NSCN (I-M) on taxation issue

DIMAPUR, JUN 17 (NPN): Speaking up on taxation issue, NSCN (I-M) on Friday said that the “belligerent attempts to belittle the wicked nexus between the naturalized Naga citizens who hold the core position of the organization and the Indian intelligent department will not make any difference no matter how tactfully the hidden truth are camouflaged in front of the public.” In a press note, NSCN (I-M) MIP said that the deliberate attempt of ACAUT to “sabotage” the very foundational principle of the Naga government on taxation, and the mischievous collusion with the adversary had become a matter of great urgency to act in unison. 2002 Gujarat massacre CASE 14 YEARS AFTER

11 get life in jail for killing 69

AHMEDABAD, JUN 17 (IANS): Fourteen years after 69 people were massacred at a Muslim housing society here during the 2002 Gujarat riots, an Ahmedabad court on Friday sentenced 11 of the 24 convicts to life in prison, one man for 10 years and 12 others for seven years. The quantum of punishment by the special court disappointed Zakia Jafri, the wife of Ehsan Jafri, a former MP who was among those brutally attacked and later burnt in the February 28, 2002 mass murder. Pronouncing the punishment in a packed courtroom, Special SIT Court Judge P.B. Desai dubbed the day of the killings at the Gulberg Housing Society “the darkest day in the history of civil society”. But he rejected the prosecution’s request to treat it as a “rarest of rare” case. Judge Desai refused capital punishment to the convicts as sought by the prosecution and advocates for the victims saying it was beyond his court’s jurisdiction. The prosecution had argued that those murdered, including women and children, were all innocent. The judge also said he would not write in the verdict that those convicted of murder and sentenced to life must

(PTI) be kept in prison till their last breath in view of their good conduct while on bail and in jail. The government had the right to remit the life sentence after 14 years if it wished to, but Judge Desai appealed to it not to invoke the provision. The court earlier turned down the conspiracy theory in its verdict. The one who got 10 years in prison was convicted of attempt to murder and 12 others, including Vishwa Hindu Parishad (VHP) leader Atul Vaidya, were held guilty of rioting and arson and given seven years in prison.

The families of the victims said their fight for justice had not ended. Zakia Jafri said she was a witness to the “brutal” killing of her husband. “They stripped him, chopped off his limbs and burnt him alive on the street. Is this the punishment for that brutal killing?” asked the 78-year-old woman who has been fighting a lengthy legal battle for justice. Indicating she would approach the higher court, Zakia said she would talk to her lawyer for the next step. Civil rights activist Teesta Setalvad said it was

a “diluted and weak” judgment and vowed to appeal against it. “Eleven people were given life imprisonment since they were convicted in serious offences. But the biggest disappointment for us is the rest of the convicts, including 12 given seven years of imprisonment,” she said. The ruling Bharatiya Janata Party called the judgment a “victory of truth”. Cabinet minister and Gujarat government spokesperson Nitin Patel said: “The right punishment has been awarded to the convicts as the court has ruled out the conspiracy theory”, adding the BJP stands vindicated. State Congress spokesperson Manish Doshi said the prosecution had failed to establish a conspiracy and could not nail the “big fish who escapted scot-free”. He said the then Gujarat government allowed such heinous killings to happen despite advance information. “The sentence is less; it could have been harsher. The real culprits slipped away and smaller people were punished,” he said. The Gulberg massacre was among 10 deadliest incidents during the riots investigated by the Supreme Court-appointed Special Investigation Team (SIT).

NH reacts to report; says hoho ‘apolitical’ NPCC known for opposing any political solution: NPF DIMAPUR, JUN 17 (NPN): Reacting to the news report— “After big win in Assam, BJP eyes Nagaland; seeks to take advantage of rift in ruling”, wherein the news portal had quoted Naga Hoho general secretary, the hoho said it “does not subscribe to any political parties and shall not compromise on the Naga political issue”. The hoho while affirming its stand as an “apolitical organization”, made it clear that “Naga Hoho belongs to all Nagas and does not subscribe to any political parties and shall not compromise on the Naga political issue”. In a press note, Naga Hoho vice president H.K. Zhimomi and secretary (Adm) Chitho Nyusou said that the hoho during its emergency executive meeting held on June 17 at Hotel Acacia, Dimapur, expressed surprised over the statement made by its general secretary that “whatever Rio does to claim back his empire is to be done before Assembly Election that will be held in 2018” and “Neiphiu Rio top-

pling TR Zeliang Govt in the near future”. It said that the views views and opinions expressed by its general secretary “does not hold water and reflects the opinions of Naga Hoho”. The statement was totally his personal views and in no ways the Naga Hoho endorses such statements, it added. The hoho further requested any freelance writer, reporters, journalists, media house to seek the approval of the office for any queries/interviews in sensitive issues confronting the Nagas. General secretary clarifies: Naga Hoho general secretary, Mutsikhoyo Yhobu clarified that the reported/author who had introduced himself as from “CNN IBM”, called him up and insisted to meet in person. Yhobu said he met the reporter at NSF office on June 8, 2016 afternoon. Yhobu said he had told the reporter that if he had wanted to meet the Naga Hoho, the president should have been approached first. However, Yhobu said the reporter personally wanted to

meet him to get his personal opinion on the present political scenario in the North East. “I implicitly told him that I was not a politician and moreover I being a member of the Naga Hoho cannot make any statements with political overtones but that the Naga Hoho stands for an honourable Naga political settlement”, he said. In this regard, Yhobu claimed that the news reporter had “completely distorted” their interaction. “In the course of our discussion among other things I said that it was by his own choice that Rio decided to become an MP by vacating his seat as CM”. “Also that if and when Mr. Rio decides to come back to state politics he would try to come back as CM and not as a mere MLA and as such the statements ascribed to me as in the article are not true”, Yhobu pointed out. He further made it clear that the above statement were purely his personal opinions and not the opinion of the Naga Hoho.

DIMAPUR, JUN 17 (NPN): NPF has reacted to the statement of NPCC that slammed the resolutions adopted by Nagaland Legislators’ Forum on Naga political issue. In a press release, the NPF press bureau while seeking to clarify “some of the contentions” raised by the NPCC said the Congress statement was “full of contradictions”, adding that they seemed to be confused of what they actually wanted to convey. It said NPCC appeared to be “panicking” since government of India and the NSCN (I-M) were “seriously inching to a political solution.” The bureau alleged that all through this while NPCC was “known for opposing any political solution to the Indo-Naga Political Issue”. It maintained that the statement of NPCC president K. Therie was “a clear indication” that Congress did not believe in the present peace process and political solution of the Naga Political issue. “How the NPCC can ridicule the resolution passed by the NLF when entire Naga people are yearn-

CNTC supports NTC; condemns threat to ACAUT DIMAPUR, JUN 17 (NPN): Central Nagaland Tribes Council (CNTC) on Friday said it would totally support statement made by Nagaland Tribes Council (NTC) stating that “never did the Nagas at any point of time gave their endorsement to any particular group or faction to collect tax or to solve Naga issue except the Plebiscite of 1951 under the aegis of NNC and said that any solution should be inclusive of all groups and content of the Framework acceptable to all sections of the Nagas”. CNTC in a press note said it further condemned the threat on ACAUT and the people of Wokha by NSCN (I-M) on taxation issue and also the claims made by NSCN (I-M) that it had the right to collect taxes from the people. Pointing out that the common people have been overburdened by taxation demands from various groups in the name of nationalism, CNTC maintained that the endurance of Naga people

was now ebbing away. “Patience has been more than once tested time and again which is going to blow up at any moment if corrective and restrictive measures are not taken at the earliest”, it said. In the name of nationalism besides collecting taxes, CNTC said people rather have questions to ask the NPGs— “what have the NPGs contributed to the society so far? Roads, schools, hospitals?” Posing a blunt question before the NPGs, CNTC asked “if such another referendum as the historic Plebiscite of 1951 is held again. Where would our NPGs stand today? It said that the NPGs should learn from their bitter experiences of the past of what had happened in Mokokchung and Mukalimi, “when the wrath of the public could no longer be held back and stopped by any forces which were ignited due to the continuous misbehavior against the people’s sentiments and wishes of the Naga public”.

CNTC further stated that NPGs should know very clearly that without the people’s support they will never survive. “If they continue to irk the public by issuing threats, summons and warnings the writing on the walls are very obvious that Nagaland will witness more bloodshed in the days to come”, CNTC said. It said that when all the Naga people were united against the curse and menace of taxation, CNTC wondered as to “why others apex bodies like Naga Hoho, NSF, NMA are all silent when the common people have sacrificed on the altar of these NPGs greed for such a long time? The council fur ther asked the apex bodies “whether they have any pity for the common men’s plight? And whether they could stand up for the rights and justice for the people?” All these issues and injustices, CNTC said had been going around right before their eyes, but observed silently. “Does the right to collect

taxes in the name of nationalism ends up acquiring crores of money, palatial buildings, luxurious cars, controlling all businesses, deducting salaries by snatching away hard earned money through the honest sweat of the brow of the people?”, CNTC questioned. CNTC voiced out to the NPGs by saying-- “feel and understand the pulse of the common people and right the wrongs before things go out of control”. It went on to say that “no revolutionary organization, however much powerful and dictatorial they are, can never survive without the support of the people”. CNTC felt that it was the right time to listen to the grumblings of the people and not to take them for granted as if they know nothing. The council noted that there has been a wide contradiction between the perspective of the past national worker and the present national workers. (Cont’d on p-7)

ing for an early solution to the Naga political issue. Why can’t they appreciate all the legislators having come together for the sake of solving the Naga political issue?” questioned the press bureau. The NPF said it could well understand the frustration of NPCC, because “they have been out of power for more than a decade now.” However, it asserted that the NPCC should have the audacity to admit the truth and cooperate with the present NLF for an early solution. It said every political party in Nagaland including the NPCC go to the poll with a party manifesto outlining the party’s priority if voted to power. “And incidentally all the politically parties in Nagaland include solution of the Naga political issue as the first in the list of priorities,” stated the press bureau. NPF said the statement of NPCC has exposed that they were “not interested for solution of the Naga political issue.” Further, alleging that Congress has been “fooling

the Naga people for so many years”, NPF said that was the reason why people have rejected them for the past three elections. “If election is to be held tomorrow they can foresee that Naga people will out rightly reject them again and for that reason they are only making noise out of desperation,” said press bureau. On the issue raised by NPCC that the trip of 60 MLAs to Delhi would be another waste of time and money of public tax, the NPF said going to Delhi or using the state resources while pursuing the Naga Political issue should in no way be misconstrued as wastage of time and money, “because Naga political issue is so dear to the entire Nagas.” Further, NPF said Therie should remember that all those past agreements he mentioned were also born out of negotiation “although it has not totally fulfilled the legitimate aspiration of the Naga people”. Therefore, NPF said the ongoing political talk needed to be strengthened so as to build a better future for the posterity.

Nagaland’s Pulp and Paper Mill will be revived: Minister AGARTALA, JUN 17 (IANS): The central government will make all efforts to revive the Pulp and Paper Mill in Nagaland, Union Heavy Industries and Public Enterprises Minister Anant G. Geete said on Friday. “We have decided to revive the mill. We will do whatever possible to set up adequate number of industries in the northeastern region,” he told reporters here. The minister, who came here on a day’s visit, said: “Growth of industries and development of infrastructure in the resource rich northeastern region is a priority of the central government.” The Centre has promised to sanction Rs 30 crore to Hindustan Paper Corp, out of which Rs 12 crore will be made available to Nagaland Pulp and Paper Co Ltd (NPPCL) or Tuli Paper Mill to revive production. Non-availability of adequate power and law and order issues had affected the rulling of the mill. Referring the huge production of rubber in Tripura, the minister said the central government would do whatever possible to set up big and medium rubber based industries in the state. Geete said 3.50 crore bogus ration cards had been revoked since May 2014 and Rs 36,000 crore saved by providing payment through bank accounts under the direct benefit scheme.

NPF termed as “totally absurd” the suggestion of NPCC president that legislators should negotiate with the government of India. NPF reminded Therie that many past agreements have failed because of many reasons. The main problem, NPF said was that the facilitators turning into negotiators and leaving out the real stakeholders. Whatever may be the pressure from the NPCC, the NPF said legislators’ forum should only remain facilitators and should not commit mistake by becoming a part of the negotiating team. NPF further urged NLF to steadfastly support the ongoing peace process and the Framework Agreement “without any iota of doubt as it is the desire of the entire Naga people to bring about early solution to the Protracted Naga issue.” Meanwhile, the NPF also asked the NPCC to come out openly whether they stand for solution to the Naga Political issue or they still want to let the problem continue without any logical conclusion?

CM’s education row: SC dismisses SLP

DIMAPUR, JUN 17 (NPN): The Supreme Court of India of June 15, 2016 dismissed the special leave petition (SLP) filed by the Nagaland chief minister T.R. Zeliang against the impugned final judgement and order dated April 25, 2016 passed by Gauhati High Court at Kohima pertaining to his educational qualification case. A vacation bench comprising Justice Adarsh Kumar Goel and Justice L Nageswara Rao, after hearing the counsel for the petitioner, said that since by the impugned order, the matter has been left to be decided by the Trial court, “we do not consider it necessary to go into the merits and entertain this petition.” However, while disposing the petition, the bench directed that the Trial court must, in the first instance, determine the question of limitation. And for that purpose, the bench said the petitioner need not appear in person and can appear through his counsel. “It will be open to the petitioner to raise all contentions, as may be available in law,” the bench said. The court also granted liberty to the petitioner to take his remedies in accordance with law if he was aggrieved by the order which may be passed by the Trial court. It may be mentioned that Gauhati High Court, Kohima Bench on April 25, 2016 quashed all three cases pertaining to the educational qualification of chief minister T.R. Zeliang, but did not stop proceedings filed by Maziezokho Niza of Jotsoma village and the other by Kuilimbe against Zeliang. K Y M C
