Your lender will explain anything you need to know, but you will start the process more comfortably if you have a few facts. There are a lot of scoring methods and systems, but lenders in Maui tend to use just the scores attached to the credit reports from the three major credit bureaus. With these, for each person, the score is a number up to 850. If your credit score is under 620, it may not be possible to get a conventional mortgage, and the lower the score, the higher the interest rate on all your new or refinanced debt is likely to be. If your score is low, you may want to look into things you can do to improve it before applying for a mortgage,

That vision became reality last month when FABMAC Homes Inc. introduced its latest model at 221 S. Wakea Ave., featuring 100-percent off-grid electrical power. FABMAC, a Kahului-based company that installs codecompliant factory-built homes, has been offering an array of high-quality, energy-efficient, affordable houses on Maui since 2009. Its newest Lokelani model features a residential solar system that Carey and Hawaiian Power and Light, which has locations in Honolulu and Kahului, are calling revolutionary. HP&L’s Predictable Power off-grid electricity system combines roof-mounted photovoltaic panels with an ultrahigh efficiency inverter and state-of the art battery storage. As a result, 100 percent of the home’s power needs are met — 24 hours a day, all year long, according to HP&L, which specializes in renewable energy and related products. Predictable Power kits can be used for off-grid or grid-tied net metering systems. “By adding the Predictable Power system from HP&L, we reach a new level in ongoing affordable accommodations,” Carey said. “With HP&L’s off-grid Predictable Power system, FABMAC owners can achieve complete energy independence — and never receive an electric bill.” FABMAC’s energy-efficient homes are equally impressive in structural integrity and aesthetic. The Kahului model home boasts nearly 2,000 square feet and is complete with carpet and vinyl flooring, a covered porch, steel and concrete foundation systems, plantation blinds and Cornice boxes, wood window sills and more. The house offers a beautiful glimpse into the host of possibilities with FABMAC’s 22 models. Create a house package to include different floor plans, sliding glass doors, extra decks and other customizations: “There are so many options that we’re bound to find something that will work for you,” Carey said. “I haven’t built one that has looked exactly like the floor

xpect to hear a lot about the need for affordable housing in the upcoming election. That’s because the Maui housing market has heated up again. An upswing is great if you are selling a home, but it can be a serious problem if you need to rent on Maui. Especially if you need to rent at an affordable rate. least three years preceding appointment. By statute, at least four members must be licensed real estate brokers who have been in the real estate business in Hawaii for three years immediately preceding appointment. Two commissioners must be public members. The statute further provides that four commissioners must be from the City and County of Honolulu, and one commissioner each from the counties of Kauai, Maui and Hawaii. Commissioners are appointed for a four-year term. The appointment to a commission position is an uncompen-
sated public service. REC is responsible for the licensure, education and discipline of real estate agents; registration of prelicense schools, continuing education providers, condominium projects, condominium associations, condominium managing agents and condominium hotel operators; and certification of prelicense and continuing education courses and prelicense instructors. There are currently 17, 633 real estate licensees in Hawaii. Of those licensees, 12,363 have an active real estate license, while 5,270 are
inactive. A breakdown by license type shows that there are 3,745 brokers; 11,357 salespeople; 1,566 corporations, partnerships, LLCs and LLPs; and 965 sole proprietors. There are roughly 1,670 condominium association registrations and 27 condominium hotel operator registrations for the entire state. Hawaii has the largest percentage of condominium dwellers in the U.S. in relation to its population; it’s also the first state to create condominium-specific laws. REC is also authorized to grant licenses to real estate brokers and salesper-
sons; make specific rules to regulate the professional conduct of brokers and salespersons; inspect client trust accounts; suspend or revoke licenses; issue certificates of registration to prelicense schools and continuing education providers; certify prelicense instructors and continuing education courses; fine licensees for violations of the license laws and rules; and register condominium hotel operators and condominium managing agents. Sellers: Some terms need attention with a purchase contract While real estate contracts are not covered by Hawaii’s Plain Language Law for contracts, the standard contract approved for use by the Realtors Association of Maui and higher real estate regulating bodies intends to be clear and unambiguous. Nonetheless, some terms, although clear in their basic meaning, may need special attention when they are seen in a purchase contract. ■ CLOSING DATE. Be sure the date the buyer wants to take title is reasonable for you. It may not be negotiable after the contract is signed.
■ DATE OF POSSESSION. Be sure the date the buyer actually wants to move in is reasonable for you. Again, this will be a fixed date when both parties have signed the contract. ■ EARNEST MONEY. This is a deposit that the buyer will lose if he or she backs out of the deal, so you want to see a larger amount of
earnest money. A large deposit is usually a good indication of a sincere buyer.
■ FIXTURES AND PERSONAL PROPERTY. You may have a definite idea of what “fixtures” and “personal property” mean, but in terms of contract language, the things included are the things listed. Be sure the items the buyer lists as things expected to remain with the property are all things you are willing to leave when you move.

But good intentions could not overcome the council’s serious inability to understand what makes economic sense for developers or to read the economy. The measure required residential developers to accommodate a welldefined class of “workforce” local residents in all of their projects. It ambitiously required that developers set aside 50 percent of their homes at prices based on the buyer’s income instead of what it cost to build the homes. That, in effect, means that the other 50 percent of the project would have to subsidy those lower prices. It offered no incentives to the developers. The measure’s timing could not have been worse. It was approved in late 2006, over the veto of Mayor Alan Arakawa, and demonstrated the council’s complete inability to read the economic conditions then at work. The bottom had already started to fall out of the national economy, and there would be few proposals for new housing starts in the coming years, let alone projects with the capacity to meet a 50-percent inclusionary housing requirement. In the years following its enactment, visiting economists would repeatedly point to this law as the reason no new homes were being built on Maui. The County’s Workforce Housing Ordinance is
credited with the creation of a total of three Workforce Housing units since its inception. Despite it being clearly dysfunctional, it took the County Council seven years to officially recognize that the measure had become more of a hindrance to affordable housing development than a help. The Council’s Housing Committee under Chair Stacy Crivello has spent much of the last year untangling the wreckage and trying to build a workable law out of the existing ordinance. About the same time the Workforce Housing Ordinance was being passed, a local community group got creative. Using an effective Vermont community land trust program as a model, this coalition of Realtors, nonprofit housing advocates and ordinary citizens created Na Hale O Maui Community Land Trust. The concept was a response to the problem of affordable homes only being “affordable” to their first generation of buyers. Na Hale is aimed at making them affordable forever. Often government would stretch to build cheaper homes that local residents could afford, often with 10-year buyback requirements. Buybacks are meant to keep qualified buyers of affordable homes from “flipping” them right after they take title. If they do have to
sell before the 10-year period was up, then they would be required to offer the home, based on formula, to the County. The problem was, there was no guarantee that the County would actually exercise its option. And after 10 years, all of the homes could be sold at straight market rates, which means their values would jump above affordable values. The land trust model calls for homes that the community creates as affordable to remain affordable forever. The land trust — in this case Na Hale O Maui — would own the land and lease it to the homeowner. The homeowner could only sell the property back to the trust at a set rate that would guaranty the homes would always be “affordable.” The owner would be able to receive a percentage of what the home would actually be worth on the open market. The original idea was for Na Hale O Maui to operate as the manager of the affordable side of the Workforce Housing formula. But then the economy tanked, and the Workforce Housing program did not produce homes to be managed. So Na Hale shifted to Plan B. Using Federal and County Neighborhood Stabilization funds, it jumped into the foreclosure fray of 2008-12 and started buying up foreclosed homes, fixed them up and bought down their financing so the prequalified
families Na Hale sold them to could actually afford them. Those prices are about $300,000. Na Hale now has more than 30 of those former foreclosed homes scattered around the island, occupied by working Maui families. If one of those homes gets sold, its new owner will also pay about $300,000 for it. They remain affordable. Now that the economy is heating up again, Na Hale is looking to go back to Plan A and start working with developers. Another positive step Maui County took in the last housing boom was to set aside 2 percent of the County’s real property tax income to fund affordable housing efforts. This was the source for the County’s contribution to Na Hale’s Plan B foreclosure efforts. The fund has also been used by other nonprofits to provide homes on the lower end of the housing spectrum. The County itself is planning to use the lion’s share of this now multimillion dollar fund to create a 64-unit workforce rental housing project in Lower Kula. The creation of this fund shows a recognition that the shortage of workforce housing is something that Maui County will always be faced with. Unfortunately, when the Affordable Housing Fund was established in the County Charter, a sunset date was attached to its money source. Unless the charter is revised
in this year’s election, the mandate for the County to contribute 2 percent of its real property tax income to this fund will go away. The fund itself will continue to exist and the County Council will still have the ability to appropriate to the Affordable Housing Fund. But those contributions will no longer be fixed. When the political angst about housing wanes, the expectation is those funds will go elsewhere and the fund will eventually disappear. Without having a go-to housing fund, the County will no longer have the ability to respond to the continuous housing shortfall. The effort to get the mandatory contribution to the Affordable Housing reinstated in the Charter is already underway. Realtors, housing advocates and the County Administration are on the record for amending the Charter to protect the continuous funding source. Maui’s housing shortage will continue as long as our island’s economy is robust and people want to come to Maui to live and work.
