2024 - QUARTER 1
As I sit to write the introduction for this quarterly, it was only days ago that a major national development rocked our industry. The National Association of Realtors has recently announced a settlement in what you may have seen in the news as “The Commission Lawsuits.” This settlement changes some of the key points in how we operate – and it is important enough that I have dedicated an entire article to it later in this quarterly. Please read on for details!
More importantly for us here locally in Washington State, the majority of the changes for us took place 3 months ago at the start of the year. I am very, very proud of the changes the Washington legislature made and our state-wide Washington Association of Realtors. I feel like they were leaders in setting an example for the rest of the country to follow.
Furthermore, I am very proud of our team for giving this new way of doing business a large priority and responding to the changes quickly and with professionalism. The timing is perfect for this issue to have an in-depth look at the structure of our team and how we got here today.
I have always felt that our business model and continued focus on innovation provide a massive amount of value to our clients. As the rest of the nation and industry flounders and tries to figure out what to do, we don’t have that problem. We reflect on our mission statement and core values.

AGENCY LAW CHANGES & BOMBSHELL COMMISSION LAWSUITS
At the start of the year Washington State passed sweeping changes to Real Estate Agency Law and drastically changed the way we have been operating for the first time in over 20 years. This change was a response to what the state saw coming down the pipeline from national class action lawsuits alleging that the National Association of Realtors had conspired to keep commission rates high by forcing sellers to pay buyer agent commissions when listing a home for sale in the Multiple Listing Services (MLS) that agents use to distribute available houses for sale to other agents.
Agree or disagree – the court found NAR and a few other national firms guilty and ordered them to pay over 3 billion dollars! Yeah, you read that right BILLION with a B. Now in the last few weeks details have come out about a settlement for around 400 million but more importantly to the industry and consumer – NEW RULES!
The basis of the lawsuit from sellers was the fact that by offering a set amount of compensation up front to pay agents
representing buyers, you were preventing the buyers from negotiating lower fees and nationally keeping commission rates inflated. Between these lawsuits and some Department of Justice investigations it became apparent to the industry and consumers that the goal was to separate the commissions and have sellers pay their own agent and buyers pay their own agent. Also paramount to the rule changes was the fact that sellers if they chose can now offer to not pay any incentives or portions of the buyer’s agent commission when listing homes in the MLS.
No one knows for sure what the result of this new system will be and I have more thoughts than this article allows me space to give. The one thing we do know is that we have always had a strong commitment to our mission statement, and regardless of what the rules are, we will adapt to work within them to continue our mission which is: “To help people meet their personal & financial goals through the assistance of buying, selling, and managing real-estate.”
THE BIGGEST CHANGE TO THE CONSUMER:
The biggest change that is first and foremost is the introduction and requirement for BUYERS who are working with an agent to have a signed Buyer Brokerage Agreement with that agent. This means that if you want to go look at a house with an agent who is acting as your agent and providing you with real estate services – you must have a signed contract to do so. I imagine that most of our past clients and consumers reading this had never thought of that. This is a core requirement however because now if the BUYER is responsible for their own agents’ pay – they must have a contract and in my opinion more importantly a conversation about what that pay structure is.
Buyers in many cases the bottom line now is: If you and your agent write a contract on a house where the seller is not offering compensation to your agent – you ultimately may be responsible for it. Know what you are signing.
There might be fewer agents in the industry due to this change, and I’m fine with that. If they can’t adapt and change, they probably shouldn’t be here. The ironic part about these changes is I have been training my agents to use these agreements for a long time. I’m happy to see these changes but it’s also a little sad to think it took legislation to put it into place. We’ve never had a problem showing our value and asking to be compensated for it. KENMORE TEAM ORIGINS
THE VERY BEGINNING:
In late 1999, I had just returned from college, and Karen and I had just gotten married. In college, I had taken a few real estate courses and studied economics. These courses sparked an interest and passion inside me for real estate investing. I was fortunate to grow up across the street from one of the most successful realtors in the Tri-Cities at the time. I knew I wanted to earn some extra money and start saving for a house and an investment property right away. To do that I took some lawn mowing jobs on nights and weekends. I asked my former neighbor if I could mow the lawns at the brokerage. He agreed, and one night he came out to talk to me and he said I could earn that money a lot faster for that new house if I was selling real estate rather than mowing the lawns!
It was just the opportunity that I had been looking for. A few months later I was licensed and headed into the world of selling real estate. The first few years in real estate were slow, learning the business, and working multiple jobs at once.
ALL OR NOTHING:
In 2004, I took a leap of faith and went fulltime into selling. My wife and I met in college and one of the best things we ever learned was the theme from our college which was “Developing Life-long learners.” We both came from a world of sports with teamwork and coaching. I was very fortunate that my uncle from Arizona was about five years ahead of me in real estate. He had stumbled across a coaching and training company in Southern California.
I was immediately hooked from my first conference. This company was helping agents across Southern California and the East Coast arrange their business like a sports team, with each individual on the team having specific jobs etc. It clicked for me right away. No one in the Tri-Cities was selling real estate like this. I knew immediately that I wanted to replicate what I was learning in the Tri-Cities.
BUILDING THE
ADDING TEAM MEMBERS AND EDUCATION:
Karen joined me in the business in 2005 and made the foundation of our team very strong. We hired our first team member by 2007 and never looked back. Of course, as is the case with any business we experienced some growing pains along the way. Not everyone is cut out for Real Estate and it takes time to change an industry that is entrenched in tradition and “This is how we always have done things.” Karen and I were constantly traveling and visiting teams that were more efficient and doing business with new technology. I remember coming home from one of these trips and implementing “digital signatures” with our clients to save them time (which by the way is how 90% of agents now do things). No one in Tri-Cities had ever seen a contract signed like this and for about 6 months half the agents in town wouldn’t accept our offers until someone signed them with a pen!
A NEW BRAND IS BORN:
In 2012 we decided that to grow our Team to the next level and advertise with guarantees the way that we wanted to, we would have to open our own brokerage and brand. This is the year that we established ourselves as an official brokerage.
Having dedicated team members helping us with paperwork, photos, showings etc. allowed Karen and I even more time to increase our knowledge on marketing and find new avenues to help sellers reach more buyers and buyers find a better selection of houses faster.
EXPANSION OF SERVICES:
As our client list of investors and homeowners grew, they were constantly asking us for a reliable source of referrals to handle their property management. In 2017, we purchased a small property management company and expanded our brand into a second Brokerage dedicated to Property Management with the same team concept and strong values we used to build the sales side of the business.
Within a few years of this expansion, we encountered another problem. Our homeowners and investors were not getting contractors to make repairs and turn properties as fast as our expectations were. This led us to another expansion and the brand expanded again by adding Kenmore Team Construction and becoming a licensed general contractor. We primarily serve our customers from this company, offering them a superior service in the small repair construction industry.
LOOKING TO THE FUTURE:
In the works currently, we have been expanding our footprint across the region. We recently opened and became licensed in Oregon, working mostly in Hermiston, Umatilla, Pendleton area. We now also sell in Walla Walla, and often travel up the valley as far as Sunnyside. Our team continues to grow, and we are adding agents to serve these new markets.

As the Business Development Manager, I assist property owners with the onboarding process to property management. I also create and nurture key referral partnerships with other industry leaders. Some of my day-to-day duties include meeting with property owners for rental analysis, assisting current owners and clients with key issues, and attending local board meetings and community events.
SIERRA JONES
As the Leasing Manager, my primary role and day to day is working with applicants, tenants, and owners during the initial leasing, renewal periods, and move outs of properties to ensure a seamless and quality experience for all parties. The process includes a wide range of task such as completing marketing packages for homes and posting them online, tenant screening, communicating with future tenants and owners, and issuing leases. Renewals offers, market analysis, and proper notices are of high importance during releasing periods, and property move outs include deposit dispositions, lots of communication, and then starting the whole process over again.
JORDAN ANGELO
As the Property Manager, I manage our in-house construction teams schedule, coordinate maintenance for all our rentals. All while communicating with vendors, tenants and owners.

As Operations, I work with our accounting team and handle the accounting, owner communication, on boarding new properties and answering any questions tenants or owners might have.

As the Leasing Assistant, I help potential tenants look for and find the home that they are interested in, from there I show them the property, explain to them our process and also answer any questions they may have. After applicant approval, I meet the tenant at the home for them to pick up their keys! I am typically the first point of contact for potential tenants when it comes to either showing them a property or if they reach out and just need some information.

As the team lead for KTPM my role is to assure the division runs efficient, makes progress toward our goals, minimize risk to the company and to ensure a quality property management experience is being delivered to both owners and tenants. Day to Day duties include executing management and lease agreements including renewals.
