KOHIMA/DIMAPUR, JAN 17 (NPN): Against the backdrop of repeated appeals and caution by various tribe organisations opposed to holding elections to Urban Local Bodies (ULBs) till the government addressed their concerns over clauses in the Nagaland Municipal Act including 33% women reservation, even after amendment in 2016; at least three houses and some vehicles of candidates in Phek town were damaged as some youths allegedly began targeting those who refused withdraw their nominations and in Dimapur, the , the Joint Coordination Committee(JCC)

AYO warns excommunicated candidates DIMAPUR, JAN 17 (NPN): Angami Youth Organisation (AYO) has issued a stern warning to intending candidates who have been excommunicated by their community and relocated to Angami areas in Dimapur and Kohima, to immediately relocate or face action. In a press note, AYO president Neinguvotuo Krose and general secretary Kekhrie Pfukha asserted that AYO would “not allow such negative characters who have refused to listen to the voice of their community and the Nagas in general to come and pollute our land, our community and the people residing in our land”. In this regard, the Youth Organisationwarned that it would take its own course of action to any extremity if such candidates do not relocate immediately.

JCC appeal

Joint Coordination Committee (JCC) comprising of Ao, Lotha, Sumi, Chakhro Angami and Chakesang tribes resolved to ask the state government to postpone elections to the ULBs scheduled for February 1,2017 and to respond at the earliest or else it would convene a public rally and followed by an indefinite bandh as a course of action. The resolutions, came after three-hour long meeting at the last date for withdrawal of nominations held at Lotha Hoho Ki which were adopted by raising of hands. Naga Council Dimapur has also endorsed the resolution of JCC. Out of the 60 candidates, who filed nominations in Dimapur district, 41 candidates- 13

BJP, 16 Independents, four Congress and NPF attended the meeting. The candidates had maintained they would withdraw only if NPF candidates withdrew their nomination first. Earlier, half of the candidates left the venue, when the meeting resumed after 10 minutes break. Even as the meeting progress, the candidates remained firm to their demanded that they would only withdraw if there is a mass withdrawal. On the other hand, JCC insisted that the candidates should listen to the voice of their respective apex bodies to withdraw their nomination paper to avoid ex-communication. JCC member also questioned the candidates, whether it was good to be elected for five years or face ex-communication from the Naga soil?

Addressing media persons at Congress Bhavan Dimapur, Chishi said that the decision was taken to respect the will of the people. “We must live with the people so importance must be given people. And we cannot bypass the wishes of the people”, he added. Earlier on January 12, at the general meeting at Kohima, the Nagaland Pradesh Congress Committee (NPCC) had passed a resolution urging State government to defer the election to Urban Local Bodies (ULBs). According to Chishi, the decision was taken in response to the demand of various tribal hohos, Naga Hoho, Eastern Nagaland Peoples’ Organisation (ENPO) and civil societies. He said candidates also expressed their willingness to uphold party’s interest and the people in general by withdrawing their nomination papers. Chishi also warned that if election was held ignoring people’s voice, there will be huge misunderstanding in the minds of the people. He said Nagas needed a government that listened to people’s voice.

ULB polls a constitutional obligation: Zeliang DIMAPUR, JAN 17 (NPN): Nagaland chief minister, T.R. Zeliang on Tuesday reiterated that holding elections to the Urban Local Bodies in Nagaland, with 33% women reservation, was a Constitutional obligation which the state government could not escape because reservation was Constitutional provision as provided by Art. 243T of the Constitution of India and not an Act of Parliament. According to CMO media cell, Zeliang said this while addressing NPF candidates of nine Town Councils-- Shamator, Meluri, Phek, Aboi, Naginimora, Longkhim/Chare, Noklak, Pungro and Kiphire, at the party’s head office in Kohima on Tuesday. He said those candidates who had filed their nominations, have not done anything wrong but were following the laws provided and required by the Constitution of India as well as adhering to the principles and ideologies of party.

As legislators have sworn allegiance to the Constitution of India, so also, as NPF members “our allegiance should be to the party we belong to and not any organization,” Zeliang said . He also lamented that the Constitutional obligation to be performed by the state government had been misunderstood, misinterpreted and even politicized in certain cases. If objections were raised before the provision of the Constitution was incorporated in 1993, he said Nagaland may have been exempted from reservation for women in ULBs. “But now, it is too late since Article 243 T is already a Constitutional provision which we cannot do away with,” he said. Clarifying on the misconception that the state Assembly could do away with all laws and rules of the Central government if Nagas do not want them, Zeliang said: “Article 371 A clearly says that

‘not withstanding anything in the Constitution, no Act of the Parliament in respect of ‘four points’ shall apply to the State of Nagaland unless the Legislative Assembly of Nagaland by a resolution so decides”. He said there was a need to differentiate between Acts of Parliament and Constitutional provisions. To this, he said Article 243 T, which cites reservation for women in ULBs, was not an Act of the Parliament which Nagaland Legislative Assembly can decide whether or not to adopt. “As long as we are part of the Union of India, the Constitution of India will be binding on us and we cannot deny this fact. And debating over an Article of the Constitution of India whether we should apply it or not is a futile exercise,” he added. In this regard, he said the September 22, 2012 Assembly resolution was questioned by legal luminaries on the

grounds that only the Parliament was competent to exempt any State from the purview of any part of the Constitution of India. He claimed that the assembly (four years later) withdrew that resolution in 2016 to rectify the “legal anomaly.” He said not fulfilling obligation as per Article 243T would also not go well either for the State Government or the people of the State. Zeliang also appealed to all legislators and candidates present at the meeting to reach out to various tribal/social organizations and to urge them to let the elections be held peacefully. Lotha public resolve to boycott civic body polls DIMAPUR, JAN 17 (NPN): Lotha Hoho at the emergency meeting with the general public of Wokha town, surrounding villages and all Lotha frontal organizations on Tuesday, resolved to boycott the ensuing Urban Local Bodies (ULBs) election 2017. A statement from Hoho president Mhao Humtsoe and general secretary Mhondamo Ovung, stated that the leaders of various organisations and general public, including many candidates in unison agreed to support the decision of the Naga organisations and to safeguard the provisions of Article 371A, for betterment of the Naga future generation. Further, the house unanimously decided and adopted the following resolutions: To hold meeting of all colonies in Wokha, and Bhandari town on January 20 at 11 a.m. at LTC hall, Wokha. Each house hold in Wokha town would be represented by a member while colony leaders with

atleast five members from each colony would represent Bhandari town at the meeting. It was also decided that the resolutions adopted in the meeting would be presented to each colony, where they will have to meet the next day, January 21 for follow up action of the resolutions. Further, Lotha Hoho has also called for a general public meeting on January 28, at 11 a.m. at public ground, Wokha. In this regard, the hoho has appeaeld top all village councils under Wokha district to be present with at least ten members each. At the meeting, the resolutions of January 20 would be presented for implementation. Meanwhile, village councils have been requested to contribute funds for supporting the Joint Action Committee and volunteers for the execution of the action plan. Kohima Lotha Hoho and Dimapur Lotha Hoho have been directed to attend the meeting positively.

DIMAPUR, JAN 17 (NPN): Calling upon the people of Nagaland to use the fuel efficiently, the Nagaland chief minister, TR Zeliang, has suggested the people to adopt certain better practices in their way of lives by inculcating various habits such as walking, cycling, sharing vehicle, use of public transport and avoiding using of motor vehicles unnecessarily. In his message on the month-long campaign on Oil Conservation, being organised throughout the country by the Petroleum Conservation Research Association under the aegis of the Ministry of Petroleum & Natural Gas, along with Public Sector Oil and Gas companies to create awareness on the need to conserve oil and natural gas, the chief minister said the demand for petroleum products throughout the country was still growing

though measures were being adopted to increase usage of new and renewable energy resources.He pointed out that India has a huge deficit in crude oil production as the country import nearly 80% of its crude oil requirement at a whooping cost to the nation’s exchequer. “Our country’s import bill is high and always dependent on the rate of global crude oil prices, and it has become imperative for the country to devise ways and means of reducing dependence on imported energy,” Zeliang said. The chief minister, however, expressed happiness at the various plans and strategies formulated by the Government of India to enhance availability of proprietary oil and gas both from within and outside the country. He mentioned that Entanol Blended Petrol and Jathropa based Bio-Diesel were being promoted to

have an impact on consumption of fossil fuels. Zeliang said that alongside those initiatives, which he said were yielding substantial benefits, the energy consumption efforts needed to be initiated to make the whole country energy efficient. Meanwhile, the chief minister congratulated the entire oil industry for organising the conservative awareness month and wished them all the very best in their endeavours. On January 16, 2017, the Minister of State for Petroleum & Natural Gas, Dharmendra Pradhan inaugurated the month long awareness drive on fuel conservation Saksham 2017 in New Delhi. Saksham - 2017 is aimed to create awareness amongst masses towards judicious utilization and conservation of petroleum products along with use of energy efficient appliances and switching to cleaner fuels.

PANAJI, JAN 17 (IANS): In what could be construed as a dig at the Naga penchant for dog-meat, Defence Minister Manohar Parrikar on Monday said during SC Jamir’s term as Goa Governor, there was not a single stray dog on the Panaji streets. Parrikar also called Jamir, a veteran Congress leader from Nagaland, a “mercenary” who was appointed as Goa governor to bring down the BJP-led coalition government in 2005, which at the time was led by him. “Jamir came from Nagaland and was given the target of dismantling the government. The only advantage we got as a result of this was not a single stray dog in Panaji,” Parrikar told a poll meet in South Goa’s Canacona Legislative As-

ZBN clarifies

D I M A P U R , JA N 1 7 (NPN): Zeliangrong Baudi Nagaland (ZBN) has expressed surprise over the statement made by organizations, questioning the eligibility of Ms. Aphian Pamei, DMC ward 18 candidate. In a press note, Zeliangrong Baudi Nagaland president Rangsam N Hau and Meijiang Gonmei clarified that “Aphian Pamei is a Zeliangrong citizen and active member of ZBN residing in Zeliangrong village, Dimapur.” Questioning her eligibility to contest the election and individualizing her by JCC, CNTC and NCD, seems to be too rude towards Zeliangrong representative living in Dimapur, ZBN stated. DIMAPUR: Khaghaboto Area Students’ Union (KASU) held its 41st session on January 13, at Khaghaboto town Baptist church under the theme “self reliance”. At the programme, Er. Kiyeto Shohe, as speaker, exhorted the students to change their outlook and mindset. “Although there are more than eighty thousand educated unemployed youths, there is no dearth of employment opportunity” he pointed. “We have rich mineral deposits and rich natural resources and if we can tap those resources, lots of employment can be generated”, Shohe added. Er. Kiyeto Shohe maintained that there are over 1.20 lakh outsiders in the state and more than 250 Crores is spend on construction transaction alone of which only 20 percent is transacted among the locals therefore he encouraged the students to bring about change and transformation in the society. Pointing out that government jobs would not make self reliant, he encouraged the students to be innovative and work hard. Shohe also encouraged the students to have inquisitive mind and have

more exposure with the outside world and make correct usage of the information technology to keep pace with the changing world. Commenting on Sumi being referred as warrior tribe, he pointed that a true warrior should stand for justice, equality, uplift the downtrodden and protect the weak. He further encouraged the students to have cordial relation with all the tribes so as to live in harmony with one another. The programme highlighted three session including theme session, panel discussion and orientation programme. Meritorious students were also felicitated during the programme. DIMAPUR: Narcotic Cell of Excise Department while on duty at Chumukedima check gate has seized contraband ganja weighing approx. 160 kgs on January 15 after receiving specific information about transportation of ganja between Senapati and Dimapur. In a press note, superintendent of Excise, S.Phyobemo Kikon, stated that on duty party led by inspector S. Kakiho Yeptho, and his personnel after a hot chase, intercepted the vehicle (Esteem) DL4CH-

0985 at Chumukedima area at 11.30 am. Kikon stated that upon search of the vehicle the contraband ganja was recovered and immediately the duty party seized and arrested the occupant of the vehicle R. DIMAPUR: Ao Baptist Church Diphupar (ABCD) Christian Education Ministry (CEM) conducted Vacation Bible School (VBS) from January 11-15 on the theme “Cave Quest: Following the light of the world”.Throughout the week the children learned Bible stories, songs, crafts and plays based on the theme and for the first time the church tried the City Verve VBS course and the teachers as well as the students commented that this course is children friendly and more relevant and interesting for the children. Children and teachers after the “faith camp” at Kiphire DIMAPUR: Three-day faith camp for Catholic children of St. Peter’s Church, Kiphire was held from January 13 to 15, under the themes “Know God, know life” and “Deepen your faith.” The participants were divided into two groups between Classes 3-7 and Classes 8-12. The sessions included explanation on the topics, appropriate video shows on the lessons and the subsequent activity on the subject matter. The activities included fill in the blanks,

word search, jumble of words, coloring the graphics, and question-answer pattern. UYO alleges backdoor appointments DIMAPUR: United Youth Organization (UYO) has alleged that there have been backdoor appointments in various posts under Chief Medical Officer (CMO) office Tuensang from 2013 to 2016. In a press release, U YO p r e s i d e n t B. M . Ya n c h u C h a n g a n d general secretary, Moa. S. Chang, claimed that the organization has detected through RTI Act (2005) wherein a total appointment was estimated to be 161 posts. Cultural troupes performing at Yimchunger-Sümi cultural exchange programme. Tohanba in his message conveyed that the Sumi and Yimchunger sharing land boundaries had co-existed since time immemorial and assured to extend help in both good and hard times. Under this programme, widows would be imparted a three-month training program on cutting and tailoring. The trainees would receive a stipend of Rs 1,500 per month. Ruzazho village council slams AR for assault; seeks inquiry

D I M A P U R : Ru z a z h o Village Council (RVC) has expressed resentment against Assam Rifles for apprehending one its members, Velasayi Sapuh, on January 10 midnight at his resident Agri-Forest Colony Kohima and “torturing him using all different ways until he was forced to sign the false accused document”. In the press release, RVC chairman Jolelhu Veswuh and secretar y Vevota Swuro claimed that on that fateful night, the other tenants were also not spared but harassed by randomly searching their rooms causing mental tortured to the small children and women also. The council claimed that Assam Rifles after

searching the room manipulated the neighbour to sign a piece of paper “no objection certificate” w i t h o u t k n ow i n g t h e contents. However, RVC said the victim’s wife on finding that the paper stated that one 0.22 pistol was found in their house and refused to sign the document. The Assam Rifles whisked her and forcefully made her to sign the paper, RVC claimed. The village council also claimed that in the year 2016 January, the victim, Velasayi Sapuh, was apprehended by Assam Rifles and manipulated him

to sign the document falsely accusing him as deputy kilonser of NSCN (K). RVC said that these two incidents have led the council to suspect some “foul play or conspiracy” for which the life of Velasayi Sapuh has been threatened. The council also pointed out that Velasayi Sapuh was found to be innocent when tried by the first class magistrate’s court vide criminal case no. 3 for 2016 incident. The council clarified that he neither joined any underground faction before nor was involved in any anti-national activity.

RVC while condemning such act towards its member said that the so called “Friends of the hills people” who were sent out with the sole mission of protecting its country’s citizens has instilled “fear psychosis in the minds of its citizens by arresting, torturing and manipulation”. The council stated the repercussions of these callous behaviour and abuse of power by Assam Rifles personnel would

hamper the patriotic spirit of the Indian nation and they would achieve exactly to opposite of what they were sent out to achieve. F u r t h e r, RVC h a s urged the state government to set up an independent inquir y commission to unearth the truth behind the conspiracy of torturing innocent citizen, book the responsible person (s) and initiate appropriate action as per the law of the land.

JFP to persuade Centre to lift economic blockade

IMPHAL, Jan 17: A 17member team of the Joint Forum for Peace (JFP) Tuesday left Imphal for New Delhi to urge the Central leaders to either clear the 78 days old economic blockade or get it lifted at the earliest. JFP is a forum of 64 different civil society organizations (CSOs) based in both hills and valley areas of the state to work together to restore normalcy in Manipur arising out of economic blockade imposed by the United Naga Council (UNC). The objective of the trip is to get the economic blockade lifted through intervention of the Central government at the level of the Prime Minister and the Union home minister. The team is planning to hold a meeting with the Union home minister Rajnath Singh on January 18 which will be followed by a meeting with the Prime Minister if they get the appointment. As stated by the delegates, they will also meet

with other leaders of the Central government to draw their attention in appraising the Prime Minister and Union home minister. During their camping at the national capital, the delegates are planning to stage a protest demonstration along with Manipuri people staying/living in Delhi urging the Central government to intervene and resolve the economic blockade permanently. Among others, the 17 delegates of the JFP include representatives of Kuki Inpi Manipur (KIM), Kabui Mothers’ Association (KMA), All Tribal Students’ Union Manipur (ATSUM), United Committee Manipur (UCM), Committee of Civil Societies Kangleipak (CCSK) Manipur, All Manipur United Clubs Organization (AMUCO) and All Manipur Muslim Organisations’ Coordinating Committee (AMMOCOC). President of UCM Elangbam Johnson is leading the delegation of the JPF. At the time of formation of the forum, it was agreed to approach

the Central government, if necessary, to get the UNC’s indefinite economic blockade lifted. Recently, the UNC’s prolonged economic blockade was retaliated by counter economic blockade at different pockets of Manipur valley. Nonetheless, the JFP and other civil society organisations have been working relentlessly to thwart any untoward incident which may result out of the economic blockade and the counter economic blockade. JFP’s trip to Delhi is in no way related to the invitation extended by Centre’s interlocutor R N Ravi to citizen organisations to hold consultations on the ongoing peace talk between the Centre and the NSCN (I-M) on January 20 in Delhi. The interlocutor invited UCM, AMUCO and CCSK to hold talks on January 20 as part of his (Ravi) series of consultations with CSOs in Manipur on the sideline of the peace negotiation between government of India and NSCN (I-M).

EPFO launches special Employees Enrolment Campaign, 2017

DIMAPUR, JAN 17 (NPN): EPFO has launched a special campaign to provide opportunity to the employers to voluntarily come forward and declare details of all employees who were entitled for PF membership between April 1, 2009 to December 31, 2016 but could not be enrolled for any reason. The campaign started from January 1, 2017 and would continue till March 31, 2017 and aims to extend PF benefits to employees hitherto deprived of PF benefits. A press note by regional provident fund commissioner-I (NE Region), B. Lalzamang stated that salient features of the campaign are: The employee’s share of contribution if declared by the employer as not deducted shall stand waived; The damages to be paid by the employer in respect of the employees for whom declaration has been made under this campaign shall be at the rate of Rupee 1(one) per annum; No admin-

istrative charges shall be collected from the employer in respect of the contribution made under the declaration; A declaration can be made under the Campaign for the period for which no inquiry under section 7A has been initiated. It also stated that establishments that enroll new employees under the campaign would be eligible to draw benefits available under Pradhan Mantri Rojgar Protsahan Yojana (PMRPY) as well as Pradhan Mantri Paridhan Rojgar Protsahan Yojana (PMPRY). The government of India pays 8.33% contribution of employers’ share to the Employees’ Pension Scheme (EPS) in respect of new employees having UAN. It also informed that any employer may send during the campaign period, a declaration, in the prescribed format, for membership of the employees. Bail plea hearing for UNC leaders on January 21

IMPHAL, Jan 17: The Imphal East chief judicial magistrate has extended the custody of UNC president and his publicity secretary for four more days while fixing bail plea hearing for January 21. Completing the seven day police custody period after the last extension, UNC president Gaidon Kamei and his publicity secretary Shangkhel Stephen were produced in the court of the Imphal East CJM today. While producing them, police prayed the court to extend the remand period for another 20 days. However, the court remanded them further only for four days while directing the police to produce them on January 21. The application filed by the accused persons under section 437 CrPC (related with granting bail in case of non- bailable offence) will be considered on the same day, the court pronounced. Due medical treatment and adequate food must be given to the accused persons while they are in the police custody, the court added. S hillon g, Jan 1 7 (Agencies): The arrest of an MLA in connection with the rape of a minor has led police on a trail which could turn up leads for a sex racket in the state. Since Inde pendent MLA Julius Dorphang’s crime came to light, nine arrests have been made in the case, with police saying that more arrests could follow soon. Dorphang was arrested from Guwahati after he was named by the 14-yearold victim, who said she had been sexually violated by the legislator twice. The sex racket came to light after an employee of the guest house was arrested for trafficking the victim last month. The girl was rescued from near the guest house and brought to the police station, where she named all those involved in the trafficking. Indicating that the case at hand involved “influential people”, a senior police official said, “Based on intelligence inputs we have received, more arrests are likely to be made.” Nine people, including Dorphang, have been arrested so far based on FIRs filed by the State Commission for Protection of Child Rights.

Woman jumps off speeding vehicle to escape rape attempt

GUWAHATI, Jan 17 (Agencies): A widow in Assam was seriously injured after she had jumped off a speeding vehicle to escape an alleged rape attempt. The police said the woman, who is in her midforties, was undergoing treatment at a governmentrun hospital in eastern Assam’s Golaghat town. She sustained injuries on her head and one eye, a doctor at the hospital said. The incident occurred at around 8 pm on Monday when the woman was travelling from her birthplace Titabor in Jorhat district to Silanijan, about 60 km away, in Karbi Anglong district where she has been living ever since her marriage. “I had dropped her at the bus stop at Titabor where she boarded a Golaghat-bound bus. In Golaghat, she probably didn’t get a bus to go further to Silanijan and boarded a goods-laden vehicle,” a relative told the media on Tuesday. The police said the woman had asked the driver to drop her at Silanijan but when the vehicle,

which was travelling at a very high speed, did not stop there saying they had not reached the place, she panicked and jumped off at a bridge near the Nambar Reserve Forest. The locals found her with severe injuries lying unconscious by the roadside. Later, the police rushed her to the hospital. Karbi Anglong Superintendent of Police, Debojit Deuri, told Express that it was a goods-laden DI truck. While three persons, including the driver, were on the front seat, the woman was seated on the back seat. “She hasn’t told us anything about rape or molestation attempt on her. Perhaps, the trio had such an intention but nothing happened till the time she had jumped off the vehicle,” Deuri said. Asked if the police could identify the vehicle or the trio, he said, “She hasn’t been able to give us details of the vehicle except that it was white DI. We’re investigating,” he said. The woman had gone to her parental home in Titabor on January 15 and was returning on Monday.

Hectic efforts were made to arrest the other absconding accused persons however no arrest have been made so far. Cong announces ties with Samajwadi Party

N E W D E L H I / LU C KNOW, JAN 17 (PTI): Efforts to form a “grand secular alliance” in pollbound Uttar Pradesh went into top gear today with the Congress declaring that it has decided to tie up with Samajwadi Party and the shape of the formation would be announced in the next two days. “I am confident that the Samajwadi Party-Congress alliance will form the next government in Uttar Pradesh,” AICC General Secretary Ghulam Nabi Azad told reporters confirming about the much talked about the tie up. Azad, who is in-charge of party affairs in UP, said this was just a beginning of the alliance process and the nitty gritty would be decided in the next one or two days. He was asked whether it would be a grand secular alliance also comprising Ajit Singh’s RLD. At the AICC briefing later, party coordinator for UP Meem Afzal spoke in similar vein. “Congress will have an alliance with Samajwadi Party in Uttar Pradesh. The details of the arrangement will be announced in the next two days,” he said. Congress announcement came close on the heels of reports from Lucknow where SP chief

NEW DELHI, JAN 17 (PTI): The Delhi High Court today sought response of the Ministry of Home Affairs on a plea seeking its status report on alleged poor quality food being served along the LoC as claimed by a BSF soldier on social media. A bench of Chief Justice G Rohini and Justice Sangeeta Dhingra Sehgal also issued notice to Border Security Force (BSF), Central Reserve Police Force (CRPF), Central Industrial Security Force (CISF), Indo-Tibetan Border Police (ITBP), Sashastra Seema Bal (SSB) and Assam Rifles seeking their stand on the allegation of poor quality food being given to jawans. It also directed the BSF to produce before it the investigation report and the steps it has taken with regard to allegations levelled by BSF jawan Tej Bahadur Yadav. “The steps have already been taken by respondent 2 (BSF) in this regard. However, we would like to see their report. Whatever report you have, place before the court on next date of hearing, February 27,” the bench said. The direction came after advocate Gaurang Kanth, appearing for BSF, informed the court that BSF has already done on the spot inspection after the incident. “Things are in order. We have found nothing as was alleged by Yadav. However, we are further looking into

the issue,” Kanth submitted. The bench, meanwhile, refused to issue any direction with regard to not taking any action against Yadav, as was sought by the petitioner, saying, “Sorry we will not go into it.” The petition was filed by Puran Chand Arya, a former central government employee, in the wake of a video posted on Facebook by BSF jawan Tej Bahadur Yadav, claiming corruption among officers and poor working conditions. The public interest litigation (PIL) sought direction to MHA to submit a status report with respect to all paramilitary forces in India over allegations of the BSF jawan in his video which went viral on social media. Citing the fundamental Right to Equality (Article 14) and Life (Article 21), the PIL filed through advocate Abhishek Kumar Choudhary highlights the allegations about insufficient and bad quality of food provided to jawans. It seeks action on the incident so that the morale of the force is not affected and also asks for clarity on ration procurement, food preparation and servings to various categories of officers. On January 9, Yadav posted a video on Facebook which showed a meal box comprising a watery souplike dal, which he said had only turmeric and salt and a burnt chapatti.

Ignoring the elephant

I

n the light of several events that have taken place during the past months, it may not be out of context to suggest that the cacophony of political hype and hyperbole in Nagaland does little to mitigate the people’s undercurrent of despair. The list of concerns are many, loss of authority-family and society, blatant corruption, rising crimes, pervasive immorality and lawless syndrome -are enough to suggest, that things have gone wrong. The outward signs cannot hide the inward problems. These signs do not augur well for society in the long run. These expose the greatest tragedy confronting Naga society today- a perplexing veneration of profane politics that has no need for the rudder of rationality. Politicalspeak has created many red herrings in Naga society and the current resentment of all major tribes against being taken for granted by their own government with the candy of civic polls being most profound. The lofty ideal of fulfilling a constitutional obligation to hold elections to Urban Local Bodies(ULBs) can also barely hide the intense interest to get central funds for “development” of towns in the state and the political motive to win the election semi-final before the 2018 final assembly elections and of course, sending a political message to politically interested women that the party ruling the government does care for them. Of course, this “constitutional obligation” cannot obliterate the other vital constitutional responsibility of the elected, to address the grievances of their people. The tribe organisations have yet to get organised over the crucial issue of knowing and understanding where their social and customary concerns lie vis-a-vis Article 371A since views are basic and not specific and that could take more time until credible leaders arrive on the scene. The most important aspect of striking a balance between the belief systems of the past and present is for the elected government to play a catalytic role. Nagaland is recognised and protected under Article 371A as a society of tribes having their own traditional practices and customary laws. The practices of the Nagas can only be described and interpreted by the Nagas themselves and not by those who have no idea about Naga way of life and who would look through the legal prism. Naga society has been hemmed in by polarized politics with politicians, both in or out of power, routinely resonating the cacophony of the call for “unity” for peace and solution. Both “unity” and “peace” is about promoting a free society, where various sections live in understanding and consequently , creating harmonious environment. The sky wouldn’t have fallen on the government’s head had it taken a little more time to engage all these concerns. Unity as being ranted by the politicians, should be practised first when it is needed. Like other states, Nagaland has its own social and other problems and when these have not been addressed, they seriously complicate the environment to the extent that today, no one in Nagaland really feels confident enough to say that the future is bright, even though there may be optimists who would like to find the light at the other end of the tunnel. Indeed, issues that are political in nature have gotten wedged into society’s growing problems and creating a negative synergy.

Customs, tradition and usages

agaland the abode of various Tribes since many generations has been practicing different Customs, Traditions and usages up till date although there is no written codification but yet is followed by convention. The absence of codified customary practices, Tradition and Usages has brought about multiple interpretation leading to dilution of the essence of the practice followed by the forefathers irrespective of the Tribes. It has therefore become imperative that the Naga society ponder over it and codify the Customs, Traditions and Usages for the younger generation unless we consider it redundant. Applicability of law cannot be by choice for own benefit, however, in Nagaland suitability is practiced. The State of Nagaland was formed out of 16 point agreement between Government of India and The Naga People’s Convention in 1960. Article 371A, the 13 amendment of the constitution gave special provision to the State of Nagaland in regard to (a) The Religious or social practices of the Nagas. (b) The customary laws

and procedure.(c) Civil and criminal Justice so far as these concern decision according to the Naga customary Law. (d) The ownership and transfer of law and its resources. The special provisions has been interpreted time and again by many individuals in different capacity but has not come to a logical conclusion due to lack of consensus opinion as there is no authoritative codification. If this approach is continued there is a danger that sooner or later the entire privilege given may be abrogated. I would like to share my opinion as regard to sub clause (ii) of Article 371A (1)(a) The customary laws and procedure. Dictionary meaning: Customs defines (i) Traditional ways of behaving or doing something that is specific to a society place or time ( ii) Customary meaning in accordance with customs. Tradition (i) The passing on of customs or belief from generation to generation (ii) A long established custom or belief passed on in this way. Traditional (i) Having to do with or following tradition (ii) In the style of the early century. Usages (i) A manner or

council. The council will also deal with disputes and cases involving breaches of customary laws and usages. Art 371 A (1) (a) Special provisions (ii) Naga customary law and procedure Having highlighted the relevant portions of 16 point agreement and Art.371A and the meaning of the customs, traditions and usages; the Naga brothers and sisters at this juncture may decide as to whether 33% reservation is within the preview of Article 371A of the constitution. Customs, Traditions and usages. a) The Nagas in early days were pagans which worshipped the nature and the head led both the village administration as well all ceremonial rituals. Only the male participated in all these rituals. b) All social functions were headed by the male and the women assisted in the domestic works but did not lead in important functions. During the head hunting days the women along with the children were protected by a group of men selected to guard the women and the children; Whereas the men from the community par-

ticipated in the war. c) Only the male participated in the decision making. d) The Naga forefathers from time immemorial were called head hunters due to inter tribal territorial supremacy where only the male participated in the war. e) The Naga society is a patriarchal system f) During the forefather days wearing of clothings were as per merit of their heroism. g)The women being respected in the society were gifted with materials during their marriage by the family and the clan. h)Although the male led in all activities the women were held in high esteem and there was no discrimination. These were practiced from generations in our Naga society, therefore to preserve this the word Customs, Traditions and usages were inserted in the agreements signed between GOI and the Naga representatives which culminated in the 13 amendment of Article 371A.As Special privileges for the State of Nagaland which is being debated in the present juncture.

There has been divergent views after the municipal election when 33% women reservation was declared by the state government where the civil societies have demanded for review of the said reservation alleging infringement of Art.371A. On considering the interpretation of Customs, Traditions and Usages it is amply clear that the word Customary denotes the Traditional ways of behaving or doing something that is specific to a society place or time in accordance with customs and Tradition having to do with or following tradition in the style of the early century. Usages, a manner or treating use, habitual or customary practice which the Naga society has been adhering till date. Therefore 33% reservation in the municipal election is contrary to the customary practices of the Nagas. Taking this into account, we have to protect the rights given to us and cautiously take correct measures by having wide consultation with the stake holder for the future generation. Rejoinder to T.L. Angami

S

ince the Indo-Naga political dispute started many lives have been lost and properties and house worth millions have been destroyed and like any other villages Zhadima also suffered consequences from the long civil war. T.L. Angami quotes and thoughts are merely his personal inspirational opinion. Infact the Shillong accord was proven only to be a decoy resulting in the death of thousands of Nagas including innocent children, women who were subjected to molestation rape and even death. On the 3rd of August the Delhi accord was signed between Government of India (GOI) and Th. Muivah to which the propaganda of the accord still remains a mystery to this very date. By God’s grace at the right time some Naga intellectuals came together to bring an amicable solution to all this inhuman

treating use (ii) habitual or customary practice. The 16 point agreement at Serial No 7 enunciates that, No Act or law passed by the Union parliament affecting the following provisions shall have legal force in the Nagaland unless specially applied to it by a majority vote of the Nagaland legislative assembly: (a) The Religious or social practices of the Nagas. (b) The customary laws and procedure. (c) Civil and criminal Justice so far as these concern decision according to the Naga customary Law. The existing law relating to administration of civil and criminal justice as provided in the Rules for the Administration of Justice and police in the Naga Hills District shall continue to be in force. (d) The ownership and transfer of land and its resources. Serial No 8. : Local Self – Government: Each tribe shall have the following units of the rule making and administrative local bodies to deal with matters concerning the respective tribes and areas: (a) The Village council; (b) The range council; and(c) The Tribal

draconic laws and tormentation, they succeeded in bringing normalcy back to the region. On the 9th unification day, Nagas of Nagaland State combining all the sixteen tribes working for the Naga national cause had decided to come under one roof on a common ground. Why then T.L.Angami had to bring confusion and delusion into the mind of the Nagas at this crucial stage, where national integrity seems to be the main objective. He needs to give a concrete answer to why we have to follow the accord and put our whole trust on the GoI which looking from the past had been the major cause of Naga division, deteriorating directly or indirectly, politically or geographically or put our faith on a political group whose agenda remain hidden to this day, why should the Nagas who are wise decision makers put their faith on a pile of secretive papers which contains are

yet unknown. The accord signed by the GoI and NSCN IM was a closed door deal and no other Nagas know on what base and ground was the accord amended. Every Naga is familiar with dirty play of the GoI ever since 1947 and with the self obsessed dealings by some of our leaders who are ready to sell their national identity for selfish desires. Where in, these leaders are applauded by our own civil and local leaders to achieve publicity, while they all remain a puppet to the GoI. Six NPGs have come together on a common platform to work together for Naga integration why then does T.L. Angami preach disunity when all can see that these little ascending moves are the stepping stone to bring unity amongst the Nagas. Also how can one rely on a pessimist who doesn’t believe in bringing peace, progress buid

by his own brothers, yet, aimlessly put his stake on a bunch of papers which he himself doesn’t know what it contains. No authority have been given to him from Angami people to represent the whole tribe in following the Delhi accord, nor had any organisation vested him the power to speak for the whole Angami Tribe. T.L. Angami himself being a past national struggler is clear of the fact how Nagas had suffered under the tyranny of the GoI and after lies and tortures inflicted on the Nagas, why should Nagas follow your proposal to drop all our ongoing progress on reconciliation and unity and worship the accord which you yourself is ignorant of the contents amended in the accord. Why preach and lead the Nagas into a darker cave when not knowing what lies inside. Wherein you speak of trends set by our NPGs leaders

in mass media and newspapers, whereas you have set yourself a new trend taking the name of a whole Naga tribe under your dire command and diverting the Nagas from a common ground to a suicidal platform. Your proposal indedd is your personal opinion and a blasphemy in general to the Nagas and itself bring confusion to the minds of the Nagas. This land cannot be a dispute, between the GoI and NSCN IM, it was our father’s land who gave it to us, you and I cannot let some foreigner arbitrate what is to become of our Nagaland. It is the Nagas who can and who will make the commitment. This land gave you and I an identity, an identity you and I ought to uphold our whole life, an identity you and I cannot simply betray for a pile of fake dealings. “URRA UVIE” GPRN/NSCN Angami region.

An acrimonious concept

he acrimonious concept of ushering in equality between man and woman through 33% women reservation acquired a stature of a social storm at the stage of filing nomination for the ULB election. An enhanced controversy centred on withdrawal of candidacy from the fray is now slowly gaining a momentum of a hurricane. In the absence of matured reasoning we are probably starring at a potentiality chaotic social tsunami sweeping across the State if Mr. T.R. Zaliang shuts down his thinking faculties and adamantly puts into motion the final ULB election process knowing well that this will be an outright challenge to the civil society. One fails to understand why NPF/DAN Government is in such a reckless hurry to implement this highly polarised ULB election with everything pointing towards a negative outcome. The only poor excuse thus far shared by the Chief Minister in support of ULB election with 33% WR to gain central funding is not good enough. While it is not a crime wanting to tap “Central Resources” for Urban Development, it is neither an opportune time nor sufficient a reason worth the cost of ripping the social order of the Nagas asunder with hatred amongst ourselves in replacement. Considering that nominations have been confirmed

in a few urban centres only, the final outcome will also be subjected to this partial disjointed election that can only establish urban bodies in few Districts/townships. This half measure exercise will become all the more redundant when the citizens start their non-cooperative reactions against such municipalities even after it is established. This religious reliance on money overpowering our judgement is getting apparent by the days. Deliberately antagonising the majority somehow shows a poor political craftsmanship of the reigning government to endanger the party prospects so close to the forthcoming Assembly election. The probable deduction that the electorate has short memory and can easily be bought with money no matter what the current controversy may be when 2018 assembly election arrives...could be a costly miscalculation. Rightly or wrongly this issue touches the core sentiment of traditional mindset of the male population and could very well become the focus of a political main plank, added to the tainted picture of blatant corrupt and nepotism ridden incumbent Government, on which an election could be fought. At this juncture, the majority can only see an overzealous Government that has cast caution to the

wind, divorcing rationality and turning the State upside down in its relentless pursuit for money. The manner in which our Chief Minister is hastily going about addressing this subject at the cost of compromising sensible social equilibrium tends to display downright reckless immaturity. As a welfare State, the Government is expected to maintain not only the material but also the mental wellbeing of its people as its primary concern. Taking an overview of the year 2016, our Chief Minister seems to have achieved just the opposite in almost all the parameters that matters to the people thus far. He has water cannoned, tear gassed and lathi-charged the voices of dissent against his corrupt Government and has determinedly protected the interest of criminals that control the system. Not being satisfied with fishing in a muddied rural pond of Nagaland that has already been drained off its resources, he has impatiently gone one step further to deliberately alienate the people to seek greater pleasure of fishing in urban financial pond at the cost of creating chronic social discord. Judging from the tempo of aggression being expressed by the Tribal Apex organisations the CM, in all likelihood, will have to once again call out his water cannon and tear gas robot squads in NAP uniform

and lathi-charge the civil disobedience movement that seems eminent...to solve his self-engineered problems. This serious rift that is being perpetuated within the Naga community is totally an unnecessary approach to put women at par with men. All in all it is a no-win situation that is likely to leave behind an ugly scar within the Naga community. Rather than push this subject to a critical level of confrontation, we should be looking at a better alternative option to achieve the same goal with a modicum of “patience”. It makes better senses not to let money fog our judgement and consider the following long-term options with additions and subtractions as deemed fit: 1. First postpone the ULB election; 2. Then take time and set up a statutory “Supreme Customary Law Court” (SCLC) consisting of knowledgeable, reputed, senior DBs/GBs from each Tribe capable of dealing with their respective Tribal customary Laws as well as Customary Laws that have common applications across the board; 3. While each Tribe has their respective Customary Laws divergent from the other in many sectors, there too are sectors that have common practices such as the customary law on inheritance, the status

definition of women in the society and so on. Let this Supreme Customary Law Court be empowered to amend customary law and practices that have become obsolete within their respective Tribes and also address and amend customary laws common to all Tribes deemed necessary for amendment; The important perspective in this exercise would be that the Nagas will have a statutory “Supreme Customary Law Court” (SCLC) that is empowered to strengthen or amend customary Laws that needs revision or have become obsolete and there-

by ensure that Article 371 A becomes a true Constitutional protection for our Naga Identity limiting the scope of any misinterpretation by our adversary at any given point in time. While such an exercise will be a time consuming effort it is nevertheless an indispensable necessity which must first be achieved rather than take irrational short cuts that could be detrimental to the Nagas identity in the long run. So much has been written and said about the ULB election. The main point which triggered off the objection was the 33% reservation for women. At this juncture, one can see the whole purpose shifting ground and turning into a war of sorts between contending parties. So many withdrawals are announced in print daily. The last date for withdrawal has come and gone with many refusing to withdraw. Should the ULB election be postponed or would it still be carried out with a handful of candidates? What would be the next plausible step for the government to do? What a bone of contention for us. Anyway, this is just the start of a new journey for Naga society. Rajasthan edn minister stands by cow remarks

JAIPUR, JAN 17 (PTI): Unfazed by criticism over his remarks that the cow is the only animal to “exhale oxygen”, Rajasthan education minister Vasudev Devnani today stood by his claim, basing it on “research websites”. Devnani had made the claim on Saturday while speaking at a programme organised by Akshya Patra foundation at Hingonia cow rehabilitation centre. “I read this fact on research websites and it recently appeared in a magazine of Akshya Patra, saying that cow inhales and exhales oxygen and included this in my speech on Saturday,” the education minister today said. To underscore the “scientific significance” of the “holy animal”, he reiterated today this reference can be found in “research studies”. Various studies have been conducted on the cow, its urine and dung, and “people need to understand its scientific values,” he said. “The Gaumutra’s benefits and its medicinal values are well known and people use and take its benefits. The burning of cow dung makes the environment free of harmful micro-organisms and mosquitoes, making the place suitable for living,” he said.

NEW DELHI, JAN 17 (IANS): Twenty five children from different parts of the country have been selected for Indian Council for Child Welfare’s (ICCW) National Bravery Awards to be presented by Prime Minister Narendra Modi on January 23. Four of the awards are posthumous. The Bharat Award has been conferred to 8-yearold Tarh Peju of Arunachal Pradesh, who sacrificed her life in an attempt to save two of her friends from drowning. Roluahpuii and Lalhriatpuii from Mizoram, and Tushar Verma from Chattisgarh have been given Bapu Gaidhani Award posthumously. While Roluahpuii saved two girls from drown-

ing at the cost of her own life, Lalhriatpuii sacrificed her life in an effort to save her cousin in a car accident and Tushar Verma lost his life in trying to extinguish a fire in his neighbour’s shed. The Geeta Chopra Award has been conferred on 18-year-old Tejasweeta Pradhan and 17-year old Shivani Gond of West Bengal who showed immense courage in fearlessly helping the police and the NGO in uncovering an international sex racket leading to the arrest its mastermind here. The Sanjay Chopra Award has been conferred to 15-year-old Sumit Mamgain of Uttarakhand who displayed outstanding bravery in fighting a leopard to

save his cousin. “These awards were initiated to give due recognition to to the children who distinguish themselves by performing outstanding deeds of bravery and to inspire other children to emulate their example,” ICCW President Gita Siddhartha told IANS. The selection was made by a high powered committee comprising representatives of various ministries, NGOs as well as office bearers of ICCW. “Eligible awardees will be granted financial assistance until they complete their schooling,” Siddhartha said, adding that the government has also reserved some seats for them in medical and engineering colleges and polytechnics.

NEW DELHI, JAN 17 (PTI): In a clear message amidst the chill in bilateral ties, Prime Minister Narendra Modi today asked Pakistan to walk away from terror if it wants to have dialogue with India. Outlining his approach for an integrated neighbourhood, Modi said his vision for country’s neighbourhood puts premium on peaceful and harmonious ties with entire South Asia. “But, India alone cannot walk the path of peace. It also has to be Pakistan’s journey to make. Pakistan must walk away from terror if it wants to walk

He also recalled several initiatives taken by him to normalise ties with Pakistan including travelling to Lahore. New Delhi, Jan 17 (PTI): In a minor relaxation to IDS tax payment rules, the Income Tax Department has said disclosures under the scheme will be considered valid even if the tax amount has been realised by December 5. The first instalment of taxes was to be paid by November 30. The government had come out with a 4-month long Income Disclosure Scheme, which closed on September 30, 2016, to give an option to domestic black money holders to declare their unaccounted wealth and come clean by paying 45 per cent tax and penalty. In an instruction to principal commissioners, the income tax department has asked them to condone the delay in payment of first instalment which has arisen due to “genuine technical difficulties”.

New Delhi, Jan 17 (IANS): India’s domestic air passenger traffic zoomed by 23.18 per cent in 2016 to 998.88 lakh, official data showed on Tuesday. “Passengers carried by domestic airlines in 2016 were 998.88 lakh as against 810.91 lakh during the previous year, registering a growth of 23.18 per cent,” the Directorate General of Civil Aviation (DGCA) said in its statistical analysis. According to the data furnished by DGCA, domestic air passenger traffic increased by 23.91 per cent during December to 95.52 lakh from 77.09 lakh during the corresponding month last year. In November 2016, the passenger traffic rose by 22.45 per cent to 89.66 lakh. The data showed that low-cost carrier (LCC) SpiceJet had the highest passenger load factor (PLF) during the month under review at 93.7 per cent.

China to launch satellite for predicting quakes Beijing, Jan 17 (IANS): China will launch a satellite this year to gather electromagnetic data which may be used in monitoring and forecasting earthquakes. According to China’s earthquake administrative agencies on Tuesday, the satellite will be launched in the latter half of this year, Xinhua news agency reported. Movements of the Ear th’s cr ust generate electromagnetic radiation which can be observed from space. By collecting data on the Earth’s electromagnetic field, ionosphere plasma and high-energy particles, the satellite will be used in real-time monitoring of earthquakes and possible seismic precursors in China and neighbouring regions. The satellite will be China’s first space-based platform for earthquake monitoring, providing a new approach for research.

new report claims women only spoke 27 per cent of the dialogue featured in 2016’s biggest movies. Despite leading roles for the likes of Felicity Jones in Rogue One and Margot Robbie in Suicide Squad, last year was apparently a bad one for female actors. According to a report by data scientist Amber Thomas, which analysed a host of films including Captain America: Civil War, Finding Dory, The Jungle Book, Batman v Superman: Dawn Of Justice, Rogue One: A Star Wars Story, Deadpool and Suicide Squad not one of the top 10 movies of 2016 had a 50 per cent speaking, female cast. Finding Dory was the closest to this level of equality with 43 per cent female characters. To be equal, the movie would have needed eight more speaking, female roles. Rogue One was apparently the worst. Only 9 per cent of its speaking characters were female. Of those 10 characters, one was a computer voice, one appeared on screen for no more than five seconds, and one was a CGI cameo

that said one word. Finding Dory came out on top with 53 per cent female dialogue. But, 76 per cent of that dialogue came from Dory alone. Trailing at the end was The Jungle Book with only 10 per cent of its dialogue spoken by a female character. While Harley Quinn was a highly advertised character in Suicide Squad, she only spoke 42 per cent as many words as Floyd/ Deadshot (played by Will Smith). Notably, Amanda Waller (played by Viola Davis) spoke frequently, totalling just 222 words (16 per cent) short of Deadshot’s word count. Female characters were also apparently outnumbered in Captain America: Civil War’s final battle by five to one and throughout the movie, they only contributed 16 per cent of the dialogue. Meanwhile female remakes are continuing on a number of movies including the forthcoming Ocean’s 8, which will feature Sandra Bullock, Cate Blanchett, Rihanna Helena Bonham Carter, Sarah Paulson, Mindy Kaling and Anne Hathaway.

New Delhi, Jan 17 (Agencies): The muted gr umblings among the BCCI officials, who have been shown the exit door following the Supreme Court directives on the Lodha Committee report, have been growing in volume and tenor as several of them are seeking legal options to address the panel’s answers to some Frequently Asked Questions (FAQs) about how the board should be run. Added to the general discontent, the removal of former India off-spinner Ashish Kapoor and former Punjab batsman Amit Sharma from the junior selection committee also may open a potential can of worms. With the Lodha Committee expected to name the replacement BCCI office-bearers on Thursday, some of these officials are seeking to take recourse with the law to address their concerns.

Many of the officebearers are miffed with the answer specifically FAQ No. 2 on the Lodha Committee website, which essentially ensures that the nine-year cut-off date for officials encompasses time spent both with the Board of Control for Cricket in India, as well as the state associations. Debarred BCCI officials can no longer even officiate in their state associations, leading to much consternation. According to media reports, the officials contend that this was a ‘departure’ from the Supreme Court order. They insist that the Supreme Court order does not authorize the Lodha Committee to prevent the sacked officials from returning to the board as nominees of their respective state associations. Another issue they have brought up is the decisions

taken by the Lodha panel in selection of the teams for the ongoing ODI series with England, as well as for the coming T20I games, which also is beyond the ambit of the committee’s authority. Sacking of selectors The removal of Kapoor and Sharma from the junior selection committee also raised questions. According to The Indian Express, these selectors need to have played a minimum of 50 first-class matches, or represented India in a Test or a One-day International. Kapoor has played four Tests for India, apart from 17 ODIs, as well as 128 first-class games. Sharma has played 53 first-class matches. The reason for the discontent is that the people retained include Rakesh Parikh, who has played one first-class match less than Sharma and has not represented India.

The chief guest also said that women players should be given equal opportunity in the field of games and spor ts. Therefore, he urged upon

the gathering to encourage women participation in the field of sports. 8 teams will compete men’s in football, and volley ball, sepaktakraw, and athletics for both men and women. The chief guest was accompanied by youth resource officer (YRO) Mon, additional SP Mon, president NPF Mon Division and party leades.
