TheIssue:Legislationthatpassedthe stateSenatethisweekandnowawaits actioninthestateHousewouldhopefully deterstateandlocalgovernmentbodies fromstallingopenrecordsrequests.

Onpaper,thestateofAlabamahas oneofthemostexpansiveopenrecords lawsinthenation.Itsaysanycitizen hastherighttoinspectandtakecopies ofpublicwritings,exceptforthoseexemptedbylaw.

Butinpractice,Alabama’slawisone oftheworst,becauseit’sessentially toothless.

Stateandlocalagenciescanstallrequestsforinformationalmostindenitely,andultimatelymembersofthe publicandnewsorganizations—usuallythelatter—havetosueinorderto gainaccesstorecordsthataresupposed tobepublicasamatteroflaw.

That’sbecauseAlabama’scurrent openrecordslawdoesn’tsaywhenpublicagencieshavetorespond.

Theparcelextendedaboutahundred feeteastwardfromHughesRoad,long beforethatroadwasbuilt.Myhousetodayislocatedadjacenttotheeastmargin oftheTribbleandGrayland. Thesouthernhalfofthe80-acreparcel wassoldfor$400in1839byJamesTribbleandhiswifeAnnEchols(ofthefamed Huntsvillefamily)toWilliamEchols,father-in-lawofCol.EgbertJ.JonesoflocalCivilWarfame.Thetimingandages suggestthatAnnmayhavebeenanaunt ofthisWilliamEchols,ortheywellhave beensiblingsorsomeothercloserelationship.Itisdif culttodeterminethe exactrelationshipbecausetherewere severalknownresidentsandlandownersnamedWilliamEcholsatthetime, mostlyinvolvedinHuntsville.

Inalllikelihoodthepurchaserofthe landfromJamesandAnnEcholsTribblewasWilliamEcholsJunior,whose wifewasnamedMary.TheseniorWilliamEcholsofHuntsvillehadawife namedSarah.Ofcourse,intheolddays thewiveswerenotalwaysnamedinthe landrecordswiththeirhusbands.While theEcholsmenboughtandsoldliterally aboutahundredparcelsoflandthroughoutallofMadisonCountyfrombefore 1819untiltheirdemise,theypurchased onlyoneothersmallparceloflandinthe
