2 officials arrested in ‘pension fraud’ Morung Express news Kohima | July 18
Two officials from Treasuries and Accounts Department at Zunheboto were arrested last week in connection with pension fraud in the State government. An FIR was lodged by the office of the Accountant General after detection on manufacturing of false pension orders. This was confirmed by V. Kezo, OSD (Budget), Finance Department, in a telephonic conversation with The Morung Express. He stated, “Our officers and directorates will be asked to carry out inquiries. We are beginning to start official inquiries from our end. We will find out (details) in a short time.” The fraud, which is said to have scammed the exchequer of more than Rs. 100 crore, emerged as a result of a special audit carried out by the Accountants General’s office, and is said to involve bank officials, national workers, retired officials among others. Further investigation is currently in process, stated an official source.

DimapuR, June 18 (mexn): Accusing the State government of “decimating” the power of State Vigilance Commission (SVC) to a mere “paper tiger” without any legal authority, the Nagaland Tribes Council (NTC) today urged the government to restore its power within two weeks time. In a representation to the Chief Secretary, Government of Nagaland, which was released to the media here through its President Lendinokdang Ao and Convenor, Committee on SVC, Theja Therieh, NTC flayed the State Government for decimating the lawful authority of Nagaland SVC by a resolution passed on June 8. The June 8 resolution is found to be “detrimental” to the interest of the general public as there should “always be an authority acting as a deterrent to corrupt activities in the State,” NTC argued demanding urgent restoration of adequate powers and jurisdictions to the anti corruption bureau. “The NTC expects the Government to rectify the anomalies committed in the resolution in question within two weeks time,” NTC stated adding that it will be will be compelled to take the issue to the next level if the government remains “insensitive to the demand tabled.” Justifying its demand, the Council drew the Chief Secretary’s attention to the first formation of Nagaland SVC through a resolution passed on April 9, 1976 in line with the Union Home Ministry’s establishment of Centre Vigilance Commission on February 11, 1964 based on the recommendation of K. Though not “specifically referred,” the Council thus alleged that the June 8 resolution has also “emasculated” the clauses 2 and 5 of the April 9, 1976 Resolutions which stated that the SVC “will not be subordinate to any department and will have the same measure of independence and autonomy as the State Public Service Commission.” However, the Chief Secretary, Govt. of Nagaland, has the overriding authority over the Commission “arbitrarily” in the amended version, NTC said. “Such dilution of the powers of the Commission will definitely hamper the efficiency of the investigative authority.” In this connection, NTC further observed that the June 8 Resolution has subjectively “divested the legal powers of the only investigative establishment in Nagaland for corruption.” The Commission has now become a “showpiece,” it noted, adding that reducing it to a ‘tiger paper’ is as good as winding up as “there is no necessity to have such Commission without legal investigative powers.” The NTC, therefore, urged upon the Government of Nagaland to restore the legal powers to the SVC by revoking the erroneous resolution without delay.

The Eastern Naga Students’ Union Dimapur (ENSUD) has stated that it is likely to agitate against the Nagaland State Government for its “non cooperative attitude” towards the full release of post-matric scholarship, a scheme of the Ministry of Tribal Affairs, Government of India. This was resolved at a joint meeting convened by ENSUD with students from eastern Nagaland affected due to non-release of scholarship, and their parents, held here at Town Hall on Monday. The students are currently studying in institutions such as University of Mewar, Divya Jyoti College, Adhunik College, International Group of Institution and Mewar Girls College. It may be mentioned the ENSUD had, in the last two years, admitted some 300 students from eastern Nagaland to undergo various technical and other courses in some private institutions and universities by assuring them that their admission and hostel expenses would be realized from the scholarship scheme of the Ministry of Tribal Affairs, Government of India, and that the students did not have to pay any money. However, many students were compelled to leave the institutions as they did not receive the assured scholarship to pay their admission and hostel fees. Earlier, ENSUD in a representation to Nagaland Chief Minister dated July 6, 2016, stated that ENSUD Education Initiative Committee in the year 201415 and 2015-16 had admitted Eastern Naga students in four colleges and one university under the post matric scholarship scheme of the Ministry of Tribal Affairs. “But due to non-release of full amount of scholarship, the students are facing lots of hardship and since all the students are from economically weaker section of the society, they are fully dependent on the early release of their scholarship and without that their studies will be jeopardized,” the representation stated. The Union also reminded that under the post-matric scholarship scheme of Ministry of Tribal Affairs,
any Scheduled Tribe (ST) student whose parent’s annual income is below Rs. 2.5 lakh is eligible to apply for scholarship provided she/he studies within India. They mentioned that the ST students from Nagaland have not received the full amount whereas ST students from other states in the same colleges and universities have received their full scholarship. Further, student representative from Mewar University, T. Thomas Konyak, said during their meeting with officials of Ministry of Tribal Affairs GOI, the officials had held the State Government responsible for not showing interest in the matter unlike other states and remarked that the Ministry of Tribal Affairs was willing to assist if the State Government shows interest. ENSUD in the representation had given July 9 as deadline for the Chief Minister to respond—while the CM had assured them of a reply within 10 days, no response has been forthcoming to date. Now, the Union has said it will be compelled to take its own course of action. At the meeting, the ENSUD also furnished copies of a communiqué of the Ministry of Tribal Affairs dated February 4, 2016, which stated that an amount of Rs.26, 46, 34, 161 (Rupees twenty six crore forty six lakh thirty four thousand one hundred and sixty one only) was to be sanctioned and released to the State Government of Nagaland as “full and final” installment under the scheme of post-matric scholarship to ST students for the year 2015-16. ENSUD expressed resentment that despite the representation to the CM and release of scholarship fund by the Centre, the affected students were yet to get their full share of scholarship. Both the former and present president of ENSUD briefed the parents and affected students on the steps taken so far by the Union in the fight for justice. Affected students and parents also gave suggestions on how to resolve the issue keeping in mind the welfare of the students. They questioned the State Level Committee set up for this for not coming up with any findings and reports. In the face of further silence, the students concluded that they were liable to agitate.

Lecture on Naga Writings in English MTLT and AKM take stock of
Kohima, July 18 (mExN): A lecture entitled, ‘Locating Naga writings in English in the culture – space of Naga society,’ was delivered at Sazolie College, by Dr. K. B. Veio Pao, on July 18. Dr Pao teaches English at Shaheed Bhagat Singh College, University of Delhi, and has recently published a book called, ‘Literary Cultures of India’s Northeast: Naga Writings in English.’ Addressing the faculty and students of the department of English, Dr Pao said that Nagas are living in very interesting and exciting times, and one very positive change that is taking place at present is the emergence of Naga writers. Naga writings draw a lot from oral tradition and they are told with a purpose, and so it is meant to teach and not only entertain, he stated. Commenting on the inclusion of Naga writings in

the Undergraduate English syllabus of Nagaland University, he said that young people studying within the state are fortunate because they are getting the opportunity to study about Naga
culture through these writings. He quoted several writers whose works are being studied by the students and said that Naga writings are important because they are relevant and
have context. He encouraged the students to value their culture and learn about it instead of blindly copying others and trying to be what they are not. He also asked them to go to the villages and elders and collect information about their culture and engage in research. “People have been writing about us, it is high time we write about ourselves. We have stories to tell”, he said. Dr. Pao also dwelt on several issues like education, religion, modernization and colonialism in the context of the Nagas and opined that certain misconceptions on these areas have to be corrected in order to appreciate and value one’s culture more. “Don’t let other people give you what you believe. Believe in what you have,” he commented. After the talk, various questions put forward by the faculty and students were answered and discussed at length.

Mozhui on July 18 to take stock of the latest status of the power outage problem in Mokokchung. According to the MTLT press release, the Mokokchung EE Electrical Division, N. Kohima, July 18 (DiPR): With a view to beautify and develop the area between Classic Island and Box cutting Junction, Kohima town, the Deputy Commissioner Kohima, Rovilatuo Mor, IAS has banned installation of hoardings/banners/advertisements within the said area with immediate effect and added that all hoardings/advertisements/banners presently installed shall be removed. The order also stated that the area from Classic Island till box cutting junction has been entrusted to Kohima Municipal Council (KMC) to take up aesthetic/beautification works. In this connection, any NGO/Organization willing to voluntarily beautify the area shall henceforth obtain a clearance certificate from the KMC. North east Briefs Thoubal shutdown affects life; KCP calls bandh Imphal, July 18 (NNN): Normal life was disrupted in Thoubal district of Manipur on July 18 as a result of a 48-hour shutdown call given by a Joint Action Committee (JAC) demanding the Manipur state government to bring all culprits to book and ensure speedy delivery of justice over the death of a local youth from Muslim-dominated Moijing village. The youth, Md Abdul alias Rahaman had succumbed after he was allegedly assaulted by unidentified persons on June 30 last. The JAC said it was compelled to call the strike as the Manipur Police have not been able to arrest the culprits despite continued pressure. Groups of bandh supporters obstructed vehicular movement along Thoubal-Mayang Imphal road since around 5:00 am placing flaming tyres and stones on the road. Religious, emergency and medical services were however exempted from the purview of the strike. Meanwhile, the Kangleipak Communist Party-Poirei Meitei Lup has announced a 13-hour state-wide shutdown beginning 5:00 am of July 20 to protest a number of anomalies in regularization of two Professors in the Jawaharlal Nehru Institute of Medical Sciences (JNIMS). According to a statement issued by the KCP-Poirei Metei Lup publicity secretary, Malemnganba Meetei, the Director of JNIMS has failed to come out with a white paper on the regularization process of Professors. Services of Prof. L. Deben, now Director of JNIMS, and Prof. M. Angouba were regularized by the Governing Council of JNIMS as they fulfilled the criteria laid down by Medical Council of India (MCI), Professor of Pathology Department, Y. Mohen had clarified recently. Prof Mohen said that they were regularized as per the resolution number 10 of the 21st Governing Council meeting of JNIMS Society held on February 15, 2015. But the KCP rejected the statement. The statement said the media, religious activities, electricity, water supply and emergency and medical services will be exempt from the purview of the shutdown.
Makhel village condemns ADC member’s action SeNapatI, July 18 (mexN): The Makhel Village Authority (MVA) has termed as “barbaric” the act of an Autonomous District Council member from Tadubi constituency with regard to an incident which allegedly occurred on the evening of July 16 at Vanee. The MVA in a press release alleged that the ADC member prevented a Shaktiman truck carrying electrical appliances to Makhel village from proceeding. During the incident, which occurred around 7:30 pm, the MVA added that the ADC member also assaulted the driver of the truck, while using abusive words targeting the chairman of Makhel village. Terming the alleged action as unbecoming of “A person who has the moral responsibility to safeguard and serve the people”, the MVA sought the attention of the authority in concern “to disqualify him from his position and book him as per law.”

Imphal, July 18 (NNN): The Working Committee of Apunba Lup, a conglomerate of 30 civil societies, recently pledged to continue its efforts and struggle to ensure justice for the victims of Armed Forces (Special Powers) Act (AFSPA) in Manipur. “Not a single personnel from the armed forces responsible for human rights violation has ever been punished here,” Apunba Lup coordinator Phulindro Konsam said. Phulindro pledged to take forward the movement by the Apunba Lup in order that AFSPA victims get access to the justice system.
He said, “The people who have been victimized by AFSPA and denied justice for decades will have to get justice. We’ll carry forward our dedicated struggle towards that end. They must get justice." Phulindro said many people have been killed and many more women have been raped and killed under the controversial Act which allows the armed forces to enjoy immunity. He reiterated that owing to the impunity not a single personnel from the state police, Army and paramilitary forces has ever been brought to prosecution which has been under stress in the state.
No compensation by Manipur government despite SC order: Kin
Imphal July 18 (IaNS): The Manipur government has failed to pay compensation of Rs 5 lakh each to the families of 28 persons killed in fake encounters, a member of one of the bereaved families claimed on Monday. Khumbongmayum Lata told reporters here that the state government counsel had also misinformed the apex court that the "compensation had already been paid". She said that the court had ordered the Manipur government and others concerned on December 8, 2015, to pay the compensation to the affected families within four weeks. Lata said that on July 13, the Supreme Court also ordered the government to pay an additional Rs 50,000 each to the bereaved families. She lamented that she along with others visited the state secretariat on Monday to enquire about the matter but returned disappointed since officials could not furnish any information and were busy passing the buck.

BJP-led Assam government on Monday said on the floor of Assam Assembly during the Budget session that a total of Rs 8,97,76,880 was spent for the helicopter tour of former CM Tarun Gogoi during his last tenure between the financial year 2011-12 to 2015-16. Replying a question of Asom Gana Parishad (AGP) MLA Utpal Dutta, Assam’s Forest minister Pramila Rani Brahma said on behalf of Assam CM Sarbananda Sonowal that for the former CM’s helicopter tour Rs 1,63,86,154 was spent in 2011-12, Rs 2,08,76,575 in 2012-13, Rs 73,49,680 in 2013-14, Rs 2,47,91,954 in 2014-15 and Rs 2,03,72,517 in 2015-16. The Court is hearing a Public Interest Litigation filed by Imphal-based Human Rights Alert and a victims’ group, seeking its intervention in the cases of 1528 alleged extrajudicial executions in Manipur from 1979 to 2012. In its ruling on July 8, it said that all the allega-
tions needed to be looked into, and offences committed by security forces could be prosecuted in civilian courts. It asked for more information about the cases. Proceedings will resume in four weeks. AND Oil India to pay Airlines to pay huge compensation ONGC higher royalty to states for cancellation or denying boarding From April 2003, New Delhi, July 18 (PTi): Cancelling a flight or denying boarding to a flier is going to cost heavily to domestic airlines as the new guidelines by the aviation regulator DGCA provides for massive compensation in such cases. As per the revised compensation norms, which are effective from August 1, an airline will have to pay up to Rs 10,000 to a flier in the case of cancelling/ delaying a flight beyond two hours, while the compensation for not allowing a passenger to board the flight stands at up to Rs 20,000. As of now airlines offer a meagre amount of up to Rs 4,000 for both denied boarding and cancelling a flight. The revised compensation has been arrived at after extensive consultations with all stakeholders including the airlines. Fliers body, Air Passengers Association of India (APAI)
founder and president D Sudhakara Reddy, however, has said that the new norms leave certain grey areas which need to be addressed. Airlines shall pay a compensation of Rs 5,000 or booked one-way basic fare plus fuel charge, whichever is less for cancelled/ delayed flights having a block time of up to one hour in addition to refund of ticket, in case a flier has not been informed by the carrier as per the DGCA norms. In the case of an airline cancelling/delaying its flight over one hour but up to two hours the compensation amount will be Rs 7,500 or booked one-way basic fare plus fuel charge, whichever is less, besides the refund amount, according to the revised norms. Romer will replace Kaushik Basu, 64, who is set to retire on when his term ends on July 31, the people said. A spokesman for the World Bank declined to comment on the decision. But World Bank economist Florence Kondylis in a Twitter message late on Saturday confirmed that the “rumors are correct” about Romer’s pending appointment.
Indian Railways to install solar panels in all railway buildings AMriTSAr, July 18 (ANi): Union Railway Minister Suresh Prabhu has said that in the near future, solar panels would be installed in all railway buildings across the nation. The Minister made this announcement on Sunday when he laid the foundation stone of one Megawatt solar power plant at the Amritsar Railway Station. The power plant, which would be set up at a cost of Rs 8 crores, will produce 14 lakh unit of power per year. Prabhu said that this plant will save Rs 1.40 crore for the railways. He said that the union government is focusing to produce solar energy from waste materials that would reduce the expenditure of the Railways on electricity, thus providing maximum facilities to the passengers during travel. The minister also said that the Railways has already successfully tested train to run at the speed of 180 kms per hour and work would now initiate to start high speed train between Amritsar and New Delhi.

It is also not transparent,” Reddy questioned. “Also, since no financial compensation shall be payable to passengers who have not provided adequate contact information at the time of making booking or when the ticket for firm travel on the selected flight is issued. This will lead to dispute settlement mechanism and which agency will be the responsible agency and in what time frame. This is especially true when it comes to transit passengers/connecting international passengers,” he said. Besides, the burden of proof concerning the questions as to whether and when the passenger has been informed of the delay of the flight shall rest with the operating airline, Reddy said adding, “This is a grey area and leaves the burden of proof in the hands of the airline and can t be accepted.
MuMbAi, July 18 (reuTerS): India needs to continue fine-tuning rules on collateral and interest rates to ensure financial institutions have enough incentives to keep lending to the poor, central bank Governor Raghuram Rajan said on Monday. Rajan said the Reserve Bank of India (RBI) would continue to look at the rules as it seeks to find a careful balance between the needs of the poor and the push for profits by financial institutions. As such, Rajan said the RBI may look at easing rules that at present prohibit taking collateral for loans below a certain size for some population segments, and reducing the ceiling rates for loans provided by micro-finance firms. “I am confident that in the foreseeable future we will bring formal financial services to every Indian who wants them,” Rajan said at a seminar on financial inclusion in Hyderabad, according to a copy of a speech released by the RBI. “Financial inclusion will be an important element in ensuring access and equity, necessary building blocks for the sus-
tainable growth of our country.” Rajan also said the RBI could be open to allowing individuals, including farmers, to declare personal bankruptcy to win a reprieve from debt, as long as this was used sparingly. A string of farmer suicides over deteriorating economic conditions have recently raised concerns in rural India. Rajan has been a big defender of financial inclusion during his tenure. He will step down from the RBI in September after stunning the country last month by saying he would not extend his term.

New Delhi, July 18 (iANS): Staterun explorer Oil and Natural Gas Corp (ONGC) stock fell nearly 5 per cent on Monday following the government decision that oil producers would have to pay royalty to crude oil producing states such as Assam, Gujarat, Andhra Pradesh, Rajasthan and Tamil Nadu at pre-discount rates. “It has been decided that ONGC and Oil India will pay royalty to all similarly placed crude oil-producing states at pre-discount prices effective February 1, 2014, pending the outcome of the special leave appeal filed by ONGC before the Supreme Court,” a petroleum ministry order said on Friday. The order implies that ONGC and Oil India are faced with an additional royalty burden of more than $1 billion, senior ministry sources said.

In this connection Petroleum Minister Dharmendra Pradhan has said: “We have decided Assam and oil-producing states will get additional royalty from ONGC and Oil India. Assam might get above Rs 1,400 crore.” ONGC has appealed in the Supreme Court against the Gujarat High Court order to pay Rs 10,000 crore to the state. In February 2014, the apex court stayed the high court order, but told ONGC to pay royalty at the pre-discount price starting that month. The government decision now means ONGC and Oil India would have to pay royalty to states based on their gross realisation on crude sales and not on the net price. It is the difference between gross and net price that is the subsidy burden borne by producers to compensate staterun oil marketing companies (OMCs) for selling sensitive petroleum products at below cost. From April 2003, ONGC started paying royalty to the central government for its offshore fields at the post-discount price, while for onshore fields, it paid royalty on the pre-discount price. While ONGC stock closed on Monday at Rs 219 a share, down 4.97 per cent on its previous close, Oil India closed at Rs 362, which was 3.04 per cent lower over its previous close on the Bombay Stock Exchange.

Must appreciate govt setting up SIT: NPF Youth Wing Kohima, July 18 (mExN): Referring to the controversy over the Special Investigation Team (SIT) set up to probe the fuel adulteration racket, the NPF Central Youth Wing today stated that instead of participating in the controversy it will be best if all cooperate and work out ways and means on not only how to bring the culprits to book, but also to prevent recurrence of such rackets in future. This statement comes in light of ACAUT Nagaland rejecting the SIT and censuring PHQ and NPF Central for issuing press release on the issue instead of the government. In a press release issued by its Media Cell, the NPF Youth Wing meanwhile said the efforts of the Dis-
trict Administration and the ACAUT volunteers in unearthing the racket must be appreciated by one. However, it also stated every right thinking citizen must appreciate the Government setting up the SIT to investigate if adulterated fuel is also being sold in other parts of the State, and to bring the guilty to book without any bias. The SIT must also expedite its findings so as not to prolong the matter thereby giving chance for the guilty to flee, suppress evidences or influence anyone, it added. The NPF Central Youth Wing further lauded TR Zeliang for setting up the SIT to “bring the guilty to book, stop the malpractice and deliver justice to the people.” The release point-
ed out that the malpractice has been reported even in the past, and complaints were lodged while some accused were also caught but released on bail or unconditionally. This, it said, must have emboldened the wrong doers and the magnitude of the racket, and the quantum of adulterated fuel being supplied to the outlets has assumed alarming proportions now. “Where preceding Governments have failed to do, or were unwilling to do, the present Government has taken a bold step and has initiated a move which can only, and should only, reach a logical and satisfactory conclusion. As is often said, credit should be given when due and to who it is due. After all, one
should learn not only to accuse, blame or criticise; one should also learn how to appreciate and cooperate at times,” it stated. The youth wing also said that through the initiative of the Chief Minister, the Government of Nagaland has decided to implement the National Food Security Act in the districts of Kohima and Dimapur by July this year, and to cover the remaining districts of the State by August. With proper implementation of NFSA, pilferage of SK Oil, presently used to adulterate diesel fuel, will be checked and the oil will directly go to the beneficiaries alone, the release stated, adding this will go a long way in checking fuel adulteration in the State.

On July 15, as per information provided by RTI applicants, the DoSE had been indicated to have “mismanaged” more than Rs. 73 crore meant for MDM. The Department clarified in a press statement from its Additional Director (HOD), Wonthungo Tsopoe, that “apart from the fund distributed amongst the SDEOs, which unfortunately was the only component pointed out as per the RTI disclosure, payment to the FCI for food grains, transportation costs for carriage of food grain from the FCI Depot to the SDEOs and the Management & Monitoring Expenditure (MME), which is 1.8% of the total outlay for MDM in a year, are incurred from the Directorate.” It further stated that there are “costs for utensils which are centrally procured from the Directorate for distribution to the schools.” “Expenditure for the other components thus
pointed out was not taken into account thereby presuming that funds to the tune of Rs. 73.00 Crores had been mismanaged,” declared the DoSE. It is, however, unclear why these details were not furnished in the RTI in the first place. The DoSE also found the allegation of “fund getting lost midway between the Finance & the School Education Department” as “preposterous” as funds received from the Government of India is “never handled in the manner as perceived by the RTI applicants.” “There are funds pertaining to MDM that are still with the State Government, however, these funds are released to the Department subject to proposals and request submitted by us and will neither be adjusted nor will it go missing since every penny that is received from the GOI is to be accounted for,” noted the DoSE. Noting that the Comptroller & Auditor General’s Report which was tabled in the Assembly had pointed out some anomalies and the same is “now under the examination State Assembly PAC and also the PAC of the Parliament,” the DoSE has chosen not to make any comment on the same.

Corruption and Social Relations
T
he debate over corruption is often dominated by moralist and judgmental viewpoints. And, in this sense, the discourse around corruption has been influenced by an attitude of ‘class.’ Therefore, corruption is often described as political ascendance of selfinterest which intensifies social, economic and political inequalities; loss of material and human resources; induces social fragmentation; creates conflict that propels a society into a constant cycle of institutional disorder and violence. This description of corruption, however, needs to be located with a historical and cultural context. Diverse experiences reveal the relationship between corruption, development and politics as demonstrated in the recent history of third world countries, particularly in Asian, African and Latin American. They show that corruption is not limited to systemic self-interest. In fact, despite its eroding effects, corruption is endemic to and institutionalized within the fabric of social, cultural and political relationships. Patrick Chabal and Jean-Pascal Daloz emphasized that, “Corrupt behaviour is, therefore, not only driven by greed and structural forces, but also by informal codes of conduct associated with reciprocity ties within particularist and communitarian social networks.” More broadly, corruption emerges from within many political and cultural structures in which it serves key hierarchical functions, thereby contributing to the political, as well as, the cultural status quo. In an ironic sense, corruption when ‘well—managed’ can contribute towards creating a sense of ‘political stability’ within a status quo of injustice. However, when corruption is “mismanaged” it may result in political stability and conflicts. This implies that when a situation is engendered by corruption, it is affected more by the “changes” in the pattern of corruption than by the existence of corruption itself. The relationship between corruption and political stability, or, for that matter, the interactive dynamic between corruption, conflict and peace is probably the most complex, and, yet, at the essence of the peace movement. At its heart, it means understanding the nature of corruption within its historical and cultural context, while keeping in mind that self-interest and self-preservation are not the only motivators of corruption. The most crucial aspect while engaging with corruption is to evolve a process to transform the relationship between corruption and cultural structures that function on informal codes of conduct and reciprocity within closely knit hierarchical networks and relationships. Perhaps addressing this difficult aspect of corruption presents the biggest challenge. In the Naga context, the political and cultural dynamics are not just re-enforcing one another, but, at times, they seem to indicate that they have become one monolithic force. This makes it all the more difficult to clearly differentiate the relationship between corruption and social, cultural relationships. However, if Nagas are concerned and determined to engage the question of corruption, they will need to go beyond identifying and naming the consequences of corrupt acts. The very relationships that corruption has nurtured with political structures and social, cultural relations and networks will have to be exposed as well. The first step is to carefully re-examine the dominant definition and framework of corruption!

In New Zealand, Lands and Rivers Can Be People (Legally Speaking)

an a stretch of land be a person in the eyes of the law? Can a body of water? In New Zealand, they can. A former national park has been granted personhood, and a river system is expected to receive the same soon. The unusual designations, something like the legal status that corporations possess, came out of agreements between New Zealand’s government and Maori groups. The two sides have argued for years over guardianship of the country’s natural features. Chris Finlayson, New Zealand’s attorney general, said the issue was resolved by taking the Maori mind-set into account. “In their worldview, ‘I am the river and the river is me,’” he said. “Their geographic region is part and parcel of who they are.” From 1954 to 2014, Te Urewera was an 821-square-mile national park on the North Island, but when the Te Urewera Act took effect, the government gave up formal ownership, and the land became a legal entity with “all the rights, powers, duties and liabilities of a legal person,” as the statute puts it. “The settlement is a profound alternative to the human presumption of sovereignty over the natural world,” said Pita Sharples, who was the minister of Maori affairs when the law was passed. It was also “undoubtedly legally revolutionary” in New Zealand “and on a world scale,” Jacinta Ruru of the University of Otago wrote in the Maori Law Review. Personhood means, among other things, that lawsuits to protect the land can be brought on behalf of the land itself, with no need to show harm to a particular human. Next will be the Whanganui River, New Zealand’s third longest. The local Maori tribe views it as “an indivisible and living whole, comprising the river and all tributaries from the mountains to the sea — and that’s what we are giving effect to through this settlement,” Mr. Finlayson said. It is expected to clear Parliament and become law this year. Visitors can still enjoy Te Urewera the way they could when it was a park. “We want to welcome people; public access is completely preserved,” Mr. Finlayson said. But permits for activities like hunting are now issued by a board that includes government and Maori representatives. A similar board will be set up for the river. Could this legal approach spread beyond New Zealand? Mr. Finlayson said he had talked the idea over with Canada’s new attorney general, Jody Wilson-Raybould.

HIV, AIDS and holistic healthcare: can spirituality and science meet?
T
he annual International AIDS Conference opens in Durban, South Africa, attended by over 20,000 people from around the world. The scope of the conference alternates each year from being a pathogenesis conference with very little social science input, to the one this year which includes community issues as well as science. This one has three largely scientific tracks, two largely social political and economic tracks, and one “cross track”. The conference theme this year is “Access, Equity, Rights Now” and there is already huge tension in the air around at least two issues. Firstly, there is the question of who may have these rights. At the UN High Level Meeting in June, there were considerable gains in recognition of women’s rights and the widespread harms of gender-based violence, such as in its capacity both to increase vulnerability to, and to result from, HIV. However, he meeting was also deeply marred by the exclusion of key populations - including lesbian, gay or bisexual people, trans* people, sex workers, people who use drugs, and others - from the process, and the limited recognition by UN and many governments alike of the issues these people face. Secondly, there is the question of what aspects of this conference theme people might gain access to. There is tension here because it has now been recognised that HIV medication taken by someone when they don’t have HIV can protect them from acquiring it. So there is a huge push for roll-out of this Pre-Exposure Prophylaxis (PrEP), from scientists and community activists alike. This is so that anyone who may be vulnerable to acquiring HIV might avoid doing so. Yet here is a slippery slope scenario. I have described this scenario in an earlier article on openDemocracy before in the whole debate around treatment as prevention (TasP), where people with HIV, especially women in the case of “Option B+” are encouraged to take HIV medication primarily to protect others. The new slippery slope now starts with the principle of individuals being offered well informed choice over if, when, and how long to take medication in the context of personal bodily autonomy. These well-intentioned strategies can quickly morph into a situation where individuals are being told that this is what they should do, and they can find themselves scorned and damned if they don’t. Once again, with Pre-Exposure Prophylaxis (PrEP), as with Treatment as Prevention (TasP), we are looking at a double-edged sword: there is the risk that medication is seen as the simple magical bullet, without consideration of the power relations involved in who gets to choose what is put in their own bodies – and the potential negative and positive consequences for them, both if they do, and if they don’t. Although the science now tells us that all of us who test positive for HIV should be encouraged to start on HIV medication straightaway, including PrEP for those who test negative, we humans have a complex relationship with medication which can’t be set aside. In particular, for the majority of women living with HIV, it is not just a question of the effects of the virus versus the effects of the drugs on our bodies: there are also the fundamental factors of gender-based violence and mental health in the equation. I was lucky enough to be able to choose when to start my own anti-retroviral treatment (ART). I waited for 8 years after I was diagnosed in 1992. Whilst I believe in the critical importance of treatment when someone feels ready to take it, I was not ready to take it before then, and may well not have managed to adhere to it as religiously as I have since 2000. It makes good gardening sense to prepare the ground before planting, to give seeds their best chance of survival. My very good health now means I do not even have to pay an HIV-related premium for my annual health insurance. So I am one example at least of where waiting until I felt ready for treatment has caused no apparent harm and may well have had a better long-term result. Until scientists include such key psycho-social factors in their trials, their findings are not yet fit for real life implementation. One simple example of this is the question of how women on PrEP are supposed to protect themselves from unplanned pregnancies and other sexually transmitted infections without continued condom use, since PrEP only prevents HIV transmission. Yet to date I have seen little substantive discussion of this. The question of who owns the rights to an individual’s bodily autonomy

he dark road to Peace in South Sudan began with the manner in which the Machakos Peace agreement was crafted. The political leadership of South Sudan, the Regional leaders of the The Intergovernmental Authority on Development (IGAD), the Africa Union and the International community must rise above their geopolitical interest and bring the suffering of the people of South Sudan to an end. For the most part, poor leadership and lack of political freedom have played a significant role in the current situation in South Sudan. The African Union has failed to provide political leadership in the continent of Africa. The African Union formerly known as the Organization of African Union (OAU), was founded in May of 1963 in the Ethiopian capital of Addis Ababa. On the eve of the meeting of leaders of newly independent Africa, one of their members, the elected president of Togo, was assassinated. His elected government was overthrown, the Constitution of Togo ”suspended” and a military junta was installed to govern the country. This tragedy was expressed only in the corridors of the hotel rooms and not in the conference hall; nor was a resolution of condemnation moved and debated. This week, African leaders will gather in the Rwandan capital of Kigali and again a new
once again becomes a stomping ground for those institutions or people with power – and pity help those without it. During this World Aids Conference openDemocracy will be publishing several articles addressing these on-going enormous challenges and others. However here I want to look at a wider perspective that is rarely mentioned - one that embraces the whole person as a sentient being, rather than one that views us just as passive recipients of medical interventions. Holistic healthcare is not new at all: traditional Chinese holistic approaches to healthcare have been around for millennia. But it is still very slow to be accepted by mainstream Western practitioners. Yet I am just one of many living with HIV who rely not just on our medication, but also on keeping a close eye on our diet, our exercise regime, and other stress-relief practices such as yoga and meditation and other spiritual practice – in its widest sense. Some HIV doctors and policy makers deride our interest in these complementary approaches to health and well-being as irrelevant at best, and really quite threatening at worst - dismissing them as subversive to the treatment roll-out mantra. Yet how can someone who does not even have adequate, let alone nutritious, food in their stomach, be expected to start and stay on treatment? Hippocrates wrote “let your food be your treatment and your treatment your food” 2,400 years ago. Yet the most recent World Health Organisation (WHO) anti-retroviral guidelines barely mention food, other than in one brief section. One colleague, a medical doctor and psychologist living with HIV, Heidemarie Kremer, has taken another route, publishing research that studied 177 people with HIV over 17 years, which shows that some people using spiritual strategies were 2–4 times more likely to survive. When women’s capacity to start and adhere to treatment can be affected fundamentally by factors such as gender- based violence and mental health, then if spirituality can help to alleviate these challenges, surely that is a huge asset. Spirituality is something which resonates strongly with many of us. Yet there is no funding in this line of research, and Kremer has now had to abandon academia for other pursuits. Another example of the wide breadth of riches that holistic healthcare has to offer, and the relatively tiny spot on this map that western healthcare offers, is provided by a wonderful book that my sister recently shared with me, that she learnt about at the Penny Brohn Centre for living well with cancer. This centre embraces a whole-life approach to cancer, alongside western treatment. Radical Remission, written by Kelly Turner, a Harvard and Berkeley trained psychologist, explores the nine most mentioned key factors identified by over 1,000 people with cancer whose stories she analysed, as alternative methods of healing: body, mind and spirit in-
terventions which may have led to a statistically unexpected positive outcome for them. These factors include radical changes to diet, taking control of our health, following our intuition, using herbs and supplements, releasing suppressed emotions, embracing social support, deepening our spiritual connection and having strong reasons for living. Since none of these factors have or can be subjected to the rigours of a randomised controlled trial (RCT), as all medication has to be, (and which scientists take as the gold standard for medical intervention), it is understandably all too easy for many western healthcare providers to dismiss these factors as quackery. Yet, as Turner explains, finding funds for an RCT of these factors, when they are normally funded by pharma (and no pharmaceutical company can see potential financial gains from patenting a specific trialled product), is nigh impossible, since it is thankfully not easy for them to take out a patent on a particular food or on yoga. I am not trying to draw simplistic parallels between HIV and cancer here. Whilst some people with cancer really do manage to recover spontaneously, to date there have only been fourteen people formally recorded to be in remission from HIV. Whilst HIV scientists accept that they really seem to be “functionally cured”, they use their existence to call for more biomedical research into an HIV cure, and for early treatment after diagnosis. There seems little consideration of whether other factors might be at play in keeping them well. I don’t think I am so lucky as not to need antiretroviral therapy (ART). So it will certainly remain a crucial part of my health strategy. I am just trying to explain that, as Kelly Turner states in her book, the pursuit of any or all of these complementary strategies will certainly not harm us, and may well enable us to stay happy, healthy and safe, when we decide if, when, and how long to take our medication. It is not easy airing these sorts of things in public. Even in the world of cancer, a holistic approach to healthcare is still mocked by many. In the world of HIV, it is even harder to discuss these things. Sadly my sister was not one of those fortunate few who found remission. But she did take to cancer with curiosity and creative thinking – determined to live life to the full with it, rather than be crushed by it. Whilst recognizing the importance and value of conventional treatment, she also decided to learn through her experience of living with cancer, to develop further her spiritual growth within., If nothing else, I want to learn and to grow from both my sister’s and my own experiences. For me, “access, equity, rights now” include my ability to take a holistic approach to my own healthcare. The drugs are hugely important but they are not – and will never be - the whole story. Inter Press Service tragedy unfolding in South Sudan will likely only be expressed in the corridors of the hotel rooms. In South Sudan, the political map will not show that the people of South Sudan have known only war, bloodshed and devastation for the last 30 years. The political map will not show that the state is now only geography, lacking government. The map will not show that the entire country has been covered up into gun suzerainties ruled by warlords. The International community has constantly ignored the voice of the people of South Sudan and instead listened to the voice of the gun men and some of the Regional leaders who have also come to power through the gun. These regional leaders and the Gun men are politically impotent. There is a need to change strategy for the sake of Peace.
When the gun began to replace the ballot as means to install rulers, massacres, devastations, and suppressions of human rights and freedoms became the leading force of governance in South Sudan. South Sudan’s political leaders, and their regional backers, should be held accountable for the atrocities committed in this young country, which has only just celebrated its five year anniversary. Besides the gun, violence and insensitivity to other people’s rights and freedoms, South Sudan’s leadership have developed the art of concealing their unsavoury motives and deeds into a very fine art. A situation which has laid hundreds of villages to waste and left homes, granaries, farms, schools, dispensaries and boreholes have been destroyed by both the soldiers of the regime and the rebels.

The agonies of the people and the loss of lives and property in South Sudan, Uganda and Burundi, are not isolated cases. In Africa, the oases of Democracy and observance of Human Rights and the voice of the African Union or the UN Security Council in support for their development are few, feeble and far between. The effort to sustain peace and unity in South Sudan is going to be a challenge to the political leaders of South Sudan, IGAD, the AU and the international community. A cursory examination of that unity and peace in South Sudan will be found to be hollow. The trickery and the disingenuousness in the provision of the current peace agreement cannot sustain stability in South Sudan. The fear of competitive politics in African countries like Uganda, Burundi and South Sudan is the leading cause of conflict. This fear, has developed in Africa into paranoia which has caused considerable unnecessary deaths and suffering in many African countries.. This instability in many African countries and especially the current situation in South Sudan, involving loss of lives, destruction of property, displacement of thousands of people and full scale violation of human rights will continue to be a major policy challenge for the international community. Relevance of Naga Morung Culture

he youth dormitories, under many forms and names, existed in a wide region of the world extending from the Himalayas and the Formosa in the North to the Australia and New Zealand in the South; and from the Eastern Pacific and Marquesas to the west coast of Africa. Thus this social institution is found among diverse races, now classed as distinct, such as Dravidians, Indo-Mongols, Malays, Papuans, Polynesians, Australians and Africans (Dongre 2013: 2). In North-East India men's houses are also found among the Abors, Mikirs, Garos, Lalungs and Lynngams, as well as among most of Kuki and Lushai tribes. In Nagaland Morung Institution is called differently by different tribes. It is known as ‘Ban’ in Konyaks, Kichuki in Angami, Arju in Ao, Chumpo in Lotha, Apuki in Sema, Renshe in Rengma, Chethiche in Chakhesang, Haku in Chang, Pang in Phom, Awikhuh in Pochury, Khiangyam in Yimchungru, Pon in Khiamniungan, Herangki in Zeliang and Singtang in Sangtam (Nshoga 2009:78). The Morung or the bachelor dormitory system was an essential part of Naga life. Apart from the family, it was the most important educational set up of the people. The prime education centre in Naga society was the morung (bachelors’ dormitory). The morung was an important educational institution for both the boys and girls. Much of Naga cultures, its customs and tradition have been transmitted from generation to generation through folk music and dance, folk tales and oral traditions, carvings of figures on stones and wood, and designs on clothes. It was also used as a guard-house during times of war. The Morung was the institution where the dignity of labour is taught, refine culture, rectified the personal shortcomings, and together they build strong society. It is observed that the morung acted as the guardian, a father, a police and the court of the boys. This institution is considered as the mother of art and culture. On account of this importance Anand observes, “The morung plays vital role in preparing younger generations in the village council. The morung is the club, the public school, the military training centre, the hostel for boys and meeting place for village elders. It is as well the centre for social, religious and political activities.” Like the boys’ dormitory, girls’ dormitory was also prevalent in most of the Naga villages, where the girls would stay in the dormitory after attaining puberty till they chose their life partners and settle in family life. During her stay in morung she would learn spinning, weaving, embroidery works, stitching, sieving, cooking, rice-brewing etc., from her senior friends. Besides, she would also come to know folklore and dances from senior girls. Apart from this learning, she would get lessons about good behavior, manner, character, morality and ethical code of conduct.
I
n October 2002, the Oxford Research Group were approached by a senior Middle Eastern Prince with strong working ties to Saddam Hussein. The Prince wanted to become an interlocutor to talk to Saddam Hussein as part of attempts to avert war. He proposed to explore whether the Iraqi ruler could be coaxed into a quiet passage out of his country, somewhat in the spirit of Napoleon to Elba. From previous experience he believed that he might have influence over that unpredictable and ruthless character, not least because of his Hashemite roots to the Kingdom of Iraq, founded in 1921 under British administration. He wanted to engage quietly behind the scenes, out of the glare of any publicity, but it was important for him that he had the authority and backing of the British government. This would be both clandestine and deniable, but it would give him an increased legitimacy in his negotiations. At the same time, Oxford Research Group was deeply troubled by the building momentum for the invasion of Iraq. Colleagues from the region understood the potential to unleash forces of instability and chaos that would destabilize the balance of power between Iran and Saudi Arabia, as well as creating the chaotic conditions in which Al-Qaida could flourish. Of course there was no certainty that the Prince’s initiative would have been successful, but perhaps what was most significant was the total lack of interest on the part of the British government to take such proposals seriously. They were dismissive and saw no traction in exploring it. It became clear that minds had been made up. A particular path was being pursued and alternative routes for engaging with Saddam Hussein were dismissed as naïve. Not only was the UK government deaf to advice from those who were from the region and therefore understood the politics, the culture, and the history in more depth, there was also a sense of hunkering down to prepare for the military option. In discussion it became clear that the UK government was holding to a tunnelvision. The Chilcot Report could not be more clear that “peaceful options were not exhausted”. Another potential opportunity was presented in December 2002, when a representative of the head of Iraqi Intelligence contacted a former head of CIA counterintelligence. The Iraqi official stated that Saddam knew there was a campaign to link him to the horrific events of 9/11, insisting that he had stockpiled weapons of mass destruction. This key informant added that the Iraqis were able to show these concerns were unfounded. This conversation was reported to senior officials in the State Department, but there was no real interest. ow that the Chilcot report has been published, do we know more than we already knew from previously published accounts of the Iraq war, its preparation and its aftermath? Does it throw any new light on the prospect of legal sanctions against those whom it has criticised? The answer to both of these questions is 'not much'. Nonetheless, there is enough information to map out the main avenues of that those seeking legal redress could pursue. Chilcot has not addressed directly the fundamental question: was the war illegal? This is understandable, as the Chilcot team included no lawyer. On 7 March 2003, Lord Goldsmith, then AttorneyGeneral, declared in the House of Lords that the United Kingdom would be acting lawfully if it attacked Iraq. The legal requirements for a legitimate attack can be simply stated. The UN Charter prohibits the use of force except in two circumstances. The first is self-defence – not applicable in this case. The second is where force is authorised by the Security Council. Lord Goldsmith’s argument was that the authority to use force given by the Security Council 12 years earlier during the first Gulf war, and which was followed by a ceasefire a few months later, could still be relied upon. (I investigated this claim in depth in a previous article). Yet in late 2002, the Government had given an assurance to the UN Security Council – through its representative Sir Jeremy Greenstock – that no force would be used without its further authority. Chilcot points out that by going to war in breach of this promise, Tony Blair undermined the authority of the Security Council. Without their authorisation, the attack was unlawful. The weight of expert opinion strongly asserts that there was no continuing or revived Security Council authority and that therefore the attack violated international law. Is Blair therefore criminally or civilly liable for the consequences of his decision to launch the attack, for which he has honourably accepted full personal responsibility? The obvious avenue to examine first is the International Criminal Court, which is already reported to be carrying out a preliminary investigation. The Court has jurisdiction over four categories of crime: genocide, crimes against humanity, war crimes, and the crime of aggression. Genocide is an unlikely candidate. ready decided on regime change and anything less was unacceptable. In December 2002, Scilla Elworthy was contacted by the former first lady of Greece, Margarita Papandreou, to help lead a delegation of female leaders of the Middle East to push initiatives to avoid war in Iraq. After a long struggle to get visas and an equal struggle to actually get to Baghdad, the delegation finally arrived on January 3, 2003. To enter the hotel the group had to walk over a mosaic in the entrance floor that depicted the face of George Bush – a piece of Iraqi irony not lost on the many journalists staying there. Having teamed up with senior UN officials whom were known and trusted, they met with Iraqi cabinet ministers and officials including Deputy Prime Minister Tariq Aziz, Foreign Minister Nagi Sabri, and Oil Minister Amer Mohammed Rashid, as well as with doctors, teachers, and scientists. They had plenty of opportunity to meet ordinary Iraqis and visit sites recently inspected for weapons of mass destruction. After seven days, Scilla wrote her first daily blog, and the group had collected enough information to write a two-page proposal to Tony Blair, outlining in ten points how war could be avoided. It was placed in Blair’s hands a few days later. It was reported that he read it quickly and said, “It’s too late.” For Blair, it was. Two months later we discovered that irreversible machinery for the US/
UK invasion had been set in motion the previous October and that Blair had given Bush his unconditional support a year previously. All these examples highlight how for a small cabal of decision-makers, once decided to go to war, any alternatives were merely a distraction. Hans Blix confirms this. He personally made a telephone call to Blair on February 20, 2003. He told Blair, after many hundreds of inspections, that they had yielded no evidence of a WMD programme. He even said ‘it would prove absurd if 200,000 troops were to invade Iraq and find very little’. Yet another example that once minds are made up the road to war is inevitable. Tony Blair told the Chilcot enquiry that Saddam Hussein was “a man to whom a last chance to do right is just a further opportunity to do wrong. He is blind to reason.” This may have been an accurate assessment, but like all personalities, however ruthless and cruel their behavior is and has been, there is always a desire for survival. The failure of military intervention and its catastrophic consequences demand that we exhaust all peaceful options prior to military engagement. This was not done. 'Contempt of parliament': After Chilcot, can Blair be prosecuted? Geoffrey Bindman
The past 13 years have seen successive calls for former UK premier Tony Blair to be prosecuted for his part in the Iraq war. Has the Chilcot Report strengthened the potential legal case against him? crime of aggression. It was defined in 2010 as “the planning, preparation, initiation or execution by a person in a position effectively to exercise control over or direct the political or military action of a State, of an act of aggression which, by its character, gravity and scale, constitutes a manifest violation of the Charter of the United Nations”. Though it fits the situation perfectly – and should be a powerful deterrent to any similar adventures in the future – the offence will not become justiciable under the ICC treaty until at least 2017. It will never apply to the Iraq war because it will not be applied retrospectively. Crimes against humanity include a long list of all the most serious crimes of violence, but the ICC only has jurisdiction when such crimes are committed “as part of a widespread or systematic attack directed against any civilian population, with knowledge of that attack.” Of course, hundreds of thousands of civilians perished at the hands of British and American forces. But can it be said that
they were subjected to 'widespread and systematic attack'? A defendant would claim that the death of civilians was unintended 'collateral damage'. War crimes are defined as acts that constitute grave breaches of the Geneva Conventions, or otherwise amount to serious violations of the laws and customs applicable in international conflict. It is, again, a long list. It would be necessary to establish specific violations by British forces for which Blair could be held responsible. Naturally, crimes against humanity and war crimes are not excused by Security Council authority or self-defence. They are crimes which can have no justification. But when an attack is illegal, does that mean that every ensuing violent act by every British soldier is a crime, if committed under its auspices? Clearly this was a concern of Admiral Boyce, Chief of the Defence Staff in early 2003, when he sought reassurance that he was not being asked to send his troops to commit war crimes. He was given that reassurance by
Lord Goldsmith. Even if Goldsmith was wrong, the Admiral’s good faith and the fact that he acted on legal advice might provide him and his subordinates with a defence. Blair too has stressed his good faith and good intentions. But were we not taught that 'ignorance of the law is no excuse'? In my earlier article, I drew attention to the parallel jurisdiction conferred by the International Criminal Court Act 2001 on UK courts over the same crimes as the ICC itself adjudicates. Prosecutions would therefore require the consent of Lord Goldsmith’s current successor as Attorney-General. There are difficult decisions ahead of him. These are deep waters, both politically and legally. More detailed work is needed before the merits of a prosecution under the provisions outlined above can be finally determined. Other avenues are possible. Some MPs are said to be seeking the condemnation of Mr. Blair for 'contempt of Parliament'. Another possible Parliamentary route is impeachment, though my own view is that it would be a fruitless exercise. Lord Macdonald QC, former Director of Public Prosecutions, has given the Times newspaper reasons for believing that Mr. Blair’s conduct in the build-up to the war could amount to the criminal offence of 'misconduct in a public office'. One example is Mr. Blair’s failure to disclose to Cabinet ministers the Attorney-General’s detailed legal advice recommending a further Security Council resolution before launching an attack. There have already been many civil claims filed by Iraqi citizens against the Ministry of Defence, based on the behaviour of British troops. Could Blair or senior officers be held personally liable to pay damages to those injured or bereaved? Misconduct or misfeasance in public office is a civil wrong as well as a crime. Blair has no immunity conferred by his position as Prime Minister against proceedings in the ICC or under the UK statute, but state immunity or head of state immunity may be claimed as a defence in other situations. This is another subject for further study. The legal situation remains unclear, but as public calls for Blair's prosecution rumble on, the pressure is mounting to find some means of holding the former prime minister accountable in a formal court – not just the court of public opinion. Relevance of Morung System Morung system was a set of learning; it was also the very foundation to modern education. The relevance of Morung culture in the present Naga society can be understood on the following arena:1. Naga Democracy: Naga traditional political institution (Democracy) has attracted many scholars. A.Z. Phizo, the erstwhile President of the Naga National Council (NNC), has argued that: “There is no political party in Nagaland. We don’t need it. All things considered, he continued, Nagaland need not intimate or adopt foreign institutions [modern democracy] in matter of political organisation.” In Phizo’s view, Nagaland was already fully democratic by traditional design, “[it’s the] very spirit of our country” as he put it, hence they would not require political parties and elections to “become” democratic. 2. Military Training: Morung was the military training centre for young boys. The art of warfare and the spirit of patriotism were taught. The same can be adopted in modern schools and colleges. 3. Value Education: In Morung, values like dignity of labour, honesty, sincerity, discipline, respect for elders, morality etc., were imparted. Morung value seems to be more practical than present Naga Christian faith and values. 4. Skilled Based Education: In Morung skills like handicraft, woodcarving, spinning, weaving, embroidery works, stitching, sieving, cooking, ricebrewing etc., were taught. Our modern education system needs to adopt and institutionalise these skills to reduce the problem of unemployment in Nagaland. 5. Naga Traditional Knowledge of Medicinal Plants: Elders in the village also tells the morung boys of various medicinal plants sitting near fire place. Every Naga tribes have traditional knowledge of medicinal plants. The younger generation need to document this traditional knowledge. 6. Dignity of Labour: The Nagas were best known for their hard work, sincerity and honesty. Morung institution has taught the virtue of dignity of labour. In the past, ‘those who refuse to work shall not be allowed to eat’. However, dignity of labour seems to elude the younger Naga generation. As a result there is a huge problem of educated unemployed youth in Nagaland. Conclusion Morung was in fact the life line of every Naga village. It is equivalent of the modern educational institution. For the Nagas, morung was more than an educational institution, it was a social institution. It was in the morung that Nagas not only learnt the cultures, values, norms and warfare tactics of their village but it has also provided the structure for the working principles of the village council. In short, “It is the fulcrum of the village democracies”. With all this advantages, there is an urgent need to reviving the rich heritage of morung system in Nagaland.

‘Demilitarisation, repeal of AFSPA & PSA, Right to Self Determination’ SRINAGAR, July 17 (KAShmIR TImeS): Hurriyat Conference (G) chairman Syed Ali Shah Geelani today listed six confidence building measures that the Centre should take for return of peace to Kashmir. The measures include rapid ‘demilitarisation’ process of population centres and repeal of “draconian” laws like AFSPA and Public Safety Act. The measures were suggested by Geelani in a letter written to several international bodies, including the UNSC, and heads of states. Among others, the letter has been addressed to prime ministers of Pakistan and Turkey, King of Saudi Arabia and Presidents of China and Iran. “We believe a good beginning could be made to create an atmosphere conducive for peace and resolution if you use your good offices to urge India to take a few Confidence Building Measures (CBMs),” the Hurriyat (G) chairman has written in the letter. “Accept the disputed nature of Jammu and Kashmir and announce the acceptance of the people’s right to self determination. NATION Briefs Government continues its flip-flop on draft forest policy New DelhI, July 18 (PTI): Continuing its flipflop, the government today told the Rajya Sabha that a forest management institute under the Environment Ministry has submitted a draft national policy, which is under consideration, weeks after dubbing the document as merely a "study". Environment Minister Anil Madhav Dave, in a written reply, said "The Indian Institute of Forest Management (IIFM), Bhopal under the Environment Ministry was asked to prepare a draft National Forest Policy. IIFM has submitted the draft policy document which is under consideration." He was replying to a question on whether the Ministry has come out with a draft national forest policy proposing levy of green tax. Following publication of news reports about the proposed imposition of green tax, the Environment Ministry had recently said it had "inadvertently" put up a study and not issued any draft forest policy after it uploaded the document titled the 'Draft National Forest Policy, 2016' on its website and invited public opinion. The Ministry had said the study done by Indian Institute of Forest Management (IIFM), Bhopal was uploaded on its website as draft forest policy by mistake.
Health Ministry and UNICEF launch campaign on immunisation New DelhI, July 18 (IANS): The Union Health Ministry, in collaboration with Unicef, has launched a communication campaign through which it aims to enhance the coverage of its Routine Immunisation (RI) programme Mission Indradhanush. The RI communication campaign was conceptualised based on the findings from a formative research carried out by the Unicef last year, which found out that many skipped the immunisation due to fear of adverse effects, low awareness about the benefits and lack of information about vaccination centres, among others. The 360-degree communication campaign was launched last week. Noted actor Amitabh Bachchan has agreed to be the brand ambassador of the campaign.
NGT orders older diesel vehicles off New Delhi's roads New DelhI, July 18 (ReuTeRS): India's top environmental court on Monday ordered authorities to remove all diesel vehicles at least 10 years old off the capital city's streets in a bid to help clean New Delhi's polluted air. The ruling is the latest in a series of court-issued orders targeting the automotive industry's role in polluting Delhi's air, which the World Health Organisation said in May was the world's 11th dirtiest. Under the order, effective immediately, the National Green Tribunal (NGT) directed the Delhi transport authority to cancel the registration of all diesel-powered vehicles produced at least 10 years ago. New Delhi's transport office must also provide the court with a list of vehicles losing their registration, Indian media reported, citing the tribunal's ruling. The court was not immediately available for comment. Experts are divided on the extent to which vehicles are responsible for Indian urban pollution, but several have called for a ban on diesel vehicles because they pollute more than petrol-fuelled cars and motorcycles.

Geelani said that on behalf of besieged people of Jammu and Kashmir he has written a letter to world community to attract their attention towards the grave and grim situation being faced by the caged people of Kashmir for the past seven decades in general and for the last two and a half decades in particular. New DelhI, July 18 (mexN): The Editors Guild of India (EGI) has strongly condemned the efforts by the Jammu and Kashmir Government to gag the media in the State. The body requested the State Government to immediately lift the censorship and refrain from any action to intimidate the press. A press release from the EGI informed that the police was sent in the early hours of the morning into the offices of the local media in Kashmir with the printing presses being seized along with the copies of the newspapers that had just been printed. Reports also suggested that the journalists and other staff working with the two “main” English newspapers of Kashmir, ‘Greater Kashmir’ and ‘Rising Kashmir,’ were detained, harassed and their mobiles taken away by the raiding police parties. “It is extremely unfortunate that the State Government, under fire for its poor management of the law and order situation in the Valley, has sought to shoot the messenger,” stated the EGI in the press release issued by its President, Raj Chengappa, General Secretary, Prakash Dube and Treasurer, Seema Mustafa. The Editors Guild further asserted that the two newspapers are “run by responsible editors and journalists and report events with sobriety.” They also remained “aghast” that the “media censorship will continue, for a minimum of three days if not more.” “This is a direct assault to the freedom of the press in India and the Guild strongly condemns this unwarranted muzzling of the media,” the EGI reiterated.
PCI seeks report on govt clampdown Meanwhile, the Press Council of India (PCI) chairman Justice Chandramauli Kumar Prasad has ordered registration of a complaint over alleged crackdown on media in the Kashmir Valley and sought a report from the state government on the issue within a week. His direction came on a complaint by president of Jammu and Kashmir Press Association G H Kaloo on alleged "attack on press" in the restive state. "The Chairman took into consideration the communications made by Council members expressing their concern about state of affairs in Jammu and Kashmir and prima facie being satisfied sought reports within one week from the Chief Secretary, Secretary (Home) and Director General of Police," the PCI said in a statement. Newspapers fail to hit stands third day The newspaper owners in violencehit Kashmir have decided not to publish newspapers after authorities allegedly raided some media houses and seized their printed copies on Saturday. Local newspapers in curfew-bound Kashmir failed to hit the stands for the third consecutive day today after the alleged "clampdown" on the media in the aftermath of widespread protests in the Valley following the killing of militant commander Burhan Wani in an encounter with security forces. No local daily -English, Urdu or Kashmiri -- was available as the newspaper owners decided not to publish them after the "clampdown" by the government on Friday night. (With PTI Inputs)

'Lok Sabha to take up bills on NEET on July 19' New DelhI, July 18 (IANS): Two important bills that seek to replace ordinances to keep state boards out of the ambit of the National Eligibility-cum-Entrance Test (NEET) for this academic year will be taken up in the Lok Sabha on Tuesday, Minister of State for Parliamentary Affairs S.S. Ahluwalia said on Monday. "The Indian Medical Council (Amendment) Bill, 2016, and The Dentists (Amendment) Bill, 2016 -seeking to amend the Indian Medical Council Act of 1956 and The Dentists Act of 1948 -- to replace the two ordinances will be taken up tomorrow (Tuesday)," Ahluwalia told reporters here. He said the business advisory committee of the House had fixed
four to six hours for discussions on the bills. The Centre had, in the wake of reported pressure from some states, in May promulgated the two ordinances to keep the state boards out of the ambit of the panIndia medical and dental entrance examination (NEET) for 2016. "Passing these two bills will be our top priority," Parliamentary Affairs Minister Ananth Kumar said. On July 14, the Supreme Court had expressed "doubt" over the validity of the ordinance allowing the states to hold their own entrance examinations for admissions to undergraduate medical courses for the current academic year after bypassing the NEET. The apex court refused to stay the ordinance's operation since 50
per cent of the states had already conducted their own entrance examinations for admissions to their respective government medical colleges. However, a bench of Justice Anil R. Dave, Justice Shiva Kirti Singh and Justice Adarsh Kumar Goel said: "Prima facie, we find that the validity of the ordinance is open to doubt." The Indian Medical Council (Amendment) Bill, 2016 and the The Dentists (Amendment) Bill, 2016 were slated to be introduced in the Lok Sabha on Monday by Health Minister Jagat Prakash Nadda but the Lower House proceedings were adjourned for the day as a mark of respect to the death of a sitting member.

Calcutta HC judges 'No' to change in name to Kolkata HC KolKATA, July 18 (PTI): Judges of Calcutta High Court have unanimously declined to accept the Centre's proposal for renaming it as Kolkata High Court and have communicated the view of the full court to Union Law Ministry. "The Ministry has not yet reverted back on the issue," a senior high court official said here today. "The Full Court of High Court at Calcutta in a meeting held on July 11 unanimously declined to accept the proposal of the Government of India for changing the name of 'High Court of Judicature at Calcutta' to 'High Court of Judicature at Kolkata' in view of long history and tradition associated with the existing name of the High Court at Calcutta," High Court Registrar General Sugato Majumdar said in a communication to the Incorporated Law Society (ILS) here as per direction of the Chief Justice of the high court. In the communication to the ILS president, in reply to his letter to the Chief Justice of Calcutta High Court Justice Manjula Chellur protesting the Centre's decision, the registrar general said,"The name Calcutta has its own grandeur and tradition, dignity and heritage and it should not be lost in oblivion," R K Khanna, president of ILS of Calcutta High Court said, adding "same would apply to Bombay and Madras."
RBI to make funds transfer via smartphones easier hyDeRAbAD, July 18 (PTI): RBI today said it will become easier in coming weeks for people to transfer funds between bank accounts through their smartphones. Speaking at the IDRBT Banking Technology Excellence Awards function, RBI Governor Raghuram Rajan also made a case for tax benefits to merchants for promoting digital transactions. Leveraging the high mobile density, mobile banking services are being encouraged through interoperable USSD channel like *99# and the Unified Payments Interface (UPI). "I am especially enthused by UPI, as smartphones become more
widely available. Transfers from bank account to bank account will become easier in a few weeks via smartphone through the Unified Payment Interface," the Governor said. Elaborating, Rajan said a villager needing to pay a shopkeeper only needs to know the latter's alias say Ram@xyzbank.psp to transfer funds. "Neither needs to visit the bank to take out or deposit money, no point of sale machine is needed. Ex-US Marine kills 3 policemen in racially tense Baton Rouge

BATON ROUGE, LA., JULy 18 (REUTERs): A decorated ex-U.S. Marine sergeant opened fire on police in Baton Rouge on Sunday, killing three officers, nearly two weeks after the fatal police shooting of a black man there sparked nationwide protests, one of them shattered by the massacre of five Dallas policemen. The Baton Rouge suspect, dressed in black and armed with a rifle, was himself shot to death minutes later in a gunfight with police who converged on the scene of a confrontation that Mayor Kip Holden said began as an “ambush-
style” attack on officers. Two Baton Rouge Police Department officers and one sheriff’s deputy were killed, and one sheriff’s deputy was critically wounded. Another police officer and one other deputy suffered less severe wounds and were expected to survive. Colonel Mike Edmonson, superintendent of the Louisiana State Police, told a news conference the gunman was believed to have acted alone, contrary to early reports that police may have been looking for other shooters. over the police killings of two black men under questionable circumstances earlier this month - Alton Sterling, 37, in Baton Rouge on July 5, and Philando Castile, 32, near St. Paul, Minnesota, on July 6. Police did not name the suspect. But a U.S. government official told Reuters the gunman was identified as Gavin Long, of Kansas City, Missouri. Long, who was black, was reported by other media to be 29 years old.

CHAOTIC MOMENTS CAUGHT ON RADIO In the ensuing pandemonium caught on a recording of emergency radio traffic, police are repeatedly heard reporting: “Officer down” and “deputy down” as officers swarmed the area searching for, and ultimately confronting, the gunman. The episode was over in about eight minutes, according to Edmonson’s account. At least one of the three officers killed was known to be black. President Barack Obama condemned the attack, vowed that justice would be done and urged Americans to focus on rhetoric and actions that united the country, rather than divided it. “We need to temper our words and open our hearts, all of us,” Obama said in televised remarks from the White House. Louisiana Governor John Bel Edwards called the shootings an “unspeakable, heinous attack” that served no purpose. “There simply is no place for more violence. That doesn’t help anyone, it doesn’t further the conversation, it doesn’t address any injustice, perceived or real. It is just an injustice in and of itself,” he told reporters in Baton Rouge. Soaring prison population prompts Thailand to re-think lost drug war BANGKOK, JULy 18 (REUTERs): Somsak Sreesomsong was 18 when he was jailed for selling illegal drugs. Now, turning 30, he is not yet half way through his 33-year sentence at Bangkok’s high-security Klong Prem prison. Somsak was “just a kid, not a big-time dealer”, his older brother Panit told Reuters after a visit to the jail. “We’re also serving time, waiting for him to get out so he can help the family.” More than a decade after Thailand declared a “war on drugs”, the country is admitting defeat. As the prison population soars, Justice Minister Paiboon Koomchaya told Reuters he was looking at changes to the country’s draconian drug laws. “I want to de-classify methamphetamine but Thailand is not ready yet,” said Paiboon, meaning downgrading the drug, popularly known as “meth”, from a Category 1 substance, which would reduce jail time for posses-
sion or dealing. Use of methamphetamine is spiralling across Southeast Asia, and authorities are struggling to respond. In the Philippines, which has some of the highest rates of “meth” use, police killings of drug suspects have spiked since the swearing-in of President Rodrigo Duterte, elected on a platform of harsh measures to wipe out drug crime. Myanmar, the source of much of the drugs flooding through the region, is bracing for an explosion in domestic use. Overall, drugs supply in Southeast Asia, especially of methamphetamine, is at a record level, according to the United Nations Office on Drugs and Crime (UNODC). HARSH PUNISHMENTS In common with much of the region, Thailand’s criminal justice system treats drug offenders harshly. Producing and trading in Category 1 drugs, which also include
heroin, MDMA - the main chemical for ecstasy pills and LSD, is punishable by death or life imprisonment. Klong Prem is home to 6,267 inmates serving sentences that range from 15 years to life, with 64 percent convicted of drug-related crimes. A typical cell measures 1.5 x 3 metres (5 x 10 feet) and sleeps five inmates, side-by-side on dark blue mattress on the floor. “Some of the men, especially the foreign prisoners, are pretty big, so it’s a squeeze for them,” said one prison guard. Lengthy sentences for drug offences are part of the reason why Thai jails struggle with chronic overcrowding, according to both Justice Minister Paiboon and U.N. experts. Thailand has approximately 40 percent of the Association of Southeast Asian Nations’ prison population, despite having only 10 percent of the bloc’s total population, the UNODC says. Paiboon, an army gen-
eral and senior member of the junta that seized power in a 2014 coup, said in an interview that Thailand would build more prisons, including 17 temporary jails for prisoners who have served at least a third of their sentence. He added that his priority was to tackle drug trafficking and addiction - an ambitious plan in a country where a record number of people use methamphetamines, known in Thai as “ya ba” or “crazy medicine”, according to a 2015 U.N. report. Having set the hosts a 283 victory target after their second innings was ended on 215 in the morning, Pakistan's bowlers, led by leg spinner Yasir Shah, provided a masterclass to bowl England out for 207. Mohammad Amir, back from a five-year ban for spot-fixing, sealed victory when he clean bowled Jake Ball. England had never chased down such a total at Lord's and while Jonny Bairstow was at the crease they appeared to still have a chance but he was undone by Yasir when he was two short of his half century. The end was nigh after that as the final three wickets went down for 11 runs. Pakistan's players celebrated victory by doing press-ups in front of their jubilant supporters. "It is one of the top wins as captain and for Pakistan as a team," captain Misbah-ul-Haq said. "I am very proud of the team and the way they came out and showed really good skills. "Today, mentally everybody was strong, and were patient. Everyone

However, besides i) The Naga Memorandum to Simon Commission of Jan, 1929 and ii) The 9 Point (Hydari Agreement) of June, 1947 which were framed in the true soundness of mind by the Naga Leaders and the NNC. The subsequent iii) 16 Point Agreement of July, 1960 by the Naga People’s Convention and iv) the Shillong Accord of Nov, 1975 by the representatives of the Naga Federal Government, behind the 1951 Naga Plebiscite for Independence was not reached in the true soundness of mind and ill-gotten. When the Naga people had al-
ready endorsed for Independence by the Plebiscite of 1951, the NPC had betrayedand bartered away the Naga Peoples mandate with Article 371A. If supposedly the Naga people’s aspiration for independence was accomplished, Article 371A will not be required at all and the same can neverbe equatedwithsovereignty. Nevertheless, instead of pointing our fingers at the Naga Leaders representing the NPC or the representatives of the Naga Federal Government, theonus of culpability rests with the then Prime Minister of India Shri. The banning of ACAUT in 2014 as alleged through the press release by MIP NSCN(IM) appears to be a myopic blunder. It never occurredto a lay Naga conscience like this writer, that the mighty NSCN(IM) will stoop so low to approve its MIP to publicize the anguishover “One Government One
Tax” without engaging in a dialogue to seize the opportunity.The Naga people had already vouched for collection of tax as mandated in Point No. 5 (Taxation) of the Nine Point Agreement in June, 1947. Quote – “That the Naga National Council will be responsible for the imposition, collection, and expenditure of land revenue and house tax, and of such other taxes as may be imposed by the Naga National Council” unquote.The clause connotes the then authority of 1(one)single entity the NNC and not multiplefactions. In this circumstances, how can NSCN(IM) remain a lame duck when the Naga publics are burdened with rampant taxation by multiple factions. To legitimize the right for taxation, as envisaged in clause 5 of Nine Point Agreement, all the NPGs are obliged
to converge and sing the bitter sweetsymphony of “One Government One Tax”. The public outcry and stance of ACAUT is for a legitimate cause of the Naga people. The way forward can be charted out by echoing the RBI Governor, Dr. Raghuram G.Rajan’s approach on ‘Development’ and ‘Nationalism’ via the “Indian Path” as spoken in a recent interview with Barkha Dutt, NDTV. That India must choose its own original path of development and not just blindly emulate any existing model. And it is up to India to set up an example by following a different path and not following other countries blindly on the issue of ‘Nationalism’, when it took many centuries to evolve for the democratic western nations and the quite
recent totalitarianmethod of the nations in the east. Apart from the existing diplomacy instruments around ‘Democratic Diplomacy’, ‘Secret Diplomacy’, ‘Totalitarian Diplomacy’, ‘Diplomacy by Conference’, ‘Plebiscitary Diplomacy’, or ‘Personal Diplomacy’, the “Naga Path” may include a touch of all the above and predominantly “Village Diplomacy”in the approach for “Development” and “Nationalism”. Self-assuredly, the present debacle on ‘Tax’ and approach to ‘Final Agreement with GOI’will be resolved by the NSCN(IM) without resorting to the “Carrot and Stick”Nehruvian policy, but by trailing the NaMo policy of dialogue in the true soundness of mind as perceived. hen I flip the newspaper, my eyes directly fall on the report given by K. Therie on 13 July 2016, about the 12th NLA session, which was held from 12-14 July 2016 in Kohima, and on the First day of the session i.e. 12"‘ July, the meeting lasted for 15 minutes (Only 15 minutes). Is It that the meeting was just to say hi and hello to one another or maybe 10 minutes to boil the water and make tea where another 5 minutes to drink and end up the session. I’m not a writer or scholar or a judge trying to prove them wrong but am just a student who wants to see change. The moment I read, a question just strikes my mind that is, "Ayah! Why do we vote to such candidate who does not even think to bring development or change in the society?" For this reason the NBCC has warned us through the clean election campaign as well as clean election Sunday which we recently had on May 22, 2016 also given us a passage from Psalm 125:3. In addition, warned us "why you must vote. Only when you cast your vote you do fulfill your Christian responsibility
in government." Therefore, we have to choose the right candidate which can help or bring change and development for the society. Using one’s own vote can change. This NLA session has taught us to think deeper. The GoI has made a budget for every corner of Nagaland for development whereas they shared the budget and bring development only in some places and publish it in the paper. hat is the stand of an advanced tribes and how do you reacts the most backward tribes in Nagaland towards the recent selection system of the allocation of MBBS & BDS course studies seats by the Common Selection Board of NSEE-II for the session of 2016-17 under the department of Technical Education? Because some of the tribes in Nagaland claimed as backward tribe but in many fronts these tribes are more advanced than the advanced tribes in Nagaland. And some tribes were advanced tribes before 1973 but afterwards degraded into backward tag and still continuing as backward tribes. Thanks to the Rengma tribe for their bold decision as they have recognized their efficiencies and the backward tag of their tribe has been denounced. And it is not only in MBBS/BDS studies reservation quota but everything such as: NPSC, Divisional level and ministerial job quota and other technical studies course etc, Chakhesang and Zeliang tribe usually used to tops. For the present example, overall numbers of seats allocation; Angami have got 10 seats and Chakhesang and Sumi got 8 each including one backward
quota for Chakhesang. So far, my observation and general bird’s eye view is concerned from the year 1994 till date Chakhesang and Zeliang tribes became either in a first, second and third position in every competition in Nagaland for overall performances percentage or tribe-wise population ratio. And for the present instances calculation of MBBS/BDS allocation, Chakhesang tribe has got highest nos of seats according to the tribe-wise population ratio and Angami tribe stood in a second place. It is naked truth that, the first class gazette officers of the single Chakhesang backward tribe are more than whole nos of ENPO areas 6 backward tribes first class gazette officers and the nos of 1st class gazette officers of single village in Zeliang tribe, one of the backward tribes in Nagaland are more than the most populous tribe of whole Konyak. As per the latest record of Human Resources Development index in Nagaland, Chakhesang tribe claimed at the top list who had obtained Ph D degree in Theological studies. And in actuality; Chakhesang and Zeliang elites are think tank of Nagas comparison to Ao and Sumi intellectuals. My conscience is very clear that,
I have no ill will nor envy or jealousy towards any particular community or individual but I am just trying to highlight the reality in Nagaland which general public must think and pounder upon and realize the actual truth and reality since both the advanced and backward tribes are being perished and deprived of its own privileges at the mercy of backward tag but in reality they are not backward tribes. I recalled that, during the course of agitation for separating the 25% reservation quota for ENPO tribes I had a hot argued and words of petty wrangled with my Zeliang and Chakhesang friends to impose door to door anti backward campaign in order to reveal the actual fact and for creamy slice. And in Nagaland, Chakhesang seems to be one of the most advance tribes and in terms of many Zeliang tribe was second to none as the first Chief Secretary was from Zeliang and so also is the present incumbent Chief Minister in the state and the single village having first class gazette officers more than that of the most populous tribe in Nagaland still claiming as backward tribe is an illogic. Yes, some portion of these areas could be lagging behind in terms of infrastructural de-
velopment but Socio-Economically, Educationally and regionally; Konyak, Pochury and Khiamngan are the only backward tribes in Nagaland. It is naked truth that, we Konyaks are the most victimized and deprived tribe in Nagaland as in every reservation quota of roster system, more than Two Lakhs Seventy Thousand population of Konyak tribe is getting same allocation or single NCS/ NPS post and that of having only Thirty to Forty Thousand populations in the single tribe is getting equal shares. And even though it is pained to us of depriving our dues privileges in front of our nose and being shamed to be in a backward tag yet the common naked reality cannot be avoided which is undeniable fact and one has to bear all these agonies tightening its anus. So, what is the stand of the both advanced and backward tribes in Nagaland and what do you think and reacts to the some of the most advanced tribes in Nagaland continued to claim as backward tribe? “Do not hide the truth and reality from the eye of Ethics”. Film on Indian soldiers in World War 1 to be screened in capital

aris-based Indian filmmaker, scriptwriter and novelist Vijay Singh's film "Farewell My Indian Soldier" -- titled "Mademoiselle France pleure" in French -- will be premiered at the French embassy here on Tuesday. The screening is being hosted by Alexandre Ziegler, Ambassador of France to India. The film is a docu-fiction on Indian soldiers, who came to France and Belgium to fight in World War. Singh, accompanied by actress Paloma Coquant, will make a presentation of the film, which will be followed by a question and answer session. Dedicated to the 1,40,000 Indian soldiers and civilian workers who defended France against invasion, the film is co-produced by Silhouette Films and Rajya Sabha Television, and supported by the Embassy of France in India. "This is the first time that such a film has been made on this subject," Singh said in a statement. "Indeed, it would seem both unbelievable and intriguing how the experi-
ence of 1,40,000 Indian soldiers and civilian workers on the Western Front, part of the 1.4 million soldiers mobilised worldwide, could have escaped the attention of any television in the world," Singh said. "In fact, even in terms of the contemporary World War 1 film footage available in the archives, there is very little on Indian soldiers. Again, much fewer Indian troops were awarded for their bravery than their British counterparts. In many ways, this film is a re-write of this part of the history of the Great War," he added. "Farewell My Indian Soldier" uses rare archive, historical testimonies, old Indian war songs and 600 insightful letters written home by soldiers to tell the fascinating story of Indian soldiers, of whom 10,000 were never to return to their motherland. NEW DELHI, JuLy 18 (IANS): No minister or government official can be an office-bearer of the national cricketing body, the Supreme Court said on Monday in a major setback to the BCCI while it also accepted the Lodha Committee recommendation of one stateone vote for representation at the BCCI. Rejecting the contention that the exclusion of ministers -- both at the central and state levels -- from being the office bearers of the Board of Control for Cricket in India (BCCI) or its state affiliates would adversely affect their administration, the bench of Chief Justice Tirath Singh Thakur and Fakkir Mohammed Ibrahim Kalifulla said this does not mean that the game would cease to get their patronage. "The argument that since
ministerial and bureaucratic support and patronage has helped the BCCI in running its affairs in the past, they should be allowed to continue, lest the game suffers, has not impressed us. We do not think that the game flourishes in this country because any minister or civil servant holds office in the state associations or the BCCI," Chief Justice Thakur said while pronouncing the judgement. The bench contended that ministers and bureaucrats who are passionate about the game will continue to promote it without holding any office in the BCCI or the state associations. The apex court said this while pronouncing on the number of objections that the country's apex cricketing body and its state affiliates have raised oppos-
ing the Justice Lodha Committee recommendations including one state one vote, ceiling on the number of terms a person could be an office bearer, age restriction of BCCI officials to 70 years and the presence of a CAG nominee on the BCCI board. Addressing the BCCI objection to the recommendation of one state one vote, more so the contribution made by the six associations -- three each in Maharashtra and Gujarat -- to the game historically and by some of them even in the formation of BCCI itself, the court said that the arguments could not be "lightly brushed aside". The six bodies are Mumbai Cricket Association, Maharashtra Cricket Association, Vidarbha Cricket Association, Gujarat Cricket Association, Baroda cricket Association and Saurashtra
NEW DELHI, JuLy 18 (PTI): The BCCI respects Supreme Court's verdict on sweeping reforms in the cricket board and it will work towards implementing the recommendations made by the Lodha panel, senior BCCI functionary and IPL chairman Rajeev Shukla said on Monday. "We respect SC's decision. Will look into how we can implement the Lodha panel recommendations," Shukla was quoted as saying by television channels. The Supreme Court accepted major recommendations of the Lodha Committee on reforms in BCCI including a bar on ministers and civil servants and those above 70 from becoming its members but left it to Parliament to decide whether it should come under RTI. Former India cricketers Bishan Singh Bedi and Kirti Azad too hailed the verdict of the apex court. A bench of Chief Justice T S Thakur and Justice F M I Kalifulla also rejected BCCI's objection against recommendations for one-state-one-vote and said that states like Maharashtra and Gujarat having more than one cricket associations will have voting rights on rotational basis. "The only reasonable and rational answer to the problem within the broad principle of one state one vote would be to allow the full membership of BCCI to rotate among the three clubs on an annual basis. During the period one of the associations would exercise rights and privileges of a full member, the other two associations would act as associate members," the court said. This rotational arrangement, the court said would give each member a right to vote at its turn without violating the broader principle of one state one vote and also
respect the "historical aspect in which these associations grew to promote the game and form BCCI as a national body." Saying that these associations will continue to field their respective teams, the court left it to the BCCI to decide the order in which the membership will rotate among them. The apex courtappointed Lodha Committee, on January 4, recommended sweeping reforms and an administrative shakeup at the troubled BCCI, suggesting that ministers be barred from occupying positions, a cap put on the age and tenure of the office-bearers and legalising betting.

BANgKoK, JuLy 18 (rEuTErS): World number four Ratchanok Intanon has been cleared of an anti-doping violation, the Badminton World Federation (BWF) said in a statement on Monday, paving the way for the Thai medal hope to compete at the Rio Olympics.
