A brief introduction to Probate
---------------------------A Grant of Probate is one of two forms of Grants of Representation issued by the various Probate Registers which are dotted up and down the country.
Whilst being a technical legal term, the effect of a Grant of Administration is really very simple. It is an Order confirming that one or more people have the legal authority to take over the financial and legal affairs of a deceased person. In law we called this the administration of an estate. Grants of Representation are issued by the Probate Registry because a deceased person can no longer manage their own affairs. They cannot write cheques, pay bills or sell their home. In order to ensure that these things are done properly, without illegal interference or fraud, English Law requires that an Executor or Representative be officially appointed by the High Court, through the Probate Registry to take over and administer the deceased person’s affairs.
Probate, has the legal authority to wind down the deceased person’s affairs. They can carry out simple tasks, such as payment of outstanding bills, as well as releasing money from bank accounts and selling or distributing the deceased person’s home and personal property. There are two types of Grant of Representation. The first is a Grant of Probate. A Grant of Probate is issued where the deceased person left a valid will and nominated one or more people to act as their Executors once they have died. If a person or persons are named as an Executor in the will, then those persons are entitled to apply to the Probate Registry for Grant of Probate. The second type of Grant is a Grant of Letters of Administration. This is the Order or Grant which a deceased relative, friend or solicitor must apply for if the deceased person has not left a will and not named people as their Executors. A Watch scheme is a citizen-organised system of policing in a particular community or environment to prevent crime and disorder.
