPA firm of Gilbert Associates, Inc. value and be utilized for highest and best use for all members. The pavilion was built in the 1970’s to be used as a sales office and not constructed for long-term use.
We have been working to update our CCRs and Bylaws to comply with the changes in the laws that affect HOAs. These are our governing documents and have not been updated for over 20 years, so they are very outdated. Our attorney had recommended we complete this process as soon as possible to comply with the law, and Vice President Pat Disney has taken the lead on completing this process. We are hoping to have the completed documents ready to deliver to the members for review and vote of approval in the next couple of months. The Board has many other projects that we are also working very hard on to complete. At the last board meeting we voted not to accept the proposed “Waterway Usage Rules” that had been published in the Keys Breeze for the 30 days required review. The Waterways Usage Ad-Hoc Subcommittee and the board felt the rules as proposed needed additional review and more study of its effects, and that possible changes would be necessary before it can be finalized. The committee will continue to meet and answer any questions and concerns of members. If anyone would like to join this committee, please contact the office. We also have self-nominating forms available if you would like to run for the board this term that would begin September 2018. If you have the time and energy to work on many projects and issues that will help to enhance the Keys and keep increasing our property values, please contact the office. We need members that care about our community and are available for the required meetings, including member disciplinary hearings that we initiated a few years ago to address and resolve rental issues, and non-payment of dues which could result in the loss of member privileges. We have recouped thousands of dollars because of these hearings. It does take time and energy but can be rewarding at times. S
everal days each week, Jesse Patterson slips into the pool at the Tahoe Keys Property Owners Association to train. The deputy director for the League to Save Lake Tahoe, Patterson needs to swim a lot of laps to be ready to join his team on July 21 for one of the most iconic swimming races anywhere. Running for over 40 years, the Olympic Club Trans Tahoe Relay is one of the most unique open-water swimming events in the world. Each team of six take turns swimming legs of a 10-mile open-water course from Sand Harbor to Skylandia, without wetsuits. Last year the race attracted over 1,200 competitors from all over the country. For the past seven years, the Olympic Club and the Trans Tahoe Relay have joined together with the League to raise funds for efforts to Keep Tahoe Blue. As Tahoe’s oldest and largest environmental advocacy nonprofit, the League is a solutions-based organization, focused on advocating for sensible environmental standards backed by science and monitoring, devoted community engagement, grassroots involvement, and a collective ideology of working together to protect Lake Tahoe. For several years, Patterson and the League have been collaborating with the TKPOA to address threats to Lake Tahoe from the aquatic invasive plant infestations in the Keys’ lagoons. This year, the Olympic Club and the League have set a goal to raise $100,000 through the Trans Tahoe Relay. Several teams are swimming on behalf of the League, including a number of long-time supporters. Every dollar raised goes to support programs to protect Lake Tahoe, including efforts to combat pollution, promote restoration, tackle invasive species and protect Tahoe’s shoreline.
