October is here with the 82nd edition of MBE Business Magazine. Like Labour Day, all of Canada celebrates Thanksgiving day, which falls on Monday, October 10th. Thanksgiving Day is a statutory holiday except in the Provinces of New Brunswick, Nova Scotia and Prince Edward Island.
Canadians celebrate Thanksgiving on the second Monday of October when the Canadian harvest is complete.
You may wonder why Canadian Thanksgiving is at a different time than the United States. You see, it comes on the second Monday of the month, which is the same as Columbus Day in the U.S. Plus, Canada is geographically situated further north, and the brief window of the harvest comes earlier, so they observe it according to the natural seasonal shift.
Canadians have been celebrating Thanksgiving as an official annual holiday since 1879. But until 1957, the date was not fixed and moved between October and November. Since the government officially proclaimed the second Monday of October as Thanksgiving Day, it has been a designated statutory holiday across the country except in the provinces mentioned above.
The mayhem that often ensues on Black Friday (the day after Thanksgiving) is legendary in the United States. Worldwide shoppers head straight from their Thanksgiving celebrations to line up for sales at the mall before it opens.
Although the holiday landing on a Monday does mean that it’s a long weekend for many people, shopping isn’t associated with it, and many stores are closed or hold reduced hours throughout the weekend—especially on Sunday and Thanksgiving Monday.

Doing business & getting success as an entrepreneur is something that is not possible unless you understand what it takes to do business. In the 25 years of my experience as a businessman I have tried to ascertain what success really is & what the formula for success is. Hence, if there is any in the business world that makes an accomplished business man into being an entrepreneur with rich experience and a business empire. The book of my life, i.e. the Autobiography is all about this. How can you make money without investing money? Firstly, you don't need money for the sake of making money. The vital elements you need here includes your intelligence (rationale) thinking, your dedication and finally your focus. These are the key attributes that you would need for sure for the sake of being a successful businessman or an entrepreneur. One last thing you need is mental stability, which is indeed one of the most important of all. If you have all these elements in you, you have the capacity to develop them with time. Obviously, you shall be able to do business with success & for sake of sustainability.
Intelligence is something that is your unique business intelligence. You can sell vegetables and make money. Just like I sold pillows to make money in my struggling days as a businessman. I learned from little things that kept on changing my attitude as a businessman. Your thinking obviously matters for your long term goals as a businessman. The dedication is something which acts like oxygen in your struggle to be a business icon or an entrepreneur. Finally, your focus shall help you in getting to your vision.
IDENTIFY YOUR STRENGTHS:
For some people it’s hard to identify what they need to do? That is, which area of business they have to get in or where they need to invest if they have money. Once you have decided that you can do something for the sake of making money, just start doing it.
The first and the most primary thing is that you identify your key strengths. Your drive, your passion and what things you can do as a businessman. There are hindrances in the business world that comes every day. Someone who hurts you or in other words someone who gets hurt is the one who learns to walk. As soon as you identify your strengths, it’s important that you don’t look behind. Once you have started something, make sure you finish it with the right attitude and the right vision. That will be the start of your walk towards success and you might even start to run when you know the secrets. Just believe in yourself and keep your confidence with you which is something that has helped in identifying your goals and strengths.
SUCCESS COMES AFTER FAILURE:
For many people failure is a fear. However, for the people with the right attitude it’s just another twist in the tail. In fact, success comes after failure or a series of failures. The objective should not be to turn your back and keep striving hard and keep trying, until you achieve success. In my early days, I was selling lottery tickets while I started working and I enjoyed that as well. It’s the attitude that you must never give up, i.e. if you have started you must end.

Just like I came across some challenges during my journey, its 100% that your journey to find yourself a place in the business world will have challenges. Everyone loves to build a diamond castle in their dreams. However, not everybody has the hard work, the passion and the commitment to accomplish it.
The challenges of your journey are certain to come whatever you do. However, you should finish something you started, before experimenting on a different thing.
While taking examples of famous & rich entrepreneurs like Warren Buffett, the King of Wall Street, or taking the example of Bill Gates from Microsoft or Apple. We dig deep into their acquisitions, their business journey and their takeovers. However, we tend to ignore their business challenges and what they have come across all throughout their lives while becoming business magnates.
It’s my humble advice to my friends & people who want to learn from my experience - you must think positively and stay
with positive people, especially if you want to attain your business objectives. You must enjoy your moments with good people and with those who are your well-wishers. They are the ones who will open new doors for you and align your thinking in a positive direction. Don’t pollute your mind amongst the negative people, who are there to negate you or demotivate you. They are the naysayers and their attitude is not good for your focus and approach. No work is big or small, from where you can start. Just start it from that point and let it be your starting point. Your positive starting point can be the start of your new life, ironically in memory of positive thinking people and in the circle of good people. Finally, the factor of dedication can’t be ignored which is a huge factor and is a massive source of your positive energy. It is not only a source of your energy, it’s a huge source of your hard work & motivation.

The interest rates that the Bank of Canada has increased is 75 cents more and as a result the buyers market has become attractive in this current situation for the investors & for future investments.
This has been our prediction in the past and looking at the scenarios and movements of the Canadian market. The past has been a reflection on the upcoming trends and the buyer's market behaviours has similarly been dependent with regards to the past events in the real estate sector in Canada.

After a long period of abnormality and unpredictability in the real estate market, the investors must invest proactively & positively in the market. This is obviously a positive market situation & ideal for the investors in terms of their investments. It is also time for investors to make sufficient growth, if they are looking got good profits in the Canadian real estate market. This is indeed the best time for this thing to happen.

are continuously saying that for the time being the interest rate is rising, however within the period of a year to a year and a half, there are chances that the market will be even better than what it has been at this point of time.

There is a massive role that needs to be determined and understood with regards to the role of management in managing people & managing change. Yes, we are dealing with people for the sake of managing things more authoritatively. This is something that relates to authority & also relates to being authoritative. The word ‘Governance’ here is a vital word for the sake of prospering with the desired eagerness and keenness.
With regards to the role of management or the correct ways in which things needs to be managed? It surely is about people management as the learning outcomes are achievable via managing people the correct way. Yes, we are dealing with professional & mature individuals that are individuals of change in a change management model. According to change management theories, the change is always initiated from top to bottom if the change needs to be powerful in the ranks.
Why being proactive counts in people management is simply to be aware of
the challenges in people management, however one must also stay abreast and alarmed of certain volatile situations that can arise instantly. Managing people via strong leadership makes things easy for those subordinates who are looking to grow & groom themselves for success.

Managing change is indeed a necessity in a successful environment. Why is this true? Basically, if you are unable to manage change, obviously, you are unable to monitor change for success. Apart from just monitoring the change, it’s important to highlight key change agents that will act smartly during the change process.
Change agents not only are ambassadors for change, but they surely are part of the real change. However, real change is always a constant thing & why real change happens is to have a deeper understanding of change management.
Change For Success- ‘How That Happens’?
Change for success needs to be monitored for a certain time period. If the change is good enough, it must yield positive results. On that contrary, if the change is ‘not for success’, it must give trouble in the beginning & thus create a warning signal for the change operators.

Making a transparent & highly aspiring feedback system is yet another role of leadership and management that helps in managing change. It can even be termed as innovation in people management and this innovation is not the end, but the start in dynamic change management strategies.
Executing a consistent, transparent & innovative feedback system with the employees, customers, clients & all other stakeholders involved obviously means pure success in future.

What is the penalty for breaking a
saving for even longer.
However, it is not uncommon for homeowners to realize that their mortgage contract is not working for them, and they need a change while still in the middle of their term or amortization period. Being stuck in a contract that isn't working can be uncomfortable at best and disastrous at worst.
Luckily, though your mortgage contract is legally binding, there is a way out provided by your lender. While this can be helpful for homeowners who need to get out of a mortgage contract, banks are not going simply allow you to break your mortgage contract without any penalty.
When you break your existing mortgage contract, there will often be a penalty, the severity of which will depend on a few factors. This penalty allows homeowners to exit their contracts while allowing banks to still collect the money they were planning on receiving.
Deciding to break your mortgage contract can be a huge decision and one that you should not take lightly. In this
What does it mean to break your mortgage?
When you agree to a mortgage contract, you agree to continue to pay a certain amount over a set period of timeyour amortization period - divided into smaller terms. The period of time is important, as it allows the bank to determine how much they can profit from lending to you.
When you break your mortgage, you end the contract early and are allowed to repay your mortgage or look for financing elsewhere. In order to make up for the lost profit, the bank will agree to end the contract as long as they are paid a fee determined by the value of your interest.
How early can you break your mortgage contract?
As a mortgage borrower, you will need to renew your current mortgage at the end of each term. When you do so, your current mortgage contract ends, and a new one takes its place. Lenders often offer a few months grace period to renew your contract early. This is not considered breaking a

mortgagee contract and will not incur any penalties as a result.
Breaking your contract early occurs when you violate any of the terms of the loan outside of this renewal period or in a way that is not permitted. This can occur at any time in your mortgage.
Though there is no limit on when you can break your contract, if you do so intentionally, you should carefully consider the timing of this decision. The time frame in which you break your mortgage contract will significantly affect how much you end up paying in penalties, which we will explore later on.
Open vs. closed mortgages
It is important to note that the considerations about when to break your mortgage generally only apply to closed mortgages. In a closed mortgage, you agree to a fixed term and cannot pay back your mortgage early without penalty. In an open mortgage, you can pay back your mortgage as much as you want as soon as you want.
The difference between the two comes down to cost. When you end your mortgage early, the bank misses out on potentially years of interest payments. Open mortgages generally have much higher interest rates to make up for less certain profits.
For this reason, closed mortgages are the most popular option for a large majority of homeowners. Buyers will usually only enter into an open mortgage if they have realistic plans
to pay back their mortgage early and are willing to cover the increased costs.
What happens when you break your mortgage contract early?
A few things can happen when you break your mortgage contract early.
The first would be a mortgage default due to a missed payment. Since you agreed to pay on time every month, missing a payment is a violation of your mortgage contract. In this case, it is usually an accident or an unavoidable circumstance for a homeowner who otherwise wants to continue their mortgage.
You will need to work with your bank to remedy the situation, including outcomes like a penalty fee and increased future payments to compensate for the missed value. Missing a mortgage payment is a horrible situation because it can damage your credit score or result in the loss of your home. If you suspect you may miss a mortgage payment, you should talk to your lender as soon as possible.
The other time homeowners may choose to end their mortgage early is by paying it off either with savings or through a refinance. In this case, you have broken the mortgage contract, but the fact that you have also paid it off makes it a lot more welcome by banks.
The bank has been paid back in full for what it borrowed, but they have also lost some potential revenue in the form of interest. In this case, your bank will usually charge you a

penalty fee, the value of which will be based on your mortgage terms and interest rate. As long as you pay this penalty, there will be little consequences or damage to your personal financial health.
How are penalties calculated?
When you decide to break your mortgage early, there are a few ways your bank will choose to calculate your penalty. Generally, this calculation will be outlined somewhere in your initial mortgage agreement.
When it comes to breaking your mortgage, a fixed rate mortgage and a variable rate mortgage will have their penalties calculated differently. In many cases, the variable rate mortgage will be the cheaper of the two to break, though this will depend on current interest rates.
Breaking a variable rate mortgage
The simplest calculation is used for variable rate mortgages. If you break a variable rate mortgage early, your penalty will be equal to 3 months of interest at either your current rate or at the lender's prime rate, depending on the lender.
For example, if you had a variable rate mortgage at 4% interest with $200,000 remaining in your mortgage balance, your penalty would be calculated as follows: • 200,000 × 4% × (3/12) = $2000 It would cost you $2000 to break this mortgage.
Breaking a fixed rate mortgage
With a fixed-rate mortgage, things get a bit more complicated. When you opt to break a fixed rate mortgage contract early,
you will pay either three months of interest or the value of what is called the Interest Rate Differential (IRD), whichever is higher. For the three-month calculation, it will be essentially the same as above. The IRD, however, takes a bit more explanation.
An Interest Rate Differential represents the difference between the interest you would pay your lender calculated at two different rates. The first of these rates is the rate, excluding any discounts that was active on the day you signed your mortgage. The second rate is the posted rate for the length of time closest to the amount of time left on your mortgage. So, for example, if you were two years into a five-year term (thus had three years left), your bank would calculate your IRD using your current rate and their three-year mortgage rate.
Once the bank has determined these two mortgage rates, they will find the difference between the two and use this rate to calculate a hypothetical interest amount for the remainder of your term.
An example
Let's look at an example to help make this clear. Like before, you have a remaining mortgage of $200,000 with 3 years left on the term. When you signed your mortgage, the most current posted rate for a fixed rate mortgage was 5.5%. Your bank's current posted three-year interest rate is currently 4.5%.
The difference between these two mortgage rates is equal to (0.055 - 0.045) or about 1%. This rate equals out to about 0.00083% per month. Multiplied over 36 months, you get 3%, then this is finally multiplied by your remaining principal to reach the final payment amount of about $6000.
If you instead calculated three months of interest at your current rate, you would get $2250, meaning you would pay the higher IRD penalty.
Note that these figures do not represent a real case but rather a hypothetical demonstrating how quickly your mortgage penalties can stack up. In addition, the IRD is a bit of a cumbersome figure to work out, and you may make a mathematical error along the way. When considering the penalties of breaking your mortgage, you should always speak to your lender or a mortgage broker who will be able to calculate the most accurate penalty for your circumstance. This will be crucial for determining the feasibility of breaking your contract.

Why would someone break their mortgage?
So now that you understand the potential costs of breaking your mortgage, you might be wondering why someone would go this route. If someone is willing to pay thousands of dollars to break their contract, the alternative must offer them even greater savings. Ideally, this is true, but it is also why you must carefully consider the outcomes before breaking your mortgage contract.
Refinancing
One common reason to break a mortgage contract is to refinance the mortgage. Beyond offering you the ability to change your mortgage contract on nearly every level, a refinance can allow you to draw a significant amount of your home's equity out. This large equity payment may very well make up for the penalty you will incur, though this will depend on the size of your penalty and the amount of equity available in your home. On the other hand, if the penalty is too great, you may want to consider using something like a HELOC to access equity without breaking your mortgage contract.
Looking for a better rate
You may also be choosing to leave your mortgage to get a better rate elsewhere. This will only make sense if the savings you make from switching are greater than the amount you will need to pay for a penalty. Once again, you should consult a professional who can run these numbers for you, as interest calculations can get complicated. In this case, you may also have the option of waiting until the end of your term to end your mortgage without penalty, which might be the more financially sound option overall.
Buying a new home
Another reason a homeowner may break their mortgage early is if they are moving to a new home either by choice or due to a change in personal circumstances. In this case, it may come in handy if you can port your mortgage to avoid penalties, though this may not be an option in all cases. If you really must sell your home, you will be forced to pay the fine, so you should try and be aware of how much you will need to pay to account for this in your search for a new home.
Options to avoid early prepayment penalties

How much is your privacy worth?
According to our venerable Canadian icon Tim Hortons, the answer is a coffee and a doughnut.
This is the company’s provisional settlement to a series of class action lawsuits after it was discovered that the Tim Horton’s app was gathering data beyond reasonable expectation, tracking users’ location even while not using the app. In an announcement, the company said it would provide a hot beverage and a baked good, totaling about $9.00 – despite that being a very odd, generous interpretation of the price of a double-double at Tims.
It is an ironic twist. In June of this year, a consulting company listed Tim Hortons as the country’s most trusted
company must now work to re-earn. As the company itself notes, the allegations surrounding the invasion of privacy were not proven in a court of law, and in a classic corporate-speak, Tim Hortons says the settlement is not an admission of any wrongdoing.
But looked at another way: Tims clearly messed up. And beyond the mistakes made by our national peddler of coffee, the episode is a reminder that, though Canada has established rules for privacy breaches, things are less clear when it comes to more explicit wrongdoing –and that is a situation that cannot stand.
The whole sorry episode stems from a 2020 National Post article by

As a result of the article and justified outrage, the Office of the Privacy Commissioner of Canada – a federal agency meant to protect privacy rights – conducted an investigation which concluded that, in its view, “Tim Hortons did not collect and use the granular location data in question for an appropriate purpose in the circumstances” and that the invasion “represented a loss of users’ privacy that was not proportional to potential benefits Tim Hortons may have hoped to gain.”
To be clear, the commissioner also stated that “Tim Hortons’ actual use

Canada has for some time had rules around what a company’s obligations are when a privacy breach occurs, such as when data is acquired through illicit means. The Personal Information Protection and Electronic Documents Act or PIPEDA outlines what a company must do to inform customer’s of both a breach and potential harm.
But for now, companies do not have similar regulation around their own invasions of privacy. Alas, those laws have been held up by the quite legitimate debate over new legislation regulating the internet called the Online Streaming Act, and privacy rules are now proposed in Bill C-27.
As with all legislation, debate and criticism is necessary. But bills designed to protect privacy have a funny habit of getting watered down after corporate lobbying and other private interests have their say.
What is clear is that Canadian companies and international companies operating here not only need a clear set of rules over what data they can collect and under what circumstances, but also what happens to them when they in fact break those rules.
That Tim Hortons can settle an investigation with an agency of the federal government and admit no wrongdoing – all the
to rounding errors for companies whose market caps are in the hundreds of billions.
Secondly, and perhaps more importantly, a lack of a clear legal framework for the gathering of data, including punishments for offences to act as genuine deterrents, signals that
Canada is not serious about privacy. That must change.
In her forthcoming book “The Fight for Privacy: Protecting Dignity, Identity, and Love in the digital age,” author and professor Danielle Keats Citron argues that the import of privacy is not merely abstract. It is, rather tied to our most basic sense of self, and also what enables us to form intimate connections with others.
That is ultimately what is at stake – and it is not something that can simply be bought off with, of all things, a double double and a honey glazed doughnut.

A return to office showdown is unfolding in Canada and pitting some bosses and workers against each other as the back to school season brings with it a renewed push to get employees back into office buildings. It’s a battle experts say could end a years-long experiment in flexible remote work – or spark a sweeping worker revolt.
“We’re seeing some evidence of a broad pushback,” said David Zweig, professor of organizational behaviour and human resources management at the University of Toronto. “Until this pandemic is dead and gone, going back to the office is going to be a hard sell.”
It’s not the first time white collar workers have been recalled to
cubicles. Yet previous return to office pans were derailed by fresh outbreaks and new variants. This time, however, some companies appear to be drawing a line in the sand. Rather than voluntary return to office guidelines, employers are mandating office attendance through corporate policies.
Some big banks and Bay Street law firms appear to be leading the charge, issuing memos mandating a set number of days a week in the office post Labour Day weekend.
Law firm Osler, Hoskin & Harcourt LLP said in a statement that on Sept. 6th, its offices will move to a hybrid zworking model where most employ-
ees will work three to four days a week in the office, subject to operational requirements and local public health guidance.
The head of Royal Bank of Canada recently said organizations need to find the right balance between remote and on site working.
“It won’t just happen organically,” RBC’s president and chief executive Dave McKay said in a LinkedIn post.
“We’re asking teams across the bank to start coming together in person more often to work and collaborate.
For many managers, the office is about culture. It’s a place of collaboration, face to face teamwork and yes, even office cooler chit chat.

We’re hearing from organizations that the value of creative collision that happens in offices just cannot be recreated virtually,” said Tara Van Zuiden, Deloitte Canada’s human capital partner and leader of workforce transformation for Western Canada. “They want the connection and collaboration that happens in person.”
For many workers, the preference for working from home is about flexibility and the lack of distractions. They want a better work life balance and an end to lengthy commutes. “People want to hold on to the autonomy and flexibility that they’ve gained around their work schedules during the pandemic,” said Zweig.
Of course some employees never worked remotely and other are clamouring to get back to the office five days a week. Some companies have already moved to a hybrid model permanently - or quit office leases and told workers to say home.
In May 2020, Canadian tech giant Shopify Inc. shifted to a fully remote “digital by design”, company - saying in a press release its location was not its Ottawa headquarters but “Internet, Everywhere.
The company does most of its work remotely and “occasionally we gather in person in highly intentional ways to build trust with our teams and connect to our mission. We call these “bursts” spokesperson Jackie Warren said in an email. But other companies are rolling out new guidelines for returning to the office this fall, a situation that could lead to a standoff between managers and workers, some observers say.
“If they’re going to call people on back en masse, every day as it was before, they’re going to get employee pushback,” said Adam Savaglio, an employment lawyer and partner with Scarfone Hawkins LLP in Hamilton.
“We could see a mass revolt.” Many workers have argued their productivity has remained strong or even improved while working from home. They say their quality of life is better as they spend more time with kids or pets or doing activities that improve their mental and physical well-being. They bristle at the idea of a rigid work day, long commutes and expensive downtown coffee and lunches.
“We’re on a bit of a collision course,” said Mike Shekhtman, a regional director with recruitment agency Robert Half. “Some employers believe the office is the best place to see a high
level of productivity. They still believe they have to see and hear their teams in order to feel like they are collaborating and innovating. But some workers are really questioning that.”
Companies that issue strict policies around returning to the office this fall could face a wave of workers quitting. It’s a significant threat in a tight labour market with a rock bottom jobless rate.
“Some employees will find the more prescriptive return to work policies won’t work for them and they will vote with their feet,” said Van Zuiden with Deloitte.
Yet it’s not about retention.
Job hunters are often searching for flexible work arrangements. Positions with strict office attendance rules are becoming harder to fill, experts say.
“The biggest challenge for employers will be that if they mandate a hard return to the office, employees might feel like they have been treated unfairly and are losing control,” Zweig said. “When that happens, people often try to restore a sense of fairness and equity by engaging in less work, like ‘quiet quitting,’ or worse.”

APPROVAL OF NEW LANGUAGE TEST FOR CANADIAN IMMIGRATION BY THE IRCC
The IRCC, or Immigration Refugees & Citizenship Canada is an organization that is responsible for the approval for Canadian citizenship & migrations. It is a body that dictates terms for the sake of controlling, monitoring & many other aspects that relates to immigration & asylum in Canada. It’s a fact that currently the process for an organization to get designated is long, complex in terms of the procedures and ‘insufficiently transparent’.
In terms of the language testing, it’s IELTS, or International English Language Testing System that is the language testing system for sake of immigration & other which includes the student’s visa. With regards to the departmental roles & the responsibilities that relates to the language testing are in current times not well defined. Apart from this, the issue is that there are overlapping policies and operational implications. The language testing in Canada is on the basis of two languages that are spoken all over in Canada & to a higher extent in some of the provinces. For example in Quebec province, the language spoken & tested for sake of immigration is French language. However, the testing system tests mostly on the basis of English language & regards to the proficiency that’s needed to be there. This is known technically as ‘language proficiency’ and is something that demands success in terms of immigration numbers and other related aspects with the IRCC.
Brief History of the Language Test:
A brief history of the lingual testing system or the language testing for Canada is relatively not so old. It is since the year 2010, i.e. 12 years from today that IRCC has only accepted the language test results from designated orgs. Hence, as evidence of language proficiency. It’s the ultimate authority of the immigration minister to
designate any language testing organization. Apart from this pre-requisite, it’s also their responsibility to approve a specific language test for the purpose of evaluation. Obviously, by evaluation we mean evaluating the language proficiency of immigration applicants. This role is a very technical role in terms of the key responsibilities. Hence, the role has been delegated to the Director of Economic Immigration Program & Policies. The key reason behind this is the immigration is planned according to the Economic indicators & economic policy framework that is in place currently. Any language testing organization appointed by the Minister of Immigration can obviously & effectively seek designation by providing a submission demonstrating how they can meet the IRCC’s criteria.

According to the IRCC, i.e. Immigration Refugees and Citizenship Canada, the French language mustn’t be left out in any case. We are not dealing with France, obviously, its Canada we are dealing with. However, certain provinces in Canada are far more linguistic in French as compared to English language. A huge number of migrants apply yearly basis to Quebec provinces, a pre-dominantly French speaking Province and the one where French language is most spoken language in a Canadian province.
