his is my first President's message. I am honored to serve as Tahoe Keys Board President. Tahoe Keys is the best and most beautiful community at Lake Tahoe. Keys property owners are some of the nicest and most caring people I have met. I hope to foster continued community involvement in all Keys Association matters. I thank Bonnie Halleran, Pat Disney, and Natalie Collin for their service to the Community on the Board of Directors. It was a pleasure for me to serve on the Board with these wonderful and hard working ladies. I take over from past President Bonnie, whose leadership was an inspiration to me. Past Vice President Pat's hard work on Committees and projects improved our Community. Past Secretary Natalie provided calm and thoughtful reasoning for Board decisions. These three ladies deserve a big 'Thank You' from the entire Tahoe Keys community. "I HOPE TO FOSTER There are many challenges facing the CONTINUED COMMUNITY new Board in 2019. Annual Homeowners Picnic

W

e hope that everyone was able to make it out to the 55th Annual Homeowner’s picnic on September 2nd, 2018 from 12–4 p.m. The weather was sunny and beautiful and we had some great food and entertainment. Attendance for this year’s event was over 1,100 Tahoe Keys Property Owners Association (TKPOA) homeowners, their family members, and guests. On behalf of the TKPOA staff, we would like

to give a special thank you to all the TKPOA homeowners that volunteered for the 2018 Homeowners Picnic. Due to a lack of a community volunteer chairperson for this year’s event, TKPOA staff was tasked with the planning and operational responsibilities. Linda Callahan, Architectural Control Department Manager (ACD) assumed the Chairperson responsibilities, with Kirk Wooldridge, General Manager and Heather Houston, Operations Manager working as CoChairpersons. This year, staff contracted with Cocomo’s Catering for the first year to cater this event. Cocomo’s provided all the delicious food including freshly grilled, on-site hamburgers,

in addition to hot dogs, Garden Burgers, apple coleslaw, BBQ beans, fruit salad, and their specialty, delicious pulled pork sandwiches. This was the fourth year of continuing line reductions for check in and food lines. For the third year in a row, the beverage station included Unruly wines, sodas, a TKPOA water station and beer provided by our local restaurant and brewery, Coldwater Brewery, owned and operated by TKPOA homeowner Deborah Brown. www.tahoecoldwaterbrewery. com. Beer selections included Waterhouse Wheat, Preacher’s Pale Ale and Tahoe Cross IPA.

For check-in, TKPOA Staff designated three check-in points based on our Pavilion Beach fence entrances. Allowing TKPOA homeowners to check in by last name, as designated A-I, J-R and S-Z, expedited the check-in process and eliminated the historical line for the third year in a row. For the first time in TKPOA Annual Picnic history, local favorite band Ike and Martin performed live music, playing a great blend of

acoustic music featuring some old, some new, great harmonies and a great time. Many members also enjoyed the TKPOA corn hole game set up on the grassy area by the Pavilion. TKPOA staff was able to coordinate some great donated raffle prizes and we would like to thank raffle donors: Tahoe Yoga Shala, Chicken in a Barrel, Valhalla Tahoe, Purity Aesthetics, Tahoe Hair Company, and Aspen Hollow.

Many TKPOA staff members rearranged their schedules to accommodate the staffing requirements for

the picnic set-up and service during this Labor Day weekend. Based on our best estimate, 300 TKPOA staff hours were utilized in the planning and operations of this event. TKPOA staff was able to meet the expected requirements for this year’s picnic and keep the costs within the 2018 budgeted expense of $17,000. Thank you again to Linda Callahan for assuming the Chairperson responsibilities, Heather Houston and Kirk Wooldridge as Co-Chairpersons and TKPOA staff and homeowner volunteers for all their efforts. We hope that you and your family enjoyed yourselves and we will see you all next year. The proposed 2019 Homeowner Picnic date is Sunday, September 1st, 2019 from 12–4 p.m.

LAKE TAHOE SHORELINE PLAN NEARING FINAL VOTE Proposed fees would apply to Tahoe Keys

T The Shoreline Plan aims to improve recreation access, experiences, and safety on the lake, while protecting the environment along the shoreline.

he Tahoe Regional Planning Agency (TRPA) is nearing a final vote on a proposed Shoreline Plan nearly three years in the making. The plan will be heard by the Regional Plan Implementation Committee of TRPA’s Governing Board on Sept. 26 and could come to a final vote by the Governing Board as early as Oct. 24. If approved, the plan would take effect Jan. 1, 2019, with permitting programs beginning next spring. The Shoreline Plan aims to improve recreation access, experiences, and safety on the lake, while protecting the environment along the shoreline. It was developed through a collaborative process by TRPA and partners including the Lake Tahoe Marina Association, Tahoe Lakefront Owners Association, League to Save Lake Tahoe, Lahontan Regional Water Quality Control Board, Nevada Division of State Lands, and California State Lands Commission. “TRPA has tried and failed multiple times to update its shorezone regulations over the last 30 years,” said Joanne Marchetta, TRPA executive director. “Through this collaborative process, we have reached a plan that is fair and will benefit lake recreation and the environment at Tahoe.” The Shoreline Plan includes development caps and regulations for a limited number of new piers, boat moorings, and public boat ramps that would be authorized, and a framework for marinas to expand or reconfigure their facilities if they incorporate environmental improvements. The Shoreline Plan also proposes some fees and fee increases needed to pay for a new shoreline implementation program to ensure that structures and boating activity do not harm the environment, scenery, or recreation experiences at Lake Tahoe. The proposed fees would apply to moorings, boat stickers, and boat rental concessions, and TRPA and its planning partners are working to apportion the fees fairly to various shoreline users and structures.

The new shoreline implementation program includes boater education and enforcement of the 600-foot nowake zone to prevent unsafe boating near the shoreline in areas where motor boats, paddlers, and swimmers interact; enforcement against illegal moorings; new monitoring and control projects to prevent the spread of harmful aquatic invasive species; monitoring for noise and scenic impacts; and new provisions to keep noisy boats with aftermarket exhaust systems that exceed TRPA, California, and Nevada sound limits from operating on the lake. Some of the proposed fees would apply to the Tahoe Keys, because it has one-fifth of the total boat moorings at Lake Tahoe and these moorings contribute to overall boating activity on the lake. Homeowners in the Tahoe Keys would have to register their moorings and pay a $43 mooring registration fee each year to help support the overall shoreline program activities on the lake. This mooring registration fee would apply not only to moorings in the Tahoe Keys, but to all buoys, boat lifts, and slips around the lake. TRPA is working to create an online system to help people register moorings and pay fees more conveniently. The agency is also working to finalize a formal agreement with the Tahoe Keys Property Owners Association that would allow it to administer existing moorings in the canals and lagoons of the Tahoe Keys, as has been done in the past. t the September 15th, 2018 Regular Board Meeting, the TKPOA Board of Directors decided on Board Officer Positions for the 2018–2019 Board terms. Also at the September 15th, 2018 Regular Board Meeting the TKPOA Board of Directors decided on the 2018–2019 Board Meeting Schedule. The Board of Directors has set a new time for the Regular Open Board Meeting for the third Saturday of each month at 2:00 p.m. at the TKPOA Pavilion. Executive Sessions

Under this legislation, executive sessions are meetings that members cannot attend; members must be given notice of the time and place of an executive session, at least two days prior to the executive session (“Two Day Notice”). The Two Day Notice shall be given in the same manner that Board of Directors provide notice for open session board meetings by posting a notice in a prominent place or places within the common area and by mail to any owner who has requested notification of board meetings at the address requested by the owner (or, with the consent of the member who had requested notification of such board meetings, by email). Executive sessions of the Board of Directors are provided by statute so Boards can address issues involving privileged information and matters of a private nature. As a result, property owners do not have a right to attend executive sessions. As provided for in Civil Code §4935, boards may go into executive session for the following matters: 1. LEGAL ISSUES. Boards may go into executive session to “consider litigation,” or to discuss current litigation. 2. FORMATION OF CONTRACTS. Boards may consider matters relating to the formation of contracts with third parties. 3. DISCIPLINARY HEARINGS. Boards should meet in executive session for all disciplinary hearings or member disputes. The accused property owners are entitled to attend the executive session for that portion of the meeting dealing with the property owner’s hearing. 4. PERSONNEL ISSUES. Personal matters includes anything involving employees including, but not limited to, hiring, firing, raises, disciplinary matters, performance reviews, and adopting or amending employee policies. 5. PAYMENT PLANS. Boards may meet with property owners in executive session to discuss requests by delinquent owners for payment plans. 6. FORECLOSURE. The decision to initiate foreclosure or collection activities shall be made only by the board of directors of the association and may not be delegated to an agent of the association. The board must approve the decision by a majority vote of the directors in executive session.

Board Meeting and Committee Minutes

Minutes as a rule, should record what was done at a meeting, not what was said. (Roberts Rules 11th ed., p. 468.) Legally meeting minutes are not required to contain owner comments and should never be a transcript of every statement made by Directors and attendees. Once the minutes are taken, and are proposed for adoption they are marked to indicate draft status, and are available to Property Owners within 30 calendar days of the meeting. (Civil Code 4950) These draft minutes then go into the board packet for the next meeting for board discussion and approval. As noted above, there is no requirement that draft minutes be posted. There is, however, a requirement that they be distributed to members who request it. If and when draft minutes are posted or distributed, they should have a large "DRAFT" stamp on the page or marked "DRAFT only--not approved by the Board" or something similar to indicate the minutes have not yet been approved by the board and may contain errors. The minutes, proposed minutes, or summary minutes must be distributed to any member of the association upon request. Associations may charge for copying costs.

oard of Directors 2017–2018: The Board of Directors is charged with the ultimate responsibility and authority for operation of the Tahoe Keys Property Owners Association (TKPOA) on behalf of the Property Owners. It is the role of the Board of Directors to guide the setting of the policies, standards, procedures, programs and budgets for the Association. I would like to recognize some of these accomplishments that occurred during the September 2017 to September 2018 Board Term. Update

on Plans to Combat Weeds in the TKPOA Lagoons By Andy Kopania, Chair TKPOA Water Quality Committee

A

s aquatic invasive plants have increasingly become an urgent, Lake Tahoe-wide threat to water quality, the environment and the economy, the Tahoe Keys Property Owners Association has been hard at work on implementing strategies to control the plants both today and well into the future. As the Chair of the Water Quality Committee I wanted to give an update to the members as to where we are at in the process.

As part of the Waste Discharge Requirements (WDRs) issued to TKPOA by the Lahontan Regional Water Quality Control Board (Lahontan), we have prohibited the use of phosphorus-containing fertilizers, encourage the reduction of lawn irrigation, and have conducted “lunch and learn” seminars for contractors to educate them on ways to reduce the release of nutrients and other contaminants (e.g. from construction work or from draining spas) into our lagoons.

Laminar Flow Aeration

We are also in the process of applying for permits from various regulatory agencies to test a technology called Laminar Flow Aeration (LFA). LFA involves bubbling air through several small diffusers on the bottom of the lagoons. The air bubbles cause the water to circulate, increasing the amount of oxygen at the bottom of the lagoons, which in turn changes the form of some of the nutrients in the sediment and “muck”. This change is intended to make the Keys Breeze

nutrients less available for the weeds, which should reduce the rate and amount of weed growth in the area of the LFA test. The test will be conducted in the lagoons adjacent to Christie Drive, north of Venice Drive. TKPOA has received financial support for this project from The League to Save Lake Tahoe. Before we can start this test, we need to receive permits and regulatory approvals from the Tahoe Regional Planning Agency (TRPA), the California Department of Fish and Wildlife, the U.S. Army Corps of Engineers, and Lahontan. The number of regulatory approvals needed for this simple test illustrates some of the challenges that TKPOA faces in finding and implementing solutions to the aquatic invasive weed infestation. A similar test was recently approved and installed at Ski Run Marina so we are hopeful that we will also receive approval soon.

Plans for the Future

While we are committed to non-chemical methods for long-term control of invasive plants; the reality is that the current approved methods are not enough to reduce the infestation to the point where those methods can keep up with the growth across the 170 or so acres that make up our lagoons. To get the plant growth to a level where non-chemical methods can be effective and the need for harvesting will be substantially reduced, we are proposing a short-term, highly managed spot use of herbicide in specific areas of the lagoons, away from the main channel and far from the entrance to Lake Tahoe. In short, our expert panel and consultants have indicated that short-term herbicide use will provide the most promising option at this point to truly curtail and treat the aquatic invasive plants in the Tahoe Keys and minimize the potential for spread throughout the lake and beyond the control of resource managers.

In order to move forward with controlled herbicide use, a joint Environmental Impact Statement (EIS)/ Environmental Impact Report (EIR) must be prepared by TRPA and Lahontan. In step with this process, we have applied for a permit from both agencies to allow use of safe, EPA-approved herbicides to combat the weeds. The herbicides that our experts have recommended target the specific invasive weed species but do not affect native aquatic plants, fish, wildlife, or recreation. The proposed rate of application would be well below the EPA-approved concentrations and are expected to quickly degrade. The herbicides would only be used in a series of controlled and careful applications to reduce the volume of plants to a manageable level, and then replaced with non-herbicide methods for long-term weed management. Despite the documented safety of using the proposed herbicides to combat the invasive weeds, we understand that herbicide use can be a divisive and contentious topic. To ensure transparency and constructive dialogue, key stakeholders have agreed to engage in a collaborative process over the next 12 months. Several stakeholders, including TKPOA, worked with TRPA to hire Zephyr Collaboration to conduct the facilitation and mediation work during the EIS/EIR process to ensure there is input from all stakeholders. Our hope is that by engaging in a robust collaborative process to design the most effective path forward, we will get to a solution faster. We will keep the TKPOA membership updated as we move forward through the process. Meetings and Approvals

The Finance Committee monthly meeting was held on September 18th, 2018. The committee reviewed and approved the August Financial Statements to be presented to the Board of Directors for approval at their next Board Meeting on October 20, 2018. The committee also reviewed the following reports prepared by TKPOA staff: • Status of the 2019 Operating and Reserve Budgets for Common, Water Co., and Water Quality. • 2018 Legal Expense Analysis though 9/15/18.

The Committee also approved and agreed to have a joint meeting with the Board of Directors to review the 2019 Operating and Reserve Budgets for Common, Water Co., and Water Quality on October 15th, 2018 at 1:00 p.m. at the TKPOA Pavilion. The next Finance Committee Meeting is scheduled for October 23rd, 2018 at 10 a.m. at the TKPOA Pavilion. As a reminder, the Budget meetings, the Board meetings, and the Finance Committee meetings and are open to members of the TKPOA (meeting dates are subject to change).

STAFFING UPDATES

By Jo Ann Wilson, Administrative Assistant The Tahoe Keys Property Owners Association (TKPOA) has had some significant Staff changes this past summer and has welcomed current and new Staff to new positions. Please join us in welcoming these Staff members to their new roles.

Heather Houston

Operations Manager We are pleased to announce that Heather Houston has been promoted to the position of Operations Manager. Desiree Wright resigned as Operations Manager to accept a position with the El Dorado County Probation Department. The decision to promote Heather was made by management in view of her exceptional performance in meeting the challenges presented and her growth into greater responsibilities. Heather entered the company as Administrative Assistant in November of 2014. Her new position will require her to handle the everyday security and front desk operations. She will also be responsible for human resources and for ensuring that staff complies with the company rules and objectives. Please join us in congratulating Heather on her new position as Operations Manager.

Jesse Isaacson

Security Supervisor Jesse Isaacson comes to Tahoe Keys Property Owners Association with many years of experience in Security Personnel. Most recently working as the Security Supervisor for the Hard Rock Casino. His attributes demonstrate the ability to be observant and alert for the safety of our homeowners, and his friendly attitude is key to customer service interaction. Jesse joined Tahoe Keys Property Owner’s Association in June of 2018 and has been a South Lake Tahoe resident for over 30 years.
