Financial gains Working with LHC frameworks gives suppliers access to construction, refurbishment and maintenance projects of over £200m each financial year. Clients who spend more than £200,000 on two or more frameworks in a year will benefit from a share in the LHC operating surplus we return to Members. About this framework agreement The LHC Framework Agreement for asbestos works and services is available to public sector organisations in England, Wales and Scotland. Fully OJEU compliant, it provides public sector officers with easy access to consultants and specialist asbestos contractors and covers the following: -- Housing and properties including common blocks of housing properties -- Public and communal buildings -- NHS and educational establishments -- All types and classifications of buildings used by public sector Contracting Authorities
This framework agreement has been established in strict compliance with UK Public Sector procurement rules for use by public sector bodies in the UK as detailed in the LHC buyer profile (www.lhc.gov.uk/buyerprofile) and as specified in the Contract Notices: -- 2103/S 147-255916 (Services) England and Wales (excluding London) -- 2013/S 147-254938 (Works) England and Wales (excluding London) These were published in OJEU in July 2013 with 13 successful tenderers appointed in September 2014. -- 2013/S 129-222514 (Services) London -- 2013/S 129-221012 (Works) London These were published in OJEU in July 2013 with 12 successful tenderers appointed in April 2014. -- 2013/S 141-245789 (Services) Scotland -- 2013/S 141-244838 (Works) Scotland These were published in OJEU in July 2013 with 9 successful tenderers appointed in March 2014.

About the tender The tender process for this framework followed LHC’s Open Procedure which eliminates the Pre-Qualifaction Questionnaire stage. Suppliers were given free and open access to the tender and offer documentation and answered Suitability Assessment Questions

From suitability to call-off contract The diagram below shows the process a supplier completes to become an LHC Appointed Company and to be awarded a contract (or “call-off”). It also highlights the support LHC provides once a project is live. On frameworks using LHC’s Open Procedure to determine Appointed Companies, suppliers have open access to the tender and offer documentation (ITT) and are asked to respond to Suitability Assessment questions covering: -- Company Standing -- F inancial standing, employment practices, environmental awareness, capacity and geographical rage -- Installation capability -- Technical capability -- Quality systems management capability

Appointing companies
Our aim is giving LHC clients and Members a choice of Appointed Companies to work with. Numbers vary per framework in line with anticipated demand and subject to the number of qualifying suppliers. -- All suppliers are notified of the results and the unsuccessful tenderers can choose to have a debrief to help improve future offers -- Contract Award Notices are published in the Official Journal of the European Union (QJEU) and on the LHC website
Awarding contracts “Call-offs”
When buyers are ready to choose a supplier for an individual project they should start the process by talking to LHC. LHC will coordinate either a direct award, if there is a single supplier on a framework, or a mini-competition if there are several. -- A mini-competition involves all capable LHC Appointed Companies -- A direct award is made to a single company, with justifiable reasoning, without reopening competition

Details of each workstream There are three workstreams within the LHC asbestos framework. Two of these address management and monitoring services and the third covers works associated with the removal of asbestos.
Workstream 1 Asbestos management services The services included in this workstream cover the following areas: -- Management and supervision of asbestos removal/ remediation projects including air sampling, monitoring and air testing (alternatively providing assistance and advice to the client’s asbestos team in the management of projects and associated services) -- Undertaking and preparing third party gap analysis of the client’s in-house procedures -- Review and update of the client’s Asbestos Risk Register -- Preparation of surveys and risk assessments as part of a client’s compliancy requirements including annual reviews as required -- Reviews and updates of the client’s Asbestos Management Plan -- Linking the Asbestos Risk Register and Management Plan with the client’s Repair or Property Order System -- Informing and training the client and its staff on existing and/or future changes in regulations and duties under the Control of Asbestos Regulations, other related legislation and Codes of Practice -- Providing advice to the client and consultants and contractors appointed by the client
Specific activities performed within workstream 1 are: -- Undertaking asbestos management, refurbishment and demolition surveys including the execution of combined surveys i.e. R&D and management -- Carrying out individual bulk sampling of suspect materials on an ad-hoc basis -- Providing professional and concise asbestos reports in accordance with HSG264 including material risk assessments and the provision where required of reports to meet specific asbestos operating templates of clients -- Providing reports as an Excel file in the correct format compatible with meeting the client’s asbestos database -- Providing analysis of asbestos bulk samples through the use of a UKAS accredited ISO 17025 laboratory, whether samples taken under the contract with the client or by others including the client’s organisation -- Day to day asbestos surveys including those required by a client to be executed within 48 hours of issue of orders from the client -- Out of hours asbestos surveys -- Emergency asbestos surveys -- Accelerated provision for undertaking surveys and bulk sampling and providing the client with results and reports, including providing verbal results of sample testing by phone with report to follow -- Preparing Asbestos Risk Assessments

Details of each workstream
Workstream 2a: Air sampling and monitoring services Specific activities performed within workstream 2a are: -- Undertaking air monitoring/air tests at the removal of asbestos and for reassurance -- Issuing four stage clearance certification that is compliant with HSG248
Workstream 2b: Asbestos management services excluding supervision of removal projects The scope of services for workstream 2b excludes the: -- Management and supervision of asbestos removal/remediation projects
-- Providing all air monitoring certificates in electronic format within agreed time frames
-- Provision of assistance and advice to the client’s asbestos team in the management and supervision of projects
-- Auditing any licensed asbestos removal contractor’s method statements and site operation
The management and supervision of asbestos removal/ remediation projects are covered in Workstream 1.
-- Providing background, leak and smoke testing as required
Specific activities performed within workstream 2b are:
-- Provision of scope/specification of work for remediation works -- Out of hours air sampling and air monitoring services -- Emergency air sampling and air monitoring services -- Accelerated execution of air monitoring/air tests and provision of all certification documentation to the client
-- Undertaking and preparing third party Gap Analysis of client’s in-house procedures -- Review and update of the client’s Asbestos Risk Register -- Preparation of surveys and risk assessments as part of a client’s compliancy requirements including annual reviews as required -- Reviews and updates of client’s Asbestos Management Plan -- Linking the Asbestos Risk Register and Management Plan with the client’s Repair or Property Order System -- Informing and training the client and its staff about existing and/or future changes in regulations and duties under the Control of Asbestos Regulations, other related legislation and Codes of Practice -- Providing advice to the client and consultants and contractors appointed by the client

Workstream 3a: Non-licensed works
Workstream 3b: Licensed works
Specific activities required within workstream 3a are:
All Licensed Works must be carried out by a specialist HSE Licensed Asbestos Contractor, who must also be a member of ARCA or another similar approved accredited body and have full environmental registration and an appropriate Waste Carrier’s License.
-- Removal of asbestos and undertaking associated works in accordance with HSG 210 Task Sheets -- Preparing risk assessments as required by HSG 210
Specific activities required within workstream 3b are: -- Local environmental cleaning -- Full decontamination -- Emergency and out of hours response services – provide onsite attendance making safe any suspect or known asbestos containing materials, completing local environmental cleaning and disposal of materials -- Encapsulation works -- Removal and disposal of asbestos containing materials using appropriate control measures and under appropriately controlled conditions -- Drilling holes and cutting asbestos containing materials and removal and disposal of waste -- Removal of asbestos containing appliances, dismantling boilers and removal -- Opening up of ducts -- Collection of bagged waste -- Provision of plywood temporary reinstatement -- Provision of all enclosures -- Supply and erect temporary hoarding and fencing -- Arrange for and have undertaken all air testing by a UKAS accredited laboratory, independent of the Licensed Contractor or the Group to which the Licensed Contractor belongs and as approved by the client -- Undertake four stage clearance, issue certification (providing that the area is safe for re-occupation) and deliver all documentation to the client -- Arrange and have undertaken periodic reassurance air testing using an accredited UKAS laboratory, issue air monitoring certificate providing that the area is safe for re-occupation and deliver all documentation to the client LHC.GOV.UK
