KOHIMA, JUL 6 (NPN): Human Rights Law Network (HRLN) Nagaland chapter in addition to the 20 PILs filed against department of health and family welfare last year has filed eight more PILs against the department in the Gauhati High Court on July 5. Eight PILs filed were on District Hospital Dimapur; CHC Sanis town Wokha; PHC Thonokyu and Tuensang; PHC Sakraba, Thiphuzu and Phek, PHC Piphema, Pherima and Chumukedima; sub-centre Kuisam under Kiphire, sub centres Khuzama, Bayavu, Jotsoma under Kohima and sub centre Meriema, Thizama, Chiedema under Kohima. Speaking to media persons at a press conference here Wednesday, one of the petitioners in the NRHM case, activist and academician, Rosemary Dzuvichu, lamented that PILs had been repeatedly filed against the H&FW department, but the department has been asking more time and failed to submit their replies to the court till now. She said that in yesterday’s hearing, the petitioner’s lawyer appealed to the judge that if the trend of asking for more time continued, the petitioner would ask the errand officers to be summoned to the court. Dzuvichu said it was “very unfortunate” to litigate and ask for people’s right to health especially women’s right to reproductive health services.
NSCN (R) busts illegal stores selling PDS rice DIMAPUR, JUL 6 (NPN): NSCN (R) on Wednesday claimed that its town command and Konyak region on July 5 busted “illegal stores” selling public supply rice (PDS) in Mon. In a press note, NSCN (R) MIP alleged that the stores were being “run by some kingpins and few staffs of Civil Supply department posted in Mon Hq.” In this regard, NSCN (R) has asked the directorate of Food and Civil Supply “to investigate the activities of their staff posted in Mon. NSCN (R) said rice meant for poor public were being stolen and sold to “non local businessmen shops and illegal stores for the last more than 10 years”. Such illegal activities involving department staffs have denied the real beneficiaries to avail their share under BPL, APL and AAY. It said that the town command and Konyak region personnel carried out surprise raid on all the three illegal stores and seized huge quantity of rice which was later handed over to the police for further investigation. Stating that the gravity of the crime was “too high”, MIP said the NSCN (R) would simply not excuse the main culprits, but initiate severe action against the three shops. Meanwhile, NSCN (R) has warned that any shops found selling rice meant for the poor public would be closed down permanently.

She informed that the matter has been followed up with the state government to constitute at the earliest. One of the petitioners who filed SLP in the Supreme Court with regard to the alleged embezzlement of Rs. 68 crore under NRHM Nagaland, Dzuvichu said that
the Supreme Court has made the central government and CBI as respondents to the case and the date of hearing was awaited. Underlining that NRHM scam involved “kickbacks and not only looting from office”, she said the case has become “complicated” because it was to do with the tenure of the previous state health minister. Dzuvichu, who is also advisor of Naga Mother’s Association (NMA), said that the Joint Action Committee on Women Reservation (JACWR) was ready for contempt petition in the Supreme Court for non-implementation of the Supreme Court order for implementation of 33% reservation for women. She said that the committee had also held a series of meetings with the legal advisor to the Election Commission of India in Delhi. ANSTA Mangkolemba demands posting of HA at SDEO office DIMAPUR, JUL 6 (NPN): All Nagaland School Teachers’ Association (ANSTA) sub-unit Mangkolemba has appealed to the department of School Education to immediately post head assistant at sub-division education officer (SDEO) office, Mangkolemba under Mokokchung district. In an appeal to the director of school education, the ANSTA sub-unit Mangkolemba president Senlikaba and general secretary Tsungdar said that the office of SDEO, Mangkolemba was going through crisis owing to “utter disregard and disobedience” of government order by one head assistant (HA), who have not joined office/duty till date. They said the HA’s order for attachment at DEO’s office, Kiphire was cancelled on May 23, 2016. However, after a lapse of one and half month, the HA was still to submit even his joining report in the SDEO office, Mangkolemba. Further, sub-unit stated that he was
transferred on promotion to SDEO office Mangkolemba on June 1, 2015 after signing an undertaking wherein HA promised not to apply for transfer for three years. They said he submitted his joining report to SDEO office Mangkolemba on June 5, 2016, but did not attend office even a single day. Expressing surprise as to how a government employee could stay away from duty for more than 10 consecutive months, ANSTA sub-unit has sought answer from the director of school education. It urged the school education director to take disciplinary action against the erring HA as failure to initiate action would lead to many such problems in future. The subunit also requested director to send one HA to SDEO office Mangkolemba immediately. They cautioned that failure to address the appeal would “attract repercussion from us and we will not take responsibility for any eventuality.”

She said the case had nothing to do with the politics of the state, but with “academics and what is wrong in the society”. Informing that the lawyer of the respondent has been continuously asking for more time to reply, she said that during the last hearing on June 27, the council for the respondent said that “they had appealed to the session judge for transfer of case” and told the district judge that they did not expect justice from the judge. Dzuvichu said that since the respondent could not produce stay order, the district judge continued hearing on “condonation of delay” filed within the limitation time and the judgment was reserved. She said the next hearing was listed for July 8 in the district court Kohima. Dzuvichu said the petitioner would oppose the stay order and transfer of case as it had no relevance on the case. She said second part of the case was the criminal complaint on the fake certificate. Dzuvichu said that in a copy served to the petitioner and submitted to the session judge “on why the respondent wants the case to be transferred”, the respondents had alleged that the petitioner was politically motivated, used by both the congress and NPF.

KOHIMA, JUL 6 (NPN): As part of the phase-1 agitation, the Nagaland Law Students’ Federation (NLSF) would stage sit-in on July 7 from 10am to 12noon in their respective law colleges across the state to express resentment towards state government’s “lackadaisical attitude” in setting up Government Law Colleges in Nagaland. The federation has demanded the state government to set up government law colleges and to give equal importance to the subject of law on a par with other professional studies in the state. Meanwhile, Kohima Law college students’ union (KLCSU) president Vitoka K Aye and general secretary Medochutuo Kiewhuo informed that the union would hold dharna at its college near Raj Bhavan road with the rest of the other students of the state from 10am to 12 noon.
Girls trafficked from Delhi; CM urged to act PANAJI, JUL 6 (IANS): An anti-trafficking NGO in Goa has urged Delhi Chief Minister Arvind Kejriwal to act against an organised trafficking network in the national capital involved in trafficking girls and women for commercial sexual exploitation to Goa. In a letter to Kejriwal, Arun Pandey of Anyay Rahit Zindagi (ARZ) has said that a large section of the girls and women rescued from “massage parlours” in Goa were trafficked from Delhi after being picked up from states like West Bengal, Assam, Nagaland and Manipur by promising them well-paying jobs. “We believe that trafficking cannot be controlled unless there is collaboration between government and non-government agencies in source, transit and destination areas,” the letter said. “The agencies in source, transit and destination needs to exchange information, and collaborate to prevent trafficking; protect and rehabilitate those who are trafficked and prosecute those involved in trafficking of girls for commercial sexual exploitation,” Pandey said in his letter to Kejriwal. ARZ is a nodal agency appointed by the anti-human trafficking unit of Goa Police and is involved in debriefing and counselling women rescued by the police in raids on brothels and massage parlours, many of which according to Pandey, masquerade as prostitution hubs.

Oil adulteration racket kingpins are also SK oil agents: ACAUT DIMAPUR, JUL 6 (NPN): Media Cell of ACAUT Nagaland expressed shock that out of six alleged kingpins of fuel adulteration three were also SKO agents such as- Dinanath, Srikanth and Umesh who were operating under Power of Attorney. Citing sources with the F&CS department, ACAUT said SK(Superior Kerosene) oil were “awarded” to these same persons “ for decades” without transparent and open tendering process. Due to it, ACAUT said, it was not surprising that out of 14 lakh litres of SKO issued as monthly quota to Nagaland, several lakh litres were diverted to black market
and utilized for adulteration of fuel. Highlighting its point, ACAUT provided the following table of list of SK Oil agents in Nagaland. (See table) Further, ACAUT pointed out that the pumps /fuel outlets were also distributing points for SK Oil and in most cases, fuel outlet owners end up as SK Oil agents. Also clarifying on the issue, ACAUT Nagaland said Lalmohan, who is proprietor of five petrol pumps is not the owner of any of the six fuel adulteration units busted on June 27 and so there was no reason to believe that his outlets were selling adulterated fuel “unless proven oth-

SRF activists surrender before KU DIMAPUR, JUL 6 (NPN): Konyak conclave involving Konyak Union (KSU), Konyak Students’ Union (KSU) Konyak Nyupuh Sheko Khong (KNSK), after holding a series of meetings on Sovereign Republic of Freeland (SRF) issues, had on July 5, 2016 meeting at Mon town “finally and peacefully settled the issues”. In a press release, KU president Manlip Konyak and assistant general secretary M. Sheiching Konyak said the meeting “successfully culminated” after the two main Sovereign Republic of Freeland activists “accepted to surrender unconditionally” before the KU. The two have been identified as Hejei Konyak, son of Mankang Konyak of Chen Moho village and Panglei Konyak, son of Longpai Konyak of T/ Chingkho village. According to KU, the “act of pledge” was witnessed by both the presidents of Totok Chingkho union and Chen area union. The union
stated that another two enrolled members L. Langjun Konyak, son of late Longshah Konyak and Wanpa Konyak, son of late Tonching Konyak hailing from Chi village had voluntarily surrendered before KU. I n th i s r eg a r d , th e Konyak Union has welcomed the “right decision undertaken by the four renegades” and returning in to the established institution of the Konyak society. KU, on behalf of all the Konyak frontal organizations, has also extended “deep regrets and apology” for the “infliction of trauma” caused upon the innocent family members and villagers of the “two precious Konyak souls” while on its quest for safeguarding the interest of the Konyak under “one uniform code”. The Konyak Union at the same time has directed all the village councils to immediately “clear out” their report on the involvement of its citizen in the SRF. It

DIMAPUR, JUL 6 (NPN): Nagaland Government Registered Class-I Contractors Union (NGRC-I CU) has fully backed ACAUT Nagaland on the issue of fuel adulteration racket busted recently and reaffirmed that ACAUT’s allegation was a “fact” and “True”. Stating this, NGRC-1 CU president Seyiekuolie and general secretary L. Phukharo Shohe asserted that contractors suffered most when engines of vehicles and machineries including tipper trucks, JCB and latest machinery and equipments used in construction last for hardly seven years instead of 15 years due to adulterated fuel. They also said while a litre of fuel gave 16 kilometers mileage, adulterated fuel gave only 10 kms and kerosene in adulterated fuel causes engines to seize. It also referred to a letter written by the ministry of Petroleum and Natural Gas on January 4,2016 to all chief secretaries and administrators, that there was evidence that some part of Kerosene allocated were being diverted. The union also pointed out that there had been a major increase in power supply to villages and so under the ‘Give Back” scheme of the government of India, nearly 50 lakh LPG connectioins were released to the poor . Such measures had reduced demand for kerosene for lighting and cooking purposes. The Union opined that such a scheme indicated a potential for Direct Benefit Transfer(DBT) for genuine beneficiaries and preventing illegal diversion.

NEW DELHI, JUL 6 (AGENCIES): The Centre has set up a committee to examine the feasibility of changing the financial year from its existing April-March cycle. The committee will examine if there would be any benefit in shifting to a different cycle and report its findings by December, the Finance Ministry has said. The committee will be headed by former CEA Shankar Acharya, and will include former Cabinet Secretary KM Chandrasekhar, former Tamil Nadu Finance Secretary PV Rajaraman and Rajiv Kumar, a fellow of the Centre for Policy Research. The Finance Ministry in a notification said the committee would examine the “desirability and feasibility” of having a new financial year cycle. The committee will have to provide a reasoning for its recommendation, from the point of view of correct estimation of the receipts and expenditure of the Central and state governments. The committee would also have to state the likely effect of its recommendation on the different agricultural crop periods and the relationship of the financial year to the working season. Besides, the committee will also have to
analyse its impact on businesses, taxation systems and procedures, statistics and data collection and the convenience of the legislatures for transacting budget work. The committee will further have to provide the government with the genesis of the current financial year and the studies made in the past on the desirability of change in financial year. “The Committee may, after due examination of all relevant factors, recommend the date for commencement of the financial year which in its view is the most suitable for the country,” the notification said. In case a change in the financial year is recommended, the Committee may also work out modalities for effecting the change, which would include appropriate timing of change, determination of a transitional period, the change in tax laws during the transitional period. It will also have to work out modalities for the amendments that may be required in various statues and changes in the coverage of the recommendations of the Finance Commission. The committee may interact with experts, institutions, and government departments for framing its report, the notification said.
‘Comprehensive consultations needed on UCC’ NEW DELHI, JUL 6 (IANS): New Union Law Minister Ravi Shankar Prasad said on Wednesday that “comprehensive consultations” were required before taking steps towards a Uniform Civil Code (UCC). Prasad made the comments after taking charge of the Law Ministry following the Tuesday reshuffle by Prime Minister Narendra Modi of the council of ministers. He said there would be “comprehensive consultations with all the stakeholders” before moving towards the UCC. Pointing out that right now the issue of UCC was being examined by the Law Commission, Prasad said Article 44 of the Constitution mandated a common civil code. Article 44, under the Directive Principles of State Policy, says: “The State shall endeavour to secure for the citizens a uniform civil code throughout the territory of India.” Describing himself as an “old hand” in the Ministry of Law and Justice, Prasad said this was his third stint, first being as a Minister of State in the Atal Bihari Vajpayee government and then when Modi took office in May 2014. He said the government favoured strengthening the justice delivery system, transparency in the appointment of judges and their fast tracking, upholding the independence of judiciary and working in harmony with it and granting citizenship rights to Hindu migrants from Bangladesh. Dismissing any confrontation with the judiciary on framing a procedure for appointing judges to the higher judiciary, Prasad said the appointment of judges should be quick and done in a transparent manner. People “competence and integrity” must occupy the high judicial positions, he said. “I don’t contemplate confrontation on the drafting of the memorandum of procedure for the appointment of judges. We look forward to work in harmony.” Responding to a question on judicial activism often flagged by Finance Minister Arun Jaitley, Prasad said an independent judiciary was an important facet of the State.
