KO H I M A , M AY 2 0 (NPN): Nagaland Chief Minister Dr. Shürhozelie Liezietsü disclosed that the state government has already made up its mind to either amend the Nagaland Municipal Act (NMA), or to enact an altogether new Municipal Act in consultation with all stakeholders and conduct ULB elections only thereafter. Addressing at the one day workshop on ULB vis-à-vis Article 371 (A), organized by Ex-Parliamentarians Association of Nagaland (Ex-PAN), at State Capital Convention Kohima, Saturday, the chief minister stressed on the necessity of holding a proper dialogue and discussion on this sensitive issue, so that no mistakes are committed which would be only bring regret. hos held on November 26, 2016 and said the meeting was basically to consult the Naga tribal bodies regarding the intention of the State Government to amend some of the provisions of the NMA 2001 as amended in 2006. He said the view was that taxation of land and buildings was a very complicated process and the nascent ULBs in Nagaland would not be in a position to impose this tax for quite some time. In view of such sensitivity of the issue he said it was the considered view that inclusion of the provision in the Act can be taken up only as and when the ULBs are ready to come forward with

such a proposal. On the issue of Women Reservation (WR) he said since state government had already decided earlier to conduct ULB elections in February 2017 with WR, it was not included as an item or agenda for consultation. However, he said the “tribal bodies were allowed to voice their views and concerns on this issue as well”. Further he mentioned that state government was aware that there was no consensus amongst the tribal bodies on the issue of WR. Nevertheless, he said as the state government had already taken a decision to conduct ULB elections with WR, notification was issued by the Government in Octo-

ber, 2016 to start the process of ULB elections as per the provision of the Municipal Act. Dr. Liezietsü said state government had not, in their wildest of imaginations, anticipated that the opposition to WR in ULBs would throw up so many ugly incidents that the state was made to witness during January and February this year. He reiterated that the main interest and intention of the State Government to go ahead with the ULB elections with WR was the desire to protect Article 371-A of the Constitution, which was very important for the state and the people. JCC/NTAC want govt to revoke cabinet resolution on ULB DIMAPUR, MAY 20 (NPN): Joint Co-ordination Committee (JCC)/ Nagaland Tribes Action Committee (NTAC) have appealed to the state government to revoke the cabinet resolution dated November 24, 2016 in the forthcoming assembly session. In a press release, JCC convenor, Supu Jamir, and secretary, Rainbow Ngullie, said the JCC & NTAC jointly submitted representation to state chief minister on March 18, 2017 requesting the government to take up the matter for discussion in the previous assembly session and pass an appropriate bill for revocation of the resolution dated November 24, 2016 with regard to conduct of Urban Local Bodies Election with 33% women reservation. However, they said the matter was not taken up for discussion during the last assembly session “despite of being a serious issue confronting the aspiration and wishes of the people of Nagaland.” Therefore, JCC/NTAC have reiterated appeal to the state government to take up the matter on priority in the forthcoming assembly session and revoke the “infamous cabinet resolution” as the same was against the wishes and interest of the people of Nagaland. JCC/NTAC said they expected the incumbent state government to use the wisdom and the powers vested upon by the people to uphold and ensure to protect the rights and integrity of the people that it represent.

Biren Singh on Saturday said the T H I RU VA NA N THAPURAM, MAY 20 (AGENCIES): A 23-yearold woman cut off the genitals of a so-called “swami”, or godman, who was allegedly sexually abusing her since she was in her teens and who allegedly tried to rape her on Friday night in Pettah. According to the police, the incident occurred on Friday night when Gangeshananda Teethapadam, alias Hariswami, allegedly tried to rape the woman at her residence. Sources told TOI the woman alerted the police immediately after she chopped off the man’s genitals with a knife. She called the emergency 100 number because she was afraid the alleged rapist would kill her. The accused claimed to be a saint associated with the Chattambi Swami Ashram in Kollam, but the ashram authorities denied any association with him. “He was a brahmachari at the ashram 15 years ago. Later, he quit. But it is learned that he was using the ashram for his fame,” said an official at the ashram. Police have charged the alleged rapist with relevant sections of the Protection of Children from Sexual Offences Act.

Biren Singh said there was “a system failure since there is no effective control over the former insurgents”. He added: “There is no proper surrender policy. The former insurgents are not given adequate assistance in terms of building houses and more. There is no means of livelihood for these people and their families.” While the Army has signed Suspension of Operations with some militant outfits, the Manipur government had refused to honour them. And so police and paramilitary forces continued to hunt, kill or arrest the tribal insurgents despite their signing the pacts.

Legal luminaries expound on women quota & Art. 371A Correspondent

KOHIMA, MAY 20 (NPN): Two well known legal luminaries of the state- Supreme Court Judge Justice (Retd) H. K. Sema and retired High Court Judge Zelre Angami- have given a legal interpretation of the constitutional provisions of Urban Local Body election vis-a-vis Article 371A at the one-day workshop organised by the Ex-Parliamentarians’ Association Nagaland (Ex-PAN) held at the Capital Convention Centre here Saturday. The issue is crucial for the state as it involves both the implementation of 33% women reservation in ULB elections and the need to safeguard Article 371A from legal onslaught. In his speech, H.K.Sema said Nagaland Municipal Act was a state legislation, thereby it can be legally implementable and if correction needed, it can be amended. Sema also said the Income Tax 1961 sub-section 26 of section 10 exempted Nagas from paying tax provided the source of income was from tribal area. However, he said municipal tax was not a tax under Income tax thereby he said people should be educated on this issue. He said the perception of Nagas on taxation must be changed if Nagas want to have good drainage system, marketing facility, good road, drinking water facility etc as to carry out these activities, Local self Government (LSG) has to earn revenue. Sema said

paying revenue to LSG was for one’s own comfort, welfare, health. He said ULB was made a burning issue unnecessarily because of lack of communication between the representatives and the people and reiterated on the need to educate the people in the village who were not cared. Sema regretted that Article 371 (A) was misused, misinterpreted and misunderstood due to lack of education and said every individual was responsible to bridge the gap between of the commoner and the educative society, legislature and the law making authority. He said Nagas may be of the understanding that having Article 371 (A), other provisions of constitution was not applicable to the state. He cautioned that this would lead to break down of constitution and reminded that Nagaland state itself was creation of the constitution. He informed that in a democratic country, states like Nagaland are governed by the rule of law. Therefore, he said no one can say constitution does not apply in Nagaland as “our liberty and freedom of movement is under the rule of law”. He also suggested the establishment of State Law Commission headed by retired high court judge stating that Nagaland was old but minds were young. Further Sema pointed out that Article 371 (A) does not prohibit Women Reservation as none of the four clauses in Article 371 (A) prohibit WR stating. (Cont’d on p-8)

Landslide: KYO seeks govt’s urgent attention

D I M A P U R , M AY 2 0 (NPN): Kiruphema Youth Organization (KYO) on Saturday pointed out that the massive landslide besides incessant rainfall, in Peducha area under Kiruphema village was a result of the “mindless dumping of soil at unstable areas by the four lanning construction company (Gayatri).” In a press note KYO president, Kezevilie Hojha;

general secretary, Mhasisieto Zhünyü; advisor, Neicasato Visienyü and action secretary Makolie Shosahie have appealed to the state government to carry out necessary repair work and to widen the narrow portions of the ‘By-pass” road. KYO said it was ready to “handle and supervise the work for public and road safety.” It pointed out that the movement of the vehicles

have been adversely affected causing untold hardship to travellers. Though light vehicles have been diverted from Peducha to Kiruphema (Basa/Bawe) to Shalom Bible seminary to Secü Zubza, KYO however said the only alternative road was narrow and in deplorable condition. KYO cautioned the state government that unless immediate action is taken, the condition of the road would worsen and may pose danger for safety of travellers. If not, KYO said it would block all vehicular movement along the “bypass” in order to carry out the repairing work at their own available resources. KYO further warned M/s Gayatri not to dump soil in Kiruphema jurisdiction (from River Noumvürü near Bamboo Hotel, and River Dierü near Essar petrol pump) without consulting them. (Cont’d on p-7)

EVM challenge to begin on June 3; EC invites parties NPPC Ltd workers union N E W D E L H I , M AY 20 (IANS): Picking up the gauntlet, the Election Commission on Saturday offered its EVMs for political parties to hack them, if possible, under a “Framework of Challenge” from June 3 but insisted that the machines cannot be tampered with in its custody. Chief Election Commissioner Nasim Zaidi announced the schedule for the ‘EVM Challenge’ under a framework of conditions decided by the Commission. Those unable to prove their point will be dubbed to have failed the test. He said it will be open to the national and state parties which took part in the recent elections in Uttar Pradesh, Uttarakhand, Punjab, Goa and Manipur and claimed that the EVMs were tampered or could be tampered even under the poll panel’s safeguards.

The parties should prove their claims within the administrative and security protocols prescribed by the Commission at its headquarters from June 3, Zaidi said. Any party which wants to join the challenge can confirm its participation by May 26. If its representatives fail to turn up on the appointed day and time, they will forfeit their right to take part in the challenge. The ‘Challenge Statement I’ said the doubters should prove that the EVMs used in the five states were tampered to favour a candidate or a party by altering their results stored in the EVMs after the polls. The claimants will have to alter the results in the Control Units used during these polls in exactly the same scenario as the EVMs remaining within

the safeguards of the EC after the polls. This covers the period of storage in strong rooms or during counting by pressing a combination of keys on Control Unit (CU) and Balloting Unit (BU) or by communication to CU or BU or both via external wireless or bluetooth or mobile phone. ‘Challenge Statement II’ asked the naysayers to prove that the EVMs used in the five states were tampered before or during polling. The claimants will have to alter the results in the EVMs used during the polls in exactly the same scenario as the EVMs remain within the safeguards of the Commission before the poll in strongrooms or during polling. Reacting to Zaidi’s announcement, the AAP, whose leaders sought to demonstrate in the Delhi

assembly that the machines can be hacked, said it will seek clarifications from the Commission on the proposed challenge. It did not say whether it will take part in the challenge. Zaidi asserted that the machines can’t be tampered with through external hardware -- wireless, WiFi, bluetooth device or mobile phones -- nor can they be manipulated at the manufacturing stage because of strict security protocol. He said the results can’t be altered by activating a Trojan Horse through a sequence of key presses because the micro-chip is programmed for one time use only. The EVMs can’t be physically tampered with nor their components be changed without anyone noticing, he said, adding the latest technological features make them tamper-proof

with features like OTP micro-controllers, dynamic coding of key codes and other measures, he said. Zaidi said the Commission does not use EVMs made abroad. These are produced through public sector manufacturers BEL in Bengaluru and ECIL in Hyderabad. “The software programme code is written in-house by these two companies, not outsourced, is approved by the Technical Evaluation Committee of ECI and subjected to strict security procedures at factory level to maintain the highest levels of integrity.” The poll panel said each party can nominate up to three persons to take part in the challenge. However, EVMs involved in any election petition or ordered to be sealed by courts will not be available for the challenge.

D I M A P U R , M AY 2 0 (NPN): The Workers Union of Nagaland Pulp and Paper Company Ltd (NPPC) has asked the chief minister of Nagaland, Shurhozelie Liezietsu to intervene for the revival of the paper mill at Tuli. In a memorandum submitted to the chief minister, the union stated that rehabilitation work of NPPC Ltd has almost stopped since September 2015 and no steps have been taken for its revival since then. According to the union, during a meeting among representatives of NPPCL management, HPC, department of Heavy Industry, New Delhi and Government of Nagaland at the chief minister residential office on May 31, 2015, DHI assured to sanction Rs.30 crore to Hindustan Paper Cooperation out of which an amount of Rs.12 crore was to be

made available to NPPC Ltd to restart the rehabilitation process immediately. At the same meeting, it was also discussed to include deputy commissioner of Mokokchung in the board of NPPC Ltd besides appointing a full time managing director for the paper mill, however, no step have been taken so far, the union stated in a press statement issued by its president Noklenlemba and general secretary Sunil Kumar Das. The workers union also reminded that the salary of the employees have not been paid since last 6 months besides gratuity and terminal benefits of the superannuated and death employees. Therefore, the union urged the chief minster to intervene for the rehabilitation of the Nagaland Pulp and Paper Company Ltd immediately. K Y M C
