ANCSU seeks ‘window period’ D I M A P U R , M AY 2 6 (NPN): All Nagaland College Students’ Union (ANCSU) has sought the intervention of the state government on the issue of physical de-linking of higher secondary level (+2) from 15 private colleges. In a representation to the chief minister, ANCSU president Toito D Chishi and general secretary Tenyesinlo Bukh stated that the school education department and Nagaland Board of School Education issued directives for the physical de-linking of higher secondary level (+2) from the colleges during the academic session 2022 “without prior information” to the concerned colleges, “causing livelihood issues to teachers and discomfort to students wherever higher secondary schools were not available”. In this regard, ANCSU appealed to chief minister to allow a “window period” and per-mit the affected colleges to continue admitting Class XI admission for this academic session 2022. The union stated that colleges have faithfully served the state for many decades when there were less Higher Secondary Schools. ANCSU said that to “cutoff this linkage abruptly” would affect the livelihood of almost 100 teachers and may not go down well in the history of education in the state. The union expressed hope that the responsible authority would intervene and deliver justice in the larger interest of the student community.

Flood situation in Assam grim; death toll 30 GUWAHATI, MAY 26 (PTI): The flood situation in Assam remained critical on Thursday with two more persons, including a child, losing their lives and over 5.61 lakh people still suffering in the deluge across seven districts, as per an official bulletin. According to the daily report of the Assam State Disaster Management Authority (ASDMA), one person each died in Kampur and Raha of Nagaon district. With this, the total number of death toll in this year’s flood and landslides has reached 30. ASDMA said more than 5,61,100 persons have been hit by the flood in Cachar, Dima Hasao, Hailakandi, Hojai, Karbi Anglong West, Morigaon and Nagaon districts. Nagaon is the worst hit with over 3.68 lakh people suffering, followed by Cachar with nearly 1.5 lakh persons and Morigaon with more than 41,000 people affected.

NEW DELHI, MAY 26 (PTI): At least 44 percent school teachers in India do not have adequate work space while 65 percent of them are overloaded with work, according to the National Achievement Survey (NAS) 2021 conducted by Union Education Ministry. The survey also found that just 58 percent teachers participated in discussions around the new National Education Policy (NEP). DIMAPUR: Pfütsero police seized 150 kgs of Ganja from a white gypsy on May 24, between Razeba town and Tsupfume. According to SP Phek, the driver on noticing the police pursuing him, abandoned the vehicle and escaped into the jungle. The police then conducted a thorough search inside the jungle, however, the accused escaped. The seized vehicle and ganja were brought to Pfütsero PS and a case was registered against the “unknown trafficker” under NDPS Act, SP informed. SP further informed that efforts were being made to arrest the absconder.

DIMAPUR: CAN Youth in collaboration with District Tobacco Control Cell (DTCC) under National Tobacco Control Programme (NTCP) organised anti-tobacco awareness programme on May 25 at River Belt School, Nagarjan. In a press release, CAN Youth informed that resource person, psychologist, NTCP, Dimapur, Imkumla talked about the types of tobacco and the harmful chemicals in to-

She said that cigarette contains 7000 chemicals and smokeless tobacco (gutka) contains 3095 chemicals, many of which are known carcinogens and how smokeless tobacco was dangerous but its ill effects often ignored. Imkumla said today every 6 seconds someone dies from tobacco use and that about 7% who die of tobacco in years are of most productive age group from 30 – 39 years and 8
million people die globally in a year. She also said that pregnant women who smoke will have three-fold increased risk of stillbirth and low birth and weight baby. Imkumla shared on the Global Adult Tobacco Survey North East India of GATS 2010 which shows that Nagaland is the second highest tobacco consuming state with 56.8 % and has reduced to 43.3% in 2016 GATS report.

Lorence Ngushe presented his talks from social perspective, Rudivinuo Kense talked from the political point of view, Vekhotalu spoke from economics perspective, Rokovili talked in relation to the global pandemic that happened two years ago and Benchilo Lotha spoke from the perspective of gender for the unemployment among the Naga youth. Through the discussions, SJC said the students realised that “government job” was not the only job and the educated Naga youth would be venturing out into other avenues for employment. In a press release, coordinator of the village visit, Dr. Velankanni Alex informed that the visit was organised as a part of “Nai Talim” and MITE’s outreach activities to enable
student-teachers to develop awareness on engaging in community services and “No to Plastic.” At the programme, 100 student-teachers of the second semester were divided into four groups and participated in a cleanliness drive. They visited Government Middle School Phesama and interacted with students and played a skit titled “No to Plastic.” Dr. Velankanni Alex also spoke on the theme.
After the school visit, the student-teachers met Phesama Village Council president and held a meeting with regard to the spirit of giving back to the community and caring for society. They also discussed the importance of village cleanliness and avoiding the usage of plastic for a better environment. The program ended with distribution of prizes to student-teachers and vote of thanks.
JJM provides 1,56,984 tap connection DIMAPUR: Jal Jeevan Mission (JJM), under the ministry of Jal Shakti, department of Drinking Water & Sanitation has provided 1,56,984 (41.61%) Functional Household Tap Connection (FHTC) to rural households in Nagaland, as per April 1, 2022 status of the JJM. According to a DIPR report, the Mission aims to provide drinking water supply to the rural households through FHTC by 2024. The mission which was announced by the prime minister of India on the 73rd Independence Day in 2019 is being implemented in Nagaland by the Public Health Engineering Department (PHED). Activities under JJM includes— provision of drinking water at 55 litres per capita per day (lPcd), focusing on IEC activities and capacity building for rural communities to manage completed schemes by themselves and Water Quality Monitoring & Surveillance (WQMS) which focuses on water quality aspects. The status of JJM as per April 1, 2022 is as follows: Total number of villages & habitations at 1499; total number of rural households at 3,77,286; balance FHTC for coverage during FY 2022-23 (58.39%) (1,12,800 numbers already approved during 2021-22 but spilled to 2021-22); new schemes under planning for approval during 2022-23— (2,20,302-1, 12,800) =1,07,502; total FHTC target for FY 2022-23 (1,12,800+1,07,502) =2,20,302.

DIMAPUR: A seminar on higher education studies was conducted on May 22 at Jalukie Town for school going students of Jalukie Town and nearby villages. A press release by Assam Rifles stated that the seminar was conducted Jalukie Battalion of Assam Rifles under the aegis of Headquarters Inspector General of Assam Rifles (IGAR-North) in collaboration with North East Higher Education Development (NED) Foundation, Dimapur.
Assam Rifles said the seminar was aimed to promote students to pursue their higher education by offering them scholarships and making them access to simplified and accurate information on education institutions and courses best suited to their career dreams. During the seminar, the students were informed on how to make right decision for higher studies thereby making easier for students to enrol in various recognized colleges and universities in the country and abroad.

468 exotic animals seized in Mizoram A I Z AW L , M AY 2 6 (IANS): A total of 468 endangered exotic animals, smuggled from neighbouring Myanmar, were seized by police and wildlife enforcement agencies in Mizoram, and five people arrested in this connection, officials said on Thursday. Po l i c e s a i d t h a t acting on a tip off, exotic animal species, including 442 lizards, were seized at Chalbawia Junction, Khankawn Police Checkgate in Champhai district on Wednesday and handed over the animals along with five traffickers to Custom Preventive Force. The seized animals also comprise four tortoises, 11 snakes, four sloths, two beavers, and a wild cat. The five traffickers were arrested while they were trying to cross the river Tiau, which divides India and Myanmar, with several cages containing the animals. Indonesia and Myanmar where there are exotic animal breeding farms. There were instances that the exotic animals seized in West Bengal and Andhra Pradesh smuggled from Myanmar and ferried through Mizoram to these states. A police official also said most of the persons arrested with the smuggled animals were only carriers who were doing the illegal job for money.

Manipur cops seize 160kg of sandalwood, 1 held Correspondent I M P H A L , M AY 2 6 : Manipur police arrested a sandalwood smuggler and recovered 160kg of sandalwood from him on Thursday. A police commando team attached to Bishnupur district police confiscated the sandalwood after they searched an A-star brand car (HR26AV-7375). The arrested alleged sandalwood smuggler was identified as Md Husain Ahmed (31) of Kwakta Bazar of Bishnupur district. Acting on specific information, the police commando team stopped the car near an oil pump at Ngangkha Lawai along Tidim road around 8.30 am on Thursday, and upon checking, sandalwood packed in four boxes were intercepted, the police said. The arrested person has been handed over to officials of the state forest department in Bishnupur district along with the recovered sandalwood for necessary legal action, the police added.

GUWAHATI, MAY 26 ( AGENCIES): United Liberation Front of AssamIndependent’s (ULFA-I) former finance secretary Jeevan Moran told News18 that the annual budget of the banned rebel group is Rs 1 crore or more, which is used for maintaining the camps. Moran, who surrendered to the Assam Police last year after he quit the group due to health condition, said, “Annually, it may be Rs 1 crore or more. All depends on the situation of the camps and requirement of foods, clothes and other materials.” M o r a n ex p l a i n e d : “Our commander-in-chief used to send the money and I would distribute it to the camps as per his directions. The fund basically comes monthly or bi-monthly. Specially commanderin-chief Paresh Baruah, senior leader Nayan Medhi, Arunudoy Dohutia and I collected the the finance from different sources as per suggestion of Baruah.” The senior-most leader said Rs 2 crore was the last deposit made in the Central Head Quarters (CHQs) when he left the camp. Moran was the chief who maintained all the camps in Myanmar.

The resolution read, “….resolved to vigorously extend logistic support to the leadership of chief minister Shri N Biren Singh in his endeavour to eradicate drugs from the state and to completely ban any form of drugs within the jurisdiction of Mao.” The meeting had also resolved to penalize defaulters including for poppy plantation, opium smuggling, trafficking, etc. and that village to village mobilization shall be initiated and regular monitoring of the same to be conducted.

Karti Chidambaram NEW DELHI, MAY 26 (PTI): A Delhi court on Thursday granted interim protection from arrest till May 30 to Congress MP Karti Chidambaram in a case registered by the Enforcement Directorate (ED) in the Chinese Visas case. Special Judge M K Nagpal also issued notice to the ED on the anticipatory bail application moved by Karti Chidambaram. The ED recently reg-
istered the money-laundering case against Karti Chidamabaram and others in the alleged scam about the issuance of visas to 263 Chinese nationals in 2011 when his father P Chidambaram was the home minister. The federal agency has filed its case under the provisions of the Prevention of Money Laundering Act (PMLA) taking cognisance of a recent first information report by the CBI in the same case.

Maharashtra NCP chief spokesperson Mahesh Tapase said the country has “lost a lot” under the BJP-led central government which completed eight years in office on May 26. He listed rising inflation, high unemployment, “suppression of democracy”, failure to safeguard national security, hate politics, historic fall in value of the rupee, “economic collapse” and erosion of social fabric as the eight “failures” of the government. “In these eight years of Modi misrule the country has lost a lot. The RSS ideology has ruined communal harmony of the country. Religion & ethnicity are ruling over science & equality,” Tapase alleged.

CHANDIGARH, MAY 26 (PTI): Jailed Congress leader Navjot Singh Sidhu will serve as a clerk in the Patiala central prison and will get a doctor-recommended daily diet that includes coconut water, lactose-free milk, a glass of juice and a few almonds, an official said. A board of doctors has recommended a special diet for Sidhu after he had sought the same in the jail. His medical examination was conducted on May 23 at Rajindra hospital in Patiala, Punjab. The 58-year-old cricketer-turned-politician’s special diet includes one cup of rosemary tea or one glass of coconut water in early morning, and one cup of lactose-free milk, one tablespoon of flax/sunflower/ melon/chia seeds, five-six almonds, one walnut and two pecan nuts in breakfast. In the mid-morning meal, the doctors have recommended a glass of juice (beetroot, cucumber, tulsi leaves, Amla, carrot etc), or any of fruits like watermelon, melon, kiwi, guava etc, or sprouted black chana, green gram with cucumber/ tomato/half lemon/avocado. For lunch, the doctors have suggested one bowl of cucumber, seasonal green vegetables with one chapati of sorghum, singhara or ragi flours. In the evening, he has been recommended a cup of

For dinner, the doctors have recommended mix vegetables and ‘dal’ soup or black chana soup and one bowl of sauteed green vegetables. At bedtime, Sidhu has been recommended one cup of chamomile tea and one tablespoon of psyllium husk with half glass of warm water, according to the diet plan for inmates. The Congress leader suffers from medical conditions like embolism and has a liver ailment. In 2015, he underwent treatment for acute deep vein thrombosis (DVT) at a hospital in Delhi. DVT is caused by a blood clot in a deep vein which hinders the normal blood flow. A jail official said Sidhu has been appointed as ‘munshi’ (assistant) to do clerical work in the jail. He will perform the job from his barrack only
because of security reasons, the official added. According to the jail manual, prisoners are categorised as unskilled, semiskilled and skilled. Unskilled and semi-skilled prisoners get Rs 40 and Rs 50 per day, respectively. Skilled prisoners get Rs 60 per day. Sidhu, the former Punjab Congress chief, was sent to Patiala central jail on May 20 after he surrendered before a local court. He has been sentenced to one-year rigorous imprisonment by the Supreme Court in a 1988 road rage death case. The apex court had sentenced him in the 34-year-old case, saying any undue sympathy in imposing an inadequate sentence would do more harm to the justice system and undermine the public confidence in the efficacy of law. A 65-year-old man, named Gurnam Singh, had died in the incident.

‘Jack’, ‘John’ instrumental in sending Yasin Malik to jail for life NEW DELHI, MAY 26 (PTI): ‘Jack’, ‘John’ and ‘Alpha’ were among the NIA’s protected witnesses who helped nail banned JKLF chief Yasin Malik. These names were given to important protected witnesses, with hidden identities for their safety, in the terror funding case in which the National Investigation Agency (NIA) had seized around 600 electronic devices during its raids at 70 places. Malik, who had pleaded guilty for the terror funding crimes, was sentenced to life by a Delhi court on Wednesday. There were nearly four dozen protected witnesses but code names were given only to selected few, who could be of help in making a watertight case, officials privy to the developments of the case said. The case was probed by a NIA team led by Inspector General Anil Shukla, a 1996-batch IPS officer from AGMUT cadre, with the then Director Sharad Kumar heading the organisation. “The verdict is definitely a reward to

Citing the Chauri Chaura incident of 1922 when citizens burnt a police station in Gorakhpur killing 22 occupants, the court said Mahatma Gandhi had called off the non-cooperation movement after the incident but the accused, despite large scale violence engulfing the valley, pressed on with these protests. “Thus, prima facie they were not following the Gandhian path but their plan was straight from the play book of the likes of Hitler and the march of the brown shirts. The object was to overawe the government by the sheer scale of violence and was nothing less than a plan for insurrection. Thus I find that prima facie there is sufficient evidence that this was also a conspiracy as is punishable u/s 121A IPC,” the court said.

American gun syndrome
A
shooting at an elementary school in Uvalde, Texas, that has killed 19 children and two adults on May 25, marked the 27th school shooting this year. This comes just ten days after a shooting at a Tops supermarket in Buffalo, N.Y., that took the lives of 10 people. The U.S. has surpassed 200 mass shootings this year. The Gun Violence Archive(GVA), an independent data collection organization, has counted 212 mass shootings that have occurred so far this year, as of Tuesday. The latest shocking outrage has reignited the national US debate about access to firearms. From 1968 to 2017 there e were 1.5 million gun deaths in the US that’s higher than the number of soldiers killed in every US conflict since the American War for Independence in 1775.Despite frequent mass shootings, attempts in the US to enact gun control legislation have long been frustrated by a powerful gun lobby. US has 120.5 firearms per 100 residents, report finds. It is the only country with more civilian-owned firearms than people. US President Joe Biden has called on legislators to ‘stand up’ to the gun lobby following a massacre at a Texas primary school. Speaking after the shooting, Biden said : “As a nation, we have to ask, ‘When in God’s name are we going to stand up to the gun lobby?” Past Democratic Party presidents had tried to regulate gun sales of all types but have failed due to the powerful gun lobby. Several investigations have shown that major anti-gun control lobbying groups – notably the most prominent, the National Rifle Association (NRA) – have close ties with the multibillion-dollar firearms industry in the US. The National Rifle Association(NRA) acts as a front for the gun lobby and works to influence both state and federal policy on guns, usually through supporting candidates who have pledged opposition to gun control measures. The NRA and similar groups often frame themselves as civil rights defenders, pointing to the Second Amendment of the US Constitution that establishes “the right of the people to keep and bear arms”. The NRA lobbies and staunchly defends, the disputed interpretation of the Second Amendment to the US Constitution, which it argues as giving US citizens the rights to bear arms without any government oversight. US gun owners possess 393.3 million weapons, according to a 2018 report by the Small Arms Survey, a Geneva-based organization. This is higher than the country’s population now of about 330 million. The gap is likely growing after Americans went on a gun buying spree beginning in 2020. India, which has almost 1.4 billion people, had the second most civilian-owned firearms with 71.1 million. The NRA is one of the most powerful interest groups in American politics due to the millions it spends on campaign contributions and its cult-like role for its fervent members and voter.Republicans have close ties to the gun lobby. Former President Donald Trump and other leading Republicans, including Texas Senator Ted Cruz. Democrats have repeatedly tried and failed to enact new guncontrol measures - including universal background checks and an assault-weapons ban - in the decade since Sandy Hook. Perhaps the USA could see some concrete action on regulating gun sales but again, a mass movement is the only option to confront the gun lobby.

Our thinking about prayer, whether right or wrong, is based on our own mental conception of it. The correct concept is to think of prayer as the breath in our lungs and the blood from our hearts. Our blood flows and our breathing continues “without ceasing”; we are not even conscious of it, but it never stops. And we are not always conscious of Jesus keeping us in perfect oneness with God, but if we are obeying Him, He always is. Prayer is not an exercise, it is the life of the saint. Beware of anything that stops the offering up of prayer. “Pray without ceasing…”— maintain the childlike habit of offering up prayer in your heart to God all the time. Jesus never mentioned unanswered prayer. He had the unlimited certainty of knowing that prayer is always answered. Do we have through the Spirit of God that inexpressible certainty that Jesus had about prayer, or do we think of the times when it seemed that God did not answer our prayer? Jesus said, “…everyone who asks receives…” (Matthew 7:8). Yet we say, “But…, but….” God answers prayer in the best way— not just sometimes, but every time. However, the evidence of the answer in the area we want it may not always immediately follow. Do we expect God to answer prayer? The danger we have is that we want to water down what Jesus said to make it mean something that aligns with our common sense. But if it were only common sense, what He said would not even be worthwhile. The things Jesus taught about prayer are supernatural truths He reveals to us.

Discrimination against Garo Tribe of Nagaland

he Nagaland Garo Tribal council (NGTC), an apex tribal body representing the Garo Tribe of Nagaland express our displeasure and resentment for not inviting the indigenous Garo recognised tribe of Nagaland at the , “Consultative Meeting on Documentation of Naga Traditional attires and motifs” held on date 23rd may 2022 at capital Convention Centre, Kohima, convened by the Commissioner & Secretary, Industries and Commerce, Government of Nagaland, where all the tribal HoHos (recognised tribes) and stake holders of Nagaland were invited except the Garo. It is very disheartening and painful that, the Garo tribe being one of the recognised indigenous tribe of Nagaland and also one of the stakeholder in the district of Dimapur, was not invited in such an important state level meeting. A reminder letter was mailed to the concerned Commissioner & Secretary to rectify and include our name in the list of invitees on date 19th may 2022, a copy of which was also mailed to the Chief Minister’s Office (CMO) and

to our constituency MLA for necessary action, but it was very sad and shock to learn that our prayer was not heard and kept deaf ear, we didn’t receive any call and letter till date. Despite of the fact, our leaders choose to attend the meeting uninvited, thinking of some positive outcome, but we were surprised only to face more embarrassment. All the sitting arrangement were done according to the tribe wise, where our tribe’s were not allotted any sit. Such kind of treatment really hurts our sentiment, which we didn’t expect. This is an act of total injustice and discrimination. We are utterly dismayed and felt rejected by this ignorance and negligence, where a recognised tribe like the Garo was left out and sidelined from this crucial meeting. It has deeply hurt and made us felt alienated and hopeless in our own land. Inspite of being a recognised Indigenous Tribe, we are often neglected on many occasions. It is quite surprising to see that our names are not found in many government websites and portals, which is unacceptable and a kind of step motherly treatment given to us. The concern departments should
do the needful in giving us our due rights, by giving us equal opportunity to participate, prosper and progress, along with all the tribes in our benevolent state of Nagaland. The Garo Tribe is no doubt a minority tribe, and one of the most backward tribe in the state, we don’t have any representative of our own to voice our grievances but there is no minority and majority in the eyes God, being a Christian state we believe that the Lord almighty will give sense of wisdom to our leaders to love one another and live equally in a true Christian spirit. It is worth mentioning that, the Garos of Nagaland has been living in Dimapur since times immemorial. Our forefather were part and parcel of the ancient kingdom of Dimapur. The Garos presently settled in Nagaland are a part of the second group of Garos who had migrated from Tibet via Myanmar (erstwhile Burma). It is believed that the Garos living in Myanmar constantly came under attack by hordes of barbaric enemies. Due to these constant attacks, they were compelled to shift their settlement to safer places. So, after a long
journey across mountains and rivers, they came to Manipur. The group of Garos who came and settled in the present day Nagaland state like the other Naga Tribes was led by Nokma (Chieftain) Muga Dingsepa and Siram Ajimpa to whom the Garos of Nagaland owe their present generation living as a very integral part of the society, state and culture of Nagaland. A majority of the Garos who had migrated from Burma settled in and around the foothills of Samaguting (present day Chumoukidema) which became our Head Quarter for several years. In those days, there was a village by the name Panbari (a Garo village) along with Samaguting (present day Chumoukedima) where the early Garos initially settled. This Panbari village is no more in existence. Some Garos shifted their settlements from the foothills of Chumoukidema (Samaguting) to the present day Darogapathar in the year 1811. The present day Dimapur Airport was earlier a paddy field of our forefathers under a Garo village namely ‘Ikranigaon’ but during the second world war it was given to the allied forces for build-
ing Airport. The Garo villages which are still in existence in Dimapur District under Nagaland state are Darogapathar (1811), Eralibill (1910), Dubagaon (1910), Ekranipathar (1942), Samaguri (1951). All the villages were established before the declaration of Nagaland statehood. Among them Darogapathar village at 2 1\2 miles is the oldest one which was established in the year 1811 as per the government notification, even though the origin may go beyond these period. Apart from that we are also permanently settled in Kohima, Dimapur Town area, Dhansaripar, Chumoukedima, Padumpukhuri and other parts of the state. Garo leaders, though uneducated, co-operated with the Government of Nagaland as well as with other civil societies whenever the need arose. Our elders also helped the Naga National Movement with every assistance whenever necessitated. This was done without any reservation or favour. After Nagaland got its statehood in 1963 the Garo tribe was given the status of recognised indigenous tribe in the state
of Nagaland as per Constitution order of 1970. The Government of Nagaland continue to give equal rights and the Garos in Nagaland thus continually enjoyed the same constitutional rights as any other recognised tribe. However, as the time passed our tribe slowly began to lose prominence and started to lose status and due equal rights given by the earlier governments and all the rights and status remain only in papers and words. Later on the Government Departments and other allied agencies of the state government began to question our INDIGENOUS and SCHEDULED TRIBE status and some government officials even went to extent of questioning our existence in the state of Nagaland and pretended to be ignorant about our settlement and existence. Nevertheless, though a small tribe we will continue to stand for our rights and future generation and by the grace of God may good sense always prevail in our beautiful state and give us due recognition as per the law and Constitution. In that spirit, the Government of India has scrapped over 1500 outdated laws since 2014-15…The Government of India, being fully cognizant of various views being expressed on the subject of sedition and also having considered the concern of civil liberties and human rights, while committed to maintain and protect the sovereignty and integrity of this great nation, has decided to re-examine, and re-consider the provision of Section 124A of the Indian Penal Code which can only be done before the competent forum.” Others like to point to the counterfactual: Every single government in India—from the Jawaharlal Nehru to the Narendra Modi government—while paying lip service to the Fundamental Rights enshrined in the Constitution, have ensured that Preventive Detention (PD) and sedition-related legislation remain a part of the governance ecosystem. It is true that in Constituent Assembly debates, both PD and sedition were held to be the antithesis of the
freedom movement. K.M. Munshi argued that “As a matter of fact, the essence of democracy is criticism of government.” It was due to his efforts and the strong persistence of Sardar Bhupinder Singh Mann that the word ‘sedition’ was omitted from the Constitution. Perhaps the reason for such draconian provisions lies in the fact that except for specialist agencies like the Central Bureau of Investigation (CBI) and the National Investigation Agency (NIA), the home ministry didn’t invest adequate time and resources in strengthening the investigative competence of the police, the forensic capabilities of the labs and the legal acumen of our prosecutors. As such, unless we take a holistic view of the entire gamut of the criminal justice administration system, the temporary provision of PD, introduced by Sardar Vallabhbhai Patel on 25 February 1950 (within a month of the adoption of the Constitution), as well as Article 124A (or its variant) will most likely continue to exist on the statute book. Sardar Patel on Preventive Detention Let us look at the sentiment and the rationale behind the first PD legislation in the country. With regard to the sentiment, Sardar Patel told Parliament that he had spent two sleepless nights over the Bill but went on to explain the rationale. He said that the fallouts of Partition and the armed insurgency in Hyderabad (1946-1951) necessitated the need
for the very same provisions that had been opposed tooth and nail when the Rowlatt Act was introduced by the British in 1919. It had been dubbed as an Act with “Na vakil, na dalil, na appeal (No counsel, no argument, and no appeal)”. However, Patel had hoped that the Preventive Detention Act 1950 would be a purely temporary provision. He would be proved wrong soon. The Act gave way to the infamous Maintenance of Internal Security Act 1971 and later, the National Security Act 1980 under Prime Minister Indira Gandhi. What is less talked about is that when Shanti Bhushan was the Law Minister in 1977, the Code of Criminal Procedure was amended to give Preventive Detention powers to District Magistrates and police commissioners. Thus, from colonial times to Independent India till today, every government on Raisina Hill has maintained such provisions. Jawaharlal Nehru on Sedition Fourteen months later, on 12 May 1951 after Sardar Patel spoke on the Preventive Detention Bill, Nehru introduced the first amendment to the Constitution. We again saw a clash between sentiment and rationale. Nehru stated: “Now, so far as I am concerned, that particular Section (124A IPC) is highly objectionable and obnoxious, and it should have no place both for practical and historical reasons, if you like, in any body of laws that we might pass. The sooner we get
rid of it the better.” However, his government not only reimposed IPC Section 124A but also strengthened it by adding two expressions — ‘friendly relations with foreign State’ and ‘public order’ — as grounds for imposing ‘reasonable restrictions’ on free speech. The former was directed at Syama Prasad Mookerjee’s campaign to annul Partition, (friendly relations with Pakistan), and the latter against the Communists in Hyderabad during the Telangana Rebellion. Not only that, the first amendment created a Ninth Schedule, which Upendra Baxi, legal scholar, described as a ‘constitutional vault’ because it contained a list of laws that could not be challenged in the courts or subjected to scrutiny by the judiciary. Legal challenges to IPC Section 124A It bears recall that as early as 1950, the Supreme Court in the Romesh Thappar vs State of Madras case held that “Criticism of the government exciting disaffection or bad feelings towards it is not to be regarded as a justifying ground for restricting the freedom of expression and of the press unless it is such as to undermine the security of or tend to overthrow the State.” Then-CJI M. Patanjali Shastri cited the Constituent Assembly’s deliberate omission of the word ‘sedition’ from the Constitution for the liberal reading of the law. Subsequently, the Punjab and Haryana High Court in 1951 and the Allahabad High Court
in 1959 declared Section 124A to be unconstitutional. However, in 1962, in the Kedar Nath ruling on sedition, a five-judge Constitution bench overruled the High Courts and upheld the Constitutional validity of the law. But the Supreme Court clarified that unless accompanied by incitement or a call for violence, criticism of the government cannot be labelled ‘sedition’. Successive reports of the Law Commission of India, and even the Supreme Court, have underlined the rampant misuse of the sedition law. The Kedar Nath guidelines and a textual deviation in law put the onus on the police that registers a case to distinguish between a legitimate speech from seditious speech. As things stand today, the Supreme Court has directed the Centre and states to keep in abeyance all pending trials, appeals, and proceedings with respect to charges framed under Section 124A of the IPC till the Central government fulfils its promise to reconsider and re-examine the provisions already declared unconstitutional by the courts in the UK, Australia, France, Singapore, South Korea, Indonesia, and New Zealand, among others. How far can India rely on a US-led Quad to checkmate China?
U
nited States President Joe Biden visited ally South Korea before he joined Prime Minister Narendra Modi, his Australian and Japanese counterparts, Anthony Albanese and Fumio Kishida, for the second in-person summit of the Quadrilateral Security Dialogue (Quad) in Tokyo, Japan, this week. As the leaders renewed their “steadfast commitment to a free and open IndoPacific that is inclusive and resilient,” gaze must be on US’ willingness to lead from the front in counter-balancing China. A lot has changed for Washington, Beijing, and the rest of the world since Richard Nixon decided to ignore Napoleon’s advice to “let China sleep”, 50 years ago believing that the dragon can astonish the world when it wakes up. In recent times, there have been plenty of statements of intent from the US presidents coinciding with China’s unabashed unfurling of its aggressive behaviour on issues of sovereignty, and vaulting economic ambition to take on the US. Washington obviously got it wrong about economic prosperity and trade with the West tempering the authoritarian instincts of the Chinese political system. The Chinese didn’t care much either for
democracy or human rights as its State-sponsored capitalism with socialistic fangs drove both the debt-trap model of financing, and international trade. Former US President George Bush said China is a strategic competitor as he went about planning ways to rein in that country. Then, he lost interest and got mired in US’ War on Terror. Barack Obama, who succeeded Bush, talked even more flourishingly about the need to counter China. He announced a Pivot to Asia. Then he too got busy elsewhere; mostly in Afghanistan. Then came Donald Trump, who talked even more menacingly about China. Biden, though shedding the US strategic ambiguity on Taiwan, used his address at the United Nations to say that Washington is not seeking a new Cold War, or a world divided into rigid blocs. But Quad is the best bet for the US to attempt taming China. A full-blown European conflict in Ukraine has the world divided between West and the rest. Though the Quad countries don’t have any doubt about the need to address the aggressive behaviour of China, who will bell the cat, and when, remains unclear. For the US, the Quad summit was another forum to
hit out at Russia on Ukraine. Painting Russia and China with the same brush serves the strategic and political objective of the US — however, it’s a position that India is naturally uncomfortable with. For India and the rest of Asia, China is an everyday reality in more ways than one. China’s rise is no longer benign. It is neither hiding its strengths nor looks like biding any time in deepening its strategic inroads into any country of its convenience. Despite all the political disputes, China remains the biggest trading partner of many countries in the region. China uses its huge pile of cash to fund projects in countries who have no better, or any, alternatives. Unless the US walks the talk on bringing about an alternative to the Chinese-centric supply-chain-led, affordable technology-driven, easily accessible-finance model, there is little that one can do to effectively checkmate Beijing. For those developed countries need to be more generous with funds, capacity building, and technology transfers. Though the US and its allies could very well account for half of the world’s gross domestic product, the world is more multipolar than it has ever been since the end of the World War II. A multipolar
world order calls for a multipronged strategy to deal with both threats and opportunities. Former US Secretary of State Henry Kissinger, who set the path for US-China establishing relationship, once wrote: “Americans hold that
every problem has a solution; Chinese think that each solution is an admission ticket to a new set of problems.” Just that the US must find solutions to these new sets of problems, for which Washington needs to do a lot more.

Kudos to banning check gate, What about Corruption?
Sir,
It’s a laudable initiative (under pressure) to ban/remove all check gates across the State. But the primary and one of root cause that is still plaguing the State is extreme corruption in the State. From the highest to the lowest of the low, corruption is rampant and has been like our DNA. It is shameful but “truth hurts”. This is particularly to those who are blatantly and righteously involved in such practices and would be reading this-- that when one tries to point finger at others, one should know that the rest of them are pointing back at you. While income generation for some due to shutting down of check gates may have become a sour thing, but for the majority it is a massive relief. No doubt the State government has issued directives-- from the Police to the District authorities, but one should first look at one’s own kitchen. No doubt there are honest and hardworking people, but one rotten apple can spoil the basket. Corruption has become like a normal thing in the State. However, for other States like Punjab, where the Health minister was sacked and arrested just for asking 1 per cent as kickback-- they take such issue seriously. I am sure many (who are masters in this field) would be laughing out loud and comparing to note that a minister has been sacked just for asking 1 per cent bribe “Just ONE PER CENT!!!” It is time the people of Nagaland need to wake up and re-look at where our State would be heading to, in the next few decades. If we a need serious and major overhaul, we need strong leadership who can crack the whip, else no one has the right to crib, criticize or even dare point fingers at those at the helm of affairs. Last year, the highest ever recorded FDI came into India. Today the world is realising that India means business.” Modi said it was not the success of the government alone but business schools like ISB, professionals who passed out from such institutes and youth played a big role.

Investigations are in process, say the police force. In the previous trade, the precious metal settled at Rs 50,912 per 10 grams. Silver, however, grows Rs 87 to Rs 61,384 per kg from Rs 61,297 per kg in the previous trade. In the international market, gold was trading lower at USD 1,848 per ounce and silver was flat at USD 21.85 per ounce. “Gold prices traded d ow n w i t h s p o t g o l d prices at COMEX trading 0.13 per cent lower at USD 1,848 per ounce on Thursday. The operation by the Federal Police, the Federal Highway Police and the Military Police took place in Vila Cruzeiro in an attempt to capture leaders of the city’s largest criminal faction, reports Xinhua news agency. In a statement on Wednesday, the Military Police said that officers responded to an attack by alleged criminals in the favela, leaving 15 suspects dead, while a 41-year-old woman was killed by a stray bullet and nine other bodies have not been identified yet. The confrontation also left several wounded, including a teenager and two people who died on Wednesday. Rifles, pistols and a grenade were seized during the operation, along with a large quantity of drugs, and motorcycles and vehicles used by the alleged criminals.

TOKYO, MAY 26 (AP): Japanese and U.S. forces have conducted a joint fighter jet flight over the Sea of Japan, Japan’s military said Thursday, in an apparent response to a Russia-China joint bomber flight while U.S. President Joe Biden was in Tokyo. The Japan-U.S. joint flight on Wednesday involved eight warplanes based in Japan, including four U.S. F-16 fighters and four Japanese F-15s, the Joint Staff of the Japan Self-Defense Forces said. The joint flight was meant to confirm the combined capabilities of the two militaries and further strengthen the Japan-U.S.
alliance, it said in a statement. The flight occurred hours after North Korea fired three missiles, including an intercontinental ballistic missile, toward the sea between the Korean Peninsula and Japan, amid concerns about another nuclear test by the North. The missiles fell in waters outside of Japan’s exclusive economic zone. Chinese and Russian strategic bombers conducted joint flights near Japan on Tuesday, Japan’s Defense Ministry said. India and Israel elevated their bilateral ties to a strategic partnership during the historic visit of Prime Minister Narendra Modi to Israel in July 2017. India’s Murali Sreeshankar claims long jump gold in Greece NEW DELHI, MAY 26 (PTI): India’s premier long jumper Murali Sreeshankar won the gold medal at the 12th Intern a tional Jumpi n g Meeting in Kallithea, Greece with an effort of 8.31m. The Tokyo Olympian is the current national record holder with a jump of 8.36m, which he had achieved last month. Sreeshankar was followed by Swede Thobias Montler, who claimed silver with an 8.27m jump, and Jules Pommery of France, who bagged bronze with an 8.17m effort in the 10-man field. Only the top three jumpers crossed the 8m-mark. Jeswin Aldrin, meanwhile, finished fifth after he hit the 7.69m mark at the 17th Iberoamerican Meeting in Huelva, Spain. The Russian, who reached the quarter-finals at Roland Garros last year after four consecutive firstround exits, struggled at times but his elasticity eventually made up for his lack of natural ability to move around on the slow surface. Medvedev found himself down a break in the first set but his brilliant
defence helped him claw his way back both times on court Philippe Chatrier. He will next meet 28th seed Miomir Kecmanovic of Serbia. Medvedev, who won the U.S. Open last year and was runner-up at the Australian Open this season, arrived at the French Open with only one match on clay under his belt after undergoing a procedure to treat a hernia in April. No. 3 Paola Badosa has become the first woman seeded in the top 10 to reach the third round at Roland Garros this year. Badosa went down a break to open the third set of her match against 68th-ranked Kaja Juvan before regrouping to grab four games in a row and was on her way to a 7-5, 3-6, 6-2 victory at Court Suzanne Lenglen that took more than two hours. Badosa’s best showing at a Grand Slam tournament was a quarterfinal appearance at the 2021 French Open. She will face No. 29 Veronika Kudermetova next.
