Hello and a warm welcome to the November edition of Dorset Business Focus, Dorset’s premier business magazine. As always, you’ll find it’s packed with topical news, articles, and information. You’ll see the front cover for this month’s celebrates our 100% retention with our Business Partners that were due to renew in October and I’d like to publicly thank all our Business Partners for their support for Dorset Chamber over many years. This retention rate is the highest across all levels of our membership and demonstrates the strength of the relationships that exist between us. When I started I Dorset Chamber, some 8 years ago (I don’t know where the time has gone!), we had around 13 ‘Patrons’. These were long-standing supporters of Dorset Chamber, with ‘patronage’ being our highest level of membership. My feeling was that ‘patronage’, whilst showing support, was perhaps oldfashioned and suggested a passive type of relationship and we wanted something much more pro-active and dynamic, and with the complete agreement of our Patrons, they all became Business

Partners, with two level available, Premier and Platinum. Eight years later and we have 27 Business Partners, each representing a sector, demonstrating the success this high-profile programme. These are a mix of large international businesses operating at a global level to smaller businesses operating in more local markets. All are great businesses and are champions of the Dorset Business community, key enablers in supporting Dorset Chamber in it’s work within the Dorset Business Community. We are very proud to be working with all our Business Partners and thank you all for your support for Dorset Chamber over the years and particularly through the pandemic, a hugely challenging time for most businesses. Businesses who choose to ignore the importance of Health and Wellbeing in the workplace – do so at their peril The benefits of having a healthy workforce cannot be understated, as good health and wellbeing can be a core enabler of employee engagement and organisational performance. Adopting a proactive and preventative approach to wellbeing in the workplace can result in •

Increased staff commitment, engagement and productivity Staff who feel valued and listened to are more likely to be engaged in the goals of the organisation, work together positively and perform to their optimal level.

Better staff retention A workplace culture that fosters staff loyalty and high morale is likely to keep staff for longer and reduce recruitment costs.

Reduced sick leave and absenteeism Staff who feel their wellbeing needs are being met are less likely to take sick leave and are more likely to return from leave taken, in a timely and sustainable way.

A more resilient workforce Building resilience can help people cope better with day-to-day stresses at work and problems at home. And putting the right mental health and wellbeing strategies in place can help to stop problems from escalating

An enhanced reputation Investing in wellbeing in the workplace sends a powerful message about your values and ethics and can help you attract a high quality workforce.

From public relations, to talent acquisition and employee retention, focusing on health and wellbeing within a business can put a positive spin on a brand’s image while boosting the morale and loyalty of those in the company. Developing the right culture through wellbeing initiatives can help companies to retain the most talented people, at the same time as maintaining the reputation as a caring employer. This is good for business and is a valuable perk for those within the company. At the same time health and wellbeing for employees must also work for businesses. A balance needs to be struck when considering programmes for staff and the cost of these programmes for the business. Some health schemes may be beyond a company’s budget, but there are many initiatives

that can be implemented cost-effectively. A culture of wellbeing can be cultivated without a great deal of outlay. Encouraging spending lunch hour outside, walking meetings and providing fresh fruit and healthy snacks are all simple ways that can make a difference. Providing information on various health issues in places where employees relax or interact, tie-in with health awareness campaigns, or business healthcare cover are all ways that make staff feel valued and cared for. The key though is that business leaders invest in initiatives and processes to create a culture and work environment that puts the heath and wellbeing of employees first and ultimately the business bottom line will be rewarded. There is now a much better understanding of how health and wellbeing policies can benefit businesses but there is still an implementation gap with many organisations not embracing this agenda fully. It should not be treated as an ‘add-on’ or a box ticked, it should be at the centre of a business model and viewed as a vital source of value creation, integrated throughout the organisation and embedded in its culture, leadership and people management. Why is this subject so important for businesses to focus on. According to Mind, the UK’s leading mental health charity. The most stressful thoughts that many people have relate to work. If people are stressed then in their downtime they may resort to unhealthy lifestyle choices which could have serious repercussions on their health and thereby creating a vicious

cycle. This ultimately will lead to poorer health and thereby a likely drop in productivity and increased sickness. It makes ethical sense that employers should shoulder some responsibility for taking care of their staff and reducing their stress levels, as well as making business sense too, as numerous studies have shown a strong link between employee wellbeing and business performance. The end goal of any health and wellbeing initiative is a healthy workforce and this results in saved costs as absent workers due to illness, cost a business time and money. A recent report found that the UK loses around £29b in staff taking time off work for sickness. The cost of replacing staff is also a heavy burden and studies have shown that a healthier workforce is happier and therefore more likely to stay in their job longer. Modern businesses ignore the need for health and wellbeing policies at their peril. An effective workplace wellbeing programme can deliver mutual benefit to people, organisations, communities and economies. Healthy workplaces help people to flourish and reach their potential and by creating work environments that actively promote a state of contentment this benefits both employees and organisations alike. Men join menopause campaign at trailblazing event Support menopausal women at work before they hit rock bottom – that was the message at a ‘men-only’ event held by Dorset Chamber. In a UK first, the session was held as part of the business support organisation’s trailblazing campaign to break the taboo surrounding the issue in the workplace. The meeting – titled ‘Gentlemen, Let’s Talk about the Menopause’ – included presentations, a Q&A and discussion. Dorset Chamber chief executive Ian Girling, who has spearheaded the campaign, said: “Although unusual, the ‘men only’ format worked really well for this event. “The response of the men attending was incredibly encouraging. It is so important to open up conversations in the workplace so women feel comfortable talking about the menopause and are supported.” He added: “We believe this to be the first event

of its kind to be held in the UK and is part of our wider campaign about menopause education. “It’s about having an understanding of what women may be going through and for a female colleague to be able to say ‘please bear with me, it’s not a great day today’.” Speakers included Nicola Green, whose consultancy focuses on the menopause in the workplace, and Edward O’Brien of Lester Aldridge solicitors. Theresa Higgins, who is Dorset Chamber head of finance and administration, also spoke of her own experiences of the menopause in the workplace. Men at the event heard that the average age of the onset of the menopause is 51 and there are more than 40 symptoms – and that women aged

over 50 are the fastest growing demographic in the workplace. Nicola, of Nicola Green Consultancy, told attendees that women may suffer in silence and end up at rock bottom before doing anything about it – with the job often the first thing to go. She added: “I believe that if we know what the menopause is and are educated about it we will all be able to manage it so much better.” Edward spoke about employers’ responsibilities and highlighted that the menopause was increasingly being mentioned at employment tribunals. Ian recently addressed chief executives from all chambers accredited with the British Chambers of Commerce (BCC) about the issue. Dorset Chamber Supports Angel and Luke Through Kickstart Scheme Earlier this year, Dorset Chamber recruited two young people through the Government’s Kickstart Scheme, which provides funding to create new jobs for 16- to 24-year-olds on Universal Credit who are at risk of long term unemployment. Presidents Column by Caron Khan Award season is fast approaching and there’s no doubt that winning an award demonstrates that you’ve been judged as an industry leader by a third party, which is surely the golden egg for any ambitious business. But, for many businesses, the application process is the thorn in the coveted crown. All too often the process is not given the time and attention it deserves, resulting in a lacklustre application that doesn’t do your achievements justice. With hundreds of awards to get through, judges simply won’t pick you out from the crowd unless you write an eye-catching entry. So, if winning an industry award is on your business’ bucket list, take five minutes to read my top tips on how to go about it…

Tops Day Nurseries show their support for UK Malnutrition Week Tops Day Nurseries, one of the UK’s leading eco-sustainable childcare providers have shown their support for UK Malnutrition Awareness Week by engaging the children in educational activities regarding health and nutrition. The children at Tops in Poole had lots of fun making their own vegetarian pizzas whilst discussing the importance of healthy eating and where our food comes from. The children at Tops in Efford, Plymouth have spent time making their own fruit kebabs and chopping the fruit themselves! They have also baked a scrummy apple and blackcurrant pie! Malnutrition Awareness Week aims to raise awareness and understanding about the risks of preventable malnutrition. Research confirms that healthy eating habits in the early years influences growth, development and academic achievement in later life. This is one of the reasons that Tops Day Nurseries took steps to radically redesign a balanced menu 5 years ago in which they completely cut added sugar from their menus, followed by over-processed food, such as ham and nuggets. A healthy, balanced diet and regular physical activity are essential for children’s health and well-being. Tops Day Nurseries has in-house catering manager who oversees the catering operations and develops menus and recipes that include all of the correct nutrients that children need. The 2 to 3 year olds at Gillingham enjoyed posting the healthy goods into the hungry caterpillar’s mouth! The children at Tops in Southsea, Portsmouth enjoyed digging up their potatoes that they have been growing, washing them and making potato salad! As well as making a yummy home-made yoghurt that they polished off at snack time! Tops is Salisbury spoke to their children about good and bad foods, and asked them what would happen if they ate too much bad food, one of the children’s responses were “our teeth will fall out!” The pre-schoolers enjoyed using their interactive table to explore a game all about healthy eating! www.topsdaynurseries.co.uk

START WELL Don’t underestimate the importance of making a good first impression. The judges will have likely spent hours pawing through previous award entries, so be sure to get the best bits in first, and don’t beat around the proverbial bush – say it concisely and confidently, or not at all. BE TRUTHFUL You’d be amazed by how many businesses scupper their chances by exaggerating or embellishing their achievements. Judges will always see through these little white lies, and they won’t give you the benefit of the doubt. BE OUTSTANDING Judges are looking for outstanding achievements and contributions to business. So if you haven’t done anything amazing, don’t enter. If you believe you have got something to shout about, take your time in discovering exactly what that thing is. BACK IT UP If you’ve done something amazing, you’ll need to prove it with facts, figures and testimonials; otherwise it’s all pie in the sky as far as the judges are concerned. Use statistics and charts to demonstrate positive results, whether that’s commercial growth, client acquisition, client retention or employee and client satisfaction. STICK TO THE WORD COUNT I can’t stress enough the importance of sticking to the word count. You’ve got to bear in mind that the judges will have read hundreds of entries, amounting to hundreds of thousands of words, so they won’t thank you for adding to their workload. PROOFREAD, PROOFREAD, PROOFREAD! It stands to reason that you should never submit the first draft. That would just be madness. But it’s also madness to only proofread your entry once, and not let other people give it the once-over. Treat your entry as a work of art, making sure each and every word is absolutely necessary, and that you’re communicating your answers clearly and succinctly. WRITE PERSUASIVELY Whilst writing may not be your strong point, it’s nonetheless important to write persuasive and engaging answers. This may mean handing the baton to someone else in your team, or enlisting a professional service to help. But it’s definitely worth the investment – by writing a compelling entry, you’ll stand out from the crowd and give yourself the best chance at being selected. Good Luck! 11

Dorset Chamber Business Partner, ESET UK Extend Partnership with AFC Bournemouth Community Trust Technology company ESET have extended their partnership with the AFC Bournemouth Community Sports Trust for the 2021/22 season. The partnership is backed by player ambassador Orjan Nyland, with ESET supporting the Trust’s lessons on keeping children safer online. The classroom-based lessons address the students’ most common uses of the internet and focuses on the safety features and age ranges for each of these different applications and websites. ESET began life as a pioneer of

antivirus protection, creating awardwinning threat detection software, while their goal now is to make sure that everybody can enjoy the breathtaking opportunities that technology offers. ESET are also executive partners of AFC Business and regularly attend corporate events, giving them the opportunity to stay connected and support businesses locally. Amy Marks, partnership ambassador at AFC Bournemouth, said: “Having a partnership between ESET and our Trust is perfect because both organisations do so much good work to support children in our local community.

REIDsteel flying high with MJS Projects at Norwich Airport John Reid & Sons Ltd (REIDsteel) has been hailed for its work during the pandemic on a major development at Norwich Airport with MJS Projects (March) Ltd. The Christchurch-based company provided structural steel design, fabrication and erection services for a £7m hangar at the airport. It involved the construction of a 54,000 sq ft building – large enough for two A320 aircraft – with 15,500 sq ft of workshop space for Norwich Airport Ltd. REIDsteel brought its value engineering expertise to rationalise the scheme’s structural steel design which led to savings in both time and money. It represented repeat business for REIDsteel at Norwich Airport as the latest in a long line of projects stretching back more than 30 years. Main contractor MJS Projects – based in Norfolk and Cambridgeshire – was instructed by airport owner Norwich Airport Ltd, which is part of the Rigby Group plc. MJS Projects Director David Henry said: “When we were tendering for our recent Norwich Airport project we were introduced to Reid Steel as a specialist in this field. “The Reid steel pre-construction team were very attentive and came to meet us to discuss the project in detail. “This gave confidence in their knowledge and expertise and they gave us invaluable information on construction method, programme and value engineering options. “Commercially Reid Steel were competitive and we chose to partner with them following a tender agreement. We were successful on this competitive tender. “Procurement with Reid Steel was fast and in line with our agreement. The preconstruction team with whom we had met at tender stayed with the design stage of the project aiding understanding and communication with the design being completed in line with the agreed programme. “Site works were organised, safe and delivered to programme and to a high standard. This was reflected in the excellent low air leakage values recorded on such large buildings. “Even as the pandemic took hold Reid Steel spoke with us clearly and sensibly and we agreed a safe and suitable way forward which we could pass on and agree with our client. “We were thoroughly impressed with the service we received from Reid Steel throughout this project and we would not hesitate to work with them on future projects.” The new MRO hangar gives significant new capacity at Norwich Airport to provide high-quality maintenance, repair and overhaul services for customers worldwide. REIDsteel has previously worked on the 14

refurbishment and extension of a hangar at Norwich Airport in 2006. This involved a 10m extension of the hangar and replacement of sliding doors, allowing the building to accommodate new, larger airliners. Other projects at Norwich included a new cargo centre in 1998 and a customs bonded warehouse with an arch span portal frame design in 1989. REIDsteel managing director Simon Boyd said: “REIDsteel is no stranger to Norwich Airport with repeat business over many years. “However, no other project faced quite the same challenges at this one with the outbreak of the pandemic. “Even so, working with a company of the quality and ethos of excellence as MJS Projects meant we were together able to drive the development forward. “Its team were proactive and positive

What is the timeline to get help with business projects? Projects run from February to July, and we advertise the projects to students in December. What are the fees and commitments to a business? It’s completely free. For consultancy projects, we ask for a small investment of your time to meet with the students (on average 5 meetings across a 6-month period with some email correspondence). Are there any additional advantages to being a part of this business community? Organisations that work with us are invited to our annual Future of Work conference that is hosted by the Bournemouth University Business School and forms part of the MBA ‘Shaping the Future of Work’ unit. How to engage young workers ViewHR have spoken to a number of employers who have taken on new employees through either through the Kickstart Scheme or an apprenticeship. Whilst apprenticeships do not typically have an upper age limit, many apprentices are recent school-leavers. The Kickstart scheme provides funding to employers to employ young people aged 16-24 who are claiming Universal Credit and at risk of long-term unemployment. Here are some key considerations for employers in seeking to build engagement with young workers: Opportunities for Learning Both the Kickstart programme and apprenticeships have an emphasis on learning. Employers receiving Kickstart funding are required to provide employability skills training, and apprentices will work towards a relevant industry qualification whilst also gaining relevant experience. It is therefore important that individuals are given the right opportunities to succeed in the learning element of their position. It is important that employers work with education provider to ensure that they understand the course requirements and can provide the necessary opportunities. Future Plans? Both Kickstart placements and apprenticeships have end dates – Kickstart funding lasts for six months, and apprenticeships vary depending on the length of the course (typically one or two years). Most employers will issue a fixed-term contract for that period, so that there is no ongoing obligation to employ the person at the end of the programme. If you are thinking of continuing to employ somebody at the end of their placement, make sure you communicate this to them. It may be that you make this conditional (e.g. on passing their apprenticeship), but if you remain silent, then they might assume that there is no role for them and start looking for something else before their contract ends. Priorities Employers seeking to engage young workers may want to review their policies and practices accordingly. However, good practice around diversity and inclusion doesn’t mean exclusively implementing things for the benefit of younger workers, as getting this right can benefit everybody!

Tax and turnaround experts warn 7.5% VAT rise will hit South East hospitality sector including Solent A 7.5% rise in VAT hitting the hospitality industry in London and the South East from October 1st will slow the recovery and even trigger permanent closures, a tax expert has warned. The 7.5% rise in VAT for the hospitality industry will slow down the Covid recovery and could even cause a number of unnecessary permanent closures, according to Scott Craig, Partner and Head of VAT at Azets, the UK’s largest regional accountancy firm and business advisor to SMEs with offices in London and across the South East including in the Solent region. The original cut, from 20% to 5%, came into effect on 1 July 2020. From 1 October 2021, the rate will increase to 12.5% and this will apply until 31 March 2022. The rate applies to suppliers of restaurant services, hot takeaway food, holiday accommodation and admission to some attractions. Scott Craig warns that the hospitality industry has not had sufficient time to benefit from the cut and some businesses could face permanent closure. He said: “The UK has slowly reopened but remains in a state of uncertainty, and this has severely affected the hospitality industry. As restrictions have lifted, businesses have no doubt benefitted from the reduction in VAT but for some the increase to 12.5% comes too soon. “Events are now being planned well into 2022 and beyond, and if the reduced rate of 5% had applied for a longer period of time businesses would have improved their financial position and have a better chance of survival. Increasing the VAT rate will reduce the income received by many and this could lead to unnecessary closures of businesses that could have been in better financial health six months from now.” Scott Craig is urging business owners in

the hospitality industry to get ready for the reintroduction of the full VAT rate of 20% on 1 April 2022. He added: “The Government’s scaling back of its Covid support measure is coming too soon for businesses with little or no cash reserves. It is vitally important these businesses are aware of and prepared for the changes. The hospitality sector should ensure it makes the most of the scaled back VAT cut before reverting to the full 20% in April and seeks professional advice if needed.” Hotel turnaround specialist Tim Wedgwood, who also owns and operates the South Lawn Hotel near Lymington, said: “Something has to be done if the UK hospitality sector is going to bounce back. Whilst the temporary reduction in VAT is welcome, it has not provided that golden opportunity for the industry to burst back into life. The cost of food has risen dramatically and has completely written off any advantage the reduced VAT was intended for. Gross profit percentages on food sales have dipped from 80% to 62%, and wages costs which historically represented a third of sales in the hotel sector are rising sharply driven by the lack of labour post-Brexit.” “With the reduction in VAT now being withdrawn the only solution would appear to be price increases but when relying to an extent on the public’s disposable income this has to be approached with caution. Reduced VAT is common throughout Europe and the rest of the world and UK hospitality urgently needs a similar long-term solution,” he concluded. www.azets.co.uk

TDSi welcomes new placement student to its Software Development Team Poole-based integrated security manufacturer TDSi announced the arrival of its latest student placement, Vlad Radoi. Vlad has joined the company’s Software Development Team for a twelve-month placement as part of his BSc (Hons) in Software Engineering studies at Bournemouth University. Vlad is the latest in an ongoing line of TDSi placement students, as Managing Director John Davies elaborated, “As a business, we have a long heritage of supporting apprenticeships and placement students across all parts of our business, so we are always delighted to support a new student. “Contribution to the British Safety Industry Federation (BSIF)” is an award I never expected to receive. I don’t work for the BSIF, I don’t have to wear personal protective equipment (PPE) to go about my work, and I’ve not directly suffered from a workplace incident. So how or what did I contribute? The BSIF is firmly established as the major independent voice of the British safety industry, helping to both influence legislation and provide industry in general with a source of authoritative information on a range of workplace safety issues. I’ve made it my job to share, plagiarise and promote the BSIF’s work and messages to maximise their impact. But PPE is the least effective method of reducing risk in the hierarchy of controls, so why do I bother to contribute? PPE is used when the risk cannot be reduced enough to provide a safe working environment otherwise. The federation’s dictum resonates with me. “Anyone can sell safety, but you shouldn’t buy safety from anyone.” Anyone can sell PPE but does everyone take the time to ensure that wearers are trained to use the PPE properly? Do all PPE suppliers provide information about how to care and maintain the products? Is it the norm that safety suppliers talk to employers about the unseen risks that PPE protects users from – hearing protection and tinnitus, respirators and asbestosis etc. – so to encourage use? I’m presuming other PPE suppliers are also fulfilling their obligations in terms of product compliance within their supply chain also. PPE is ineffective if it’s not used correctly, if it is not fit for purpose or not compatible with other products. Whilst it might look the part, ineffective PPE wouldn’t be the last line of defence potentially resulting in irreversible harm. Just because it fits, the wearer may be covered but are they protected? Anyone provided with PPE deserves to go home from work safe and well.

First freight shipment to arrive on ‘Brexit buster’ Morocco to UK route The Port of Poole, in Dorset, is anticipating its first delivery via a new direct shipping route from Tangier in Morocco. The route has been established by maritime and transport specialist, United Seaways. A shipment of 100 freights of organic seasonal fruit and vegetables is shortly scheduled northbound. The route will now run once per week and largely comprise the transportation of dry and refrigerated freight. The link cuts overall journey times on goods to and from the UK to fewer than three days, compared to more than six days via road. It will be used to encourage British importers to source fresh produce and other products directly from Africa, and export companies looking to enhance their southbound trade to Morocco and the surrounding region. Trade relations between the UK and Morocco have a long-standing history of over 800 years, and it is anticipated the link will further strengthen ties between the countries. The route has been in planning for over two years and will help bypass post-Brexit traffic congestion and import procedures on goods arriving via Europe. It will also significantly reduce emissions compared to current logistic chains by road. In addition, the fallout from the current pandemic has caused global supply chain bottlenecks, shortages and disruption to the shipping industry, with sharp increases to

ocean-going freight rates. Alongside its strategic logistics partners, United Seaways will be able to offer the new direct line with the most competitive rates, significant emissions reduction, full logistics services including road haulage, door to door services, custom clearance services and warehousing services as demanded by exporters and importers. To offer this service and to overcome the present global supply chain disruption, current and future HGV driver shortages with the most competitive rates, United Seaways will shift from a RoRo service (unaccompanied cargo only) to RoPax service (accompanied cargo). Captain Brian Murphy, Marine and Port Director at Poole Harbour Commissioners, said: “The Port of Poole has been working closely with United Seaways to get this ‘Brexit Buster’ service up and running. Work and diabetes Nuffield Health Bournemouth Hospital encourage employers to understand diabetes and offers tips on how to support staff Diabetes in the workplace is becoming more prominent as an increasing number of people are diagnosed with the condition every year. More than 4.9 million people in the UK are currently living with diabetes, and by 2030 Diabetes UK predicts that over 5.5 million people will have a diagnosis. To coincide with World Diabetes Day (November 14th), Dr Richardson, consultant endocrinologist at Nuffield Health Bournemouth Hospital, is highlighting why employers need to understand what diabetes is, what impact it could have on their staff and business and how they can support those who have diabetes. “Diabetes is a condition that causes a person’s blood sugar to increase and there are two main types of diabetes. Type 1 develops when the body’s immune system attacks the pancreas, stopping it producing insulin. If left untreated, type 1 is life threatening, but the effects can be reversed once the patient is given insulin. “The most common is type 2 diabetes which is often caused when insulin is not being used for carbohydrate metabolism but being redirected into fat metabolism. Type 2 can potentially be reversed with weight loss, therefore releasing more insulin to deal with meal carbs. “While not everyone can lose enough weight to reverse their type 2 diabetes, healthy eating and regular exercise can improve blood sugars and reduce the long-term problems that are associated with diabetes. “As an employer, it’s important you understand the condition to be able to support your staff with diabetes and know the impact it could have on health and safety at work if not managed correctly. Health and safety risks could include impaired awareness and reduced concentration which could lead to accidents. All this could result in increased time off work for those not correctly managing diabetes. “So as an employer, what could you do to support employees with diabetes. Here are some practical tips: • Open up the conversation - Having an honest conversation around diabetes can help in many ways. Provide privacy - those with diabetes may need to take insulin injections or check blood sugar levels throughout the working day. Also, consider standing workstations. Look at your company values - Aside from supporting staff who have diabetes, there are improvements you could make to reduce the risk of diabetes. You can make healthier choices in food and drink available in the workplace, encourage exercise and work-life balance and have policies on mental health and wellbeing.

Christmas shouldn’t be taxing? With COVID restrictions lifted many businesses will have organised their Christmas party but they need to be aware of the possible tax implications on this and on the making of gifts to staff. Staff Parties Provided your function meets certain conditions it is free of tax and national insurance contributions. It should be annual event and must be open to all employees and not exceed £150 per head (ph) including VAT. The total cost of the party is the whole cost of the event, from the start to the end and it includes food, drink, entertainment, taxis home, overnight accommodation, etc. The limit of £150 per head applies to all those attending the function, not just employees. So, if employees are allowed to bring guests, the total cost should be divided by the total number of employees and guests. It does not have to be a single function, the £150ph can be across separate locations and departments provided all employees have opportunity to attend one. However, be aware that If the cost goes above £150ph the whole amount is taxable, not just the excess. This may mean your employee has to pay the relevant tax although there is also a grossing up exercise that can be used to avoid this. If you don’t use the full £150ph, the unused element could be spent on another staff function, say in the summer, eg a staff barbeque. One way to ensure you don’t fall foul of the limit is to ask staff to make a small contribution to the costs to cover any excess. Staff Gifts These can fall under Trivial Benefits rules which allows you to make gifts provided they are not contracted, up to £50 (incl VAT) per annum per employee, and where the gift is not for services performed. Be aware that if the cost exceeds the £50, the whole benefit is taxed, not just the excess. For Directors, office holders and their families the benefit is capped at £300 per tax year. To mark this achievement, John reflects on why he’s been selected for this prestigious award, and how his team refused to be beaten by Covid. If I’m honest, I was surprised to hear I’d been shortlisted as a Finalist in the ‘Business Resilience Award’ at the British Franchise Awards. While my team are no strangers to award wins – we’ve been fortunate enough to win four National Brokers Awards since 2015 – this one is extra special as it acknowledges our commitment to our customers and to each other during the recent crisis. When I founded Coversure Poole, I did so as I wanted to offer people a one-stop insurance shop, to provide employment to local people and to take control of my destiny. I worked hard, networked like crazy and began assembling a great team and before I knew where we were, I had a flourishing business and I was ready for the next step on my business owner’s journey: a second Coversure office in Weymouth. I acquired Coversure Weymouth in late 2018 and by the end of 2019 it was flourishing. Between our hospitality, taxi, landlord and liability insurance clients, we had a broad mix of clients, and everything was looking great. I began thinking of a third office and of taking on more staff. Things could hardly have been better. Then the pandemic hit, and I began to fear that I would not only have to shelve my growth plans, but I thatI might lose my entire business. Ours is a service business, one that operates from high street offices. It’s been built on faceto-face networking, personalised service and through the building of long-term relationships. That’s the way insurance broking has always worked and yet almost overnight our working practices were made impossible. My team couldn’t come into the office, my clients couldn’t come and talk to me and as the economy plunged so I lost significant amounts of existing business and the prospect of new business never seemed less likely. The outlook was bleak. We weren’t about to give in though. I came into this business to serve the community’s insurance needs and with many clients suffering as much if not more than we were, I was determined to be there for them. To facilitate this, I equipped the team with laptops and the tools to work remotely. To maintain our levels of customer care I eschewed furlough and instead kept as many of the team working on full pay as I could. This, it turned /company/dorset-chamber/

out, was a wise decision. Once lockdown was announced we were inundated with calls from clients asking about business interruption cover, unoccupied property insurance and other policy issues. They were grateful for the advice the team gave them and appreciated our help in getting cover pared back while the crisis lasted. The team were understandably fearful for their jobs, so I did my best to assure them that they were secure. I applied for grants, took no salary for myself for several months and used every trick in the book to keep costs down so that I could keep them safe. It was hard, but I never doubted we’d come through as I knew the business was strong, the team committed, and I certainly hadn’t come this far to fail now. As things began to ease I was overwhelmed by the gratitude we received from our clients. We’d been there for them when they needed us most which was the point of opening the business in the first place. I felt like we’d achieved something significant simply by surviving and that reinvigorated my belief in what we’re doing. The positives that Covid brought were to remind me of why I was doing this, of how great my team are and how much our clients value what we do for them. It was inspiring, and it made me determined to continue to grow my business organically and through acquisitions. What does the future hold for Dorset town centres? The challenges faced by the UK’s highstreets and town centres have been clear for all to see over the past 18 months. But as more people return to work and following on from the recent announcement of Bournemouth’s ranking as the 4th happiest place to live and work, are we rounding a corner, and will our town centres follow suit? If the recent £22 million ‘Town Deal’ funding to deliver ambitious regeneration plans for Boscombe town centre is anything to go by, then the future looks bright. Together with the consultation due on the region’s new BCP-wide Local Plan, it is an exciting time of potential for Dorset’s town centres. Eleven sites with a gross development value of over £2 billion have been earmarked for regeneration by BCP Council, and the interests of town centres have been protected with the creation of BCP Futureplaces Ltd. However, could recent planning changes hamper town centre regeneration plans? Over the summer, permitted development rights (PDR) were extended and a “higher threshold” for the use of ‘Article 4’ directions by local councils, was implemented. The changes have the potential to deliver significant conversion of buildings from non-residential to residential in town centres, which would allow much needed footfall back into these areas. Whilst positive in town centre regeneration terms, the changes remove the ability of local councils to steer PDR development within their local area, despite what might be laid out in the Local Plan. This will be particularly detrimental for local authorities without significant landholdings in their town centres, who will now have less control over what is developed there. Logistics Crisis As the supply chain gets worse British Chambers of Commerce has responded to the latest ONS survey on business conditions. William Bain, Head of Trade Policy at the BCC, said: “This data backs up our own findings that the supply chain has been facing persistent challenges for the last few months. It is no surprise that more than one in three trading businesses have experienced problems in sourcing materials, goods and services at home, or had to change suppliers.

“Over the last 18 months, our own research has also illustrated the unprecedented impacts on revenue, cash flow and international trade. “As recently as Q2 2021, we found that nearly 3 in 4 exporters reported no sales growth. “We also discovered that 82% of construction sector firms that attempted to recruit in that quarter said they faced recruitment difficulties – the highest level on record.

“Around half of construction sector firms also cited ‘inflation’ as more of an issue to their business than the previous quarter. “Other issues picked up included commodity shortages, skills shortages, new costs to international trade, and insecurity of supply chains “The ONS data shows Brexit continues to be a major factor too, with companies experiencing challenges on both imports and exports, issues with customs duties and rising transport costs. “This is further strong evidence that the UK Government should convene a summit with key business organisations and firms to consider the short and long-term solutions. The supply chain disruption must not be allowed to worsen over the next few months in the run up to Christmas.” Sue Bhatt, International Trade Manager at Dorset Chamber said: “Not only are we dealing with the aftermath of Covid and the restrictions which were in place, the shortage of HGV drivers has had a large impact on the trade industry where goods are unable to reach their final destinations. “There is also the added factor of the shortage of containers due to shipping disruptions which have left many thousands of containers stranded at sea on ships or anchored near jammed-up ports. This has had and inevitable knock-on effect. “It has been predicted that shoppers should also brace themselves as there could be a longer wait on delivery times impacting on Christmas. However, at Dorset Chamber, we have a seen a positive turnaround with an increase of 16% for export documentation requirements since the pandemic began, which is a positive step in the right direction.”

A new vintage clothing section has opened at the Julia’s House charity superstore in Creekmoor, Poole, and includes both men’s and women’s wear for all seasons. Seventy bags of vintage donations have been collected and stored in the shop’s warehouse over the last two years, and the recent explosion of interest in retro and sustainable fashion has prompted the charity to create a dedicated vintage fashion area in store. “We knew we had collected around 400 600 pieces, including coats, dresses, suits, tops, bags, shoes and accessories,” says shop manager, David Hutchings. “We’d hung on to them because we knew vintage items were a little bit more special. “Sorting through the items was a very exciting day for us – we had a few outfits from the 1950s and 60s, and recognised some familiar styles from the 70s, 80s and 90s, too. Some 1980s designer women’s ‘Dior’ shoes were a hidden gem and also a number of original Laura Ashley dresses, St. Michael (M&S), Biba, Topshop, Adidas and other well-known brands of the time.” The Julia’s House charity superstore in Creekmoor’s Neighbourhood Centre is much more than your typical charity shop. It’s an amazing emporium of preloved clothes, accessories, household items, furniture, books, toys and electrical goods, with thousands of items sold every year. The store receives over 4,000 donations each week and all funds from Creekmoor and the charity’s twelve other shops

across Dorset and Wiltshire go towards the care of seriously ill children locally, and support for their families. “We hope shoppers will be as excited as we are about the collection,” continues David. “We’re really keen to see how people will wear these items or blend them with other pre-loved fashions from our store – we’d love to see photos of them wearing the clothes!” Helping the families of children with lifelimiting or life-threatening conditions has been the sole purpose of Julia’s House since the charity started 18 years ago. It was the vision of children’s nurse Julia Perks, who saw the desperate need to support these families in the local community. Through the sorting, recycling and reselling of preloved items in its shops, the charity now finds itself playing a role in the current demand for more sustainable fashion and eco-friendly living. The process of renewing a commercial lease explained Once a commercial lease comes to an end, a tenant has two options: •

To renew the lease and remain in the property

To vacate the property

Tenants can renew by negotiating with their landlords, or they may benefit from a legal right often called security of tenure or LTA rights. This entitles the tenant to stay in the property and to request a new lease. If the tenant benefits from security of tenure, they can serve a Section 26 notice on the landlord. This sets out the tenant’s suggestions for the new lease with a proposed start date, and needs to comply with the required time limits. The landlord does have some limited options for refusing to renew the lease if they receive a Section 26 notice, but provided the criteria is satisfied, the landlord can refuse to renew. That said, the landlord cannot be forced to renew the lease of a ‘bad’ tenant, if for example, the tenant fails to pay rent. The landlord has 2 months to respond to the service of a Section 26 notice, if they wish to oppose it and a tenant can withdraw a Section 26 notice, if the lease has not yet expired. There are strict criteria for who, when and how notices for renewals can be served and an opportunity can be missed if these are not compiled with. Impact of fuel shortages on employment Last month’s fuel supply issue would have affected most employees, except maybe those with electric cars! But what obligations do employers have if employees say they can’t get to work because of fuel shortages? Why is this important? Technically speaking, it is a matter for the employee as to how they get to work. Subject to any company policy in place, an employer is under no legal obligation to pay employees who are unable to attend work due to transport issues. As a result, where employees are unable to travel to work by any means and they are unable to work from home, employers can require employees to take unpaid leave or allow them to use their annual leave. Those using annual leave should be paid as normal. That being said, employers should still act reasonably to keep employee relations positive and to minimise any potential legal risks. Disciplinary action for non-attendance may be unwarranted if the issue is completely outside of the employee’s control.

However, if an employer considers that an employee has been dishonest or is taking advantage of the situation, disciplinary action will be more justified (subject to the usual requirements for a fair process will apply). Employers should consider each individual’s circumstances before deciding what action to take. What should you do? Given many employees will have worked from home during the pandemic, it may be as simple as allowing employees to continue working from home for the time being. Other reasonable steps may include allowing flexible working times (to avoid travelling during busy periods or when petrol stations are at their busiest), allowing flexible working locations (e.g. at different offices closer to home) or providing

the cost of additional expenses for alternative transport (e.g. trains, taxis, buses or bicycles). Dependant on the scale of the issue, you may want to dedicate some resources to finding local stations with fuel and allowing your staff to leave in the day to fill up (for example, outside normal lunch times). Disciplinary action may be warranted if you suspect that the employee is being dishonest or is taking advantage of the situation. But make sure you can show evidence of such dishonesty otherwise you could be on the end of a constructive dismissal claim and/or unfair dismissal claim. What are the rules on monitoring remote staff? While there are many benefits to both employers and employees of working from home, one of the potential drawbacks for employers is the perceived loss of control over employees and their actions whilst working. Employers may therefore be tempted to increase the monitoring of their IT systems, not just to check up on whether their employees are working when they should be, but also to ensure the security of their systems and information, including personal data. Here, we take a look at some of the legal issues surrounding the monitoring of remote workers and some of the practical steps that employers can take to comply with their obligations. Is monitoring your remote staff illegal? There is no specific privacy legislation that expressly prohibits employers from monitoring its employees. However, the law does impact upon employee monitoring in several ways, including: •

The Human Rights Act 1998, incorporating Article 8 of the European Convention on Human Rights relating to the right to a private life.

The Investigatory Powers Act 2016, which governs the interception of electronic communications.

The Data Protection Act 2018, where electronic surveillance of employees involves the processing of personal data.

What are the legal issues when monitoring your employees? The legal issues involved in monitoring employees are complex, but the key points are as follows:

Lawful authority in this sense means having obtained the consent of both the sender and recipient. The exceptions where consent will not be required include a range of legitimate business activities, including the detection of unauthorised use of an employer’s systems. Data Protection Electronic monitoring of employees will inevitably involve the processing of personal data and therefore trigger the application of data protection legislation, which sets out a number of principles that must be complied with. These include obligations relating to the purposes for which data can be processed; the manner in which it must be processed; and the information that must be provided to employees about the reasons and forms that monitoring can take. The Information Commissioner’s Employment Practices Code gives a number of good practice recommendations when monitoring emails, for example limiting the extent to which emails can be read to the address or email header unless it is essential for a valid reason to read the content. Under the old data protection legislation, it was usual for employers to include a clause in the contract of employment confirming the employee’s blanket consent for the monitoring of phones, emails etc. However, employers can no longer do this under the current legislation and instead need to be

able to (1) identify a lawful basis for monitoring employees; and (2) inform employees of that lawful basis and the forms that monitoring will take before engaging in the monitoring. This is usually done by setting the information out in the privacy notice that employers are in any event bound to provide to their employees. One potential lawful basis for monitoring is to ensure compliance with an employer’s policy as to how its IT systems are used. It is therefore advisable to have an IT policy and for it to include provisions that reinforce the purposes and form that any monitoring will take. Although a blanket consent to monitoring in a contract of employment is no longer appropriate, it is still worth including a provision in the contract of employment that makes the employee aware of monitoring and signposts the employee to the relevant privacy notice and IT policy that the monitoring is carried out under. It is also worth noting that employers who electronically monitor their employees are likely to be obliged to carry out an impact assessment of its monitoring activities to assess the necessity and proportionality of doing so. This includes assessing the purposes of the monitoring and whether there is a less intrusive way of doing it.

Privacy at Work While it is only public authorities who are directly subject to the provisions of the Human Rights Act, it is still relevant to private sector employers as courts and tribunals are bound to interpret all legislation in accordance with the rights under the act, including the right to privacy. For example, a dismissal can be unfair if the circumstances concern an infringement of the employee’s right to a private life that cannot be justified. The right to a private life also impacts upon the way other legislation is interpreted. It is therefore important that any monitoring that might infringe the right to a private life can be justified by reference to a legitimate business need that cannot be achieved in a less intrusive way. Automation has been making manual processes quicker and easier for decades, and the next move for many businesses is to incorporate artificial intelligence (AI). The use of AI alongside automation can open up endless possibilities for business transformation, by combining the rapid task execution of automation with machine learning and data analysis of AI and enabling your systems to not only do for themselves, but to think for themselves as well. What is the difference between artificial intelligence and automation? These two areas go hand in hand but are distinctly different. It’s a fast-growing industry, and in 2020 a record $15bn of venture capital was invested into UK tech companies, according to a report from Tech Nation.

If your invoice processing is already automated, for example, you can develop AI to recognise patterns in invoices and payments and process them automatically. The system can learn to make decisions based on previous activity and account for differences such as invoice layouts or customer information, and also has the potential to make suggestions you might not have thought of based on previous activities or rules. Are there any risks to using AI? As with any technology, it can only be as good as the information used to build it, so if you are provided with poor input data it will not deliver the desired results. During the development of a new system, you will need a threshold of certainty to say ‘this is what we can trust’, and you will likely need some level of human intervention to check the data quality and to check the system performance.

As developers, we believe we also have a responsibility to use technology safely. The data we are given and the abilities we have put us in a trusted position, and as well as using technology for the intended purpose, we must also take all measures to ensure customer data is protected and used securely. There is an argument that sometimes a human may get an instinct or gut feeling about a decision, and that feeling can be right, whereas a machine can’t recognise those anomalies or follow an instinct. In this case, you can use automation in initial decision-making and then review the process while you build confidence in the decision-making process and analyse if the right data is going on or what needs to be adjusted. How can artificial intelligence be used for business processes? There are different types of AI, from machine learning right through to the development of robots that act and behave like humans, and this means that AI has potential applications for every industry. The beauty of it is that it can be designed in any way you choose to deliver time savings, greater accuracy in processes, and business improvements. Algorithms can already look at data such as buying patterns and make suggestions to businesses or customers based on their data, but with AI these suggestions can become more intelligent and consider external factors to predict changes in the market, such as seasonal fluctuations. The NHS sees around 1 million patients every 36 hours, which means it has a wealth of health data available and is an ideal setting for AI development. Successful Rugby Lunch raises almost £40,000 The Diverse Abilities Rugby Lunch, hosted at Hoburne Park in Christchurch and sponsored by Dixon Stewart, raised almost £40,000 for the disability charity. The fundraiser featured guest speakers Gavin Hastings, Scottish former Rugby Union player, and David ‘Flats’ Flatman, former prop for Bath and English Rugby Union player, and was compered by Ross Goode. Gavin Hastings said: “I was delighted to be able to support the Diverse Abilities Rugby Lunch and be part of an outstanding fundraising effort from all who attended. I think the atmosphere in the room was one which we have all missed over the last 18 months or so and the energy manifested itself into a real party atmosphere. Congratulations to all involved.” With a grand total of £36,443 made on the day, the 10 years of lunches has raised £268,443 to help provide vital care for children and adults with disabilities in the county. Fundraisers on the day included a

raffle, silent auction, live auction, and a game of the popular Knife, Fork and Spoon quiz. David Fuller, IT consultant at Avaloq UK, attended the event and commented: “The Rugby Lunch was a great chance to talk rugby, enjoy some great food and wine, and raise money for Diverse Abilities. I took my two sons Richard and Jack along to get the younger generation involved. “Gavin Hastings and David Flatman were both excellent speakers and in conversation. I hope that we can see them again soon. Everyone involved in organising and running this event did a great job. We were reminded of the great work that is done by Diverse Abilities in the community and how important these events are to raise funds. We will be there again next year and I recommend it to all rugby fans.”

Guests enjoyed a three-course meal provided by Hoburne Park, followed by a presentation by Gavin Hastings and a Question-and-Answer session with David Flatman. Guests were also able to purchase signed copies of Gavin Hastings’ new book ‘Legacy of The Lions’. Housing to the fore as Dorset and BCP local plans progress Following the creation of two new unitary councils in Dorset in April 2019, there has been a bit of a “lull” in terms of strategic planning. However things are changing. Dorset Council published its draft local plan for consultation between January and March this year. The response has been significant, so significant in fact that the Council hasn’t yet published all the responses on its website! Next month, BCP Council is to publish its “Issues and Options” local plan document, with a consultation period likely to run until Christmas. Both local plans are at an early stage, and both cover a wide range of planning issues from transport to town centres, countryside to community facilities. As usual however it is likely to be housing – how much and where will it go – which will be the most contentious issue in both plans. So, what can we expect – well, the position in Dorset is a little clearer given that their draft plan contains fairly detailed housing figures and locations. In BCP, we expect rather less detail, and also quite a push from the Council for a housing requirement below what the Government’s “standard method” calculates. Here’s a quick table with some headlines: DORSET
