Lok Sabha election dates likely today NEw DElHI, MARCH 4 (IANS): The Election Commission is likely to announce the dates for the Lok Sabha election Wednesday. The term of the current Lok Sabha expires June 1. A new house has to be constituted by May 31. An estimated 814 million voters will be eligible to vote, with 97.1 million new voters added since the 2009 election. The “None of the Above” (NOTA) option will be given to voters -- for the first time in a parliamentary contest. About 800,000 polling stations will be set up across the country, according to Election Commission sources. Around 1.2 million electronic voting machines will be used in the election and another 250,000 have been ordered from public sector companies. In 2009, there were 714 million voters and 671 million in 2004.

Long History of Struggle and Violence The only reason nonlocals like T cannot afford to report such incidents is because there is fear and it is a gamble for survival. However, the important issue that arises in the Naga society is how Nagas have developed such tendencies of discrimination and how do we stop it. “We are not racist, neither are we violent. There are too many damaging memories to deal with,” says Kedo Peseyie, Pastor

City Church, referring to the memories of the Naga struggle for independence, who feels that these stories remain fresh. Peseyie adds that Nagas have a strong tendency to protect their tribal identity, which is not wrong but a lot of times it has been channelized in the wrong direction leading to violence between tribes and races, instead of enhancing progress by prompting healthy competition. “To be honest, it is the way we grew up because of the Naga struggle and the trauma we went through in the hands of the Indian Army, we have looked at any Indian/non-local as bad,” says Dr. Ngullie, further adding that Nagas cannot go on looking at every “non-local” as an enemy. Many times, the damage and mental trauma passed on to the next generation is far worse than the generation which has actually experienced it, as student leader Zakie Khate says, “The anger and hate that we harbor is more dangerous than the ones who have actually encountered the real suffering.” Such chain of angry reactions that young Nagas to-

cept of “original sin” which puts people in the same category. “Because of sin, we are what we are. No race is worse than the other. We are all in the same boat. There

is absolutely no moral or intellectual reason to support racism,” says Kedo. Second, is the fact that everyone is created in the image of God. A Hindu or a Muslim does not appear lesser or hold lower dignity in the image of God than a Christian. All possess equal dignity and deserve equal respect. These two doctrines, according to Kedo Peseyie, are the essence of Apostle Paul’s most countercultural statement: There is no longer Jew of Greek, male or female, slave or free, but all are one.“Try living Paul’s idea, and people from your own tribe will call you a traitor,” he adds, however. Dr. Ngullie suggests two points from the Truth and Reconciliation Commission (TRC) introduced by Bishop Desmond Tutu –confronting the truth and seeking forgiveness in the midst of severe human rights violation committed during apartheid in South Africa. Second, is the Journey of Conscience. In the year 2000, the Naga Peoples’ Movement for Human Rights (NPMHR) took a courageous step to traverse the Journey of Conscience where it, along with other civil society groups, visited parts of the Naga

NAY PYI TAw, MARCH 4 (PTI): Warning about the evolving threat of terrorism in the BIMSTEC region, Prime Minister Manmohan Singh on Tuesday sought stronger cooperation from the seven-nation grouping to effectively counter it, asserting that their security is “indivisible”. Addressing the 3rd BIMSTEC Summit here, Singh said the region faces many common challenges — from natural disasters to terrorism which have to be collectively addressed to make an important contri-

bution to peace, harmony, security and prosperity in Asia and the world. “Like our prosperity, our security, too, is indivisible — whether it is the security of sea lanes of communication in our region or the persisting challenges of terrorism and transnational crimes,” he said. The seven members - India, Bangladesh, Sri Lanka, Thailand, Myanmar, Bhutan and Nepal - bring together over 20 per cent of the world population, which is about 1.5 billion, and a GDP of over USD 2.5

Following a break on March 6, the final three days will exclusively feature various art forms, mainly from the North East, to be choreographed by award-winning folk artiste from Assam, Dr. Prasanna Gogoi. Additional highlights will be folk art forms from the South and North of the country. “It is a platform for artistes from not only the region but for artistes from various parts of the country,” said Tzudir of the festival. Another important objective of the event will be the promotion of artistes from rural areas. According to him, for too long, information and resources have been, primarily and largely, focused in the urban areas. However, he said that it has been realised that it is in the rural regions where folk art flourishes. “Our resources, our programs will be channelled to the rural areas...so that there is an understanding of their importance because we recognise the fact that most of the art forms actually are being practiced in the rural areas;” in due course bring-

ing it to the larger domain, he said. On upcoming events, he added that the Spring Festival is a warm up to the ‘Yatra’ (chain) programme scheduled for an April start. As an institution of the Ministry of Culture for the promotion and conservation of the indigenous culture of the North East, Tzudir said that the NEZCC will also focus on eradicating misconceptions associated with people from the region. Alluding to the regular incidents of racerelated discrimination and sense of alienation generally experienced by people from the region in the mainland, Tzudir said, “We have understood and recognised the fact that the alarming news (of racists remarks and attacks) that are making headlines are primarily out of ignorance of the NE region.” In this regard, he said that the NEZCC will also work toward debunking myths and prejudice associated with the region; while bringing the North East’s vibrant way of life to the forefront of the national mainstream.

We need to remember history rightly from the perspective of forgiveness.”

A 20-year old Naga boy’s body, who died in New Delhi on Monday, has been flown into Nagaland on the morning of March 4. Wiribou Chawang (20), who had arrived in New Delhi only a month back from his home in New Jalukie, Peren, looking for a job, became breathless at night in his sleep at his residence—his roommate called the neighbours on hearing him choke, and they took him to the Safdar-

jung Hospital in New Delhi, where he was declared dead on arrival, said a senior police officer. According to police, Chawang was suffering from a breathing problem. On Sunday evening, he also complained of a breathing problem. Police, however, ruled out any foul play. “Police are awaiting his postmortem report to ascertain the exact cause of his death,” an officer added, which will be available only after 14 days. Chawang’s body has been sent to Nagaland with the help of New Delhi’s Na-

galand House by the 7am Air India flight on March 4, informed Hollande Ngonamei, former president of the Zeliangrong Students’ Union Delhi who coordinated the efforts. He said that the Deputy Residential Commissioner at Nagaland House extended all help possible, including arrangement of transport and other logistics. In a chilling daylight robbery, a 72 yearold woman was drugged and robbed in her own house in Dimapur. The victim, Y. Amongla Ao, regained coherence only after 3 days, after which a police complaint was filed. The incident occurred on February 28 at Amongla’s Duncan Basti residence. On February 26, as per Y. Amongla’s narrative, a stout middle aged woman came to her house looking for small household jobs. With her domestic help away, she asked the woman to return in two days for work. The woman returned on February 28, morning, along with a seven month old baby girl, and another girl of 15-16 years of age. When asked by the old lady, they said they were “Mians” and the older, dark complexioned, woman said that she has to take care of a lot of younger children, and that Amongla should employ the young girl as a domestic help. According to the narrative, the older woman wore a black scarf round her head and had silver bangles on the wrists, while the younger one wore a red salwaar suit. After the introduction, the duo helped out with household chores till around 11:00am, when Amongla offered them tea. Leaving her cup in the kitchen, Amongla said that she went to the neighbouring grocery store to get bread. Returning she finished her cup of tea, at the same time wondering why her tea tasted unusually sweet. She usually takes tea without sugar.

After tea, they sat on the corridor of her house. This is when the older woman asked her, by tapping on her head, if she felt any headache. She recalled feeling a sensation of pain on her knees but not headache. The next thing she knew, she woke up in the ICU of the Christian Institute of Health Sciences and Research (CIHSR). She was found unconscious on the floor by a three year-old neighbour, at around 1:00 pm, who alerted the neighbours and later her family. At first, it was suspected to be a case of heart attack but tests did not suggest such. She had vomited thrice in her unconscious state. Meanwhile, it was discovered that things were missing at the house. It was not until March 2 that she gained complete coherence to recall what had happened. “My gold necklace, ear rings, ring, mobile phone and seven pairs of salwaar suits were gone. My whole body still hurts, especially the neck, and my stomach is burning. I was obviously poisoned and robbed,” said Amongla, who cannot “forget the face” of the older woman, with her large eyes. Her Medicolegal Report from the CIHSR suggests “poisoning”. She suspects what happened to her could be part of an organized racket. “Since we live on the main road, people saw the duo leave with bags from our house but my mother used to donate things to the underprivileged all the time, so no one thought anything was amiss,” said Amongla’s daughter, who filed an official complaint with the West Police Station, Dimapur, which has confirmed that someone from the Dimapur police Women’s Cell will get back to them.

‘Russia has right to use force in Ukraine’

MOSCOw, MARCH 4 (AP): Accusing the West of encouraging an “unconstitutional coup” in Ukraine, Vladimir Putin said Tuesday that Moscow reserves the right to use its military to protect Russians there but hopes it won’t need to. The Russian leader’s first comments on Ukraine since its fugitive president fled came as U.S. Secretary of State John Kerry arrived in Kiev to meet with Ukraine’s new government. Putin declared that Western actions were driving Ukraine into anarchy and warned that any sanctions the West places on Russia for its actions there will backfire. “We aren’t going to fight the Ukrainian people,” Putin said, adding that the massive military maneuvers Russia had been doing involving 150,000 troops near Ukraine’s border had been previously planned and were unrelated to the current situation in Ukraine. He ordered the troops back to their bases. The U.S. announced a $1 billion aid package Tuesday in energy subsidies to Ukraine, which faces a looming financial disaster. “We are going to do our best (to help you). We are going to try very hard,” Kerry said upon arriving in Kiev. “We hope Russia will respect the election that you are going to have.” Related story on page 9

The North East Zone Cultural Centre (NEZCC) has lined up a series of exciting events for the Spring Festival, 2014. The festival which took off on March 3 will culminate on March 9 with more than 365 artistes, including school children, from across the North East as well as from other Zonal Cultural Centres partaking. Addressing a press conference on the second day of the festival, NEZCC director, Lipokmar Tzudir, stated that the festival will feature various folk art forms, besides themebased entertainment. The curtain raiser on March 3 was themed ‘Music in the Park’, followed by ‘Movies in the Park’ on March 4. The entertainment section will conclude on March 5, which will feature magic shows. “Considered almost a dying art in the country,” the NEZCC is happy that it is in a position to promote the art, said Tzudir of the magic show-themed evening on March 5.

The DC Mokokchung made the declaration while addressing the villagers during his first official visit to the Kangtsung Yimsen recognized in 2012. Mass prayers to keep Mizoram prohibition aiZaWL, march 4 (TNN): Mizoram Synod's second highest decision-making body, the Synod Executive Committee (SEC) of the Presbyterian Church of India, the most powerful church in Mizoram, decided to organize mass prayers across the state to pray for continuation of the Prohibition law, which has been in force in the state for 17 years. The church decided that mass prayers should be held at all local churches across the state on March 9 (Sunday) night and also submitted a written statement airing the stance of the church on prohibition to the chief minister.

The SEC, in a statement, said the church believed that Mizoram had been peaceful and the lives of the people pure due to the imposition of the Mizoram Liquor Total Prohibition Act, 1995, since February 20, 1997. "We have information that the state government is contemplating reviewing the dry law and making changes and the Presbyterian Church felt that the stance of the church required to be reiterated," the statement said. The Synod authority said that in accordance with the teachings of The Bible, alcohol caused serious harm to human beings and should not be allowed to be free-

ly available. "Alcohol causes so many social evils including murder, rape, vehicle accidents and more," the statement said. The church said it wanted not only continuation of the dry law but also to strengthen it and appealed to the church members to pray for its continued enforcement in the state. The SEC had convened a meeting of all newly-elected legislators on Tuesday at the J M Lloyd Hall in the Synod Conference Centre when a written statement in which the church's stance on prohibition was mentioned was given to all the legislators.

The state excise and narcotics department had initiated a change in the prohibition and the Mizoram Excise Bill, 2014, to replace the Mizoram Liquor Total Prohibition Act, 1995, was drafted and sent to the state law department for approval. Excise and narcotics minister R Lalzirliana had earlier said they intended to introduce the bill during the coming budget session of the state legislature commencing from March 18. Many people in the state, including social workers and civil societies like the Mizoram Journalists' Association (MJA) and

the Mizoram Bar Association had said the dry law was an utter failure and had done more harm than good during the 17 years of its imposition. Powerful NGO Young Mizo Association and other NGOs also felt that the prohibition had not been successful. Many people also felt that the church was interfering with the policy-making of the government which was against the spirit of secularism. The church, however, stuck to its guns and it was yet to be seen whether the state government would succumb to pressure from the powerful church yet again.

ATCFM to go ahead with indefinite economic blockade imphaL, march 4 (NNN): All Tribal Chiefs’ Forum, Manipur (ATCFM) has reiterated today that its decision to impose indefinite economic blockade from the midnight of March 10 will not be re-considered unless the State Government address its demand. The chiefs' body demanded payment of wages and cost of material components under MGNREGA scheme. The decision was taken through a meeting of the leaders of political/ social organizations, six Districts Chiefs’ Association and All Tribal Chiefs’ Forum held at Kuki Inn on Monday. Since the funds are being routed through the Manipur State Rural Development Agency, there have been anomalies in the implementation of MGNREGA resulting in the delay of payment of wages or cost of material components, the organisations alleged. India hardens stance against US protectionism ahead of visits

New DelhI, March 4 (reuTers): Trade minister on Tuesday accused the United States of excessive trade protectionism, launching a broadside that coincided with the visit of a top U.S. official to patch up a stormy bilateral friendship. Trade friction between the two countries has increased ahead of a general election in India, amid lingering tension over the recent arrest and strip search of a female diplomat in New York suspected of visa fraud. The ruling Congress party government of Prime Minister Manmohan Singh does not want to be seen as bowing to U.S. pressure on trade issues ranging from the quality of Indian drug exports to software piracy. “There are issues which India has raised where we feel there is very high and unacceptable protectionism,” Trade Minister Anand Sharma told reporters, adding that Washington made it too hard for Indian nationals to obtain U.S. visas. He also said that India’s patent law was compliant with the rules of the World Trade Organisation (WTO), while India would not agree to tougher

rules to protect intellectual property. India is furious about a decision by the Office of the United States Trade Representative to drag it before the WTO over the subsidies and local content rules it has set to promote solar power generation. Trade Ministry officials say India’s rules on local sourcing were fully compatible with the WTO, and they argue that 16 U.S. states have similar local sourcing provisions. Indian analysts say the Obama administration appears to be seeking trade advantages from a weak government as part of its wider drive to export away the U.S. trade deficit, which despite narrowing last year still totaled $470 billion. “The U.S. seems to be looking at exports to India, China and other emerging markets to support its economic growth,” said N.R. Bhanumurthy, an economist at the National Institute of Public Finance and Policy, a Delhi-based think-tank. “These frictions are likely to continue until a global recovery eases the pressure.” The U.S. embassy was not available for

Sharma’s prickly comments on U.S. trade reflected concern about the sluggish pace of India’s own exports, which he forecast would grow by 4-5 percent in the current fiscal year to the end of March. India curbed imports of gold last year to narrow a worrying current account deficit, but with external pressures easing, Sharma suggested the curbs should be eased to discourage gold smuggling. its officials not to entertain any request from the United States International Trade Commission (USITC) - a quasi-judicial federal agency - to examine its trade practices. Referring to intellectual property, Sharma said India was adhering to the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS), which is administered by the WTO. India opposes any stricter agreements, known in the trade jargon as ‘TRIPS-plus’, that would assure greater patent protection for proprietary medications, potentially dealing a blow to its own generic drugmakers and making it harder for its citizens to get access to affordable medicines. “India has protected its commitment to the TRIPS agreement. But what is being asked of India is TRIPS plus,” Sharma told reporters. “TRIPS plus, India has made it clear, India will never accept.” U.S. Energy Secretary Ernest Moniz is also due to travel to India next week. His visit was also postponed because of the diplomatic row.

Mumbai was the least expensive major city in which to live, partly due to government subsidies on some products and low local wages. The Indian financial capital was followed by Karachi, New Delhi and Damascus as the fourth-cheapest, which EIU said reflected the weakening of the Syrian pound due to the country’s civil war. It cited a strong Singaporean dollar, the high price of utilities and the cost of car ownership as among the factors contributing to Singapore taking the top spot away from Tokyo, which for years has led the rankings. The calculations are based on the cost of living in U.S. dollars. Paris rose 6 places to become the world’s second-most expensive city, which the EIU said in part reflected a recovery by European economies. “Improving sentiment in structurally expensive European cities combined with the continued rise of Asian hubs means that these two regions continue to supply most of the world’s most expensive cities,” Jon Copestake, editor of the report, which looks at over 400 individual prices, said in a statement.

New York, March 4 (PTI): Business tycoon Mukesh Ambani may have retained his title as India’s richest person for 7th year in a row, but his place among the world’s richest people has dropped to lowest in 8 years. As per latest Forbes rich list, Ambani is ranked 40th globally with net worth of USD 18.6 billion -- the highest for any Indian. This is his lowest rank for Ambani since being placed at 56th position in the year 2006 with a net worth of USD 8.5 billion -the first year when Mukesh and his younger brother Anil Ambani were ranked separately by Forbes after their split. The current networth of USD 18.6 billion of Mukesh Ambani also marks a significant decline from USD 43 billion of wealth recorded in 2008, when he was ranked 5th richest across the world. It was in the year 2008 itself, when Mukesh Ambani entered the top league of 10 richest people in the world and remained there for four consecutive years till 2011. “Worth USD 43 billion in 2008 when he was the world’s fifth richest person, Mukesh Ambani has seen a precipitous decline in his fortune since then, a USD 2.9 billion drop in the past year alone,” Forbes said. Regardless, Forbes said he remains India’s richest person and is “still bullish”. Ambani plans to invest USD 25 billion in his

The company reported a net loss of USD 2.5 billion in 2013, lower than that of the previous year, thanks to cost cutting measures. According to Forbes, a weak economy and falling rupee took their toll on the wealth of Indian billionaires. In the 2014 Forbes list, India has 56 billionaires in all with a collective net worth of USD 191.5 billion which is a tad lower than last year’s haul of 55 names worth USD 193.6 billion. Sensible Young Bloods In Nagaland

A

n old man in the Village developed a wearisome habit of restlessly vanishing from his house frequently without information to the small girls entrusted to keep an eye on him when the grown-ups are away for their own works. One day, the Man vanished and was not to be traced anywhere in the vicinity. Later, it was learned he had gone to a distant place and returned without any mishap. And when the elderly Aunties ruefully talked about the man’s restlessness, one of the small girls on whose charge the old man used to be left said: “Nowadays even Elderly People have become very disobedient”! Indeed it is often easier to bring understanding to a young Fool than to an elderly Intellectual. More often than was descent, this Homo sapien has lamented young bloods in the Nagas seemed to have lost the interest to invest on deeper realities in the society and seemed more prodigal, not caring for earnest living. But now, just as Elijah must have become elated when his Servant on return from an errand to the top of Mount Carmel for the 7th time at end of an endless 3 years without a drop of rain in the land, lastly said: “a cloud as small as a man’s hand is rising from the Sea”. Hopefully today, the Naga Society also seems to be raising precious few young sensible bloods, like delicate tender plants, pure and lovely, sprouting from minute seeds on the ground after a shower of rain at the approach of the spring season. Quite a few young bloods today unbelievably are considerably deep-ob-

serving and have sensibility equal to the evolving world around us. The Naga Society needs to mark these Minds; they are more precious than marble Buildings or the many tired bloods in the State; they are the materials from which the future good of the State can come. At the moment they appear timid, which is a good right thing; they would attain temperance, not carried away by verbosity. They would attain boldness, most importantly Courage, that comes out of Conviction; they would be able to discern the right from the wrong more and more; proper from the improper; have wisdom to comprehend the real from the ‘nakli’; understand mountain tops far above the cloud, the big from the low frivolous; have inward Humility than the superficial and develop the great humane sense of Equality. They have the flexibility of Magnanimity but would not compromise a whit with the Evil. They aim to live simple and pure in the midst of their industrious plenty. Those are the characters of Mind, Soul and Attitudes that would generate Peace, Prosperity, Greatness and Dignity for Nagaland. I would love to live in that Nagaland: everyone would: Nagas would do well to know these young bloods the in full Naga Names, than a Joseph Puchuri or a Daniel Konyak or Issac Achumi. NCSU Dmp supports head office Kohima, march 4 (mExN): Nagaland Contractors and Suppliers’ Union (NCSU) Dimapur unit has firmly expressed support to NCSU head office’s resolution on misuse of writing pad by contractors and new registration and renewal of identity card to be recommended by district units. NCSU Dimapur unit in a press release cautioned its members not to let unregistered members use the writing pad of the union. The release appended by vice president, Hotoshe Chophy and press secretary, A Tureng asked its members to be vigilant and report the matter if any member violates the resolution. It also cautioned the departments not to issue work order to unregistered NCSU members and without inviting open tender system which is against the government standing order. The Action Committee of the union will organize a visit to all the development departments to check and verify if any works have been allotted to unregistered NCSU members or whether open tender system is followed or not, the release said. The Union also asked all the registered members under Dimapur unit who are yet to renew their identity cards to do it at the earliest. The office will remain open on every Wednesday.

The statement of head GBs of both the villages affirmed that Sugar Mill Nullah had been the traditional boundary between the two villages. Former deputy commissioner, Ukhrul once said that he would shift the mini-secretariat to Imphal and function there. He said that “Tangkhuls, including underground cadres were purchasable. Frontal organisations can be bought; a matter of few thousand bugs,” so on and so forth. While the community people do not expect such candid and uncultured remark from a respectable person like deputy commissioner, we need to re-examine why and what really prompted the DC to be as blunt and reckless as to keep the whole population as if they are his pocket money. It does sum up the entire spectrum of corruption level; and the deputy commissioner was at the helm of such affairs. Otherwise, what did he mean by ‘purchasable’ if he was not purchasing someone or all of the people there? In a small state like Manipur we need two governments to run the affairs. The first government asserts legitimate rights because they are people’s elect. The other government’s claim over the people varies on different counts: from the rights to self-determination to the right of secession from ‘a union’ based on historical as well as political merits.

But one thing is common:ultimatum for recognition to what each claim as inherent as birth right. The constitutional and legitimate government is not, as we understand, free from the other government(s). Either to run the government together or be totally segregated from one another is a matter of wise management; it involves seriousness and danger as well.However, the entire gamut of the businesses when prudently handled provides benefit: shifting accountability and freedom from law. Here it is never ‘long arm of the law;’ it is very low arm or short leg of the law. Therefore, our responsibility to tidying up the house is very simple: select appropriate mob either broom or brute and it will do the job; the job gets done, and that is the end of the Right to Information. We may account this as one of the factors to decide what berth or portfolio our people’s representatives deserve. The consequence is long forgotten. Once I spoke to a congregation: “experts say that fossil energy will be exhausted in fifty years’ time; and that the only source of energy will be wind and sunlight, save water. Therefore, we have to advice Union power Minister to create a department under one powerful Minister to be called as Sky and Firmament Minister.” I was a joker; I can be prophetic too.

Naga Jurisprudence

T

he contest between customary law and the State’s legal system has created a gap wide enough to be exploited to such an extent that justice is no longer delivered by either. The contest is not so much between the principles of customary law and the legal system, but rather, more at the level of function and interpretation, and their application and jurisdiction. Furthermore, because there is very little public knowledge and public clarity on this issue, there is confusion over the scope and jurisdiction of customary law. For instance, there have been on some occasions where rape cases have been tried by customary law, when in actuality, rape cases cannot be dealt with under customary law, because it falls under the State’s Criminal Procedure Code. Such inconsistencies have led to the dereliction or gap in how due process is applied that summarily amounts to justice being denied. In order to maximize the two legal components effectiveness, customary law and the State’s legal system need to be perceived and implemented as complementary processes. The differences and the real gap between customary law and the State’s legal system need to be reconciled within practicing legal institutions. The confusion over customary law’s scope and jurisdiction needs to be clarified. Academic law institutions will need to evolve a more vibrant and resilient evolution of customary law that is consistent with principles of universal law. Customary law in Naga society requires being critically evaluated and transformed into a jurisprudence that is consistent with the values and principles acceptable by international norms. However, it is important that the existing customary law remains founded on values, a jurisprudence, that is relevant to Naga life. Nagas need to be able to take what is good from the past and transform this knowledge into the present day relevance. As Thomas Sankara put it, 'we must be able to take from our past from our traditions - all that is good, as well as all that is positive in foreign cultures, so as to give a new dimension to our culture.' Further, the structures of the Naga legal system too must be consistent with international standards. Through this process Nagas would have the opportunity address their perspective of laws, conduct and institutions within a new comprehensive ethical framework of democracy, restorative justice, equality, respect and dignity. Considering the community nature of Naga society, the importance of customary law cannot be negated. It is equally important for customary law to be based on a jurisprudence that affirms and meets acceptable standards of law. Once the process for Naga jurisprudence has evolved, the prevailing inconsistencies can be addressed both at the functional, as well as the conceptual levels. Through developing our own jurisprudence, the Naga praxis of justice and liberty will be a steppingstone toward our shared future and a respectful coexistence.

Like Nothing On Earth

T

hough I am nearing 40, it remains an ambition of mine to climb a previously unclimbed mountain. I have in mind possible peaks in Bhutan, Sichuan and north-western Tibet—all of them elegant in their architecture and severe in their remoteness. But my first choice would be the shield volcano Olympus Mons. Its main slopes present little difficulty to the mountaineer, rising as they do at an average angle of five degrees. Its summit is a caldera, or collapsed crater, whose jagged upper rim requires no ropework to reach. Seen on a plan-view map, indeed, it appears to offer little obstacle to an easy ascent. Except that Olympus Mons is on Mars. I first heard of the mountain in a Pixies song: "Sun shines in the rusty morning/Skyline of the Olympus Mons/I think about it sometimes", yowled Black Francis, setting my teenage self dreaming. Research revealed its astonishing statistics: the second-highest peak in the solar system, three times the altitude of Everest, one hundred times the mass of Mauna Loa (the largest volcano on Earth), the size of Arizona in area, encircled by an escarpment up to eight kilometres high, and its peripheries engulfed by dust storms that can last for decades. The ludicrous notion of climbing Olympus Mons only occurred to me when I read Kim Stanley Robinson’s remarkable work of areology, "Red Mars" (1992). The first of a trilogy of novels, it begins in the year 2027, when a hundred-strong team of humans make landfall on Mars. Their task is to terraform the red planet from a frozen and irradiated wasteland into a habitable environment, ready to receive future waves of colonists from Earth. The most compelling aspects of “Red Mars” are not its hard-science details or political dramas, but its evocation of the awesome Martian landscape. For Robinson’s pioneers explore an authentic terra incognita. Their footfalls and tyre-tracks are the first to mark the Martian regolith. They are the first to witness the rich berry colours of each Martian dawn. There is a purity to their discoveries that is now impossible on Earth, where queues of climbers jostle and grump on the upper ridges of Everest, and every square mile of surface has been satellite-mapped. In an early chapter, a small team push north from their base near the Martian equator, heading for the pole. They wear mesh "walker" suits to prevent expansion bruising in Mars's minimal atmosphere, and breathe from backpack airtanks. For weeks they travel, passing through red deserts cratered by meteor strikes, and then a region webbed with dry-bedded canyons. Around latitude 60°, they enter the Vastitas Borealis, an immense lava plain of bare rock, which cedes ten degrees farther north to a band of dunes 500 miles wide, formed of hard-packed grey and purple dust. They watch sunset over this petrified sand-sea, while low in the sky hang two evening stars—Venus and Earth. At last, they enter the Chasma Borealis, a wind-carved valley whose floor is crunchy with CO2 frost, whose huge ice-walls are terraced by wind erosion and sublimation, and whose long tongue guides them deep into the Martian Arctic. Robinson narrates this epic journey as a kind of future history, telling it so calmly, and with such particularity, that it is hard to believe it has not in fact taken place. We have never reached Mars, of course, but for centuries we have projected our dreams—political, cosmogonical, aesthetic—onto it. To me, thanks to Robinson, it represents a last true wilderness, an extreme geography of hyperacids and thermokasts, and a realm of mineral marvels. Gazing at Mars through binoculars as it glimmers orange in the dark, I seek a glimpse of the true sublime, unattainable on our own polluted and post-natural planet.

Beyond sausages and poached eggs Fiction: Below are I the ramblings of am 30 years old now. Yet I look 40. I stay in a small hamlet near Darjeeling. It is basically a hamlet made up of tea garden workers. No, I do not own the land; they say it belongs to the tea garden. I am the driver of the Manager and hold a special position among my fellow workers. When I was four years old I lost my father. He had gone to get sausages from Keventer’s in Darjeeling for the then Manager. My mother used to tell me that the earlier Burra Sahib loved to have sausages and poached eggs for breakfast. My father was the cook of the Manager’s bungalow, and his prized possession; the Manager had filched him from a very famous restaurant in Darjeeling for a bottle of Glenfiddich, the restaurant owner’s weakness. Twelve years later on that fateful day, there was a meeting for Gorkhaland in Chowk Bazaar. The crowd got so excited by the Supremo’s speech that they were almost ready for action. The cops sensed the tension and opened fire. My father received a bullet to his chest. The packet of sausages still lay clutched in his hand when they brought him to the police station. The Burra Sahib never got to eat those sausages. Today I stand in Chowk Bazaar with thousands of people listening to the present Supremo. They say that this latest installment of bandhs and rallies has been caused by the Central Government’s decision to form the new state of Telengana. I could well understand why my father had stopped upon seeing such a crowd, but I do not really know if he was actually listening. It’s been twenty six years now and the fight for identity, the fight for land, the fight for Gorkhaland is still on. I wonder if anyone is listening. I am a class five dropout. I went to the local school in the mornings and did odd jobs at the Manager’s bungalow where my mother was given a job as a maid after my father’s death. Our Burra Sahib was a very benevolent man. He threw lavish parties at Christmas. We all looked forward to when his wife, an Anglo-Indian, would come with their children to celebrate Christmas at the bungalow. We used to bring the best Christmas tree and the children and their mother used to decorate it with different toys and tiny bulbs. All the Managers from the adjoining gardens and important people from Darjeeling used to come to celebrate Christmas at our Manager’s house. The lawn would be full of cars. Some had red lights on their roofs and belonged to bureaucrats and politicians. The other servants in the house used to say that they were all important people who had to be served well as our future was in their hands. I wondered how. But the songs and music of the party generally deafened these questions I had in my head. I used to wear my best clothes during this time. My mother used to neatly iron my Dashain clothes so that I could look presentable. I used to carry the trays of pakoras, meat balls, French fries and chips to the Sahibs (I never touched the sausages. I always felt that it was the sausages which took my father’s life). The Sahibs were always happy with me as I was smaller and quicker than the hired staff, and carried matches to light their cigarettes and a bottle opener for their beer. They used to say, “Grow up fast, your Sahib needs a driver. Learn to drive.” As for the Memsahibs, they used to stare at me very intently. For them, I was only ever the son of the cook who lost his life while getting sausages for the Burra Sahib. And so they often used to say “Grow up fast and become a good cook like your father.” They never told me to study. I always felt studying was useless. After all, they were important people and they knew

ow do we judge our nation's foreign policies? Can citizens bring standards of right and wrong to international relations? For followers of foreign affairs the debate lies between realists and liberals. Realists elevate the security of the state and the advancement of its interests as the unavoidable criteria for international action. Liberals more flexibly enhance security goals by promoting a peaceful global community through trade, cooperation and democracy. Realism's claim to creating a just world lies in accepting the "reality" of an anarchy of conflicting, sovereign states, moderating actions and rejecting crusades. Liberals more ambitiously seek to build a world of peace through greater economic and social ties, and the spread of democracy. Both approaches judge policies by their impact on their vision for international relations, ie. the security of independent states; the advancement of a democratic peace. Individuals' relations with other human beings, while acknowledged, is not central to their goals. Institutions act toward other institutions. But how people treat other people is basic to all our lives. The question remains how these approaches to policy reflect human nature and affect real people. Where can we find guidance to the human values affected by policies? Perhaps from unusual religious traditions including the practice of one monastery of Buddhist monks who have taken vows of silence unless their speech can pass through three gates/thresholds: Is the speech necessary? Is it true? Is it kind?

what was best for me. “My life was in their hands,” I thought. I had to grow up fast so that I could cook and drive for my Burra Sahib. So here I am, thirty years old. The Manager’s best driver. Three years back my new Sahib took me to Kolkata. He always talked about this great city. I went everywhere with him as his assistant and he introduced me to all his friends as his ‘Man Friday’. I did not understand what he meant by that, but from the reaction of his friends, I could well understand that he meant I was an important person, and I felt elated about it. What was strange to me though, was people in Kolkata always asking me where I was from. I didn’t understand what they meant till someone asked me where in Nepal my home was. Well, I couldn’t answer them as I only knew that I was from this small hamlet in Darjeeling. Every year on 15 August and 26 January we had the flag hoisting ceremony in our garden. I was always one of the most enthusiastic during these ceremonies. Whenever there were cricket matches between India and Pakistan, I always used to wear the Indian jersey my Sahib had given to me. I was proud that I was an Indian. So how could I answer from which part of Nepal I was? My father never talked of Nepal, nor had I ever been there. Sometimes, some local netas used to tell me that since those in the plains never considered us as Indians, we had to fight for the land we had lived in for generations. At first I did not believe them, but this trip to Kolkata opened up a bunch of questions, and suddenly the Gorkha in me was created. Questions began to germinate in my mind: why was I given the nationality of Nepal offhand? Why did my condition never change? Why could I only serve and never be a master in my own land? Someone told me the other day that the Government of Bengal never cared for us, and asked why the Governments in Kolkata and

Delhi were incapable of providing a basic necessity like water to Darjeeling, when the British could get the train to reach us some 130 years back? Why were there no good colleges, or a University? Why are the people who represent us in Delhi always from Delhi and not from our place? Why is the condition of the road so bad? Why is it that the national highway, which was brought down by a landslide a few years ago, is taking such a long time to repair? Why is it that even though Nepali is on the Eighth Schedule it is still considered a foreign tongue? They say that in 1956, the different states of India were created on the basis of language. What stopped them from making Darjeeling into a separate territory at this time? If Telengana can be created now, what is wrong in having Darjeeling as a separate territory? I do not understand the meaning of ‘Union Territory’, ‘Gorkhaland Territorial Administration’, or ‘Darjeeling Gorkha Hill Council’. However I do know one thing – that the Gorkhas have continuously been asked about their loyalties even though they have been living here for generations, serving masters in both Calcutta and in Delhi. Is it that while we are serving we must also be constantly questioned about our supposed native place? I have heard that there is a statue of Durga Malla in the garden of Parliament and that Ram Singh Thakuri, a ‘Gorkha’ created the music for Kadam Kadam Badaye ja and gave the musical notations for our National Anthem to the Army Band. I do not know if there exists any ‘Bengal’ regiment or a ‘Delhi’ regiment in the Indian Army. But I do know that there exists one called the ‘Gorkha’, which the entire world says is the most fearless. They say so and I have no reason to disbelieve them. So why does the ‘average’ Indian always want to know where I am from? Today, as I stand in Chowk Bazaar, I do not understand why our leaders are linking our identity crisis with the making of Telengana state. I have heard that there, they are fighting for a capital called Hyderabad. We do not want to take Kolkata, which is Bengal’s capital, so why do people in Bengal feel that we are trying to snatch away something that belongs to them? We do understand the anger when the strikes disrupt their holidays, but then right now we are fighting for something more important. We too love Darjeeling tea the way it is, and even if demand is granted there won’t be any change in its aroma or taste. But we too have grown, and want our own space in this beloved nation, one where we are not questioned about our identity and allegiance. As I walked away from the gathering, I wanted to cry. I felt jittery as the feeling of disempowerment and hopelessness started creeping into my mind. I did not know how I could face my Burra Sahib with these distraught thoughts. He had been always nice to me, but was worried these days since the tea garden and the factory had been locked up for over a month. Heading past Clubside and towards The Mall, I saw Keventer’s. It was locked. I walked past and entered a narrow alley. I knew the place where I could get fresh sausages. I knocked on the small creaky wooden door, and as it opened I went in and asked the old guy to give me a kilo of sausages. The rates were inflated, but I did not mind paying. I took the small packet that he handed to me and started whistling back to the tea garden. My Burra Sahib loved sausages and poached eggs for his breakfast. He was after all his father’s son. This happened not as a result of limited violence used by some protesters, but because the movement made it impossible for the government to demonstrate that it retained the consent of the people. Defections Defections from the Yanukovych administration, including the diplomatic corps, as well as from the police and from his ruling party, began after the regime used brutal force against the peaceful students on November 30. Yanukovych’s own chief of staff submitted his resignation immediately after that attack (a resignation that was not accepted) and then resigned again after his boss signed the anti-democratic laws on January 17. A number of mayors and governors all over Ukraine voluntarily resigned or were forced to resign by the people. Repeatedly protesters called on local security forces and the army to declare in public whether they were with the people. In December, retired Berkut officers and veterans called on their serving colleagues to act according to the Constitution and not use violence against demonstrators. Some Berkut police – particularly from western Ukraine – refused to follow the orders of their superiors at the interior ministry. Others in Kyiv came out carrying signs that Yanukovych was no longer their president. In one publicized instance, a young man who served in Berkut defected because, as he explained, he did not want to shoot his father who was on maidan. Local business leaders refused to pay taxes to the government arguing that their money should not be used to pay for thugs or police repression. Even in the stronghold of the Party of Regions – Dnipropetrovsk – two businessmen rebelled and allowed the uncensored news of their defection to be broadcast on local TV stations. In the final days of Yanukovych in Kyiv, thirty-six members of his ruling Party of Regions (a number that grew to seventy) decided to defect and join the parliamentary opposition in Verkhovna Rada, to vote for the law that ordered the withdrawal of security forces from the streets of Kyiv and their return to garrisons. Yanukovych could no longer rely on an obedient majority in parliament. On the same day, Yanukovych’s main henchman, Vitaliy Zakharchenko, the minister of interior fled to Belarus, and was joined by Yanukovych’s personal banker, Sergey Kurchenko. Their departures seem to have been hastened by a more serious defection: that of the Ukrainian army. During three months of civil resistance, Yanukovych had tried desperately to ensure the loyalty of the armed forces. He reportedly asked Ukrainian army officers to sign loyalty oaths to him, and anyone who refused was fired or reassigned. But in the end, loyalty oaths were not worth the paper they were written on. When generals refused to carry out Yanukovych’s orders, he demoted and reassigned the chairman of the joint chiefs of staff on February 19 and appointed a new chairman – a navy general - considered to be loyal to the regime. On February 20, the admiral ordered an immediate mobilization of four elite army brigades (two airborne and two navy) – all in all 2,500-3,000 soldiers stationed in the southeastern parts of Ukraine, and their immediate dispatch to Kyiv. On the same day the orders were issued, the deputy chairman of the joint chief of staff resigned in protest against the regime’s attempts to get the armed forces involved in the domestic conflict. Eventually, only one brigade of 500 troops left their location in Dnipropetrovsk on the day the orders came but the train that carried them was stopped by activists. They later blocked the roads to fend off another attempt to transport the same troops, this time by buses. Other brigades remained in their barracks. Once the parliament enacted the law to withdraw interior security forces from Kyiv in the late evening of February 20, the officers commanding the brigades used it to justify their decisions not to move their troops to Kyiv. It became obvious that Yanukovych had lost the means to put down the movement. Collapse Between February 18 and 20, almost 100 protesters were killed on the Maidan in Kyiv. With mayhem ensuing on February 19 as Berkut police and other interior security forces swarmed the capital, the government declared an all-out “anti-terrorist” operation against the demonstrators. The next day, however, the government began to crumble with increasing defections, and in the evening of February 21, Yanukovych fled Kyiv. In terms of the fundamental dynamic of how civil resistance can shred the legitimacy of an abusive government and then induce defections from its own enforcers and supporters, there is no serious discrepancy between the narrative of the collapse of the power of Victor Yanukoyvch in 2014 and the fall of Ferdinand Marcos in the Philippines in 1986, Gen. Augusto Pinochet in Chile in 1988, the communist politburo in Czechoslovakia in 1989, Suharto in Indonesia in 1998, Milosevic in Serbia in 2000, or Mubarak in Egypt in 2011. These regimes were very different, much less the societies in which successful civil resistance was organized and mobilized. But the forces that took the form of nonviolent movements in these countries and the action they took were similar: an eclectic but united political coalition, growing and persistent numbers of ordinary people participating in coordinated tactics, challenging the regime’s legitimacy, capitalizing on the backfire from repression to accelerate the momentum of events, and spurring defections from the military and other leaders, even among those who were loyal almost to the end. In most successful nonviolent struggles, three kinds of violence at the tactical level can complicate the plans of the movement: free rider violence by bands of bellicose sympathizers, street violence by self-mobilized radicals, or organized radical flanks trying to embellish the narrative of a revolution they could then claim to have partly led. Two dangers are posed by undisciplined violent groups: violence in public space diminishes participation by the broader public and can therefore sap the force of a movement, and violence targeting regime defenders can annul the possibility of defections, without which few movements succeed against repressive governments. These effects were averted in Ukraine, because the claim of the movement that had taken shape in the Maidan last November - that it represented the authentic will of the Ukrainian people - could not be forgotten or dismissed by most onlookers. With that credibility and its resilience intact, the movement in Ukraine was not undermined by violent intruders before it succeeded in its primary mission: dissolving the consent of the people and the loyalty of regime defenders on which the authority and capacity of Victor Yanukovych to remain in power depended.

very individual or organisation has their own goals and desires which can be achieved only through efficient and effective management. Management in simple word means managing things (men, time, finance, resources) tactfully. Management refers to all those activities which are concerned with the formulation of objectives, plans and policies. According to Mary Parker Follett, a great management thinker’, “Management is the art of getting things done through others”. . Henry Fayol, another great management thinker believes that to manage is, “to forecast, to plan, to organise, to command, to co-ordinate, and to control.” Management is also a process (defined as a systematic way of doing activities to achieve the objectives) consisting of interrelated functions like planning, organising, staffing, directing and controlling.. Proper implementation of management makes a person or an organisation stand tallest amongst all. The word ‘Management’ is a huge subject. It carries different meanings, depending on the context in which it is used. Here, I would like to stress on some areas which will be important for an individual in achieving its goal and its contribution towards the society or organisation. The need for an importance of management to become successful in life, assumes great significance. It requires a special skill and knowledge to seek the fullest co-operation to achieve one’s objectives set by an individual or an organisation. Management is important for an individual or an organisation because it helps in achieving its goals and objectives through effective utilisation of time and different resources. Those Organisations that performs management functions effectively, survives. The success of an organisation, both formal and informal, depends largely on how well the various activities and resources are managed, planned and organised. Likewise, the success of an individual depends on how effectively he/she manages the activities of life. Management exist everywhere. In fact, each one of us practices management in every walk of our life, but the fact is, we don’t actually realise it. When we hear the word ‘management’, the first thing that comes to our mind is business or managing money or finance or human resources. We must realise that management is not only for institutions, organisations or companies but it is also related to our personal life. When I mention this, some of us will question how do I exercise managerial functions? But the fact is, everyone, irrespective of our different profession, job or position, performs management, starting from our own doorstep. As rightly defined by Louis Allen, ‘Management is what a manager does’. Every individual is responsible for one’s own life, depending on how one decides, plans and implements its objectives. We are all managers of our own life as we are all managing our life in our own way. Our success will be determined by how effective we use our management skills in dealing with different situations of life. Parents have the responsibility of bringing up their children as well as managing their activities. Parents perform managerial activities to a large extend. They have to manage their time for their work, for their children, and other social responsibilities as well. Parents should guide their children in a way that they get the right thing at the right time, and also at the right place. If their managing skill is effective, their children will grow up to be responsible citizens, else the wheel will turn the other way round. Parents should realise the interests and capabilities of their children, nurture them and point them to the right direction, where they best fit. Students are the ones who need proper management in every aspect of life. Every morning, they manage themselves by standing in front of the mirror, to groom themselves and make sure that their uniforms are immaculately put on for the class. If all these formalities are not taken care of, the whole thing will be a mess. In order to be a better performer, one needs to be a responsible student. They need to know how to manage their time, studies and other co-curricular activities. In the end, those students who manage well will excel in every area of life, for instance, in academic, sports or in any other co-curricular activities. Even teachers, preachers, bankers, businessman, administrators, social workers or any other profession requires management so as to flourish in his/her work, as well as in personal life. They should manage their time and resources (human and non-human) efficiently in order to achieve the desired goals. Proper planning, organising, executing and controlling are mandatory in attaining greater heights of goals. Management is, therefore, basically concerned with getting things done at a right time with the right resources and at the right place. SC sends Subrata Roy to judicial custody

New Delhi, March 4 (iaNS): The Supreme Court Tuesday sent Sahara chief Subrata Roy and two directors of his company to judicial custody till they present a concrete proposal to return the balance of Rs.19,000 crore they had collected from investors through optionally fullyconvertible debentures. The money through OFCD was mobilised by two Sahara Companies - Sahara India Real Estate Corp Ltd and Sahara Housing Investment Corp Ltd. The court has fixed March 11 as the next date of hearing. Sahara in December 2012 had deposited Rs.5,120 crore with the Securities and Exchange Board of India (SEBI). Directing the judicial detention of Subrata Roy and two other directors Ashok Roy Choudhary and Ravi Shankar Dubey - the court noted that despite being given sufficient opportunities, there was no proposal to “honour” its Aug 31, 2012 judgment and the subsequent orders of Dec 5, 2012 and Feb 25, 2013, to return the investors’ money. “In exercise of the powers conferred under articles 129 and 142 of the constitution, we order detention of all the contemnors, except Vandana Bhargava (the fourth respondent) and send them to judicial custody at Delhi, till the next date of hearing,” said the bench of Jus-

BIMSTEC leaders set year-end deadline for trade pact Nay Pyi taw, March 4 (iaNS): Mindful of the delays, the two-day BIMSTEC Summit concluded in this Myanmar capital Tuesday with the leaders now setting a year-end deadline for a free trade pact among the sevennation grouping. In a declaration, the leaders, including Indian Prime Minister Manmohan Singh, directed the negotiating committee to expedite work for concluding the Agreement on Trade in Goods by the end of 2014. In 2004, the finance and trade ministers of the BIMSTEC countries had agreed to establish a free trade area by June 2012. A few years later, the deadline was advanced to June 2010. But differences over issues such as tariff lines and quantum of concessions have kept the proposed pact from being inked. The agreement, when signed, will lead to reduced tariff on commerce among the member countries as also liberalise trade in goods, services and investment.The grouping comprises India, Sri Lanka, Thailand, Myanmar, Bangladesh, Bhutan and Nepal. The declaration also said the trade committee must continue its efforts for early finalization of the agreement on services and investments, besides the pacts on settlements of disputes and assistance in customs matters.

waShiNgtoN, March 4 (Pti): Laxmi, a victim of acid attack and a standard-bearer for the movement to end acid attacks, has been selected by the US for prestigious International Women of Courage Award. Laxmi will receive the award from US First Lady Michelle Obama at an awards ceremony at the State Department. She was 16 when an acquaintance threw acid on her face while she waited at a bus stop in New Delhi’s busy Khan Market in 2005, disfiguring her permanently. Her attacker, a friend’s 32-year old brother, planned to use the acid to destroy Laxmi’s face after she refused to respond to his romantic advances. “Many acid attack victims never return to normal life: they often go to great lengths to hide their disfigurement, many forgo education or employment rather than appear in public, and suicide is not uncommon. But Laxmi did not hide,” the State Department said. “She became the standard-bearer in India for the movement to end acid attacks. She made repeated appearances on national television, gathered 27,000 signatures for a petition to curb acid sales, and took her cause to the Indian Supreme Court,” it said. “Laxmi’s petition led the Supreme Court to order the Indian central and state governments to regulate immediately the

sale of acid, and the Parliament to make prosecutions of acid attacks easier to pursue,” the State Department said. “Much is left to be done, and Laxmi continues to advocate on behalf of acid attack victims throughout India for increased compensation, effective prosecution and prevention of acid attacks, and rehabilitation of survivors,” it said. An opinion piece in the Global Times said emerging economies such as India and China have been shaken by the global financial crisis, and that weakened their influence in the reform of global governance. India and China together can get more respect from the West than if they remain rivals, the daily said. Echoing the success of the 17th India-China special representatives’ meeting on the boundary question and the annual defence and security consultation last month, the daily said both nations will see a few rounds of economic and strategic talks this year. The leaderships of China and India have drawn lessons from the past, and were determined to resolve controversial issues such as the border problem, it said. Both sides have reached a consensus to control the elements that might trigger tensions along the border, the daily asserted. “Peaceful and friendly cooperation is a positive factor in the changing international situation. Health ministry ends invasive tests on rape victims NagPUr, March 4 (Pti): The Union Health Ministry, which has drawn new guidelines for treating rape victims, has asked all hospitals to set up a designated room for forensic and medical examination of victims besides outlawing the two-finger test performed on them, dubbing it as unscientific. The Department of Health Research (DHR) along with Indian Council of Medical Research (ICMR) with the help of experts formulated this set of national guidelines for dealing with criminal assault cases, which will hopefully put an end to the “horrendous” medical process, which the victims are subjected to after the sexual abuse. The DHR has also drafted a new manual to address the psycho-social impact of sexual violence including counselling that the victims should receive to alleviate her woes. These guidelines have been made available to healthcare providers who work with victims of sexual violence. A experts’ group on Gender and Health was formed by Dr V M Katoch, Secretary to GOI-DHR and Director General ICMR in November 2011 under the chairmanship of Dr M E Khan (Secretary, Sexual Violence Research Initiative) to for-

mulate these guidelines which can be used at Primary Health Centres and district hospitals whenever a rape victim approaches them. Later, Indrajit Khandekar, incharge Clinical Forensic Medicine Unit (CFMU) & Associate professor at Mahatma Gandhi Institute of Medical Sciences (MGIMS) Sevagram-Wardha (on whose study report titled “pitiable & horrendous quality of forensic medical examination of sexual assault cases” a PIL was filed in Bombay High Court) was given the responsibility to draft these guidelines. The guidelines drafted were made available to public and experts and their opinion was sought. Following this, the guidelines were released for circulation on December 16, 2013. Dr. Khandekar, who pursued the matter single handedly, told PTI that he had successfully impressed upon the state government on how to handle such cases and now at national level too, the Centre has come out with fresh guidelines. “It has been observed that the rape victims are usually put under a horribly judgemental microscope from the moment they call up the cops. They are often subjected to judgmentally attitudes by

both the doctors and other medical staff in the hospital. The new guidelines include that every hospital must have a designated room to deal with Medico Legal Cases (MLC) of sexual assault to provide privacy to the victim and must have essential equipments listed in the guidelines,” he said. There must be provisions to provide alternative clothing for the victims and smooth collection of MLC evidence keeping in mind the sensitivity of the circumstances. Also, there must be training sessions for sensitising doctors and other medical staff for the protocols and guidelines for MLC examination/reporting of such cases, it has been outlined. As per the guidelines, while carrying out medical tests no third person must be present in the room other than the doctor. If the doctor is male, a female attendant must be there, Dr. Khandekar said. The new set of rules also provide comprehensive care which must address issues such as physical injuries, STDs, HIV, Hepatitis B, etc. Also the psychological effects must be recognised and the patient shall be provided counselling, social support and appropriate referrals, it said.

The maligned two-finger test that was used by doctors to opine whether the girl is habituated to sexual intercourse or not, has been outlawed and the manual recognises that it is no way scientific and shall not be performed. Doctors are asked not to use word rape in their opinion, as it is a legal definition and not a medical diagnosis. For the first time, names of samples, its preservative and purpose of analysis for forensic lab has to be printed itself on the form before sending it to FSL (forensic science lab). This will avoid inadequate preservation of sample and analysis of sample for wrong purpose, the guidelines said. A provision for DNA analysis has also been done. A separate form for medical management as a check list has been provided too. In the past, rape survivor examination was done only after receiving police requisition. Now this is not mandatory for a rape survivor seeking medical examination and care. The doctors should examine such cases without an FIR if the survivor reports to the hospital first. Also, it is now mandatory for the forensic medical report to state precisely the reasons for each conclusion.

Military force would be “last resort” in Ukraine

MOSCOW/KERCH, MaRCH 4 (REutERS): President Vladimir Putin said on Tuesday that Russia saw no need to use military force in the Crimea region of Ukraine for now, in remarks apparently intended to ease East-West tension over fears of war in the former Soviet republic. The use of force by Russia in Ukraine would be a choice of last resort, Putin said, and sanctions being considered against Moscow by the West would be counter-productive. Putin told a news conference at his state residence outside Moscow there had been an “unconstitutional coup” in Ukraine and ousted leader Viktor Yanukovich, an ally of Russia, was still the legitimate leader of the country despite giving up all power. Earlier on Tuesday, Putin ordered troops involved in a military exercise in western Russia, close to the border with Ukraine, back to their bases. Ukraine said observers from the Organization for Security and Cooperation in Europe, a pan-European security body, would travel at its invitation to Crimea in an attempt to defuse the military standoff there. WESTERN RESPONSE The United States has begun spelling out its response to Russia’s incursion, announcing a suspension of all military engagements with Russia, including military exercises and port visits, and freezing trade and investment talks with Moscow. rity advisers on Monday to discuss how the United States and its allies could “further isolate” Russia, a White House official said. “Over time this will be a costly proposition for Russia,” Obama told reporters. The State Department said the United States was preparing to impose sanctions on Russia, although no decisions had yet been made. Russian forces shipped three truckloads of troops by ferry into Crimea after taking control of the border post on the Ukrainian side, Ukraine’s border guards spokesman said. Vladimir, a 50-year-old cab driver, said people do not want the Russians to leave. “When they are here, it is safer,” he said, voicing the opinions of some in the region who fear a return to the chaos in Ukraine after the collapse of the Soviet Union. Kiev’s U.N. ambassador, Yuriy Sergeyev, said Russia had deployed roughly 16,000 troops to Crimea since last week. Both sides have avoided bloodshed, but the market turmoil on Monday highlighted damage the crisis could wreak on Russia’s vulnerable economy, making it harder to balance the budget and potentially undermining business and public support for Putin. Exiled Uighur leader urges calm Thailand may extend state of emergency

BEIJING, MaRCH 4 (REutERS): A prominent exiled Uighur leader has urged China’s government to respond calmly to a knife attack in southwestern China and not “demonise” ethnic Uighurs after Beijing blamed the mass killings on extremists from the far western region of Xinjiang. Rebiya Kadeer, President of the World Uyghur Congress, also said tension could only be reduced in Xinjiang if China acknowledged rights issues the large Uighur minority faces. China has vowed to crack down on what it says are militants bent on transforming Xinjiang into an independent state called East Turkestan. But it has also emphasised ethnic unity after what it described as a terrorist attack on Saturday in Kunming in which 33 died, including four assailants. Many Muslim Uighurs object to Chinese curbs on their culture and religion, though authorities say they enjoy broad freedoms. “At this time of heightened tensions, it is important for China to deal with

the incident rationally and not set about demonising the Uyghur people as state enemies,” Kadeer said in the Englishlanguage statement, using the group’s spelling for the Uighur minority. “The fact remains that peaceful dissent against repressive government policies targeting Uyghurs is legitimate, so the Chinese government must not conflate this constructive criticism with the events of 1 March. “It is absolutely vital the Chinese government deal with the longstanding and deteriorating human rights issues facing Uyghurs if tensions are to be reduced.” Kadeer is a former Chinese political prisoner accused of leaking state secrets in 1999 who left China on medical parole and settled near Washington with her husband and part of her family in 2005. She previously had been a celebrated millionaire who had advised China’s parliament, and is now condemned by Beijing as an “anti-Chinese splittist”. The statement added that the World Uyghur Congress

“unequivocally condemns the violence that took place at Kunming railway station” and expressed condolences to victims’ families. The government has not explicitly accused Uighurs of carrying out the attack, though by calling them Xinjiang extremists the implication is clear. The one person identified by Beijing as being an attacker, Abdurehim Kurban, appears to be Uighur, judging by his name. In Kunming, capital of the southwestern province of Yunnan, many hundreds of km from Xinjiang, members of the small Uighur community have said they felt under suspicion. The government has responded with anger to suggestions that its policies may be to blame for violence in Xinjiang, saying that it faces a real threat from “terrorists”. Fu Ying, spokeswoman for China’s largely rubber-stamp parliament, which opens its annual session on Wednesday, told reporters that the Kunming attackers were “inhuman” killers and that the world should unite to combat terrorism.

BaNGKOK, MaRCH 4 (REutERS): A state of emergency in Bangkok could be extended until anti-government protests end completely, Thailand’s foreign minister said on Tuesday, adding that he feared more violence even though the protests had subsided. Protests aimed at overthrowing Prime Minister Yingluck Shinawatra are in their fifth month but at the weekend the remaining protesters closed down several big protest sites and moved to a central Bangkok park. “If Suthep continues with his protest and there are more violent incidents, including grenades thrown, shootings and acts of violence by provocateurs, the emergency law will have to stay until the situation improves,” Foreign Minister Surapong Tovichakchaikul told reporters. The protests are led by Suthep Thaugsuban, a former deputy prime minister in a government led by the Democrat Party, now the main opposition party. “We will wait for security forces, the army and the cabinet to de-

cide before the emergency expires on March 22,” Surapong said. The government imposed the 60-day emergency in Bangkok on January 21 to prevent an escalation of the protests ahead of a general election on February 2, which nevertheless was disrupted. Ancient virus revival poses threat to humans

LONdON, MaRCH 4 (IaNS): A 30,000-yearold giant virus frozen in ice has been revived owing to global warming. Scientists now warn that melting ice around the world could uncover new biological threats to human or animal health. The research team incubated a 30,000-yearold Siberian permafrost core sample taken from coastal tundra in Chukotka, near the East Siberia Sea, with acanthamoeba castellanii -- a common host of giant viruses. They found the presence of a giant virus particle known as a pandovirus, a type previously unseen. The find could reveal viruses are far more diverse than previously thought -- and warn that ancient viruses could affect humans. According to a statement issued by France’s National Centre for Scientific Research (CNRS), the work shows that viruses can survive being locked up in the permafrost for extremely long periods. The team of French and Russian researchers identified the virus by taking a culture of amoebas found in the permafrost. It is so big - 1.5 millionth of a metre - that it can be seen through an optical microscope rather than the more powerful electron microscope. “It has important implications for publichealth risks in connection with exploiting mineral or energy resources in Arctic Circle regions that are becoming more and more accessible through global warming,” said CNRS in media reports. The researchers warn that rising temperatures could release more viruses from areas such as Siberia. They believe the finding could mean there are far more diverse types of virus than previously thought.

PrETOrIA, MArCh 4 (AP): The first witness in the Oscar Pistorius murder trial broke down in tears on Tuesday, saying she still remembers the terrified screams of a woman on the night the double-amputee Olympic athlete killed his girlfriend by shooting four times through a toilet door. Michelle Burger, who lives near Pistorius' home and who had been composed through two days of grueling cross-examination, wept as she finished her testimony. Earlier the trial was interrupted and the judge ordered an investigation into allegations that a South African television channel was broadcasting a photograph of Burger - against a court order guaranteeing privacy to witnesses who request it. Gerrie Nel, the prosecutor, asked Burger about her emotions at the time when she made her statement to police. "It was quite raw," Burger said, her voice breaking. "When I'm in the shower, I relive her shouts," she said of hearing the woman screaming before the sound of gunshots in the pre-dawn hours of Valentine's Day last year. Burger lives about 177 meters (193 yards) from Pistorius' house. Nel asked her how she was coping. "I'm coping fine," Burger said. "It's

been a year." Burger's testimony about events on the night of Feb. 14, 2013, contradicts the Olympian's story. Pistorius says he shot four times through a toilet door, hitting Steenkamp three times in the head, arm and hip or side area after thinking she was a dangerous intruder. He pleaded not guilty to the murder charge lodged by prosecutors, who say Pistorius intentionally killed Steenkamp. During cross-examination of Burger, Pistorius lawyer Barry Roux insisted the university lecturer was mistaken in saying that she heard a woman screaming and that she actually had heard Pistorius screaming for help in a high voice after accidentally shooting Steenkamp. Giving sometimes grisly details of the 29-year-old model Steenkamp's killing, Roux said Steenkamp had been shot in the head, which would have resulted in brain damage and "no cognitive function" and so she wouldn't have been able to scream just after the last bullet struck, as Burger testified. "With the head shot, she (Steenkamp) would have dropped down immediately," Roux said. Burger disagreed. "I heard her voice just after the last shot," she said. "It faded away."

The 24th Naga Style, 9th Senior & 5th Junior Freestyle Wrestling tournament of the Nagaland Wrestling Association (NWA) got underway here today at Kohima Local Ground with Neiphiu Rio, Chief Minister & President of Nagaland Olympic Association (NOA) as the chief guest. Addressing the gathering, Rio lauded NWA for upholding and preserving the oldest traditional and indigenous sport of the Nagas, i.e., wrestling. Calling Naga style wrestling “a very popular indigenous game,” Rio vouched for protecting the game and further advocated enhancing the game’s popularity to the world. The Chief Minister pointed out that the state government is serious about protecting and promoting Naga style of wrestling. In this regard, he urged NWA to give more efforts to promote Naga indigenous wrestling at a national as well as internation-

al level. He also called upon NWA to make documentaries on Naga wrestling to showcase to the world. To promote sportspersons, the state government in its cabinet meeting had earlier decided to promote Chekrovolu Swuro to the rank of DSP. Rio, lauding Chekrovolu Swuro for becoming the first Naga lady olympian from Nagaland, stated that Swuro is an inspiration to sports lover for reaching the highest level. Earlier, NWA president Nikhrolo Khalo in his address stated that wrestling is a favored indigenous game nationwide. “Though the styles and techniques are different, Naga style is one of the most unique and fairest games,” Khalo stated. He informed that in free style wrestling for the national level, the NWA conducts free coaching camp from time to time for cadets (16-18 years), Juniors (18-20 years) and senior (20 years and above). Khalo stating that the nation today needs sports person further added that there is vast

scope and avenue for employment through sports. Keku Zeliang, former NWA president lighted the tournament torch with reigning NWA champion Kezhalelie Keretsu as torch bearer. Administration of oath was administered by NWA technical secretary Hukhoneyi Soho. Altogether, 54 wrestlers, from Chakhesang Wrestling Association (CWA), Angami Sports Association (ASA), and Zeliang Wrestling Association (ZWA), are vying for the coveted championship title under Naga style. Meanwhile, free style wrestling will commence on March 5. Free style weight categories to be conducted include: Senior: Men- 55, 60, 66, 74, 84, 96 and 120 kgs; Women- 48, 51, 55, 59, 63, 67 & 72 kgs. Junior: Men50, 55, 60, 66, 74 & 84 kgs; Women44, 48, 51, 55, 59, 63, 67 and 72 kgs. 28-year-old Atoto Kire representing Angami Wrestling Association (ASA) today emerged as champion of the coveted Naga style wrestling which took place at Kohima Local Ground under the aegis of Nagaland Wrestling Association (NWA). Standing 6 feet and weighing 85 kilos, Kire son of Sizo Kire from Kigwema village, bagged a cash prize of Rs 2 lakhs sponsored by 1st class contractor Rokolhou Angami. Kire beat Rovilhoulie Pier in the pre-quarters, and Visevo Zashumo in the quarter finals. He then defeated Vevohu Swuro in the

semifinal to enter the final. In the final, Kire defeated Vekuzo Vezhu (29) representing Chakhesang Wrestling Association (CWA), to become champion of the 24th Naga Style Wrestling Championship. Vezhu, son of Vecuta Vezhu from Khomi village, stood slightly shorter then his champion opponent at 5’10 but weighed 5 kilos more at 90 kg.
