Nagaland logs 15 fresh Covid cases DIMAPUR, JUL 19 (NPN): Nagaland on Tuesday logged 15 fresh Covid-19 positive cases while no deaths were reported during the day. Of the fresh cases, six were from Kohima, four in Phek, two in Dimapur and one each in Longleng, Peren and Wokha, taking the total caseload to 35,628. The death toll remained unchanged at 764 (including 5 non-Covid deaths but with positivity). The State currently has 75 active cases-- 38 in Kohima, 21 in Dimapur, 6 in Peren, 4 in Phek, 2 each in Longleng and Mokokchung and one each in Wokha and Zunheboto. The sample positivity rate stood at 13.51% as on Tuesday.

Prez poll: Ballot boxes arrive Delhi

DIMAPUR/NEW DELHI, JUL 19 (NPN/AGENCIES): A day after the presidential election, the ballot boxes boarded flights from different states including Nagaland on separate air tickets under the name “Mr Ballot box”. The boxes were accompanied by election officers, for their return journey to Delhi from the states’ capitals. The ballot box from Nagaland was flown to Delhi by IndiGo flight accompanied by additional secretary NLA K. Rio and other officials including Central observer, Surender Kumar.It is probably the first time that the election commission booked two-way tickets for the ballot boxes. Earlier, these were sent as hand baggage by supervising officials. Counting of votes to decide the fate of Presidential candidates will be held on July 21.

As soon as the House assembled at 11 am, opposition members belonging to the Congress, Trinamool Congress, DMK and others came to the well of the House carrying placards against the imposition of the GST on some new items. They raised slogans against the Modi government over the issue of price rise. The placards read “Gabbar Singh Strikes Again”. The opposition has been describing the GST as Gabbar Singh Tax, referring to the Bollywood blockbuster Sholay’s villain Gabbar Singh, who used to illegally collect taxes from the villagers in the film. Speaker Om Birla appealed to the opposition members to go to their seats and said carrying of placards inside the House is against rules. He said since the House is discussing farmers’ issue, the members should participate in it. “You carry rules book but don’t follow rules. The rules prohibit carrying placards here but you are carrying them. You raise farmers issue outside the House but not inside...,” Birla said. As the opposition members did not pay any heed to the Speaker’s appeal, he adjourned the House till 2 pm after about 15 minutes

Members of the Congress, Left, and AAP insisted on a discussion on the issues, forcing adjournment of proceedings till 2 pm. Chairman M Venkaiah Naidu rejected notices given by Leader of the Opposition Mallikarjun Kharge and other leaders under rule 267 that calls for setting aside the business of the day to take up the issues listed by them. “I am not admitting them,” Naidu said soon after the listed papers were laid on the table. Opposition members insisted on a discussion on the issues. Naidu asked members to resume their places and ordered that nothing that they speak would go on record. Soon after, he adjourned the proceedings till 2 pm. The Congress on Tuesday held a protest over the

issue of price rise in Parliament complex here, a day after the Goods and Services Tax on packaged food items such as milk and curd came into force. Besides Congress leader Rahul Gandhi, some opposition MPs including Supriya Sule of the NCP, Ram Gopal Yadav of the Samajwadi party and Priyanka Chaturvedi of the Shiv Sena were present during the protest held in front of Mahatma Gandhi’s statue in Parliament complex. Raising slogans against the government, the Congress members demanded a rollback in prices of LPG. They also held banners and placards which read that “high inflation, continuous price rise badly affecting common people”. The Congress whip in Lok Sabha Manickam Tagore said opposition members led by his party wanted a discussion on price rise and GST but the government did not allow and the speaker adjourned the House till 2 pm. “We will raise the same when the House reconvenes. Why is the government afraid about holding the discussion,” he asked.

brought to public domain, if it (NFR) was unsatisfied with the kind of response from the State government. The union said neglect of such a pertinent issue by all stakeholders was questionable and demanded transparent explanations. DNSU reminded that railways serve as the lifeline for almost 90% of the student community studying outside Nagaland as most of them could not afford flight tickets. The signatories also disclosed that DNSU has been receiving multiple complaints that the sole train terminal at Dimapur has been shifted somewhere else, thereby causing immense trouble for the students. DIMAPUR, JUL 19 (NPN): Dimapur Naga Students Union (DNSU) has taken serious note of the allegations made by Northeast Frontier Railway (NFR) regarding encroachment of railway land in Dimapur and said it was compelled to question the silence of the state government on the matter. DNSU vice president B. Mhajan Tsopoe and general secretary Sedelo T. Vadeo referred to several reports published in the Nagaland Post, which had been highlighting the factors affecting economic development of Dimapur since the past decade but that the State government appeared to be turning a blind eye. Water-filled vessels and tanks are to be tightly covered. One should wear clothes that cover the complete body. Sleep under mosquito net preferably insecticide treated (LLIN) during day and night time. Immediately consult a doctor in case of high fever.

MUMBAI, JUL 19 (PTI): The rupee recovered from its all-time low of 80.05 to close 6 paise higher at 79.92 against the US dollar on Tuesday following forex inflows and suspected RBI intervention. A positive trend in domestic equities and losses in the US dollar in overseas markets also boosted the local unit while a rise in crude oil prices restricted gains. At the interbank forex market, the local unit opened lower at 80.00 against the greenback and fell further to its all-time low of 80.05 to a dollar due to overnight gains in crude oil prices.

DIMAPUR, JUL 19 (NPN): Drawing attention to repeated mention by the Parliamentary Committee on the Naga political issue (PCoNPI) that talks had concluded on October 31, 2019, MIP of NSCN (I-M) countered that had the “Indo-Naga political talks” concluded on October 31, 2019 then a joint statement should have been the norm and not the “unilateral statement by RN Ravi”. Further, MIP said, Ravi may have concluded talks with NNPGs but that was not the story with NSCN (I-M). In a statement, MIP said had that been so, then even NSCN (IM) would have “taken the pleasure to share with the Naga people with much jubilation.”

Theire said there was no reason to surrender to the ruling party and let them win uncontested. “We will contest all 60 seats in the next Assembly elections,’” he added. On the other hand, AICC secretary Dr. Ajoy Kumar said that the AICC had prepared its strategy to face the 2023 Assembly election. He also remarked that for the past two decades, Rs 5 lakh crore must have been spent in the State, which failed to reach to the people. This, he alleged has been siphoned off. He alleged that the money the government had spent during the election was looted from the people. “They are giving the stolen money of yours,” he added.

NPF only political party keeping Naga issue alive: Azo Power shutdown in parts of Dimapur DIMAPUR, JUL 19 (NPN): NPF Legislature Party (NPFLP) leader and UDA co-chairman, Kuzholuzo (Azo) Nienu, Tuesday reiterated his claim that NPF was the only political party that was keeping alive the Naga political issue. Speaking at the NPF Peren division re-organization programme at Peren town hall, the NPFLP leader said that the NPF was given birth in the Naga soil during the worst turmoil in 1960s. He said NPF was not a party that chased after power or position, but stood for the cause of the Naga people, adding that welfare of the Naga people was its priority. He further reiterated that

NPF does not belong to any individual or controlled by any individual or leader, but belonged to the Naga people. He pointed out that any Naga people was welcome to join the NPF. Azo said the party with or without its representative in the State Assembly would exist and continue to work for the Naga

people and its well-being. He claimed grassroots of the party was still intact even after 21 MLAs defecting to NDPP. According to NPF press bureau, the party’s chief ministerial candidature also said that though the ruling government party was running strong, many of its (NDPP) office bearers were resigning and joining the NPF. He said the development was “an indication of lack of confidence on its leadership and the survival of the party.” NPF leader expressed optimism that NPF would form the next government in Nagaland. NPF secretary general Achumbemo Kikon also reiterated that NPF belonged to the

entire Naga people and said that Naga people should take the privilege to be a part of the party. Kikon, therefore, called upon the people to take the responsibility to push forward the NPF for the better future of the Naga people. DIMAPUR, JUL 19 (NPN): Power department has informed that there would be shutdown of power supply in and around Dimapur town in a phased manner from 3am to 8am starting July 20-30, 2022. In a press release, Dimapur electrical division executive engineer, Er. Y. Akito Sema, stated that the proposed power supply shutdown was being necessitated as the department would be carrying out maintenance work for shifting of existing 11 KV lines as well as LT lines to the newly constructed trunk lines. In a press release, Lapiye centre for mental well-being informed that during the programmes, resource person, counseling psychologist, Lovitoli Awomi spoke on the topic “the need of mental health awareness in present context”. DIMAPUR: Deputy commissioner (DC) Noklak, Hiazu Meru inaugurated the Noklak District Handloom and Handicraft Council (NDHHC) office at Punyaongan Sector Noklak Town, Tuesday. According to a DIPR report, DC said Noklak district has potentials to upsurge in handloom and handicraft sector as the district has many good artisans. He said that through NDHHC, artisans would get an opportunity to earn their livelihood. He pointed out that some of the “last traditional Naga practices” such as cotton growing, weaving and traditional products were found in the district. Correspondent KOHIMA, JUL 19 (NPN): Kohima Municipal Council (KMC) has informed that it would start checking use of plastics from July 20 onwards. Informing this at the felicitation programme for winners of the cleanest ward awards under the Urban Development department at KMC office on Tuesday, KMC administrator, Lanusenla Longkumer said defaulters would be penalised an amount of Rs. 1000 in the first phase and Rs. 2000 in the second. She informed that the third penalty would lead to cancellation of trade licence. The administrator advised the public/customers who receive plastic bags from shopkeepers to re-

port the matter to KMC saying the issue would be forwarded to District Task Force (DTF). Lanusenla also reminded that the annual KMC Cleanest Ward Award was still on and acknowledged KCCI for sponsoring in the previous year. KMC have also added—drainage: dumping of garbage in drains will be checked; Ward would get negative marking if SuP was seized from shops/ business establishments/ restaurants/ eateries etc.; wards are requested to submit their annual social work calendar to the office by August 10, 2022. KMC appealed to all the citizens to use re-usable/ biodegradable substitute and avoid use of plastics at various gatherings and meetings at the same time

NVCO reminds govt to implement Consumer Protection Act, 2019

DIMAPUR: Nagaland Voluntary Consumers’ Organisation (NVCO) has once again reminded the state government to immediately implement the Consumer Protection Act, 2019 and provide proper office/court room/building to run Nagaland State Consumer Disputes Redressal Commission in the State. In a representation to chief minister Neiphiu Rio, NVCO president Kezhokhoto Savi said though the State government had notified rules for implementing Consumer Protection Act, 1986, the Act had since been repealed and a new one enacted– the Consumer Protection Act, 2019. According to Savi, consumer markets for goods and services had undergone drastic transformation since the enactment of the Consumer Protection Act, 1986. Therefore, he stressed that it had become inevitable to amend the Act to address the myriad and constantly emerging vulnerabilities of the consumers. Savi disclosed that National Consumer Disputes Redressal Commission president was also likely to visit Kohima in August to check whether the State Commission and the district level commissions/ forums were functioning as per the Consumer Protection Act, 2019. They claimed that some people from Arunachal Pradesh had encroached on reserved forest land at Panbari to set up an agricultural farm and fenced the area, a senior officer said. Locals on the Assam side had opposed it and removed the fence, while some

miscreants from Arunachal Pradesh attacked an Assamese family and took away their motorcycle on Monday evening, he said. Police personnel from the Bordoloni outpost of Dhemaji rushed to the spot, and discussions among the officials of both the states were also held, the officer said. “The situation has been brought under control,” he said, adding that a strict vigil is being maintained in the area. The incident happened barely three days after Assam Chief Minister Hi-

manta Biswa Sarma and his Arunachal counterpart Pema Khandu had signed the ‘Namsai Declaration’ on July 15 wherein they had pledged to resolve the border disputes between the two states. The two states had also decided to restrict the number of ‘disputed villages’ to 86 instead of the previous 123 and would try to resolve the issues by September 15. The two states share an 804.1 km-long border. T h e g r i e va n c e o f Arunachal Pradesh, which was made a union territory in 1972, is that several forested tracts in the plains that had traditionally belonged to hill tribal chiefs and communities were unilaterally transferred to Assam. After Arunachal Pradesh achieved statehood in 1987, a tripartite committee was appointed which recommended that certain territories be transferred from Assam to Arunachal. Assam contested this and the matter is in the Supreme Court.

No casualty was reported in the explosion that targeted the residence of director Dr Ahanthem Shanta at Uripok Ahanthem Leikai under Imphal police station of Imphal West district around 8.30 pm on Monday. The bomb lobbed by the suspects exploded at a pond near the house of the director. A team of Imphal police station conducted a spot inquiry on Tuesday morning and registered a case. I TA NAG A R , J U L 1 9 (PTI): The Hollongi Greenfield Airport near Arunachal Pradesh capital Itanagar is all set to be operational from August 15, with the first flight test landing conducted by the Airports Authority of India (AAI) on Tuesday, a minister said here. A Dornier aircraft, manufactured by Hindustan Aeronautics Limited, landed at the airport at around 10.30 am. State Civil Aviation Minister Nakap Nalo claimed that the pilots, after the test landing, appreciated the runway and other infrastructure at the airport. Hollongi is about 15 km from Itanagar. Currently, there is no airport in the vicinity of the state capital, the closest one being Lilabari Airport in Assam’s

North Lakhimpur district, at a distance of 80 km from here. “AAI first flight test landing done at Hollongi Greenfield Airport today. As promised, we have completed the Hollongi Airport before time frame. It will be commissioned on 15th August 2022 and will be available for passengers,” Nalo tweeted. GUWAHATI, JUL 19 (PTI): More than 40,000 pigs have died of African Swine Fever in Assam since its detection in the state in early 2020, Animal Husbandry and Veterinary Minister Atul Bora said on Tuesday. Over 14,000 families have been economically affected as a result of the pig deaths and the disease has spread to 22 districts, the minister told a press conference here. The African Swine Fever (ASF), which was first detected in the country in Assam in February 2020, affects both domestic and wild pigs. While swine flu can spread from animals to humans, ASF cannot be transmitted from pigs to humans. Around 900 pigs have died since January 2022 mainly due to the massive flood this year, the minister said. “This is a deadly disease and the mortality of pigs is 100 per cent. At present 22 districts of Assam having 72 epicentres are affected by ASF. Since March 2020, 40,482 pigs have died of ASF affecting 14,005 pig farming families,” Bora said. The government culled 1,378 pigs spread across 27 epicentres to contain the spread of the disease in the north-eastern state, he added.

Assam cabinet approves formation of five new commando battalions

GUWAHATI, JUL 19 ( AGENCIES): Assam cabinet on Monday approved Rs 839.95 crore for the formation of five new Commando Battalions in the state. Reportedly, the battalions will be deployed in sensitive areas where the security situation is tense and this unit will constitute a key component of counterinsurgency operations, reports The Sentinel Assam. ‘’Besides, the new battalion will also play a pivotal role in enhancing the capabilities of the Assam police in tackling crime,’’ said Assam Tourism Minister Jayanta Malla Baruah while briefing the media after the cabinet meeting. The five battalions will be set up in the districts of

Hailakandi, Karbi Anglong, Sivasagar, Biswanath, and Tinsukia. Meanwhile, Assam Chief Minister Himanta Biswa Sarma took to Twitter to inform us that this move happened to be one of several other decisions taken at the cabinet meeting pertaining to the creation of new battalions, developing of new ropeways, setting up Assam Complex in Maharashtra, promoting forensic education, easing norms for EWS candidates, protection of tenure of ward commissioner, etc. In June last year, the Assam government decided to raise 10 new commando battalions on the lines of the National Security Guard (NSG) in order to give more muscles to the cops in combating crime.

would be difficult for them to win the 2024 parliamentary elections if the alliance with Congress and NCP continued. Shewale claimed that Thackeray had told the Shiv Sena MPs that he too was keen on realigning with the BJP and had made a lot of efforts in that direction last year. However, the decision to suspend 12 BJP MLAs from the Maharashtra assembly for one year in July last year created doubts in the BJP ranks about the sincerity of the Sena’s desire to revive the alliance with the BJP. NEW DELHI, JUL 19 (PTI): The Supreme Court Tuesday granted interim protection from arrest till August 10 to suspended BJP spokesperson Nupur Sharma in connection with the FIRs/complaints filed against her in several States over her remarks on the Prophet made during a TV debate show. It also protected her from any coercive action in the FIRs/complaints which may be registered or entertained in the future about the May 26 telecast. A bench of Justices Surya Kant and J B Pardiwala, which had earlier refused to club the multiple FIRs lodged against Sharma after coming down heavily on her for her controversial comments on the Prophet, took note of the alleged threats to life extended to her after its July 1 order. Observing that it never wanted Sharma to visit every court for relief, the bench issued notices to the Centre and several states

including Delhi, West Bengal, and Maharashtra on her plea urging protection from arrest as well as the revival of her withdrawn petition seeking clubbing of nine FIRs lodged in several states. “In the meanwhile, as an interim measure, it is directed that no coercive action shall be taken against the petitioner pursuant to the impugned nine FIRs/ complaints or such FIRs/ complaints which may be registered/entertained in future pertaining to the telecast dated May 26, 2022,” the bench said. The top court sought responses of the Centre and the concerned States by August 10, the next date of hearing. While taking note of the submissions made by senior advocate Maninder Singh, who appeared for Sharma and referred to the threats to her life, the bench said its concern is how to ensure that the petitioner will avail of the alternative remedy as permitted by the court on July 1. “In order to explore such modality, let notice be issued to the respondents in the miscellaneous application for August 10,” it said.

NEW DELHI, JUL 19 (PTI): Several opposition leaders and a BJP ally alleged Tuesday that the army was using caste as a factor for recruitment under the Agnipath scheme, a charge swiftly rejected by Defence Minister Rajnath Singh as a “rumour”. RJD leader Tejashwi Yadav and AAP’s Sanjay Singh launched a sharp attack on the government while JD(U) leader Upendra Kushwaha and BJP MP Varun Gandhi also tweeted a purported document linked to the recruitment exercise to question the need for a caste certificate and raised concerns. The ruling BJP accused the critics of “belittling and insulting” the army and alleged that they were trying to instigate youngsters for street protests. “I want to make it clear that this is a rumour. The

(recruitment) system which was in place before Independence is being continued and there is no change to this,” Singh told reporters in Parliament complex. BJP spokesperson Sambit Patra asserted that the army’s recr uitment process dates back to preIndependence. This was formalised by a “Special Army Order” after 1947, and the practice remains the same, he said. The army had submitted an affidavit in response to a PIL in the Supreme Court in 2013 when the Congress-led UPA government was in power, that caste or religion has no role in its recruitment, and applicants are asked about this for administrative reasons, Patra told reporters. Shewale, the leader of the rebel faction of the Shiv Sena, claimed that they have aligned with the BJP as per the wishes of Thackeray, who was himself making similar efforts in June last year but backtracked later. Economy under stress

t is not only India’s retail inflation rising to 7.79 per cent in April, the highest since May 2014 but also the falling rupee to the dollar which has breached the Rs.80-mark. These two negative factors are posing serious concerns for the economy. Inflation has been around for sometime but the government as well as the government-controlled Reserve Bank of India has been giving figures during the past year that do not reflect the correct picture. In simple words, inflation refers to the rise in the prices of most goods and services of daily or common use, such as food, clothing, housing, recreation, transport, consumer staples, etc. On this, the government has said its own agencies have provided the statistics but independent economists have always cautioned the government against trying to paint a rosy picture since there has to be basis for the pronouncement of India becoming the dream $5 trillion economy and global powerhouse by 2024-25.Such a claim was reiterated by Chief Economic Adviser (CEA) V. Anantha Nageswaran on June 14 , when he said India would become a $5 trillion economy by 202627 and $10 trillion by 2033-34. If the inflationary trends either continue or remain within the 6.5% to 7% region, it would be difficult to foresee the country achieving the objective. The current inflation has been driven by steeper edible oil and supply chain disruptions owing to the Russia-Ukraine war are responsible for rising prices. Since the start of 2022, as crude oil and other commodity prices have started rising in the wake of the war in Ukraine, India’s CAD has widened sharply. The retail inflation in India marginally eased to 7.01% on an annual basis in the month of June, from 7.04% in May, owing to easing crude and edible oil prices. The overall food inflation came in at 7.75% in June as compared to 7.97% preceding month. The Indian rupee breached the psychologically significant exchange rate level of 80 to a US dollar in early trade on July 19. A Bloomberg report stated that , the rupee declined to Rs.80.06 per dollar and was weakening against the dollar because in the market there is a greater demand for dollars than there is for the rupee. This increased demand for dollars vis-à-vis the rupees is, in turn, happening due to two factors. One, Indians importing more goods and services than what they export. This is what is called Current Account Deficit (CAD). When a country has it, it implies that more foreign currency (especially dollars) are flying out of India than what is coming in. The other factor is falling investments in the Indian economy. While foreign investments in India had picked up well but it gradually declined by beginning of 2022. This has happened because the interest rates in the US are rising much faster than in India. The Modi government admits that the current geopolitical situation and soaring prices may slow down growth even as inflation remains high. Ironically, this is happening at a time when the world economy is striving to emerge from the slump caused by the coronavirus pandemic and (is) steadily trying to boost the pace of growth and the jury is out whether the optimism for achieving the much-hyped $5 trillion economy makes economic sense.

But once His life has been created in me through His redemption, I instantly recognize His right to absolute authority over me. It is a complete and effective domination, in which I acknowledge that “You are worthy, O Lord…” (Revelation 4:11). It is simply the unworthiness within me that refuses to bow down or to submit to one who is worthy. When I meet someone who is more holy than myself, and I don’t recognize his worthiness, nor obey his instructions for me, it is a sign of my own unworthiness being revealed. God teaches us by using these people who are a little better than we are; not better intellectually, but more holy. And He continues to do so until we willingly submit. Then the whole attitude of our life is one of obedience to Him. If our Lord insisted on our obedience, He would simply become a taskmaster and cease to have any real authority. He never insists on obedience, but when we truly see Him we will instantly obey Him. Then He is easily Lord of our life, and we live in adoration of Him from morning till night. The level of my growth in grace is revealed by the way I look at obedience. We should have a much higher view of the word obedience, rescuing it from the mire of the world. Obedience is only possible between people who are equals in their relationship to each other; like the relationship between father and son, not that between master and servant. Jesus showed this relationship by saying, “I and My Father are one” (John 10:30). “…though He was a Son, yet He learned obedience by the things which He suffered” (Hebrews 5:8). The Son was obedient as our Redeemer, because He was the Son, not in order to become God’s Son.

Environment law needs to go beyond the ‘pollution paradigm’

R

ecently, the 2022 Environmental Performance Index projected that four countries – China, India, the United States, and Russia, will account for over 50% of residual global greenhouse gas emissions in 2050. A few weeks before that, the Intergovernmental Panel on Climate Change (IPCC) Sixth Assessment Report noted, as a final warning, that if global warming is to be limited to 1.5°C, immediate deep emissions reductions are essential across all sectors. At the launch of the IPCC Report, UN Secretary General, Antonio Guterres added, “(s)ome government and business leaders are saying one thing – but doing another. Simply put, they are lying. And the results will be catastrophic.” Several final warnings on the consequences of climate change have been delivered without resulting in the substantial recognition of acts/omissions that contribute to it, to be recognised as legal wrongs with adequate remedies in India. Other than the absence of an act of parliament addressing the climate, one hurdle for the articulation of climate change as a legal wrong in India, is the perspective from which environmental issues are viewed. Despite widespread and accessible knowledge available on the far reaching consequences of climate change, the environmental crisis continues to be seen as a ‘pollution

problem’. The restricted vantage point of the pollution paradigm is evident in the actions of environmentally irresponsible entities and how courts treat them. The fundamental question in the pollution paradigm is: how much harm to the natural environment is permissible? Legal remedies under the pollution paradigm are restricted to a post-facto, pollution management exercise. Intricate ecosystems and the complex relationships that run them are broken into what are understood as separable parts of a whole – air, water, forest, wildlife. When hearing petitions challenging environmentally degrading projects, courts view violations of environmental law from the perspective of restitution and compensation. The degradation of one is understood to be substitutable by replenishing the other. For instance, issuing a direction to plant trees and install smog towers where a development project violates conditions of its environmental clearance, as the Supreme Court did in the Central Vista case. More recently in Pahwa Plastics the Supreme Court framed the question before it in these words: “The question in this case is, whether a unit contributing to the economy of the country and providing livelihood to hundreds of people, which has been set up pursuant to requisite approvals from the concerned statutory authorities, and has applied for ex post facto EC,

With no Assembly in J&K, no MLA from the erstwhile state will vote in the Presidential election this time. But that did not deter Sinha from visiting the state, meet political leaders and support Kashmiris’ right to political voice and representation. Murmu’s handlers in the BJP saw no reason for her to visit J&K and seek support of non-existent legislators. Inconvenient questions, however, are being raised. Even if Murmu, unlike Sinha, has not spoken against defections, toppling elected governments and the President’s duty to uphold the Constitution, will she even raise decisions that affect tribal interests? Barely 10 days after the BJP announced her name as its candidate for President, the Union Government notified fresh Forest (Conservation) Rules, 2022. The rules eliminated the need for obtaining the consent of forest dwellers or even the Gram Sabha of the villages concerned, required earlier before clearing forests for commercial exploitation. Was Murmu briefed or even consulted? It was not required under the law but with the BJP tom-tomming its decision to promote a tribal as President, the decision betrayed a certain degree of insensitivity. Is it taking Draupadi Murmu for granted? As the Governor of Jharkhand, Murmu had indeed refused to give her consent when the then BJP chief minister Raghubar Das wanted to amend the Chhotanagpur Tenancy Act and the Santhal Pargana Tenancy Act. Both the laws protected tribal land rights and made it difficult for tribal land to be alienated. While the chief minister wanted to dilute the provisions and had the backing of the party in the face of tribal unrest, Murmu had stood firm. But can she display similar spine as President? Will she be as pro-active in protecting tribal rights and reservation for them? The lot of tribals in Jharkhand did not improve much when she was Governor though. Thousands of tribals were charged with sedition during the Pathalgarhi agitation; and thousands continue to languish in jail for being seen with Maoists or seen sharing meals at haats. Jignesh Mevani, the Gujarat

legislator and Congress leader, feels that just as Ram Nath Kovind’s elevation to the Rashtrapati Bhavan made to difference to the lot of Dalits in the country, Murmu’s election too will make little difference to the lot of tribals. Murmu’s nomination is being widely seen as BJP’s tribal outreach. RSS has been working through Vanvasi Seva Kendra and Saraswati Shishu Vihars in tribal areas for over half a century. And BJP’s poster boy Babulal Marandi, also a Santhal like Murmu, was made the first chief minister of Jharkhand. But Marandi quit the BJP for unknown reasons and floated his own regional party before doing a Ghar Wapsi a couple of years ago. But he continues to be in the doghouse in the party, which has not forgiven him yet. In the 2019 general election, BJP did win 31 of the 47 ST reserved seats in the Lok Sabha, four more than in 2014. But it lost power in both Jharkhand and Chhattisgarh, both the states having a sizeable tribal population. Out of the 29 seats reserved for Scheduled Tribes in the Chhattisgarh Assembly, it was the Congress which went on to win 25 of them. Similarly in Jharkhand, BJP could win only two of the 28 seats reserved for STs, the rest bagged by JMM and Congress. Murmu’s elevation as President, BJP hopes, would help it consolidate support of tribals in states like Gujarat, Rajasthan and Odisha as well. Draupadi Murmu is the only Governor of Jharkhand to have completed the full five-year term since the inception of the state in the year 2000. The unassuming and soft-spoken lady like her predecessor, it is widely believed in political circles, will sign on the dotted lines. But people who have seen her at Ranchi’s Raj Bhavan are not so sure. She has a mind of her own, claims an IAS officer from Jharkhand who goes on to add that she should turn out to be a fine propeople President. Murmu, a widow who lost one of her sons in a road accident in 2012 and her husband in 2014 following a heart attack, is known to be deeply spiritual. A devotee of BramhaKumaris with headquarters at Mount Abu in Rajasthan, she meditates regularly and had advised her only surviving child, a daughter, to remain single and join the order. The daughter is however married, has a two-year-old child and works in a bank. She taught Santhali in a school before getting a job in the Odisha secretariat. importantly, illegal acts become ‘technical irregularities’ in this crusade. An approach based in the procedures of environmental law, environment impact assessment, cumulative impact assessment for instance, requires environmental entities and environmental costs to be understood in their entirety, and the consciousness to understand that they are equal to social or economic costs. The fundamental test in this approach would be: Is the activity concerned necessary to meet an essential need which cannot be met by an environmentally acceptable alternative compliant with existing environment law? The correct approach must see all that which makes the environment – rivers, forests, the animal kingdom, natural processes and other entities as equal to human beings and their ‘needs’. To look beyond direct human impact, measurable today and understand consequences not so far in the future as IPCC and EPI have warned. A few developments in other jurisdictions are instructive. In the landmark Shell judgement of the Dutch Court, for the first time a court imposed a duty on a company to do its share to prevent dangerous climate change. The Court noted that the obligation on Shell to reduce emissions is an “obligation of result” and a “best-efforts obligation”. Therefore, to not just address pollution, but best

efforts to curb emissions altogether. Any climate consciousness in law and policy must look beyond pollution. In attempting to modernise international criminal law, Independent Expert Panel for the legal definition of ecocide, proposed to recognise ‘ecocide’ as international crime. Ecocide is defined as “as unlawful or wanton acts committed with knowledge that there is a substantial likelihood of severe and either widespread or long-term damage to the environment being caused by those acts”. Once adopted and incorporated with an amendment to the Rome Statute, this would be the only international crime that does not require direct human impact. Glimpses of this approach are also evident in the rights of nature movement. Judgements and legislations across the world on the rights of nature are attempting to change the architecture of environment laws, to rescue them from the pollution paradigm, to envision environmental costs more completely, to humanise them in order for them to be finally seen as real costs and to use the language of rights to translate the environmental crisis into a final warning that many reports, judgements, statutes and scholarship have hoped to be. In this way the new way of seeing, is really the old way of seeing the environment, to inform the way we should engage

with the environment. To make the environment and environmental issues alive as they have been in indigenous consciousness. Naturalist Sy Montgomery in her book, Soul of an Octopus, chronicles the time spent at the New England public Aquarium in getting to know the octopuses it was home to. By the end of her time there, these gentle giants came to not only recognise her, they greeted and embraced her with their suckers. Montgomery describes the meeting of the minds of two species which could not be more different and yet no more similar, breathing water and eating with their mouths, in their armpits. At the heart of the developments in law or the lack thereof, is human relationship with nature. Until environmental costs are seen equal to economic costs, construction projects such the Central Vista will continue to be disguised as development projects and violation of environment law will continue to be ignored as technical irregularities. If law is to be the forum to address the environment crisis, it needs conviction and moral courage to articulate it as the legal wrong that it is. Is India ready to deal with population challenges?

orld Population Prospects 2022 has revealed that India ran faster than expected in the population race and is set to become the largest populated country in the world in 2023, four years ahead than estimated in 2019. This brings unprecedented challenges which need to be converted into demographic advantage with planning and action at war footing, or else the nation will land into perilous conditions. The report by the Population Division of the United Nations Department of Economic and Social Affairs has been produced following a major upgrade of the entire process of estimates. It included, for the first time, estimates and projections by single year of age and by one-year time interval – the so-called “1x1’ data configuration instead of the “5x5” layout employed previously. This was done to respond to the growing demand for annual population data to assess progress in implementing the Sustainable Development Goals (SDGS). The implication of the data is that the world in general and India in particular will be in greater need to respond to this new data that far exceeds all earlier estimates. Now, November 15, 2022 is predicted to be the day that the global population reaches 8 billion, 8.5 billion in 2030, and 9.7 billion in 2050, before reaching a peak of around 10.4 billion during 2080s and remain at that level until 2100. Obviously, COVID, conflict and climate crises that are jeopardizing the global goals and creating new crises of food, fuel, and finance are most likely to be exacerbated by the burden of population. The world is already moving backwards on eliminating hunger and malnutrition, and the prospect of India to be housing the largest number of poor demands urgent attention. In 2022, the two most populous regions were both in Asia: Eastern and South-Eastern Asia with 2.3 billion people (29 per cent of the global population), and Central and Southern Asia with 2.1 billion (26 per cent). China and India, with more than 1.4 billion each, accounted for most of the population in these two regions. India is in an unenviable position since it accounts for

only 2.4 per cent of the total world surface area while housing over 17.7 per cent population. It goes without saying that the country will need to cater to the needs of the largest number of people in the world from the next year itself. More than half of the projected increase in global population up to 2050 will be concentrated in just eight countries, and India is among them along with Pakistan. Population pressure may trigger a desperate situation not only in India but also in its neighbouring countries in China and Pakistan. For many countries, including India, the challenges posed by rapid population growth are compounded by their vulnerabilities to climate change and sea-level rise. India becoming the largest populated country will mean greatest additional pressures on resources of the country and posing challenges to the achievement of the sustainable development goals (SDGs). It should be noted that India’s SDG preparedness ranking continues to decline. A UN report has found that India faces major challenges in 11 and significant challenges in 3 out of the 17 SDG goals. Challenges remain in one of the goals while only in two goal SDGs have somewhat been achieved. India clearly has gone out of track in achieving SDG targets by 2030. The challenge to feed, educate, and provide medication to the largest number of people in the world would increase. However, the share of population at working ages is going to increase thanks to reduction in fertility. Though with rise in life expectancy at birth, the population of elderly persons would also rise putting pressure on younger people for their care, but it would also shift in the age distribution that would provide a time-bound opportunity for accelerated economic growth known as the “demographic dividend”. To maximize the potential benefits of a favourable age distribution, India will need to invest in the further development of human capital by ensuring access to health care and quality education at all ages and by promoting opportunities for productive employment and decent work. As for aging population, the country should take steps

to adapt public programmes to the growing proportion of older persons, including by improving the sustainability of social security and pension systems and by establishing universal health care and long-term care systems. With a bigger population, India will have to face the problems related to migration within the country and abroad. It is therefore imperative for India to ready an action plan to deal with the situation in terms of providing jobs, housing, water, education etc to the migrants. The labour movements would be a special area of challenge that must be converted into opportunity by benefiting from the manpower. For this, India will have to take steps to facilitate orderly, safe, regular, and responsible migration in accordance with SDG target. The COVID-19 pandemic has impacted all components of population change including fertility, mortality and migration. The report has noted that it has continuing and profound impacts on health, economies and societies with no clear end in sight. India must take this warning seriously because it would need to protect largest number of people in the world. The relationship between population and sustainable development should be considered within the context of climate change and the environmental challenges having impact on all life forms in general and human life in particular. The largest population also means greatest environmental damage. It may exacerbate the problems or accelerate the timing of their emergence, depending on the problem in question, the timeframe considered, the available technology and the demographic, social and economic context, as a whole or in specific regions. India should also prepare to meet the needs of growing number of children and young people, and should invest in human capital by ensuring access to healthcare and quality education at all ages and opportunities for productive employment. Modi government must act fast and plan afresh in the light of the new yearly population data to respond to crises and cater to the needs in real time. (IPA Service)

NEW DELHI, JUL 19 (PTI): The Samyukta Kisan Morcha, an umbrella body of farmer unions, on Tuesday rejected the government’s committee on minimum support price, saying “so-called farmer leaders” who supported the nowrepealed farm laws are its members. Senior SKM member Darshan Pal alleged the Centre’s committee looks “bogus” as it does not talk about ensuring the legal rights of farmers. The government on Monday formed a committee on Minimum Support Price (MSP), eight months after it promised to set up such a panel while withdrawing the three contentious farm laws. Former agriculture secretary Sanjay Agrawal will be the chairman of the committee. The government has made a provision to include three members from the Samyukta Kisan Morcha (SKM) in the panel. “Today, we held a meeting of non-political leaders of Samyukta Kisan Mor-

The panel comprise Niti Aayog member Ramesh Chand, agri-economists CSC Shekhar from the Indian Institute of Economic Development and Sukhpal Singh from IIM- Ahmedabad and senior member of the Commission for Agricultural Costs and Prices (CACP) Naveen P Singh.

THIRUVANANTHAPURAM, JUL 19 (PTI): Kerala Higher Education Minister R Bindu has shot off a letter to Union Education Minister Dharmendra Pradhan, seeking strong action against the agency, which allegedly forced girl students to remove their undergarments before entering a NEET exam centre in Kollam district. In her letter to the Union Minister, the Kerala minister expressed “dismay and shock” at the news of “naked assault on the dignity and honour of the girl students” who appeared for NEET examination in an exam centre at Ayur in that district on Sunday. Bindu said an agency that has been entrusted with the conduct of the examination allegedly forced the girl participants to strip before entering the test centre for reasons known only to themselves. “The shame and shock of this unexpected turn of events have affected the morale and composure of the students whose performance in the test was consequently affected,” she

said and strongly recommended action against the agency to prevent future occurrences of a similar nature and sought the Union Minister’s intervention in the matter. “I write to place on record that we take strong exception to such inhuman behaviour from an agency that has only been entrusted with the task of conducting the examination in a fair manner”, the minister said. The issue came to light on Monday when the father of a 17-year-old girl told the media that his daughter, who was sitting for her first-ever NEET exam, was yet to come out of the traumatic experience wherein she had to sit for the over 3-hour-long exam without a brassiere. The father had told media that his daughter was dressed as per the dress code mentioned in the NEET bulletin which did not say anything about innerwear. The Kerala police has registered a case against the friskers allegedly involved in the incident on the basis of the complaint filed by the girl.

GURUGRAM, JUL 19 (PTI): A deputy superintendent of police investigating illegal stone-mining was killed Tuesday when a truck he signalled to stop in Haryana’s Nuh district drove into him, officials said. Hours after the officer’s death, police said a man allegedly involved in the killing was arrested after being shot at and injured during an encounter with them. Tauru DSP Surendra Singh had signalled the truck to stop. As the officer approached the truck to check documents, it ran over him. His gunman and driver jumped aside to safety. Singh was rushed to hospital where doctors declared him dead, police said. The DSP had gone to Pachgaon area near Tauru to conduct raids to stop illegal mining in Aravalli hills when he spotted the truck at 11.50 am. Haryana Chief Minister Manohar Lal Khattar promised strict action while the opposition slammed the BJP government over illegal mining in the state. “In the murder case of Tauru DSP Surendra Singh, orders have been given to take strict action. He lived with his family in Kurukshetra and hailed from Sarangpur village in Hisar district. Senior Congress leader Randeep Singh Surjewala demanded a judicial inquiry into the incident and alleged that the mining mafia was enjoying the state government’s patronage. “Does the chief minister not know that a mining mafia is flourishing from Yamunanagar to Nuh and Mewat? Why is the government acting like a mute spectator?” he asked.

In the previous trade, the yellow metal settled at Rs 50,284 per 10 grams. S i l v e r, h o w e v e r, dipped by Rs 137 to Rs 55,539 per kg from Rs 55,676 per kg in the previous trade. “Spot gold prices for 24-carat gold in Delhi were up by Rs 6 per 10 grams in line with firm COMEX gold prices,” said Tapan Patel, Senior Analyst (Commodities) at HDFC Securities. CAIRO, JUL 19 (AP): At least 22 people were killed and 33 injured in a car crash on Tuesday near Egypt’s southern province of Minya, authorities said. The crash took place in the early morning when a passenger bus hit a stopped trailer truck on a highway linking the capital of Cairo to the country’s south, local authorities in Minya said in a statement. The bus was heading toward Cairo. Authorities said the truck was changing tires on the roadside when the bus hit it in the city of Malawi in Minya province, about 220 kilometers south of Cairo. Ambulances rushed to the scene to transfer the injured to hospitals in Minya. Footage from the scene posted by local authorities showed a bus with heavy damage in the front half apparently from the crash with the back of the truck. Asian Games to be held in Hangzhou from Sep 23, 2023

BEIJING, JUL 19 (IANS): The 2022 Asian Games, which were postponed due to the prevailing Covid-19 situation in China, will now take place in Hangzhou from September 23 to October 8, 2023. The Olympic Council of Asia (OCA) took the decision on the new dates on Tuesday in Kuwait. CBI registers case against Batra after he resigns

NEW DELHI, JUL 19 (AGENCIES): The Central Bureau of Investigation (CBI) has registered a case against Narinder Batra, the former president of the Indian Olympic Committee (IOA) and Hockey India, and four others for misappropriation of funds. According to The Tribune report, the case has been filed against Batra and the others “for committing illegalities for renovation & furnishing of the office of President, Indian Olympic Association during the year 2018”. Apart from Batra, among those named are a few officials from Hockey India, including its executive director RK Srivastava, former president Rajinder Singh, former secretary Mohd Mushtaque and a few unknown officials. “Searches were conducted today at offices of HI & IOA at Delhi; residential premises of the accused at New Delhi & Jammu which led to recovery of incriminating documents/records,” a CBI statement said. The statement said that in 2018, the suspects “got executed the work of renovation & furnishing of the office of then President of IOA without prior approval of Executive Board of Hockey India”.

AIFF staring at FIFA ban after FSDL files case in Supreme Court

NEW DELHI, JUL 19 (IANS): The All India Football Federation (AIFF) is staring at a possible FIFA ban after Football Sports Development Limited (FSDL) which manages the Indian Super League filed a case in the Supreme Court, requesting to amend some clauses in the Draft Constitution submitted by the Committee of Administrators (CoA). Sources close to the development said that the FSDL is not happy with the way the SC-appointed CoA has drafted the constitution and included the clause of implementing the principles of promotion and relegation in ISL. This is the reason FSDL has filed a petition in the Supreme Court and is seeking permission to intervene in the matter, said the sources. In their application to Apex Court, FSDL said, “The Applicant, being an important stakeholder in Indian football, duly submitted to the All India Football Federation (“AIFF”), its comments and objections to the proposed Constitution of AIFF. As elucidated in detail hereinafter, it is the humble submission of the Applicant that the Committee of Administrators (“CoA”) has failed to take into consideration and has

even rejected certain material suggestions and objections to the Constitution of the AIFF made by the Applicant herein. “The Applicant is constrained to approach this Hon’ble Court as certain exclusive rights and entitlements granted in favour of the Applicant under a longterm agreement, i.e., the Master Rights Agreement dated 09.12.2010 (“MRA”) executed in the year 2010 by the AIFF are being totally disregarded and violated by virtue of certain provisions contained in the proposed Constitution of the AIFF. Further, the said provisions are also against the development and promotion of football in India.” A delegation of FIFA and the Asian Football Confederation (AFC) has set the Committee of Administrators (CoA) a deadline of July 31 to amend the statutes of the Constitution and conclude the elections by September 15, 2022. In case, the case is prolonged and goes on beyond the deadline set by the FIFA-AFC delegation, the sport’s world governing body could ban the AIFF, said the source. The Draft Constitution says, “Provided that the above functions/roles cannot be delegated or assigned to any other entity or organization.” It is clearly mentioned in article 63 of the Draft Constitution that the AIFF is the original owner of all of the rights emanating from Competitions, without any restrictions as to content, time, place and law, and shall retain these rights under all circumstances. “These rights include, among others, every kind of commercial rights, financial rights, audiovisual and radio recording, reproduction and broadcasting rights, multimedia rights, marketing and promotional rights and incorporeal rights.”

NepalT20 League from September 24

KATHMANDU, JUL 19 (IANS): The Cricket Association of Nepal (CAN) has unveiled four of the six teams that will feature in the inaugural season of the NepalT20 League, scheduled to take place from September 24 to October 22 at Tribhuvan University Cricket Stadium. Players from around the world will be taking part in the first season of the league. The four franchises are Kantipur Capital, Biratnagar Superkings, Janakpur Royals and Lumbini All Stars.
