Govt seeks parties’ views on all-India judicial service NEW DELHI, May 9 (PTI): Supreme Court’s plan to explore whether a single agency can hold the examination to fill up vacancies in the lower judiciary has come as a morale booster for the Centre, which is convincing states and political parties to support its plan for an all-India judicial service (AIJS). Seven States, including BJP-ruled Madhya Pradesh and Arunachal Pradesh, have opposed the formation of an AIJS, a proposal which has received a fresh push from the Modi government. Another BJP-ruled state, Maharashtra, wants recruitment for AIJS to be done in a particular manner which the Law Ministry feels was “not in consonance” with the provisions of the service included in the Constitution. According to a Law Ministry, the Governments of Bihar, Chhattisgarh, Manipur, Odisha and Uttarakhand want major changes in the proposal formulated by the Centre. “State Governments of Arunachal Pradesh, Himachal Pradesh, Karnataka, Madhya Pradesh, Meghalaya, Nagaland and Punjab do not favour formation of AIJS,” it said.

AAP demonstrates EVM tampering in Delhi assembly Gallows for three who gangNEW DELHI, MAY 9 (AGENCIES): High drama and showmanship pervaded the Delhi assembly’s special session on Tuesday, as the Aam Aadmi Party staged a live demonstration on rigging an Electronic Voting Machine (EVM). AAP MLA Saurabh Bhardwaj took to the floor with a dummy EVM and explained the operating mechanism, before displaying how the device can be ‘hacked’ with a ‘secret code’ so as to manipulate the votes polled in it. “As voters cast their votes they believe their vote goes to the right party. But the person tampering EVMs, posing as a voter, can use secret codes to decide which party will win,” Bhardwaj said. Citing experience gleaned from a 10 year career as a software engineer, Bhardwaj said his demonstration was meant
tion was only a prototype and not an ECI EVM. The EC has time and again rubbished allegations that EVMs can be programmed to favour any particular party, a charge levelled by various political parties, including the AAP, after the assembly election in five states earlier this year.

to show that “any machine can be rigged or hacked.” He simulated polls by casting random number of votes for various candidates after entering the secret code in the EVM. The results showed votes skewed into the BJP’s favour. “I have seen again and again around the country, several places whoever one votes for, vote goes to only
BJP, due to VVPAT. If elections continue to be done through these EVMs there will be no measure of democracy left. Only one party will rule,” Bhardwaj said after the live demonstration.

After Bhardwaj demonstrated the rigging on live television on the floor of the Delhi State Assembly, leaders from opposition parties such as Congress and Samajwadi Party demanded a probe to clear the doubts. But this may not be the end of the EVM tale. Congress leader Shehzaad Poonawalla on Tuesday sent out invitations to a press conference to be addressed by his brother Tehseen and an independent activist VV Rao. “On 10th
May 2017 Monday, ‘Election watch’ Convener and EVM Petitioner in Supreme Court V.V.Rao, along with entrepreneur & activist Tehseen Poonawalla, will be holding a press conference to challenge the Election Commission of India on EVMs,” Ponawalla wrote in the email. A senior Congress leader, on the condition of anonymity, said, “There is something sinister afoot. All this is so that the BJP can muster enough numbers in the Rajya Sabha to have complete control. A member of the BJP’s Parliamentary Board told me recently that they were planning to dismiss every non-BJP state government one by one. They are starting with AAP because Delhi’s Rajya Sabha seats fall vacant in January. They will come for us next. Dictators rig elections, not democrats. Modi is like a Desi Putin.”
raped, murdered Pune techie
PUNE, MAY 9 (IANS): A fast track court on Tuesday pronounced the death sentence for three prime accused in the sensational October 2009 gangrape and murder of a 28-year-old software engineer Nayana Phatak-Pujari. Special Judge L. L. Yenkar, who on Monday convicted Yogesh Ashok Raut, Mahesh Balasaheb Thakur and Vishwas Hindurao Kadam for kidnapping robbing, gangraping and then killing the victim, sentenced them to death after a hectic day full of arguments between the prosecution and defence lawyers. Raut (32) and Thakur (31), both belong to Pune, and Kadam (34) is from Satara district. Special Public Prosecutor Harshad Nimbalkar forcefully argued for the death penalty against the convicts, terming it as
“the rarest of rare cases” considering the brutality of the crime against the victim. He said that the prosecution conclusively managed to establish the complete chain of circumstances that led to the serious crime and said they deserved “the maximum punishment” under the laws. “Considering the brutal manner in which the victim was gangraped and then killed, this falls under the category of rarest of rare case,” he said pressing for the death penalty after the conviction. As co-accused, Rajesh Pandurang Chaudhari, who was arrested as an accomplice, later turned an approver and was granted a pardon, defence lawyers B.A. Alur, Ranjit DhomsePatil and Ankush Jadhav, who sought a milder sentence, also argued that he was also guilty and should face the same punishment.
