NSCN (I-M) adamant on integration of Naga areas

D I M A P U R , AU G 1 8 (NPN): Even as the chief negotiator of the NSCN (I-M) and general secretary Th. Muivah and Government of India’s Interlocutor to the Naga talks R.N. Ravi recently issued a joint communiqué that sought to convey the message that solution was well within reach and soon, the NSCN (I-M) has virtually threatened to walk out of the process for solution unless its demand for integration of Naga contiguous areas were accepted as part of the deal. According to reliable sources, NSCN (I-M) leaders led by Th. Muivah have made it clear to government of India’s Interlocutor R.N. Ravi that they were ready to walk out of ongoing peace talks if the government of India did not consider integration of Nagas’ land. Sources further disclosed that both the entities were now talking seriously about integration of Nagas land in the face of an adamant stand adopted by the NSCN (I-M) which has coined another slogan “No integration, No solution.” The issue of integration had been insisted upon by the NSCN (I-M) and in the face of opposition from neigh-
ANPSTA alleges anomalies in appointment of PTs D I M A P U R , AU G 1 8 (NPN): All Nagaland PreService Teacher Association (ANPSTA) has alleged that for the last several years, the department of education has been appointing primary teachers (PTs) through the back-door on contract, ad hoc, temporary basis in various schools in Nagaland without following the TET guidelines or without conducting any selection process. In a representation addressed to the commissioner & secretary and director school education, the ANPSTA action committee convener Bendangsunep Longkumer and vice-convener Avi Ringa said they have all passed the Nagaland Teacher Eligibility Test conducted in the year 2013 and 2016 and were eligible to be appointed as primary teachers in any school in Nagaland. The representation stated that despite successfully getting through the Nagaland Teacher Eligibility Test no selection process whatsoever for recruiting primary school teachers from amongst them have been undertaken till date. ANPSTA stated that all back-door appointments deserved to be immediately cancelled/terminated and recruitment be conducted. In the event its representation was not considered within a period of 15 days, ANPSTA cautioned that it would have no other alternative, but to seek the redressal of its grievance before an appropriate court of law. ongoing talks with the Government of India (GoI) with regard to sovereignty and integration of Naga territories, Raising said “Nagas were not asking for sovereignty from India as sovereignty of Nagas belonged to the people”. On August 12, NSCN (I-M) general secretary Th. Muivah and government of India’s Interlocutor for talks, R.N. Ravi in a joint communiqué, setting at rest speculations regarding status of talks, especially after the demise of NSCN (I-M) chairman Isak Chishi Swu, assured that talks were progressing in the right direction and that both sides were closer than ever before to the final settlement and expressed the hope that it would be sooner than later. Both Th. Muivah and R.N. Ravi reiterated that the political initiative of the government of India and the NSCN (I-M) to resolve the Naga political issue had received a new urgency and impetus during the last two years. During the period, the two said talks had become more purposeful, less ritualistic and more forthright and far more frequent than in all previous years adding this helped build unprecedented mutual understanding and trust.

‘Status quo’ order stalling Tap individual’s potential for developmental works: NFR development, says Acharya

DIMAPUR, AUG 18 (NPN): Northeast Frontier Railway (NFR), Divisional Railway Manager (DRM), Lumding, Pankaj Jain on Thursday said “widening works of railway lines No. 2 and 3” at Dimapur railway station had been stalled due to the ‘status quo’ order issued by the district court following a case filed by some parties who were evicted by railway authorities. Addressing media persons, Pankaj Jain who was in Dimapur on Thursday to inspect the condition of Dimapur railway station, said around 50 households that had encroached railways land were evicted in a ‘proper manner’ in the presence of magistrates and police in 2014. However, he said around 15-16 households claiming to have land pattas, “illegally issued by the state government”, filed a case in the court which ordered status quo owing to which development works in the station has been stalled. Jain said that the state government would be submitting a written statement to the court regarding its position on the case by August 31, 2016. On the slow progress of development at Dimapur railway station, NFR authorities stated the severe financial crunch of the state government between 2009-2012 was one of the reasons. In this regard, the railway authorities have called
on the Zonal Railway Users’ Consultative Committee and Divisional Railway Users’ Consultative Committee to facilitate the railways to tackle the land problem. Jain also assured that cleanliness of Dimapur railway station would be a priority, particularly Nagaland Express and BG Express, the only trains that originates from Dimapur. He however informed that the lack of water supply system at Dimapur station was an issue as the trains had to depend on Lumding station for cleaning. Jain also informed that the railways have a long-term plan to shift the current goods yard to Rangapahar, with initiation from the state government to develop the roads. Earlier, the DRM during his visit inaugurated Upper Class AC Waiting Hall at the railway station.

KOHIMA, AUG 18 (NPN): Nagaland governor, P.B. Acharya, and chief minister, T.R. Zeliang, addressed the 30th annual general meeting of the Indian Red Cross Society Nagaland (IRCSN) state branch at Durbar Hall, Raj Bhawan here on Thursday. Speaking at the meeting, Acharya reiterated his idea to tap the potential that lay dormant within individuals and utilize it for the development of the society. The governor, who is also the president of IRCS Nagaland branch, acknowledged the contribution and service rendered by the IRCS Nagaland state branch and urged the members to put more effort and reach out to the people in times of need. Acharya also called upon the public and NGOs to ex-
tend their help to enable the schemes and benefits from the government reach the rightful beneficiaries as the government agents alone cannot fulfil the mission. He advised the IRCS Nagaland state branch to give elaborate report at the general meeting with the activities carried out in the current year and past years. Acharya expressed his happiness at the performance of the IRCS Peren and Dimapur districts and further urged other districts also to emulate the same. MDTOA threatens ‘chaka bandh’ Will go ahead with women reservation: CM ACAUT demands final draft
MOKOKCHUNG, AUG 18 (NPN): Mokokchung District Truck Owner Association (MDTOA) has threatened to launch ‘chaka bandh’ along the national highway (Mokokchung to Mariani road) if the state government fail to repair the said stretch within 30 days. In a statement MDTOA president Sentilemba and secretary Pokyim informed that the association had submitted a representation to chief engineer PWD (NH) highlighting the issue, as the road was the lifeline for people living in Mokokchung, Tuensang and Zunheboto district. They said if the government fails to take heed of their demand, it should not be held responsible for any eventualities that may arise. The road has been serving the three districts in various forms like public transportation and supply of essential commodities and at the same time people were dependant on this road for their livelihood, it added. Around 500-700 trucks ply along the stretch on a daily basis which has been neglected for several years, MDTOA said
adding, the condition has worsened and vehicles were unable to ply. As a result, the three important districts have been greatly affected, particularly the tuck owners as they have to bear the brunt of the trucks/ vehicles which are damaged beyond repair while transporting pubic and supplies.
Mkg power crisis: MTLT relaxes its deadline
Mokokchung Town Lanur Telongjem (MTLT) on Thursday informed since its demand for restoration of power supply in Mokokchung within one month expired on August 18, 2016, a joint sitting with the All Ward Union (AWU) held on Thursday agreed that the MTLT would relax its demand in view of the 15-day ultimatum served by the AWU. In a press release, media cell, MTLT said this was agreed in the interest of the public as well as in the interest of the move initiated by the All Ward Union. MTLT said it stood by the AWU’s stance and warned that new situations would invite new actions and reactions.

KO H I M A / D I A M P U R , AUG 18 (NPN): Nagaland chief minister, T.R. Zeliang, leaving aside all the opposition, Thursday affirmed that his government would go ahead with the implementation of 33% women reservation in the Urban Local Bodies (ULBs) elections. He informed this to the media persons on the sidelines of IRCSN general meeting held at Raj Bhawan on Thursday. When asked about the stand of the government on the issue, which was opposed by Naga civil society organizations like Naga Hoho and Ao Senden, Zeliang said that the government would stand by the cabinet’s decision. On August 11, Zeliang, at a function held in Kohima, announced the cabinet’s decision to implement the 33% women reservation in the Urban Local Bodies (ULBs) polls. Following the announcement, Naga Hoho expressed surprise over the cabinet decision and appealed to the gov-
ernment “to keep the cabinet decision in abeyance without issuing the notification till the matter is settled amicably”. The hoho said that the cabinet went ahead with the decision “without consulting the civil societies as one of the major stake holders within the state”. Ao senden, the apex body of the Ao community, also expressed its surprise over the decision and said the state government’s hustle to implement the said act when even the parliament was yet to pass the act. Ao Senden has said “it is also totally in contrary to the Indian constitution article 371 (A)” and also totally against the Ao custom.

Was victimised by VK Singh, banned illegally: Army Chief New Delhi, Aug 18 (PTI): In an unprecedented step of a serving Army Chief taking on one of his predecessors, General Dalbir Singh has alleged that he was “sought to be victimised” by Gen (retd) V.K. Singh, now a Union Minister, with the sole purpose of denying him promotion as Army Commander. Gen Dalbir Singh made the allegation in an affidavit filed by him in his personal capacity while responding to a petition moved by Lt Gen (Retd) Ravi Dastane who had alleged “favouritism” during his selection as the Army Commander. “I was sought to be victimised by the then COAS with the sole purpose of denying promotion to the appointment of Army Commander. False, baseless and imaginary allegations of lapses were levelled against me in the show cause notice (of May 19, 2012),” Gen Dalbir Singh said. then COAS could not be made the basis by the apellant to challenge my appointment as GOC-in-C, Eastern Command. In fact, it is the answering respondent who is the victim and not the appellant, as is sought to be made by him,” he said. The affidavit further said, “The passing of directions for initiating administrative action against me after about one month of having already finalised the Court of Inquiry smacks of a motivated, biased, arbitrary and malicious intent to punish me which the then COAS executed apparently as planned by him”. Regarding the Jorhat operation, Dalbir Singh has said in his affidavit that “on that day, I was away on part of annual leave and rejoined duty on 26 Dec 2011”. Dalbir Singh’s promotion as GOC-in-C, Eastern Command, with effect from June 15, 2012 was cleared by General Bikram Singh who had reversed the DV ban after V K Singh had retired on May 31, 2012.

Informing this in a press note, ENPO general secretary, Manlang Phom said the house deliberated at length on the issue, after which majority of those present opined that “since NLA in 2006 passed an amendment Act of Nagaland 33% women reservation in Municipal/Town Councils, and basing on October 28, 2011 ENPO resolution no.14 and subsequent reaffirmation on October 12, 2012, the house unanimously resolved that ENPO on behalf of the people of Eastern Nagaland shall not to oppose (in principle) the implementation of 33% women reservation and leave the matter to the Supreme Court final verdict.” Manlang further said that the house also resolved that the debate on 33% reservation should be purely and separately applied only in regard to Municipal and Town Councils “without any legal and political implications or infringement upon Article 371 A (1) (a).”

DIMAPUR, AUG 18 (NPN): Demanding that the final draft on anti-corruption mechanism Lokayukta be made public, ACAUT has submitted various points for inclusion in the final draft, before the Nagaland Lokayukta Act is passed in the coming Winter Session of the Assembly. According to ACAUT media cell, the points were submitted during the meeting with the Standing Committee on Lokayukta, constituted by the NLA, on August 17. Media cell said the team met the Standing Committee led by its chairman, Er. Levi Rengma, and members C. Apok Jamir, R. Tohanba, and Dr. TM Lotha. At the meeting, the committee expressed the dire need for the Lokayukta Act at this juncture, and also “voiced apprehension that the body maybe misused for political vendetta”, media cell said. To this, ACAUT said Lokayukta should not become another “paper tiger” like the State Vigilance Commission “whereby even its suo moto
power has been taken away with by the Cabinet, an issue first raised by the NTC”. ACAUT also apprised the committee on the danger of senior bureaucrats on the verge of retirement lobbying for membership in the Lokayukta. In order to discourage political practice of rewarding loyal bureaucrats with membership in various constitutional and statutory bodies, ACAUT proposed a “cooling off ” period of at least five years after retirement before any retired bureaucrat could be considered for the august office, media cell said. Further, ACAUT told the Committee the anti-corruption ombudsman “has nothing to do with Article 371 (A) and thus citing reason that Lokayukta violates article 371 (A) has no logical basis, the Article 371 (A) has frequently misinterpreted to suit vested interest”. ACAUT also demanded that the Nagaland Lokayukta Act should satisfy the people of Nagaland.
Education row: Review petition filed against order of JMFC Peren Correspondent
KOHIMA, AUG 18 (NPN): After the Judicial Magistrate First Class (JMFC) Peren had dismissed the complaint case against chief minister T.R. Zeliang’s educational qualification on July 29, on the ground of being barred by time limitation, the petitioners have filed a criminal revision petition before the Kohima Bench of the Gauhati High Court (GHC), challenging the decision. At the hearing Thursday, senior in the Supreme Court advocate, K.N. Balgopal representing the petitioners said they were within the limitation period as per the Supreme Court(SC)and High Court (HC)orders. Balgopal informed the judge that in the event the case goes in their favor, they would not want to revert the case to JMFC Peren for trail. Balgopal maintained that magistrate, who was asked to decide only the ques-
tion of limitation, had gone beyond the brief by making remarks against the petitioners, accusing them of political vendetta. He further said when the HC had already noted that the petitioners had a locus standi on the matter, the magistrate by casting aspersions on the petitioners, virtually exceeded her jurisdiction by interfering in the HC order which the SC had accepted. Balgopal said in the objection filed by the respondent before the JMFC Peren, a line was added claiming that Hon’ble HC has not decided in any of the issues raised, giving the impression that the HC has given the liberty to the magistrate to re-hear the issue whose merit had been settled by the High Court. Balgopal said if the judicial precedence or decisions of the High Court were ignored, a state of confusion would be created in the administration of justice and that the
constitutional authority of the HC would be undermined. “I leave the matter to the High Court to decide the issue separately,” he added. He said this sentence that the HC had not decided on the issue was actually missing in the SC order. The advocate therefore maintained that the respondent T.R Zeliang, by interpolating the SC order had committed contempt of court, and also in support of the interpolation, he (Zeliang) had filed an affidavit before the magistrate, amounting to another offence of perjury before the Peren Court. He said even though the judgments were tendered to the JMFC Peren and read out at length and if the judgments were heeded to, the petition would not have been dismissed. After hearing the senior advocate, justice LS Jamir of the Kohima Bench High Court fixed September 14 as the next date of hearing. K Y M C
