Aseven-pageentryfoundinMadison CountyDeedBookPaboutRachaelbeganwithan1813courtactioninVirginia.Rachaelwasaslavewhohadbeenallowedtosueher“owner”(JohnDraper Sr.)intheQuarterlySessionsCourtof WytheCountyforherownfreedomand forthatofherchild,Juda.The rstpage indicatedthatRachaelwasjoinedin thesuitbyherbrotherSamandachild. Thecomplaintwasthattheownerhad committed“trespass,assaultandbattery,andfalseimprisonment”plusunspeci ed“otherwrongs”againstthem. Thetestimonyrelatedbacktoevents ofMarch1,1770,whenThomasClay(a grandsonofthefamousHenryClay)attackedthem“withstavesandswords” intheSouthamParishofCumberland County,Virginia.Theyweretakenand impressedasslaves,servingThomas Clayforseveralyearsuntiltheywere giventoWilliamClay(uncleofThomas) assecurityonadebt.
In1774theownershipofRachaeland herchildwaslegallytransferredby ThomasClaytoWilliam’ssonMitchell Clay.AtthattimeRachaelwasdescribed asaNegroaged20withchildJuda,age 7.ThiswouldmeanthatRachaelatage 13gavebirthtoherdaughterJuda,who wouldhavebeenbornin1767.MitchellClaysubsequentlysoldbothRachaelandJudatoJohnDraperfor“120 pounds”(oftheoldEnglishmonetary system).The1813lawsuitagainsttheir last“owner”,JohnDraper,requested “60pounds”damages,whichwaslater speci edas$500.
TheVirginiacourtin1813awarded Rachaelandherdaughtertheirfreedomplus“onepenny”--afarcryfrom the$500thatwasrequestedbytheplaintiffs,especiallywhenconsideringthat theyhadbeenunlawfullyenslavedfor 43years.However,beforetheruling wasimplemented,thedecisionwasappealedbyDraper.Depositionsweretakenin1818and1819fromSusannahClay (wifeofThomasClay,whowasthen deceased).TestimonyovertheyearsrevealedthatThomashadalsobeenseparatelysuedbySamforhisfreedom, whichwasgrantedtoSamaround1815. Furthermore,JohnClay,another sonofWilliamClay,hadownedaslave namedPeterwhohadalreadybeenfreed bytheVirginiacourt.Yetanothersonof William,ElijahClay,hadownedslaves JamesandBess,whohadlikewisebeen freedbythecourtinapriorcase.Allof thesepresumedslaveshadbeendeterminedtobedescendantsof“Chance,” aCatawbaIndianwomanwhowasthe motherof“Nann”and“Judy”.
