Office of profit: EC rejects AAP’s plea 21 AAP MLAs likely to face disqualification NEW DELHI, JUN 24 (AGENCIES): In a major blow to Delhi Chief Minister Arvind Kejriwal, the Election Commission of India on Saturday refused to drop the ‘office of profit case’ against 21 AAP MLAs. The Election Commission concluded that the 21 AAP legislators were appointed Parliamentary Secretaries, hence become accused in the “office of profit” case. The AAP MLAs are facing the threat of disqualification in the case. Since the AAP MLAs held de facto posts of Parliamentary Secretaries from March 13, 2015, to September 8, 2016, the proceedings on the question of their disqualification will continue, the EC said in its order on Friday. Show cause on some officials amicably settled, says ENPO

DIMAPUR, JUN 24 (NPN): Nearly a month after it issued show cause notice to some of its officials for their alleged active involvement in “partisan politics”, the Eastern Nagaland Peoples’ Organisation (ENPO) on Saturday said the matter has been amicably resolved “after clarifications and unconditional apology for the same by the erring officials.” In a press release, ENPO president, Khoiwang Konyak, and general secretary, Manlang Phom, said the matter was resolved through a joint consultative meeting with federating tribal units and frontal organizations held on June 20, 2017 at Tourist Lodge Dimapur. Further, the meet resolved to continue to “maintain the fair image of the organization by all concerned.” Meanwhile, ENPO has convened a joint coordination meeting with the 20 Eastern Nagaland Legislature Union (ENLU) members on June 29, 2017 at 11am at DUDA Guest House Kohima. ENPO has requested all ENLU members, president of six federating tribal bodies and president of all frontal organisations to attend the scheduled meeting.

Congress attacked AAP and sought the resignation of the MLAs involved. The 21 AAP legislators had approached the poll panel to drop the disqualification case as their appointments had already been set aside by the Delhi High Court on September 8, 2016. Out of these 21 legislators, Jarnail Singh had resigned from the Rajouri Garden seat in January to contest the Punjab assembly elections. The Election Commission, in its 23-page order, said it was not in dispute that the respondents (legislators) were appointed Parliamentary Secretaries in the Delhi government by an order of March 13, 2015. “Thus, it is evident that from the date of their appointment on March 13, 2015, till the date of setting aside of their appointment on September 8, 2016, the respondents were de facto holders of the office of Parliamentary Secretaries, albeit by way of an illegal appointment order and, hence, the present proceedings before the commission on the question of their disqualification is maintainable and shall continue,” the EC said.

The EC said: “... without prejudice to the merits of the case, the reference relating to the question of alleged disqualification of the respondents under Section 15 (4) of the Government of National Capital Territory of Delhi Act, 1991, for holding the said office survives and is maintainable in respect of all the said respondents, except Jarnail Singh, MLA of Rajouri Garden, who has resigned his office on January 17 and even byelection has been held on April 17 to fill that vacancy in the Delhi assembly.” AAP spokesperson Saurabh Bharadwaj on Saturday said: “The EC’s order should not be misinterpreted. The High Court had declared the very order of appointment of 21 Parliamentary Secretaries as null and void.” “Therefore there was no question of hearing a petition for the office which never existed,” Bharadwaj said. Welcoming the EC order, Delhi BJP President Manoj Tiwari said: “After the High Court, the EC has also found these AAP MLAs guilty of enjoying the office of profit as Parliamentary Secretaries.”

“These MLAs now have no moral or legal right to continue as legislators,” he said. Delhi Congress President Ajay Maken demanded the resignation of 20 AAP MLAs and dared them to face the electorate again. “The Congress demands the immediate resignation of the 20 MLAs currently facing the office of profit charge. We challenge them to face the Delhi electorate again,” Maken told the media here. In 2015, the AAP government passed an amendment to the Delhi Members of Legislative Assembly (Removal of Disqualification) Act, 1997, to exempt the Parliamentary Secretary’s post from the definition of office of profit with retrospective effect. President Pranab Mukherjee rejected the Delhi government’s bill to exclude the post of Parliamentary Secretary from the “Office of Profit” definition, leaving a sword of disqualification hanging on the heads of 21 AAP MLAs. The High Court declared their appointments illegal, saying the order had been passed “without concurrence/approval of the Lieutenant Governor.

DIPHU, JUN 24: A group of miscreant allegedly torched eight houses along the Assam-Nagaland border area in Karbi Anglong, Assam police said. Police said that the miscreants came in a vehicle and burnt eight houses located in Karbi Anglong Model village situated in Lahorijan area Friday night at around 12.30

p.m. and escaped from the scene. Police said one person, reportedly a resident of Dimapur, was arrested in this connection and was lodged at Dillai police station. Police also informed that properties worth several lakhs were destroyed. SP Karbi Anglong and OC Dillai PS confirmed about the incident and assured to take all measures to provide security to the villagers.

KOHIMA, JUN 24 (NPN): All Nagaland College Students’ Union (ANCSU) has demanded enhancement of the Post Graduate seats in all the departments under Nagaland University. This demand was contained in a representation submitted to NU vice-chancellor during ANCSU tour to Lumami on June 20 last, said ANCSU president Temjennungsang Jamir during a press conference held at NSF conference hall here on Saturday, which was also attended by ANCSU general secretary Benjong Longchar and other union officials. According to ANCSU president, the union also urged the VC to appoint assistant and associate professors strictly as per the UGC guidelines in all the colleges

NEW DELHI, JUN 24 (IANS): The monsoon session of Parliament will commence from July 17, the day the President’s election is scheduled in which over 776 MPs are eligible to vote.

Presidential Poll The Cabinet Committee on Parliamentary Affairs, which met here on Friday evening under the chairmanship of Home Minister Rajnath Singh, has recommended holding the session from July 17 to August 11, informed sources said. They said the session was being slightly advanced due to the Presidential election in which MPs and MLAs are voters. The monsoon session of Parliament is usually convened towards the end of July and carries on till August end. With the session beginning on July 17 it will ensure that all Members of Parliament are in Delhi. The voting will take place in Parliament House. An MP can also vote in his home state where MLAs generally vote.

States’ fiscal deficit soars to `4.93 trillion in FY16 MUMBAI, JUN 24 (PTI): Led by the most populous Uttar Pradesh and the largest Rajasthan, the gross fiscal deficits of all the states skyrocketed to Rs 4,93,360 crore in fiscal 2016 from Rs 18,790 crore in FY1991, according to the latest RBI data. According to the second edition of RBI’s statistical publication titled ‘Handbook of Statistics on States 2016-17’, which was released today, the gap is projected to improve to Rs 4,49,520 crore as per the budget estimates of the states for fiscal 2017. Uttar Pradesh had a fiscal deficit of a paltry Rs 3,070 crore in FY91, which zoomed to Rs 64,320 crore in FY16 and but is projected to improve to Rs 49,960 crore in FY17. According to the 16year data, Rajasthan, which had a gross fiscal deficit of Rs 540 crore in FY91, saw it soaring to Rs 67,350 crore in FY16 and is projected to decline to Rs 40,530 crore in FY17. Maharashtra, one of the most urbanised and industrialised states, had a gap of Rs 1,020 crore in FY91 but the same jumped to Rs 37,950 crore in FY16 which is projected to improve to Rs 35,030 crore in FY17. On the other hand, Gujarat, which had seen rapid industrialisation during the period of data analysis, had only Rs 1,800 crore in fiscal deficit in FY91 but the same had jumped to Rs 22,170 crore in FY16 and is projected to further deteriorate in FY17 to Rs 24,610 crore. In fact from FY01, there was not a single year when the western state had

shown improvements in its macro numbers. In FY01 its fiscal gap stood at Rs 7,990 crore which almost doubled to Rs 15,150 crore in FY10 and further to Rs 18,320 crore in FY15. Another state projected to have higher deficit in FY17 is Andhra Pradesh at Rs 20,500 crore, which was Rs 17,000 crore in FY16. Similarly, Tamil Nadu, a state known for state freebies, is also projected to have a higher deficit at Rs 40,530 crore in FY17, up from Rs 32,320 crore a year ago and Rs 1,130 crore in FY91. Again, Kar nataka, which had good finances in the past, is also estimated to post higher deficit in FY17 at Rs 25,660 crore, up from Rs 20,560 a year ago and Rs 560 crore in FY91. Similar is the case with Kerala, which is also slated to have higher deficit at Rs 23,140 crore in FY17 from Rs 17,720 crore in FY16 and a healthy Rs 800 crore in FY91. Reflecting its improved finances on the back of rising investments following better law and order situation, Bihar is slated to improve its finances with fiscal deficit of Rs 16,010 crore in FY17 against Rs 28,510 crore in FY16. The state which had for long been the badland of the nation had Rs 15,90 crore deficit in FY91. West Bengal, despite having high debt levels, has been improving its finances with its fiscal deficit projected to improve to Rs 19,360 crore in FY17 from Rs 25,180 crore a year ago and a healthy Rs 1,630 crore in FY91.

Power shutdown in Kohima on Jun 26

DIMAPUR, JUN 24 (NPN): State Department of Power has informed that due to commissioning of new 132kV bay at 132/33kV Kohima substation, there would be a total shutdown of power supply on June 26, 2017 from 5am to 2pm. In a public notice, executive engineer, transmission division Kohima, requested all consumers under Kohima district to extend cooperation and bear with the inconvenience.

DMC notifies shops

DIMAPUR, JUN 24 (NPN): Dimapur Municipal Council (DMC) has notified that all the shop keepers other than workshop and industries within DMC jurisdiction were allowed to keep open their respective shops on June 25, 2017 (Sunday) from 1pm onwards. In a press release, DMC administrator, Moa Sangtam, said this was to facilitate the costumers of the forthcoming Eid festivals.

Flood situation worsens in Assam GUWAHATI, JUN 24 (PTI): Flood situation in Assam worsened Saturday over 87,500 people in Lakhimpur, Karimganj and Sonitpur districts. According to a report by the Assam State Disaster Management Authority (ASDMA) 131 villages are under water at present, while 148 hectares of crop land have been damaged. Till yesterday a little over 82,000 people were affected across Assam due to the calamity. Around 500 people are taking shelter at relief camps in Karimganj district, officials said. Meanwhile, ASDMA said local people have recovered the body of a woman, who was washed away on by Ranganadi flood waters on May 31. The woman was identified as Pallabi Saikia (32) from Nowboicha.
