Golden Horseshoe Chapter I am pleased, on behalf of the Golden Horseshoe Chapter of CCI to contribute a few words for this 2019 edition of the Professional and Business Partners Directory.

From the PRESIDENT This directory is published annually as a tool for our members and the broader condo community. Not only is it a ready resource (available in print and digital versions) it is also evidence of the wide network of businesses and professionals that exists for the benefit of condominium owners. From St. Catharines to St. Jacobs, Burlington to Brantford and Guelph to Grimsby, our directory was created to serve you! The Professional and Business Partner Committees of both the Golden Horseshoe Chapter and Grand River Chapter together with the joint Communications Committee of both chapters, have once again created a valuable resource. In the following pages you will find useful information and articles relating to important topics in the condo industry, an article index as reference for what has been published in our publication Condo News over the 2018 year, as well as the ever helpful listing of Professional and Business Partners. Stephanie Sutherland Stephanie Sutherland is a condominium lawyer with McCarter Grespan Beynon Weir PC, working with condominium corporations and unit owners. Stephanie sits on various CCI-GHC and CCI-GRC committees and is on the GHC Board. She is a frequent speaker at CCI events, and obtained her ACCI in 2015. Grand River Chapter As the new kid on the block, the Grand River Chapter (GRC) has worked diligently over the past year to establish a strong grass-roots foundation.

From there, we will build on our mission of providing members with education, information, awareness and access to expertise. Thanks to the leadership of the chapter’s first president, Maria Finoro, and the boots-on-the-ground determination of our members and first board of directors, I’m happy to report that we have already made great strides. We were pleasantly surprised and greatly honoured to be the youngest chapter in CCI’s 35-year history to receive the Lorne Young National Chapter of the Year (Tier Two) award. During that first year, we not only balanced the budget but also made a small profit. We exceeded our anticipated membership base and held three successful Leaders’ Circle Events in Brantford, Waterloo and Guelph. We also distributed updates to 160 members on the new cannabis legislation and strategies for dealing with electric vehicle-charging station requests. Recognizing the immense contributions of two chapter members – Ted Pritchard and Maurice (Chevy) Cheveldayoff – CCI National presented them with Distinguished Service Awards (DSAs). This is the first

time two DSAs have gone to the same chapter at the same time in the same year. We are entering our second year in good shape. Our first formally elected board of 13 directors brings a range of experience including accounting, property management, engineering, legal and contracting. We have also implemented a succession plan to ensure longevity. Our goals for 2019 and beyond are to continue strengthening the chapter through proven strategies and events as well as innovations. To that end, we have partnered with the Association of Condominium Managers of Ontario (ACMO) to introduce a managers’ Lunch & Learn session on April 5. Another initiative to increase event attendance is to better harness the power of social media to attract audiences that we are not reaching now. I believe that the future is built on forging strong community and relationships.This means working with other chapters to share and learn, encouraging members to step forward with ideas and suggestions, and increasing participation in chapter business. And with the collaboration and support of our internal and external communities, I’m confident that GRC will continue to provide its members with excellent leadership.

From the EDITORS' DESK Welcome to 2019. For some reason it seems so strange to write that date.

My younger self could not imagine what life in the twenty first century could be like, and with all that is happening in the world today I’m still not sure what the end of this century will be like. The weather for one is giving all condo buildings challenges, for example no salt in our near future. But necessity being the mother of invention perhaps someone will finally come up with a better system than salt for our driveways and roads. How to use new technologies not just for cost saving but also for their other advantages is an important part of future planning – read LED lighting by Michael Chen.

To Be the Board or Not to Be the Board, That Is the Question Serving on a board of directors is a rewarding privilege. The competitive pay, exceptional benefits and indexed pension all make the task lucrative.

Coupled with the thanks of one's community, these perks explain why countless people vigorously pursue being a board member. Regrettably, the opposite experience is endured by many directors. Volunteer boards often navigate thorny and complex issues their daily lives may not have fully prepared them for, while being buffeted by unit owners claiming they could do a better job. In many condominiums there are unit owners who take their opinion to extremes. Rather than registering their concerns under ‘other business’ at an owners' meeting, these unit owners keep boards awash in unsolicited advice. This can include daily e-mails of complaints, submitting alternative plans, or offering an army of more skilled professionals waiting in the wings. Many boards consume precious hours and resources responding to these individuals, invariably second guessing themselves in the process. In turn, at year-end an auditor often cites rising professional fees for increased property management, engineering, accounting and legal services; this in turn gives rise to a fresh round of complaints. This situation seems like an endless catch-22. Respond to

the unit owners and the carousel ride may never end. Ignore them and their actions become more strident. Thankfully a recent case from Ontario's Superior Court lends overdue assistance. In Patterson v. York Condominium Corporation No. 70, a unit owner and former board member thought her plan for the Condominium outranked the Board's. Armed with a professionally prepared audit, funding plan & budget, and a repair report, Ms. Patterson argued her 'plan' for the Condominium was to be preferred. Ms. Patterson cited her belief that the Condominium's was both deficient and also in violation of the Condominium Act, 1998 (the “Act”). While the Board did acknowledge some failings in the recent past, the Board claimed an ongoing turnaround in the Condominium's fortunes and had its own plan in place to restore the Condominium to financial and physical health. The matter was ultimately litigated. Ms. Patterson sought a compliance order, pursuant to section 134 of the Act. The relief claimed was ostensibly for the implementation of her plan. The Condominium resisted, citing that the Board was elected to manage the


affairs of the corporation and the courts should not substitute their own judgement for those of a board; this is commonly referred to as the 'business judgment rule'. Provided a board has acted fairly, reasonably and in good faith, the Condominium submitted, their decisions should prevail. The court in this case agreed with the Condominium. The court denied Ms. Patterson's intervention, reinforcing the business judgement rule for condominiums, holding: "‌the Board that is elected to manage the affairs of the corporation and that the business judgement rule applies. The Board is, in my view, in a much better position to make decisions affecting the corporation than this court. Our court should not substitute its own

judgement for those of the Board, which has been elected by the unit owners." Ultimately, Ms. Patterson was ordered to pay a portion of the Condominium's legal costs, her share totalling $14,646. Regrettably, the case did not give much guidance on how to respond to unit owners like Ms. Patterson. Can a condominium ignore them, refuse to reply to their e-mails or omit them from consideration at a board meeting? The case does appear to reinforce that a condominium does not have to entertain a never-ending cycle of such contributions. Unit owners are entitled to request condominium records and review the affairs of their corporation 'like an open book'. What they are not entitled to do is attempt to run the condominium,

without first seeking election from their fellow unit owners. While a board should be careful not to dismiss suggestions outrightly, when such 'contributions' begin to interfere with a condominium's governance, a condominium may invoke the business judgment rule. So although the pay, benefits and pension are thin and the thanks of one's community rare, this case does uphold an important concept in that the courts will grant a board deference, so long as the board acts in good faith, fairly and reasonably. Five Questions You Should Be Asking Your Winter Service Provider When evaluating your winter service needs and starting the process of looking for a qualified service provider it is increasingly important to be thorough in your search.

Asking the right questions can help you to differentiate between a mediocre and an exceptional winter service provider. Here are five key questions to be asking in pursuit of a great service provider. Is your winter service provider progressive? Progressive service providers are always looking for better ways to deliver service to their clients. This year’s salt shortage has service providers looking for new ways to reduce salt usage on sites by investing in new plows that offer greater ground contour resulting in a better road cleanup after plowing. This means that less salt needs to be used to melt the remaining snow after plowing. In recent years there have been significant improvements with ‘Live Edge’ or ‘Flex Edge’ plows whose cutting edge is made up of individual flexing sections 12 to 18 inches in length that contour to the road surface allowing better snow clean-up. As a result, substantially less salt is required to return conditions to bare pavement. While the savings in salt costs help cover the 30% increase in equipment costs, the true savings of less salt use on site are to condominium infrastructure such as concrete pavers, walkway and vegetation. Is your service provider Smart about Salt certified? The Smart about Salt Council is a not-for-profit

organization which offers training to improve winter salting practices and recognizes industry leaders through certification. Salt is an effective tool used to battle winter snow and ice. It does, however, have the potential to affect ground vegetation, sidewalks, roadways and urban infrastructure. Salt must be applied in the correct circumstances and in the correct amounts in order to maximize its effectiveness and lessen its harmful effects on the environment. A Smart about Salt service provider has invested in training and made a commitment to comply with industry standards to lessen the negative salt impacts on your infrastructure. Does your service provider hold themselves and your service to a higher standard? Service providers who are serious about delivering a higher service standard use tools for continuous improvement. The SN 9001 Quality Management System, specifically for the snow and ice industry, is an example of such a tool. Some of the key elements of the SN 9001 process are:


• The pre-site inspection to look at existing damage and determine best locations to pile snow. • Creation and “sign-off” of the snow map by the board or property manager. • The post-storm audit to note any deficiencies and constantly look for continuous improvement. To maintain the standard, the certification is audited each year by third-party auditors. Condominium Authority of Ontario: Supporting Mandatory Director Training It’s been just over a year since mandatory training for condominium directors became law in Ontario and 10,870 directors have completed the free online program as of early December 2018.

The Condominium Authority of Ontario (CAO) is responsible for providing the mandatory training for condo directors. The CAO was launched on September 1, 2017 and introduced a wide range of services and resources to support healthy condo living in Ontario. Mandatory director training is one of those services.

Board directors are integral to the success of the condominium corporation, and are often responsible for hundreds of thousands, if not millions of dollars in operating a condo. The more knowledge a director gains, the better they can serve a condo corporation and its residents.

• No longer counts towards quorum of the board

All directors elected or appointed to a condo board on or after November 1, 2017 must complete mandatory training within six months. If they don’t complete the training, they immediately cease to be a director according to the Condominium Act, 1998 (the Act). The only exemption is for directors of corporations that have not held their turn-over meeting. Once a turn-over meeting has been held, the directors must complete the training within six months of election.

Legal consequences of not completing mandatory training on time The CAO is proactive in supporting condo directors to fulfill this mandatory requirement so that they better understand their important responsibilities on behalf of all owners in the condo corporation. The CAO sends reminders to 16

Results to -date Feedback on the training has been extremely positive. Results of director training surveys show that an average of 88 per cent of respondents reported very high satisfaction with the training. An average of 92 per cent of survey respondents learned something new and over 96 per cent would recommend the training. Easy-to-follow, online format of CAO’s director training program The CAO’s director training program was developed in consultation with owners and directors. To keep costs down and reach the almost 45,000 directors across the province, the CAO developed an online format. The online modules are short, easy to follow and include knowledge checks along the way. There is no test or exam. The online format also allows users to stop at any time and return later to continue at their convenience. Modules can be completed in any order and are fully accessible, allowing the user to select audio, text and video, or use a screen reader.

Training program covers need-to-know topics The CAO’s program consists of 21 modules. Each addresses an important area of knowledge, including: • financial management fundamentals • maintaining the condominium’s physical integrity • the role of directors and their key responsibilities • effective leadership for strong condominium communities. The online modules are 10 to 20 minutes at audio speed. The entire program takes three to six hours. You can control the speed and complete the program at a faster or slower

pace and return at another time.

Tracking each director’s completion Since the training is valid for seven years for any future election or appointment to the board, the CAO maintains a permanent record of directors who complete the online CAO Director Training Program. Corporations can view completion dates for their directors on the “Contacts” page of the corporation’s profile when logged in to the CAO’s system. Directors (and others since the training is available free of charge to anyone) can access their electronic certificate of completion when logged in to the CAO Director Training Program. This electronic certificate of completion can be downloaded and saved as a PDF file or printed. Directors are required to provide the certificate of completion to their corporation within 15 days of completion. Directors must complete the training using their own CAO account, preferably created using the invitation code that the CAO sends to directors, in order to get credit for completion.

Having difficulty with the online format? Here are a few solutions that may help. The CAO is committed to ensuring that every director who is interested in continuing to serve on the board is able to complete the training. Here are some successful strategies used by condo boards and managers to support directors who may not have or use computers regularly:

• Having someone set up computers and walk directors through the training modules as part of a board meeting. This provides an opportunity for the board as a whole to discuss the topics and how these areas are addressed for their corporation. • Making computers available for condo directors to use in the condo management office or another location. • Contacting the local high school to seek student volunteers. This approach will also help students receive community involvement credit towards their diploma. • Accessing the computer equipment available at local libraries or asking a friend or family member to assist. In addition, the CAO is available to help. If a director is unable to complete the online training using any of the above strategies, they should write to the CAO at info@ condoauthorityontario.ca and provide details about their specific circumstances. The CAO will consider circumstances on a case-bycase basis to help find a solution. CAO is committed to meeting directors’ needs. The CAO gathers feedback from directors who have contacted our customer care teams and through the online survey that is provided at the end of training. Big Waste Purging, moving, renovating, upgrading - all of these life changes leave homeowners facing the same dilemma: How do I get rid of all this stuff?

Aside from taking matters into your own hands and hauling everything to the dump, condo owners have other options when it comes to handling bulky stuff.

But let’s start with what NOT to do: 1) Do not drag your items to the waste area on your property and leave it for collection. Yes, it will get taken away, but the bill for that collection lands on the entire condo, including yourself and your neighbours. 2) Do not put large items down the chute. Getting them through the opening is just half the battle. Large items get lodged in chutes all the time, and it’s very costly to get them out. Which means the condo, including yourself, will be paying a big bill. 3) Do not cram all your large items into the bins in the garbage area. Doing this will fill the bins faster and result in extra collections. Which, you guessed it, is a bigger bill for the whole condo.

So what do you do with this big waste if it can’t go with the rest of the trash on the property?

1) If it is reusable furniture, clothing, household items or construction materials, contact a local charity such as Habitat for Humanity, Value Village, Salvation Army or whoever else might help your community and ask if they will come collect your donation. 2) Another option for good quality used items is to post an ad on a community website, such as Kijiji, to see if anyone would like to buy your stuff. Remember: Your trash could be someone else’s treasure. 3) If the items can’t be reused, check your local paper or look online for businesses which offer private waste collection services. 4) Talk to neighbors or the property manager and see if other people have big things they need to get rid of as well. If so, then maybe a large item collection day can be scheduled for the whole condo. 5) When in doubt, contact your property manager. They will be able to recommend the right resource for your collection needs. Your neighbours, property manager and

collection specialists will thank you for finding alternatives to putting large items in with regular waste.

Now that Cannabis has been legalized for a few months, and many condominium corporations have implemented various rules limiting cannabis use, Boards and Managers are faced with continual questions such as, “Can a condo ban cannabis?" and “How do you investigate and enforce complaints?”

Cannabis in Condos – Now that the Smoke has Cleared The Condo Act requires that rules be “reasonable”. Generally, Boards are given broad discretion in determining what kinds of rules will suit their unique communities. Only if a rule is patently unreasonable will a court be inclined to strike it down. As such, a rule prohibiting the smoking of cannabis in units and/ or on balconies could certainly be seen as reasonable. Ideally, any rule limiting cannabis use would also impose the same restrictions on tobacco. Contrary to often-held belief, the fact that these are legal substances in no way gives residents an absolute right to smoke them in their units or on their balconies. However, as with so many condo issues, putting a rule in place can be the easy part. Efficient and effective enforcement is where the real work is to be found.

Once a complaint is received that a resident appears to be smoking cannabis, and the smell is transferring to the corridors or other units, the complainant should be asked to provide the dates and specific times that the smell transfer is noted, either in “real time” or via a weekly log. Obviously, this is easier in a building with on-site management or security, but is still possible even if those are not present. The complainant should be able to identify a rough area, or specific units that are suspected, however the corporation should investigate all units in the surrounding area to verify accuracy. If this consumption can be documented over a course of several days, the data can then be analyzed for specific times of the day that WINTER 2019 | CondoNEWS

the offender is smoking cannabis. Once this has been narrowed down, the corporation has a few options to investigate.

With some planning and a little effort, a condominium community can nip cannabis issues in the “bud”.

The Superintendent or the Board can be notified by the complainant of the occurrence and they can attend the area to verify. In real time. However this must be limited to certain times of the day as no one can be expected to be on 24-hour call for such an investigation. Another method that may hold merit is a third-party investigation, conducted either by someone like a security company hired only for this purpose, and will therefore have no vested interest and therefore cannot be accused of any bias. In all cases, if documentation has yielded a specific pattern of smoking, then this should be provided to the person investigating, as this can drastically narrow down the time frames for investigation, leading to more efficient investigation.

Once the situation has been verified and the rulebreaker located, enforcement steps can be taken, including the possible involvement of the corporation’s solicitor in particularly serious cases. Should this not yield results, the corporation may have to proceed to mediation/arbitration or to court, depending on the specifics of the case. One way to possibly reduce in-suite cannabis consumption is for a Board to consider designating an outdoor location as a smoking area. While some may chafe at this notion, creating such an area may help alleviate tensions, ushering in harmony for all residents. Finally, to clear up another misconception, even if a condo corporation’s owners were to vote down a rule prohibiting cannabis smoking in units and/or on balconies, most condos already have an applicable existing rule preventing residents from carrying on any activities which will cause a nuisance or interfere with the quiet enjoyment of another unit. Corporations should contact their solicitors to consider whether such a rule, or other sections of their governing documents may be able to assist. 22

Snow Expectations This year the big buzz is around the salt shortage. The shortage is forcing contractors and property managers to reassess contracts, prices and expectations. There is definitely an opportunity to learn and to do better.

The salt shortage has been precipitated by a number of factors. Salt is locally mined, but the major mine in Goderich experienced a labour dispute this year which shutdown production for a number of weeks. Another mine operated by Cargill has experienced a water leak and this has negatively impacted their production. In addition, you may remember the late spring snow storm, which ate up most of the salt reserves. As is practice the municipalities have first priority on salt and this year, they have opted to raise the quantity they are holding in reserve.

Many contractors received notice this year that their regular supplier would not be able to fill their salt orders. All other contractors have experienced a significant cost increase on the salt they are bringing into their yard. Because of the shortage there are no guarantees that there will be salt available as the season progresses. Many contractors have made provisions to secure and store their salt on premises. This all adds to the cost of winter maintenance. With this increased cost to the contractor is an increased cost to condominium corporations. Good service costs money WINTER 2019 | CondoNEWS

and many contractors are issuing letters and notices of salt surcharges to their clients. This cost of maintenance for the condominium corporations cannot be avoided. It is important to have open lines of communication with your contractors to ensure good service at a fair price. Increased cost is to be expected with the current salt shortage, but there is also opportunity to review expectations and scope of work. Is it realistic to expect all hard surfaces to be clear of ice and snow at all times? Because of unrealistic expectations contractors often oversalt. With education to unit owners and additional

signage, we can come to realistic expectations of site conditions. We do live in Ontario and we do experience snow. There may also be opportunity on a given site to close down walkways or parking areas for the winter thereby eliminating the need to winter maintenance. Again, this should be properly communicated and marked. With an eye to a longer-term payback, an open discussion about the current condition of sidewalks and parking lots may reveal that the need for excessive salt is a result of a bigger problem. Often, an overdue resurfacing project will result in puddling, which increases the need for salt to address ice buildup. We need to get Smart about Salt.

But everyone needs to be involved in that discussion. The winter of 2018/2019 will be marked by the salt shortage and will affect budgets and the bottom line, but it will also be an opportunity to open and expand lines of communication between contractors, property managers and unit owners. Together we can review expectations, consider site conditions and work towards being smart about salt. A Case Study of First Markham Village: Lighting Retrofit Project Smart building owners and property managers are gradually retrofitting the current fluorescent lighting system to the LED lighting system because of the tremendous benefits of the LED solid lighting technology.

Its lower energy output reduces the building’s overall energy consumption. Compared with the fluorescent lamp, LED’s longer lifespan reduces the building’s maintenance cost. Overall air conditioning requirements can be reduced by LED’s low heat working condition. Unlike fluorescent lamps, LED tubes contain no mercury or any hazardous materials. The City of Toronto building code states that motion sensors are allowed for use in multiresidential hallways and parking garages as long as the overall brightness in these areas meets the minimum illumination. New lighting systems offer dimmable, repairable and remotecontrollable LED products which are the latest

breakthrough in the residential and commercial lighting market and specialized for underground parking garage and common hallways. These LED tubes have a built-in motion sensor that can help people achieve different dimming modes and maximum energy savings compared to regular LED tubes. These LED tubes’ modularization decreases the cost for repair rather than changing the tubes completely so it also

decreases the wastage. The remote-control feature allows people to change the dimming mode freely between 0W, 3W, 6W and 9W to achieve the maximum energy savings. The dimmable feature is very useful for hallways and underground parking lots since these areas are seldom used but all the lights are fully lit, especially for the period from 12 a.m. to 6 a.m. The dimmable feature can achieve 40 percent more energy savings than using regular fully-lit LED products. LED Townhouse Retrofit Because of the large floor area, townhouse complexes can have large underground parking lots.

Take the First Markham Village (FMV), located at 8 and 10 Cox Blvd, Markham. Before the LED lighting retrofit project, the underground parking garage had 895 pieces of 110W 8’ T12 fluorescent lamps and 284 pieces of 60W 4’ T12 fluorescent lamps. The lighting system has 347V voltage and was outdated, as well as consuming a huge amount of energy. In order to test the significant energy savings result,


three portable power meters were installed at parking stalls #85, #87 and #89 on December 16th, 2013 to track the electricity consumption of two 4’ T8 LED tubes with motion sensor, one 110W 8’ T12 fluorescent lamp and two regular 18W 4’ T8 LED tubes, accordingly. The full power of our LED tubes with motion sensor is 18W. The LED technician sets both tubes’ dimming mode to 6W. Both LED tubes will dim down to 6W automatically if there is no motion detected in the motion sensor’s detectable range for a minute. After 92 days’ examination, the typical light fixture of one 8-foot T12 110W fluorescent lamp consumes 281.11 KWH in total and $42.17 in dollars. Two regular 4-foot T8 18W LED tubes consume 79.49 KWH in total and $11.92 in dollars. Two LED tubes with motion sensor only consumes 20.77 KWH and $3.12 in dollars. Therefore, 92 percent of electricity consumption savings in the underground parking garage could be achieved by retrofitting the existing fluorescent lamps to LED tube with motion sensor. Please see the power meter consumption table and diagram below in Table 1.

After one year of operation of LED with motion sensor, the actual hydro meter readings also explain how significant the electricity consumption savings are after retrofitting the fluorescent lamps to LED with motion sensor. (Note: The hydro meter reading not only includes the electricity consumption of the underground parking garage, but also contains other electricity consumptions). The actual hydro meter data comparison table between September 2013 and September 2014; October 2013 and October 2014. Dryer fires are real and happen every day. They cause property damage, loss of possessions, loss of homes, injuries, hospitalizations and even fatalities.

Getting the Facts on Dryer Fires As more and more homeowners make the transition to townhome and condo living, the issue of preventative maintenance is even more apparent than ever as neighbouring units are directly affected when events such as a dryer fire occur in a complex. In the construction of new homes, primarily townhouses, laundry facilities are often found to be located on second or third levels of the unit. In low- and high-rise condo units, clothes dryers are often situated in compact closets either side by side or as stacked combo setups. Often, the dryer is set up on one side of the unit with a long vent run to the opposite side before reaching the termination vent. Maintaining these long vent runs requires specialized equipment and service to ensure that the entire vent

run is cleared of any combustible lint buildup from the clothes dryer all the way to the (exterior) termination vent. Townhouse units with clothes dryers located on the second or third level of the home can have the vent running into the attic to a roof termination vent. These require a professional that specializes in attic and roof vent services. Another important preventative measure is to ensure that the entire dryer venting system is made up of metal-only venting. Foil or plastic / vinyl (white) dryer venting is recognized by the appliance manufacturer as a real fire hazard. In fact, there is a warning label that can be found at the back of every clothes dryer that reads the following


or similar warning: “DO NOT USE FOIL OR PLASTIC. USE METAL VENTING ONLY. FAILURE TO FOLLOW THESE INSTRUCTIONS CAN RESULT IN FIRE OR DEATH.� If your dryer is equipped with a foil vent (expandable shiny tin foil with a wire ring running through it) or plastic (expandable white) venting, it should be replaced with either a rigid or semi-rigid metal vent only. The reason being that if a fire should occur, a metal vent will help to contain it whereas foil or plastic gives very little to no protection whatsoever. LINT TRAP BOXES Condo units often have a secondary lint trap box equipped with a screen to help catch any lint that gets past the lint screen in the clothes dryer travelling that travels through the venting. The challenge with these units is that they are often installed in an area in the laundry closet (ie: ceiling, behind the stacked dryer, or not in sight at all) where they are often quite difficult to reach without the aid of a step ladder, thus creating a falling hazard. Just as these lint trap boxes can be useful, they can also prove to be a fire hazard if not properly maintained, allowing the lint to back up into the dryer itself causing the appliance to

overheat and breakdown or even catch fire! CLOTHES DRYER FIRE SAFETY Every clothes dryer comes equipped with its own lint screen to help trap lint before it makes its way through the venting to the termination vent outside. Cleaning out the lint screen after each load alone is not enough to remove the fire hazard. Lint manages to make its way into to the venting through the air velocity output of the clothes dryer. Lint also accumulates inside the dryer cabinet itself, in the form of combustible layers on top of the heater coils (electric dryers) and around igniters (gas dryers) as well as blocking up the exhaust blower fan which is what creates the actual fire hazard. Fires that start inside the dryer cabinet and then spread through the venting across the rest of the home often cause extensive damage. For this reason a complete Dryer Fire Prevention service should always include a clothes dryer inspection. (Unless the clothes dryer is brand new). Having the clothes dryer inspected and cleaned along with the entire vent run will not only help protect homeowners from a preventable dryer fire, but is proven to help reduce appliance repair costs (90% of clothes dryer issues are directly related

to lint build-up). A lint free clothes dryer and dryer vent run will also result in shorter drying times as low as 25-35 minutes for even full load! IMPORTANT TIPS TO HELP PREVENT A DRYER FIRE If the clothes dryer is taking longer than 60 minutes to dry a load, STOP USING IT IMMEDIATELY and call a professional Dryer Fire Prevention Service company as there is a VERY HIGH RISK of it catching fire! NEVER leave the clothes dryer RUNNING UNATTENDED for long periods such as when going to bed or leaving home. KNOW THE WARNING SIGNS - It takes 40 minutes or longer to dry a full load. - The dryer is equipped with a foil or plastic vent. - A burning smell is noticed when the clothes dryer is running. If it has been more than 2 years since the last dryer fire prevention service, an inspection is highly recommended. CONDOMINIUMS & TAXES The basic activity of a condominium, collecting monthly common element fees, qualifies it as a notfor-profit organization. A corporate tax return is filed annually but no taxes are assessed. In addition, the corporation may have to file a non-profit organization (NPO) information return. This return must be filed if combined interest and rental income exceed $10,000 in the current fiscal year, if the corporation owned assets valued at more than $200,000 at the end of the previous fiscal year or if the corporation has ever filed an NPO information return in the past. It is important to file this return within six months of the fiscal year end, to avoid penalties. This return does not assess tax but can impose penalties, if filed late, of $25 per day up to a 36

maximum of $2,500. Most condominiums earn some interest income. To date, we have not seen this income attract tax for any of our clients. The corporation needs to be sure that interest earned on reserve investments or a reserve bank account is kept as reserve income. It cannot be deposited into the general fund bank account. Laundry income – if the condominium collects the coin (cash) from the laundry machines, rather than using a third party service, this cash may result in a qualified opinion on your audited financial


statements. Cash cannot be audited and it is susceptible to theft. If the corporation does not want to use a third party service, see if you can set up a documented system that involves two unrelated people overseeing each other through the handling of the cash until it is deposited into the corporation’s bank account. This may not result in an unqualified report, but will increase the controls related to cash collection. Rental income – this includes, but is not limited to, parking, guest suite, locker and roof top. (Notable exemptions include longterm residential rent, such as superintendent suite, and parking rent charged to residential units.) • If you earn $50,000 in total from these sources in four consecutive calendar quarters, or less, you must register for HST. Once registered, you must collect HST on these sources. Consult with your accountant to determine if you can claim Input Tax Credits (ITC’s) on any expenditures incurred once you have registered. • Be careful – even if you aren’t registered for HST, some suppliers will include HST in their payment to you. We have seen this frequently with roof top rentals to cell phone tower companies. If they include HST in their payment, you should return the HST portion or you will need to register for HST and submit

the HST to the government. The corporation cannot keep the HST. • Common Element Fees for commercial units are considered a taxable supply from an HST perspective. If this income, combined with the above list, exceeds $50,000 in four consecutive calendar quarters, or less, the condominium will have to register for HST. Receipt of income other than monthly common element fees could jeopardize your notfor-profit status. At a minimum, this means you may have to pay tax on these incomes. CRA has audited a number of condominium corporations over recent years. They issued letters to various corporations pointing out that the activity was not compliant with notfor-profit income. However, to date, no action has been taken. If you have any questions about your condominium and taxes, please contact your accountant. Landlords are allowed to add “Terms and Conditions” which would be the equivalent of “Rules and Regulations” and other operational terms previously used by most professional landlords, but it is up to individual landlords as to whether they choose to add terms and conditions.

What Does the Standard Form Lease Mean for Tenants in Condominiums? The Province amended the Residential Tenancies Act, 2006 (RTA) to include a requirement that all landlords use a “prescribed form” of lease for different classes of tenancies (it is 13 pages long); and has enacted a regulation which came into effect on April 30, 2018 making it mandatory for landlords of most kinds of “rental units” (i.e. condominiums, houses, apartment buildings, secondary suites) to use the “Standard Form of Lease” for all tenancies entered into on or after April 30, 2018. A copy of the Standard Form of Lease is available at:

www.forms.ssb.gov.on.ca The Standard Lease Form must be signed on or before the day the tenant

is entitled to occupy the rental unit and applies to Tenancy Agreements “entered into” on or after April 30, 2018. The Standard Form of Lease contains seven pages of basic terms and conditions of tenancy and six pages of “Information for Tenants”. unit. If it is, the tenant must agree to comply with the condominium declaration, by-laws and rules, as provided by the landlord. While the RTA will apply to tenancies in priority to any other provincial statute (other than the Human Rights Code, s.3 RTA), it is possible for residential landlords of condo units to enforce some provisions of condominium declarations, by-laws and rules against tenants. For example, the “no pets” and “family status” use provisions in some condominium documents can be enforced in a tenancy of a condominium unit, even when those same provisions would be unenforceable in an apartment setting. This can be difficult for unit owners and tenants to understand and may require a letter from the condominium corporation’s lawyer to explain the enforceability of these provisions in the condominium rental context, if compliance becomes an issue. If tenants breach the condominium rules, the unit owners will generally be required to take steps to enforce the condominium declaration, by-laws and rules through an application to the Landlord and

Tenant Board (LTB) on the basis of “interference with the landlord’s legal interest”. A Board Member at the LTB always has an ability to refuse eviction based on an exercise of discretion. There are precedents, however, to support eviction based on a breach of the “no pets” and “family use” restrictions set out in condominium documents (see: Metropolitan Toronto Condominium Corp. No. 949 v. Irvine, (1994) 42 R.P.R. (2d) 319 and Simcoe Condominium Corporation No. 89 v. Dominelli, 2015 ONSC 3661 [“no pets”] and Nipissing Condominium Corporation No. 4 v. Kilfoyl, 2010 ONCA 217 (“family status”). Landlords, to protect their own interests, should ensure the prospective tenant is well aware of the requirements under the declaration and the rules of the condominium prior to entering into a lease to curtail issues that may arise if a tenant was not so apprised.
