oday I tried to understand the interpretation of this verse and I was amazed that the Qur’an of Allah Almighty is amazing. Verily, Allah is not ashamed to set forth a parable even of a mosquito or so much more when it is bigger (or less when it is smaller) than it. And as for those who believe, they know that it is the truth from their Lord, but as for those who disbelieve, they say: “What did Allah int end by this parable” By it He misleads many, and many He guides thereby. And He misleads thereby only the Fasiqin (the rebellious disobedient to Allah) (2:26) Mosquito is not just a mosquito , it is a surveyor, a scientist, a surgeon, a chemist, something worldly intelligent, a planner, a diver, a microbiologist, a physicist, all these qualities in one mosquito are found. Allah Almighty has given the example of a mosquito by calling it very ‘contemptible’ and the example given by Allah is not a common . What do I know? “

Al-An’am, Ayah 151, & Surah 17. Al-Isra’, Ayah 33.) The Prophet (S) explained in his sayings three types of cases where taking life becomes permissible under Islamic Law, one of which is premeditated murder. As to the second part of your question, Allah (S.W.T.) gave the authority and right to the heir(s) of the victim to demand equal punishment be applied on the killer. Allah Says:’...And whoever is killed (intentionally with hostility and oppression), We have

given his heir the authority (to demand equal punishment)....’(Surah 17. Al-Isra’, Ayah 33.) With regards to the third part of your question, ‘What purpose does the capital punishment solve in the grand design?’ The answer that Allah (S.W.T.), who created us and everything else, says in the Quran: ‘ And there is (a saving of) life for you in Al-Qisas (the law of equality in punishment), O’ possessors of sound minds...), (Surah 2. Al-Baqarah, Ayah 179.) The saving of life that Allah (S.W.T.) refers to in the above Ayah can be seen in several ways: 1) Without serving justice to the family of the victim, people could take matters into their own hands, thus a never ending retaliation by killing could take place as had happened in past history in many nations. 2) This type of justice is applied only by the government not you and I, to establish law & order. 3) This type of punishment surely deters people from killing because simply the killer will not be there to commit another murder. Also consider what is the alternative? If you say imprisonment, let me point out to you that sometimes imprisonment is not a suitable/sufficient punishment. I have personally visited some of the jails, and inmates told me that they were repeat offenders because the system is not strong enough to stop them from doing it again and again. In fact prision can also be a training camp for criminals to be even more dangerous to the socity, since they can exchange information on how they can commit crimes in more efficint ways. The punishment of mprisonment creates several other problems also. For e.g. first of all the prisioner live at the expense of the public (the goverment has to use much of the tax money for the building and running of the prisons. It could otherwise be used to help the poor/needy population and/or etc.). To end my answer to your good question, I think the best way to determine if capital punishment works or not is to look at statistics from different countries to see how much lower are murder rates due to applying the capital punishment. Eid Fest at Princess Margaret Secondary School, Surrey

A

fter a three-year delay in events and celebrations in schools due to the COVID 19 Pandemic, the Muslim students at Princess Margaret Secondary School came together to hold an Eid Fest on May 11. With the help of over 30 volunteers, an incredible coordinating team, and supporting teachers and staff, the school hosted over 500 coming and going students in their cafeteria. The focus of the event was to share the joy of Eid as well as educate the student population about the celebration. Some activity booths included Mehndi, Calligraphy, Islamic artifacts of relevance, a photo booth, and a trivia stall all organized to emphasize important aspects of Eid. And of course, Eid is not truly Eid without an abundance of food which the students purchased and received generous donations from restaurants such as Taste of Lahore, Pak Punjab Samossa, Syrian Gourmet, as well as homemade donations from community members. Attending esteemed

guests included Mr. Gondal and Ms. Ali, president, and general secretary of the British Columbia Muslim Association, Mr. Naseer Pirzada, editor-in-chief, from the local Miracle newspaper & CMMC member, and Islamic Relief volunteers, led by Husnain Nawaz who aided in the setup and cleanup of the event as well as contributed to the general atmosphere of the day. Notable volunteers include Khadija Nadeem who spearheaded the approval and organization of the event, Zoha Faisal who organized the publicity and event setting, and Zain Afridi who took charge in providing food and refreshment arrangements. The purpose of events such as these are to take steps to connect youth in the west to their culture and religion and the Princess Margaret Eid Committee was pleased to do that work this year. The turnout and overall support from the community was overwhelming and the team looks forward to continuing the tradition in the coming years.

City of Surrey Mayor Hon. Dough McCallum and Councillor Ms. Allison Patton were also invited at this Dinner. Ms. Khan thanked all the guests to join the Edid Dinner at her request. n May 17, 2022 Patrick Brown, leadership candidate of the Conservative Party of Canada, met with Muslim community members at Burnaby Masjid. Patrick outlined his plan to change the Conservative Party so it’s inclusive of all Canadians with no elements of racism or Islamophobia. He also outlined how he has spoken up on injustice to the Palestinians and will not move the embassy to Jerusalem. Patrick has a long history of supporting religious freedom and fighting Islamophobia. He opposes Quebec’s Bill and has spoke up in opposition to the CAA/Citizenship act in India resulting in the Indian Lobby is now actively working against him. In Canada a party normally governs an av-

erage of 10 years and flips back and forth between a Liberal and Conservative government. The Liberal Party will be at the 10-year mark when the Federal election occurs in Oct. 2025, thus the next Conservative party leader will most likely be the next Prime Minister of Canada. We need a friend of all the minority communities to be the next PM. We have a historic opportunity to change the Conservative Party. If Patrick does not become leader, we may face a new era with Stephen Harper type policies now under Pierre Poilievre. It is critical to sign up as members to vote for Patrick. Homelessness was and still is a prominent social issue in BC

By: Khadija Nadeem, Miracle’s Editorial Member n 2020, the world experienced the effects of the global pandemic, COVID-19 as it infected millions across the world. When countries all over the world went into lockdown, there were many negative impacts that affected a diverse variety of groups. Many struggled financially, and because of the stay-at-home order, unemployment was at a high. Mental health issues were on the rise and it’s safe to say that the collective population was ready to leave the pandemic and its issues behind but it wasn’t as simple as that. Not only did the pandemic have new, long-term effects on our lifestyles but it also aggravated issues that previously existed. Homelessness was and still is a prominent social issue that occurs specifically here in BC and the Lower Mainland. Unfortunately, the danger of homelessness for youth is far more high-risk than that for adults. Youth are more likely to be victims of exploitation, develop behavioral and mental health problems, increase usage and abuse of substances, and enter the criminal justice system when in the condition of homelessness. Often, there is trauma that has relation to the many causes of youth homelessness that many victims carry with them throughout the majority of their lives. can easily become long-term if not addressed accordingly. An example is the solitude in which many youths live when homeless. Being completely by yourself not only has negative emotional and mental effects but also leaves youth at a disadvantage socially when they eventually find themselves in a better situation. Some young people may be by themselves and without consistent living arrangements since they were very young but often, youth homelessness is a result of estranged family and failed relationships which are one of the leading causes of youth becoming homeless. Many young people leave home after prolonged physical, sexual, and/or emotional abuse, strained relationships, addiction issues in the family, and parental neglect. Strong relationships with family and friends and having a support system are critical for young people to develop and grow yet, unfortunately, a significant amount doesn’t receive the care and treatment they deserve and are entitled to. Before the pandemic and especially during, homeless shelters and food and money drives played a big part in helping homeless youth. Similarly, drop-in centers, street outreach programs, and public systems including child welfare, criminal justice, schools, community programs, and other youthserving systems serve society in identifying and engaging with at-risk youth. These resources also

help with early intervention so not only do they aid in preventing youth homelessness, but they also take action towards helping those who are struggling with it so as to reduce the impact and duration of it. In September 2020, many programs and plans were announced by the government to help take care of Canadian citizens. As part of emergency measures, easier access to life skills and rehabilitation supports through the AYA program (Agreement with Young Adults) was put in place until September 2021. These measures allowed eligible youth/young adults in the program to take part in life skills programs and cultural learning options as well as access to mental health and rehabilitative supports which are important to those transitioning into the adult phases of their lives. Additionally, youth who were living in foster care, contracted residential agencies, or with relatives through outof-careare arrangement would be able to remain where they were. And youth on Independent Living Agreements and Youth Agreements would continue to receive financial support. And even in the pandemic, social workers continued to transition-plan with young adults who were ready to move on from their current placements. Shortly after, the province decided to extend COVID-19 emergency measures and all youth who were set to transition into adulthood at age 19 would continue to

receive housing and financial support until March 31, 2022. Youth and young adults set to transition out of government care would be able to stay in their arrangements for up to one additional year. Any support that the government is able to provide our citizens is beneficial especially to the youth who have struggled through the additional challenges of this pandemic but they’re doing their part however temporary it may be. As we move forward, the government will be withdrawing additional support but that doesn’t mean that the pandemic will be withdrawing its effects which are most commonly long-term. As a community, we must do what we can to help our youth because they are our future. Donating to clothing drives and homeless shelters is only a small way we as individuals can make an impact on the lives of young, struggling strangers. Be kind and remember the Hadith No 1410, Sahih Bukhari Narrated by Abu Huraira: “Allah’s Apostle said, If one gives in charity what equals one date – fruit from the honestly earned money, and Allah accepts only the honestly earned money – Allah takes it in His right (hand) and then enlarges its reward for that person (who has given it), as any one of you brings up his baby horse, so much so that it becomes as big as a mountain.”

MP Sarai’s motion on permanent residency for temporary foreign workers passed unanimously

PRIVATE Members Motion, M-44, Permanent residency for temporary foreign workers, introduced by Randeep Sarai, MP for Surrey Centre, was passed unanimously

in the House of Commons on Wednesday following a second hour of debate. Motion M-44 addresses ongoing challenges with the immigration system, filling critical gaps in the labour market by creating more accessible pathways to permanent residency for temporary foreign workers (TFWs). With an aging population and domestically low birth-rate, Canada is seeing a decrease in population. Some estimate that by 2030 population growth will come exclusively from immigration, which already accounts for almost 100% of Canada’s labour force growth and 75% of Canada’s population growth – mostly in the economic category, said Sarai. Despite Canada’s historically low unemploy-

ment rate (5.2% in April 2022), industries like the agriculture sector continued to experience high job vacancy rates that they are unable to fill with domestic labour. Temporary foreign workers contribute to Canadian economic growth and ensuring regional labour demands are fulfilled, however the path to permanent residency remains out of reach for many of these workers, noted Sarai. While there are pathways for to permanent residency (PR) for lower skilled workers such as through regional and industry specific programs, TFWs continue to face challenges in gaining PR status due insufficient higher education, and low language testing scores. Despite their valuable contribution to our communities and economy, and great

employment records over a number of years working in this country – TFWs continue to be at a disadvantage in attaining PR status. This motion encourages the Government of Canada to continue to work towards making PR status attainable to more TFWs. Sarai said: “Not a day goes by that I do not receive a call or an email from an employer who cannot find workers for their business. From restaurant owners, produce packers and logistics companies to IT groups, everyone needs workers. VICTORIA - A new state-of-the-art and seismically safe Royal BC Museum (RBCM) is coming to Victoria and will be more accessible for all British Columbians. The new museum will reflect the experiences and perspectives of all who contributed to B.C. ‘s history, providing a cultural legacy for generations to come. The new museum is made possible through a $789-million investment from the Province. “For decades, people from British Columbia and around the globe have come to the Royal BC Museum to learn about our special corner of the world. For just as long, the stories told here have failed to accurately reflect our colonial history or include everyone, and priceless collections are now being put

at risk in an aging building,” said Premier John Horgan. “That’s why today, we are making this historic investment to build a safer, more inclusive and accessible modern building. Once complete, the new museum will be a flagship destination for tourism and a place where generations to come will learn about the richness and diversity of B.C.’s history.” Like the Royal BC Museum’s collections and research building in Colwood, the new museum will be built to achieve high efficiency for all its HVAC systems. Indeed, the Commonwealth Fund’s latest international survey of the general population reveals that in 2020, Canada ranked dead last (10th out of 10) for

wait times to see a specialist and receive elective surgery. Additionally, far more Dutch (69 per cent) and Swiss (68 per cent) participants reported waiting less than four weeks to see a specialist than Canadians (38 per cent). And for elective surgery, 99 per cent of Germans and 90 per cent of French citizens reported waiting less than four months versus 62 per cent of Canadians. While the pandemic has obviously affected some of these wait times, older data tell the same story. Our health-care system struggled long before the pandemic—again, despite consistently being a top spender. But the news this year isn’t all bad. Canada performed better than the average universal health-care country on survival rates for heart attacks (ranking 9th out of 27), breast cancer (5th out of 26) and rectal cancer (6th out of 26) despite the relative shortage of resources and long wait times. Indeed, these serve more as a testament to our health-care workers than to our resource-deficient system.The past 19 months have pushed provincial health-care systems, and those who

ineteen months into the COVID pandemic, Canada’s health-care system continues to face serious challenges, with hospitals in some provinces struggling with overcrowded ICU’s and staff burnout. The result? Despite progress in some quarters, elective surgeries are once again being postponed and non-COVID patients will have to wait for medically necessary care. While it may be tempting to blame our current challenges on COVID-19, our new study suggests the pandemic is exacerbating—but not causing—the systemic problems that plague our underperforming health-care system. The study compares the spending and performance of 28 countries with universal health care (on an age-adjusted basis) using 2019 data (the most recent year of comparable available data from the OECD). In line with previous findings, we find that while Canada ranked as the second-highest spender (at 11.3 per cent of GDP) among its

here are two ways to approach eating for focus: focus in the moment and focus as you age. Shahbaz Malik lauds Canada’s ‘invaluable support’ to Pakistan in Covid-19 pandemic

akistan’s Acting High Commissioner to Canada Mr. Shahbaz Malik has expressed the confidence that bilateral relations between Pakistan and Canada would further expand in days ahead to include a full spectrum of political, economic, security and cultural arenas for the mutual benefit of both countries and their people. He said that Pakistan and Canada established bilateral diplomatic relations in 1947, shortly after Pakistan’s independence, and the relationship had grown from strength to strength over the decades. He said both Pakistan and Canada continue to cooperate on bilateral and multilateral fora due to a commonality of views on a number of global challenges like peace and security, climate change and multilateralism. He lauded

Canada’s “invaluable humanitarian support to Pakistan through the Covid-19 pandemic”. Mr. Shahbaz Malik made this statement while addressing a gathering of members of the Pakistani diaspora, local dignitaries, and members of diplomatic corps, including high commissioners and ambassadors, invited to a Qawwali performance organized by the Pakistan High Commission in collaboration with the Delegation of Ismaili Imamat in Canada. The event was dedicated to the celebration of the 75th anniversary of the diplomatic relationship between Pakistan and Canada as well as 75th Independence Day of Pakistan falling this year. Various Canadian Senators and parliamentarians as well as Mr. Paul Thoppil, Assistant Deputy Minister, Global Affairs Canada, and Dr. Mahmoud Eboo, AKDN Representative to Canada, also attended the function. Welcoming the guests to the event, Pakistan’s Acting High Commissioner Mr. Shah-

baz Malik observed that Pakistan at this significant juncture of our bilateral relations between Pakistan and Canada, was looking forward to expanding these ties to cover political, economic, security and cultural fields. He underlined the importance of cultural linkages between people and their role in strengthening bilateral relations and described the Qawwali event as an effort to introduce the Canadians to Pakistan’s vibrant music and culture. He told the guests Qawwali as a traditional form of Sufi music and poetry had gained considerable global audience and recognition due to a deep spiritual message it conveyed to the listeners. He also thanked Dr. Eboo and the AKDN team for their generous collaboration in arranging the event. He also recalled AKDN’s historic association with Pakistan, particularly the role of His Highness Sir Sultan Muhammed Shah, Aga Khan III as the first President of All-India Muslim League as well as being a comrade of Quaid-e-Azam Mohammad Ali Jinnah during the freedom struggle for Pakistan. He said AKDN had been contributing generously to the health, education and social development sectors in Pakistan and the Government and the people of Pakistan deeply valued that support. Voluntary Extreme Intoxication now Legal to use as Defense for Violent Crimes: New Decision from the Supreme Court By: Khadija Nadeem, Gr 10

On Friday the 13th, the supreme court of Canada issued a significant decision allowing criminal defendants in cases regarding or involving assault to use a defense known as self-induced extreme intoxication. Essentially, it means defendants who voluntarily consume intoxicating substances and then assault or interfere with the bodily integrity of another person can avoid conviction if they can prove they were too intoxicated to control their actions. Justice Nicholas Kasirer claimed that “to deprive a person of their liberty for that involuntary conduct committed in a state akin to automatism – conduct that cannot be crimi-

nal – violates the principles of fundamental justice in a system of criminal justice based on personal responsibility for one’s action.” But my question to Justice Kasirer is that if our system is based on personal responsibility for one’s actions, where does that responsibility go when one makes the decision to become so intoxicated they can’t control decisions that may very well prove bodily harm to others? What fault is it of any victim if an offender makes the personal choice to become intoxicated and then goes as far as to harm another? Does that not make the offender liable for their actions? Where is the personal and social responsibility there? Where is the justice there? To be even more specific, under Section 33.1 of the Criminal Code, extreme intoxication cannot be used as a defense in criminal cases where the accused voluntarily ingests the intoxicating substance. And yet, the Court found that the section is too vague and that it contradicts the Canadian Charter of Hu-

man Rights and Freedoms. A prominent argument is that allowing this defense to be used in cases of voluntary extreme intoxication would privilege rights over those of vulnerable groups including women and children who disproportionately bear the risks of intoxicated violence whether that be physical or sexual. The harm caused to women alone as a result of intoxicated violence is an infringement on an individual’s right to security and equality and is simply pernicious. Holding individuals accountable for violent crimes, especially in a state of extreme intoxication, is a pressing matter in itself. Not to mention that failure to condemn such actions will only discourage reporting and excuse violent behavior. Our legal system is in no way black and white and I certainly do not doubt that, but as a minority, in multiple ways, living here in Canada, this decision from the Courts affects me significantly. Not only that, it harms me significantly. knowing that a person who

makes the decision to heavily intoxicate themselves has more rights and legal authority than a person like me, who may be the victim of their harmful and violent intoxicated actions not only makes me feel like less of a person under the eyes of the law and our society, but it also proves to me that we are living in a twisted world where we have to work against our systems for every battle we choose to fight. When will my country be on my side?

ANALYSIS: Nawaz Sharif’s homecoming conundrum

W

ITH the eventual return of PMLN supremo Nawaz Sharif being contemplated by the incumbent government, the question has arisen whether his outstanding prison sentences will be remitted by the government before his arrival or he will apply to the courts for relief after his return. An Islamabad accountability court had in July 2018 sentenced Mr Sharif to 10 years in Adiala jail in the Avenfield apartments reference. In September the same year, the Islamabad High Court had suspended that sentence, but Mr Sharif was arrested again in December after being found guilty in the Al-Azizia reference and sentenced to seven years’ imprisonment. He was later released for eight weeks on bail on medical grounds, following which he had proceeded to London for treatment. As he never returned to Pakistan to complete his sentences in both cases, there remains the question of what is to be done about them if he were to return now, as he reportedly wishes to.

Punjab’s powers

It is worth noting that the president has broad powers to provide relief to any convict under Article 45 of the Constitution, which states: “The president shall have power to grant pardon, reprieve and respite, and to remit, suspend or commute the sentence passed by any court, tribunal or other authorities.” However, with the incumbent unlikely to offer any relief in this regard, this option remains closed till Dr Arif Alvi is replaced with a more sympathetic head of state. Regardless of what the president chooses to do, however, the Punjab government can act independently of him in making a decision on providing relief to a prisoner. Because Mr Sharif was sentenced to serve time for the Al-Azizia reference in Kot Lakhpat jail, which lies in Punjab’s territory, the court, while giving him bail in that case, had reminded the provincial government that under Section 401 of the Code of Criminal Procedure (CrPC), it had executive powers to extend bail or suspend the sentence in the future. The Punjab government therefore retains broad powers to suspend or remit Mr Sharif ’s sentence in both Al-Aziza and Avenfield references under Section 401, as Adiala jail too falls in Punjab’s territory. The court’s order stated: “The provisions of the above sub-section shall also apply to any order passed by a criminal court under any section of this Code [CrPC] or of any other law, which restricts the liberty of any person or imposes any liability upon him or his property. “Nothing herein contained shall be deemed to interfere with the right of the president or of the central government when such right is delegated to it to grant pardons, reprieves, respites or

remissions of punishment. The provincial government can, on its own, pass any order regarding the suspension of sentence. “The rationale behind Section 401 CrPC is that the provincial government on its own can scrutinise the matter and, where for reasons it believes that the sentence is to be suspended, can do so without even the convicted person agitating the matter.”

Legal view

Senior lawyer and Prosecutor General of the Anti-Narcotics Force (ANF) Raja Inam Ameen Minhas noted that it is common for the government to remit the sentences of prisoners, especially on the eve of festive occasions like Eid. However, remission or suspension of a sentence does not set aside the conviction. He explained this is because there is a legal distinction between a conviction and a sentence. A conviction means someone has been found guilty of the offence they were charged with, whereas a sentence is the punishment for being guilty of that offence. It may be recalled here that the Supreme Court had in its 2009 judgement in Nawaz Sharif vs the State discussed the president’s power to pardon a convict under Article 45 of the Constitution. The apex court had held that the effect of grant of pardon, even in full, was not the same as an order of acquittal by a court of law. Therefore, even if he is pardoned or receives a remission of sentences, Mr Sharif cannot hold any public office till his convictions are also overturned. Mr Sharif will still have to pursue his pending appeals if he wants his name fully cleared. Senior lawyer Salman Akram Raja said that even though Mr Sharif is an absconder at the moment, the federal government can pardon him even before he sets foot in Pakistan under Article 45. He said the scope of CrPC, in comparison, is comparatively narrow, as remission in sentence is usually granted for good conduct. He noted that since Mr Sharif is at large, the applicability of the powers available with the Punjab government is somewhat complicated. THE process of consultation with allies is underway. Yesterday, Prime Minister Shehbaz Sharif met the MQM-P convenor and the JUI-F and PPP leadership. It remains to be seen how quickly decisions are taken. Since becoming the face of the unity government, the PML-N has rapidly lost the goodwill it spent years building up while in opposition. After Finance Minister Miftah Ismail’s press conference on Sunday, it is clear that while the PM and his kitchen cabinet are aware of the economic crisis, they look to their party’s leadership in London for ‘guidance’ on policy matters. Nawaz Sharif et al, meanwhile, seem to be making decisions that are more in the interest of the PML-N than the people. Internal differences are causing serious delays in economic governance, as well as creating uncertainty in the capital markets. The reaction on Monday to Mr Ismail’s press conference came in the form of another sell-off in the stock market and the continued weakening of the rupee-dollar exchange rate. It is difficult to sympathise with the PMLN, even though the party keeps reminding us that the economy is in the shape it is because of the decisions the PTI made in its last days in power. Yes, the unsustainable fuel and electricity subsidies draining Pakistan’s treasury were indeed introduced by the PTI, but what has this new government done about them? It is strange to hear senior PML-N leaders lamenting the subsidies, yet not even coming up with a subsidy rationalisation plan though it is in their power to do so. The truth is that while they can blame Mr Khan all they want, each day of their own indecision is costing the treasury billions of ru-

pees and wreaking further destruction on the capital markets. The PML-N contends that any difficult decision it has to take must first be endorsed by the other parties in its government. This not only betrays the PML-N’s lack of trust in the parties it chose to ally itself with in order to remove the PTI from power, it also exposes its lack of foresight when forming the government. If the PML-N so desperately wanted the other parties to share the burden of economic decision-making, why did it not demand that the finance ministry be headed by a coalition partner? It is evident that the PML-N is only suffering from buyer’s remorse, and it is only the commitments it made to secure the vote of no-confidence that are holding it back from abdicating its responsibilities altogether. If there is no decision in the next few days, the PML-N should step down and let a caretaker set-up take over. Even that decision will likely come with political costs — people will ask what the vote of no-confidence really achieved. However, the way the transition of power has been bungled, there is hardly any other option. Source: dawn.com

After SC opinion on Article 63-A, what’s the status of Punjab CM election? received a total of 197 votes while 186 votes are required for a simple majority. If the 25 votes by PTI lawmakers are removed from his tally, he would lose his majority. So, what does today’s SC verdict mean for the future of Hamza Shehbaz’s government in Punjab? Dawn.com talked to some legal experts to answer this question.

‘Depends on ECP verdict’

The Supreme Court on Tuesday, in its decision on a presidential reference seeking interpretation of Article 63-A of the Constitution, said the votes of defecting lawmakers will not be counted. Article 63-A seeks to restrict lawmakers from voting (or abstaining) in violation of party instructions “in relation to election of the prime minister or chief minister; or a vote of confidence or a vote of no-confidence; or a money bill or a Constitution (amendment) bill”. In its interpretation of this article, the apex court said votes cast against party direction “cannot be counted and must be disregarded, and this is so regardless of whether the party head, subsequent to such vote, proceeds to take, or refrains from taking, action that would result in a declaration of defection”. This opinion of the apex court raises some pertinent questions with respect to the election of the Punjab chief minister, which resulted in PML-N’s Hamza Shehbaz becoming the provincial chief executive. That is because contrary to what happened in the National Assembly, the votes of 25 dissident PTI lawmakers were instrumental in helping Hamza get over the line; he

Barrister Asad Rahim, who assisted the federation in the case, said the current decision was directly connected to what the Election Commission of Pakistan (ECP) would decide with regards to Punjab’s dissidents, which is “the first factual hurdle”. “If the ECP decides they have defected, contrary to the direction of the parliamentary party, the Supreme Court judgment will apply, and the election of the chief minister will be set aside.” However, Rahim added, that this could only happen once “the question of whether the opinion is to be applied retrospectively” had been decided. He also said that in future, in cases of defection, the speaker would simply not count dissenting votes. A retrospective application would mean that today’s judgment could be applied to past events, such as the April 16 election of the Punjab chief minister. Lawyer Abdul Moiz Jaferii had a similar opinion. He said the PTI could take the validity of the CM election to court “but it would first need to be seen what the ECP based its decision on”. Earlier today, the ECP reserved its verdict on a reference seeking the disqualification of 25 dissident MPAs of the PTI, who had voted for PML-N’s Hamza Shehbaz in the election for the Punjab chief minister on April 16....Source: dawn.com
