Rajiv (my Smurfy) and I formally met in matric and although we disliked each other, we cannot deny the instant attraction. This attraction grew stronger in university and finally our love story took off in 2008. We have graduated together, shared milestones, faced many challenges, moved provinces, experienced so many beautiful moments and then in June 2019 we sealed our love with a spiritual promise of forever, together. Our wedding day was magical, shared with the closest of family and friends. Our only 2 service providers (Toxic Micz and Maharajas Caterers and DĂŠcor) delivered beyond our requests and made the entire experience effortless and simply memorable. We had envisaged rain on our wedding weekend and were glad that Mr Sun decided to attend our celebrations also. Our day began with a photoshoot which was literally and figuratively a walk in the park, thanks to the Toxic Micz Team. Although it was the middle of winter, it felt like a colourful spring day. Once we entered the Hall, we were blown away by the soft romantic colours and ambience of love and excitement. I truly feel that our wedding was imperfectly perfect!! YWPG 2019/20 | 3

JEWELLERY Ring in the new While the prong setting is traditional for rings, the sleek and modern bezel setting is also currently very much in vogue. This setting surrounds the gem with a thin band of precious metal, keeping it secure while creating a perfectly smooth edge that also helps to accentuate the appearance of the stone. The vintage design of the navette ring – literally meaning ‘little ship’ because of its elongated setting that is pointed at both ends – is making waves once more. Fashionable in Victorian times as well as the art deco era, the navette style is quintessentially large and elaborate, containing clustered stones in various patterns and colours, often surrounding a central stone. This eye-catching ring is ideal for brides wanting to combine vintage with something a bit more edgy and modern! One of the most exciting emerging trends is the open ring. As the band isn’t a continuous circle, it allows for a creation that’s truly bespoke, with so many new combinations of angles, cuts of gem, shapes and colours. Mixing metals in engagement ring settings and wedding bands guarantees versatility as well as a modern twist. Bring together yellow and white metals, or try different shades of gold. For example, setting a diamond in a white metal like platinum makes the stone really shine out while also playing up the yellow gold of the band. The shape of the gem is another important aspect. Traditional shapes include round, pear, oval, elongated oval with pointed ends (marquise), square (princess), square with rounded corners (cushion) and rectangular (emerald). Stones may also be cut in the shape of a heart or something more unusual like the kite, which is diamondshaped, or the shield, which is roughly triangular, with straight or rounded sides. The latest fashion is the half-moon, which is straight on one side and curved on the other. Coloured gems are becoming more and more popular, especially when paired with white diamonds. Brides get the best of both looks – the inimitable sparkle of a diamond along with the individual statement of a coloured stone. Smart choices include aquamarines, tourmalines, rubies and sapphires. Romantic and classic, the pearl engagement ring has also made a comeback on the wedding trend watch-list. Certain metals look better with specific gems. For example, sapphires and diamonds appear even brighter with a platinum or white gold setting, while emeralds and rubies are complemented by yellow gold. Bridal jewellery Necklaces can be either bold pieces or understated additions to the bride’s total look, depending upon the neckline of the gown, with deep V-necks, off-the-shoulder or high necklines very popular at the moment. Layering and stacking jewellery creates a unique statement and is gorgeous with a strapless dress or plunging neckline. Brides can mix and match, with different varieties of metals and even different types and colours of stones. Choker necklaces, which are also making a comeback, look fabulous on a long-necked bride. Choose a longer necklace if you want a broad neck to appear more graceful and streamlined. Your bridal hairdo can either hide or highlight your choice of earring. In 2019, earrings are focal feature in bringing the whole ensemble together. Dazzling drops are in the spotlight, and are just the ticket for brides who want to bring on the bling! They look best with an up-style or short hair. Pastel-coloured gems in necklaces, bracelets and earrings are becoming a fast favourite in bridal jewellery, particularly when worn with a white wedding dress, as their soft and delicate hues impart elegance and sophistication. VENUES wedding packages and offer a professional service, with well-appointed function rooms and sometimes a ballroom as well, not to mention in-house catering and banqueting facilities, a functions coordinator, and accommodation for the newlyweds and their guests too. Golf or country clubs are also popular choices, as they tend to have attractive grounds and buildings that are ideal for hosting events. Like a hotel, they’re equipped to cater for large numbers of guests and provide a comprehensive service. Another choice is a restaurant, which might be ideal for a smaller wedding. Some of these venues also have outdoor spaces, allowing for the reception to move from a welcome drink in the garden or on a rooftop pool-deck to the main reception venue indoors. Do bear in mind though that larger venues may be somewhat impersonal, and may host more than one wedding on the same day. There are a number of exciting non-traditional venues out there as well, such as an art gallery, barn, boat, industrial space, or even an aquarium. A much less formal option is the home wedding. However, while this can be the least-cost alternative, it will require the most input in terms of organisation. VENUES VENUE CHECKLISTS There are a multitude of things that need to be factored in when looking for a reception venue that’s just right for you. To avoid the disappointment of falling in love with, and then having to reject, what at first glance seemed like the ideal venue, there are some questions you should be asking before you start to narrow down your options. When making your selection, speak to the bookings manager as well as the catering manager. If the venue also has an events coordinator who will be there on the day to supervise the set-up of the wedding this will be a huge bonus. Save the date Number one on the checklist is to find out whether the venue is available on your chosen wedding date. Many popular places are booked long in advance, particularly at certain times of the year and over specific holidays and special dates like Valentine’s Day. Alternatively, if you’ve set your heart on a special location which is not available on the date of your wedding, you may prefer to change your wedding date to accommodate the venue. Space matters You also need to know the extent of your guest list when going venue hunting. No matter how charming a location may be, you’ll want to make sure the area has adequate space for all your guests. Many couples underestimate the number of people who they (and their parents) will end up inviting, so get that guest list finalised ASAP! Knowing how many guests are on your list will also assist in budget planning for all aspects of the wedding. Do also consider the whether the venue will be big enough to host not just the guests but also any activities you may have planned, such as dancing, and whether there is space for a band and/or DJ. Generally speaking, you will need more space for a formal, sit-down dinner than a cocktail-style event. Look at the shape of the room and consider architectural aspects such as columns or other obstructions that could block your guests’ views of the main table or dancefloor. Balancing the budget Your budget is another important matter. Depending on the venue, you could be looking at a flat fee for hiring the space, or a price per-head if there are in-house caterers. Also look at the amount of decorating the venue will require, as this is will be factor om determining its overall cost. In the event that you allocate too much of your budget to the venue, you may struggle with funds for other important wedding day elements, such as food, flowers and music. Look at what is included in the price of the venue hire. As mentioned above, ask if inhouse catering is provided, or whether you will need to hire your own catering services. Additionally, if they do cater in-house, determine what that catering comprises. A sitdown meal, buffet or snacks? Will they be able to tailor the menu to suit guests with specific dietary requirements? And is the price of waiters included or extra? Bar services are a further consideration. If the venue has a licence and bar facilities, ask about costs for drinks as well as bar staff, whether you will be allowed to bring in your own drinks and, if so, what the corkage charges are. If the venue doesn’t serve alcohol, find out if you will be permitted to bring your own. Chances are, items such as tables, chairs and linen will be part of a venue’s wedding package, but other essentials may not. Remember that whatever items are not supplied by your venue will need to be sourced from a hiring firm, thus adding to the final cost. This could include things like cutlery and glasses as well as table decorations, a PA system and dancefloor.

VENUES Accommodation and access If you’re having a destination wedding, holding the reception a fair distance from an urban centre, or simply expecting lots of overseas and out-of-town guests, then their accommodation is another issue you need to think about. Many venues have the added bonus of being connected to a hotel or other type of lodgings. If not, then make sure that there are other places nearby where guests can spend the night. The location of the venue is also important in terms of accessibility for your guests. It’s all very well to opt for a reception in a remote location that can only be a reached via a dirt road, but consider your guests’ mode of transport and whether the road is suitable for most cars. In the case of an urban venue, does it have enough parking? If not, you could try to locate a parking lot in the vicinity and perhaps organise a shuttle service to the venue. Is the location of the ceremony close to the reception venue? With today’s burgeoning wedding industry, a number of venues as set up to host both the ceremony and the reception – a practical option that has the added benefit of minimising potential transport complications. You may also need to find out if the venue has ramps for wheelchair access and is otherwise suitable for disabled guests. Does it have adequate seating for the elderly and does it cater to the needs of young children? Are there sufficient and suitable bathroom facilities?

VENUES Weather issues The time of year and expected weather conditions are other issues to keep in mind when looking at a prospective reception site. If your wedding is taking place in summer, enquire about whether the venue has adequate air-conditioning. Likewise, a winter wedding may need additional heating. While Durban and the KwaZulu-Natal coast enjoy great weather throughout the year, with lovely long summer days, there’s also a good chance of rain and humid conditions at this time. On the other hand, the subtropical coastal areas experience warm, dry winters, which average 23°C during the day and rarely drop below 10°C at night. If you’re considering a venue in the Drakensberg or Midlands, bear in mind that while the weather is generally more temperate, you can expect afternoon thundershowers in summer, and cold nights with the possibility of snow during the winter months. In the case of bushveld, locations, the cooler months tend to be more pleasant, as these areas can be quite hot and wet in mid-summer. Other considerations Find out whether the venue has any limitations in respect of noise levels, dancing and candles. Ask what deposit they require, and what their cancellation policy is. Don’t forget details such as overtime charges and other fine print before signing the contract. Additional questions could include things like whether the venue may be hosting other weddings on the same day as yours, who will be in charge during the reception, and whether there are any major renovations or building programmes scheduled before (or during) your wedding. VENUES DESTINATION WEDDINGS Destination weddings continue to be an extremely popular choice, especially for couples looking for an exotic location to celebrate their nuptials in the company of an intimate group of family and friends. Destination weddings are also ideal for partners who come from different parts of the world, as settling on a neutral location may be the perfect compromise for both sets of families. PHOTOGRAPHY Start by looking for someone whose photographs you love and who shares a similar vision and philosophy to you and your partner. Are you looking for photos that are hip and edgy, sentimental and romantic, classic or documentary-style? Browse through some local print and online bridal magazines, and make a list of the photographers whose work speaks to you. The next step is to look at the photographers’ individual websites – in addition to their portfolio of photographs, their ‘about’ page should give you a good idea about who they really are, how they work and whether you’re likely to ‘click’. Think about whether their style (traditional, natural, photo-journalism) will be suitable for the context of your wedding. Once you’ve narrowed down your options, the next step is to meet with the photographer in person or talk to them on the phone. Chances are you will spend more time with them on your big day than even your bridesmaids, so it’s essential to find someone whose personality gels with yours. Your photographer’s technical ability and equipment is also a key concern, and is dependent on your wedding venue as well as the time of day you’re getting married. Daytime weddings where lots of natural light is available tend to be much easier to shoot than images in a dark ceremony venue or an al fresco evening reception. The more challenging the lighting environment, the more skilled your photographer will need to be. For that reason, when perusing a portfolio, take careful note of the location and lighting, determining whether it will be similar to that of your chosen venue. Of course pricing is another serious consideration. Remember to see what’s included in their package, such as how many images they will shoot, the cost of additional hours, second photographers, high-res JPGs, albums and an engagement and/or other shoots. Your photographer may offer a variety of packages, so make sure that yours can be tailor-made to suit your needs. Additionally, find out when you are likely to receive your photographs and digital images. Editing can be a lengthy process, and delivery might take longer than you expect, so it’s always best to ask. Just as equipment and skill-sets have evolved, so too have a host of innovative ideas which are presently inspiring photographic effects, styles and settings. Here are some hot wedding photography trends that are gaining momentum in 2019. Aerial photography using drones has been around for the past few years and is only growing in popularity. Thanks to advances in technology, it’s even easier (and increasingly less expensive) to include drone footage in your wedding day package. Involving overhead shots of the bridal party as well as the venue itself, this is a great way to capture the bigger picture and overall excitement and energy of the big day. Looking for a super-romantic effect? Backlit photography, which takes advantage of natural or artificial light to create a glow behind the subject, is a current trend. So too is stop-motion wedding photography, which entails the animation of still photos in a high-definition video to present a unique statement about the bridal couple. These days wedding photography isn’t only about the big day itself, since couples are keen to capture an even greater variety of special moments. This has led to the rise of the engagement shoot and, more recently, the proposal shoot, boudoir shoot and after-wedding shoot as well. Recognising that the proposal is just about as important as the wedding itself, some prospective grooms are opting for professional pre-wedding photography to record their proposal for posterity. At the other end of the scale, the post-wedding session is generally done the day after the wedding. These allow the photographer to shoot the couple in another location, and tend to be more natural and relaxed, as well as allowing additional time to get alternative shots, and perhaps take advantage of better lighting too!

PHOTOGRAPHY PICTURE IT! Some photographers will request a list of required photographs, while others will have their own tried-and-tested list from which to work. If you have any specific shots that you want taken, make sure to give the photographer your list in advance and discuss any particular requests beforehand. Casual and quirky photos of the wedding party getting ready are essential, as are fun shots of the bride and groom that let their unique personalities shine through. Special details, such as the wedding invitation, bouquet, dress, shoes, rings and jewellery, need to be captured … close-up! ‘First look’ photos have been trending for a while now and are still very popular. These record precious moments, such as the groom’s first glimpse of the bride, or her father’s first look at her in her wedding dress. Pictures of the bride’s make-up and hairdo are also a must-have. While you need to get individual shots of the members of the bridal party, it’s also a lovely idea to bring in parents and grandparents for a generational photo. Have a photo taken of the reception space before the guests arrive in order to document all the exquisite details of the décor, centrepieces, signage, table settings, favours and wedding cake. Action shots, such as entrances and exits, complete with confetti, sparklers or even coloured smoke bombs, make for wonderful memories. Portraits with the flower girl and ring bearers are timeless, and don’t forget an individual photo of the handsome groom … it isn’t only the bride who deserves all the attention on the big day! I completed my graphic design degree in 2016 at Vega Design School and I also graduated with a diploma in photography in 2018 at Vega Design School. Maybe you just need a little advice to steer you in the right direction when it comes to wedding themes and vendor choices, or perhaps you need someone more hands-on to help you manage the day-to-day decisions and appointments, and liaise with service providers on your behalf. So how do you know if you really do need to enlist the services of a wedding planner? Not having enough time for wedding planning and preparations is usually the number one reason for hiring a coordinator. This is likely to be the case if you’re having a very short engagement. DÉCOR & HIRE Minimalistic décor is one of the current trends in weddings. This involves less clutter, pared-down table settings and simple yet eye-catching centrepieces. To create a feeling of space, bring the outdoors in with the lush greenery of an indoor garden. Earthy elements taken from nature are inspiring décor features like leaves, crystals and pebbles, with abstract organic arrangements such as trailing ivy, grapevines and garlands hanging from walls as well as taking the place of centrepieces. At the other end of the scale, some brides are embracing ‘maximalism’, with oversized floral installations, extravagant table settings, and lots of colours and patterns. Wedding décor inspired by Morocco is big news in 2019. Cue gorgeous desert hues and rich, patterned fabrics in shades of blue, red, plum and burnt orange, cushions and hanging lanterns, and metallic copper accents. BRIDAL WEAR Today there are styles aplenty for any type of bride, from traditional and classic to vintage, modern or Bohemian. In 2019, the emphasis is on classic fabrics and cuts. Sleeves are big news, as are sleek column dresses, while strapless gowns are not as prevalent as they were some years back. Much of this may be attributed to the refined minimalism of Megan Markle’s long-sleeved, boat-necked gown, which has inspired current off-the-shoulder necklines and pared-down bridal silhouettes. With brides prioritising comfort and practicality, wedding dresses with pockets have been gaining popularity for the last few years. Gowns with asymmetrical design elements, such as the oneshoulder style and hemlines that are slanted or highlow (high in the front and long at the back) are very in vogue. Two-piece wedding gowns with crop tops are another trendy option, as are convertible dresses, where the top layer of the skirt can be removed at the reception to reveal a sleeker look. Other hot choices include florals, voluminous capes and capelets, lots of embroidered detailing, beading and even feathers, proving that pageantry is still alive and well in bridal fashion! Velvet is the fabric of choice for brides getting married in the cooler months. Even if you’re not ready for an all-velvet gown, consider adding velvet details on shoes or the bouquet ribbon to add interest and texture.

Choosing a bridal gown When choosing a wedding dress, first think about the type of venue, the formality of the occasion, the time of day and the season. Is it a town, country or beach wedding? Something large and elaborate or small and simple? Then consider your body shape and personality. If you’re an introvert, the chances are you’d feel out of place in something too flamboyant, while if you’re more outgoing, a dress that’s too demure and low key also wouldn’t work.

Remember not to leave it too late to start looking for a bridal gown. Experts suggest at least nine months before the wedding to allow time for ordering and alterations. Take a selection of lingerie with you when visiting the boutique; strapless underwear in a nude shade is best. It’s also advisable to take no more than one or two people with you when you go dress shopping, as too many different opinions may just confuse you. Mothers of the bride and groom

Many brides look for a dress online, which is fine, provided you first visit a bridal store and try on different styles to see what suits you. Even if you have a definite idea of the type of dress you want, don’t simply dismiss other designs; many brides are surprised to find that a style they hadn’t ever considered actually makes the perfect wedding gown. At the same time, a bride shouldn’t feel obliged to choose a dress that isn’t true to herself.

Traditional guidelines for mothers of the bridal couple suggest that the bride’s mother should select her dress first and then let the mother of the groom know what she has chosen in order for them to complement one another. Their dresses should be a similar style, length and colour, but shouldn’t match too closely. White, off-white or a neutral shade that’s similar to the bride’s dress is a definite no-go, as is a black dress, unless the outfit has been approved by the bride and groom.

Before you start trying on dresses, know what your budget is. It’s heart-breaking to find your dream dress and then realise you can’t afford it! Also, be careful about arriving at a decision too quickly. Yes, the first thing you try on could be ‘the one’, but make sure to try on more dresses just to be a hundred percent certain.

Over the years, the strict etiquette regarding wedding dress codes has relaxed somewhat. It’s no longer considered inappropriate for a mother of the bride or groom to wear a strapless dress or one with spaghetti straps – which can be teamed with a shawl, wrap or bolero jacket – and black or deep-toned dresses may also be appropriate, depending on the wedding colour scheme, with black and white weddings becoming increasingly popular.

On that note, it’s good sense to select a gown in your size or slightly larger. You don’t need the pressure of having to lose weight to fit into your dress, and it’s much easier to have something taken in than let out.

HEALTH & BEAUTY Don’t try out a completely new beauty regimen, as new beauty products can trigger an allergic reaction. CAKES & CATERING Once you start looking at catering options, decide at the outset on a budget that you’re comfortable with, as well as the type of food you want. After getting some recommendations on caterers from friends, other wedding vendors, or even your favourite restaurant (which might also have a catering section), have a look at the caterer’s website and Instagram account to get an idea of their range as well as any specialities and packages. Then narrow it down to just a few and set up appointments for interviews. Some questions to ask include whether they’re available on your wedding date and whether they have ever catered at your venue before. Establishing what their specific needs are relative to the venue in terms of space and facilities. This goes hand in hand with the more relaxed atmosphere of some contemporary weddings, characterised by an absence of designated seating, very few formalities and lots of mingling. Spit braais can be a real crowd pleaser for an outdoor wedding, and are perfect throughout the year. Marketstyle weddings with a variety of food stalls are a great way of incorporating the couple’s favourite cuisines; think mezze platters, rotis and bunny chows, Asian noodle bars and spicy tacos. If you’re planning a reception that will continue late into the evening, then the trend of late-night wedding food is for you. Typically, this includes snacks such as pizza, chicken sliders, fish ‘n chips, cheese and tomato toasties, or coffee and doughnuts, and as well as other unique eats that reflect the bridal couple’s preferred comfort foods. Dessert tables for post-wedding feasting can also be loads of fun. These make a stunning visual impact and are so versatile, providing an assortment of different dessert options for guests to try. MUSIC The music you choose for your ceremony depends on the formality of the service and whether or not it will be held in a place worship. In the latter case, you may only be able to play religious ceremonial music, while if it’s being held in another location you should have more flexibility. Also consider whether you will have pre-recorded or live music, and who will be performing. Musicians could include pianists, violinists, cellists or harpists, a string quartet for a fuller sound, a choir and soloist, or perhaps even the acoustic guitar sounds of a folk singer. Deciding to have a live band or a DJ play at your wedding reception is all about your personal preference, and logistics such as space, budget, guest demographics, and the time of day the wedding is being held. For an elegant cocktail function, you could have a musician playing timeless piano classics, while at a livelier affair R&B, Latin and Reggae style bands might be more suitable. It’s been said that if you want something special for your wedding day, there really is no substitute for the energy and vibe of a live band. However, don’t forget that a wedding DJ can offer a greater variety of music genres than a live band, and also tends to cost less. As themed weddings continue to be fashionable and wedding bands ever more diverse, some couples are choosing a band that plays music from a particular era or culture. However, it may be a little too much if that is all they play, so try to find a band that will mix themed music with general party music. While wedding receptions have traditionally had a band or a DJ, these days many couples are opting for both. Then you can have the ambiance and wow factor of live music, along with a DJ to complement the entertainment with his greater range and flexibility. Your chosen reception venue may be able to advise you on good musicians and DJs. Of all the wedding music played during a reception, couples are most likely to remember the songs chosen for important dances such as the first dance, parent dances, and the last song of the night. Whether it’s a song that you love for what it represents, one that reminds you of your relationship and how you met, or simply a great tune, your chosen music should be something that’s particularly meaningful to the two of you. When it comes to the rest of the music to played at the reception, it’s a good idea to draft a playlist, asking for suggestions from your wedding bandleader or DJ. Couples can also research song list ideas online via a Google search or use a music-streaming site, as well as asking friends and family for their favourite (and least favourite) tunes. HONEYMOONS Ideally, your honeymoon destination should be a spot that ticks all the boxes for both of you in terms of your interests and activities. At the same time, think about finding a place which allows you to strike a balance between sightseeing experiences and downtime for simply enjoying one another’s company. Bear in mind that incorporating all of your favourite things into just one trip can be a little overwhelming! For newlyweds who don’t have time for a multi-destination overseas vacation there’s the option of a ‘mini-moon’, which might entail a long-weekend or a mid-week break to a local destination, providing a short but sweet final chapter to the big event. Some couples would rather opt to stay put in the resort or hotel where the wedding took place, giving themselves a day or two to recover from the celebrations in absolute luxury and pampering. At the other end of the scale, there’s the ‘mega-moon’, which could see couples blocking off months on the calendar for a totally immersive exploration abroad. This might entail a journey covering multiple destinations and spanning a plethora of countries – the equivalent of a ‘gap year’ for newlyweds, before the time comes to settle back into careers and commitments. Other current honeymoon trends include the ‘adventure moon’, comprising excitementpacked, adrenalin-filled travels to unusual destinations; the ‘giving-moon’, which involves volunteering in a community project at your chosen destination; and the ‘buddy-moon’, where couples head off on holiday with other newly-married friends. However, whatever you do, it’s not worth maxing out the credit card or taking a personal loan or revolving credit to fund your trip! Couples could consider a ‘honey-fund’, where guests can make donations towards the honeymoon instead of choosing from registry items. Chances are, you have quite enough linen and kitchenware already! While you might want to save money by travelling in the off-season, do first check on details such as expected weather conditions for that time of year as well as whether the destination’s top tourist attractions will be open out of tourist season. Travel agents advise booking a trip over shoulder season instead to get the best of both worlds. Furthermore, they suggest that you should try not to take a trip that’s more than 13 hours long if you only have a week for your honeymoon, as a significant portion of your time away will be taken up with travelling rather than enjoying your destination. Book your trip well in advance in order to ensure you get bargain deals on flights and accommodation. It’s also wise to organise activities and special sight-seeing tours before you reach your destination, planning in advance where possible so you don’t waste time stressing over the little details during your honeymoon. And do remember to include time for relaxation as well as adventure! Be savvy about passports and visas, bearing in mind that many countries require your passport to be valid for six months after your travel date. Adults’ passports are valid for ten years, so check out what the expiry date is on yours. If you have to get a new passport, while you’re unlikely to beat the queues at your local Home Affairs branch, it does save time to fill out an online application beforehand on the e-home affairs website, which also allows you to upload the relevant supporting documentation. At the same time, it’s important to sort out all your foreign exchange needs, such as credit cards, prepaid travel cards and cash, in good time. Pack a universal adaptor for electronics, make sure you know how to put your mobile phone on international roaming, and don’t forget your chargers!

NAMBITI PLAINS PRIVATE GAME LODGE is situated in the beautiful and diverse landscape of Nambiti Private Game Reserve, just east of Ladysmith in close proximity to the Drakensberg and within fairly easy driving distance of both Johannesburg and Durban. LEGAL Making an informed decision regarding your marriage contract is vital. Your lawyer will be able to explain to you the different types of systems that exist in South Africa, along with the pros and cons of each. What will work for one couple won’t necessarily be suitable for another, as it all depends upon individual circumstances, such as assets owned by each party and whether one or both of them intend pursuing a career during the marriage. To ensure parity and equity in the relationship, both partners need to be on the same page when it comes to the choosing the contract, which will have far-reaching financial and practical consequences. Considering the marriage contract An Ante-Nuptial Contract (ANC) needs to be signed in front of a Notary Public (a qualified attorney) and registered at the Deeds Office within three months of marriage. There are two types of out-of-community of property marriages, those with the accrual system and those without. Under South African law, if you don’t have an ante-nuptial contract your marriage will automatically be deemed ‘In Community of Property’. With the In Community of Property system, all assets and liabilities, whether acquired before or during marriage, fall into one joint estate. Should the couple divorce, each partner will be able to lay claim to half the assets in their joint estate. Both partners have equal powers of administration, but some transactions relating to the estate, such as opening a bank account, may only be performed with the consent of the other spouse – a situation which is often impractical. As all debts (past, present and future) are shared, the couple’s combined assets will be at risk from creditors. If one of the spouses becomes sequestrated, the other spouse would automatically be sequestrated as well. Signed by both the bride and groom, an Out of Community of Property system requires the couple to enter into an ante-nuptial contract before the wedding. When drawing up the contract, each party lists their assets, recording the accumulated value. For the duration of the marriage, these and all other assets purchased by the respective spouses remain their own property, with husband and wife each being able to handle their own estates. Each partner is responsible for their own debts, whether incurred before or after the marriage. Contracts entered into with the accrual system allow husband and wife to retain separate estates during the marriage. In the event of death or divorce, the net increase in the value of each partner’s estate is calculated and then divided equally. Only the profits accumulated during the marriage are shared; debts are not. Any assets accumulated by the respective partners before marriage remain their property and are not shared. This system offers the sharing benefits of an out of community of property agreement combined with the protection of the in community of property system.

LEGAL The sole difference in a marriage without the accrual system is that the estates remain completely separate during and after the marriage, and neither spouse can lay claim to any part of the other’s estate. While this option allows spouses asset protection as well as independence, it may not be as fair as a marriage with the accrual system as it does not recognise any nonfinancial contributions made during the marriage. Legal requirements South Africa’s three laws relating to marriage comprise the Marriage Act (Act 25 of 1961), the Customary Marriages Act (Act 120 of 1998), and the Civil Union Act (Act 17 of 2006). The Customary Marriages Act provides for the civil registration of marriages solemnised according to tribal custom. The Civil Union Act covers same-sex marriages, with partners given the choice of having their union called a ‘civil partnership’ or a ‘marriage partnership’ and enjoying the same legal and material benefits and responsibilities as couples married under the Marriage Act.

According to the Marriage Act, the ceremony must take place indoors, in a church or other building used for religious services, a public office (like a magistrate’s court) or a private dwelling. Further, it should take place in the presence of at least two witnesses, and the entrance to the venue must be open. Only marriage officers, such as a minister of religion, magistrate, special justice of the peace, and commissioner of oaths, are allowed to conduct a marriage ceremony. In order to get married, partners will need documents such as a valid ID book, passport, or an affidavit attesting to their identity if the original document has been lost or stolen. If either partner is a minor, they will also need the written consent of their parents, legal guardians or the Commissioner of Child Welfare. Partners who have been married before require a final decree of divorce, while widows and widowers need to produce the death certificate of the deceased spouse. Clear copies of the two witnesses’ IDs or passports are also required.

The low-down on legalities for overseas brides and grooms who plan to tie the knot in South Africa can be found on the website of the Department of Home Affairs: www.home-affairs.gov.za. Foreigners will need copies of their passports, including a copy of the visa page with the last entry stamp through customs, three colour passport photos each, and a letter of nonimpediment from their embassy. They also need to fill in a ‘Declaration for the Purpose of Marriage’ (Form BI-31) in the presence of the marriage officer, and produce copies of divorce decrees or death certificates where necessary. After the wedding ceremony, the marriage officer will automatically issue you with an original abridged marriage certificate. As an unabridged certificate is sometimes required for the marriage to be registered in your home country, the marriage officer will apply for your unabridged certificate when registering your marriage with the Department of Home Affairs.
