KOHIMA, JAN 24 (NPN): Nagaland chief minister T.R. Zeliang Tuesday appealed to all tribe organisations, opposed to women reservation and ULB elections, to reconsider their stand by allowing the elections to be held as scheduled. He made the appeal while speaking as chief guest at the ‘National Girl Child Day’ held at the Capital Convention Centre Kohima under the theme ‘My Girl Child, My Asset, Not Liability’. With both the tribe organisations and government firm with their opposing stands, the chief minister told the tribe organisations not to impose views and opinions on others through threat and intimidation. Zeliang maintained that since time immemorial, Naga women were never given the opportunity or responsibility to take part in the field of politics or decison making process. Diphu, Jan 24: Four militant groups have called for shut down in Karbi Anglong to boycott Republic Day celebrations on January 26 and to pressurise Centre for passage of the Autonomous State Bill in the next parliament session. Altogether the separate bandh calls would be effective from January 25 to January 28, 2017. United Peoples Liberation Army (UPLA) has called for boycott to Republic Day celebration from January 25, 5 a.m. to January 26, 5 p.m. On the other hand, IK Songbijit-led PDCK including NDFB-S, NLFT and KLO has called for a 24-hour shutdown on January 26 from 12:01 a.m. to 11.59 pm. KANCHASDCOM and its allied organizations KSA-Inglongpho, Karbi Riso Adorbar, Karbi So-Arlo Amei and Karbi Unemployed Youth Association have also called for a 24-hour shutdown in Karbi Anglong and Dima Hasao autonomous district from January 27, 5 a.m. to January 28, 5 a.m. to pressurize Centre for passage of the Autonomous State Bill in the coming of Parliament session.

Sakhrie stated that Nagaland has been celebrating National Girl Child Day since 2008 at the Anganwadi Centres, it was only this year that it was being celebrated at the state

level. She reiterated that the occasion was not only to remove discrimination, exploitation of all kinds but also to secure the rights and provide girl child with equal opportunities in all spheres etc. Mission director SRCW, Daisy Mezhur stressed on the need for mothers to change their mind-set by allowing the girl child to participate in various activities instead of restricting them. Mezhur also appealed to all to give the girl child, a dream, a dream of hope, equality, dignity, and opportunity for better future making and to make the child an asset. She further appealed to the chief minister to consider ‘Girl Child’s Policy’ even in Nagaland. The programme was chaired by a nine old girl-Jentina Yaomei Shangkhu while Benjongsola Jamir and Ruovilhou Kense, both 11 year old girl and boy presented special number making the event more attractive. On the occasion the national bravery award winner of 2015, Mhonbeni Ezung (9 year old) was also felicitated.

Staff Reporter called for a consultative D I M A P U R , JA N 2 4 (NPN): State Election Commission (SEC), after examining the memorandum submitted to the chief minister by JCC, has informed the chief minister’s office that there was no alternative but to complete the electoral process as announced. In a letter addressed to the commissioner & secretary to CM, the State Election Commissioner, Sentiyanger Imchen informed that the Commission after examining the memorandum referred to the SEC, concluded that the election process which got underway since December 21 consequent to the issuance of a notification cannot be stopped/postponed/ deferred. Imchen further stated that the entire electoral process once set in motion has to be taken to its logical conclusion. On January 23 JCC, after the public rally, in a memorandum to CM demanded deferment of civic polls on or before January 26, failing which it said an indefinite state-wide bandh would be imposed .

DIMAPUR, JAN 24 (NPN): Determined to go all out against the Urban Local Bodies (ULB) elections, the Joint Coordination Committee comprising of Ao, Lotha, Sumi, Chakhro Angami and Chakhesang on Tuesday called upon all citizens to be prepared for any kind of eventuality if the state government turn deaf ears to the voices of the people. A JCC member reminded the state government that it was not just on single tribe or individual’s voice but the voices and appeal of all Naga tribes. As announced during the mass public rally on January 23, the JCC reiterated that the Naga public would impose an indefinite state-wide bandh if the state government failed to defer the elections on or before January 26, 2017. JCC in this regard has appealed to all citizens not to undertake any journey programme, official engagements, parties, meetings etc. with effect from January 27 to February 1, 2017. Meanwhile, JCC has

Govt. to pump in Rs 5500 cr ZTYO backs JCC’s ENWO plea to allow ULB elections in NE to beef up connectivity demand on ULB polls GUWAHATI, JAN 24 (AGENCIES): What is expected to beef up connectivity in the insurgency dominated pockets and international border areas, Union Ministry of telecommunication will install around 6000 towers across Northeast India under the comprehensive telecom development plan for Northeast India. Secretary department of telecommunication (DOT), J.S Deepak spent two days in Northeast India and had meeting with CMD of BSNL, Bharat Broadband Network Ltd and Rail Tel. Deepak told ET on Tuesday, “We have discussed state wise what were hurdles and what ways to overcome it were. 2017 as far as DOT is concerned is year of focus of Northeast India.” The project will connect 8250 villages across the region in next two years. Deepak added, “We have sanctioned project for providing connectivity to 9000 villages which do not have connectivity. This has to be done in two parts; one part will be done by BSNL and other by private telecom service provide. BSNL will do this work in Arunachal Pradesh, Dima Hasao and Karbi Anglong. Tender of

this project is in process and we will launch the same next month.” He added that second project is to connect the district and state headquarters in optical fiber ring. This is in progress and by 2018 it will be completed. Fund is not a problem and this is clear vision of Prime minister, Narendra Modi. “In two years time from 2017 and 2018, we are investing close to Rs 5500 Crore in Northeast India.” BSNL Assam has proposed to install over 1000 mobile towers. BSNL has submitted a proposal for setting up 2000 mobile towers, out of this at least 920 towers will come up in insurgency infested and disturbed areas of KarbiAnglong and Dima Hasao, Bodoland and pockets of Upper Assam.” Around 108 mobile towers will be installed along Indo-Bhutan and Indo-Bangladesh. Most of these towers will be run via satellite.” Deepak said that, “Northeastern states have assured that mobile towers will be allowed to installed in government buildings and radiation will be not in the way. Time taken for right of way approval and cost of it will be taken care of. There is delay in giving approval in right of way approval, states have assured they will look into it.”

DIMAPUR, JAN 24 (NPN): Zunheboto Town Youth Organization (ZTYO) has endorsed its firm support on the demand of Joint Coordination Committee (JCC) to defer Urban Local Bodies (ULBs) election in the state, with a warning that it would enforce indefinite bandh within its jurisdiction in the event government ignore the appeal of the people. Media cell of ZTYO vowed to stick by its apex organization, Sumi Hoho’s stand, a co-organising member of JCC, and warned that the state government would be held solely responsible in the event of any untoward incident occur during the enforcement of the bandh. Reminding state government that going against the wishes of the people was against the principles of democracy, the youth organization urged the government to initiate necessary consultative process with all stakeholders so that certain amendments are made before implemented, instead of “adamantly forcing” through the ULB Act 2001, which was against the wishes of the people. Further, the youth organization urged state government to abide by the chief minister’s statement, who categorically stated that, “elections would not be held in places where there is opposition”.

DIMAPUR, JAN 24 (NPN): Eastern Nagaland Wo m e n O r g a n i s a t i o n (ENWO) has appealed to various organisations in the state opposing the urban local bodies (ULB) elections to reconsider their stand and allow elections to take place peacefully. In a press release, ENWO president, Birila Tokiu, and vice president, Pejem Konyak, also appealed to all Naga brothers opposing women’s reservation “to change their attitude towards women and start respecting their mothers through whom they came.” Expressing “shock” that “unchristian methods” like banishment and excommunication of the candidates was taking place in a Christian society like the Nagas, ENWO said if Naga men “truly respect their women”, then they must support women reservation in ULB. The organisation argued that reservation of seats was “right instrument”

to empower women in the state as the power of decision making and leadership in society played a vital role to empower a voice that was “being constantly suppressed.” Further, ENWO maintained that reservation for women would also encourage and instil confidence in women, adding that unless reservation was granted, they would hesitate to come forward. ENWO termed as “unfortunate” that in a 60member assembly, not a single member was a woman, “and yet we still claim that men and women are treated equally in Nagaland.” Women participation in the municipality level local self government, ENWO said would enable better understanding of women’s problems and facilitating their uplift. It went on to assert that women participation and contribution would be helpful in handling matters like hygiene, sanitation, health, waste management and other civic issues that

were primary role of municipal authorities. ENWO also said that equal participation of every section of the society in the administrative process, especially at local level, such as a municipality, was essential to a progressive society. Pointing out that it becomes “close to impossible” for any woman to contest against a man in a society where the concept of patriarchy has been deeply rooted, the ENWO said the concept of reservation was therefore important for truly empowering women in the state. Meanwhile, ENWO has thanked and appreciated ENPO, ENLU, ENGOA, ENSF and all the tribal leaders for standing in support of the women’s reservation. It further urged them to stand by their women till the process of elections was over, saying women needed their blessings and support to be able to take the mantle of leadership roles in the form of town councillors.

State BJP unit urges people to avail all central schemes Governor’s appeal DIMAPUR, JAN 24 (NPN): State BJP has appealed to people of the state to avail facilities to help bring development to the state by highlighting some relevant central schemes for the benefit of people. The appeal was contained in a statement issued by state BJP general secretary (media) & spokesperson, Jaangsillung Gonmei, who pointed out that the BJP-led NDA government at the centre has launched several pro-people social security and developmental schemes to create an equitable society. Among several schemes, meant to address the needs of people in urban and rural areas, farmers, youths, women, poor, general public, industrialists, etc. certain relevant schemes needed to be given adequate attention as necessitated to bring about an all round development. One such scheme, the state

BJP spokesperson said was Shyama Prasad Mukherji Rurban Mission (SPMRM), which was approved by the union cabinet on September 16, 2015 chaired by Prime Minister Narendra Modi with an outlay of Rs. 5142.08 crore, to drive economic, social and infrastructure development in rural areas. As the mission was to transform rural areas into an economically vibrant urban area, the state BJP said the scheme was therefore termed as “Rurban” mission. The mission aims at development of rural growth clusters that have latent potential for growth, in all States and UTs, which would trigger overall development in the region. Those clusters would be developed by provisioning of economic activities, developing skills and local entrepreneurship and providing infrastructure amenities.

Further, those clusters would be well delineated areas with planned layouts prepared following the planning norms (as laid down in the State Town and Country Planning Acts/ similar Central or State statutes as may be applicable), which would be duly notified by the State/UTs. Finally those plans would be integrated with the district plans/master plans as the case may be. The state governments would identify the clusters in accordance with the Framework for Implementation prepared by the Ministry of Rural Development, which would be geographically contiguous Gram Panchayats with a population of about 5000 to 15000 in desert, hilly or tribal areas. For the selection of clusters, the Ministry of Rural Development would adopt a scientific process of cluster

selection that involves an objective analysis at the District, Sub District and Village level, of the demography, economy, tourism and pilgrimage significance and transportation corridor impact. Following this analysis, the ministry would provide a suggestive list of sub districts to the state and the state governments would then select the clusters following a set of indicated principles included in the Framework for Implementation. The mission aims to create 300 such Rurban growth clusters over the next three years, across the country. The funding for Rurban Clusters will be through various schemes of the Government converged into the cluster. To ensure an optimum level of development, fourteen components have been suggested as desirable for the cluster. The States would prepare Integrated Cluster Action Plans

for Rurban Clusters, which would be comprehensive plan documents detailing out the strategy for the cluster, desired outcomes for the cluster under the mission, along with the resources to be converged under various Central Sector, Centrally Sponsored and State Sector schemes, and the Critical Gap Funding (CGF) required for the cluster. While these were being implemented nationwide in varying degrees and progress with astounding successes, the state BJP lamented that certain pockets of the country lacked the pace of gradual implementation. In this regard, the BJP general secretary mentioned that the BJP Nagaland unit president Visasolie Lhoungu has also appealed the people and government to avail of these facilities for the overall development of the state.

Acharya on the occasion of ‘National Girl Child Day’ appealed to all social organisations, professional and commercial groups in Nagaland to sponsor girl children for education under Beti Bachao Beti Padhao Scheme. For this, a press note issued through the PRO Raj Bhavan stated that the Governor had opened a bank account in State Bank of India No. 35843617072, where a cheque can be deposited for Rs 2500 per year per child and to intimate Governor’s office by e-mail or over phone the sponsor’s name, number of girl child sponsored for education, bank details and date of deposit. Acharya in his message reminded that the National Girl Child Day was observed to reaffirm and protect the right of the child and to highlight to the citizen of Beti Bachao Beti Padhao programme. state TVC clarifies; cautions bootleggers DIMAPUR: Tsungiki Village Council (TVC) has clarified to the news item, ‘28 Assam Rifles seizes liquor in Wokha’ published on January 20 stating that the mentioned accused Renthungo Humtsoe is son of late Chumzamo Humtsoe of Humtso village and not Chumyamo Humtsoe as mentioned. A press note from TVC chairman, Pilamo Ezung stated that TVC has ascertained the name of the accused. It stated that the accused had also admitted that he was moving the illegal consignment towards Mokokchung for business purposes when his vehicle broke down. To escape notice, he admitted to have hidden the consignment at the go-down of a mill near Tsungiki Bazaar without the knowledge of the owner or Tsungiki villagers. Condemning the act, TVC cautioned that it would take prompt and proper action against defaulters as deemed fit. Tsungiki Village Council also informed all concerned that TVC would carry out surprise checks along the NH 2 passing through its jurisdiction and defaulters, if any, would be strictly dealt with according to the laws governing its village. Tsungiki Village Council has further lauded the prompt and appropriate action of 28 Assam Rifles in apprehending such bootleggers in the area.

DIMAPUR: GPRN/NSCN has mourned the demise of its deputy kilonser Yansamong Yimchungru, Ministry of Law & Justice, after a brief illness. Excise (MS) seize liquor DIMAPUR: Excise Mobile Squad Special Surveillance Team has seized a consignment containing 630 bottles of assorted liquor on January 23 from National Highway, Dimapur. In a press note by Superintendent of Excise Kahoto Sumi, informed that one person was arrested and charged under relevant section. Applauding the personnel, Kahoto asserted that, in addition to the normal duties, the Special Surveillance Team would remain vigilant to curb the illegal flow of liquor.

KMC directs

DIMAPUR: Kohima municipal council (KMC) as per the earlier notification has directed all the traders/shop owners selling tobacco products under Kohima municipal jurisdiction to put signage on their shops. However, despite of several reminders during checking, certain shops selling tobacco products have not adhered to the directives. In view of the above, seizure of licenses and other penalties would be enforced with immediate effect.

Information on Republic Day celebrations KOHIMA: In view of the 68th Republic Day Celebration at Secretariat Plaza Kohima on January 26, Kohima police would be enforcing the following traffic regulations as part of the security arrangement. According to Sr. SP Kohima, only vehicles with appropriate car passes would be allowed entry to the Secretariat Plaza, while parking outside the main gate of the Secretariat would be free for all public. No vehicles will be allowed to be parked by the roadside from 6 a.m. on January 26, at the following routes-- from BSNL telephone exchange till Classic Island; from Raj Bhavan till M.S Classic Island; from Classic Island till Assembly Secretariat via Razhü Point. Heavy vehicles will not be allowed to ply from High School Jn. to Assembly Secretariat via Sanuoru subway during the R-Day programme except government departmental buses. Heavy vehicles will not be allowed to ply in Kohima town till the end of programme. All loading and unloading of goods in Kohima town should be completed by 6 a.m. Heavy vehicles are also not allowed to be parked along the “D” Block road. DIMAPUR, JAN 24 (NPN): Two-day orientation programme on “educational management of children with intellectual disability” commenced here Tuesday, at DBIL, Don Bosco Higher Secondary School, Dimapur. The programme has been organized by National institute for empowerment of persons with intellectual disabilities (DIVYAGJAN) in collaboration with Sarva Shiksha Abhiyan (SSA) Nagaland. Speaking at the inaugural prog ramme, Commissioner Disability, Nagaland Dr. Atha Vizol informed that out of nearly 20 lakh people living in Nagaland state, it has a total population 29,631 People With Disability (PWDs) as per 2011 census. Briefing about the

various NGOs and inclusive schools institutions working with the PWDs, he said that primary school, Lerie Chazoi, Kohima was the first inclusive government school. D r. A t h a a l s o underscored the role of Churches and its importance to understand PWDs. He lauded the NGOs especially NBCC for taking the bold step in approaching disability in a “Christ like manner” and for declaring third Sunday of November, every year, as disability Sunday.

On the importance of spreading awareness, he said that the rights of PWDs should not be depressed or deprived. Lamenting on the lack of infrastructure of PWDs in the state so far, Dr. Atha said almost all institutions/ government departments were yet to implement disability Act and it was just a matter of time that a proper office will be set up to address the need of PWDs. He appealed the government to make effort to create Composite Regional

Centre (CRC) and other centres for empowering and looking into the needs of PWDs. Accordingly, Dr. Atha also informed that thirty government buildings were selected and access audited for accessibility Indian campaign project and the proposal for the project estimate has been sent to the ministry for approval already. He further encouraged the young generation of the state to take up specialization in the field of disabilities and contribute in making

history by turning Nagaland disability friendly state. DDEO R. Amongla in her short speech encouraged the par ticipants to be dedicated and be humble inorder to understand the needs of PWDs. She further encouraged them to deal with the children with special needs with care and love so that with their involvement they would be able to create a better life for PWDs in the days to come. DIMAPUR,JAN 24 (NPN):Eastern Naga National Government (ENNG) has Tuesday condemned the pre-planned attack on Assam Rifles convoy by the United Liberation Front of West Eastern South East Asia (UNLFW). The Naga people living in and around Nam Pawng, Arunachal and Pangsau, Namyung township areas usually celebrate Naga traditional culture festival in Nam Pawng town every year in January, and the attack on AR convoy was “carried out in order to disrupt the festival,” stated Khaung Waung Mossang, home minister, ENNG in a condemnation note. As a result of the attack, Naga people from Pangsau, who came to attend and those who wanted to attend the festival, are facing trouble as the Indian Army has blocked Pangsau pass, stated ENNG. ENNG also further warned that such anti-social act would not be tolerated by the people.

Dawki, Jan 24: Union Minister of State for Home, Kiren Rijiju laid the foundation stone for a Rs. 92.34 crore integrated check-post (ICP) at the India-Bangladesh international border here in Meghalaya to boost bilateral ties. “The ICP will generate employment opportunities and provide a major fillip to the economy of the state and the region. The ICP will strengthen the already good relations between IndiaBangladesh”, he said.

Dawki, about 85 Km from Shillong, is the largest trade route with Bangladesh. If she manages to get the Muslim votes along with the Jatavs, she may be able to

form the next government. But the SP-Congress alliance may keep the minority votes away from her. A loss for the BSP would prompt the BJP — and to some extent the Congress — to woo the Jatavs away from Mayawati. For the Congress, the prospects are likely to be better after the alliance with the SP. The other bright spot for Congress is that Priyanka is taking a more than active interest in the party’s work in UP. The clamour within the party that she should take up a post and even contest the 2019 general elections is likely to grow after these elections. Party leaders are hopeful she will accept if only to strengthen the hands of her brother Rahul. A loss for the BJP, which has upped the stakes in UP by claiming a repeat of the 2014 Lok Sabha polls where it won 71 out of 80 seats, would mean some dissenting voices becoming more vocal. Party chief Amit Shah, who still enjoys the full confidence of PM Modi and appears unassailable, may find some leaders and the RSS questioning his performance. Along with the rest of the country, Nagaland too, celebrates its 7th National Voters’ Day on the foundation day of the Election Commission of India that is 25th January 2017, in the state capital, all Election Districts and the sub-divisions under the theme ‘Empowering Young and Future Voters’. t would be unfortunate, if the current imbroglio between the state government and Naga women leaders on one side and Naga tribe organisations and civil societies, on the other side over the issue of holding elections to town and municipal councils fails to find middle ground so as to avoid an unwanted crisis that could lead to deep divisions within Naga society. The points raised by the Naga tribe organisations are not baseless as they have been around for a long time and so needed to be seriously addressed by the government. Addressing them does not imply surrendering to the demands but which would work towards bringing about a greater unity of purpose and understanding. At the same time, ignoring them would be detrimental to peace and harmony in society. The leaders of various tribe organisations are not ignorant or uninformed about the constitution as well as the legal aspects regarding Article 371A vis-a-vis tax and 33% women reservation. Granted that as per Article 243T and Part IXA, municipalities are to have 33% women reservation. However the issue is not questioning the operation of Article 243T and Part IXA but how it is rightly or wrongly, being seen as infringing upon another Article( 371A) under which the Naga people are insulated from any Act of parliament involving (I)religious or social,(II) Customary laws and procedures among others unless the state assembly by a majority vote. The responsibility of the elected members to provide adequate inputs on such issues and also enlighten and safeguard the people and their interests cannot be greater. The apprehensions stem from the facts as illustrated by lessons from other states where court interpretations have made societies feel betrayed. That is not surprising since lawyers and judges go by available facts of the constitution which are interpreted in as many ways as legally tenable. When the government of India included Nagaland under Article 371A along with other clauses in the 16 Point Agreement; it was a positive and magnanimous response to the desires of the Naga people for an alternative to peace and progress. Thus, the entire state comprising of sixteen tribes has been accorded special safeguard under the constitution to preserve and protect the way of life of the people. The issues that have come up were not unexpected but on hindsight, perhaps it could have been better handled so that differences of opinion did not create an unwholesome atmosphere. All stakeholders involved may have probably forgotten that in the end, the only option to resolve such issue was among themselves. Now, that Naga tribe organisations have issued a 3-day deadline expiring on January 26 on the government to defer elections to town and municipal councils, the confrontation will be inevitable since the government is determined to conduct polls. The state government has to take a major part of the blame for having pursued the directive in a bit of a haste after having made up its mind and the consultation held proved to be an academic exercise. For the government and the ruling party, the purpose of the civic polls may be politically expedient in many ways and so also for the few women leaders who felt they cannot be denied their constitutional rights now after having pursued it through court(s). Neither side can exist in a vacuum and it is hoped that better sense would prevail where humility and magnanimity brings unity of purpose.

Article 371 A in relation to Article 243-T of part IX A

take this humble opportunity to write for public consumption on the subject Article 371 A in relation to Article 243-T of Part IX A with the implementation of 33% Women Reservation. Commendable views and opinions from various walks of life have been expressed. However the reason as to why Government took such a decision to go for the ULBs election was poorly highlighted in the public domain. The Article 371 A is the only Special Provision for the Nagas inserted in the Constitution of India by the Constitution 13th Amendment Act.1962.The Special Provision is sacred, supreme and dear to the Naga people, the provision which does not required to be reproduce here. Now, the question arises who should implement the Special Provision and powers contend in the Article 371 A of the Indian Constitution in terms of legislation, executive, interpretation, governance, regulating and enforcement. The answer is founded in the Constitution itself. Only the Constitutionally constituted Authority alone can legislate, execute, interpret, govern, regulate and enforce the provision for the Naga people. Under the Constitution of India, the following constitutional established authority alone can implement the provision of Article 371 A. Firstly, the Union, that is the Central Government, i.e the President, Council of Ministers, both Houses of Parliament and the Supreme Court with all its machinery under their control, details of which forms Part V of the Constitution of India. Secondly, the State i.e the State Government of Nagaland i.e the Governor Nagaland, Legislative Assembly, the Council of Ministers and High Court with all its machinery details of which forms Part VI of the Constitution of India. Thirdly, the Panchayats which forms Part IX of the Constitution of India from Article 243 to 243-0 and by virtue of Article 243-’M’ (2) (a); the State of Nagaland does not apply. However, the Government of Nagaland by enactment of the Nagaland Village Area and Regional Council Act 1972- the Village level i.e, the village councils are the constitutionally established Authority at the local self Government level to implement and enforce the power contend in Article 371 A. Fourthly, the Municipalities which forms Part IX A of the Constitution of India from Article 243-P to Article 243-ZG. The state of Nagaland by the Municipal and Town Council Act 2001 with its amendment 2016 incorporating 33% Women Reservation is a constitutionally established Authority in the urban areas applicable to those towns which fulfills the criteria to be recognized as Municipal Council and Town Council. Fifthly, the Co-operative Societies which forms Part IX 13 of the Constitution of India from Article 243-ZH to Article 243-ZT. The Nagaland Co-operative societies Act (Amendment 2005). The various Co-operative societies have the power to resolve the disputes as per the provision of Article 371 A of

the Constitution 01 India. Therefore, to implement the power and functions contend in the Special Provision for the Nagas under Article 371 A of the Constitution, the constitutionally empowered established Authority for the time being is only the union of India, the state of Nagaland, the Village Councils of Nagaland, the Municipal and Town Councils of Nagaland, the co-operative Societies of Nagaland. Now the question as to why the government of Nagaland of the day decided to go ahead with the Municipal and Town Council election on 1st February 2017. The Municipal and Town council Act 2001 was enacted and passed. The Act was implemented by conducting election in 2004 in the entire state of Nagaland except for Mokokchung and the election were also conducted without 33% Women Reservation since the provision was not inserted in the Act. The Honorable Guwahati High Court in 2005 passed a judgement directing the State Government to implement 33% Women Reservation over a petition filed by a women candidate in Dimapur (East) Town Council. The State Government did not go for appeal and instead took up the act for Amendment in 2006 inserting 33% Women Reservation in the Municipal and Town Council Act 2001. Election was announced in 2009 with 33% Women Reservation, however the Naga Hoho and the tribal organizations objected and in the process not a single nomination was filed and the Government has postponed the election which was followed by various consultation with the Tribal Hohos, NGOs, Civil societies including various women organization. The state government have to find a way out to constitute the ULBs and nominating members was taken up, however it could not receive acceptance for proper funding from the Ministry and even the pressure to enforce High Court judgement has become a matter of great concerned. The state government in its effort to balance and to bring an amicable resolution with the Tribal Hohos and women group on the one hand and the High Court on the other resulted to passing a Resolution in the Assembly in 2012 whereby making Article 243-T of Part IX A not applicable to the state of Nagaland on the ground that it infringes Article 371 A of the Constitution of India. Consequence upon the Resolution in the Assembly, the women group challenge the Assembly Resolution in the Supreme Court through a Special Leave petition which was admitted and pending for final disposal. In the mean time, the Government Advocate in the Supreme Court are being honest enough to suggest that the arguments that Women Reservation of Article 243-T of Part IX A inserted by Constitution 73rd & 74th Amendment 1992 infringes Article 371 A does not formed a winnable argument and suggested that the best way out would be negotiate with the women group and bring about amicable resolution to withdraw the case. When

the Advocate fighting for the Government are not confident and feeling uncomfortable to argue, there is nothing much the state government could take the alternative approach to the issue. The Government on its part made several attempts with the women group as well as the Tribal bodies and when all these attempts failed to bring about amicable resolution to the issue, the Government is left with very limited options. Option 1: To wait for the Supreme Court judgement. This would mean the government could only resort to delay tactics and finally end up losing the case and in the process given away overwhelming power to the Court to interpret the limit of power of Article 371 A of the Constitution of India for wrong reasons and thereby eroding the Special Provision for the Nagas. This situation would also mean giving power to the court to enact and implement the provision in totality. Option II: To pre-empt Court decision by going ahead with the ULB election. By opting this Option-II the Special Leave petition in the Supreme Court will become infractious and it takes away the power of the Court to make any reference, observation, remarks pertaining to Article 371 A and thereby protecting and preserving the sanctity of Article 371 A. The Government had several round of discussion and opted for the Option- II to pre-empt the Court decision by bringing Amendment in the Municipal and Town Council Act 2001 by incorporating 33% Women Reservation through the Amendment of 2016 when all options to bring about amicable resolution failed. The Election Commission was accordingly asked to proceed with the conduct of ULB election. The Election Commission accordingly proceeded with the Notification for the conduct of the ULB election. This decision on the part of the Government is aimed at protecting and preserving the sanctity of Article 371 A and thereby avoiding any interpretation of Article 371 A by the Court for wrong reasons. As far as the Municipal and Town Council Act 2001 is concerned is already an existing Act and implemented. That means only 33% reservation for women is the issue. In this also going by the opinions and views expressed by the various organization, the issue is not very clear. Wether we are opposing women participation or against women presence in the decision making body. By suggesting that women should be given nomination even to the extend of voting right that means the women participation is not opposed. The women reservation is a National policy brought about by 73rd & 74th constitutional Amendment Act 1992 to empower women belonging to Scheduled Caste and Scheduled Tribe in Municipalities for a period of 10 years and further extended for a period of 10 years in 2012 and will end by 2022 unless further extended. Empowering women if the Nagas says is against religious, social customary practices, civil and criminal justice then what about MGNREGS Act which

provides 100 days Right to Employment to the citizens of the country. Right to employment envisage in this MGNREGS Act is not our culture, tradition, customary, social or religious practices of the Nagas as provided by Article 371 A. There are countless of such innovative policies and programme which does not enfringe Article 371 A but only empowers its citizens growth economically, so is the women empowerment, right to girls education, even establishing the Department of Women Development does not in any way infringes Article 371 A rather such an innovative and positive steps will only strengthen Article 371 A. Even the State Assembly is not the customary and social institution of the Nagas but by the Constitution 13rd Amendment Act 1962 the state of Nagaland with Special Provision under Article 371 A was created to promote, protect and preserve the religious or social practices, customary laws and procedures, administration of civil and criminal justice involving Naga Customary law, ownership and transfer of land and its resources, similarly the local self government are established in the villages known as Village Councils and in the urban municipalities by our own State Municipal and Town Council Act 2001 are known as Municipal Councils and Town Councils. In conclusion, Part VI of the Constitution of India with special reference to state of Nagaland; Part IX of the Constitution of India the Panchayats, for the states of Nagaland, Village Councils; Part IX A of the Constitution of India the Municipalities, for the state of Nagaland the Municipal Councils and Town Councils; Part IX B the Co-operative societies of the Constitution of India, for the state of Nagaland, the Nagaland Co-operative societies Act (Amendment 2005) and since the Nagas fall under the category of Scheduled Tribe Part X of the Constitution of India all these Constitutional Provisions are enabling provisions to strengthen Article 371 A when it comes to the Nagas and the state of Nagaland. Just going against the state government decision is not enough but as stake holders it is required to analyse and examine and the circumstances leading to the state government to make such a decision. The state government have taken several level of discussion with various stake holders and also within the government established set-ups to arrive at this decision approving the Election Commission to conduct election to the ULBs in the state of Nagaland. The process for conduct of ULB election is in progress and the completion of the process is now beyond the power of the state government to stop, postpone or defer except to allow the completion of the process by the Election Commission, by virtue of Article 243-ZG even the courts are barred from interfering in the electoral matters except by an election petition to the authority constituted as provided by law. Where is our conscience?

t is so disheartening to see many of the candidates who are adamant to contest the elections, defying the appeal made by the public—their voters. One tribe cannot say we will withdraw only if this or that tribe withdraws. Look at the best example of the Angami tribe-- they have shown exemplary sacrifice by making it a point that NO means NO, for which no one has filed nominations. What about the so called other tribes who only knows how to talk big. I feel the apex tribal bodies should all agree to pull up the candidates and ensure that everyone backs out from the elections. If not Nagas should disassociate itself with whichever tribe that fails to listen to the UNITED VOICE of Nagas. In case anything should happen during the elections—all those candidates should be held responsible. Another irony is that some near and dear ones of the leaders of Naga

National Political Groups are contesting the elections. Many may have forgotten the freedom struggle issue or cause and booted them out just for personal gains-- when most of the time it is called the “Indian elections.” Conscience should speak. On the other hand if all the apex tribes were so adamant to go against the ULB elections, why are the younger youths being allowed to jump into the vehicles and scream (so called campaign) till their last breathe whole day especially at night disturbing every neighbourhood. The youth organizations of respective areas should rather ensure that such elements are not allowed to be the stumbling block. My humble suggestion is that if at all the apex tribal bodies are extremely serious to oppose the elections, they should ensure that every candidate and every one roaming around the towns shouting as though they have just come

out from the zoo should be stopped or else it would be a better idea to lock yourselves up (apex bodies) at home and let the elections be held. This is a challenge which should be seriously and tactfully handled. If the apex bodies fail on such issues, when everyone is united, it would be the most embarrassing and total failure on their part and people would lose respect. Lastly, I would ask every individual what does Democratically elected mean? Does it mean by having quota in politics and depriving others. Isn’t it supposed to be free and fair and open to all. Reserving a seat this time and making it open the next time, what kind of a democratically elected body are we talking about. What ails Dhansiripar Sub-Division Public Organisation

T

o begin with, the Dhansiripar SubDivision Public Organisation (DSDPO) to the best of my knowledge was formed in 1996 with 28 recognised villages and then some unrecognised villages of the sub-division in its jurisdiction. At first when the DSDPO was formed, there had been another formation of DSDPO led by other group of people. Thus for few initial months, there had been two existence apex body of the sub-division. This has made the public confused and the two drawn to loggerheads. Sensing this estrangement and in the interest of the public, the then SDO (C) of Dhansiripar C.K Nihekhu’s intervention was sought and the matter was amicably resolved. Thence to that, the DSDPO founded by Y. Hekiye Swu existed as legally permitted organisation. Ever since its formation, this DSDPO regulated itself with its terms of office bearers and enjoys the public mandate. Therefore besides the present DSDPO president, There had been four former presidents to have led the DSDPO in each of their own respective terms of office bearers. Among those four, two have already paid the debt of nature, late Viqhuzhe Shohe and late Minsit Jidung. The stance of this multi-tribes apex body is kept in DSDPO in keeping delivery of public services, co-ordination and maintaining peaceful co-existence among the member tribes. To give an instance of its past public service, the NST bus service extension into our Dhansiripar sub-division is none other than the DSDPO demands for the same. Similar demand for the public needs like road amelioration, bridges construction, office creation and upgradation can be met only through the public apex body in a concerted manner of our own demands. The public needed to give the strengthen hands of the administration through this public apex body. The general public needed to retrospect, how the DSDPO as an apex body of the sub-division had taken steps in the past for the development like public representation to the several authorities and competent offices indicating our desires of better health care, educational institutions, better road connectivity of the sub-division, Dhansiri bridge construction, irrigation facilities in the sub-division etc. It’s a resolution was regulated in the public domain in active participation of village administration in some notable villages. Somewhere the DSDPO has also taken bold steps to defend the public interest which are still fresh in minds of the public. This Dhansiripar sub-division is in need to see itself for SDO (C) office up gradation to that of ADC Head Quarter like in other place. The fire brigade station, treasury office, SBI Bank Branch etc, are in grave need of the public of the Dhansiripar sub-division. However, the public apex body of the Dhansiripar sub-division is in its deep hibernation. In earlier by gone terms of the office bearers of the DSDPO, it has done some tangible jobs of its own land in the Manglumukh, Dimapur main road touched and completed construction of office building of its own in its official headquarter Dhansiripar. This laudable job of public interest should be taken as an illustrious proof of selfless services done by the doyens of the DSDPO and emulates us to work for the public services. But, however what is ironic of state of affairs is that, the present team of office bearers/ DSDPO official is given itself of its executive/official functioning at a grinding halt in its entirety. What is more irresponsible that this can be had with us all to allow like this without resorting to constitutional remedy to dissolve or select/ elect office bearers afresh? I therefore take this opportunity to appeal sincerely to the concerned elders, respective tribe/community leaders, GBs, Villagers of this Dhansiripar sub-division to see that this DSDPOP is survived for the welfare, development, public services and peaceful co-existence of this mini Nagaland-sub-division in as much this different tribes and community lives in our Dhansiripar sub-division. Targeting Congress Vice President Rahul Gandhi, Rajnath Singh blamed Pakistan for supplying drugs into India. “There is this young Congress leader, who celebrated New Year in a foreign country, calling Punjab youth as addicts,” said the Home Minister referring to Gandhi’s earlier remarks that 70 per cent of Punjab youth were addicted to drugs. “I admit our neighbouring country Pakistan constantly endeavours to smuggle drugs to India to destroy the Indian youth. But I want to assure you that if you bring the BJPSAD to power in Punjab we will take to task all those who indulge in this. “From drugs to terrorism, Pakistan has been constantly engaged in its bid to destabilise India. But I am here to warn Pakistan that get rid of

all these habits or else we have already shown what we can do. “Our armed forces have already proved that if the need be, we can cross the line,” he said referring to Indian Army’s September 29 cross-border surgical strikes. Flaying the Congress over corruption, Rajnath Singh said: “It has been more than two and half years of the Narendra M o d i g ove r n m e n t a t the Centre, but even our staunchest critics cannot bring corruption charges against us.” “The Congress which indulges in corruption is now asking for votes. Viral video shows Chennai JNU students refuses to take police setting fire to an auto lie detector test in Najeed case

C HENN A I , J A N 2 4 (AGENCIES): A day after Chennai witnessed peaceful protests on Jallikattu turning violent, a video has emerged that purportedly shows policemen committing arson. Tweeted several times, the video shows a police constable inserting a bundle of burning newspapers into the back of an auto. Actor Kamal Haasan, who has been a vocal supporter of Jallikattu, tweeted the video seeking an explanation. The authenticity of the video, that also did the rounds on WhatsApp, could not be verified. According to a report in News18, the video was allegedly telecast on News18 Tamil after it was sent in by a viewer. The report also says that the area where the video is taken seemed to be Mylapore, that is close Marina Beach where the initial protests were taking place. However, the Chennai police has denied reports of arson against its officers. When the video was brought to the notice of police officers, one K Shankar told NDTV that action

would be taken if found guilty. Meanwhile Mylapore deputy commissioner told News18, “We are looking into the veracity of the video. We are shocked... We will take action against the policeman if it’s true.” However later, during a press conference the police alleged that the video had been morphed. Police commissioner S George, according to The News Minute, said that, “We must look into the hidden motive behind this video. The video will be probed by the multimedia department.” George, had in a news conference also said that the police did not use force on protesters. Thousands of police personnel were deployed across Chennai on Monday, a majority invading the beach and dragging away young men who had been camping there demanding legalization of Jallikattu. Many of the protesters, after being ousted from the beach, took over neighbouring streets and hurled bricks and stones at police.

New Delhi, JAN 24 (AGENCIES): After nine Jawaharlal Nehru University (JNU) students who had been served notices to join the probe into the disappearance of Najeeb Ahmad, failed to show up for the lie detector test, the Delhi High Court told them to not feel insecure and come forward to take the test. According to the Indian Express, a division Bench of Justice G S Sistani and Justice Vinod Goel said, “If some person is given notice, he should come forward and he can deny or accept that allegation. No one should feel insecure. One should be bold enough to appear and

go through the tests if there is nothing to hide.” This was after Advocate Rahul Mehra, appearing for the Crime Branch of the Delhi Police, told the division bench, “Since the students did not come forward for interrogation it raises doubts in the mind about their involvement.” During the hearing, according to an IANS report, one of the nine students approached the court and alleged biased investigation against them and sought a fair probe into the case. The Indian Express reported that lawyer Sidharth Luthra, appearing for JNU student Sunil Singh, told the

court that the students could not be forced to take lie detector tests without consent. However, Advocate Mehra told the court that the Crime Branch had been probing the matter responsibly. “Had we been biased we would have put them behind the bars,” he said. “We are a responsible force, don’t force us to do something we don’t want to do,” Mehra added. “They should join the investigation. They should come forward if they have nothing to hide and come out clean. For more than three and a half months we are handling it responsibly. If you (nine students) are so honest then come and join investigation. Many notices have been issued to them.” Najeeb Ahmad, 27, a first year M.Sc. student, went missing from his hostel on JNU campus on the night of 14-15 October last year, allegedly after a row with fellow students who were members of the RSS student wing, the Akhil Bharatiya Vidyarthi Parishad (ABVP). The next hearing on this matter is on 13 February.

New Delhi, Jan 24 (IANS): The cabinet on Tuesday approved a new housing scheme to provide interest subsidy for loans up to Rs 2 lakh for construction of new houses or renovation of existing ones in rural areas. The decision to improve “housing stock and create employment opportunities in rural housing sector” was taken at a cabinet meeting here chaired by Prime Minister Narendra Modi, an official statement said. However, the scheme will not be extended to those who have already availed benefits under a similar programme, the Pradhan Mantri Aawas Yojana-Grameen (PMAY-G). “The Union Cabinet has approved a new scheme for promotion of rural housing in the country. China new ‘Two Child’ policy increases births by 7.9% BEIJING, JAN 24 (AGENCIES): In late 2015, China announced an end to its infamous 35-year-old “One Child” policy, which was aimed at curbing the exploding population of the nation of more than 1.3 billion people. Now, the initial data on the experiment to allow married couples to have two children has come in, and the Chinese government is touting it as a success. According to the Communist Party’s National Health and Family Planning Commission (NHFPC,) there were 17.86 million births in China last year, an increase of 7.9 percent from the previous year. “It demonstrates that the universal second-child policy came in time and worked effectively,” said Yang Wenzhuang, a division director of the NHFPC in a press release. Like many countries with a low birth rate, China was concerned about how to care for its aging population, as there were a dearth of young worker to help support them, as well as a gross gender imbalance, because so many female babies were abandoned or aborted in the patriarchal society. Melbourne, Jan 24 (Agencies): Four-time champion Roger Federer coasted into the Australian Open semi-finals with a straight-set defeat of unseeded Mischa Zverev in 92 minutes. The 35-year-old reached the last four in

D imap u r , J an 2 4 (NPN): The 9th Open Volleyball Tournament, organized by Falcon Club, was held at Mangkolemba from January 18-20 under the theme ‘Strengthen, Resolute and Excel.’ Mangkotsürong Sporting Club ‘B’ of Nokphu emerged as the champion after defeating Thor Clan Club of Mangkolemba.
