EDITORIAL
BUDGETS, ELECTIONS AND BETTER LIFE OUTCOMES It’s hard not to get all politically motivated at a time like this, but let’s just remember what we as an industry are really here to do.
F
irst there was the Federal Budget, then there’ll be a State Budget handed down on May 9, followed by a much anticipated Federal election on May 18. The atmosphere is politically charged for sure. While that might bore some people to tears, for others it means a few more weeks of nervous anticipation. So we’ve tried to present some balance in this issue of Master Plumber Western Australia, with a mix of content to appeal to all tastes across our broad cross-section of members and friends. But let’s face it - whatever the political flavour, as plumbers we have a job to do and that doesn’t change. That said, as an Association of and for employers in an industry that is tightly regulated, we can’t help pipe up when politics are at play. That means we’ve certainly got a bit to say – from our President’s Report on the recent Budget (page 8) to our national industry association’s focus for lobbying over the coming months regardless of who takes the reins after we go to the polls (page 10). But we’ve provided plenty of relevant non-political news and views too, ranging from a warning about liability insurance exclusions when it comes to working at heights (page 12), to a summary of recent updates to the Australian Standard AS3500 (page 14). In March, we took the opportunity not just to recognise and celebrate World Plumbing Day, but to use the occasion as the launch pad for a very special, world-first initiative.

Better Life Outcomes is aimed at delivering improved and sustainable plumbing solutions to remote communities around Australia, including a focus on flexible learning for community members. It’s a national initiative being driven by the MPGA and a host of other founding partners, and even had an international flavour with renowned Irish activist Sir Bob Geldof flying in to deliver the keynote address. Read about it and see the photos of the launch from page 16. There’s often a lot of negativity around the treatment of women in the construction industry, but one woman tells quite a different story (page 22). Legionella is an ongoing risk when it comes to water temperature, particularly in steamy shower environments, but there is a viable solution (page 23). We put the trusty LandCruiser 200 Series through its paces, not that it was any challenge for this old faithful. You can join us for the ride on page 28. There’s also our usual Business Essentials (page 24) and some new product info (page 26), while we cover off a couple of the many member benefits (page 30). PRESIDENT’S REPORT By Geoff Kelly
No surprises delivered in Federal Budget The Coalition’s recent Federal Budget did not deliver anything unexpected. And coming on the eve of a federal election, that is hardly surprising.
T
he first thing we’ve heard about continuously is that Australia is back in the black for the first time in 12 years. All that really means is that the Coalition has managed to save a bit more by spending a bit less, but most would agree that’s a decent and responsible example of financial management. The second is the promise of tax cuts ahead for low to mid-income earners. And the third is that there were no surprises as we head into a federal election. Of course, without a majority in the Senate to make the necessary legislation, and with latest polls tipped in Labor’s favour, most of it could be nothing but noise. But there are certain things that both sides are likely to implement that offer some hope. Aside from the cynical view that it’s all about vote grabbing – of course it is but that goes for all sides of politics in the lead-up to elections – the personal tax
cuts will certainly benefit younger people starting out in the workforce. Apprentices fall squarely within the bracket of those set to get at least a small boost. Labor is promising similar things for low to middle income earners and has said the moves would be fast-tracked if it takes office on May 18. The key difference between the parties is that the Coalition is offering to lower the top marginal tax rate for higher income earners, while Labor aims to increase it. Small and medium business get an immediate boost with the instant asset write-off extended to medium-sized businesses and the threshold increased from $25,000 to $30,000. That’s one Budget promise that definitely will deliver as it came into effect from 2 April 2019 and lasts until 30 June 2020. So if you’re planning any asset upgrades, there’s no need to wait. On a broader scale, there was some healthy allocations for infrastructure projects
around the nation and even WA Treasurer Ben Wyatt was applauding from the other side of the political fence, thanks to a fair chunk for WA road and rail allocations. WA was also promised a greater slice of the GST pie. But while it might be a larger percentage, the pie is smaller overall this year. In other words, all states will see a smaller dividend. That said, Mr Wyatt told media the favourable treatment was an indication that WA votes were vital. And with the leaders of both major parties announcing a pre-election debate in WA, it’s obvious they feel the same way. Although there’s a few weeks of fierce politicising ahead, it seems WA should fare well whatever the outcome. At the end of the day, the plumbing industry and your association will go on doing what we do well – delivering professional, sustainable, safe and healthy solutions to the people of WA. Because public health matters.

NATIONAL PUSH TARGETS ALL SIDES OF POLITICS By MURRAY THOMAS, CEO
Ahead of the federal election, Master Plumbers Australia has compiled five essential topics designed to deliver positive change for the industry and the public.
T
he MPA is made up of most of the statebased associations around the country and represents the industry when it comes to matters of national significance. Our New Zealand counterpart has also leant its support to the calls, given Australia and New Zealand utilise a shared system of product standards and certification. The five items, captured in the MPA’s Fighting for Positive Change booklet, are: 1. All plumbing products sold, imported into and used in Australia must hold WaterMark certification 2. Implement stronger national legislation

and defined processes to guarantee security of payment for construction industry contractors and sub-contractors 3. Introduce Continuing Professional Development and mandatory minimum four-year apprenticeships across the plumbing industry 4. Bring plumbing industry employment legislation into line with standard business practices 5. Ensure offsite constructed modules in the construction industry, commonly called pods, are certifies by a licensed plumber if they involve plumbing works
These were among eight items for attention in WA identified by the MPGA and highlighted in an article in the previous issue of Master Plumber Western Australia magazine. They have also been raised regularly by other state associations and, as the industry moves towards greater consistency nationally, will be the subject of lobbying by the MPA on all politicians in the lead up to the election and when the result is decided. Important advice on non-conforming liability insurance
P
lumbers and other trades are being advised to carefully read the fine print regarding Liability Insurance Cover exclusion clauses. There have been a number of reports from other states about some insurance providers adding clauses to insurance policies which exclude liability for work carried out above two stories or higher than 10 metres. Advice from some state-based regulators is that policies containing such exclusions will not meet the legislated requirements for insurance cover and may lead to plumbing licences not being renewed.
While Western Australia does not have such limitations regarding insurance at present, it is the subject of a current review and may become legislation in the future. Nevertheless, business owners are urged to check any policies carefully and talk to your insurer/broker to clarify that your policies are adequate. Be aware that exclusions are not necessarily shown on Certificates of Currency. You need to check the policy itself. Examples of exclusions seen in some cases include: “This Policy does not cover any liability arising out of or in any way connected with any work done or undertaken by or on behalf of the Insured on levels of any building greater than 2 storeys in height.
For the purpose of this exclusion a building greater than 2 storeys is one with two or more storeys above a ground floor not including any underground basement carparks.” “This policy will not extend any coverage to any Insured where any; 1. External work is performed above 10 metres from the ground. 2. NCC spells out changes to AS/ NZS3500:2018 series
T
he latest version of the National Construction Code (NCC) comes into effect from 1 May 2019 and bring into play the new Plumbing Code of Australia (PCA), which references the AS/ NZS3500:2018 series. The NCC updates are the first since 2015. Below are some of the key changes from the 2015 versions:
3500.1 • Backflow Prevention: Fire services backflow protection requirements reviewed to remove the option of using ‘single check non-testable’ devices and to clarify that containment protection is required • Plastic Pipes in Direct Sunlight: Amended and made consistent as appropriate with the relevant clauses in Parts 2 and 4 regarding plastic pipes and fittings installed in direct sunlight • Circulatory Heated Water: Revised to provide deemed-tosatisfy provisions for the design, installation and commissioning of circulatory heated water piping systems • Non-Drinking Water: Section 9 ‘Non-Drinking Water Services’ reviewed to address a number of issues

SIR BOB GELDOF FLIES IN TO LAUNCH VITAL PLUMBING INITIATIVE
World Plumbing Day was celebrated with international style – and the launch of a life-changing initiative – when activist, philanthropist and musician Sir Bob Geldof presented the keynote address at the MPGA’s Better Life Outcomes lunch in Perth recently.
T
he program is being driven by the Indigenous Plumbing & Sanitation Foundation, Master Plumbers & Gasfitters Association of WA, Master Plumbers Australia, Nirrumbuk Aboriginal Corporation, Plumbing Industry Climate Action Council, and the Plumbing & Pipe Trades Employees Union of Australia. In his typically irreverent style, Sir Bob began with a barrage of toilet humour before turning his attention to the serious and vital role that plumbing and sanitation had to play in delivering better health, economic and environmental outcomes globally. “Nearly every civilization since it sprang
16
MASTER PLUMBER | AUTUMN 2019
up has tried to do what you do, which is to create sanitation and healthy conditions for society to function within,” Sir Bob said. “And yet today, poor sanitation is the cause of more than 1,200 deaths of children under five per day. To put that in perspective, that’s more than AIDS, TB and malaria combined. “The lack of effective sanitation costs the world an estimated $223 billion every year – every dollar spent on sanitation provides at least $5 in economic return. “Now apply that to some of the remote communities here and even if you don’t measure the pure economic return in terms
of GDP but in terms of human value, it’s extreme.” Sir Bob, the driving force behind the global Live Aid movement, told the 300 attendees that as an industry, plumbers had the power to not only change lives in Australia but globally. “I put it to you that with the ingenuity in this room alone, with the organisational structure that you’ve got here, why aren’t the Aussies delivering inventions, reimaginings of what sanitation must be, if we are to stop the collapse of communities and cities? “The consequences of what you do on
a daily basis could radically alter how we manage not just the structures of a society but of the entire global environmental system.” The Better Life Outcomes program, which has former AFL star and indigenous advocate Michael Long as its ambassador, aims to deliver a sustainable, repeatable model of plumbing installation and maintenance to remote communities around the country. Master Plumbers and Gasfittters Association of WA CEO Murray Thomas said it was time for industry and government to take a collaborative approach to delivering long-term outcomes after numerous initiatives had failed over the years. “We need to get away from expensive band-aid measures currently in place to address issues affecting remote communities and investigate and implement improvements that are sustainable and selfmanageable,” Mr Thomas said. “That includes a new approach to

education and training, and in particular the development of more flexible and culturally appropriate apprenticeship programs. “These are services that must be permanently available within communities and can offer long-term employment opportunities for Aboriginal people.” The Better Life Outcomes program will commence with pilots being run at communities in WA’s Kimberley region and in regional Victoria. The pilots will include an audit of current infrastructure and availability of maintenance services, followed by a full needs analysis, cost modelling and training.

According to Linda Hamilton, there’s an incorrect perception that construction sites are intimidating places for women.

he co-director of Hi-Vis Women Australia and Managing Director of all-female building company Buildcraft WA says while the industry is male dominated, the trust, respect and mentoring she received from male role models in her climb through the ranks were brilliant. It is that experience that led her to launch Hi-Vis Women Australia, a social enterprise dedicated to empowering positive change and celebrating women in the building and construction industry.

“I wanted to let young women know that it’s a great industry to be involved in,” Linda said. “All my mentors were men and the higher I rose up the ranks the more I became the only woman in the room. “But there are perceptions that in many cases are untrue about the industry and its treatment of women, and we need to break down the barriers.” Linda says the industry being heavily male dominated is self-perpetuating and that if young women were provided with
more opportunities to explore the broadranging options, the gender imbalance could quickly be overcome. Hi-Vis Women was established to provide female mentors working within the industry to help young women understand the opportunities. “There are entry-level positions available across the full spectrum of the construction industry and paths to build interesting and rewarding careers,” Linda said. “But a lot of girls don’t have the knowledge or know that there are opportunities to explore the industry before making decisions about which way they want to go. “One of our objectives with Hi-Vis Women is to teach girls to be accountable and how to appropriately deal with situations that may make them feel uncomfortable. “We’ve found that the notion of bullying and intimidation is far less an issue for females than what people think and there’s a very protective, nurturing mentality among the younger generation for anyone who’s considered ‘part of my squad’.” One of the initiatives being implemented by Hi Vis Women is the All Female Build – a project to involve girls and women deemed to be at risk to gain experience in the building and construction industry. “A big part of it is exposing girls to all the facets involved in working in the sector including dealing with any issues,” Linda said. “Some girls have come from backgrounds where there might be a lot of conflict and a lack of support to help them develop necessary life skills. “It’s our job is to show them that there are ways to resolve conflict without burning bridges.” The initiative is being used as a case study, with support from Curtin University, with a view to developing a template than can be applied across other industries.

Tempering adds to legionella risk in showers
A
RECENT report by Flinders University found that 75 per cent of home bathrooms in Adelaide contained potentially deadly legionella bacteria.
It is the bacteria that can lead to Legionnaire’s Disease, an illness which affects the lungs and can be particularly dangerous for elderly people and those with weakened immune systems. According to media reports, the study found that the bacteria occurred where hot water systems were set to lower temperatures and if showers were not
used for extended periods. The report called for storage hot water systems to be set to a minimum 65C and for showers that were used less frequently to be run at least at weekly intervals to prevent the build-up of stagnant water in pipes. But according to Master Plumbers & Gasfitters Association CEO Murray Thomas, a lack of consistency in regulations between Australian States, as well as different specifications for various hot water system models, has left homeowners confused and plumbers
with their hands tied. “The Plumbing Code of Australia calls for storage hot water systems to be set at a minimum 60C, while a lot of instantaneous systems might be hardwired to a maximum of 50C,” Mr Thomas said. “Then there are standards that specify maximum outlet temperatures in facilities such as schools and aged-care homes, which are quite rightly enforced to prevent scalding. “In cases where water can be delivered to outlets at temperatures of 65C or higher, there is a significant scalding risk to users.” Mr Thomas said issues could occur depending on where the tempering valve was located. In many cases, even if the temperature at the hot water system could be set to 65C, water may still sit in pipework after the tempering valve and that did not eliminate the risk of legionella proliferating. Legionnaire’s Disease is most commonly contracted by inhaling steam or water vapour, hence enclosed shower recesses are regarded as a greater risk area. Rob Pond, founder and director of Therm-Oz Showers, said a point-ofuse thermostatic shower was a highly effective option. It was Mr Pond’s innovation and two years of persistence that saw thermostatic mixing valves being included in the Australian Watermark scope. “It is equally important to remove the risk of legionella bacteria and to prevent scalding, and a thermostatic shower valve achieves both by bypassing a tempering valve and allowing hot and cold water to be tempered at the outlet,” he said. “The hot water supplied to baths and wash basins should still pass via the tempering valve to ensure scalding dos not occur but the risk of inhaling legionella bacteria is much less than in showers.” Mr Pond said Therm-Oz thermostatic valves removed the risk of scalding as water was tempered at the outlet to a maximum temperature of 45C, while a safety function ensured it defaulted to 38C. This complies with AS/NZS3500.4:2018, which specifies tempering requirements for special uses such as early childhood centres and aged care facilities.

The Personal Property Securities Register: An essential trade tool By AARON MCDONALD, Principal
T
he Personal Property Securities Register (PPSR) is the national online register that provides information to the public about registered security interests in personal property. For the construction industry, the PPSR is a tool to protect interests in personal property and also to inform those concerned about existing registered interests. In the construction industry, it is common practice for expensive equipment such as tools, scaffolding and trailers to be left onsite. To ensure the safety of such items, many choose to register their interest through the PPSR. By doing so, you are protecting your interest in personal property should a business go into liquidation or your equipment not be returned. This registration makes you a secured creditor, and should be done immediately.You should also check the register for pre-existing interests.
A Real-Life Example of the Security afforded by the PPSR The New South Wales Supreme Court case of Maiden Civil (P&E) Pty Ltd v Queensland Excavation Services Pty Ltd [2013] illustrates how important it is to register your security interest on the PPSR. In 2010, Queensland Excavation Services purchased machinery using third party finance and then went on to lease it to Maiden Civil (P&E). However, they failed to register their interest on the PPSR before leasing it to Maiden. Two years later, Maiden obtained a loan from Fast Financial Solutions, which registered a security interest over the leased machinery. When Maiden subsequently went into liquidation, both QES and Fast Financial made a claim for the machinery. The PPSR was used to determine the preference of their claims. Since Fast Financial had perfected their security interest and QES had not, their interest was prioritised over QES’s, even though they owned the machinery. Furthermore, Fast Financial was able to claim the machinery as compensation for Maiden not repaying the loan.
Making a Smart Decision In the construction industry, it is always important to register your security interest, even if you don’t foresee any issues arising. It is important to note that registered security interests do expire.You should always be aware of the validity period and ensure you renew your security interest before it lapses or else you risk becoming an unsecured creditor.
Facebook fame folly Tradies chasing social media stardom could be posing liability risks.
T
he workplace would be pretty boring if you couldn’t have a laugh, but tradies chasing social media fame are putting job sites at risk and posing liability problems. There has been a spate of on-site larrikinism of late with safety being ignored in the pursuit of 15 minutes of fame. Last year, a brawl believed to have been filmed in Sydney’s Bankstown showed tradies on-site attacking each other with a heavy ladder. The vision went viral. Another video posted to a streaming website showed a tradie recording himself as he leant over and whacked his colleague in the head. Seconds later, the colleague fires at him with a nail gun – lodging a three-inch nail into his left arm. One Brisbane tradie has used construction site antics to garner a 120,000+ following on Facebook and over 600,000 views on YouTube. It seems becoming a social media sensation is a lure many can’t resist. But while such hijinks are often dismissed as just “having a bit of fun”, when it comes to construction site safety, it’s no laughing matter. According to Safe Work Australia, 33 Australian workers were killed in the construction industry in 2016, with current statistics indicating 35 workers are getting injured on building sites daily. If property is damaged or someone is injured, it becomes a question of liability. In some instances, it might also be a case of criminal culpability. Both employers and employees have obligations around worksite health and safety and all could be held accountable if something goes wrong. There have been no shortages of legal cases where a workplace prank has gone wrong and someone has been injured. Employers have a duty of care to provide their workers with a safe place and system of work, as well as adequate training and instruction. As they can be held liable for the acts of their workers. Employees, from senior managers to apprentices, also have a duty of care around worksite safety. And just because a worker doesn’t take part in a prank, doesn’t mean they’re off the hook if it goes pear-shaped. Establishing and enforcing strict WHS protocols, policies, procedures, standards and rules on-site and ensuring everyone is aware of them may help limit the risk of worksite practical jokes and horseplay happening. hen it comes to drain cleaning, the more power the better. When it comes to the perfect blend of on and off-road capability, SIMON SHEPHERDSON finds there’s nothing to compare to the much-loved Toyota LandCruiser 200 Series.
D
id you have grandparents, relatives or family friends with one of those big, comfy couches? The sort that as a kid, you could lay on, stretch out and still not touch both ends, with a strong chance you’d fall asleep because it felt so good? That’s perhaps the best way to describe Toyota’s LandCruiser 200 Series. Not that you should fall asleep at the wheel, but it’s

certainly an option if someone else drives and you get to stretch out in one of the passenger seats. It’s a big, heavy beast providing a very smooth ride. In fact, you could describe it as more of a glide even when you bounce over the odd curb or hit a speed bump a bit quicker than might otherwise be advisable. The 200 Series comes in GX, GXL,VX and Sahara variations, with diesel and petrol options (diesel only for the GX). The idea of a smooth ride on the road and off-road comfort used to be mutually exclusive. Admittedly Toyota overcame that issue a few years ago now, but it’s still worth an explanation. It’s in large part due to the Kinetic Dynamic Suspension System (KDSS), which started life as a feature of the Lexus but has found its way back into Toyota’s larger 4WD offerings. It comes standard on
the GXL petrol,VX and Sahara LandCruiser models and is optional in the GXL diesel). According to Toyota, the traditional issue of achieving both on and off-road comfort was partly due to the anti-roll bars that connect both sides of the vehicle to help maintain a horizontal position when cornering on the road, but that can place limits on an individual wheel’s range of vertical travel when negotiating uneven surfaces. KDSS is designed to react dynamically to forces being applied across the suspension, optimising chassis performance whether on or off-road. It achieves this by using an electrically controlled network of hydraulics to modulate or even disable the anti-roll bars. LandCruiser has developed a reputation as one of the best and for very good reason. I was behind the wheel of the GXL, powered by a 4.5L twin-turbo V8 diesel engine. It gave me the distinct sense I could go anywhere,
tow anything and still feel like I was on my grandmother’s couch. There’s a lot of empowerment when you’re looking across the tops of most other cars at the lights, knowing that a quick stab of your foot could leave most of them in your dust as the sleek but formidable beast powers away. It’s quiet and highly responsive to anything you do with your feet – a lot more so than other recent diesel-powered vehicles I’ve trialed. The only real giveaway that I was in the diesel rather than petrol model was that the twin turbo system kicks in between 2,000 and 3,000rpm, providing impressive acceleration for a car of this size. You know
navigate than many other 4WD options – and the LandCruiser is certainly one of the bulkier options available. There are front and rear parking sensors on versions from the GLX up, while the VX and Sahara offer Toyota’s Multi-Terrain Monitor that uses four cameras to help give you a close look at the conditions right around the vehicle. as well as some fairly innovative parking assist cameras Toyota indicates that all diesel options offer mileage of 9.5L/100km which is pretty good for a big 4WD. Admittedly, the test model was showing 12.5L/100km on the trip computer, which can probably be put down to previous test drivers over its
“King off the road” moniker. There are eight seats in both the diesel and petrol GXL variants, as well as the petrol options of the VX and Sahara, (five seats for the GX and seven in the VX and Sahara diesels). Even the rear row of seats has enough width for three adults if you have a car full. There’s plenty of the typical Toyota safety measures in place – front and side airbags (although a few placement variations depending on the model). There’s also Trailer Sway Control so if you are lucky enough to have access to one of those big boats you know you’ll have an extra level of protection when you hit the open road.

you could pull out to overtake and have plenty of acceleration in the bank if needed. Toyota has added an additional 5kW of power, taking the diesel to 200kW, and the torque remains at an impressive 650Nm. Despite the turbo kick, there’s very smooth performance right through the gears thanks to the 6-speed Electronically Controlled Automatic Transmission (ECT). I had the distinct impression I could hook up a very large boat on a heavy duty trailer and head off to a remote location for a week’s fishing and four-wheel-driving. But no one wanted to lend me their boat and insurance restrictions meant I had to stick to sealed metropolitan roads. Still, it was lots of fun. Some might suggest it’s a bit hard to maneuver into tight spaces around the city and if you were accustomed to driving a hatchback that may be the case. But I found it no harder to
4,500km life liking that kick of the turbo as much as I did. From a styling point of view, not a lot has changed since the 200 Series hit the market in 2008. While it offers plenty of creature comforts and that distinct LandCruiser appeal, particularly in the top-end Sahara, it was never meant to be a slick-looking head turner. While you will pay a fairly hefty price even for the base GX option, you know you’ll be getting the typical Toyota quality, reliability and performance. And the tugboat power if you need to pull anything up to a braked capacity of 3,500kg. It’s nicely trimmed on the outside for sure but not in a way that would deter most people from venturing off-road. And that’s a good thing because even without having had that opportunity, I was well aware it would certainly live up to its MASTER PLUMBER | AUTUMN 2019

DRAWING A LINE IN THE SAND JUST THE OTHER day, someone asked me what was on the cards for 2019. I was a bit taken aback. After all, it was April already. So I answered very vaguely. But it got me thinking – is there a date at which it is no longer appropriate to ask such things? I’ve always been a staunch believer that there are definite time limits on daterelated greetings. Happy New Year is fine up until Australia Day – at a stretch it can extend to the first work day in February if someone’s been away. Christmas wishes are strictly limited to December as far as I’m concerned. And only up until December 28th because then you move into the Happy New Year territory. But is there a line in the sand that you
should stop asking people vaguer things like “What are your plans this year?” Maybe I have a subconscious fear of admitting I didn’t set any concrete New Year’s resolutions. And while I might have a heap of bucket list items I’d love to tick off, I’m not sure if they’ll happen this year or somewhere in the dim distant future. Of course, there’s plenty on the agenda work wise. But some of it is up in the air given there’s a federal election looming and the outcome could dictate priorities somewhat. So I guess the answer is that for now, my plan is to keep doing what I do – contacting existing members, visiting those I can as often as possible, and promoting the advantages of membership of the Master Plumbers & Gasfitters Association to newcomers.
