OVERNMENT departments, residents and businesses owe the Msunduzi Municipality R1,8 billion. By end of July, the debt was around R1,5 billion. On the municipal debt pie chart, ordinary residents owe the municipality R975 million, businesses owe R364 million while government departments and other debtors owe the municipality R164 million and R138 million respectively. Surprisingly,thereportalsoshows that the municipality owes itself R27 million. In July the debt collection rate was 49%. By August, the debt was R1,7 billion. Municipal manager Mxolisi Nkosi

He said that the need for housing has driven some members of the community to erect informal housing structures in their back yards. Maritzburg Fever understands that in 1996, a memorandum of agreementfortheprovisionofproject management services for the development of a Glenwood area was signed between the Msunduzi Municipality and Built Environment Support Group (BESG).

BESG was initially commissioned by the municipality to facilitate the production of a development plan for the entire area and also to supervise the first three phases of the project. BESG previously responded that they stopped work in 2006 when the Msunduzi Municipality failed to budget for the continuation of their support work. The municipality also previously acknowledged that the Glenwood project is aimed at providing a range of housing types such RDP, rental and bonded houses. Nine years ago Wagner managed to collect 2000 affidavits from local people who were in need of housing. “I still have the affidavits and those peopleshouldbeamongtheoneswho must receive first preference for the RDPs. Again, no one should jump the queue,” he said.

THE Msunduzi Municipality is fast tracking investigations into the theft of its fuel, and also the alleged fraud relating to promises to place work seekers into permanent employment at the municipality. At the recent Executive Committee (Exco) meeting, the audit committee chairperson Sandile Mnguni said that the municipality is undertaking forensic investigations into these two matters. InJunethisyear,theseitemswerehighlighted by Msunduzi Mayor Chris Ndlela during the delivery of his state of the city address. “Themunicipality,likeanybigorganization, is faced with fraud, corruption, theft, gross irregularities and, since coming out of administration, a number of investigations have been undertaken and concluded. “Matters investigated ranged from fraud and corruption relating to supply chain management, promises to place work seekers into permanent employment, fuel theft, theft of cash, theft of material and equipment, over-

time, theft of time, theft of municipal vehicles, abuse and misuse of municipal vehicles,” said Ndlela during his state of the city address. The theft of fuel has been reported to have cost the municipality thousands of rands. “Disciplinary processes have been initiated against employees, others finalised and some are in different stages of appeal in the bargaining council and labour court. In instances where it has been established that there was a prima facie case of criminality that may have occurred, cases have been reported to the South African Police Services,” said Ndlela. It has also come to light that Msunduzi vehicles are being used for personal commitments and they have been spotted at shopping malls and schools. Last year’s annual report shows that there were 11 disciplinary measures taken by the municipality due to the misuse of council vehicles. Msunduzi Municipality spokesperson Thobeka Mafumbatha said that the issue of the misuse of council vehicles is being investigated by the municipality’s internal audit.

5 November 2014 for its operations. The good news is that this expansion will help increase local job opportunities and help grow the local economy. Alumicor applied for further purchase of some of the Camps Drift 6200m2 piece of land right next to its smelting plant. The Alumicor smelting plant supplies the Hulamin rolling mill with pure aluminum ingots. “We have received a request from Alumicor. We think that it has a potential to increase our economy and create more

jobs,” said municipal manager Mxolisi Nkosi. The deputy municipal manager for economic development, Dr Ray Ngcobo, said that further investigations need to be carried out on the market value of the land. “This is music to everybody’s ears. This is job creation. This is good news. This is a story to tell,” said Exco member Bill Lambert. He said that he was relieved that council has finally made a decision to sell the land six years after the initial

OUR South African waste pickers recently travelled to Barcelona in Spain to learn more about zero waste initiatives. The Kwazulu­Natal provincial coordinator, and member of the executive committee of South African Waste Pickers’ Association (Sawpa), Douglas Maphumulo, is one of the waste pickers who travelled to Barcelona. Waste pickers from Sasolburg, Vereeniging, Mafikeng and Pietermaritzburg spent a week in Spain to enrich their knowledge on green campaigns. Maphumulo has been a waste picker for years. He said that one of the challenges facing waste pickers is that government does not recognise them and that some of the zero waste programmes are only known to government officials. “We decided to come together as waste pickers so that we could figure out a way forward. The things

we recycle feed our families and help put our children through school. We do not believe that burying wealth is the wisest thing to do,” said Maphumulo. Maphumulo added that with the help of groundWork and various environmental NGOs, they are now aware of their rights as waste pickers. In Barcelona, Maphumulo said that he learnt more about compost initiatives and waste to energy projects. “The exposure has been an eye opener. If we can tackle waste to energy projects, there would not be a need for landfill sites. The government needs to recognize our existence because we have become experts in what we do. In future we want to be represented in parliamentary discussions,” said Maphumulo. Musa Chamane, who is the waste campaigner at groundWork, stated that the zero waste approach creates jobs and helps with climate change. “Sawpa and groundWork support a zero waste approach as it creates jobs, saves the government money and it combats climate change. Sawpa and groundWork believe that waste recycling’s ultimate goal needs to be zero waste and this cannot happen until everything, including organic waste, is composted. Sawpa is yet to implement projects focusing on this waste stream and this is a good opportunity for learning,” he stated.

Cansa launches new mobile clinic in KZN THE Cancer Association of South Africa (Cansa) in KwaZulu-Natal recently celebrated the launch of a new mobileclinic,generouslysponsoredby The South African Muslim Charitable Trust. The clinic is worth R460 000 and will be used to service rural and underprivileged communities throughout the province. Some of the services which will be provided to the communities, free of charge, include clinical breast

examinations, lifestyle risk assessments,PapSmearsandProstate Specific Antigen (PSA) blood tests whichtestforthepossibilityofprostate cancer in men. The clinic will also be used to educate communities about cancer and about lifestyle changes that can be made to reduce their cancer risk. Throughout the month of October, themobileclinictravelledtocommunities in and around the midlands to provide services. When problems

were detected, patients were referred for appropriate treatment. Throughout the process of diagnosis and treatment, they are supported by Cansa staff and volunteers. “We are grateful for partners such as The South African Muslim Charitable Trust. With help, it makes it easier for Cansa to continue their good work in the communities by offering screening to under-resourced areas,” said Bugs Pancha, chairperson of Cansa’s board of directors.

AST year, the Pietermaritzburg community helped raise R35 000 for the CHOC House in Pietermaritzburg. The house, in Muswell Hill, provides a home away from home for families with children receiving treatment for cancer at Grey’s Hospital’s Paediatric Oncology ward. This year, the Russell High Interact girls have adopted the CHOC Christmas House the Maritzburg College Art boys built last year and, along with the help of Ingrid Lens of Palette, they are going to give it a whole new look. The wooden advent house will have 12 drawers for each day leading up to Christmas, and Parklane Centre has come on board to fill each drawer with a surprise and to give the house and campaign a home-base at the centre.

The campaign is designed as a community countdown to Christmas with a lucky draw taking place on each of the 12 days of Christmas from 13 to 24 December. Lucky draw tickets are R10 each. Parklane Centre, Just Boutique and Minuteman Press have also sponsored the printingofa‘ColouryourwaytoChristmaswith CHOC’ advent calendar. The picture, done by a local artist, depicts the Christmas journey but also the journey towardshealingofachilddiagnosedwithchildhood cancer. This colouring calendar is suitable for children in Grade RR to Grade three and will be made available to 20 schools. (Part one of this article was featured in Maritzburg Fever Law Corner on 1 October 2014). A LANDOWNER is required to receive written notification once a land claim has been gazetted. The landowner is then given 60 days to indicate whether or not he or she is of the view that the claim is valid or whether the landowner objects to the claim. Although the Land Claims Commission conducts a validation process, very often it is up to the landowner to do research in order to make submissions to the Land Claims Commission on whether or not the landowner is of the view that the claim is valid and/or to set out facts which place the claim in dispute. The Restitution of Land Rights Act sets out the basis for a valid claim and the fol­ lowing factors must be present: 1.The claimants must have been deprived of rights in land after 1913. It is important to note that this right does not mean ownership but any right in land; 2.The dispossession must have been as result of racially motivated laws or practic­ es; 3.Those dispossessed of the right must not have received just and equitable com­ pensation at the time of the loss. It is often the case that before a landowner is in a position to comment on whether or not a claim is valid, such landowner requires information from the Land Claims Commission. It is often the case that a landowner was not the owner at the time when the dispossession took place and has no independent knowledge of whether or not the dispossession occurred and whether or not it was as a result of racially discriminatory laws or practices. A landowner is entitled to request cop­ ies of the claim form completed by the claimant and any documentation relied upon by the commission in validating the claim. As such, a landowner that becomes aware of a land claim should make use of an attorney who is au fait with land claim matters to ensure that the correct information is obtained and the correct submissions are made to the Land Claims Commission ­ whether the claim is valid or not. TheLand Claims Courthasveryspecific rules and procedures which are unlike those which govern other courts and, as such, it is vital that landowners appoint a legal team with experience in such matters. Ultimately, it is important to bear in mind that it is not the commission that determines validity. If there is a dispute with regard to validity it must ultimately be determinedbytheLand Claims Court, if the issues cannot be resolved on any other basis. Even if the landowner is of the view that the claim is valid or decides not to oppose the claim, the landowner would still benefit from legal advice to ensure that, in the IN STOCK NOW! event that the land is acquired for the claimant/s that the landowner does receive fair compensa­ E&OE tion.

Grace College valediction service Grace College held its valediction service in honour of the class of 2014 recently. Nibha Surajlal was awarded the dux of the school, amongst others, and is commended for her outstanding achieve­ ments. Head girl Brennah Coslett was the recipient of the headmaster’s award in recognition of living out the school’s motto “My Utmost for His Highest” in all aspects of her school life. As part of the design and technolo­ gy syllabus at Cordwalles Preparato­ ry School, the Grade seven boys were tasked with designing and building a go­kart to take part in the annual Grade seven go­kart race. After the boys were put through various racing formats, a wonderful morning was had by all as the rest of the school watched with excitement and anticipation for when they reach Grade seven. Jamie Reynolds from St John’s Diocesan School for Girls represented South Africa at the Fina Mastbank Swimming World Cup in China. Reynolds made the finals for the 50m and 100m backstroke and the 50m butterfly – which means she was one of the eight best swimmers at the event for those strokes. She also made first reserve for the 100m individual medley and the 100m and 50m freestyle events – which means her times for those events were the ninth fastest at the swimming world cup.

HEY say that every team does all in its power to knock a top outfit off its perch. Double champions KZN Inland know they are in for a battle in striving to retain their two trophies this season. In the KZN capital-based side’s favour is that they have played only two rounds of the 2014/15 season, while opponents have already racked up three and even four rounds of matches. So Inland’s prolonged build-up to the business of the season is giving captain Shane Burger’s squad time to ease into the fray. Reigning Cricket South Africa Provincial 50-Over Challenge and CSA Provincial T20 Challenge champions, the Inland lads, under wily coach Grant Morgan, have been training intensively for some time and this is sure to bear fruit as the season continues. Inland all-rounder Kyle Nipper and his team-mates are already showing impressive form. With the three competitions divided into pool A and pool B this time round, plus rather bewildering selective cross-pool matches thrown in, the format does not reflect the better pure league system where the 14 teams THE KZN Midlands is bracing itself for the biggest field the Midlands Ultra Triathlon has had since its inception in 2009. “Entries from all over Africa and the world have been flooding in since April this year and at this point, we have far exceeded our past race entries. The Midlands Ultra, one of Africa’s most popular triathlons which takes place on 30 November at the beautiful Midmar Dam, hasanentrycapof1000competitors,”said race director Damian Bradley from B­Active Sports.
