WHO IS MARINE QUEENSLAND?

Who is Marine Queensland?

W

ith over 400 members state wide Marine Queensland is the recognised voice of Queensland’s Recreational and Light Commercial Marine Industry. Marine Queensland strives to promote boating and facilities through industry leadership. The Association works to develop and promote professional standards and services for its members and the boating public. Marine Queensland caters for the diverse interests and sectors within the industry ensuring strength from unity whilst maintaining the identity and focus of the individual industry sectors. Marine Queensland has strongly advanced the interests of members across the three tiers of

Government. It is because of this advancement that the industry is increasingly being recognised as a significant contributor to social cohesion and environmental sustainability. The social, environmental and economic contribution of the leisure marine industry is a major benefit to the State and the Communities in which it operates. In 2013 Marine Queensland was able to represent the interests of members on issues surrounding commercial marina rents and valuations, parallel and grey imports, boat ramps, pontoons and marine infrastructure; and marine zone planning processes. Buying a Boat - Privately or through a dealer? T

he decision to buy a boat is not made lightly. Much time and effort goes into it to make sure you are getting something that is right for you and your family. There are many options available to consider when purchasing. Do you buy new or second hand, locally built or imported, online, privately or through a dealership.

Price is going to play a major role in your final purchase decision but be sure that price equals value. There is nothing worse that realising your ‘great deal’ is going to cost you a lot more than you bargained for when you get it home. Key things to consider as part of your purchase decision include: vessel condition, ownership and after sales service and warranty.

BUYING A BOAT When purchasing privately: • Visit the PPSR website for a PPSR Certificate to ensure there is no money owning on the vessel (www.ppsr.gov.au) • Check that the vessel is not stolen • Check the PPSR Certificate to ensure that the seller is registered owner and authorised to make the sale • Cross match the registration numbers on boat, trailer and engine match those on the registration certificates • Ensure the trailer is road worthy • Ensure the vessel is sea worthy with no undisclosed repairs required When purchasing privately you need to remember that there is no after sales service and no warranty on the vessel, motor or trailer. Once the boat is yours so too are any potential problems and issues along with it.

When choosing to purchase through a dealer: • You’ll have a greater variety of boats to select from – both new and used boats • Second hand boats purchased through a dealer may be traded in vessels or they may be boats

• You will have formal contracts and documentation for the purchase. When deciding on your boat purchase, price is only one of the things you need to be considering. Weigh up your options carefully to make sure you, as a buyer, are protected every step of the way.

KNOWING YOUR BOAT TOWING RULES

Knowing your boat towing rules T

he legal width limit for any vehicle using Queensland roads is 2.50 metres. In Queensland, the Department of Transport and Main Roads provides limited access for vehicles that exceed regulation dimensions when carrying indivisible items. An indivisible item is one that cannot be divided without extreme effort, expense or risk of damage to it. The department has become aware of the increase for light vehicles towing trailers with boats that exceed regulations. To ensure these movements are undertaken in a safe manner the department in conjunction with the Marine Queensland has developed a policy to assist in the movement of these vehicles. Boats over 2.5m up to 2.9m wide can be moved when operating under the conditions of the Guideline for special

use trailers, Form 26, Version 2, which was released on 23 August 2013. Prior to the release of version 2 of the guideline, overwidth boats (2.5 - 2.9m) operated under the conditions of a Class Permit which originated in 2011. The Class Permit has now been withdrawn and all of the conditions incorporated into Version 2 of the guideline. Version 1 of the guideline dealt with the movement of Dragon Boats, Gliders, Rowing sculls and Yachts. Prior to the release of the Class Permit, Queensland Police did issue some permits for overwidth boats. This has since ceased and now the guideline is to be used. The Guideline for special use trailers, Form 26, Version 2 can be found on the Marine Queensland website – www.marineqld.com.au

Grey Imports raise both financial and safety concerns for buyers. As these products are being imported without the manufacturers consent they will not be covered by the manufacturer’s warranty. Grey imported products may not be subject to the same thorough safety check that authorised product are. This means you could potentially be putting your family and yourself at risk through use.

It is important to remember that whilst the product may meet the safety requirements in its country of origin it does not mean that it will meet the minimum safety requirements here in Australia. IS IT LEGAL? Products are manufactured for specific markets (or regions). This product is manufactured to comply with standards and specifications of each market. Product which is imported into Australia must be assessed against Australian Regulations and Standards.

Australian regulations and standards are there for a reason. Non compliant product needs to be viewed as substandard unless measures are taken to bring it into compliance.

Authorised Dealers and Brokers provide this support. Unauthorised channels often do not. Many insurance companies will not cover a claim if the product is found to be non-compliant against Australian standards. You could be uninsured.

IS IT WORTH IT? Have you given careful consideration to the true costs of importing a boat, PWC or engine? There is more to it than the price on the window.

Check the total cost of bringing the product into the country - you might be suprised to find there are costs and taxes in addition to the purchase price.

After Sales Support. Most Authorised Dealers and Brokers are not permitted to provide after sale support such as servicing or spare parts to grey imports. This often means that any servicing and maintenance cannot be performed by factory trained professionals.

Selling a Boat - Privately or through a dealer? I t’s time to sell your boat. Circumstances may have changed or you’ve decided to upgrade to a bigger one. Now you have to decide which method you want to use to find your beloved boat a new home.

With such a variety of options available to us now – online classifieds websites, dedicated boat sales websites, newspapers ads, marine brokers and consignment dealers, how do you know which offers you, as a seller, the most protection during the sales process?

When selling privately you need to be aware that you may be opening yourself to a variety of risk. Often time you are dealing with complete strangers so you will want to take appropriate precautionary measures to avoid fraud, scams or theft.

When selling privately: • Thoroughly screen callers claiming to be interested in your vessel. Be particularly weary of anyone offering to purchase your boat long distance as the risk of fraud in these circumstances is great.

verloading is dangerous and one of the easiest ways to capsize your boat. The more weight in the boat, the lower the freeboard. Freeboard is the minimum vertical distance from the surface of the water to the gunwale or deck. The gunwale is the upper edge of an open boat. Overloading compromises the safety of everyone on board and increases the chance of swamping or capsizing. When preparing for a trip, the boat operator is responsible for assessing the load on board, both people and objects. For example: • heavy items should be stowed in a low and central place where they cannot move around • weight, including passengers, should be distributed evenly through the boat • the weight of extra fuel and water should be taken into account.

Check the operation of all trailer lights. If inoperative lights are discovered, they will need to be replaced or repaired prior to departure. • Secure or remove the jockey wheel. • Ensure that any equipment, personal effects and luggage (including esky’s, bags etc) are fully secured and correctly loaded, as to not adversely affect the Gross Trailer Mass (GTM) or ball weight. Poor load distribution is a major cause of trailer sway and instability. • Ensure all canopies, aerials, masts etc are lowered and secured. • Ensure security straps are attached and the motor support is in place.

Prepare your boat for severe weather Q

ueensland is no stranger to sever weather conditions – floods, fires, storms and cyclones, Queensland has seen it all. The dangers during severe weather events are very real and it’s important to take steps to say safe and prepare your boats in these situations.

Carry out trailer maintenance checks to prevent the risk of a trailer break down when moving your boat to safety. When a storm is approaching, make sure your boat is tightly secured to the trailer and where possible secure the boat and trailer to fixed objects. If the boat is lightweight

it is also a good idea to consider letting some of the air out of the trailer’s tires. Remove and secure all loose items on your boat. If your boat is in a marina, check to see if your marina has a cyclone contingency plan. Your berthing contract may outline steps you will need to take in the event of a severe storm. Make sure you boat, trailer and equipment are marked with your HIN or driver’s license number. It is also a good idea to take photographs and record an inventory of your boat, trailer and equipment.

Boat Security A

n increasing number of boats, trailers and boating accessories are stolen every year. With planning and preparation you can secure your boat and rest easy. Boats are often targeted because they appear to have little or no security. Thieves will either try to make off with the whole boat, or target items left inside; such as radios, fish finders or depth sounders. These items are usually portable and easy to trade or sell. Most marine theft and vandalism isn’t reported as it is under the insurance policy’s excess or hassle level.

Sun protection when out on the water N

othing beats being out on the boat on a brilliant sunny day. Between the sun’s rays beating down and reflections from the water beating up, boating can be tough on your skin. With planning and preparation you and your family can have a sunburn free day out on the water. For best protection, the Australian Cancer Council (www.cancer.org.au) recommends a combination of the following sun protection measures: • Slip on some sun-protective clothing that covers as much skin as possible • Slop on broad spectrum, water resistant SPF30+ sunscreen. Sunscreen should be applied 20 minutes before you head out in the sun and every two hours after that. It’s important to make sure you are putting on

enough sunscreen, at least one teaspoons worth limb, front and back of the body and half a teaspoon for the face, neck and ears. • Slap on a hat that protects your face, head, neck and ears • Seek shade • Slide on some sunglasses making sure they meet Australian Standards. Be extra cautions when out in the sun in the middle of the day when UV levels are most intense. The SunSmart UV Alert is published in the weather section of daily newspapers and on the Bureau of Meteorology website. Issued by the Bureau when they forecast a UV Index for the day of three or above, the SunSmart UV Alert identifies the times of the day when sun protection will be needed.

ruising, wave jumping, surf riding and skiing are just a few fun ways to get out on the water and enjoy your personal watercraft (PWC). Whatever activity you choose, the best way to enjoy your sport is safely. Whether you own or just borrow a PWC, it is vital to understand the safety rules and regulations for a PWC in Queensland. Otherwise you risk getting an ‘on the spot fine’. It is compulsory for all PWC operators to hold a personal watercraft licence (PWCL). This is a separate licence from the recreational marine driver licence (RMDL). All licence applicants must complete an approved BoatSafe course for personal watercraft operations before being eligible for a licence. A valid recreational marine driver licence is a prerequisite for the PWC licence.

All PWCs must be registered. Registration symbols must be: - displayed on both sides - at least 100mm high - legible from 30 metres - clearly visible in contrasting colours to your craft - easily seen if your craft is underway The registration label must be displayed on the port (left) side of your craft adjacent to the registration symbols. Looking after our waterways W

e all share a responsibility in keeping our waterways and beaches clean. Too often fishing line, hooks, plastic bags and nets are left behind after a great day out on the water. Not only is it unnecessary, but hundreds of sea creatures die as a result of trying to digest a piece of rubbish that they’ve mistaken for food. It is estimated that 100,000 marine mammals and turtles are killed annually from plastics litter around the world. The disposal of plastics at sea is strictly prohibited under the International Convention for the Prevention of Pollution from Ships.

The disposal of all other types of garbage is prohibited within 12 nautical miles of the nearest land – this includes most of the Great Barrier Reef. Fines for those found in breach of these laws can reach up to $1 million for companies and $200,000 for individuals. Whilst deliberate littering is of major concern on our beaches, bays and waterways, the greatest contributor to waterways pollution is ‘no-point source’ pollution. No-point source pollution is waste and litter that does not come from a single identifiable source, but enters the waterways from numerous points including runoff from streets and roads via storm water drains.

LOOKING AFTER OUR WATERWAYS

There are a few things that can be done both at home and on the water to minimise our impact on the environment and contribute to healthier, cleaner waterways: • Be conscious of rubbish. Always make sure your rubbish ends up in a rubbish or recycle bin at the end of a fishing trip. It never hurts to pick up a stray bit of rubbish floating by your boat or washed up on the beach either. • Avoid using anti-fouling paints on boats. Alternatives include a barnacle scraper, wax and Teflon based paints. • Be careful when refuelling or conducting boat maintenance whilst out on the water. Take care to avoid spilling fuel and oil.

• When emptying sewage holding tanks make sure you do so at a designated sewage collection outlet or in at the very least, in accordance with the rules and regulations set out by the local government or port authority. • Do not dispose of solvents, oils, paints, varnish, thinners, paint strippers, pesticides, poisons, fertilisers, acids and solid objects down the drain. Check with you local council as to the correct, and environmentally friendly, methods of disposal for these items. • When washing the car and boat at home, try to do so on the lawn or a grassy area. This will minimise the run off of detergents that will find their way into storm water drains and into the ocean.

Responding to Marine Incidents I

n the unfortunate event of being involved in a marine incident, it’s important to know your legal obligations and also the requirements of your insurance company in case you need to make a claim. Marine incidents must be reported to a shipping inspector (Marine Safety Officers, Water Police or QLD Boating and Fisheries Patrol) within 48 hours of the incident occurring. If you are unable to access an inspector you can contact them by phone. It is an offence not to report a marine incident and can result in fines of up to $3000.

A reportable marine incident may include: • The loss of a person from a boat; • A collision with a boat or pwc; • The stranding of a boat; • Material damage to a boat, or caused by boat’s operations; • Danger to a person, boat or structure caused by a boat’s operations.

RESPONDING TO MARINE INCIDENTS If in doubt as to whether an incident is reportable or not, contact a shipping inspector. Most insurance companies will require a copy of the marine incident report and may not honour your claim if an official report has not been filed. If you are involved in a marine incident with another vessel, you are legally required to: • Provide assistance to any injured parties where possible, without endangering yourself; • Stay at the scene of the incident to provide assistance to all parties involved; • Give your, and where applicable, the boat owner’s contact details to the operator of the other vessel/s involved; • Assist the other vessel/s owner with any damaged property. If you are in the vicinity of where an incident has occurred, you are legally required to render assistance to the parties involved so long as there is no risk of danger to yourself or those on the other vessels.

Boating on freshwater

Q

ueensland has many inland waterways ideal for fishing, boating and water sports. Operating on freshwater lakes and dams, however, can be quite different to estuary boating. Freshwater boating requires a new set of skills and knowledge. Most freshwater boating is conducted on dams or impoundments which are water storage facilities for either agricultural irrigation or town water supply. Other freshwater boating is conducted on the various rivers throughout western Queensland or the upper reaches of

coastal rivers. These rivers are predominantly waterholes except when in flood. Boat registration and licensing requirements are no different to any other boating requirements throughout Queensland. Some freshwater impoundments do have restrictions imposed by the authority which manages the dam. These restrictions range from what activities can take place, access to the water and whether outboard motors are permitted. While there is no tidal flow in freshwater, the height and depth of water can vary dramatically

ESSENTIAL SAFETY EQUIPMENT Boats operating in fresh water are required to carry the same safety equipment as specified for smooth water.

• Wearing a life jacket, especially in the early morning or late afternoon, might mean the difference between survival and drowning if you fall overboard into very cold water. • Don’t underestimate the weather — take heed of forecasts and be aware that encountering bad weather on a freshwater dam is dangerous. • Slow down when boating close to shore to avoid hitting underwater hazards. Never ski close to the shoreline. • Keep at least 100 metres clear of dam walls and spillways at all times.

Personal watercraft

Cruising, wave jumping, surf riding and skiing are just a few fun ways to enjoy your personal watercraft (PWC). Whatever activity you choose, the best way to enjoy your sport is safely. Whether you own or just borrow a PWC, it is vital to understand the safety rules and regulations for a PWC in Queensland. Otherwise you risk getting an ‘on-the-spot fine’. More information about PWC regulations is available from Maritime Safety Queensland’s website or contact your local regional office.

Personal watercraft licensing

It is compulsory for all PWC operators to hold a personal watercraft licence (PWCL). This is a separate licence from the recreational marine driver licence (RMDL). All licence applicants must complete an approved BoatSafe course for personal watercraft operations before being eligible for a licence. A valid recreational marine driver licence is a prerequisite for the PWC licence.

Personal watercraft registration

All PWCs must be registered. Registration symbols must be:

• at least 100mm high • legible from 30 metres • clearly visible in contrasting colour to your craft

PWCs travelling at night or at times of reduced visibility must show navigation lights – sidelights and either an all round white light or a stern and masthead light.

EPIRB

• easily seen if your craft is underway. The registration label must be displayed on the port (left) side of your craft, adjacent to the registration symbols. • A supervised unlicensed driver is not allowed to carry passengers other than the supervising PWC licence holder. • A supervising PWC licence holder must wear the kill switch safety lanyard when the PWC is being driven by an unlicensed driver. A Ride Smart sticker must be affixed to the PWC and visible to the operator at all times.

If you travel more than two nautical miles offshore, when beyond smooth and partially smooth waters, you must carry a 406 MHz digital EPIRB. You must register your 406 MHz beacon with AMSA and display the registration sticker on the beacon. Registration must be renewed every two years. You must also advise AMSA of any changes to ownership and vessel details. Safety equipment which carries a manufacturer’s expiry date must be serviced by the manufacturer or authorised service agent by the expiry date and replaced if necessary.
