Importance of proxies in strata

Home all set for inspection now and for auction on July 31. By SCOTT WOODSIDE THE 2011 Capricorn Yanchep Variety WA Charity Home built by Gemmill Homes is now open for inspection. A joint partnership with Gemmill Homes and Capricorn Yanchep, and supported by the team at Century 21, the home will be open for inspection every Monday and Wednesday from 2pm to 5pm and Saturday and Sunday from 1pm to 4pm until the auction at 11am on Sunday, July 31. Variety WA Chief Executive Officer Michael Pailthorpe said net proceeds from the sale would enable the charity to provide much-needed equipment and programs to assist sick, disadvantaged or special needs children in metropolitan and regional WA.

“We are incredibly grateful for Gemmill Homes, Capricorn Yanchep Estate, Century 21 and the many generous suppliers and tradespeople who made this project possible,” Mr Pailthorpe said. The four-bedroom, twobathroom home has all the architectural flair, space and designer features every family could wish for, including a magnificent alfresco area, outdoor kitchen and pool. JOHN Angus, author of Understanding Strata Titles – an A to Z on everything strata, is offering valuable advice on the complex procedures of strata title management. “Before every general meeting, coowners of a lot – whether they both attend the meeting or not – are obliged to complete a proxy form granting the proxy to either or any one of them (or a third party) in order to vote at that meeting,” he said “The standard schedule 1 by-laws – which apply to almost all strata companies – stipulate this very clearly. “The by-laws go on to say that, the instrument of proxy must be in writing.” A proxy should be presented before the meeting commences. Mr Angus said experience suggests that many owners were unaware of this requirement. “Make a note next time you arrange a meeting and be sure you send out a blank proxy form with the date and type of meeting for co-owners to sign,” he said. “If you are unsure where to obtain a suitable form of proxy, contact a strata manager or the Strata Titles Institute of WA.” ■

Fascinating glimpses into our past Mt Flora Regional Museum a must for City of Stirling residents, writes KEREN BELLOS DO you remember dancing the night away at the Snake Pit? Did you know that on one Saturday in November, 1962, the Scarboro Surf Life Saving Club rescued 119 people and one horse from our waters? Have you ever wondered what happened to the Nookenburra Plinth monument? Offering a fascinating insight into local cultural, social and natural history, the Mt Flora Regional Museum provides City of Stirling residents with an opportunity to step back in time. Situated in Elvire Street, Watermans Bay, the museum is housed in its biggest exhibit – a tank that was built in 1936 to supply water to North Beach households. The building’s rooftop affords arguably the best views in the northern suburbs. During World War I the tank was also used as an observation post by the 10th Light Horse Regiment. After the facility was phased out of service in the 1970s, a group of dedicated volunteers at the North Suburban Historical Society converted it into a museum to preserve local history. Today, visitors can climb the staircase to the panoramic lookout, which features artist Anne-Maree Pelusey’s mural of almost 300 fish. Inside the museum, architect Richard Llorens has designed two levels, with the ground floor dedicated to local history and the upper level featuring “rooms” that offer a social account of the past. Large black-and-white photographs and artefacts, such as the wrecked brig Centaur’s

cargo and Nookenburra Plinth from the old Nookenburra Hotel, are showcased in displays of various themes, including indigenous, pioneering families, planning and construction, and surf life saving. The City of Stirling has operated the museum since 2006 and museum curator Tracy Willet told Residential that she loved nothing more than to share stories with visitors. “You still need your history books with dates and places, but it’s the stories that bring past events to life,” she said. “When school groups visit, I tell the children local stories to give them an idea of what life was like for early families living in the area. “Kids love looking at things of old and the older generation also loves visiting, each having a different experience. “I’ve seen people get really emotional because the museum brings back so many memories for them.” Mrs Willet said the school days exhibit, complete with 1950s school case, old abacus and hand puppets made by North Beach Primary School students in the ’60s, was a favourite of younger visitors. She said senior citizens favoured the new war-time display, which included a 10th Light Horse Regiment slouch hat, mess pan, ration

vouchers and badges. “This sweetheart badge was worn in honour of a loved one who was away at war,” Mrs Willett explained. She said her favourite artefacts included a small 1920s milking stool and the 1912 autograph albums of local residents Myrtle Newland and May Bellairs. The museum’s oldest item is a book that pioneer Edward Hamersley signed and dated in 1858. Mrs Willet said she was always keen to copy residents’ old photographs for the museum’s collection and add their family information to the historical records. Donations of memorabilia were also welcome. She said she encouraged people to write their stories. “It doesn’t have to be well written or grammatically perfect as the emphasis is on the stories and it’s a great legacy to leave our families and community,” Mrs Willet said. “Everyone has a story and it makes us proud to know our family’s background. “The same is true of our communities and we take pride in our community when we know the challenges they faced and how life has changed over the decades.” The Mt Flora Regional Museum is open from 1.30pm to 4.30pm on Sundays and by appointment for community groups. Building upwards being shunned Is a fear of heights holding back WA’S urban development? asks SCOTT WOODSIDE WHEN it comes to increasing urban densities,West Australians seem to have a fear of heights exceeded only by Tasmanians, according to recently released figures from the Australian Bureau of Statistics (ABS). Just 14 per cent of Western Australia’s building approvals in the past year have been for dwelling units over four storeys high. This compares with 65 per cent in the ACT and 61 per cent in Victoria. The figures show that in May just 20 per cent of building approvals were for non-house dwellings such as apartments and townhouses, a figure that’s consistent with Perth’s annual figure of 18 per cent. By comparison, 84 per cent of building approvals in Canberra in May were for non-house dwellings, while 52 per cent of Brisbane’s approvals were for

non-house dwellings. “Perth’s percentage is easily the lowest of Australia’s capital cities,” Urban Development Institute of Australia (UDIA) CEO Debra Goostrey said. “At 18 per cent, it’s well below the next lowest, which is shared between Hobart and Adelaide, where non-house approvals are 31 per cent,” she said. The ABS figures also reveal that Perth has the lowest percentage of non-house dwelling approvals of Australia’s cities, showing that Perth has a long way to go to meet the State Government’s ambitions to increase density. “The Government needs to create enough opportunities for medium and higher density developments across the metropolitan area to ensure sustainability and to meet the changing needs of our growing population,” Ms Goostrey said. ■

Refunds, if you know how Property investors can maximise their tax benefits, advises SCOTT WOODSIDE THOUSANDS of WA property investors will receive large tax refunds during the coming financial year because of obtaining a tax depreciation report for their properties. “Despite this, there is still a large number of investment property owners in WA who do not understand that they can significantly boost their cash flow by claiming tax deductions for a large number of items through depreciation benefits,” managing director of tax depreciation specialists DEPPRO Paul Bennion said. “In particular, property investors fail to understand that the tax benefits from depreciation can be just as important as rental income and that tax benefits obtained through depreciation can be equivalent to 60 per cent of the total purchase price of the

property. For example, taxation ruling TR2006/15,garden gnomes are depreciable as plants over their economic life.” Mr Bennion said that for an average residential investment property in Western Australia, this can equate to over $100,000 in possible tax benefits through depreciation. “A large proportion of these tax benefits are never claimed which means that each year hundreds of millions of dollars in tax benefits are lost every year by investors not claiming their legitimate entitle-

ments,” he said. “As part of its service to owners of rental properties, DEPPRO searches for a large number of items that could be claimed in a depreciation schedule. “Depreciation is a complex area of taxation that requires a professional company to undertake a depreciation schedule because of constant changes in rules.” The ATO is now taking a more aggressive approach to tax deductions made by residential investors and has asked a large number to provide more details about their claims relating to property investments. “Property investors should check that the company undertaking their tax depreciation schedule is a member of the The Australian Institute of Quantity Surveyors (AIQS),” Mr Bennion added. “Employing a company who is a member of AIQS such as DEPPRO gives protection to consumers that their tax depreciation schedule complies and is completed in a professional manner.” ■
