Tender awards rejected and set aside by High Court The Greater Tzaneen Municipality has been lambasted by the High Court for serious irregularities in the awarding of two tenders for the upgrading of two gravel roads to tar. The Municipality has also been rapped over the knuckles by the Judge for a string of wrongdoings: possible contemptuous conduct, failing

to comply with the Constitution, for not being transparent in conducting their business, being unfair, failing to implement risk management, failing to act cost-effectively and not running a fair, equitable, transparent, competitive and cost-effective procurement process etcetera. The High Court has now set aside the tenders

and the GTM has to commence afresh with the tender process (within21 days). Legal costs resulting from the mismanaged tenders will yet again rob Tzaneen’s ratepayers of many hundreds of thousands of rands and there is also a possibility of huge claims against the GTM. • Read our full report on page 7

Winners’ first sho’t left experienced SA Tourism in partnership with SA’s favourite trio, Mi Casa, visited Tzaneen last week, with the aim to discover hidden gems that Limpopo has to offer. The tour covered all nine provinces, to promote domestic tourism in the country. Limpopo is said to be the number one tourism province in South Africa. J Something said, ”through this project we aim to see an increase in South Africans being inspired to have their very own #My1stShotLeft”. Mo-T added that “we also have realised that tourism plays a very important role in putting food in people’s mouths”. And Dr Duda concluded by saying that “when more people travel, we get an opportunity to create jobs from the local tourist guide that takes you to the local chesa nyama to the guy that helps you when you’re about to jump off the Soweto Towers.” These experiences do not end with celebrities and Media — they’re accessible and affordable to every South African. The three young winners that were part of

the tour said that they never got a chance to travel, so winning the sho’t left competition made them get their first sho’t left experience. “In a space of two days, we experienced local popular tourism attractions like Magoebaskloof Canopy Tours. We were joined by some awesome people on the trip, including Muvhango actress Phindile Gwala, Mashabela the comedian and Isibaya actress Kabomo Vilikazi.” This exciting initiative was aimed at highlighting interesting and fun leisure opportunities, such as wall climbing and quad bik-

In recent years, new drugs called ‘biologicals’ have improved cancer survival and remission rates to unprecedented levels. Although ground-breaking, and proven to mean the difference between life and death in many clinical trials, biologicals come with a hefty price tag. The interplay between health insurance products from medical aid to critical illness, disability and even gap cover requires an experienced eye to get the balance of benefits right for each person’s unique circumstances,” says Rafique Saville, Principal Officer of Professional Financial Solutions. It’s exactly this situation that Rafieq’s client, “Mary*, found herself in when she was diagnosed with peritoneal cancer. In fact, this was Mary’s second cancer diagnosis after surviving breast cancer. (*Name changed to protect her privacy) Mary did not respond to conventional chemotherapy and radiotherapy which lead to her being put on biological treatments at a huge cost that her medical aid did not cover. With stage 4 peritoneal cancer (a rare cancer that affects the tissue that lines the abdomen), Mary required her biological treatment every 16 days at a cost of R26 000 per vial — costs which she had to cover herself. She has been on this treatment regime for a year now and her cancer is stable, has not spread any further and doctors are hopeful about recovery. But it has come at a price: 23 treatments per year comes in at R600 000. Thankfully, Mary’s critical illness policy with Hollard paid out a substantial lump sum within days of diagnosis and submission of the necessary paperwork. Had it not been for

this cash lump sum that she used to pay for the biological treatment, the outcome could have been very different today. “People don’t often consider the fact that the financial implications of a serious illness may run well beyond the cost and duration of the initial treatments,” says Chegwidden. “High rehabilitation costs can also be incurred over an extended period of time. Post treatment, living with cancer may require a complete change in lifestyle. In addition, if you are seriously ill, it is likely that you will also experience a loss of income due to being unable to work for an extended period of time, possibly even permanently. For the self-employed, this presents an even greater risk. These are costs that will not be covered by your medical aid and the financial implications are far-reaching. Cases such as this demonstrate why it is essential to have critical illness and disability cover in place. However, in planning your cover, it is important to remember that critical illness and disability products are not replacements for medical aid; but complimentary benefits in a well-structured healthcare portfolio ” he explains. “As a financial planner, we often experience the exact impact that financial planning has on our client’s lives first hand,” says Saville. “In Mary’s situation, one important lesson stands out: medical aid is vital however it is simply not enough. Mary was well covered with medical aid, critical illness and disability cover which means that she emerged from her illness not only with her health intact, but her finances too.

One killed in NTK robbery Four armed suspects attempted to rob a branch of the NTK Coop at Trichardtsdal on Monday. One of the suspects fired a shot at the cashier, but was shot dead when the owner of a security company, who happened to be in the store at the time, retaliated. Another suspect was heavily wounded by a gunshot to the shoulder. The other two suspects fled in a red Citi Golf. It will be hard —if not impossible — to proof wrong accusations of the GTM being reckless in wasting taxpayers’ money on court cases (fraught with exorbitant legal fees). Millions of rands have been spent wastefully and fruitlessly by this municipality in the last couple of years on legal matters. What is equally alarming is that often during these legal proceedings it became clear that the GTM’s affairs were managed irresponsibly, showing clear signs of irregularities that strongly reminded observers of corrupt behaviour. Today we expose yet another serious faux pas by the GTM. In a strange and inexplicable way they switched bidders in a tender. They also seemed to have bent over backwards to find a reason to award the tender to the highest bidder, which would have cost the taxpayers millions of rands more. It is time that the mayor and her team of councillors, as well as the senior management of the GTM (especially the municipal manager and the chief financial officer) are challenged to report to the community why they allow this ‘habit’ of getting caught on the wrong side of the courts. But who will challenge them? Tzaneen does not have a ratepayers association (what a shame!), and the business chamber is too busy socialising to get involved. Have we become so blasé that we don’t mind this dangerous state of affairs?

Twaalf jaar gelede op Vrydag 14 Mei 2004 het ons oor die krisis in munisipaliteite in Limpopo berig; en met vers en kapittel uit die Ouditeur-generaal se verslag bewys dat ook die GTM en die GLM se sake nie goed loop nie. Twaalf jaar later kan met reg gevra word of dit hoegenaamd beter gaan. Dan was daar ook ‘n voorbladberig oor mnr Tertius Horn van Letsitele wat op pad van die Eiland af in ‘n rondloper-seekoei vasgery het en ernstig beseer is. Hy het gelukkig die voorval oorleef. Die foto is van hom in sy hospitaalbed (MediClinic Tzaneen wat destyds nog as die Tzaneen Private hospitaal bekend was) en sy twee kinders.

Die wêreld waarin ons leef het al ongelooflike liefdesoffers aanskou en beleef. Een daarvan is die verhaal van Alice. Sy was die tweede oudste dogter van koningin Victoria (1819 – 1901), die Britse monarg wat vir 63 jaar en 7 maande oor Brittanje geregeer het. Alice se jongste seun, Ernst-Ludwig, is met die dodelike siekte witseerkeel besmet, waarvoor daar in daardie stadium geen geneesmiddel was nie. Dit was hoogs aansteeklik en dodelik en enigiemand wat simptome daarvan getoon het, is onmiddellik in kwarantyn geplaas. Alice is glad nie toegelaat om onbeskermd by Ernst te kom nie. In ‘n stadium het Ernst vir die verpleegster wat na hom omgesien het — terwyl hy in afsondering was — gevra waarom sy ma hom nooit meer soen nie? Die verpleegster het na Alice gegaan en haar vertel wat Ernst gesê het. Dit het haar moederhart gebreek. Alice het dadelik opgestaan, na Ernst gegaan en hom met haar soene versmoor. ‘n Paar dae later is sy begrawe. Wat dryf ‘n ma om soiets te doen? Net een woord: Liefde! Wat dryf ‘n God om sy ere-posisie langs sy Vader in die ongelooflikheid van die hemel prys te gee, homself te verneder, mens te word, voor mense wat Hy met sy eie hande geskape het te laat verneder, deur sy eie wil na ‘n verskriklike marteling te stap, toe te laat dat hy gegesel word, bespot word, gekruisig word en sy lewe op te offer sodat ons kan lewe? Net een woord: Liefde! 1 Johannes 4:9 – 10: “Hiérin is God se liefde vir ons geopenbaar: sy enigste Seun het Hy na die wêreld toe gestuur, sodat ons deur Hom die lewe kan hê. Werklike liefde is dít: nie die liefde wat ons vir God het nie, maar die liefde wat Hy aan ons bewys het deur sy Seun te stuur as versoening vir ons sondes.”

ander regte. Die reg op vryheid van spraak is net soos die reg op menswaardigheid ‘n integrale deel van ons demokratiese bestel. Gevolglik moet die reg ‘n balans handhaaf tussen verskillende, dikwels mededingende, menseregte. Elke saak word op sy eie meriete beoordeel, om te bepaal welke reg onder bepaalde omstandighede sal seëvier. Vryheid van spraak beteken die publikasie van lasterlike stellings word somtyds beskerm. Dit is byvoorbeeld regmatig om lasterlike stellings te publiseer, wat waar en in die openbare belang is. Ook as dit kom by verslaggewing oor hofverrigtinge geniet die media vrywaring teen lasteraksies, solank die verrigtinge billik en akkuraat weergegee word. Die beginsel hier is dat regspleging in die openbaar plaasvind en dat dit van die media verwag word om verslag te doen oor dit wat in die howe gebeur, al is dit lasterlik ten opsigte van sommige partye. Die media maak egter soms foute. Mense wat onregmatig belaster word het wel remedies.

Wat is laster? Die Grondwet waarborg aan elke persoon die reg op menswaar-digheid. Dit word beskou as een van die hoekstene van ons demokratiese bestel. Wanneer iemand dus jou goeie naam en reputasie skend deur laster te pleeg, is jy in beginsel geregtig op toevlug tot die reg. Maar wat is laster? Dit is wanneer ‘n persoon se goeie naam en reputasie geskend word deur die publikasie van lasterlike woorde. By laster is die vraag nie hoe jy self voel oor die publikasie nie, maar of regdenkende mense by kennisname van die publikasie geneig sal wees om minder van jou te dink. Die hof gebruik ‘n fiktiewe “redelike mens” as maatstaf om te bepaal of ‘n stelling lasterlik is of nie. Ook belangrik is dat “publikasie” enige vorm van kommunikasie insluit, hetsy deur die gesproke woord, geskrewe woord of selfs foto’s. Laster kan gepleeg word op enige platform en in enige formaat, insluitend op webtuistes, blogs, sosiale media en in koerante of tydskrifte. Die grondwet beskerm egter ook

GTM gets a heavy punch on the nose Tenders rejected and set aside by High Court • Legal costs to skyrocket

The Greater Tzaneen Municipality (GTM) has been dealt a knockout by the High Court (Gauteng Division, Pretoria), by ruling that two tenders processes for the upgrading of roads in rural areas should commence afresh. Acting Judge Crouse made the ruling in two substantive applications for review. In the one case (for the upgrading of a gravel road between Mafarana and Burgersdorp to a tar road) and referred to as Project 1, the applicants were Quality Plant Hire CC and Expectra 388 CC (in a joint venture) and the respondents were the GTM and Selby Construction. In the other case (for the upgrading of a gravel road between Moruji and Matshwi/ Kheshokolwe to a tar road) and referred to as Project 2, the application was also brought by Quality and Expectra (again in a joint venture), whilst the respondents were the GTM, Matlala Nyapele Investment & Properties CC and Readira Refuse Services CC. In her lengthy written judgment Judge Crouse did not hesitate to point out that the GTM was in fact in breach of the Constitution of the Republic pertaining to the municipal procurement process. To add insult to injury the process followed by the GTM in the allocation of the two tenders was found not to have been fair, equitable, transparent, competitive and cost-effective. In her judgment Judge Crouse furthermore pointed to a Supreme Court of Appeal (SCA) finding that “the Constitution requires that the procurement of goods and services by organs of State shall be transparent, its purpose is to ensure that the tender process is not abused to favour those who have influence with within the institutions of the State or those whose interests the relevant officials and office bearers in organs of state wish to advance”. The SCA added to this that “it requires that public procurement takes place in public view and not by way of back-door deals, the peddling of influence or other forms of corruption”. Where and when did it all start? On 9 July last year (2015) the GTM’s bid evaluation committee (BEC) reported to the GTM’s bid adjudication committee (BAC) that Selby was recommended as the successful bidder on Project 1 for the tender amount of just less than R54 million (some R7 million

more than the price of the applicants). This recommendation was turned into an official award by the acting municipal manager at the time, on 29 August 2015. In an undated BEC report it was stated that the BEC met on 2 July 2015 and that Selby was recommended for Project 2 in the amount of just less than R90 million. In August the GTM’s bid adjudication committee (BAC) recommended that Project 2 in fact be awarded to Selby. This recommendation was also turned into an official award by the acting municipal manager at the time, on 29 August 2015, to Selby. However, in a rather strange and inexplicable way Project 2 fell into the lap of Readira for a tender amount of some R99 million. The applicants (Quality and Expectra) tendered for R15 million less! Judge Crouse said of this, “there is no indication of how the award to Selby turned into an award to Readira”. She added that “the argument (therefore) that the municipality could just, at a whim, substitute one successful bidder for the next, flies in the face of all the Constitutional principles applicable to State procurement”. “In not pursuing its private law remedies and merely awarding the tender at a higher price to Readira, the municipality failed, on the face of it, to act with transparency and cost-effectively,” the Judge said. The GTM, despite being invited by the Judge (on numerous occasions) refused to place evidence before the Court as to how Readira suddenly was appointed in respect of Project 2. It however became clear that Selby was found not to have the necessary plant and equipment for the tenders, but no further details of Selby’s scoring on other functionality criteria were stated. “It would have been very easy for the Municipality to have shown such a score card. They elected not to do so. It deliberately chose not to do so. I am therefore unable to find that Selby’s appointment was transparent or fair in the circumstances,” Judge Crouse found. The disqualification of Quality and Expec-

tra was based on an allegation (by the GTM and the others) that they did not have the required plant and equipment, but the Court found that this was not the case. They had more than what was required, but due to incomplete or wrong descriptions on the licensing papers for a tanker, a grader and an excavator their bids were disqualified. The Municipality also failed to give reasons for their decision to disqualify the applicants’ bids, despite a request from the applicants for clarification. “Neither did the Municipality implement an attempt at risk management and resolution of the dispute, as they are required to do in a procedurally fair process,” the Judge said. The court also found that the applicants’ position on plant and equipment was far more favourable than that of the other bidders. Selby had no plant and equipment and Readira had no equipment under four categories and the wrong equipment under two further categories. Quality and Expectra had all the required equipment, but the Municipality seems to have chosen to “use” the wrong information on the licensing papers to disqualify them. The Municipality also failed to give the bidders a reasonable opportunity to respond to clarify the position, according to the Court’s findings. “Having not done so (to allow the applicants to respond to the query pertaining to the licensing papers) has especially infringed upon transparency and cost effectiveness of the whole process,” Judge Crouse said. It was as a result of all these “unclear happenings” that Quality and Expectra sought an interim interdict during November 2015. During this time no work had been commenced with on the two projects. However, after the granting of the interim interdict, it was necessary for the applicants to bring a further application to interdict the respondents from continuing with the work on the two tenders. The respondents, however, continued to work on the projects. This could be seen as an act of contempt of court and even the

applicants’ Counsel disavowed that they would have given advice to proceed with work after the interim interdict. The GTM’s attitude was that the applicants’ objection (in the interim interdict) did not hold water. On this point the Judge also directed some harsh words at the Municipality. “Such an attitude is a dangerous one and again offends the rules of natural justice; but in the face of a valid court order, it is contemptuous. The Municipality, in not implementing risk management, failed in its Constitutional duty of acting in a procedural fair manner.” And finally the Judge decided not to allow a request that the Court should consider an order that the Municipality compensate Selby and Readira for the work done on both projects. “I have given serious consideration to this suggestion. I have decided not to do so, as I do not want to limit any remedy that either party may have against the Municipality or vice versa,” the Judge said. The court ordered that for both projects the decisions to disqualify Quality and Expectra are reviewed and set aside; that the GTM’s decision to award the tenders to Selby, Readira and Matlala, as well as the service level agreements entered into between the GTM and the respondents are reviewed and set aside; that the GTM is to commence afresh with the tender processes with 21 days of the order (26 April 2016); and that the respondents are to pay the applicants cost jointly and severally, the one paying the other to be absolved and that these cost should include the costs consequent on the employment of two Counsel. It goes without saying that the awards to Selby and Readira, now set aside, would have cost the taxpayer some R22 million more than the prices tendered by Quality and Expectra. In addition, the legal costs incurred by the GTM will undoubtedly amount to hundreds of thousands of rands. GTM builds a new sports centre at Runnymede

Family gardening project produces A special day to harvest the spitz vegetables at the Mmathakana family gardening project at Moime village, Lenyenye, was recently held. According to the project manager, Mr George Ramodike, it took them three and a half months to grow the vegetables (mainly spinach and cabbage) in a dry situation due to the shortage of water. “We are pleased that at last one thousand bunches of spinach would be supplied to our valued customers. We were fortunate enough to have survived the summer season, while supplying our customers until this favourable cold season which is suitable for a variety of vegetables,” Ramodike said. The gardening project aims at supplying all the creches and self employed business people around Lenyenye, BaNkuna, BaKgaga, BaMaake and BaThlabine traditional authorities, although a few of them are being supplied on a weekly basis — including pensioners. “We also managed to supply the newly established Molagadi Caterers in the Lenyenye shopping centre with vegetables twice a week,” Ramodike said.

Now the GTM has committed R28 million on a multipurpose sport centre currently under construction in Runnymede Village. The sports centre will boast both indoor and outdoor sports fields and will benefit thousands living in and around Runnymede. The centre, which will boast 1 200 meters of palisade fencing, will have a standard football pitch with standard size running tracks around. Both the field and the running tracks will be provided with special grass. The centre will also boast a concrete pavilion with roofing. Also included in the centre is a multipurpose hall to be used for indoor games such

as basketball, volleyball and netball. The hall will also house pavilions on the sides as well as ablution facilities. Outside and adjacent to the football pitch, the centre will boast basketball, volleyball, netball and tennis courts. These will be constructed in combos to reduce space and costs. Since grass will be used in the soccer field boreholes will be drilled for irrigation purposes. Participants using the facility will also have access to change rooms equipped with showrooms, lockers and shower benches. Ablution facilities will be provided for both players and spectators.

People living in villages were forced to settle for dusty sport fields to enjoy sport, but that is slowly changing in the Greater Tzaneen Municipality (GTM)”, according to the GTM’s spokesperson. Throughout the past week the police in the jurisdiction of the Tzaneen cluster have locked up 69 people for various criminal offences. In Tzaneen 47 people were arrested for various criminal activities. One person was arrested for assault, seven for assault GBH and nine for shoplifting. Another four people were arrested for theft, five for housebreaking and theft, two people for robbery, seven for counterfeit goods, three for possession of drugs, four for possession of copper cables, two for reckless and negligent driving and three people were arrested for contravening the Road Traffic Act. Unlicensed firearm case still going No outcome has been reached in the case against two traffic officers, Robert Mangalana (51) and Clifford Lubisi (45). The two accused are attached to the Tzaneen Traffic Station and they have been charged of being found with an unlicensed firearm at a gun shop. Mangalana and his co-accused Lubisi appeared in the Tzaneen Magistrate’s Court last week. The duo made headlines last year when they were arrested at a gun shop in Tzaneen. The average age of an entrepreneur in South Africa is between 22 – 45 years, according to the latest Global Entrepreneurship Monitor (GEM) South Africa 2014 report.

on the Monday, as there was an 08:00 cut off time to ensure that teams finish before dark. A team’s time was accumulative start to finish, covering over 270 km. Tiaan and Jeandre set off at 04:20 on the Sunday, in excellent racing weather, tackling the Witteberg mountain on the first run leg. They completed the 60 km run in 10:12, running into Balloch at 14:32. After changing into their cycling kit and having a bite to eat they set off on the 145 km bike leg. The bike leg is not for the faint of heart. From the hectic descents through gulley’s and down washed out roads to carrying and pushing your bike through the bush, rivers and up some steep and unridable passes, this was no joke. Not even to mention that most of the bike leg was done through the night. On the bike leg there were support points along the route where your seconding team could help you out with bike issues, food, nice hot coffee and much needed encouragement. Tiaan and Jeandre rode into Mdlokovana, the start of the paddling leg, 13:15 later at 04:50 on Monday morning, muddy, tired and cold. They had a proper meal, took out some sleeping bags and had a 30 minute power-nap. Waking up with the sunrise, they changed into their paddling gear. The clock hit 06:00 and they were ready to paddle, but the boats had not arrived yet due to a flat tire on the boat trailer. After watching all the other racers start and hanging around anxiously the boats arrived at 07:15 and they set off, wondering, has this ruined their race. After hitting some sand banks, a few moments of almost falling asleep while paddling and a very muddy portage around a weir they paddled underneath the Hertzog Bridge at Aliwal North, the finish for the War Trail 2016. They paddled 6:05 on the 65 km paddling leg and after the organizer deducted the time they lost waiting for their boats, they clocked an overall race time of 32:15. This shifted them into a second place finish overall.

The Tsholofelo community group visit Stanford Lake College every year, as part of Stanford’s outreach programme and the “dream an’ do Foundation”. Their itinerary during this year’s visit was jam-packed and activities included a canopy tour in Georges Valley, participating in a range of adventure activities at the school’s Outdoor Adventure Centre, and the highlight — an unforgettable day trip

to Kruger Park. They learnt about the wildlife and trees and were lucky enough to see three of the Big Five. They also visited the Riverside Wildlife Rehabilitation Centre, the Agatha Crocodile Ranch and a cheese and organic farm. The week-long visit was a massive success and they took back special memories. SLC is proud to be part of this programme to make a difference in the youth leaders’ lives.

All of us Stanfordians, along with the rest of the scholars attending the conference, provided service on one of our solidarity days. Our eyes were stretched wide open on these days as we were able to see that there are so many other people who are much less privileged than us. We felt that we had to change people’s lives for the better. Tien leerlinge van die Laerskool Tzaneen het aan ‘n Limpopo Provinsiale Skaaktoernooi in Polokwane by Northern Academy deelgeneem. Meer as 300 skaakspelers vanoor die provinsie het daar teen mekaar meegeding. Twee van die Larries het op o.14-vlak deelgeneem, terwyl die ander agt op die o.12-vlak deelgeneem het. The Led Lenser War Trail

A staff member of Stanford Lake College and his team mate achieved a remarkable finish in the grueling annual Led Lenser War Trail. This meant a 60 km mountain run, a 145 km MTB ride and a 65 km paddle race. The main event was the Stage event where individuals race one stage per day and sleep over, but the challenge that Tiaan Fullard (SLC staff member) and his team mate, Jeandre Theunissen, decided to tackle was the non-stop War Trail. Vossie is Limpopo se krieketspeler van die jaar Johan Harms van die Hoërskool Ben Vorster is onlangs deur die Limpopo Impala Krieketunie vir sy krieketprestasies van die afgelope krieketseisoen vereer. Hy is tydens die unie se jaarlikse galadinee en prysuitdeling as die unie se o.13-speler van 2015 aangewys. Die Northern Titans se assistent-afrigter, mnr Mandla Mashimbyi, het die toekenning aan hom oorhandig. Harms het in 2015, by die nasionale o.13-krieketweek in Johannesburg, die meeste lopies van al die provinsies se o.13-kolwers aangeteken. Hy het ‘n totaal van 344 lopies in die vyf wedstryde aangeteken, met ‘n gemiddeld van 86 lopies per beurt. Dit sluit twee vyftigtalle asook ‘n onoorwonne 119 lopies in. Harms het ook in 2015 die meeste lopies van alle Limpopo-spelers, ongeag hul ouderdomsgroepe, aangeteken.
