[All approvals are also published in Keys Breeze Monthly “Board Actions Summary” and Board Minutes available on the TKPOA Website] 1. 2018 Integrated Management Plan (IMP) for Aquatic Invasive Species (AIS) Weeds – [WATER QUALITY] based on the 2017 Water Quality Special Assessment Ballot passing on April 22nd, 2017, the TKPOA has contracted with Sierra Ecosystems Associates (SEA) for $33,363 the IMP for AIS planned activities for 2018. The Water Quality Committee (WQC) and the Board of Directors have approved the following tasks to be taken on by SEA during 2018: a. b. c. d. e.

2. Lagoon Water Circulation System Assessment – [WATER QUALITY] Evaluation and recommendation completed by Domenichelli and Associates Engineering $25,000. 3. Facilities Planning for Water Production Facilities to Address PCE Contamination in Source Groundwater – [WATER COMPANY] awarded to Kennedy/Jenks Engineering & Design for engineering report and recommendations for $111,129. 4. Well #3 - Engineering Planning and Design of new Emergency Back-up Generator – [WATER COMPANY] awarded to Far West Engineering 100% plans completed for $20,540. Generator ordered for $45,787, and site installation contract awarded to Thomas Haen Company for $83,987. 5. Pavilion Beach Shoreline Protection –[COMMON AREA] This project is to protect Pavilion Beach to reduce loss of property due to ongoing erosion during periods of high lake levels. Contracted with Marvin Davis and Associates Inc. (MDA) for design and Susan Simon Environmental Planning for permitting. TKPOA Membership voted their approval. Contract Awarded to Thomas Haen Company for $315,000 with construction in process. 6. Street Light Replacement with LED Fixtures – [COMMON AREA] Phase 1 included The Keys Breeze Magazine

30 Contempo LED Street light fixtures 3000K LED 240V @ $750.00 per light for $22,500. 7. Cove 3A – Roof Replacement contract awarded to Amundson Roofing for $152,700 and installation is currently underway. 8. Cove 4 – Replacement of Exterior Stairs and Decks approved by TRPA, the City of South Lake Tahoe (CSLT). Project awarded to Tahoe Decks & Remodeling for $128,035 project started in fall of 2017 and continuing 2018 summer. 9. Cove 5 – Deck Replacements and Repairs approved in phases by the Cove Advisor. Cost to date $16,478. 10. Islanders 2 – Siding Repairs and Staining Project Building 1&2 awarded to Kaczmar Painting for $89,780. 11. Tahoe Marina Shores (TMS) – Repainting of Buildings 1 through 8. Buildings 1-5 complete. Buildings 6 - 8 this fall, for total project cost of $85,200. 12. Bavarian Isle Bulkhead Emergency Repairs/Replacement Project – Plans and analysis for collapsed bulkhead at 1975, 1979 Garmish Court and TKPOA Water Quality ramp at 1981 Garmish Court, awarded to Noble Consultants-G.E.C., Inc. Questions about the project received and answered for the two affected owners. Project awarded to Tahoe Marine and Excavating for estimated total 209.8 ft. @$2,161.31/ ft.=$453,440.

Proposal-RFP (Bid Phase)

13. Pavilion Best Management Practices (BMP’s) – [COMMON AREA] Design for new storm water infiltration “Rain Garden” basins in the vicinity of the Ala Wai Pavilion parking lot and pickle ball court as required by Tahoe Regional Planning Agency (TRPA) and the LRWQCB Waste Discharge Requirements (WDR). Worked with Marvin Davis and Associates Inc. (MDA) for design and engineering as part of the Pavilion Shoreline Protection Project RFP for construction in process. 14. Ala Wai Tennis Court Bathroom – [COMMON AREA] Plans completed and land coverage approved with building permit approved. RFP and bidding process conducted with RFP’s sent to 15 contractors. Received four (4) bids for project. Project is currently on hold until 2019 for Board of Directors consideration. 15. Water Lateral Replacement Phase I – [WATER COMPANY] Design for this project on Danube, Morrow, Monterey and Beach Court for the replacement of 45 - water service lateral from the street mains to 91 homes has been completed. The Association owned portion of the water service laterals that have galvanized pipe are slated for replacement due to age, condition and current leak repairs. Request for Proposals (RFP) and Bidding Process was conducted with three bids received. Project is being re-phased and re-allocated for future years. 16. Water Quality Ramp Replacements – [WATER QUALITY] TRPA permit approved, approvals from other agencies pending. LRWQCB has required lake bed mitigation conditions for approval of this project.

Noble Consultants – G.E.C., Inc. has been contracted for the design, the same firm that completed the 2015 Bulkhead Assessment Study. Susan Simon Environmental contracted for permitting. Under the 1991 Stipulation for Entry of Judgment the TKPOA has the authority to proceed as the lead agency and is working with the Tahoe Keys Marina and Yacht Club (TKM&YC) and Tahoe Keys Beach and Harbor Association (TKB&HA) on design. 18. Light House Shores – (LHS) Asphalt Roadway Replacement RFP’s sent and bid received, now proposed for Spring 2019 19. Cove 3A Bulkhead Replacement Reaches 8 and 9 – Design for the replacement of the 3A Bulkhead is moving forward in conjunction with East Channel Bulkhead work performed by Noble Consultants – G.E.C., Inc. Susan Simon Environmental contracted for permitting. 20. Corporation Yard Relocation and CTC Land Exchange – [COMMON AREA] Contracted David Goldman Environmental Architecture to develop conceptual plans and analysis of land usage. Meetings with California Tahoe Conservancy (CTC) conducted by Board Subcommittee to negotiate deal points and exchange information for TKPOA Membership ballot measure TKPOA Vote approved on November 18th, 2017. On August 8th, 2018 the CTC Board of Directors conducted its scheduled meeting and the CTC – TKPOA “Land Exchange” was agendized as planned. The CTC adopted the following resolution as well pursuant to Government Code section 66907.8: “The CTC hereby authorizes staff to take all actions necessary to relocate the existing TKPOA Corporation Yard to El Dorado County Assessor’s Parcel Number APN 022210-41-100, and to obtain Conservancy access to the Upper Truckee River marsh through APN 022-161-06-100.” The CTC Board approved the TKPOA Corporation Yard Relocation Project unanimously. The CTC had completed the California Environmental Quality Act (CEQA) as required for this project as agreed. On August 9th, 2018 the City of South Lake Tahoe (CSLT) Planning Commission unanimously approved the “NEW” TKPOA Corporation Yard Facility proposed build out for Special Use and Design Review Permit - File #18-125. On August 22nd, the Governing Board of the Tahoe Regional Planning Agency (TRPA) approved the “NEW” TKPOA Corporation Yard Facility application for a Local Public Health and Safety Facility, TRPA File Number ERSP2018‐0806. The TRPA Governing Board of Directors unanimously approved the project.

Indoor Pool Replacement of Pool Water Circulation Pump and Filter – [COMMON AREA] this has been completed and included a redesign of the main circulation pump with a high efficiency motor /filter assembly equipment upgrade approved December 16th, 2017 and awarded to Tahoe Pool Service Equipment for a total cost of $8,720. Also during the indoor pool closure of February 5th through February 8th 2018 the 2018 yearly maintenance and cleaning was completed by the TKPOA Recreation and Maintenance Staff. 22. Indoor Pool Spa’s and Deck Replacement Project – [COMMON AREA] This has been completed and included new spa’s a redesigned/lowering of the spa’s to be level with the indoor pool deck Replacement deck is new paver deck and

Pavilion Tennis /Pickle ball Court Replacement of Pavilion Tennis Court – [COMMON AREA] awarded to Zaino Tennis Courts for $90,460 complete in July 2018 and converted to 4 pickle ball courts for an additional $5,950. 25. Tennis Courts at Venice Drive Repair and Resurface – [COMMON AREA] awarded to Zaino Tennis courts for $10,588. 26. Basketball Court Landscaping Upgrade – [COMMON AREA] Completed by TKPOA Landscape Staff $4,500. 27. Radar Speed System - [WATER QUALITY] East &West Channel temporary location installation for $7,228. 28. West Channel Bubble Curtain – [WATER QUALITY] Installation of power supply compressors and bubble curtain tubes for $26,900. Received grant funding from League to Save Lake Tahoe. 29. Cove 1 – Fire Damage Reconstruction Townhomes 170-177 Eight homes destroyed/damaged by fire on May 3rd, 2016. Contact awarded to Howe Built Construction. Phase I to construct the “Warm Shell” is completed. Phase II – Interior build out of Townhomes has also been completed with individual Townhome Owners and Howe Built Construction. Total cost $2,694,727. 30. Cove 1 – Re stain Building 2&3 Buildings/decks awarded to Keys Painting for $27,000. 31. Cove 2 – Upper balconies Repainted awarded to Southern Cross Painting for $10,160.

32. Cove 2A – Building 4 (Units, 223-232) Replacement of Redwood Decks with Pavers and Replacement of Storage Closet Doors and Floor. Awarded to Tieslau Constructing for $82,246. 33. AUGUST 18TH — EXECUTIVE SESSION BOARD ACTIONS z Reviewed six personnel matters. z Reviewed four member disciplinary matters, including four disciplinary hearings. z Reviewed 17 legal matters, including ongoing issue with the Tahoe Keys Marina and Yacht Club. z Reviewed 14 contracts. z Reviewed TKPOA Board Subcommittees 2017-2018: A Board motion was made to sundown eight subcommittees, and to move the Community Dock Committee to the September 1st, 2018 Regular Board Meeting. z Approved Board Direction to Communicate Cove 1 Dock 15 feet to alleviate the encroachment from Cove 2 Navigational Waterway. z Approved Contract with EMKO-Environmental Services, Inc. for 2019 Aquatic Invasive Species (AIS) Professional and Technical Services, for a cost not to exceed $14,100 for January 2019 to December 2019 to be expensed to Water Quality Professional Service WDR Operating Account (EIS/EIR).

AUGUST 18TH — BOARD OF DIRECTORS MEETING BOARD ACTIONS z Approved: Kaczmar Painters for the Islanders 2 Exterior Siding Repairs and Staining for $89,780 plus a $8,978 contingency for a total of $98,758 to be funded out of the Islanders 2 Reserves Fund. z Approved: Amundson Roofing for the Cove 3A Roof Replacement for $152,700 plus a $15,270 contingency for a total of $167,970 to be funded out of the Cove 3A Reserves Fund. z Rescinded: Motion from the July 21st, 2018 Regular Board Meeting to approve the Reserve Expenditure Request (RER) – Generator Installation for Water Company Well #3, and approved the proposal from Thomas Haen Company in the amount of $83,987 to be funded out of the Water Company’s Reserve Fund. z Approved: Proposal from Jacobi for $43,510 for the Reserve Expenditure Request (RER) – Granular Activated Carbon (GAC) Filter Median Replacement Well #2. Project to be funded out of the Water Company Reserves Fund. z Approved: Proposal from BESST, Inc Global Subsurface Technologies for $24,275 and the Wetlabs sample testing cost in the amount of $3,450 for a total amount of $27,725 for the Reserve Expenditure Request (RER) – BESST Technology Water Sampling Well #2. Project to be funded out of the Water Company Reserve Account. z Approved: The purchase of one storage unit from ConExWest in the amount of $3,846.68 in order to store the TKPOA Water Quality Turbidity curtains in order to reduce future spending. TKPOA Corporation Yard Relocation Project By Kirk Wooldridge, General Manager

T

he Tahoe Keys Property Owners Association (TKPOA) Board of Directors and TKPOA Staff have been moving forward on the California Tahoe Conservancy (CTC) “Land Exchange” since the Membership majority “FOR” vote on November 18th, 2017. The TKPOA has been working toward receiving the necessary approvals for the “NEW” TKPOA Corporation Yard proposed build out on the new parcel located at 2421 Venice Drive [APN: 022-210-41100] prior to finalizing the TKPOA Corporation Yard Relocation Project (“Land Exchange”) and related contracts. On August 8th, 2018 the CTC Board of Directors conducted its scheduled meeting and the CTC – TKPOA “Land Exchange” was agendized as planned. The CTC Board of Directors toured both sites in the morning with TKPOA Staff and at the afternoon meeting Aimee Rutledge – CTC Acquisitions Manager delivered a presentation on the details of the TKPOA Corporation Yard Relocation Project (“Land Exchange”). The Agenda scheduled the approval of Resolution 18-08-03 for CTC to adopt the following finding based on the accompanying staff report, and pursuant to Public Resources Code section 21000 et seq.: “The Conservancy, in its capacity as the lead agency, prepared the Initial Study and Negative Declaration for the TKPOA Corporation Yard Relocation Project (Project). The Conservancy finds on the basis of the whole record before it that there is no substantial evidence that the Project will have a significant effect on the environment, and that the Negative Declaration reflects the Conservancy’s independent judgment and analysis. The Conservancy hereby adopts the Negative Declaration and directs staff to file a Notice of Determination with the State Clearinghouse for this Project.” The CTC adopted the following resolution as well pursuant to Government Code section 66907.8: “The CTC hereby authorizes staff to take all actions necessary to relocate the existing TKPOA Corporation Yard to El Dorado County Assessor’s Parcel Number APN 022-210-41-100, and to obtain Conservancy access to the Upper Truckee River marsh through APN 022-161-06100.” The CTC Board approved the TKPOA Corporation Yard Relocation Project unanimously. The CTC had completed the California Environmental Quality Act (CEQA) as required for this project as agreed. On August 9th, 2018 the City of South Lake Tahoe (CSLT) Planning Commission conducted its monthly meeting and the “NEW” TKPOA Corporation Yard Facility proposed build out on the new parcel located at 2421 Venice Drive [APN: 022-210-41-100] was agendized. The CSLT Planning Commissioners unanimously approved the project, for Special Use and Design Review Permit - File #18-125.

On August 22nd, the Governing Board of the Tahoe Regional Planning Agency (TRPA) conducted its monthly meeting and the “NEW” TKPOA Corporation Yard Facility proposed build out on the new parcel located at 2421 Venice Drive (APN: 022-210-41-100) was agendized. The TRPA approved the TKPOA application for a Local Public Health and Safety Facility, the TKPOA Corporation Yard Facility [APN: 022-210-41100] TRPA File Number ERSP2018-0806. The TKPOA Governing Board of Directors unanimously approved the project without any questions as part of the consent calendar. TKPOA Staff has received approvals for the next step of the “NEW” TKPOA Corporation Yard Project which is the development of Building and Site Plans for CSLT Building Department approval and to begin the Request for Proposal (RFP) process with proposed construction to start on “Phase I” during the summer of 2019. The proposed 4,853 square foot one story building would be divided into one office space and five garage bays for use by TKPOA Maintenance Landscaping, and Water Quality departments. The design includes a 15,333 square foot asphalt parking lot and an 8,100 square foot concrete pad for aquatic invasive species (AIS) weed handling and drying that are harvested from TKPOA lagoons. A 6-foot high wrought iron fence will circle the property on the front side with landscaping around the perimeter, and a wooden fence around the backside. At the September 1st, 2018 Board of Directors meeting the Board agendized the following documents for potential approval the TKPOA – CTC Land Exchange: Quitclaim Deed, License Agreement for Right of Access between Tahoe Keys Property Owners Association and the California Tahoe Conservancy, Grant Deed and License Agreement (A “New” Short Term Lease ending on April 30th, 2023 for use of the current Corporation Yard). The TKPOA Attorneys of Richardson-Ober, PC have reviewed all proposed documents and provided a response. The TKPOA Board of Directors unanimously approved all documents for signature and processing. With the completion of these documents the TKPOA Resolution #2017-002 “The Authorization to perform a “Land Exchange” with the CTC for a “NEW” TKPOA Corporation Yard Site for the development of Maintenance Shops, Water Quality Operations, and parking areas will become official. As Resolved and voted on the following “Land Exchange” requirements apply: 1. TKPOA Ownership of the “New” Corporation Yard Site parcel APN: 022-210-41-100 2. A “New” Short Term Lease ending on April 30th, 2023 with the

For the “Land Exchange” the CTC will bear the cost of and complete the following: 1) The California Environmental Quality Act (CEQA) document for the land transfer, 2) Documentation and approval of 100% Land Coverage and Commercial Floor Coverage (CFA) as required, and 3) At the current TKPOA Corporation Yard site the “Fill and Building removal”.

A $50,000 BMP operating cost to install and maintain over the “New” lease period at the current TKPOA Corporation Yard. A “New” Corporation Yard site moving and build out costs of $880,000 for new Maintenance Shop Buildings, Water Quality Operations parking areas for vehicles, and area for AIS weed storage and drying. Authorization of this phased approach to the construction build out that would utilize current and future Common Area Reserve Funds allocated for this project. In utilizing this approach the TKPOA does not anticipate the need for a special assessment or short term Common assessment increases related to this project. As of April 30th, 2023, the CTC will be allowed to combine the restoration of the Corporation Yard with the Upper Truckee Marsh Project. Authorization during “New” lease period for the CTC to use the current TKPOA Corporation Yard for staging or other management activities associated with the Upper Truckee Marsh Project. Authorization to grant the CTC non-exclusive access rights through the Colorado Court property owned by the TKPOA for long term maintenance and management of the CTC Upper Truckee Marsh Project. These CTC access rights would be granted through a License Access Agreement with the TKPOA.

Notice of Change in Association Rules

TEXT OF PROPOSED CHANGES The TKPOA Board of Directors approved to adopt the following changes to Association Operating Rules at the August 18th, 2018 Regular Board of Directors meeting. These changes were noticed for a 30 day member review period in the June issue of the Keys Breeze. Purpose and Effect of Proposed Rule Change To further clarify the Owner, Renter, and Vacation Renter Policy, Rules, and Regulations Whereas, the Tahoe Keys is a private family-oriented, residential community that is located in a scenic and quiet environment. The close proximity of the residences in the Tahoe Keys increases the likelihood that disruptive behavior will impact other residents; and Whereas, the Tahoe Keys is administered and managed by a Property Owner’s Association, herein referred to as ‘TKPOA’; and Whereas, a large number of properties within the Tahoe Keys are offered as short term vacation rentals through Vacation Rental Agencies and/or Vacation Rentals by Owner or through other agencies or by other methods; and Whereas, the City of South Lake Tahoe has a Vacation Rental Ordinance as set forth in Article XIII of Chapter 28A of the City of South Lake Tahoe Code. This ordinance is intended to address problems involving excessive noise, disorderly conduct, vandalism; overcrowding, traffic, congestion, illegal vehicle parking and accumulation of refuse at vacation home rentals and some of these problems have impacted Tahoe Keys. Anyone who leases their property in the City for shortterm rentals is required to register and obtain a license from the City and must comply with the following regulations (“Vacation Rental Restrictions”): • No more than two people per bedroom plus four additional people are allowed to remain overnight [unless as otherwise restricted by Cove rules]; • The number of parked vehicles is controlled and signage inside and outside the home must be Keys Breeze

posted setting for the parking requirements; • The owner or the owner’s agent must be available for immediate contact; • The property may not be used for commercial activities such as weddings, receptions or large parties; • Licenses must be reviewed annually. Violation of the City of South Lake Tahoe Vacation Rental Restrictions may subject the owner to penalties and fines; and Whereas, the TKPOA Governing Documents provide TKPOA with the authority to fine and impose other disciplinary actions on property owners for violation of the TKPOA governing documents by themselves, their tenants and vacation renters; and Whereas, the TKPOA CC&Rs prohibit conduct, which violates statutes, ordinances and laws, which includes the Vacation Rental Restrictions imposed by the City of South Lake Tahoe; and Whereas, the activities of owners, renters, and vacation renters frequently interfere with the quiet enjoyment of nearby residents in the community; and Whereas, the goal of implementing this policy, and rules and regulations, is not to punish owners that are using their properties as rentals, but rather, it is intended to modify the behavior of the renters to be more respectful of the TKPOA’s community, to observe the rules and regulations, and to create a peaceful environment; and Whereas, TKPOA incurs substantial costs in dealing with monitoring and enforcement of TKPOA governing documents; Now Therefore, TKPOA hereby adopts the following Policies, Rules and Regulations: 1. All owners of short-term vacation rentals in Tahoe

Keys must register with the TKPOA administrative office and secure an annual “TKPOA Rental Permit” for their property in order to operate a vacation rental property within the Tahoe Keys. The permit, which has an annual fee, must be displayed in a front window of the rental property. Permits are not transferrable. Nuisance violations will be tracked on a rolling 24 month period. Failure to register a vacation rental with the TKPOA administrative office is a violation, and subject to potential member discipline and fines. 2. All owners, renters, and vacation renters in Tahoe Keys must comply with the City’s Vacation Rental Ordinance. 3. All owners, renters, and vacation renters must comply with the TKPOA governing documents including provisions which prohibit “nuisance” behavior and set forth rules concerning vehicles, boats, trailers, parking and use of docks and lagoons; 4. Each vacation rental shall have and display a Rental Placard which may be obtained from the City of South Lake Tahoe; 5. No home may be rented to nor used by more than two (2) people per bedroom plus four (4) additional people [unless otherwise restricted by Cove Rules]; 6. The number of vehicles shall not exceed the number set forth in the City of South Lake Tahoe Rental Placard and shall only be parked in spaces designed for the unit being rented; 7. Trash Disposal: a. Townhouse dumpsters are for the exclusive use of the townhouse owners and their authorized renters. Only household trash can be placed in the Townhouse dumpsters, no large items may be disposed of in these dumpsters. b. Owners of single family homes are reminded that curbside trash is on Fridays and are responsible for informing their renters and guests to not place trash at the curb prior to the scheduled pick-up day. Trash containers may not be placed at the curb until 6:00am Friday morning. Owners will be financially responsible for any trash left out early that has to be pickedup by Association Staff at the current rate of $75.00. Owners may also be subject to a fine of $250.00 for violation of trash pick-up rules. c. Owners may place two bags of household trash per week in the dumpsters located in the parking lot of the Pavilion Office. Rental and cleaning agencies hired by homeowners may not utilize these or the townhouse dumpsters. No large or construction debris may be placed into or left next to the Pavilion dumpsters. Owners may be subject to a fine of $500.00 for improper or prohibited use of Association dumpsters. 8. Tahoe Keys has adopted this Policy for enforcement of following our Rules and Regulations; the following conduct is prohibited: a. Excessive, disruptive or objectionable noise including noise levels in excess of what is permitted by applicable laws after 10:00pm on weekdays and weekends; b. Use of pools, spas, and hot tubs with the use of jets, blowers, and other mechanical elements that produce noise are prohibited between the hours of 10:00pm and 7:00am; c. Speeding in excess of 5 miles per hour (mph) or causing a wake which could cause damage to adjacent properties while in a TKPOA lagoon or waterway; d. Loud music from a watercraft while in the TKPOA lagoon or waterway; e. Indecent exposure; f. Trespassing, including but not limited to boat docks; g. Drunk or disorderly conduct; h. Destruction of private property;

i. Harassment of residents or TKPOA staff or other conduct that is an unreasonable annoyance to the neighborhood; j. Allowing dogs to be “off leash” and failure to pick up and properly dispose of pet waste. 9. In the event TKPOA determines that a potential violation of this Policy has occurred, the owner and if applicable the tenant will receive a notice of hearing as provided in the TKPOA governing documents – and as more specifically described in the attached. ADDENDUM 1 – PROCEDURES FOR DEALING WITH NUISANCE COMPLAINTS, which by this reference is incorporated herein. In such event if a violation is found, TKPOA may impose any or all of the following disciplines: a. Impose a fine of up to one thousand dollars ($1,000) per occurrence and take appropriate action to collect the fine(s); b. Suspend the right of the owner or the tenant to use or allow renters use of common areas or common facilities (except for ingress and egress to the property) c. Impose a special individual assessment against the property owner for costs incurred by TKPOA (including sums paid to contractors, attorneys and/or others) to repair damage and/or cure a violation of this Policy; d. Request appropriate action by the City of South Lake Tahoe 10. TKPOA will notify all TKPOA Members and all Rental companies that this policy is in effect. The notice will include a recommendation that each member owning a rental property in the Tahoe Keys should include terms of their rental agreement that any fines may be passed along to the renter. It will also recommend that each rental agreement should include a deposit to cover any possible fines that may arise. ADDENDUM 1 – PROCEDURES FOR DEALING WITH NUISANCE COMPLAINTS: First Nuisance Complaint: A. Security contacts the property renter/occupant at that address, if it is safe to do so. IF IT IS UNSAFE TO APPROACH THE RENTER/OCCUPANT – CALL S. LAKE TAHOE POLICE. TKPOA Security will continue community patrols to monitor property at a safe distance to observe and/or record any continuing activity at the property until the South Lake Tahoe Keys Breeze

Police (SLTPD) arrive, at which time Security is primary witness to relay information to SLTPD. B. If applicable, verify the display of a City of South Lake Tahoe (CSLT) Vacation Rental Placard and a TKPOA Rental Permit. C. If safe, Security explains the nuisance violation, gives the homeowner or renter/occupant copy of the Owner, Renter, and Vacation Renter Policy with Addendum 1, Security Letter and requests they conform to the rules. D. Based on the response by the Occupants, the Security Officer’s discretion, and review of Nuisance Complaint Log, the Officer can complete an Incident Report accordingly, or continue the violation process of notification Steps E &F. E. Violation exists - Security immediately calls the Homeowner & the Management Company, if any, to advise of violation and lodge complaint F. Violation exists – Security calls City of South Lake Tahoe (CSLT) Short Term Vacation enforcement officer (542-6100) to advise of the violation/ complete (CSLT) Vacation Rental Enforcement form, and record in TKPOA Incident Report. G. Security completes TKPOA Incident Report, Nuisance Log, and Security Log – copy sent to General Manager (G.M.). Security will record the address, owner’s name, Management Company if applicable (and phone), City Vacation Rental permit number (if no permit, advise City enforcement division) and TKPOA Rental Permit. DAVIS STIRLING CIVIL CODE § 4041 Property Owners Mailing Address Information

I

ncluded with the Fourth Quarter Assessment, to be mailed to members around September 14, 2018, will be the request for all Tahoe Keys Property Owners Association (TKPOA) to provide the Davis Stirling Civil Code § 4041 information. As of January 1st, 2017, every California community association has been required to ask its members to provide their contact information and property status. Civil Code § 4041 has required, starting January 1st, 2017, that each association must solicit the following information from its members and an owner of a separate interest shall, on an annual basis, provide written notice to the association of all of the following: 1. The address or addresses to which notices from the association are to be delivered. 2. An alternate or secondary address to which notices from the association are to be delivered. 3. The name and address of the owner’s legal representative, if any, including any person with power of attorney or other person who can be contacted in the event of the owner’s extended absence from the separate interest. 4. Whether the separate interest is owner-occupied, is rented out, if the parcel is developed but vacant, or if the parcel is undeveloped land. Although the statute does not mention how often an association must solicit this information, it does state that each member is responsible for providing this information to the association on an annual basis. The association shall solicit these annual notices of each owner and, at least 30 days prior to making its own required “Annual Disclosure”. If a Property Owner fails to provide the notices set forth in requirements (1) and (2) above, the last address provided in writing by the owner or, if none, the property address, shall be deemed to be the address to which notices are to be delivered. It’s important to note that as long as the Association requests all of the contact information above, Civil Code § 4041 places the responsibility on the Property Owners to provide their correct and current contact information. Requiring members to provide this information should aid associations in giving notice of meetings or for other required notices as well as with the collection of delinquent assessments as it should help negate the argument that a notice was sent to the wrong address in the future. What did you do before becoming an artist? In college, I was a ranger in Desolation Wilderness as part of the Echo Unit. The experience had a profound effect on my life. I wanted to figure out how to stay in the mountains and make a living, so I went into business in Strawberry, California building mountain cabins. How did you get started painting? When the market fell apart and construction work dried up, I had to start over. I thought about what really brought me joy and realized what mattered to me was how I felt when I finished homes for people, and when I worked as a wilderness ranger. My mom resurfaced the finger paintings I made as a child and I immediately remembered the joy associated with creating them. I went back to school for a Master’s in Fine Art.

What would surprise people about the way you create? I paint on a blank wall. I don’t have an easel. I don’t buy canvas on stretcher bars. I buy canvas in big rolls, pin it to the wall and paint. When I’m finished, I stretch it if there’s a reason to. Is there a tool other than your paintbrush that you’re currently obsessed with? There is, and this is an insider’s secret… I use epoxy. It gives my paintings a certain look and brilliance. What do you enjoy doing most when you’re not creating? I consider myself a student of painting, the violin, and of fly fishing. I love playing jazz and rock and roll violin—the louder the better. Everything else fills in around those three things.

n the Tahoe Keys, there are many members who rent their House or Townhouse out Long-Term and Short-Term. A Long-Term Renter is defined as individuals who rent a home or Townhouse for thirty consecutive days or longer. Short-Term Renter(s) are any tenant staying at a property for less than thirty (30) days. With the winter rental season approaching, this article is to inform you of some important information to share when renting your home. Always leave a copy of the TKPOA Operating Rules, especially the Owner, Renter, and Vacation Renter Policy, Rules and Regulations, for your renter(s) to review and abide by. If your renter(s) violate TKPOA’s Operating Rules and/or CC&Rs, you as a homeowner could be sent a warning or potentially be fined by the Association. It is also important to communicate TKPOA’s recreational facilities access requirements so that your renters are aware of these rules before visiting the TKPOA Pavilion Office: In order for Long-Term Renter(s) to get an ID card for use of the TKPOA facilities they must present a lease or rental agreement and a Tahoe Keys Long-Term Renter ID Card Application signed by the owner. On the ID Card Application, the property owner must indicate how many cards you want to relinquish to your Long-Term Renter(s). Remember all properties are allocated 4 Member ID cards per property. There is an annual cost of $20 for a long-term renter(s) to obtain their Long Term Renter Card. In order for Short-Term Renter(s) to gain access to TKPOA’s facilities, they will need to show a copy of their lease or rental agreement and pay a fee of $10 per person per day or $40 per person per week. NOTICE OF CHANGE IN ASOCIATION RULES

TEXT OF PROPOSED CHANGES (The entire text of the proposed Rules for Cove Advisors and Cove Advisor’s Committee Changes are new additions to Association Operating Rules) The TKPOA Board of Directors approved to adopt the following changes to Association Operating Rules at the August 18th, 2018 Regular Board of Directors Meeting. These changes were noticed for a 30 day member review period in the June issue of the Keys Breeze. Purpose and Effect of Proposed Rule Change To further clarify rules of the Cove Advisors and Cove Advisor’s Committee The following text includes rules that have been enforced for several years by the Tahoe Keys Property Owners Association (TKPOA). The Board of Directors has approved these rules to go through the 30 day member review period to ensure the proper rule change procedure has been followed. The Advisor’s Committee is a standing Committee, established by the TKPOA Bylaws, Article X, Section 1 (c). The Committee shall serve the Board of Directors and is comprised of community volunteers. Due to the diversity of Architectural designs, competing property use demands and other local concerns within the various Subdivisions comprising Tahoe Keys, the Board shall be served by a Committee of subdivision advisors, with each Subdivision represented by no more than two advisors who shall be property owners within the Subdivision they represent. The duties, authority, and responsibilities of the Advisors shall be as set forth in the Association Rules. 1. The Committee shall have no more than two Advisors per Subdivision. Owners must meet the following criteria to serve as an Advisor: a. Must be an owner of record in the subdivision they represent b. Must be an Association member in good standing c. Must be able to commit to the time necessary to fulfill advisors duties as set out in these rules d. Must be approved by the TKPOA Board of Directors by motion at a regular Board Meeting 2. If a Subdivision has more than one Advisor, one shall be appointed as the Key Advisor and shall be the only Advisor entitled to vote from their Subdivision. The Key Advisor shall act as a primary liaison between the Subdivision and TKPOA Management, Board of Directors, and Advisors Committee. The second Advisor may, in the Key Advisor’s absence, function as the Key Advisor at meetings. 3. An Advisor may be removed by majority vote of the owners of their Subdivision or by a petition signed by more than 50% of the owners of record of the Subdivision or by Board motion at a regularly scheduled Board meeting. 4. Advisors Committee vacancies can be filled by a Subdivision owner volunteer or by nomination. Criteria outlined above must be met. 5. Meetings for the TKPOA Advisor’s Committee shall be: a. Held quarterly at times set forth by the Committee Chair and Co-Chair at the Pavilion Office. b. Special Meetings of the Advisor’s Committee may be held by majority vote. c. 6. The Chair and Co-Chair of the Advisor’s Committee shall be appointed by majority vote of the Committee during the July Committee meeting and shall serve 2 year terms. Nomination and voting for the Chair and Co-Chair shall be completed at the same meeting. a. The Chairperson’s duties shall include: 1. Prepare meeting agendas 2. Conduct meetings 3. Prepare reports of actions and recommendations to the Board of Directors 4. Take minutes of the meetings or supervise the recording of the minutes b. The Co-Chairperson’s duties shall include: 1. Assist the Chair as needed 2. Take over duties in the absence of the Chair 3. Take minutes of the meetings or supervise the recording of the minutes 7. Voting on all issues brought before the Advisors Committee shall be by Subdivision. One vote may be cast per Subdivision by the Key Advisor. The CoAdvisor may cast a vote in the absence of the Key Advisor. 8. Subcommittees, if required, shall be appointed by a majority vote of the Advisors Committee. 9. All proposed or requested actions approved by the majority of the Subdivisions represented at the Advisors Committee meeting shall be reported to the Board of Directors for their review and action as they deem appropriate. 10. The Advisors Committee and the individual Advisors shall follow and adhere to the TKPOA Governing Documents, Board Policies, and Association Rules as they are amended and approved. 11. Minutes shall be taken at every Advisors Committee meeting and copies furnished to the TKPOA Administrative Assistant for inclusion in records and Board meeting packets. 12. Duties and responsibilities of Advisors include: a. Communicate with Subdivision owners a minimum of once per quarter on current events, projects, updates, etc. in the Subdivisions b. Solicit input from Subdivision owners on items of concern

c. Call meetings of Subdivision owners when necessary d. Report maintenance, repair, or other property issues to the attention of the General Manager, Maintenance Manager, Board, or other TKPOA Committees as appropriate e. Consult with Accounting Manager on available funds prior to starting any repair or maintenance project f. Complete and approve work orders for required maintenance and repairs within the Subdivision g. Forward projects requiring Architectural Control Committee (ACC) approval to the ACC with properly completed applications, plans, etc. h. Conduct poll or vote of Subdivision owners on proposed aesthetic changes to building exterior or Subdivision grounds as required by the TKPOA governing documents i. Review and approve Subdivision project change orders and modifications j. Approve and renew on-going operational contracts such as snow removal, landscape, and painting that are covered under the Subdivision’s budget and do not require additional assessments within the Subdivision 13. Advisors are prohibited from the following: a. Contracting or committing the Subdivision to an expenditure over $2,500 without prior Board approval b. Directing the work of Association employees c. Making approved contract or plan changes for projects over the $2,500 limit without prior Board approval d. Approving changes or modifications to Common Area property without prior Board or ACC approval 14. Changes or amendments to these rules may be recommended by Advisors to the Committee for consideration. Final review and approval is required by the Board of Directors, who may also make necessary changes at any time pursuant to the rulemaking authority provided in the TKPOA governing documents

TEXT OF PROPOSED CHANGES

On August 18th, 2018 the TKPOA Board of Directors approved the following changes to the Architectural Control Rules Brochure for a 30 day membership review period. These rules will be considered for adoption at the September 2018 Board of Directors Meeting. Purpose and Effect of Proposed Rule Change To further clarify Architectural Control Rules 04.10 Height Limits: The maximum ridge line of the structure cannot be higher than twenty-five feet (25’) from the top of the curb measured at the center of the front property line nor can the chimney extend above twenty-seven feet (27’) measured from the same point. No additional structural components may exceed 25’(feet) in height. 10.06 It is required that all areas be landscaped. A timed automatic sprinkler system with a backflow preventive device is mandatory. Planting is to be done with native or readily adaptable sod, plants, shrubs, ground cover, and trees that require minimal soil fertilization and watering. Refer to TKPOA approved Plant list. 10.07 Plant materials (shrubbery) must be maintained at a height of no more than four feet (4’) in front of the house or four feet (4’) in the rear of the house. Left intentionally blank 10.08 No fruiting trees are to be planted as to not attract wildlife. For existing fruit trees; fruit must be removed as soon as it ripens and cannot remain on the tree. 10.09 Boulders, rocks, and earth mounds, shredded bark (gorilla hair) and decomposed granite (DG) are to be utilized used in moderation.. Decorative rock material should not exceed 30% of total landscaped coverage. 10.10 Boulders, earth mounds, rocks, and large plantings (trees), and shrubs cannot be placed within any utility easement. Snow removal and access to buried utilities must be provided for at all times. 10.13 Trees cannot be planted closer than ten (10’) feet to the front property line, five feet (5’) to the side property lines or fifteen (15’) to the high water line. All trees must be approved by ACC. 13.09 All applicants must comply with Dock Guidelines as specified within the Form 13 Boat Dock application.

Dock Guidelines A minimum 50-foot wide navigation channel will be maintained. This minimum may increase at entrances to long channels. Docks should be located at or near the center of the lot water frontage. Docks and moored boats cannot encroach on the property of neighboring lots or extend beyond the pier headline. For new construction, various dock configurations and dimensions can be considered, but will not exceed 225 sq. feet. Height: 18 inches above water level or high water mark. Fascia will extend from decking to not less than 8” above the water line. All pilings must be contained within the dock. The height of all pilings must not exceed 3 feet above the high water line (HWL). Dock pilings must be a minimum of 2 ½” in diameter. 13.10a Plastic Floating Motorized Personal Water Craft docks prohibited.

Light fixtures may not be placed closer than 12 feet apart on dock and OWP corners. Lights on top of dock piling must be low intensity. 14.05 Solar lights must be low voltage, low intensity and may be used to enhance landscaping and identify pathways and other features. Must be positioned as to not create reflective glare or be offensive. 15.02 Free Standing temporary storage structures (including Bear Boxes) of any type are not permitted. Permanent storage structures integrated into the design of the residence structure may be considered on a case-by-case basis. 15.06 The operation of snowmobiles is prohibited within the City limits of South Lake Tahoe or the Tahoe Keys. 15.07 The operation of off-street vehicles is prohibited in Tahoe Keys Common areas. 19.07 Boats can only be moored to a dock, not to another boat. (No rafting)

13.17 Over Water Platforms (OWPs) The maximum width, parallel to the high waterline, is limited to 25% of that measurement. Under no circumstances can the width, as measured parallel to the high waterline, be more than twenty feet (20’). The TKPOA Board of Directors approved to adopt the following changes to Association Operating Rules at the August 18th, 2018 Regular Board of Directors Meeting. These changes were noticed for a 30 day member review period in the July issue of the Keys Breeze. Purpose and Effect of Proposed Rule Change To further clarify rules for TKPOA’s Lagoons and Waterways The following text includes rules that have been enforced for several years by the Tahoe Keys Property Owners Association (TKPOA). The Tahoe Keys West Channel and Lagoon system is a privately owned system and is governed by the TKPOA Board of Directors. The responsibilities and authority of the Board are set forth in the California Corporations Code, the Articles of Incorporation, the By-Laws and the Declaration of Protective Restrictions of the Tahoe Keys Subdivisions. It is the purpose of these rules to enact regulations to maintain and protect the Tahoe Keys Lagoon and Waterways; and to protect the quality of the waters to assure that no impairment of water quality will adversely affect Tahoe Keys or Lake Tahoe. It is the intent that this article shall be uniformly interpreted with Chapter 14 of the City of South Lake Tahoe regulations concerning lakes and other public waters, and County, State or Federal regulations, and shall not contradict or supplant any existing laws, ordinances or regulations. The provisions of these rules and regulations are to provide for the members of the TKPOA the means of effectively monitoring and controlling the operations of boats and of related structures and equipment on the waterways of the Tahoe Keys in order to maintain, improve and preserve the same. Boating Operations Regulations A. In order to protect and maintain the lagoon banks, bulkheads, docks, piers, and moored or berthed vessels from wave and wake action, vessel speeds shall be limited to five (5) miles per hour. B. The towing of one or more persons on the surface of the water on tire tubes, floats, rafts, planks, surfboards or water skis constitutes a navigational hazard and is prohibited. C. The operation of motorized equipment on the frozen surface of the waterways is prohibited. D. The use of a vessel as a place of abode upon the Tahoe Keys waterways is prohibited. E. The anchoring of a vessel in the navigable waterways in such a manner as to impede or obstruct the flow of boat traffic is dangerous and creates a hazard and a nuisance and is prohibited.

F. Stray Vessels, sunken or dilapidated vessels, drifting docks, floats, timbers and other floating materials and structures constitute a hazard and a nuisance. These vessels shall be removed from the waterways at the expense of the homeowner. G. Aircraft landing or taking off from the waterway constitutes a hazard and is prohibited. Aircraft taxiing on the waterways is permitted; but extreme care shall be exercised by the operator of such aircraft. H. The operation of commercial boating activities on the Tahoe Keys waterways is prohibited. Section 7: Refuse, Dumping, Polluting A. No person shall throw, deposit, or discharge refuse, sewage, garbage, or waste matter of any description into or upon the Tahoe Keys Waterways, sidewalks or beaches within the boundaries of Tahoe Keys. B. No person shall discharge, dump, deposit or allow any oil, paint, varnish, gasoline, petroleum products or byproducts, or non-biodegradable detergents or soaps into the Tahoe Keys waterways or on the streets or gutters within the boundaries of Tahoe Keys. C. No dead fish, fish bait, animal or pet excrement, or other putrefying matter shall be deposited, or allowed to be deposited, into the waters of the Tahoe Keys or left on the banks, piers, floats, docks, gutters or walkways in the Keys.

Section 8: Navigational Buoys and Signs A. No person shall move, interfere with or damage in any way the navigational floats, safety buoys or signs. Section 9: Bicycles, Roller skates and Scooters A. Bicycle, Roller skate and Scooter riding on the pier extending into the lake is prohibited. Beach and Swimming Areas A. The safe swimming area marked adjacent to the TKPOA Pavilion Office is a restricted area and the operation of boats in this area constitutes a hazard to swimmers and is prohibited. B. Swimming in navigational waterways is prohibited. Enforcement TKPOA is authorized to issue citations pursuant to any violation of these regulations. Such citations shall be presented to the Board of Directors for consideration of any damages that may be assessed to cover costs incurred by the TKPOA in repairing or replacing a damaged item or facility. The Board of Directors may assess the owner/ member of the Association the amount of damages incurred and may use the authorized methods of collecting such assessments.

BOAT AND TRAILER PARKING By Heather Houston, Operations Manager

n the ongoing effort to enforce the Tahoe Keys Property Owners Association’s (TKPOA) CC&Rs, this is a reminder that boat and/or trailer parking or storage of any kind is not allowed within the Tahoe Keys. These rules apply to single family and townhome subdivisions. Any boat or trailer parked or stored in the Keys is in violation of the TKPOA CC&R’s, Section 12; Vehicle, Boat, Trailer and Parking Restrictions. The following restrictions shall apply to the use, storage or parking of boats, trailers and vehicles within the Properties: “(a) House trailers, motor homes, boats, campers recreational vehicles, commercial vehicles, vehicles having a gross weight in excess of one ton, Motorcycles, bicycles, vehicles undergoing repairs and trailers may only be parked or stored within the Properties in an enclosed garage except that such equipment may be parked for periods of short duration for purposes of Keys Breeze

loading and unloading and the Association shall be entitled to implement a guest or visitor pass system to permit Owners or tenants and the guests and visitors of Owners or tenants to park campers or motor homes within the Properties for periods not to exceed seven days.” At this time, the Association does not have a guest or visitor pass system that permits Owners, Renters, or Guests to park or store a boat or trailer within the Keys for any length of time. If you have been or were planning to park or store your boat or trailer in the Keys, you will need to make arrangements for storage off property.
