TR Zeliang wins trust vote 47-11

Kohima, Jul 21(NPN): Between numbers and legality, the crisis within NPF legislature wing, which had spilled over to Raj Bhavan, the High Court and finally at the Legislative Assembly, ended when numbers prevailed to give chief minister T.R. Zeliang victory by 47-11 on July 21, 2017 but under controversial circumstances. The 47 included--36 NPF, 7 Independent and 4 BJP. The 11 included 10 NPF and 1 Independent. One seat remains vacant. The house had earlier met on July 19 for a vote of confidence but it did not take place as deposed chief minister Dr.Shürhozelie Liezietsü and eleven loyalists did not turn up. After chief minister T.R.Zeliang moved the confidence motion, nine out of eleven loyalists of NPF party president Dr.Shürhozelie Liezietsü attacked the manner in which the Speaker recognised appointment of T.R.Zeliang as Chief Whip and issuing a notification. They also raised issues about the legality of the motion moved by Zeliang as he no longer was NPF member

after his expulsion on July 19,2017. In the July 21 session, there were two NPF WhipsKiyanilie and T.R.Zeliang and two leaders of the House- T.R.Zeliang and Kuzholuzo(Azo)Neinu, while T.R.Zeliang was expelled from NPF. Spearheading the attack, former Speaker Chotisuh Sazo asked Speaker Dr. Imtiwapang Aier when was NPF Chief Whip Kiyanilie Peseyie removed as the Whip and under what rule?. It may be mentioned that a Whip is only appointed by the party and this is officially notified in the gazette by the Assembly Secretariat. Kiyanilie was officially appointed by the NPF party on November 14,2014 and notified by the NLA on November 15,2014. Sazo also did not spare the Governor P.B. Acharya whom he accused of violating rules governing conduct of the house under the constitution of India especially summoning the house on Wednesday. He also said the Governor violated the convention by summoning the house within two days . He explained that as per rules of

procedure and conduct of business, no assembly business is ever conducted on a Wednesday as it has always been a non-transaction day for the state assembly as well as Parliament. Also, as per convention, he said at least three days time was given to members for attending the assembly. He also disclosed even on the day of the session, none from among the 11 MLAs had received any official intimation about the July 21 session summoned by the Governor. He said the “undue haste in summoning the assembly was partisan and unconstitutional.” Sazo described the dismissal of chief minister Dr. Shürhozlie by the Governor on July 19 on the day of the court verdict, as “unfair, undemocratic, arbitrary and lacking logic” and for which he opposed the motion for confidence moved by chief minister T.R.Zeliang. Also taking part, Yitachu said Zeliang could not move a no confidence motion against his own party chief minister so resorted to all unconstitutional means—“to do indirectly what he could not be done directly”. It also reminded the governor that the official whip of the NPF, recognised by him since 2014 and had effect on February 5, 2015 when the then chief minister called for a vote of confidence, continued to be the sole and authorised whip of the NPF. Don’t protect vigilantism: SC to Centre, states

NEW DELHI, JUL 21 (PTI): The Supreme Court Friday asked the Centre and the states not to protect any kind of vigilantism and sought their response on violent incidents of cow vigilantism. A bench headed by Justice Dipak Misra was informed by the Centre that law and order is a state subject but it does not support any kind of vigilantism in the country. “You say that law and order is a state subject and states are taking actions as per law. You don’t protect any kind of vigilantism,” the bench, also comprising A M Khanwilkar and MM Shantanagoudar, said. It also sought the assistance of the Centre and states for removing violent content related to cow vigilantism uploaded on social media. “Law and order is a state subject and Central government does not have any role into it. However, Union of India is of the view that no vigilante group has any space in the country as per procedures of law. It does not support any kind of vigilantism by private persons,” Solicitor General (Cont’d on p-8) Ranjit Kumar said.

Responding to the questions raised by the legislators opposed to him, chief minister, T.R Zeliang reminded them that “a minority group cannot run the government.” He further pointed out that nowhere in the NPF party’s Constitution has been mentioned about the procedure of appointing the Chief Whip by the Party by the president. While making it known that the word “whip” has not been mentioned in the NPF constitution, Zeliang demanded to know under which para, clause was the NPF president authorized to appoint the whip. Zeliang clarified that he was elected as the NPF legislature party leader on May 17, 2014 and since then no NPF legislator was elected as the legislature party leader even after he resigned as CM on February 19. Zeliang however said that he never resigned as the legislature party leader. On the issue of being expelled from the party, Zeliang said even though he was expelled, he will still continue to be an NPF legislator in the house

NPF expels 19 MLAs from party and suspends 10 others D IMA P U R , J UL 2 1 (NPN): In another political development, NPF’s crisis further deepened on Friday after 19 legislators were expelled from the party “indefinitely” and another 10 legislators suspended from the party with immediate effect. NPF working presidents-- Huskha Yepthomi and Apong Pongener in the order stated that based on the recommendation of the Disciplinary Action Committee (DAC), the following legislators were expelled from the party indefinitely. (See Table) The order stated that the DAC, during its meeting on July 21, re-examined the activities of the 19 members and found that they had directly violated the Constitution of the NPF by demanding the resignation of the NPF president without any basis. They also violated the party Constitution by defying the Whip on the floor of the house on July 21, 2017. The listed members have been expelled since the party has come to the conclusion that the members were involved in anti-party activities and singularly aimed at

It said that the following members had also directly challenged the NPF constitution by demanding the resignation of the party president, saying it was “a clear case of anti-party activities.” NPF said that the members had also violated the party’s constitution by going against the party whip on the floor of the house on July 21, 2017. With this only five NPF legislators (excluding Speaker) in support of T.R. Zeliang has been spared by the party.

ZOAN reacts DIMAPUR, JUL 21 (NPN): Zeliang Officers’ Association Nagaland (ZOAN) has expressed pain at the statement of ASTD president, Supu Jamir that anybody except T.R. Zeliang was acceptable as chief minister. ZOAN secretary, Dr. Hiabe Zeliang, ZOAN said it appeared to be like a politically motivated statement not expected from a responsible organisation like ASTD. He said T.R.Zeliang returned as CM after fulfilling all norms with overwhelming support of MLAs including 11 Ao MLAs. ZOAN said there has been no history of sore relationship between Aos and Zeliangs since time immemorial and such a statement by “few vested interest persons like Supu Jamir” could incite the sentiments of the peace loving people. ZOAN advised ASTD to refrain from using “provoking statement”, which could damage cordial relationship that Zeliangs and the Aos enjoy.

Flood relief camp setup at DDSC stadium D IMA P U R , J UL 2 1 (NPN): To address the flood situation in Dimapur, the district administration has designated DDSC Stadium, Gologhat Road as relief camp for flood victims. According to an official bulletin, the Dimapur District Incident Response System (IRS) has been formed with DC Dimapur, Kesonyu Yhome, as the RO and ADC Dimapur, Sara Jamir, as the incident commander. IRS structure had been divided into operation sector, transport branch, logistics and shelter unit, food unit, medical unit and evacuation unit. Officers from various departments and DDMA members have been assigned to take care of their respective units. DC Dimapur has directed all the sections for setting up specific units immediately. IRS team led by ADC Dimapur, Sara Jamir, also

visited various flood affected areas and food stuff and offered monetary assistance. Ekhoyan (Domokhia) Rs. 84,000, Naharbari Rs. 50,000, Toulozhuma Rs. 50,000, Nepali Kashiram Rs. 40,000, Thahekhu Block VII Rs. 50,000, Thahekhu village Rs. 50,000, Kushiabill Rs. 50,000 and Seithiekema Rs.50,000. It was informed that remaining affected areas would be paid on July 23. Food unit of Dimapur district Incident Response System (IRS) distributed food items including rice, dal, potatoes, salt and mineral water to the displaced people camped at Naharbari and Ekhyo Yan (Domokhia) July21, 2017. The 32 Assam Rifles also distributed food packets to the flood affected victims at Ekhyo Yan. Meanwhile, DC Dimapur, Kesonyu Yhome, has informed all responsible

public/NGOs to contact SDO (C) Nyempo Wallim (9612921898) and EAC (8575872575) at the emergency centre (EOC) for any assistance/donations towards the flood victims. DC also notified that safe drinking water facilities would be available at DDSC Stadium from 10am onwards for flood affected people. Similar facilities would also be available at Burma camp and Dhobinala on July 22 from 7am to 8:30am In this regard, DC has informed all concern to report to designated locations for delivery of services in providing safe drinking water: police/home guard &DC at DDSC Stadium (10am), 173rd Bn CRPF at Burma Camp (7am to 8:30am) and 32 Assam Rifles at Dhobinalla (7am to 8:30am).
