Photocopier & MFD contracts – buyers beware! The leasing of photocopiers, multi-function devices (MFD) and other equipment is an area in which schools frequently find themselves in contractual difficulties. Headteachers, governors and school staff need to ensure that great care is taken when considering entering into contracts for these products and their associated services. Poorly constructed deals can have a serious and long-term impact on schools’ finances and there are some unscrupulous firms out there saddling unwary schools with expensive arrangements.
Some tips to help protect you and your school If you are considering entering into a new contract and want to make sure that you are getting the best possible value for your school, following these simple recommendations will help you to make the right choices: Lease type – make sure that the contract is an Operating Lease and not a Finance Lease. An Operating Lease allows you to rent the equipment directly from a manufacturer or supplier who retains responsibility for maintenance and repair. The structure of a Finance Lease means that it is considered a form of borrowing. The finance company buys the equipment from the manufacturer and leases it to the school. The school does not get the benefit
of any warranties or guarantees and is responsible for maintenance and repair. Schools are prohibited from entering into Finance Leases under the Kent County Council Scheme for Financing Schools. Terms and conditions – read these carefully and ensure that the document you are signing reflects the actual deal that the salesperson said you were getting. Always ask for all the costs to be broken down in a way that makes it clear to you exactly what you’re paying for, and why. Never allow yourself to be talked into signing an incomplete agreement and always keep copies of signed agreements.
Shop around – there are now providers in the market who will lease equipment on a shorter term basis rather than tying you in to the typical three to five year contracts, and who won’t require long periods of notice to terminate. Find out if there are any existing tried and tested contracts or frameworks available within the local authority that you can buy into – these are likely to offer better value than a standalone deal. Upgrading – if you upgrade during the term of an Operating Lease make sure the price you are paying for the newer machine does not also include a rolled over amount from any time outstanding on the original lease. This can lead to escalating costs.

Case Study Firth Park Academy’s lighting was predominantly old, high energy fluorescent style fittings, expensive to run with high maintenance costs. Several corridors were over lit due to the high quantity of fittings installed and lighting was extremely harsh. Academies Enterprise Trust (AET) approached LASER and the challenge was to design an LED lighting system that could quickly pay for itself through savings in electricity bills whilst providing softer lighting that still creates a bright, clean look.

FRAMEWORK SCOPE In accordance with best procurement practice, EU and UK procurement directives and regulations The Procurement Partnership Ltd (TPPL), on behalf of KCS, created and lead on the national framework for the supply of rental vehicles.
FRAMEWORK USE Our national framework is available for use by all public sector bodies and charities including: • Blue light services • Schools and academies/academy trusts • The NHS and NHS trusts • Housing trusts/associations • Publicly-owned private companies • Local authorities

INDIVIDUAL CONTRACT AWARD The agreement operates via an online pricing platform, which all suppliers to the framework are required to integrate with and upload pricing to, giving customers access to competitive, compliant pricing across a wide range of vehicles at all times as well as allowing bookings to be completed. Customers will select suppliers via the following methods: 1 DIRECT AWARD Customers will issue call-off contracts under this agreement using their necessary vehicle specifications and supplier price lists to determine which vehicles are suitable for hire. All relevant information will be available from the online platform provided to members. 2 MINI COMPETITION Customers can run mini competitions for long term, higher volume proposals. TPPL will tailor a specific document, incorporating various elements for evaluation to be run (free of charge) through the Delta e-sourcing portal on behalf of the customer. Alternatively, customers can conduct mini-competitions through their own portal providing they inform TPPL of the exercise and its outcome and include relevant framework references. In any event the Contracting Authority takes no responsibility for the chosen contracting method of any Participating Authority.

There will be three lots: Educational catering services, Social and Healthcare catering as well as Venue and Event Catering.
