T

he Dolce Vita, or the “Good Life,” Ranch is one of the finest properties in this part of the state. It is a unique and one-of-akind property that any landowner, rancher, or architecture aficionado would truly appreciate. Located just 30 minutes from downtown Fort Worth, in Weatherford, Texas (“Cutting Horse Capitol of the World”), it is an ideal property for the weekend retreat or the full-time residence.

Location

The property is located approximately one hour and 30 minutes from Dallas and 30 minutes from Fort Worth in the heart of Parker County in Weatherford, Texas.

Land

Dolce Vita Ranch is considered to be in the Cross Timbers Eco Region of Texas. It is not uncommon in this part of the state, and specifically in this Eco Region, to find a combination of rangeland, pastureland, and farmland with dense cover in many areas including tree species such as blackjack oak, post oak, and live oak trees, as well as eastern red cedar and mesquite in some parts. This property has been very well manicured to create an ideal setting for both wildlife and livestock. Approximately 40 to 45 percent of the property is open pastureland, and approximately 55 to 65 percent of the property is heavily wooded or has good amounts of cover. There is both level land near the creek bottom and rolling hills looking off into the distance, making the diversity of terrain on the property truly unique.

Water

The subject property has three water wells that supply water to all of the improvements. Inside the main residence, an industrial water storage tank ensures that water pressure stays excellent at the home. There are two stock tanks, a seasonal draw on the west side of the ranch, and a small portion of frontage on both sides of Sanchez Creek.

Terrain & Topography

Elevation on the property ranges from 995± feet above sea level near the location of the main residence to 940± feet above sea level near the banks of Sanchez Creek. The majority of the soil located on the ranch is Windthorst fine sandy loam, as well as some Venus sandy loam and Bosque loam.

Improvements

Situated near the highest point of the property, the main residence of Dolce Vita Ranch is a spectacular masterpiece representing elegant sophistication and the finest examples of true craftsmanship.

The exterior of the home is a combination of stucco and stone creating what many consider to be an authentic Italian style detailed with arches and pediments throughout. The tile roof and vine-covered wood pergolas create an ideal ambiance both inside and outside the home. All of the grounds surrounding the home are perfectly designed to create an efficient flow around the house to the various porches, sitting areas, and covered areas well-suited for dining or entertaining. Multiple fountains surround the saltwater pool that sits between the main home and the two-story guest house that adds to the welcoming Italian feeling. Each of the patios features stone flooring and flagstone walkways going into the courtyards. On the east side of the home, a total of three ponds are situated in the magnificent garden area. One of the ponds was built with stones dating back to the turn of the century that were found on the property. Upon walking through the main door to the residence, you will first see a 10-foot-wide custom marble chip terrazzo in the entryway welcoming guests as they begin their journey into the home. Earth-tone marble floors flow throughout the entire home on multiple levels beginning with the exquisite entryway. Immediately after admiring the immaculate floors, it is impossible not to quickly notice the pristine Venetian plaster walls

throughout the entire home. Some of the walls were polished and finished to shine in a similar way to the floors, while others were left rougher to create an aged appearance. Several ceilings in the home have hand-painted murals that must be seen to be truly appreciated. The doors and casements throughout the residence are all from La Puerta Originals of Santa Fe, New Mexico. Many of the doors have origins starting in India, Argentina, and Brazil. The front exterior door, specifically, was from a church in Argentina. The 11,080± square-foot home features a total of six bedrooms, six full baths, and three half baths. Each of the bedrooms features an excellent view of the surrounding countryside, and most of the rooms have their own balcony or covered area outside adjoining the room. The main bedroom features two separate closets, a multi-head shower, standalone bathtub, workout area, and a private sauna. Each bedroom has its own special appointments and features making each one unique in its own way. The main living areas of the home feature large windows to help bring the outside in and create a warm environment ideal for entertaining. The kitchen features built-in refrigerator/freezers, a six-burner range with griddle, double ovens, steam/ convection oven, warming drawer, microwave, and a pot filler over the range. Next to the living area and kitchen lies a state-of-the-art theater room

with tiered seating ready to showcase the next blockbuster! Below the kitchen and living area lies one of the most extraordinary features of the home, a custom-designed wine cellar capable of storing 3,700 bottles. In addition to the main residence, there is a twostory guest home overlooking the swimming pool and featuring a living area, full kitchen, and dining area, as well as a bedroom and full bath. All of the grounds around the main residence and guesthouse have been manicured to create the most incredibly peaceful setting incorporating a variety of native and non-native plant and tree species to landscape the grounds. The property also features a four-stall horse barn with two storage bays inside, and shop with an exposed covered area on one side, ideal for storing tractors and equipment. There is another storage barn used for keeping equipment out of the elements.

Recreation & Hunting

Recreational opportunities are abundant throughout the property. Enjoy horseback riding or driving ATVs on the trails. Hunting on the ranch includes whitetail deer, feral hogs, dove, and duck. Great fishing can be had in either of the stock tanks on the property. °

n a famous Gospel story, Jesus walks on the water to catch up to his disciples who are floating across a lake in a boat. The weather turns rough, transforming the once-smooth surface to choppy unpredictability.

When his disciples see him amid the wind and waves, they are terrified. They wrongly assume he is a ghost because in their experience, people don't just stroll across a lake.

Jesus says, "Take courage! It is I. Do not fear." After the shock wears off, Peter, known for his brashness, decides he, too, will walk on the water. Peter steps out of the boat onto the water's surface. He makes steady progress toward Jesus, which was his goal, until he begins to focus on the wind instead of his destination. Once he began to consider the dangerous uncertainty of the wind and the water, Peter's faith fell victim to his fear— and he sank. As Jesus reached out his hand to the flailing man, he said, "You of little faith. Why did you doubt?"

Well, after living through 2020 and 2021, I know why. When you are being buffeted by gale force winds, and the water around you, for as far as you can see, is roiling, your survival instinct screams, "Hunker down and stay in the damn boat!" And yet, the human spirit allows us to step outside. And once outside the boat, we all have a choice: move forward in faith or sink in fear. As 2021 continues to unfold in the unexpected ways that life does, I've been humbled and inspired by my colleagues who have not only maintained their focus and their faith in this land industry, but are moving boldly forward. The market is rewarding their vision, persistence and courage. In March 2020, as the pandemic grabbed up the entire world in a seeming death grip, no one could have—or would have—predicted the rural land market would respond as it did. No one could have imagined that an unprecedented lockdown would trigger a seemingly insatiable appetite for elbow room. No one could have anticipated that in the summer of 2021, we'd be in the middle of one of the hottest land markets of all time. And yet, the human spirit allowed visionary brokers to step outside the boat. Imagine the collective disappointment of the industry—and our land-hungry clients—if everyone had chosen to stay hunkered down. Ironically, if our industry had fearfully stayed in the boat, we would have missed the boat. While the willingness to step out is alive and well in the industry as a whole, it is alive and thriving in our offices as well. Through the pandemic, we've experienced some shifting and refocusing of our own. Each and every one on our team has risen to the challenge, taking on new roles and increased responsibilities without ever missing a step. Their creativity, professionalism and commitment to excellence is something to behold. I'm proud to work alongside them as we never lose sight of our mission: to help the best brokers in Texas bring the best ranches in Texas to the largest pool of qualified buyers possible. While we humans have never been in control of the world around us, we maintained an illusion, or maybe a delusion, that we did. COVID-19 shattered our collective fantasy, but not our collective spirits. We are strong. We are resilient. We will continue to put one foot in front of the other, stepping out of the boat and into uncertain waters. And armed with faith, vision, persistence and courage, we will not sink now—or ever.

n 2020, a private landowner imported 10 white rhinos from Namibia. These rhinos are part of a growing group of non-native wildlife living on private ranches throughout the United States. In the southern U.S., from Florida to California, private landowners have become the primary caretakers of some of the world’s most endangered wildlife. Texas is the epicenter of this rapidly growing industry.

Species such as dama gazelle, Arabian oryx, Masai giraffe and Grévy’s zebra have become not only the property of landowners, but these animals have become a valuable asset class and an incomeproducing investment.

What started as excess animals from landlocked zoos has evolved into a multi-billion-dollar industry. In recent years, demand is being fueled by tax incentives, capitalism and enthusiasm for wildlife conservation. A firm foundation built over the last 50 years is giving the industry tremendous support and staying power. No longer just a hobby for the rich, non-native wildlife has found its way into the hands of capitalists. As a result, critically endangered species from across the globe are thriving in private hands. Investors are claiming profits and their actions are saving wildlife for generations to come. 1

Where did they come from?

Simply put, zoos. Like all entertainment attractions, something new is required to keep our attention and get us to visit again and again. In the case of large city zoos, new offspring sell tickets. Everyone loves seeing a newborn giraffe, zebra or rhino. What most have never considered is that these animals live for decades, and zoos simply do not have the space to house them while continuously breeding. Since the 1950s, this has resulted in a steady supply of zoo animals making their way into the hands of wildlifeloving landowners.

Although occasional imports have occurred since the 1980s, it is nearly impossible to import antelope (ruminants) because of diseases in wild populations. This inability to import new animals plays a huge part in the scarcity and limited availability.

How many nonnative species of hoof-stock and animals are in the U.S.? Starting with a single ranch and one species in the 1920s, today there are thousands of landowners housing a plethora of exotic wildlife. While no precise census has been conducted in the last decade or more, there are general estimates that can be made.

There are approximately 100 species of hoof-stock that private landowners are breeding. Between free-ranging and captive-bred populations, there are easily more than one million non-native animals on private ranches. Species such as axis, blackbuck and aoudad lead the way with several hundred thousand head per species. These three groups account for the vast majority of the population. Species such as sable, kudu and nyala each have three to four thousand animals for their respective species. Exotics are grouped into two categories: commons and supers. Commons are just that; they are not particularly rare and are regularly found free ranging. Axis, blackbuck, aoudad, nilgai and fallow deer fit into this group. These species are relatively inexpensive and are more geared towards entertainment and pleasure than investment. They are generally seen as the entry level animals for those making a passive entry into the industry. Supers, however, are species such as sable, Grant’s gazelle, impala and kudu. These species, generally speaking, have fewer than 4,000 animals each. Some species such as Grévy’s zebra, cape buffalo and giraffe are limited to a few hundred head. This rarity is driving their value to epic levels, and without the ability to increase the population any faster than mother nature allows, it will take decades before supply meets demand. 1

What is the financial benefit and why?

While most people would never consider a giraffe or a kudu as being the same as a printing press, a manufacturing machine or heavy equipment, according to the federal tax code, they are the same. Section 179 (and 168k) of the United States tax code covers depreciation of business equipment. Livestock, a 179 asset, is classified as business equipment. Since 2017, the current depreciation rate for business equipment is 100 percent in the year of purchase. Since exotic wildlife is classified as livestock by the Texas agriculture code, (chapter 1, SEC 1.003(3)), the purchase of breeding groups of exotic wildlife is 100 percent tax deductible in the year it is acquired.

To simplify this further, landowners that acquire breeding groups of exotic wildlife are considered to be in the breeding business. All business equipment being used for this enterprise is eligible for section 179 depreciation. This tax incentive is causing a groundswell of demand for new purchases of already scarce and limited animals. There are certain limitations to the deductibility, therefore it is important that a potential investor consult with their financial professional prior to making an investment for tax purposes.

Owning exotic wildlife in an IRA?

Yes, you read that right. . . . As the result of companies like San Antonio-based Wildlife Partners developing a syndicated investment vehicle, not only can landowners acquire exotics for their ranches, but qualified accredited investors across America can participate as well. They can do this without ever leaving home. In 2018, a third-party due diligence company was hired by an investment firm to conduct a due diligence analysis of the program. This in-depth inspection of the program allowed the company to launch its product through a network of financial professionals. Since 2018, nearly $15,000,000 have been invested in exotic wildlife through these offerings. These investments can be made through an IRA for qualified participants. In some cases, conversions of an existing IRA to a Roth IRA have resulted in significant tax savings. Of course, all investments involve risk, and an investment in an exotic animal breeding partnership has specific risks that a potential investor must be aware of, including, but not limited to, the potential limited market for offspring, loss due to disease, and even the weather. Private landowners have had the corner on the market for exotic wildlife over the last 40 years. Suddenly, investors from across the U.S. have become acquainted with the industry, and the result is tens of millions of dollars of new capital being deployed into the market every year to the benefit of landowners and wildlife populations.

So, what does the future look like for exotics?

Most Texas ranchers believe that the outlook for non-native, rare and endangered wildlife is tremendous. With capitalistic investors at the helm, charting the course towards profitability and sustainability, critically endangered animals from across the globe are being given shelter, protection and excellent care. Texas ranches are becoming the Ritz Carlton for exotic wildlife. With extremely limited supply and new purchasers of offspring entering the market consistently, sale prices have escalated recently, and prior investors are reaping the benefits. By receiving significant tax savings through the acquisition of exotics, and revenue from the sale of offspring, we believe a new form of wildlife conservation has emerged as a proven strategy for the future! °

ith the uncertainty created by COVID-19—initially we weren’t even sure how much direct access would be allowed at the Capitol— we didn’t develop a huge legislative agenda,” said Doug DuBois, chairman of TWA’s Legislative Committee. “Instead we narrowed the focus of our offense, and prepared to play defense when and where necessary.” Defense is needed every biennial session. With more than 7,000 bills filed on a mind-boggling array of subjects including returning regulars such as water, immigration and property rights, there is always something lurking in the details that can create problems for Texas landowners.

“The sheer volume of legislation filed guarantees that there will always be at least a few bills we deem harmful—those fights will have to be waged on-the-fly and in the trenches because we don’t know they’re coming until they show up,” said Joey Park, an Austin-based Legislative Consultant, who along with Legislative Consultant Mignon McGarry and TWA’s CEO David Yeates made up the organization’s paid advocates. Volunteers, members of the Legislative Committee as well as officers and general members, form the rest of the team. Offensively, TWA turned its attention to the Sunset Bills reviewing and re-authorizing the Texas Parks and Wildlife Department (TPWD) and the Texas Animal Health Commission (TAHC) as well as continued eminent domain reform. These bills, since signed into law, are respectively: SB 700 sponsored by Sen. Dawn Buckingham (R-Lakeway)/HB 1830 by Rep. John Cyrier (R-Bastrop), SB 705 sponsored by Sen. Eddie Lucio (D-Brownsville)/HB 1830 by Rep. John Cyrier (R-Bastrop), and HB 2730, sponsored by Rep. Joe Deshotel (D-Beaumont).

The Sun Didn’t Set

Every 12 years, on a rotating schedule, all Texas’ state agencies undergo a Sunset Review conducted by the Texas Sunset Commission. As part of the process, the Sunset Commission sets an expiration or “sunset” date in law for the agencies

under review. The agencies will automatically be abolished on their Sunset Date unless the Legislature passes individual bills to continue each one, typically for another 12 years. Once again, it was time for TPWD and TAHC to go under the microscope. “Both agencies are crucial to Texas landowners, so we worked hard to ensure that the Sunset Commission understood that,” DuBois said. “We wanted them to know we not only supported the agencies’ missions but believed they are doing a good job overall for Texans.” The process begins long before the Legislature meets. In the interim between Sessions, the Sunset Commission and staff hold meetings and hearings with stakeholders along with conducting extensive internal reviews of each agencies. At the end of the first phase, the Sunset Commission issues a report that contains its recommendations. The recommendations’ depth and breadth vary, and may range from minor nips and tucks to internal management systems to sweeping changes such as abolishing the agency or folding a portion of its duties into another agency. When the reports emerged from the bureaucratic shadows, the ensuing recommendations for both TPWD and TAHC fell into the category of tweaks. “The recommendations for both agencies were fairly benign,” said Park, noting most were targeted at tightening up a few internal processes. “Since the reports were straightforward and simple, so were the resulting Sunset Bills.” In the Texas Legislature, straightforward bills don’t necessarily guarantee a straight path through either chamber. Like any other bill, Sunset Bills are subject to amendment on the floor. An attempt was made to tack some language regarding deer breeding onto TPWD’s bill. TWA blocked the move. “We were successful in our defense; the bill passed cleanly and it was the first Sunset Bill signed by the governor,” Park said.

The action not only reauthorized agencies for the next 12 years, but served as acknowledgment of jobs well done. “The Sunset victories are a great vote of legislative confidence for the employees and appointed commissioners at each of these agencies,” DuBois said. “By its actions, the Legislature reaffirmed that the agencies are doing a good job of serving the constituencies they are supposed to serve and a ‘go-ahead’ to keep doing what they’re doing.”

Eminent Domain

For the past six years, TWA has been leading the charge to reform the state’s eminent domain laws to give landowners a condemnation process that is more equitable and transparent. The issue pits landowners against oil and gas companies as well as other private, for-profit companies that have been granted the power of eminent domain. “Eminent domain is a David versus Goliath fight— and private landowners are not Goliath,” said Park, noting that often the odds are 30 lobbyists:1 lobbyist in favor of the oil, gas, pipeline and powerline industries when both sides gather to wrangle in committee hearing rooms. “We’re not trying to interfere with the energy industry’s ability to do business or make a profit; our goal is— and always will be—to create fairness for those landowners who are gravely impacted by it all.” As Texas continues to grow and drive demand for more infrastructure while fragmenting oncelarge ranches into smaller parcels, the need for eminent domain reform has become more urgent. Not only are there more pipelines and transmission lines sprawling across rural Texas, but they have a bigger impact on smaller properties. For instance, a pipeline bisecting a 200-acre homestead in the Hill Country leaves a much bigger footprint than a pipeline snaking through 250,000 acres of South Texas brush. “Texas is growing—and that growth is cutting into private land,” Park said. “It’s an issue that isn’t going away, so we’re going to keep working with industry to find solutions.”

TWA and like-minded organizations worked with a sponsor to submit a bill. For the first time, the oil and gas industry brought its own bill to the table. “The fact that the industry brought a bill to the table is a significant shift,” Park said. “In the past, the industry simply played defense.” Sponsors met. Negotiations produced a bill that was passed almost unanimously by both chambers. The bill increases information provided to landowners about eminent domain by the state, sets minimum easement terms requiring companies to disclose contract terms up front, and give the right to file complaints against rightof-way agents.

Harris County, home to Houston, than there are west of the I-35 corridor. As a result, TWA’s legislative team has to educate as well as advocate. “Often, legislators who serve urban and suburban constituents not only don’t understand rural issues, but they don’t understand how rural issues impact their lives in the cities,” Park said. “If food comes from H-E-B and water comes from the tap as many assume, why should they be concerned?”

While the resulting legislation didn’t accomplish everything TWA wanted, it is a milestone nonetheless.

Under those circumstances, it’s easy for rural issues to get overshadowed by social issues such as transgender athletics, emerging concerns such as this session’s big elephant, reform of ERCOT and stability in the electrical grid, and the always contentious and difficult appropriations process.

“HB 2730 lays the foundation for meaningful reform,” Park said. “Perhaps, even more importantly, though, the bill’s almost-unanimous passage signals that the Legislature, for the first time, agrees that something must be done to fix it [eminent domain].”

With 150 state representatives and 31 state senators, TWA’s three professionals and a handful of volunteers can’t tackle the Herculean job of telling rural Texas’ story alone. To that end, it’s imperative that Texas landowners establish personal relationships of their own.

Fingers on the Phone

“It’s less about storming the Capitol and more about contacting your local legislators and communicating with them regularly,” Park said. “The more direct points of contact that we have, the better chance we have to ensure that officials hear our side of the story.”

Each session, the divide between urban and rural Texas continues to grow as population in our major cities and suburbs continues to skyrocket. As is often noted, there are more representatives in

Legislators value personal connections with trusted information sources more than the public suspects. Texas legislators are part-time public servants. Most work other jobs. “It is impossible for them to know everything about everything—and they shouldn’t have to,” Park said. “They rely on input from the people who their policies impact to help them make informed decisions.” Landowners who live in metro areas but own rural properties are in a unique position, DuBois said. They, as urban constituents, can showcase rural concerns and educate outside the session. TWA, as an organization, often hosts retreats on private ranches to help legislators and their staffs understand the state’s landscape and its impact through ecological services. Individual landowners can do the same thing. “Sometimes it’s as simple as making an urban legislator aware that they have constituents who need help on rural issues,” Park said. “It’s all about communication and relationship building.” In the past, legislative influence used to be flexed by “boots on the ground.” These days, “fingers on the phone” can be just as effective. “When landowners can call or text legislators on their phones—and the legislators pick up—those relationships are priceless,” Park said. “There is no way to express the value to rural Texas.” °

hat do you get when you combine high demand and low interest rates? A Texas land rush, according to Farm Credit lenders.

Families who felt cooped up during the COVID-19 pandemic are ready for more space. People moving to Texas from all over the country need a place to live. And many see rural property as a stable investment that can provide income and enjoyment.

“When something hits the market, it's snagged right away,” says Sarah Franklin, branch manager at Texas Farm Credit’s Pleasanton branch, south of San Antonio. “We’re almost seeing bidding wars for rural homes and properties. Timing is certainly of the essence.” In some areas, that’s leading to higher prices. “People know interest rates are low and are willing to pay these market values,” says Travis Tekell, a loan officer in AgTexas Farm Credit Services’ Burleson branch, south of Fort Worth. Things move quickly in a hot market, so make sure you’re ready when you find your dream property.

1. Research the market Think about where you want to purchase rural property and how you intend to use it. Do you plan to buy or build a home? Are you looking for recreational or investment property? How close do you want to be to a city? Get a sense of local prices by looking at websites that specialize in farm and ranch property. Compare asking prices with valuations on the county appraisal district’s website. And work with a good real estate agent and lender who understand rural property.

2. Check into infrastructure Consider how you’ll use the property and what infrastructure you need. Is trash pickup, municipal water and sewer service available in the area? How about electricity, cellular service and highspeed internet? Is there legal access from a highway, county road or private easement? The county, nearest city, your real estate agent and current service providers are all good resources.

3. Look for existing improvements Things like barns, wells, septic systems, roads and a boundary fence add value and save you money down the line. “As long as they’re in good condition, improvements are beneficial at homes, homesites, and property used for farming and ranching,” Franklin says. Check on groundwater, surface water and soil conditions to plan for future improvements, too. FALL 2021

4. Set a realistic budget Know how much cash you’ll need to purchase, maintain and improve the property. If you’re getting financing, don’t forget the down payment—typically 20 percent for land purchases. “A lot of people start by looking for property, and the banker wishes they would start with us,” Tekell says. “We can help them understand their plan, ask the right questions and determine their budget. Getting prequalified for a loan saves a lot of time once they do find property.”

5. Know codes and restrictions Look into county laws, municipal zoning and deed restrictions that could limit how you use a property. “Make sure there aren’t restrictions that keep you from carrying out your plans, like building a home or subdividing the property for your heirs,” Franklin says. “If it's close to a city or town, zoning might restrict the types of animals you could have.”

6. Know your surroundings Check on current and proposed land use on neighboring tracts. Commercial development, intensive livestock operations, oil rigs or traffic noise could affect the property’s use, enjoyment and future sales potential. “At the very least, I would get in the truck and go see the property rather than just look at an aerial shot,” Tekell says. “On a computer you just can't hear and see the things you can when you’re there.”

7. Maintain property tax advantages A special-use valuation—commonly called an ag exemption—can reduce property taxes significantly. Many eligible properties already have one, but you’ll need to reapply after the purchase. The county appraisal district will ask how you’re managing the land in order to qualify. One way is to keep a current tenant who leases the property for farming or ranching. You could also try your hand at growing hay, managing wildlife, harvesting timber or—if it’s 5–20 acres—keeping bees.

8. Shop insurance rates If you get financing, you’ll have to insure any structural improvements. Anything in a floodplain also requires flood insurance. Franklin also encourages insurance for raw land and cash purchases. She recommends hazard insurance, rainfall and pasture insurance for drought-prone areas, and credit life insurance to cover loan debt. “Life insurance isn’t easy to talk about, but we’ve seen that policy help families hold onto their property after someone passed away,” she says. Most insurance agencies cover rural homes and outbuildings. Ask your lender and rural real estate agent where to find crop, livestock and pasture insurance.

9. Prepare for financing Make sure you have a strong credit score, which helps you qualify for financing and faster loan programs. Turn in a loan application and a financial statement or tax returns. And if you’re forming a legal entity like a limited liability corporation or S corporation, have your documents ready well before closing. “It's a much smoother, faster process if everything is ready at the same time you’re applying,” Tekell says.

10. Use local experts Brokers and agents specializing in rural real estate are experts in their local markets. Local rural appraisers understand property’s value, flood risk, water access and much more. And local rural lenders like Farm Credit have loan products specifically for rural property owners. “I recommend finding people you're comfortable with who will stick with you beyond that one transaction,” Franklin says. “I know I'm always happy to answer questions new property owners have, like who to contact about building a fence or drilling a water well. That’s where those ongoing relationships are important.” °

I

n the second quarter of 2021, the growth in sales volume accelerated up 43.77 percent to a total of 8,561 sales, compared to a quiet 2020 second quarter. Strong demand resulted in a shortage of listings and shot prices up a remarkable 16.29 percent to $3,433 per acre statewide. The eastern regions all experienced double digit price increases with substantial increases in the total acres transferred. Price increases in the western areas were more muted. The continued flight of buyers to safety in rural properties produced these remarkable results.

Texas buyers set a new record in total dollar volume at $2.35 billion. That total posted a 93.21 percent increase over the moribund 2020 market. A total of 685,585 acres transferred. This continues to be one of the most active periods in Texas land market history. The typical size dropped 4.78 percent to 1,176 acres. Panhandle and South Plains: Activity moved up only 5.96 percent in this region. Prices inched up 2.99 percent to $1,172 per acre for a moderate increase. This increasing trend resulted in a 97.44 increase in acres sold to a total of 137,447 acres with a 103.34 percent increase in total dollar volume to $161.1 million. Far West Texas: Activity in the Permian Basin oil play had driven this market for the past several years. When oil prices collapsed in 2020, so did demand for large properties in this region. The number of sales increased 12.88 percent, but total acreage fell 37.60 percent. The market focus switched from desert rangelands for energy exploration to high-priced mountain properties. So, the region posted few sales at very high prices. The lack of activity makes it difficult to find reliable pricing information. West Texas: Sales activity increased 47.46 percent with a 1.89 percent price increase to $1,725 per acre. Total acreage sold exploded up 133.25 percent to 173,981 acres, driving a 137.55 percent increase in total dollar volume to $300.1 million. This extremely active demand should begin to push prices higher.

Northeast Texas: Volume of sales expanded 47.13 percent, pushing prices up to $5,735 per acre. Total acreage increased 47.13 percent to 89,854 acres. Rising prices and increasing acreage drove total dollar volume up 73.58 percent to $515.3 million. Markets reflect very strong demand throughout the entire region. Gulf Coast – Brazos Bottom: The volume of sales ramped up 61.86 percent from 2020 with total acres sold increasing 30.59 percent. Price increased a remarkable 15.96 percent to $7,447 per acre. The high price and expanded total acreage produced a 51.43 percent increase in total dollar volume to $334.2 million.

South Texas: Sales activity increased substantially in the region to the south of San Antonio, increasing 53.44 percent. Prices grew 10.40 percent to $4,290 per acre. Total acres grew 86.04 percent, driving total dollar volume up 105.38 percent to $330.4 million. Austin – Waco – Hill Country: Prices in this region soared 20.49 percent to $4,840 per acre. In addition, sales volume increased 44.93 percent, boosting total acres sold by 48.36 percent to 138,550 acres. This activity increased total dollar volume by 78.75 percent to $670.6 million. The Future: The stampede to the countryside accelerated in the second quarter. Undoubtedly, the pandemic and urban unrest prompted this continuing quest for rural acreage. Many observers fear that market activity at these levels will not last and signs of possible cooling have appeared in housing markets. However, nothing on the horizon points to a diminution in demand for safe space in the countryside. The coming months will likely see a continuing scramble for land with increasing upward pressure on prices. The possible emerging wave of pandemic infections may inspire even more demand pressures. At some point, this feverish demand may wane, but no current developments seem poised to cause buyers to retreat. °

In the lower elevations, which includes the lush creek bottom, the soil is rich, deep and productive. Each year the native pecan trees produce a bounty which the wildlife feast on.

A three-acre lake, complete with a dock and stocked with bass year-round, is an angler’s dream as well as a kayaker’s paradise. Springs burble up through the limestone in hidden nooks throughout the ranch. In addition, the water-rich ranch also includes three small stock ponds along with a windmill outfitted with a solar pump to supply two wildlife-watering stations in the far-reaches of the ranch. A highly productive well supplies the houses and provides irrigation for the yard.

Depending on the season, cultivated fields, encompassing about 160 acres, are planted in a mixture of wheat, oats and sunflowers, providing grazing, hay or a buffet for migratory doves. Cherokee Springs Ranch annually produces about 150 round bales of hay that are used to supplement the cattle herd during the winter months. As the elevation climbs, the land’s character changes from open, rolling hills dotted with live oak and scattered park-like clearings to rougher, wilder limestone outcrops. The native brush, which has been sculpted to remove excess cedar, provides a wildlife smorgasbord


WILDLIFE & LIVESTOCK For the past 10 years, the abundant wildlife resources—native whitetails, Rio Grande turkeys, feral hogs, doves, ducks and a plethora of non-game species—have been managed under the watchful, experienced eye of a consulting wildlife biologist. The primary goal has been keeping populations in balance with the land’s carrying capacity, so each species can thrive and the habitat remain abundant. Hunting opportunities have been limited to family and friends but could be expanded into a commercial operation if the new owners so choose. While the current owners have focused their attention on wildlife, they maintain a 20-head herd of commercial cows to help manage the vegetation and honor the area’s ranching heritage. Because of the land’s productivity, the livestock operation, depending on the new owners’ goals, could be enlarged.

LIVING The main house and adjoining guest casita form a welcoming compound situated near the front of the ranch. Conservation Easements W H AT A R E T H E Y, A N D CO U L D T H E Y B E R I G H T FO R YO U ? STORY BY MARK STEINBACH, PH.D. TEXAS LAND CONSERVANCY

P

rivate land ownership has always been a distinguishing characteristic of Texas—from farms and ranches that have been in the same family for generations to recently purchased second homes in idyllic rural areas. Whatever the situation, many Texas landowners face the same dilemma: how do you ensure that the land you love looks the way that it does forever? Using a tool called a conservation easement, landowners can ensure that the integrity and natural condition of their land remains intact for generations.

Conservation in Texas

With 95 percent of Texas (approximately 163 million acres) held by private landowners, Texas has far and away the most privately held land in the country—more than Montana, Kansas, and California combined. Unfortunately, we are also leading the nation in the amount of rural land lost annually to development. According to the Texas Land Trends from the Texas A&M Natural Resources Institute (NRI), over two million acres of agriculture land has been converted to some other use between 1997 and 2017, and 1.2 million acres have been lost in the last five years alone. Population growth in Texas means new residents need new homes to buy and apartments to rent, leading developers to covet the farms, ranches, pastures, and open space in proximity to metropolitan areas. This slow crawl of development and changing land use is imperceptible on a day-to-day basis but drastic over the long run. Relative to its size, Texas has very little land dedicated to conservation. The Texas Parks and Wildlife Department (TPWD) manages a little over one million acres in state parks and wildlife management areas (WMAs), and the remainder is split between the United States National Forest Service and National Park Service. This means the bulk of land and wildlife conservation in Texas falls to private landowners.

Abundant opportunities exist for landowners to enact conservation measures on their land. There are several entities such as TPWD, USDA Natural Resource Conservation Service (NRCS), and Texas A&M AgriLife Extension which offer education, guidance, and programs to assist with conservation and management of natural resources. But what about protecting land as a whole? This is where conservation easements come into play.

What is a Conservation Easement? At the most basic level, a conservation easement is a very specific deed restriction. The drawback of a deed restriction is that it can be undone by a future landowner. A conservation easement is a legal agreement between a property owner and a qualified conservation organization, such as a non-profit land trust, municipality, or governmental entity, which cannot be undone. When entering into this kind of legal agreement, the owner voluntarily agrees to restrict the type and amount of development that may take place on their property. This is possible since the development rights of property are similar to other property rights such as minerals or grazing, which can be leased, sold, gifted, or separated from land. A conservation easement is the legal instrument to separate development rights and have them held in trust for permanent protection.

Conservation easements date back many decades in the United States, but they didn’t gain traction in Texas until the early 1980s. Today, there are almost 800 conservation easements in the state encompassing more than one million acres of protected land. The bulk of this work is done by a coalition of more than 30 land trusts scattered across the state. Land trusts are charitable organizations whose mission is land and water conservation. In total, these land trusts have conserved over 1.8 million acres of land through conservation easements, outright land ownership, and collaborative efforts with state and local entities. Some focus on geographic regions like the coast or ecosystems like prairies. Others, like Texas Land Conservancy, work at a larger scale across the entire state.

The Nuts and Bolts of Conservation Easements

What does enacting a conservation easement look like from the landowner perspective? Every conservation easement is customized to the landowner and the property. The traditional land

uses including agriculture, hunting, and recreation are always allowed, unless the landowner has specific prohibitions they would like to enact. The landowner decides what limitations or provisions to protect on their property. For instance, if a landowner has an existing house on a property, but has two children, they might reserve the right to build two additional houses. Similarly, if the desire is to have no more construction on the property, a prohibition on future building can be added. Because the easement is permanent, it is imperative to spend time thinking about all the potential uses of the land, and it is a good idea to acquire counsel to help navigate the process. There are a few misnomers surrounding conservation easements. One is that the landowner loses control of the land, and the public has access. That is absolutely false. There is no public access granted. However, the holder of the conservation

“ The bulk of land and wildlife conservation in Texas falls to private landowners.” easement is required to make a site visit once a year to ensure the terms of the conservation easement are being upheld. This is a coordinated visit with the landowner’s permission. Likewise, a conservation easement is not foolproof protection against condemnation. They can be helpful but may not be able to prevent it. So why would a landowner voluntarily limit what they can do on their land? First is a desire to keep land the way it is now for future generations. Whether I’m working with a landowner whose history goes back 100 years on land or a new landowner, they all love their land. That love extends beyond their lifetime, and something they want to ensure future generations will enjoy. A conservation easement is an insurance policy to do just that. Second, there are financial benefits. I will assume that to all the readers of this magazine, it is obvious how valuable land is. Land values have seen an almost 300 percent increase in the past two decades, and the previous year has seen an

even more dramatic increase in values. When a landowner places a conservation easement on their property, they are giving up certain development rights, and those rights have value. That value can be used as a tax deduction because land trusts are 501(c)3 non-profits, and the conservation easement is considered a charitable donation. An appraiser is required to determine the value of the contribution. Additionally, a conservation easement lowers the value of a property, which can be a beneficial estate planning tool related to lowering an overall estate value. If the idea of a conservation easement is intriguing, there are great resources through the Texas Land Trust Council, a statewide trade association for all land trusts. Typically, a landowner will visit with a couple of land trusts to gauge interest for a particular project and see if it is a good fit. On average, the typical conservation easement transaction takes three to six months to prepare the required documents and accomplish due diligence. I’m encouraged by the increasing trend among landowners using conservation easements resulting in a steady uptick in conserved land for future generations. I will close with a quote from Aldo Leopold’s Sand County Almanac, “Health is the capacity of the land for selfrenewal. Conservation is our effort to understand and preserve this capacity.” By conserving private lands in Texas, we can ensure the health of our state and the preservation of our unique Texas character for generations to come. ° FALL 2021

The ranch is a world-class and extraordinary example of natural resource and rangeland restoration undertakings over the course of several decades following an intense use of portions of the surface to secure lignite. The resources (financial, engineering, scientific and otherwise) that were put to work on this restoration project have resulted in an 11,000-acre ranch with rolling rangelands of both improved and native grasses, heavily wooded bottomlands (and some hilltops) and incredible water features. Location & Habitat The ranch is located ten miles southeast of College Station in Grimes County. Kyle Field is clearly visible from high points on the ranch. Approximately 5,700 acres of the property are rolling, reclaimed grasslands, including areas of native and improved grasses. A minimum of four feet of select soil was distributed over this area, and the forage is strong, as indicated by the current stocking of approximately 2,000 head

of cattle grazing the property. Punctuating these grasslands are approximately 920 surface acres of lakes teeming with fish and wildlife within the property’s borders. Two primary areas of hardwood bottoms make up the bulk of the remaining acreage. Over 2,000 acres of contiguous, mature, Navasota River hardwood bottoms provide excellent habitat for the plentiful white-tailed deer and hogs that populate the ranch. A second contiguous woodlands area over 1,700 acres associated with the Gibbons Creek and Dry Creek watersheds accent the rangelands. Wildlife The property has outstanding deer hunting throughout large portions of the property, particularly associated with the thick bottomlands along the Navasota River frontage and along the Gibbons Creek riparian corridor. It has been actively managed for deer through Texas Parks and Wildlife. Waterfowl hunting on the multitude of lakes, wetlands and smaller ponds is amazing. One of the unique aspects of the property is the amount of waterfowl habitat that exists on the property. Dove, hogs, alligators as well as predators are very common on the property. The ranch’s diverse ecosystems are home (year-round or during annual

migration) to all types of other animals, birds and of course, fish. Bald eagles and osprey are very common on the property. Improvements Few improvements exist on the property beyond excellent all-weather roads, engineered lake dams, low water crossings and new fencing. Water Lakes of Gibbons Creek Ranch is so named because of the exceptional amount of surface water covering over 920 acres in over 40 lakes and ponds to be found on the property. The water coverage on this ranch is more than the total acreage of all of Central Park in New York City. The list of lakes includes eight lakes with over 50 surface acres and 11 lakes with 10 acres to 50 acres of surface water. Quite simply, there is a staggering amount of water on this ranch. All of the lakes were stocked with Florida bass and hybrids as well as forage fish such as redear, threadfin shad and coppernose bluegill. Other water features include almost two miles of frontage on the Navasota River and four miles of Gibbons Creek (most of it on both sides). Plenty of smaller ponds, wetlands and sloughs exist all over the property. No water wells are currently being used on the property; however, groundwater is present in this area from 250 feet to 550 feet deep in the Yegua/Jackson aquifers. °
