elcome to the summer. I hope you have plenty of activities planned and for you golfers what a great venue we have right here at Red Hawk. The course is in great shape! With summer comes a few challenges of which we need to be aware. The first and foremost is that our children are out of school. This increases their presence outdoors so we need to keep an eye out for them. They may be bicycling, skate boarding, just playing or simply walking and hanging out; whatever the case, let’s keep our eyes open so they are safe. The second aspect to consider is fire potential. There are many more BBQs going on. Given we are in the driest season means be extra careful. July is a great month of celebrations but leave the fireworks to the experts. Setting off your own fireworks is against the law. If you witness anybody playing with fireworks please report the incident to the Sparks police department ASAP. We will also ask our safety patrol to be vigilant for this and to assist Sparks PD to identify those thinking they are above the law. A third aspect is to treat our environment with respect. That translates to picking up after your dogs, to leave the trees alone (no climbing or breaking branches), to adhere to the speed limit of 25 mph while driving in the community...just to state a few. All of it is common sense; you have it so use it. We have had a rash of graffiti tags lately. We are working closely with Sparks PD and our safety patrol ESI to catch the disrespectful culprits. Please contact our safety patrol if you have pertinent information; we offer a $500 reward for information that leads us to an arrest. There are a few tips: if you know a person that has black or red permanent paint stains on their fingers, or if they carry a rather large backpack for no good reason, or of course if one brags about it...all strong signs of involvement in such act. Let us know. This last one is a rather sad storyline. For those of us involved in golfing, there is a family of hawks living in the trees along the # 13 tee box on the Hills course. A parent hawk was found dead from gunshot wounds at the bottom of the evergreen tree. If anybody has information regarding this despicable act please contact me at my email address. I will forward the information to the proper channels. On a more positive note, I hope you all noticed the great face lift to the windmill corner. We will continue rejuvenating our “first impression” features. Next will be the upper area along the sound wall along Vista East side in July. Just more steps towards making our community the most coveted on the Valley floor. In closing, on behalf of the Board and our partners (Associa Sierra North ASN—our community management partner, ESI Security, Reno Green landscape maintenance) I hope you all had a memorable July 4th and wish you the best summer ever. hope this 3rd quarter edition of the HawkTalk finds everyone well and that you all are having a wonderful summer so far. This is the perfect time to complete any improvement projects around your property. Please remember to seek/obtain approval by the DRC before making any exterior modifications/alterations. Many owners have recently been granted approval to paint their homes which is great for the entire community. Remember, if you are applying the same colors as the original paint, you do not need to obtain DRC approval. We recently met with the Wingfield Springs Kelly Moore representative in efforts to streamline the process for owners picking out new paint color schemes to submit to the DRC. Please be sure to visit the Kelly Moore Store on Markey Street in Reno when you are ready to start looking for colors. Let the store representative know that you are a Wingfield Springs owner. There are two reasons why it is important to let them know this; the first reason is because there is a paint color scheme brochure specific to the community. These are the colors and color combinations from which all owners should be choosing. There are also two pre-approved specially mixed fence stain colors that can be found at the Kelly Moore store. The second reason is that Kelly Moore offers a 45% discount for all Wingfield Springs owners on their paints and stains! If you have any questions of Kelly Moore, please contact the local sales representative, Kenneth Barnett at 356-1600. There has been sufficient time to ensure your landscaping is up to par and your lawn is well maintained and manicured. We have started sending out non-compliance letters for lawns that are not being maintained or need attention. The Board is aware that there are a handful of abandoned/foreclosed homes that unfortunately include lawns that are not being maintained by either the owner or the lender. We understand the frustration that this causes for their neighbors. Please be assured that the Board is taking necessary action in efforts to resolve this matter with the offending parties by following the Association rules and regulations, fine and lien policies. There are some owners who fail to comply and let their property fall into disrepair. The Board plans on reviewing this issue to determine the magnitude and decide if a different course of action is feasible. This is a reminder that there is no parking in the cul de sacs within the community. No Parking signs have been posted on all cul de sacs because emergency vehicles need access 24/7. WSCA CC&Rs and Rules & Regulations also require no parking. If you witness someone removing a no parking sign from a cul de sac location, please report this to the Association immediately. A removed sign by an unauthorized party does not take away the authority to enforce this rule. All violations of this rule will be enforced accordingly. Lastly, it has come to our attention that some owners, or guests of owners, are utilizing other owners’ vacant lots by parking on them and/ or driving across them. This is trespassing and should be avoided unless you have received permission from the vacant lot owner to do so. Please be respectful to your neighbors and their property. We Can Be Thankful... that Nevada convenes only every two years, as compared to our neighboring state on the west, to consider more new laws that impact us. The 77th Session ended on June 4, after a very brief Special Session to pass five “urgent” bills that failed to meet the midnight, June 3rd deadline for the mandatory 120 day period. [AB = Assembly Bill and SB = Senate Bill] Although most legislators recoil at the thought of actually dealing with evaluating proposed statutes for the NRS 116 Chapter, they nevertheless keep “refining” the laws under which common interest communities are governed. This session, by concerted effort, we defeated several very intrusive, even oppressive, proposed bills. Rather than reading about them, here are the details on several important ones that the Governor did sign into law. Most take effect October 1. AB 395: HOA Bullying Bill This makes it a misdemeanor for a manager, agent, a board member, officer, employee of an association or a unit owner or a unit owner’s guest to willfully and without legal authority to: § Harass or otherwise engage in conduct which would cause harm or serious emotional distress or reasonable apprehension of harm or stress; OR § Create a hostile environment for that person. In plain English, folks living in, governing and operating associations can’t bully each other. If a manager or board members issues a fine or citation pursuant to the governing documents, it would not be harassment [have legal authority]. A Board member could not claim harassment if a unit owner petitioned for a mediator [allowable]. Hostile environment is a somewhat vague standard, but is typically exhibiting a pattern or unwelcome and hostile actions. It’s a good idea to approach disagreements in a civil and polite manner while sticking to known facts and avoiding personal judgments or opinions. Best practices include being reasonable and professional. SB 130: Photo Support for Violations State Senator Don Gustavson, our representative, introduced this bill because of his personal experience with how a violation was handled by the management company. Now: § Details must specify the alleged violation § Proposed action that unit owner is asked to take to cure the violation § The amount of the fine § The date, time and location for a hearing on the violation AND § A clear and detailed photograph of the alleged violation, if the violation relates to the physical condition of the unit/property or the failure to act when it is possible to obtain a photograph. Note: the intent is to be clear [no blacked out or hard to see the infraction photo]. A continuing violation [one not cured usually w/in 14 days] may incur additional fines for every 7 days that the violation is not cured and there does not have to be an opportunity to cure or notice of opportunity to be heard [new requirement]. The law does not give the association the right nor does it require the association to enter private property to obtain a photograph. AB 370: Referee Program & Alternative Dispute Resolution Changes The Real Estate Division has created a new, optional ADR process for complaints and makes other changes to existing mediation and arbitration requirements. It is called a “referee program”. There are very specific rules under which an aggrieved party may file a

complaint relating to the CC&Rs or procedures used for increasing, decreasing or imposing additional assessments [AKA special assessments]. The RED appoints and assigns the “referee”. There is a $50 fee for both the complainant & respondent. The “referee” issues an opinion and an award determination. No costs or attorney’s fees may be awarded [The standards and experience to be a “referee” are still TBD]. Either party has 60 days to challenge the ruling in court. If either party does NOT agree to enter the program, the dispute goes to mediation. Mediation has its own set of rules and the mediation is limited to 3 hours at a cost of $500; with the option of continuing the mediation at a cost not to exceed $200 per hour. Parties may also agree to enter arbitration [if one party did not like the “referee’s” or mediator’s result]. Caveat: The parties must agree to binding arbitration. Costs may not exceed $300 per hour. Comment by Board member Brainard: What will the requirements for a “referee” be? Historically, NV mediators and arbitrators must have met certain criteria to hear cases regarding community association matters. Now the selection of a referee is up to a “bureaucrat” in the Real Estate Division. AB 370 does not impose any legal, community association or other knowledge requirements on a referee. This is a big step backward. The referee program needs regulations to be adopted...usually a six-months to at least one-year process. A matter to watch. SB 280: Escrow, Letters of Intent & Demand Letters This was the omnibus bill in 2013. Near the end of the session this bill became the “home” for issues that failed to pass in earlier bills, but not all were successful. While some provisions are not “community association friendly”, it could have been much worse. There was intensive lobbying by all sides with interests in how our common interest communities are governed. Three broad areas are: § Escrowing of community association assessments [due monthly here in Wingfield Springs]; however, both the bank & homeowner must agree to an impound account. § Letters of intent [adds an additional step to the notices—after 60 days past due—required prior to the association sending a notice of delinquent assessments; requiring more information be sent to the owner] § Demand letter [usually needed in a property’s resale] may be requested by the unit owner, an agent of the unit owner or the holder of a security interest on the unit [lender] and must contain the amount of the monthly assessment for common expenses and any unpaid obligations of any kind currently due from the selling unit owner. AB 273: Foreclosure Mediation Program A last minute pop-up! It automatically enrolls a delinquent owner into the program overseen by the NV Supreme Court. However, that owner does have to respond & pay a $200 fee to participate. Last minute amendments require the owner to pay current assessments on his home, and the trustee must notify directly the association when the owner completes/ fails to complete the program. When the officer responded Sparks Police were onsite. Officer was unable to make contact with Sparks Police. • A resident reported young children riding bikes in the road without adult supervision. The officer responded and found the parents onsite. No further action was taken. • Resident complaint of children riding a motorcycle up and down the street for most of the day. The officer responded located the children and made contact with the parent. The parent apologized and the motorcycle was put away. • A resident called in a complaint of children doorbell ditching in the area of Ambush and South Florentine. The officer responded to the area. The officer was unable to locate any children in the area or suspicious activity. • A resident called in a complaint of an individual who stated he worked for AT&T soliciting in the area. The officer responded to the area. The man was located and the officer made contact. The man was able to present his AT&T
paperwork. The officer informed him that soliciting was not authorized in the Wingfield area. The man left the area without issue. • A resident called in with a noise complaint and complaint of Christmas lights on. There was no music heard upon arrival. The officer made contact with the resident. The resident agreed to turn off the Christmas lights. • Resident complaint of a vehicle revving the engine. The officer responded to the area and located the vehicle. The officer informed the owner of the complaint. The owner of the vehicle stated was tuning the vehicle and was done for the day. • Resident complaint of a vehicle parked in the same place for several days. The officer responded to the area and located the vehicle. No action was taken against the vehicle as it was parked legally. • Resident complaint of a vehicle possibly leaking fuel. The officer responded to the area and located the vehicle. The officer found a faint smell of fuel but found no evidence of a leak. • Resident complaint of a bonfire in the neighbor’s yard. The officer responded to the area. The officer found it was a gas fire pit and there were no violations. • Resident complaint of a loud party in the Ambush Circle area. The officer responded and made contact. The officer informed the individuals of the complaint and asked them to quiet down. The individuals complied. • Resident complaint of children playing doorbell ditch. The officer responded to the area and was unable to locate the children or any suspicious activity. • Resident complaint of loud music in the Poco Bueno Circle area. The officer responded to the area and found the location of the music. The officer made contact and the individuals were informed of the complaint and turned down the music. SUSPICIOUS ACTIVITY • A resident in the area of Ten Mile Drive and Banestone called to report there had been children throwing rocks at homes near the bus stop. The officer went to the bus stop area and watched as the children waited for the bus. No suspicious activity was seen. The officer watched the area for several days. • A resident reported a car rack was stolen from their residence. Officer responded and Reno Police had already been notified, officer took a report and was on the lookout for any suspicious activity. • A resident called and stated their kitchen alarm was sounding. They had remotely turned off the alarm. They asked that an officer check out the situation. The officer responded and checked all exterior doors to the residence. There was no sign of forced entry or suspicious activity.
• A resident called to report a suspicious white truck parked on Runningmead. The officer responded to the area and located the vehicle. The officer made contact with the driver. The driver was the newspaper delivery person. There was no suspicious activity in the area. • A resident called and reported a suspicious white car with the lights on. The officer responded and located the vehicle. The vehicle doors were locked with no persons inside. It appears that the owner had left the lights on by accident. • A resident of Silverton Way called and reported a group of juveniles had hopped the fence in his neighbor’s yard and were throwing rocks in the pond. The officer responded to the area and was able to locate said juveniles. The individuals were on Red Hawk Golf Course property. The officer contacted Red Hawk security with the information. Red Hawk security dispatched an officer. • A resident called stating there was a group of children in the park playing basketball. The resident was concerned about the group vandalizing the area. The officer responded and made contact. The group was being supervised by parents, there was no suspicious activity seen. • A resident called and reported a group of males attempting to enter a Black BMW with a coat hanger. The officer responded and was able to locate and contact the group of individuals in question. The officer was informed that the individuals had locked the keys in the vehicle and were waiting for the tow truck. The men provided identification. The officer remained in the area until tow truck arrived on site. VANDALISM • While on patrol the officer located new graffiti. The residents were not home. The officer took photos and included the residence in the patrol watching for any suspicious activity. • A resident called and stated they had seen a group of children being loud and throwing trash bins around the park. Officer arrived onsite there were no persons in the area. The officer picked up the trash can. • A board member called and reported a young male on the Wind Mill. The officer arrived on site the young man was on the wall. The officer has seen this young man before and it is believed he is a “free runner.” The officer was unable to locate the individual. • The officer found light graffiti on the back fence of a home on Banestone. The officer took pictures and reported the issue to Associa. • The officer found two homes with toilet paper on them in the area of Island Queen Drive and Rey Del Sierra. The officer patrolled the area looking for any suspicious persons or activity.

2013 AQUAFEST 8/17/2013 | 10 am | $30 Idlewild Park, 1805 Idlewild Dr., Reno Sierra Nevada Community Aquatics will be hosting our 5th annual Aquafest on Saturday, August 17. The event will be held at Idlewild pool and utilize Olympic athletes as hosts for the day’s activities. The day will begin with several aquatic clinics oriented toward the local youth, masters, and triathlete club swimmers. This will be followed by the successful fun relay meet we held last year. Next on the schedule will be a “free swim day” for the general public from 1–4 pm. We plan to host water safety courses during this time and attempt to promote the value of aquatics and the need for support to the community in general. Throughout the day SNCA will have a low cost barbecue meal available for attendees of the various events. The day will end with an evening dinner fundraising event at the California Building where we will once again use the athletes and their experiences to help relay the dire need or new aquatic facilities in the region.

GIANT SECRET MUSIC FESTIVAL 9/14/2013 | 10 am | $45 Wingfield Park, 1st St. & Arlington Ave., Reno Giant Secret Music Festival is an independent movement of sound and culture. An experience that calls out to the true music lover, jammed packed with the best music, mixed in with the standard festival perks, including Reno’s first silent disco. Proceeds will benefit High Sierra Industries, a local non-profit.
