Do I need a deposit to buy a house? Yes... Usually a minimum of 5% deposit is generally required. The term used for this is “Genuine Savings” – meaning, the deposit is to be saved over a minimum 3mth period held in your account. Some lenders will waive the “Genuine Savings” requirement if you can supply a suitable rental payment record that shows a consistent ability to maintain a commitment. If you were to apply with one of those lenders that offer this exception, you will still need approximately 5% cash

deposit plus costs*, but it could be in the form of a gift, first home owners grant, or cash held in a term deposit etc. *Most mortgage lenders will also require you to cover the 5% deposit plus any fees in establishing the loan eg: Stamp Duty, settlement fees, mortgage registration fees etc. This is just the surface, as there are so many options available, hence buying a house can be a confusing and intimidating time.

When there are hundreds of conveyancing firms to choose from it is often difficult for sellers or purchasers to decide who to engage to undertake their conveyance. In our experience the decision to engage a particular conveyancer is not always the price, although at Ormeau Legal our fees are extremely competitive and we don’t ask you to pay us anything until settlement. We operate our business from a registered office and have a dedicated team of professionals to ensure that your conveyancing matter runs smoothly. Whilst we can conduct most of our correspondence via email and phone we prefer to use a personalised approach and we encourage you to attend our office to meet with us so that we can explain the necessary searches that should be undertaken and any other questions that you may have. We understand that as a first home buyer the purchase of a property can be both stressful and confusing. Our aim is to assist you throughout the process and be available to answer your questions both during business hours and after hours. WHAT IS ALL THIS PAPERWORK? We are often asked why there is so much paperwork in our initial letters? It is a legal requirement that we send you all of the necessary information and if this is the first time that you have purchased in Queensland you will be left feeling that you have just received enough paperwork to rivel the novel War and Peace! Don’t let that stress you out, just arm yourself with the paperwork and we

are more than happy to sit with you in our office and explain the process with you. The buyers search list is extensive and client’s can be excused for feeling overwhelmed and confused as to what type of searches they should be undertaking. Generally, the standard searches are adequate however, there are instances when you need further searches. An example of when further searches should be conducted is in the example of Mr and Mrs Smith who have attended an open home. The property boasts 4 bedrooms, 2 bathrooms and 2 living areas. The house is comprised over two levels with the lower level consisting of a bedroom, bathroom and living area. It is not uncommon that the lower level does not comply with the local Council building requirements and therefore the additional bedroom, bathroom and living area are not identified and accordingly this affects the value of the property. Whilst the height of the ceiling may only be a few centimetres shy of compling with the local Council requirements the cost of rectifying can be significant. The contract does not tell us that the bedroom, living area and bathroom are downstairs it is only when you describe to us the outlay of the property that we would become aware of the fact that further searches should be undertaken. This is why we say that it is important that you take the time to attend our office and discuss your proposed purchase with us so that we can develop a full understanding of the property that you intend to purchase. It might be that

you are a seasoned investor, in that case we may never need to meet you in person and all of our correspondence can be conducted via email and or phone. We encourage you to send us your contract prior to signing so that we are able to suggest any amendments that we consider necessary to protect your rights. An example of this is where the property has a swimming pool, the contract may say that the swimming pool is to be left in a clean condition but it does not say that the pool pump must be left in good working order. A pool pump can be an unnecesary expense that could have been avoided if the contract contained a special condition. Another example is how you would like to receive the property. The contract could provide for the property to be left in a clean and tidy condition, but what is that really saying? What you deem to be clean and tidy may not be what the seller deems to be a clean and tidy condition. At Ormeau Legal we offer a personalised service and we encourage you to attend our office. AUTUMN

KEEP YOUR GARDEN FLOURISHING WITH THESE TOP TIPS FOR AUTUMN Make new plants from cuttings. Take 10cm cuttings from hardwood herbs such as rosemary and bay or natives such as banksias, grevillea and coastal rosemary. Remove the lower leaves, dip cuttings into hormone powder and pot in small containers of premium potting mix. Keep just moist and shelter from strong wind and sun. Trim hedges before the onset of winter to keep them compact and bushy from ground level. Check your lawn and make sure any weeds you sprayed last month are dying. Repeat the treatment if necessary. Aerate the lawn with a garden fork and scatter lime lightly over it. This sweetens the soil after many years of lawn food application. Rejuvenate tired lawns with an autumn feeding to ready them for the onset of cool winter weather. Check for borer damage on all deciduous trees, paying attention to the trunk at soil level. It‘s easier to check when trees are dormant and bare. Don’t try to cultivate soil beneath large trees; you will only damage the roots. Make planting holes between the roots instead and insert small plants with tiny root systems that establish themselves readily. Bromeliads thrive under trees.

GARDENING Transfer the leaves that fall on your garden and lawn to the compost bin on a regular basis, otherwise they will smother your plants and grass. Don’t rush to prune spent seed heads. They provide a wealth of food for birds that visit the garden. Magnolia fruit attract parrots who feast on their seeds. If you have cymbidium orchids, they should be placed in full sunshine to encourage good flower spikes during winter and spring. Divide evergreen perennials. Lift them from the soil, divide at the root and re-plant into well-conditioned soil.
