Lokayukta orders registration of PE case against deputy CM Correspondent KOHIMA, FEB 20 (NPN): Following a complaint lodged by a former student leader against deputy chief minister, Y. Patton for his alleged “misdeeds, abuse of power and maladministration in the police/home department”, the Nagaland Lokayukta justice Uma Nath Singh has ordered registration of a preliminary enquiry (PE) case in this regard. “As the complaint is procedurally in order, the law has to take its course. Thus, I need to proceed as per provisions of Section 8(1)(a); Sec. 10, Sec. 11 and Sec. 12 of the Nagaland Lokayukta Act (NLA) 2017 by passing appropriate order(s),” Singh stated in its order dated February 20, 2020. Since the allegations was related to a high public functionary, Singh stated that “before undertaking an exercise of investigation, which is governed by the provisions of Cr.Pc., which, if ordered immediately without complete verification of facts as alleged in the complaint, may
have a cascade effect on the existence of state government.” In this regard, the Lokayukta directed the coordinating officer/inspector of Nagaland Lokayukta police establishment to register a PE case, to be conducted by the higher authority/ functionary, namely the chief minister Nagaland, who shall submit his report on an affidavit before the next date of hearing. Aye in an affidavit submitted to the Lokayukta alleged that Patton, in his speech at a recent programme, had “proposed and offered to the candidates who qualify the written exams of NPSC to approach him for help at the interview stage”. Aye said that Patton, having been the Home minister for almost seven years, with a short break in between, was allegedly involved in “rampant abuse of administrative discretion
and favouritism and also interference in normal administrative functioning of the police department,” such as on appointment issue. Aye said it was evident that Patton, during the recently concluded Assembly session, had squarely blamed the SPs and Commandants for making almost 1135 appointments in the department during 2018-19, without advertisement except for 206 constables and 35ASI/SI. Meanwhile, the complainant urged the Lokayukta to consider handing over the case to the Central Bureau of Investigation (CBI) or someone with impeccable credentials, to avoid any kind of influence during the course of investigation. Further, the Lokayukta under Sec. 35 of the NLA 2017, directed that the Nagaland Police and the Commissioner of police Dimapur in particular, to ensure protection of the complainant, who falls in the category of “whistle blower”, failing which necessary legal consequences shall follow against the authority responsible for such protection.

Ravi, after taking serious note of the offences, sent a missive to the state chief secretary, Temjen Toy urging the state government to consider filing criminal cases against the three and to investigate the matter. In the letter dated February 17, to the chief secretary, issued through T. Mhabemo Yanthan commissioner & secretary to the Governor, a copy of which was made available to media, mentioned that the three officials under the department- joint director (directorate), junior education officer (directorate) and junior education officer (DEO Wokha)- were issued show case for offence of misappropriation of public money, fabrication of documents, cheating and criminal breach of trust, inflicting financial loss to the state exchequer. In the light of the above, the letter stated that the Governor of Nagaland deemed these as offences being “criminal and serious” and therefore desired that the government consider registering a criminal case and investigate it. Further, the Governor also mentioned that the Supreme Court had held that criminal and departmental proceedings could run simultaneously.

KOHIMA, FEB. 20 (NPN): Minister of Public Health Engineering Department (PHED), Jacob Zhimomi, Thursday disclosed that the department has set a target of providing Functional Household Tap Connection (FHTC) to every household in 550 villages (50 villages in each district) in the financial year 2020-2021 under Jal Jeevan Mission (JJM). The Har Ghar Jal programme, under JMM, is envisioned to provide safe and adequate drink-
ing water through individual household tap connections by 2024 to all households in rural India, under the department of Drinking Water and Sanitation, Ministry of Jal Shakti, Government of India. Addressing the PHED review and co-ordination meeting at the department’s conference hall on Thursday, the minister directed all the executive engineers (EE) of the district to list out all the department’s incomplete or defects projects and submit it to the department within 15 days. He also di-
rected the EEs to upload details of how funds from the ministry have been spent in time. Jacob said that the main reason for delay of funding from the ministry was late uploading of the project for evidence in the official website. Reminding that PHED was public utility department and answerable to the public of its activities and achievements, the minister called upon the department officials to tighten the belt and work hard. He also advised the respective districts to conduct seminars relating to sanitation for behavioural changes. The minister further directed the officials to visit the project site and not be “a table engineer.” Challenging the engineers to work hard, the minister said unless they worked hard the state would not develop. On sidelines of the programme, minister informed that Zarü stream project, which would supply water to the state capital, would be commissioned by March this year.
DIMAPUR, FEB 20 (NPN): Rengma Public Union Chümoukedima (RPUC) has extended its support to the Naga Tribal Union Chümoukedima Town (NTUCT) over its stand on alleged illegal appointments in police department and urged it to immediately file a case in Lokayukta on behalf of the general public. Rengma Public Union Chümoukedim president Hillo Kent in a statement also termed chief minister Neiphiu Rio’s assurance in Nagaland Legislative Assembly (NLA) on February 14 to constitute a panel to review the appointment system in the government and give recommendations on making fair recruitments as an eyewash. NEW DELHI, FEB 20 (PTI): Supreme Cour t Thursday refused to entertain a plea seeking to define the word ‘minority’ and laying of guidelines to accord minority status based on state-wise population of a particular community. A bench of Justices R F Nariman and S Ravindra Bhat allowed advocate and BJP leader Ashwini Upadhyay to withdraw the plea with the liberty to approach the appropriate forum for the relief. During the hearing, senior advocate Vikas Singh, appearing for Upadhyay, said that the word ‘minority’ needs to be defined and guidelines need to be laid for their identification at state level in accordance with the apex court verdict of 2002. The expression ‘minority’ has been used in Articles 29 and 30 of the Con-
stitution but it has nowhere been defined, he said. As per the Census of 2011, Hindus are actual minority in Laddakh, Mizoram, Lakshdweep, Kashmir, Nagaland, Meghalaya, Arunachal Pradesh, Punjab and Manipur, Singh said. The bench said if the petitioner has any remedy, then it lies somewhere else not in the apex court. There are two options, either the court will dismiss the petition or the plea can be withdrawn by the petitioner, it said.
Singh then said that he would like to withdraw the plea but would like to have liberty to move the appropriate forum. The bench dismissed the plea as withdrawn but gave the petitioner liberty to approach the appropriate forum. Upadhyay’s plea said that as per the Census of 2011, Hindus are merely 1 per cent in Laddakh, 2.75 per cent in Mizoram, 2.77 per cent in Lakshdweep, 4 per cent in Kashmir, 8.74 per cent in Nagaland, 11.52 per cent in Meghalaya, 29 per cent in Arunachal Pradesh, 38.49 per cent in Punjab and 41.29 per cent in Manipur. “But, their minority rights are being siphoned off illegally and arbitrarily to the majority population because neither Centre nor respective State has notified them as a ‘minor-
ity’ under Section 2 (c) of the National Commission of Minorities Act. Thus, Hindus are being deprived of their basic rights, guaranteed under the Articles 30,” the plea said. It said that despite Hindus being in minority in these states, they cannot establish and administer educational institutions of their choice in spirit of Article 30(1) of the Constitution. “On the other hand, Muslims are 46 per cent in Laddakh, 95 per cent in Kashmir, 96.58 per cent in Lakshdweep; Christians are 87.16 per cent in Mizoram, 88.10 per cent in Nagaland, 74.59 per cent in Meghalaya; Buddhists are 50 per cent in Laddakh and Sikhs are 57.69 per cent in Punjab. But, they can establish and administer the educational institutions,” the plea said.
DIMAPUR, FEB 20 (NPN): Eastern Nagaland College Students’ Union (ENCSU) has welcomed the State Government, particularly the minister concerned, for its immediate positive response to Wangkhao College students’ demand and assuring to address their matter within 10 working days. The union however expressed its strong opposition to the department of Higher Education’s decision to appoint contractual teacher at Wangkhao College, stating it was totally against the contractual appointment system at colleges in Eastern Nagaland. It said such appointments would create more problems in education sector and cautioned that if any such teacher was found
even after its appeal, this could create more complications. It requested the eastern Nagaland students to remain alert against such appointments. Urging the State government, particularly the higher education department, to look for existing lectures in some colleges and those attached at directorate in Kohima and Dimapur, ENCSU further suggested rectification and reshuffling of lectures from their assigned posts and send them where there was shortage of teachers at present. It also questioned the department why it was not aware of shortage of lectures at Wangkhao College when the semester exam was just near, which implied neglecting Eastern Nagaland institutions, and demanded
only regular teachers in the colleges of the area. Demanding that the higher education department immediately provide principals in colleges, the union said some colleges were functioning without them. It added that there was shortage of lecturers not only at Wangkhao College but in all the four government colleges, which were suffering due to shortage of teachers in every department in eastern area. It urged the department to immediately fulfil the genuine demands of the students of Wangkhao College and other Eastern Nagaland colleges.
