ACAUT questions re-tabling Lokayukta (Amendment) Bill

D I M A P U R , N OV 2 5 (NPN): Against Corruption and Unabated Taxation (ACAUT) Nagaland has expressed strong objection against the move of the government for reintroduction of the Lokayukta (Amendment no 2) Bill at the ongoing Assembly Session on the ground that this will only defeat the very essence of the Nagaland Lokayukta Act. ACAUT also recalled that the then governor RN Ravi had “rightly” returned the Nagaland Lokayukta (Amendment No. 2) Bill, 2021 to NLA speaker Sharingain Longkumer for reconsideration since it was deemed as “antithesis for transparent governance” ACAUT media cell pointed out that the post of Lokayukta in Nagaland has been lying vacant beyond the 6-month time frame as per the Nagaland Lokayukta Act 2017 under section 3(9). ACAUT said the time

limit expired on August 5, 2021, but till date the twomember search committee consisting of the chief secretary and advocate general, were still unable to submit their report. Instead, the Lokayukta (Amendment no 2) Bill was being tabled at the ongoing monsoon session of the state Assembly 2021, ostensibly to change/extend the time period for appointment of Lokayukta from six months to one year. ACAUT also informed that as per the provision of the Nagaland Lokayukta Act, the Lokayukta in the state comprises of a Chairman/Lokayukta and four other members designated as Upa Lokayukta. However, the state government, without assigning any reason, appointed only two persons-Lok Ayukta and Upa Lokayukta. However, the Lokayukta resigned under compelling situation and the sole member (Upa Ayukta) has been

manning the entire institution all alone, said ACAUT. ACAUT therefore questioned, whether a single person had the legality and propriety to hold a public legal institution which was legally mandated to be manned by five qualified persons? It maintained that at least the minimum requisite quorum of three persons should be followed “to avoid being hit by Coram Non Judice.” On the appointment to the tenure post of Upa Lokayuta, ACAUT said this should be drawn from the general age group and should be person(s) of impeccable integrity, valid qualification and without any party affiliation. Therefore, ACAUT said that the appointing authority, being governed by law, appointment against such legal quasi-judicial posts should inarguably be within the parameter of the law.

New Covid variant confirmed with multiple mutation LONDON/JOHANNESBURG, NOV 25 (PTI): A new variant of COVID-19, feared to have a high amount of spike mutations unseen before, has been detected in South Africa, with authorities there confirming 22 positive cases associated with it on Thursday. Dr Tom Peacock, a virologist at Imperial College London, posted details of the new variant classed as B.1.1.529 on his Twitter account earlier this week, following which scientists have been weighing in on what is being considered a variant of concern – though it is yet to be formally categorised. Scientists the world over will be watching the new variant for signs of gaining momentum or spreading more widely and rapidly. The high number of spike mutations are concerning from the point of view of both higher transmissibility and immune evasion. “Bottom line is B.1.1.529 may already be quite widespread in SA [South Africa],” Dr Peacock tweeted on Thursday.

KO H I M A , N OV 2 5 (NPN): State chief minister, Neiphiu Rio said Thursday said there was no shortage of teachers in the state, but rather an excess of about 10,000 teachers as indicated by the current teacher-student ratio of 1:10 as against the national average of 1:30. He was responding to a starred question during the ninth session of 13th Nagaland Legislative Assembly here on Thursday. Rio described the state ratio as good but only problem being lack of adequate teachers for math and science subjects. The chief minister informed that an exercise was being carried out to identify schools having no enrolment but teachers posted and also schools where teachers outnumber students. The chief minister also noted that the cabinet had banned appointments during Covid-19 pandemic but, since the pandemic has eased, the ban was lifted. However, between the process of scrutinising vacancies in each department coupled with NSF’s demand for NSSB and ENPO’s demand for 45% reservation, a case was filed and the court banned all appointments. He said that till today, the government was struggling with the issue of ap-

pointment and urged upon members to give the government some time to resolve the issue. Rio also said that the government has appealed to Gauhati High Court, Kohima Bench to remove restrictions on fresh appointments in various government departments. PWD (M&H) minister Tongpang Ozukum claimed that there were excess teachers in urban areas as nobody wanted to go to rural areas. He said teachers would be redeployed in schools where there was shortage. Highlighting the challenges faced by the department, school education advisor KT Sukhalu said appointment could be made only after the ban

was lifted by the court. NPF legislator Yitachu expressed concern over shortage of teachers in primary schools and urged the government to look into the matter so that schools in the state would be able to run with full strength. NPF legislature party leader, TR Zeliang also echoed the same concern and called upon the government to look into the matter of appointments in the School Education Department. He urged the cabinet to take this matter as most important agenda so that the ban is lifted, particularly for the School Education department. NPF member Imkong L. Imchen also opined that appointments in and school education and medical departments needed to be exempted from the purview of the ban. KO H I M A , N OV 2 5 (NPN): Nagaland chief minister Neiphiu Rio on Thursday introduced the resolution for implementation of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest (SARFAESI) Act, 2002 on the first day of the ongoing 9th session of the 13th Nagaland Legislative Assembly. Moving the resolution, Rio said that the Nagaland Land and Revenue Regulations (Amendment) Act, 2002 amended the Assam Land and Revenue Regulations, 1886 by inserting a proviso after sub-section (2) 162 permitting transfer by way of mortgage in favour of the banks, registered cooperative societies and the financing institutions with

the condition that such entries shall not transfer any land to a person other than the indigenous inhabitant of Nagaland except with the previous sanction of the state government or an authority appointed in this behalf. The resolution stated that opinions were expressed on the applicability of SARFAESI Act, on account of the specific constitutional protections under Article 371 A (I) (a) (iv), and the consequent nonimplementation of the Act has been detrimental to the overall economic growth of the state, restricting flow of credit to the people. It further said that banks had been reluctant to provide loans in the absence of secured assets and an effective mechanism for the expeditious recovery of dues in case of default in loan

repayment. The resolution asserted that “Article 371 A(I)(a)(iv) of the Constitution of India provides that no Act of Parliament in respect of ownership and transfer of land and its resources shall apply to the State of Nagaland unless the Legislative Assembly of Nagaland by a resolution so decides.” It pointed out that the provisions of SARFAESI Act, 2002 cannot override any provision of the Constitution of India. “The tenor of Article 371A of the Constitution of India will apply at the stage when the banks/ financial institutions would make an attempt to transfer the ownership of the property through the process of auction,” it added. Therefore, the resolution stated that “banks/ financial institutions are obligated to respect and follow

the mandatory constitutional protection (Article 371 A (I)(a)(iv)) to ensure that the ownership of Security Interest is transferred, following the procedures laid down in the SARFAESI Act 2002 read with the Nagaland Land & Revenue Regulations (Amendment) Act 2002 and other applicable Acts of Nagaland, only in favour of an indigenous person and none else.” The resolution will be taken up for consideration and adoption on November 26. Meanwhile, the chief minister also moved three bills-- The Nagaland Fiscal Responsibility and Budget Management (Fourth Amendment) Bill, 2021, The Nagaland Goods and Services Tax (Fifth Amendment) Bill, 2021 and The Nagaland Lokayukta (Second Amendment) Bill, 2021.

The report pointed out that the budget allotment and expenditure of the health and family welfare department against the

overall state budget during the five-year period 201419 ranged from Rs.521.09 crore (4 per cent) in 2014-15 to Rs.797.48 crore (3.90 per cent) in 2018-19 even as the National Health Policy, 2017 envisaged allocation of at least eight per cent of the total budget of the state for health sector. CAG repor t found that expenditure on health ranged from Rs.418.09 crore (4.13 per cent) to Rs.631.42 crore (4.17 per cent) of the total state budget during the period. It stated that the department did not utilise the allocated funds in five years period 2014-19 with savings ranging from Rs.103 crore (19.77 per cent) in 2014-15 to Rs.166.07 crore (20.82 per

cent) in 2018-19. Out of the total expenditure of Rs.2649.93 crore incurred on health during 2014-19, CAG report stated that revenue expenditure was Rs.2493.73 crore (94.10 per cent) and the capital expenditure was Rs.156.20 crore (5.90 per cent). It said the department spent a mere 0.58 per cent of the total revenue expenditure on drugs/ medicines. Due to decline in revenue expenditure on drugs and medicines, CAG report said there was shortage of drugs in health units across the state. It said availability of drugs in the sub-centres varied from 5 per cent to 73 per cent with an average of 33 per cent. (Cont’d on p-8)

NGBF, ENNWA of NSCN (R) dismayed over split within NSCN (R) D I M A P U R , N OV 2 5 (NPN): Nagaland GB Federation (NGBF) and Eastern Naga National Workers Association (ENNWA) of the NSCN (R) have expressed dismay over the split within the NSCN (Reformation). NGBF: Nagaland GB Federation (NGBF) Thursday said it was disheartened by the “latest development that has taken place among NSCN (R).” In a press release, NGBF president Sahlem Konyak and general secretary Shikuto Zalipu said it was “very unfortu-

nate and juvenile on the part of NSCN (R) to opt for yet another split at this crucial juncture” when Nagas were appealing to the Naga political groups (NPGs) to “come together as one for decades old Naga solution.” NGBF said “they must realise that their every step determines Naga’s future in respect of Indo-Naga political solution”, adding that “our slight mistake can derail our mission.” Further, NGBF said that individual or group’s interest should not be greater than that of

State logs 14 fresh Covid-19 cases D I M A P U R , N OV 2 5 (NPN): Nagaland on Thursday recorded 14 fresh Covid-19 positive cases while no fatalities were reported during the day. Of the fresh cases, eight were from Dimapur, four in Kiphire and one each in Mokokchung and Wokha, talking the total caseload to 32092. Training on food processing DIMAPUR: A three-day skill development training on local food processing and preservation was organised by ANMA Integrated Development Association (AIDA) under SBI Foundation – gram seva programme from November 21-23 in all five adopted villages of SBI Foundation. AIDA informed that the first stage training was delivered by convergence officer (AIDA- SBI GS staff) Imnayangla Jamir with support of program manager Pfokho John and livelihood officer Kt Khino Anal at Tsithrongse village for gram sevaks, remedial teachers and some SHG representatives. The training was organised to provide skilling and trainings to rural community, to encourage selfemployment by promoting small, cottage and local industries and to empower rural women. The 15 representatives would train SHGs at their respective villages namely Urra, Bade, Tsithrongse, Diezephe and Khriezephe.

DIMAPUR: DGP Nagaland, T. John Longkumer, Thursday disclosed that the Nagaland police since 2018-2020 had registered 249 cases of violence (crime) against women leading to the arrest of 19 persons, rescue of 26 women and girl from human trafficking and rescue of 18 sex workers. He was speaking as the guest of honour at the flagging off programme of the “car campaign” ” in commemoration of “international day for the elimination of violence against women” (IDEVW) and “16 days of activism against gender-based violence” on the theme “end violence against women now!” at old MLA hostel junction, Kohima. He said that said that it has been the concerted effort of the Nagaland po-

lice to address the issue of violence against women and to this effect, women police stations and anti-human trafficking units had been established in all the districts. Additionally, DGP informed that women help desks had been established in every police station to increase the outreach and reassured the women of Nagaland that there were constitutional and legal provisions available to combat this threat and ensure justice to all who were wronged. He said that the Indian constitution through the fundamental rights and directive policies of state policies laid the foundation for a just and egalitarian society where the dignity and respect of women was ensured. The legal provisions in the Indian Penal Code and CrPC (Amendment Act)

2013 enshrine preventive and punitive actions to safeguard the rights of women and girls. These laws are further bolstered by other laws such as Protection of Women from Domestic Violence Act 2005, (Prevention of) Immoral Traffic in Women’s and Girl Act, Sexual Harassment of Women at Work Place 2013, POCSO Act 2012, The Prohibition of Child marriage Act, 2006, Indecent Representation of Women (Prohibition) Act 1986 and the IT Act 2000, he informed. He said the campaign was aimed to prevent and eliminate violence against women and girls by increasing awareness, promoting advocacy and creating opportunities for discussions on the challenge and solutions and assured that all grievances would

be taken up expeditiously for redressal as per the law of the land. Need to identify forms of violence against women that present Naga society is faced with: NSCW chairperson NSCW chairperson, Khrienuo Tachü in her introductory message briefed that the 16 days of activism was observed worldwide to end all forms of violence against women. She said that mass awareness and sensitisation was required to stop sexual harassment, domestic violence, and the exploitation of women and girl child. “As a community we need to identify and address the forms of violence against women that the present Naga society is faced with”, she stated. She said that every female should be able to

walk freely and safely in the streets in any locality at any hour without fear, threat or harassment. Tachü informed that NSCW was working together with several stakeholders to end all forms of violence against women and that change must come from the grassroots. In this regard, she informed that NSCW was cooperating and working closely with tribal community leaders, colony and locality elders and church leaders to bring change and achieve concrete results. Meanwhile director, social welfare, Michael Zaren and member secretary, Nagaland state legal services authority, Victo Sema shared their views on calls to increase awareness, galvanise advocacy efforts and sensitise the end of violence

against women. The programme was jointly organised by department of social welfare, NSCW, NSSWB, SRCW, Angawadi, child line and women helpline, KCCI, AKMWP, NAC. Around 50 cars participating in the campaign dispersed to various colonies across Kohima town distributing IEC materials, flyers, posters, banners, etc., to create awareness on the elimination of violence against women. Wokha: Commemorating IDEVW, 16 day activism against gender based violence under theme was launched in the conference hall of the deputy commissioner (DC), Wokha on Thursday. According to a DIPR report, SDO (C), Wokha Selemla S. Sangtam who

chaired the meeting said this was an annual event and during this 16 day activism, team from Mahila Shakti Kendra, Saki-One Stop Centre (OSC) and volunteers would be conducting house to house campaign where pamphlets and leaflets would be distributed to spread awareness and sensitise the people on ending violence against women. Central administrator, Sakhi-OSC, Renthunglo Kikon said that OSC office which was located at district hospital premises was fully functional and the staff were working tirelessly to assist girl child and women in distress and those facing domestic violence and other forms of violence such as sexual harassment and child abuse. She urged the gathering to report such cases to the office of OSC so that timely action and help would be extended to the victims and that OSC was offering counselling and other basic needs free of cost. DIMAPUR: A block-level orientation on COVID-19 prevention and control in schools under the programme of Nagaland Education Project-The Lighthouse (NECTAR) was held on November 23 at EBRC (Samagra Shiksha) Training Hall, Tseminyu with the school heads under the establishment of SDEO Tseminyu. In a press release, EBRC (SS) Tseminyu informed that special guest Extra Assistant Commissioner (EAC) Tsogin Rosy Sangtam exhorted the teaching fraternity to work hand in hand. She admitted that teaching was not an easy job and for which proper coordination and cooperation was prerequisite since teachers deal with a

wide range of people and backgrounds. Sangtam emphasised that the teachers as moulders should not give up on their mission or calling to lay the foundations of students for posterity. Stating that people would continue to live in a “new normal”, Sangtam said one should find ways to overcome the problems of COVID-19. DIMAPUR: An inter departmental coordination meeting under Pfutsero sub division was held in the conference hall of the ADC Pfutsero on November 22. According to a DIPR report, while chairing the meeting, additional deputy commissioner (ADC), Pfutsero welcomed the members and briefed the house on the various issues discussed in the previous inter-departmental meeting. Stressing on the impor tance of attending the monthly coordination meetings, he urged the officers to be sincere and regular as various important agendas were discussed during such meetings. Rejected TMC’s merger proposal: Akhil Gogoi GUWAHATI, NOV 25 (PTI): Raijor Dal president Akhil Gogoi said on Thursday that his party has not accepted the Trinamool Congress’s proposal of a merger as it does not want to compromise on its Assamese identity. Addressing a press conference here, Gogoi, however, said that only West Bengal Chief Minister Mamata Banerjee can challenge and defeat Prime Minister Narendra Modi in the present political situation. “I have not met TMC leaders, but they have been in touch with us regularly. They even contacted us just a while ago. They invited us to discuss all issues and take a final decision. “The TMC is giving us a proposal that we should merge with them. Our point is that we represent the Assamese regional sentiment. We are a regional political party, representing Assamese nationalism. We don’t want to compromise on our separate regional identity,” Gogoi, also an MLA, said. If the opposition wants to defeat the BJP and RSS in 2024, then all the regional forces must unite and form a federal front, he added. “We have been discussing these two points with the TMC. They gave us the proposal of merger, but we have not accepted it because we believe in our

separate regional identity,” Gogoi said. He also asserted that if there is anyone who can challenge and defeat Modi in the current scenario, then there is no doubt that it will be Mamata Banerjee. Raijor Dal, born out of the anti-Citizenship (Amendment) Act movement, has only one representative in the Assam assembly in Gogoi as an Independent MLA. The TMC has been trying to expand its presence across the country with an ambition to lead the antiBJP force in the 2024 Lok Sabha elections and project Banerjee as the only reliable challenger to Modi. Twelve of the 17 Congress MLAs in Meghalaya, including former chief minister Mukul Sangma, joined the TMC, dealing a body blow to the grand old party in the Northeastern state. The TMC earlier entered Tripura’s political arena, contesting a bitterlyfought municipal election in the neighbouring state. It will also contest the assembly elections in Goa. Banerjee, on her recent trip to Delhi this week, cast her net wide and had a good catch in three-term Congress MP from Bihar Kirti Azad, former JD(U) general secretary Pawan Varma and Haryana politician Ashok Tanwar, a former state Congress chief.

AJP aims to revive anti-CAA stir in Assam GUWAHATI, NOV 25 (PTI): Opposition Assam Jatiya Parishad (AJP) on Thursday announced a 10day state-wide programme to revive the anti-Citizenship (Amendment) Act protest, which had been marked by violence two years ago. AJP president Lurinjyoti Gogoi appealed to the people to join the protest in large numbers to commemorate two-years of the protest, which had seen five civilians losing their lives in police firing. “The relevance of the anti-CAA movement has increased after the successful farmers protests, which showed that a democratic agitation can bring positive results. We believe that the anti-CAA movement should restart in the state,” Gogoi told reporters here. Democratic movements have an important role to play in a democracy and can reverse anti-people decisions, said Gogoi, who was at the forefront of the anti-CAA protest in December 2019 as the general secretary of All Assam Students Union (AASU). When pointed out that BJP had won a decisive mandate in Assam in the Lok Sabha and the MarchApril state polls, the AJP leader said “The Congress had won the election in Assam after enacting the IMDT Act, which was antiAssamese and people had protested against it”.

The 10-day protest by AJP will begin with observing Martyrs Day on December 10 at Chhaygaon followed by ‘Black Day’ across Assam the next day. The Centre’s decision to repeal three controversial farm laws following the over a year-long agitation by farmers has given a fresh impetus to several outfits in Assam to revive the antiCAA stir. The AASU and Krishak Mukti Sangram Samiti (KMSS), outfits that were at the forefront of the anti-CAA protest in 2019, Raijor Dal and the AJP, the two political outfits formed by leaders of the protests, are now holding discussions within their organisations and with other groups to intensify the agitation. The contentious CAA seeks to provide Indian citizenship to Hindus, Jains, Christians, Sikhs, Buddhists and Parsis entering India on or before December 31, 2014 from Bangladesh, Pakistan and Afghanistan after five years of residence here. The anti-CAA stir began as a mass protest led by students and youth organisations in early 2019 before the Lok Sabha polls. It subsided after the 2016 format of the bill lapsed in June 2019 when the term of the then Lok Sabha ended as it could not be tabled and passed in Rajya Sabha. When the bill of the

present CAA was passed in Lok Sabha on December 9, 2019, Assam had witnessed one of the most violent protests in its history which saw three rail stations, post office, bank, bus terminus, shops, dozens of vehicles and many other public and private properties being set ablaze or totally damaged. After the Rajya Sabha passed the Citizenship (Amendment) Bill on December 11, the state had erupted in uncontrolled protests, in which agitators fought pitched battles with the police and administration in almost every major city and town of the state. This led to a government crackdown, including arrest of leaders of the stir, snapping of internet connectivity and imposition of curfew. The momentum of the stir slowed down after the AASU, which came into prominence after the arrest of KMSS leader Akhil Gogoi and some of his associates, decided not to block roads, organise demonstrations in fields and complete daily protests before sunset. The stir had almost faded away after the students union had announced a temporary break from protests in view of class 10 and 12 board exams in January-February 2020. The agitation literally died following the COVID-19 outbreak and subsequent lockdowns.

TMC to be an effective opposition: Mukul Sangma SHILLONG, NOV 25 (IANS): Opposition leader Mukul Sangma, who along with 11 Congress MLAs joined the Trinamool Congress (TMC) on Wednesday night, on Thursday said that the Congress has failed as an effective opposition party in the country and the TMC would be a pan-India viable alternative opposition party. Reliable sources said that political strategist Prashant Kishor and his team members, who have been camping in Shillong for the past two months, apparently engineered the defections. Pala said in Shillong that the desertion of the 12 MLAs is not a setback for the party, it is a new challenge and the Congress leaders know how to face the challenge. With the latest political development a triangular contest is in the offing in the 2023 assembly elections between the ruling National People’s Party (NPP) led Meghalaya Democratic Alliance (MDA) in which the two-member Bharatiya Janata Party is an ally, the Congress and the TMC. The latest political development in the northeast state is a major boost for West Bengal Chief Minister and TMC supremo Mamata Banerjee, who after the March-April assembly election success in her state, has been trying to expand her party’s footprint beyond Bengal. Cong mulling legal action against defectors

Correspondent The Congress, which lost 12 of its 17 legislators in Meghalaya to the All India Trinamool Congress on Thursday, said it was mulling legal action in this regard. “Legally also we will fight. We are in touch with our lawyers. Soon we will also do something,” Meghalaya Pradesh Congress Committee president, Vincent H Pala said. “I expected this to happen. So, honestly, we all were prepared. Definitely there will be damage done to certain areas in the Garo Hills, where Mukul, who was the chief minister and been in the party for so long, but there will also be resurgence of the Congress, especially in the East, and the North and the South of Garo Hills,” Pala said in reference to Mukul Sangma taking the major chunk out of the CLP to merge with the TMC. Former Speaker and veteran Congress legislator, Charles Pyngrope, who also defected to the TMC, said that the legislators have merged with the TMC by virtue of having two-third of the strength of the State legislature. However, legal experts and political observers maintain that the defection of the Mukul- Sangma led faction of the Congress to the TMC would not attract any action under the anti- defection law as they have the requisite numbers with them.

IMPHAL, NOV 25: Manipur government on Thursday agreed to introduce the proposed new Manipur (Hill Areas) Autonomous District Council (ADC) Bill-2021 in the house of state Assembly. With this, the agitating tribal student bodies have agreed to suspend the ongoing economic blockade on national highways. The government also agreed to the release of all the executives of ATSUM, KSO and ANSAM arrested by the police earlier without any conditions. The agreement was signed between the leaders of agitating student bodies and the state government after a talk in the presence of tribal ministers in the N Biren Singh government today, in the evening. Presidents of ATSUM, ANSAM and KSO and additional chief secretary Letkhogin Haokip were the

signatories of the agreement. The talk was held in the presence of state YAS minister Letpao Haokip, PHE minister L Dikho and hills and tribal affairs minister Vungzagin Valte and officials of the state tribal affairs and hills department. During the talk, the state government agreed to hold a discussion with Hill Areas Committee (HAC) of the state assembly on the draft ADC bill within five days (on or before November 30) The state government further agreed to introduce the draft ADC bill 2021 in the upcoming winter session after completing the due process of law provided under the Constitution of India. At the same time, the student bodies agreed to suspend the three-day old economic blockade on the national highways for the time being,” the points of agreement which a copy is available with the Imphal Correspondent stated.

Reports said that the combined team arrested the 11 executives while they were imposing the blockade by stopping Imphal-bound loaded trucks last night, around 11 pm. Denouncing the arrest of its leaders, ATSUM had served an ultimatum to release its leaders by 2pm of today (November 25) while threatening to intensify its ongoing agitations. Meanwhile, windshields of at least five Imphal-bound loaded trucks were smashed by suspected blockade supporters while crossing Nungba Bazar area along NH-37 around 1am on Thursday. Raining projects in UP

F

or political parties that matter, Uttar Pradesh does matter in every way for it holds the key to power at the centre. UP provides the highest number of Lok Sabha seats at 80. Any political party wanting to make a serious try for power has to first make its imprint in the 403- member state assembly. For the BJP, the 2022 Assembly elections in Uttar Pradesh is most crucial as that itself will serve as an indicator of whether the party with prime minister Narendra Modi at the helm, can turn around the fortunes of the party. Incidentally, prime minister Modi migrated from Gujarat and adopted Uttar Pradesh as his home state and contested from Varanasi and won handsomely in 2014. UP was ripe for the picking and Modi led from the front in 2014 when he stood from Varanasi to win big from UP and other states like Madhya Pradesh, Rajasthan, Gujarat etc. Earlier in 2012, the BJP had won 28 seats to the Samajwadi Party’s 224 and BSP’s 80 in the assembly elections. In the 2014 Lok Sabha elections, the BJP won impressively bagging 71 out of 80 seats and no other party could cross the 5-mark. This was reflected in the 2017 assembly elections when BJP overtook all other parties by winning 312 of the 403 seats in the UP assembly. The SP could manage only 47 seats. However in 2019, the BJP could not retain the 71 seats it won in 2014 when the party bagged 62, the BSP 10, SP 5 and Congress 1. With just a few months left for the crucial UP polls, the state will see the launch of several mega projects, some of which will be inaugurated by Prime Minister Narendra Modi. The series of projects will be launched in the months of November and December ahead of the polls due next year. Among the mega project is the Noida International Airport at Jewar Uttar Pradesh. Jewar , when fully completed will be Asia’s biggest airport. It is the fifth international airport is to come up in NOIDA in the National Capital Region (NCR). The phase-1 of the airport will have a capacity to serve 12 million passengers a year and is scheduled to be completed in 36 months. Prior to Modi, UP had only two international airports - Lucknow and Varanasi - till 2012. The third international airport at Kushinagar became operational after it was inaugurated by Modi on October 20, while work on the airport in Ayodhya is on in full swing and air services are expected to start early next year. Besides the Noida international airport, Modi also inaugurated Film City and Ganga Expressway. He will also inaugurate Gorakhpur’s closed fertilizer factory and Gorakhpur AIIMS will also start by next month. Modi also inaugurated the 340.8 km Rs.22,500 crore Purvanchal Expressway which also has a 3.2 km air strip to be used during emergency. Modi is also to launch the National Cadet Corps Alumni Association of which he would be the first member. He would launch 100 new co- educational Sainik Schools as well. He had also earlier, inaugurated the Rs. 400 crore unit for propulsion system of anti-tank guided missiles under the UP defence corridor in Jhansi is part of the projects that would be launched besides Rs. 6300 crore worth of projects in the Bundelkhand region. Modi and the BJP are leaving nothing to chance in order to retain UP and also win huge in 2024. It remains to be seen if voters in UP will vote for Adityanath or Akhilesh in 2022 and Modi or others in 2024.?

Most of us are not consistent spiritually because we are more concerned about being consistent externally. In the external expression of things, Paul lived in the basement, while his critics lived on the upper level. And these two levels do not begin to touch each other. But Paul’s consistency was down deep in the fundamentals. The great basis of his consistency was the agony of God in the redemption of the world, namely, the Cross of Christ. State your beliefs to yourself again. Get back to the foundation of the Cross of Christ, doing away with any belief not based on it. In secular history the Cross is an infinitesimally small thing, but from the biblical perspective it is of more importance than all the empires of the world. If we get away from dwelling on the tragedy of God on the Cross in our preaching, our preaching produces nothing. It will not transmit the energy of God to man; it may be interesting, but it will have no power. However, when we preach the Cross, the energy of God is released. “…it pleased God through the foolishness of the message preached to save those who believe.…we preach Christ crucified…” (1 Corinthians 1:21, 23).

Happiness: An outcome of money acquisition or beyond H appiness as a term and a vocabulary is often used by all – the rich and the poor, irrespective of nationality, gender, creed, color, class or caste. There have been a number of definitions and notions on ‘happiness’ available in the literary world. Over the years, ethicists, philosophers, theologians and others have delved into the meaning and content of ‘happiness’ from diverse vantage points. And yet, the conception of ‘happiness’ keep changing as the templates radically and drastically shifts and thus warrants more clarity as the world we live progresses. Notions on ‘happiness’ though available in plenty, however there are two perspectives seem to be clashing with each other – material and beyondmaterial. From an economic perspective, Ruchir Sharma comprehensively argues in his article appeared in the Times of India dated 11th of November, 2021, that how money as means to happiness leverages which the US Congress recently joined a growing list of world leaders pushing to supplement GDP with a broader measure of human progress. In line with it, Simon Kuznets, the Nobel Laureate who invented the precursor to GDP to quantify US losses during the Great Depression. Substantiating further, he cites Kuznets who pushed for a higher standard moving beyond the crude tallying of goods bought and sold hardly reflected the well-being of people. In

`1968, US Senator Robert Kennedy said gross output measures everything “except that which makes life worthwhile”, including the health, education and welfare of children. These aspects add more value, while quantifying and qualifying Gross Domestic Product (GDP). However, researchers have been proposing alternatives from Gross National Happiness to the Well-Being Index. Using examples such as Malaysian Fuzzy Quality of Life Index, and India’s Green GDP, more specifically, the US legislators keep promoting the Genuine Progress Indicator (GPI), which contends alongside the Better Life Index (BLI) mooted by the Organization for Economic Co-operation and Development (OECD). Nonetheless, GDP is the most commonly used measure for the size of an economy, growth and development. GDP can be compiled for a country, or region or for several countries combined together. As the contours of indicators to measure GDP keep changing, currently the contender is the Better Life Index (BLI) endorsed by OECD. For decades there have been attempt to replace or modify GDP in tune to the changing social and environmental factors or the combination of both or disagreeing on some aspects of it so that new ways of measuring it. There are a few who are opposed to measuring GDP because it takes the sum total of the gross domestic product that obscures the per capita income of

a person, which is why they want measuring GDP per person or aggregating the average income per person. Measuring GDP per person or average portrays and thus reflects on a few social welfare indicators by showing how a particular section (s) of population have progressed in socio-economic facets. It is assumed generally that the wealthier nations with higher per capita GDP have higher life expectancy and relatively better equivalence of social support leading to lower infant mortality, poverty ratios, pollution and corruption. Based on these parameters many believe that richer countries that enjoy higher levels of per capita income countries tend to be happier. For instance, the recent World Happiness Report ranks just one country with per capita GDP under $15,000 (Costa Rica) in the top 25. None with per capita GDP over $15,000 in the bottom 70. The rationale being happiness survey look into any country that enjoins per capita GDP. Those developing countries with higher per capita income are now following suit as prescribed by the UN’s multidimensional poverty index, which includes quality of life measures such as access to drinking water; a solid roof overhead and basic assets like a bicycle. So, the growth paradigm is now an accepted nomenclature of the world that underlines liberalization, privatization and globalization (LPG). India is a classic example that seem to have reduced

poverty-stricken communities; infant mortality rates; brought down significantly the number of people living in severe multidimensional socio-economic aspects as per the UN reports. Despite its progress in the multidimensional factors, India has been sliding down in its happiness rankings and presently stand in the 139th position out of 140 countries. In addition, India’s per capita GDP is around $2000 which adds to rising concern over inequality and corruption. Do all these factors lead to less happiness? As we see the facts and figures and the data subscribing to these. The data shows that higher the income higher is the happiness. So, the higher income countries such as Swiss and Norwegians are happier than the less rich Germans and French. This is the schema that the current policy makers view. However, there are some who go beyond money and materialistic yardsticks and considerations such GNP, GDP, per capita income and host of others. There are many more aspects to life and living, and so measuring humans should not be solely on materialistic means. Nevertheless, in a world we live is now dictated by materialistic values that asks for more and more acquisition. Wants are unlimited and human nature is pushed towards meeting those wants. Materiality has taken over the ethos and now humans are driven by Mammon – materiality of the world.

The driving force of our world now is sheer mass production and mass consumption. The desire to produce unlimited goods is being propelled by an ideology of materialism vis-à-vis ‘unlimited wants’. Humans have to fight against this greed of acquisition to satiate the ‘unlimited wants’, which is insatiable. An ideal example is Bhutan, though poor, in terms of happiness it stands apart. And so, happiness is not that determined by money alone. Money plays some part just a portion in augmenting happiness and certainly there are other things that adds to it. What is happening now is in a world of materiality the higher levels of ethical codes and values seem to have been pushed to sidelines. When money becomes the centripetal, it is obvious that the aspects that constitutes ‘happiness’ such as contentment, sharing, need-based not want-based, moderation and thankfulness gradually ebbs out. Instead greed and dubious means of acquisitiveness takes the center-stage. Happiness is the end and the means to acquire it revolve around not acquisition of money, but goes beyond. As Lao Tzu rightly points out that “If you look to others for fulfillment, you will never be fulfilled. If your happiness depends on money, you will never be happy. Be content with what you have; rejoice in the way things are. When you realize there is nothing lacking, the world belongs to you.” Dr. John Mohan Razu

For women from marginalised groups, justice still remains a far-fetched dream in India

T

he recently released Tamil film, Jai Bhim, addresses custodial torture and death and traces the twists and turns of the judicial process as it unfolds in the courts. As its title indicates, the film’s protagonist, a left-leaning lawyer, insists on the rule of law and constitutional rights and spares no effort to work either to secure justice for the brutal violence inflicted on a man from an Adivasi community, and which resulted in his death. Deeply traumatised by all that had transpired, his shocked yet resolute wife stays with the judicial system, till a modicum of justice appears a possibility. The film has been inspired by a real-life incident in which justice was ultimately secured, but the incidents have been somewhat fictionalised. Ironically, it is for this reason that it has been criticised – for instance, it has been said that the filmmaker deliberately changed the name of the chief perpetrator of custodial violence. While in the original case, the officer was from a minority community, he was shown to be a man from a locally dominant caste. This, critics insist, has been done with the intention of maligning the caste in question. This is an intriguing charge, and while one is tempted to assign local, political motives for this, I wish to do something else here – address the questions such a charge raises. Understanding police brutality Does torture have to do with the fact that the “torturers” are likely to be from dominant social groups, rather than otherwise? Is it the case that the police are brutal because they assume they are socially entitled to wield power over the poor and the socially marginal individuals they routinely view as “rowdy sheeters” and “habitual offenders”? May we then assume that policemen from non-dominant social groups might be less inclined to inflict violent hurt? Even if they do, could it be said that they were acting on orders, rather than otherwise? How might we even know how dissent works in the force, given there are no mechanisms, such

as unions or associations, where one might bravely insist on one’s right to conscionable action? K Balagopal in an important essay, Whom and Why do Police Kill? has noted that in any local instance, the police, no doubt, answer to the realities of social power and authority, and are almost always prevailed upon by locally powerful political persons or parties to act in ways that they do. But, equally, they act, in keeping with the power that is vested in their uniform and persons. Set “apart”, in that they are seldom held accountable for their acts, in an everyday sense, they remain “distant” from those they police. Distrusted and feared, the system, Balagopal makes clear, is sustained by its ability to exercise calibrated violence and arbitrary terror simultaneously. Whether by labelling people as deviant, or attending to their gender, caste and community identities, the police work to a social template, even as they exult in their authority to spread menace and fear. They do this as a matter of course, habituated, as they are, to ways of being and acting in impunity. In turn, this “habitude” defines their social presence and role. In order to understand police brutality, and why it implicates all those that join the force, we need to understand how habitude works its effects. And for this, we need to attend to the workaday character of policing, and take note of the social power and menace symbolised by khaki and lathi, and note how routine police procedure and action naturalise brutality, as such. And here I wish to draw upon the work undertaken by a state agency, the Tamil Nadu Women’s Commission, which, at one time, called attention to routine acts of police cruelty as it did to acts of monumental hurt. Caste and gender In the years 2002-2005, the Tamil Nadu Women’s Commission, headed at that time by V Vasanthi Devi, identified and acted on a range of matters that afflicted women’s lives. From sexual harassment to custodial torture of women detenus, the plight of women undertrials to the problems faced by sex work-

ers, Dalit women’s struggle over land to female infanticide, the commission addressed a range of issues and through diverse means: the holding of public tribunals, locally organised sittings and hearings that brought the commission home to mofussil and rural citizens and by seeking out and working closely with a range of civil institutions including women’s groups, civil rights advocates, Dalit organisations. Given that it had as yet not been granted statutory powers, the commission sought to build ethical credibility for its acts through these means. In and through this work, the commission realised the centrality of policing in the lives of ordinary citizens, rather the ways in which the police station had emerged as a given site for the arbitration and resolution of disputes and afflictions that were wide-ranging: marital discord, property-related issues, indebtedness, caste tensions, discrimination at work sites, petty cheating, embezzlement, thievery. Women, who sought legal succour and justice in any of these instances, first approached the local police. Sometimes they were forced to do so because the other parties to the dispute at hand had gone to the police with their grievance. In almost all instances, whether they were complainants, or had been called to the station for questioning, women were made to feel humiliated for having brought “family” and “personal” matters out into the open, and subjected to belittling misogynistic verbal taunting. Further, working-class, lower caste and Dalit women were subject to casteist abuse should they dare protest police high-handedness, in however respectful a manner. Caste worked in other ways as well: a Dalit woman’s self-confidence was as likely to irk a policeman as anything that she actually said or did. One of the complaints that the Women’s Commission received had precisely to do with a “casual” crime of this sort. A working Dalit woman had been taunted by a local policeman. She took the matter to the station and protested his casteist slurs,

only to be further demeaned and physically assaulted. If the complaints had to do with caste discrimination or with sexual violence, complainants were threatened and sometimes had cases filed against them. Taking the part of the dominant castes and of male perpetrators, and actively aided by a culture of nepotism and corruption, local police, the commission found out, sought to break a female complainant’s resolve in any number of ways. Custodial violence The commission’s meticulously maintained records (made available to this author by Vasanthi Devi) make it clear that for women, especially if they are poor or Dalit, or both, and if they have fallen out with their husbands or families, everyday policing is one sustained horror. While in some instances it resulted in bone-chilling acts of torture and death, the more pervasive form of menace had to do with the routine and casual degradation of women’s persons and an instrumental and brutal approach to their justice concerns. Unsurprisingly, the commission listed “police atrocities” as an area of its core concern – and the term came to refer to acts that routinely compromised a disenfranchised woman’s struggle for justice and dignity as well as to specific acts of custodial violence against women. In one instance where a Dalit woman, Karuppi, from the arundathiyar community was found hanging from a transmission tower close to a police station, the commission sought a public enquiry which revealed a horrific sequence of events set in motion by the local police: her arrest, an attempt to foist (false) theft charges on her, physical intimidation of her family members, deploying her kin to beat her and violate her dignity and finally her death. Eventually, following the commission’s intervention, the matter went to court and the policemen concerned were convicted and sentenced, but since then, they have gone on appeal to the Supreme Court. It is 18 years since Karuppi died her tragic death and her memory

awaits an elusive justice. The commission marked the violence done unto Karuppi and her family not only the atrocity that it was but as a violent expression of the everyday indignity inflicted on the poor and the marginal citizenry. In the public hearing where the crime was addressed initially, it was pointed out that custodial brutality remained unnoticed and unaccounted for because, for the poor who were its victims, this was but an extension of their social defencelessness. On the one hand, the criminal justice system actively sought to criminalise them – in Karuppi’s case, the police attempted to foist a false charge of thievery on her, and when she refused to “accept” she was “guilty” of the crime, they tortured her. On the other hand, the system made it clear that the poor cannot claim innocence. Karuppi’s family was threatened with dire consequences, should they seek to speak the truth, of what happened to her and them. Only when the commission secured them safe and enabling conditions and active protection of their persons, could they stay with the case and prosecute for justice. That our most marginal citizens are ready to fight the legal and constitutional fight, should they be assured of the minimal conditions to wage such a struggle, is grimly ironic. In effect, they wagered their good faith on a system, geared to retain them in their social and economic marginality. The Tamil Nadu Women’s Commission was sensitive to both the specific as well as structural issues that women sought to battle. This is why it marked police brutality, as such, as an issue for women and went on to mark their everyday experience of policing as an unlikely yet powerful object lesson – as if to say that it is not only the atrocity that tells us the truth about a brutal system but equally its everyday workings as experienced by its most marginal sections. MUMBAI, NOV 25 (PTI): The Bombay High Court on Thursday commuted to life imprisonment the death penalty awarded to three convicts in the 2013 gangrape case of a 22-year-old photojournalist inside the defunct Shakti Mills compound in central Mumbai, saying that they “deserve imprisonment for life to repent the offence committed by them as death puts an end to the concept of repentance”. A division bench of Justices Sadhana Jadhav and Prithviraj Chavan refused to confirm the death penalty awarded to Vijay Jadhav, Mohammad Qasim Shaikh and Mohammad Ansari, and commuted their sentence to life imprisonment for the remainder of their lives. lough or parole as they cannot be allowed to assimilate in the society and as there is no scope for reformation. At the time of the incident in 2013, Jadhav was 19 years old, Qasim Shaikh was 21 and Ansari was 28. The bench, while pronouncing its order said that it cannot ignore the fact that the offence has shocked the collective conscience of the society and rape is a

violation of human rights, but the sentence of death is irrevocable. “A rape victim suffers not just physically but mentally as well. It is a violation of human rights. But only public outcry cannot be taken into account. Judgment should not be guided by public outcry or public opinion,” the court said. It added that courts have a duty to consider cases

dispassionately and cannot ignore the procedure laid down by the law. “Death puts an end to the concept of repentance. It cannot be said that the accused deserved only death penalty. They deserve imprisonment for life to repent the offence committed by them,” the bench said. “The convicts deserve life imprisonment for the remainder of their natural life. They cannot assimilate in society as they look upon women as an object,” the court said. Claiming that the waterway would serve as a corridor for South East Asia, Paiwang said the waterways would be beneficial for districts like Phek and Meluri whose high deposits of granite, marble and limestone could be shipped to international markets. NEW DELHI, NOV 24 (PTI): Delhi Environment Minister Gopal Rai on Thursday said the government has decided to reimpose the ban on construction and demolition activities following the Supreme Court order in this regard. He said instructions have been issued to the Labour Department to prepare a plan for providing financial assistance to workers affected by the ban. “We have decided to ban construction and demolition activities again from Thursday. The reimposition of the ban will cause inconvenience to workers. So, we will provide them financial assistance. We have directed the Labour Department to prepare a plan in this regard,” Rai told PTI. The Supreme Court had on Wednesday reim-

posed the ban on construction activities in Delhi-NCR until further orders. Non-polluting construction activities such as plumbing work, interior decoration, electrical work and carpentry are allowed. The apex court had also asked authorities to use funds collected as labour cess for the welfare of construction workers to provide them subsistence for the duration of the ban. The ban on construction and demolition activities was lifted on Monday in view of an improvement in the air quality and inconvenience caused to workers. The dentists registered the protest during the interaction that Nadda held with medical professionals from different streams late Wednesday evening, which was organised by the BJP’s state medical cell. The group of dentists, which protested, was affiliated to the Indian Dental Association (IDA). Since all the positive cases were not given ART services, the report said possibility of transmission of HIV&AIDS to the new-borns cannot be ruled out.

MUMBAI, NOV 25 (PTI): The rupee slumped 12 paise to end at 74.52 (provisional) against the US currency on Thursday amid month-end dollar demand and foreign fund outflows from equity and debt markets. At the interbank foreign exchange market, the local currency opened at 74.55 and witnessed a high of 74.47 and a low of 74.58 against the US dollar. The local unit finally settled at 74.52, down 12 paise over its previous close. On Wednesday, the rupee had closed at 74.40. “Rupee depreciated after two days of consolidation amid month-end dollar demand and foreign fund outflows from equities and debt markets,” said Dilip Parmar, Research Analyst, HDFC Securities. Lacklustre price actions have been seen in the global forex market following the US holiday, while the rupee traded on the backfoot.

common medication used to treat reflux, heart burn and ulcers could lessen the effectiveness of lung cancer immunotherapy drugs, according to a new research. Researchers at Flinders University in Australia investigated the impact of proton pump inhibitors (PPIs) on patients undergoing treatment for non-small cell lung cancer, the most common type of lung cancer, accounting for 85 per cent of cases. Patients received either chemotherapy or were treated with a combination of chemotherapy and atezolizumab, an immune checkpoint inhibitor drug, designed to boost the immune system into killing cancer cells. The results published in Nature’s British Journal of Cancer, showed that PPI use was associated with worse survival in patients with advanced cancer treated with atezolizumab plus chemotherapy, but not in those that received chemotherapy alone, with the study showing PPI use was linked to a significant decrease in the benefit of the immune therapy treatment. “Stomach issues and reflux are common in can-

cer patients so the use of antacids and PPIs is common. Nearly 30 per cent of cancer patients use them, and usually for extended periods of time,” said lead author Ash Hopkins from the Flinders Health and Medical Research Institute. “Of concern is that the medication is often overused or used inappropriately, as it is seen to cause little harm, however our research could indicate a need to change this approach,” Hopkins added. PPIs treat a number of stomach issues by reducing acid production in the wall of the stomach. Recent studies have shown the medication can cause significant gut microbiota changes, which could lead to its impact on cancer immunotherapy. “Immune checkpoint inhibitor (ICI) drugs help the immune system by switching on T-cells, allow-

ing them to kill or control cancerous tumours but the gut microbiota also plays an important role in regulating our body and its immune function,” said Hopkins. “When this gut microbiota is impacted it can stop the ability of ICIs to

activate the immune system, meaning the drugs simply won’t work as well to fight off the cancer.” While further studies are needed, the researchers noted it could be time for oncologists to reconsider indiscriminate use of PPIs for their patients. (IANS)

Tennis Australia announces ‘Summer of Tennis’, AO from Jan 17

SYDNEY, NOV 25 (IANS): Tennis Australia announced its “Summer of Tennis” on Thursday, which would include a host of events across several states in the lead-up to the Australian Open 2022. Ahead of the tournament, beginning officially on January 17, a total of 17 events will be held in the states of New South Wales (NSW), South Australia, and Victoria. Among the warm-up tournaments announced was the ATP Cup, which was confirmed to be hosted by Sydney from January 1-9. “There is no better place to kick off the season than in Australia and we look forward to seeing the fans out in force in January,” said ATP Chairman Andrea Gaudenzi. Other headline events include the Victorian Wheelchair open from January 8-12, and the Adelaide International women’s events beginning January 2. Tennis Australia CEO Craig Tiley said the line-up was designed to create numerous competi-

tion opportunities for some of the best players in the world. “It’s incredibly important to have the world’s best players competing across the country, inspiring the next generation of players and growing interest and excitement in our sport,” he said. The series of events is set to be one of Australia’s largest international events since it closed its borders due to the pandemic and would be a boon for crippled local economies. Tiley said the pandemic has created a “massive challenge” for the event: “It’s why we waited as long as possible to secure optimal conditions for the players and fans in as many locations as we could.” The qualifying round for the Australian Open would run from January 10-14 and the main event would run from Jan 17-30. Tennis Australia has previously announced that unvaccinated players would not be permitted to compete in the 2022 Australian Open.

Lakshya Sen set to become youngest Indian to qualify for World Tour Finals NEW DELHI, NOV 25 (PTI): India’s Lakshya Sen is set to become the youngest shuttler from the country to qualify for the season-ending HSBC BWF World Tour Finals which will be held in Bali, Indonesia from December 1. The 20-year-old from Almora has enjoyed an impressive run on the BWF world tour and is currently ranked fifth in the World Tour rankings. He will join Kidambi Srikanth (ranked 3rd) in the men’s singles competition, two-time Olympic medallist P V Sindhu (4th) in women’s singles and women’s doubles pair of Ashwini Ponnappa and N Sikki Reddy (6th) at the event, which was shifted from Guangzhou to Bali due to the COVID-19 pandemic. Srikanth, Sameer Verma, Sindhu and London bronze- medallist Saina Nehwal have competed in the year-ending tournament in the past. While Sindhu is the

only Indian to win the BWF World Tour Finals in 2018, Saina had reached the summit clash of the BWF Superseries Finals in 2011.
