NEW DELHI, SEP 30 (IANS): A nationwide alert was issued on Friday after intelligence inputs on possible attacks by Pakistan-based terror groups in the country in retaliation to the Indian Army’s surgical strikes on terrorist launch pads across the Line of Control. Home Minister Rajnath Singh reviewed the security scenario with top officials of his ministry and central police organisations at a meeting attended, among others, by National Security Adviser Ajit Doval and Home Secretary Rajiv Mehrishi. In an advisory to states, the Home Ministry said additional forces should be deployed in all sensitive places, strategic installations, markets, religious places and other key places to ensure security, The central government has asked the metro cities to be extra vigilant. Nagaland Baptist youth appeal govt for improved road DIMAPUR, SEP 30 (NPN): Nagaland Baptist Church Council Youth Department (NBCCYD), the Baptist Youth of Nagaland, has expressed anguish over the deplorable road conditions in Nagaland and appealed to the state government to improve road conditions in the state In an appeal to the Nagaland chief minister, NBCCYD president, K. Hekato Awomi, and NBCC youth secretary, Vikuo Rhi, said during the 32nd Annual Session of the department at Ahthibung recently, attended by 22 associations from all districts, the Baptist youth empathised with the government that in spite of resourcefulness, in terms of natural and human resources, the state remained underdeveloped. “With this backdrop the Baptist Youth of Nagaland brings to you their deep-felt anguish over the state of affairs, with special reference to the deplorable conditions of roads in Nagaland,” the signatories said in the appeal to CM. The youth opined that the government must adopt a holistic approach that underscored the need for a road system, which guarantees maintenance, safety, liveability and a sense of community if all round development was be achieved. With monsoon coming to an end, the Baptist youth said the whole state was left with potholes, mud and water stagnation on the roads making it tough for common motorists to drive.

Pakistan’s Inter-Services Public Relations also issued a statement and said Gen. Raheel Sharif had asked all commanders to lay more emphasis on combat readiness. “Pakistan can’t be coerced through any amount of malicious propaganda,” he said. He said that “highest” state of vigil was being maintained along the LoC and all along the International Border.

Pak postpones SAARC summit; 5 countries pullout

ISLAMABAD, SEP 30 (PTI): Pakistan today postponed the SAARC Summit to be held here next month after India along with four other member states of the regional grouping decided against attending the meet. “Pakistan deplores India’s decision to impede the SAARC process by not attending the 19th SAARC Summit at Islamabad on 9-10 November 2016,” the Pakistan Foreign Office said in a statement. It claimed that the spirit of the SAARC Charter is “violated” when a member state casts the shadow of its bilateral problems on the multilateral forum for regional cooperation. Besides India, four other SAARC members-- Bangladesh, Bhutan, Afghanistan and Sri Lanka pulled out of the summit, indirectly blaming Pakistan for creating an environment not right for the successful holding of the meet.

UN appeals India, Pak

Concerned over the tensions across the LoC, UN Secretary-General Ban Ki-moon’s top aide has asked India and Pakistan to exercise restraint and resolve their differences peacefully. In the wake of the surgical strikes conducted by India targeting terror launch pads across LoC, Ban’s spokesperson Stephane Dujarric said the UN is “obviously following this situation with great concern” relating to the increase of tensions across the LoC.

DIMAPUR, SEP 30 (NPN): Nagaland chief minister T.R. Zeliang pointed out that the police department was one of the biggest and most important of all departments in the government, as it was saddled with maintenance of law and order, which became its primary duty ever since the existence of organised societies and governments. Speaking as chief guest at the 62nd batch attestation parade of recruit havildars and recruit constables at the Police Training School (PTS) Chumukedima Friday, Zeliang congratulated the successful recruits who will become part of the state’s police force. He reminded the recruits that they will be in contact with various people at different levels while performing their duties. The impression thus created by the recruits in the minds of the public, will

be the impression that public form about the police, he said. He advised them to be firm while dealing with criminals and friendly and helpful to citizens. In this regard, the chief minister reminded the recruits that their performance and behaviour would be crucial for maintenance of law and order. He also asked recruits to remember that failure of security results in breakdown of the entire government machinery. The chief minister also pointed out that havildars and constables at the passing out parade Friday, were from a special dispensation for the four districts of Eastern Nagaland including the Sumis of Kiphire district. ZPO clarifies stand on Rongmei recognition NH calls on Gov; takes up VCs DIMAPUR, SEP 30 (NPN): In a twist to the Rongmei issue, Zeliang People’s Organisation Nagaland (ZPO) general secretary Kerang Dumtta has clarified the stand of the organisation, to enlighten Nagas against what he described as “the so-called media cell of ZPO supporting the tribes which are against the recognition of Rongmei as a Naga tribe.” Dumtta said the above was “bizarre, considering the fact that, the ZPO had, on September 10,2010 written to the government of Nagaland, declaring that it had no objection to the recognition of the Rongmei community as a Naga tribe in Nagaland.” However, according to Dumtta, the ZPO, then headed by “our respected late leader Azu Newmai” could not function as expected by the people and thus became moribund after some years, except for the occasional press releases. He also cited the incident at Peren Town Hall on August 5, 2010 when the meeting could not be held on account of unruly scenes when public expressed displeasure “in a

violent manner”. Then on December 13, 2012 he said Zeme Council “apex tribal body of Zeme Nagas” decided to form a ZPO in consultation with Liangmai Nagas and on May 10, 2013 the latter also resolved to do likewise. Therefore, a joint meeting of the two councils- Zeme and Liangmai- was organised on June 7, 2013 where it was decided to form an organisation and formally resolved to constitute an electoral college comprising of both recognised and unrecognised Zeliang Naga Village Council Chairmen under Peren district including presidents of Zeme and Liangmai councils. He said that representatives of defunct ZPO- Azu Newmai, Kingim Kulimbe and Intintiebe- were then included as members of the election commission for the purpose of conducting election of office bearers for the proposed public organisation. of new ZPO office bearers was conducted at the general meeting in Jalukie on June 21, 2013 attended by 72 village council chairmen in Peren district where Kiezin was elected as president and Kerang Dumtta as general secretary along with other office bearers. Dumtta said ZPO has thereafter been functioning smoothly till date. He further said as office bearers of ZPO (formed by the Zeliang people) they urged upon people not to be misled by press releases issued without any genuine name by those hiding behind the nomenclature of ‘Media Cell.’ Dumtta further requested newspapers not to entertain such press releases in future, issued without proper designation and identity. He concluded that their organisation, formed with mandate of public of Peren is called Zeliang People’s Organisation and there was no dispute among the Zeme and Liangmai councils of Nagaland and therefore, statements of self-styled organisation that exist without public mandate should not confuse the Nagas, Dumtta added.

DIMAPUR, SEP 30 (NPN): Naga Hoho members on Friday called on Nagaland Governor, P.B. Acharya and expressed concern over various issues with regard to quality education in the state including “appointment” of the vice chancellors (VC) and “irregularities in Nagaland University (NU)”. A representation submitted to the governor, signed by NH president P. Chuba Ozukum and secretary (Adm) Chitho Nyosou, stated that “from the beginning a poor choice was made in appointing the Vice Chancellor and it still continues”. The hoho said, while appointing VCs, personal loyalty got the better of more relevant considerations like competence, academic eminence and personal integrity. “The result has been disastrous and till now we are paying for the consequences,” NH said. NH said, ever since its inception in 1994 NU had seen many ups and downs in spite of its remoteness and other

political instabilities and issues, the people of Nagaland have extended all its possible co-operation. However, even after 22 years, NH lamented that NU was unable to attain its height as a Central University at par with other progressive Central Universities, coupled with several unhealthy issues of financial misappropriation by the institutional heads resulting into series of agitation and removal of VC and officials of the University on corruption charges. It also reminded governor that NU had experienced years CBI inquiry, even as some cases were still pending, while some officials had been removed and some retired. The hoho also expressed concern over the “sub-standard infrastructural development” in the three campuses. NEW DELHI, SEP 30 (NPN): Top leadership of the country led by Prime Minister Narendra Modi, chief ministers and ministers from states and Union Territories on Friday signed a ‘Declaration of Commitment’ to make ‘India Open Defecation Free and Clean’ by 2019. Prime Minister Narendra Modi, Union Ministers and chief ministers of Andhra Pradesh, Assam, Chattisgarh, Goa, Haryana, Maharashtra and Goa besides ministers from states and UTs signed the declaration during the INDOSAN (India Sanitation Conference) in Delhi on Friday. Other elected representatives from rural and urban local bodies, district collectors, Municipal commissioners also signed a similar Declaration, an official communiqué stated. Addressing the inaugural session of INDOSAN, Union Minister of Urban Development, M. Venkaiah Naidu said the largest ever mass mobilization has taken place under Swachh Bharat Mission (SBM).

Naidu informed that as on date 405 cities and towns have come to be Open Defecation Free and 739 would become ODF by March next year. 24 lakh individual household toilets have so far been built in urban areas and another 19 lakhs under construction. 20,000 of the 82,000 urban wards have become ODF. 90,000 community and public toilet seats have been built and another 1.29 lakh seats under construction. He said with people leading the India Sanitation Alliance, cleanliness in rural and urban areas has been mainstreamed with political leadership at various levels for the first time. “21st century India has to get free from illiteracy and LITTERATI people who throw litter in the open,” he said. He further termed MODI-- “Mood Of Developing India”, over the last two years has been for a Clean India. After a slow start, Swachh Bharat Mission gained momentum over the last one year with good progress in implementation in both rural and urban areas.

Acharya appeals all to take part in ‘Swachh Bharat Mission’ DIMAPUR, SEP 30 (NPN): Nagaland Governor, P.B. Acharya, nominated as one of the National Brand Ambassadors for ‘Swachh Bharat Abhiyan’ (Clean India Mission), by the Prime Minister appealed to all stakeholders, NGOs, civil society, government employees, college and school authorities, students’ organizations, etc. to participate in the process of building a “Swachh, Shashakt, Samriddh and Niryog Bharat.” Prime Minister Narendra Modi launched the ambitious ‘Swachh Bharat Abhiyan’ on October 2, 2014, on the occasion of Mahatama Gandhi’s 145th birth anniversary, with the to achieve an ‘open-defecation Free (ODF) India by 2 October 2019, the 150th birth anniversary of Mahatma Gandhi. In this regard, government has set a goal to construct 12 crore toilets in rural India, at a projected cost of Rs. 1.96 lakh crore. Acharya in a statement Friday, said even as people remember Gandhiji, the father of the Nation or Bapuji, for the leadership of non-violent Indian freedom struggle, cleanliness was very near to Gandhiji’s heart. Acknowledging the sacrifices made by Gandhiji in the freedom struggle, he said the government announced ‘Swachh Bharat Abhiyan’ as a national campaign to cover 4,041 statutory cities and towns, to clean the streets, roads and infrastructure of the country.

Acharya appealed all to keep their surroundings neat and clean. “We need to keep our houses, markets, public places, etc. clean and neat. Garbage/waste should be properly disposed off. It should not be thrown into public places,” he added. The Governor expressed gratitude to Prime Minister for appointing him along with nine other important social leaders (Nav Ratnas) as National Ambassadors of Swachh Bharat Abhiyan. In order to carry the mission forward, he said nine prominent personalities from various fields of Nagaland were appointed as State Brand Ambassadors-- Abei-u Meru, Vizopal Chaya, GeofferyYaden, Supongmeren Jamir, Longtam Phom, Hokhugha Chishi, T. Khongo, Methaneilie Solo Jütakhrie and Alobo Naga. While urging all “to be soldiers to turn this novel idea into action”, Acharya said through the practice of the proper cleanliness everyone would be able to keep themselves physically and mentally clean, thereby making all good, civilized and healthy human beings. “Cleanliness brings feeling of physically, mentally and socially well-being and helps to make good personality. Cleanliness gives rise to good character by keeping body, mind and soul clean and peaceful,” Acharya stated.

Centre approves `1,660 cr highway projects for 8 states NEW DELHI, SEP 30 (AGENCIES): The government, on Friday, approved Rs 1,660 crore worth of highway projects in eight states including Uttar Pradesh, Maharashtra, Assam, Andhra Pradesh, Tripura Sikkim, Meghalaya and Nagaland. “The standing finance committee (SFC) on Friday cleared eight projects worth Rs 1,659.96 crore for 454 km length for eight states,” a road transport and highways ministry official said. Of the eight projects, five will be undertaken on the engineering, procurement and construction (EPC) mode. There will be two-laning of Nongstoin - Shillong Section of NH-44 and Nongstoin - Rongjeng - Tura road while in Nagaland the project aims at four-laning of Dimapur to Kohima Section of the National Highway. In Tripura the Rs 172 crore project pertains widening to two lane with paved shoulder on Churaibari Agartala section of NH-44 while Sikkim will see construction of 1000 metre length viaduct at Rangpo on NH-31A. Assam package contains shifting of Electrical line and operational cost for compensation trees for construction of Dhola-Sadiya Ghats Bridge. Rs 219 crore project for UP pertains to upgradation of 37 km stretch of AllahabadMirzapur section of NH 76E.

Governor lauds PM, Army’s surgical strikes

DIMAPUR, SEP 30 (NPN): Nagaland Governor, P.B. Acharya has congratulated Prime Minister, Narendra Modi for his strong and right decision to fight terrorism and the Indian Army for carrying out the surgical strikes on September 28 on terrorist launch pads across the Line of Control (LoC). He noted that the operation carried out by the army was “to safeguard our Nation and neutralise Pakistan sponsored terrorists planning to infiltrate into Indian territory.” Acharya asserted that “India under the dynamic leadership of Modiji is safe”. He also saluted the brave soldiers for their valour and said that the people were “really proud of our Army and the whole nation supports them”. Stating that “our brave jawans had given a befitting reply” to those attacking innocent civilians and jawans, Acharya said the surgical attack reaffirmed Army’s valour and commitment to nation’s security. He said it was a proof of Indian Army’s valour and patriotism and a clear message sent to the terrorists by destroying their launch pads across the LoC.

Petrol price up by 36 p/ltr; diesel cut by 7 p

NEW DELHI, SEP 30 (PTI): Petrol price was today hiked by 36 paise a litre, the third increase in two months, but that of diesel was cut by 7 paise per litre in line with international trends. This is the third increase in rates in petrol in two months, while in the case of diesel, it is the second price reduction this month. Indian Oil Corp (IOC), the nation’s largest fuel retailer, said petrol price is being hiked by 28 paise per litre (excluding state levies) and diesel rate is being cut by 6 paise (excluding state levies).

DNSU backs CCoFA demand for CBI probe

DIMAPUR, SEP 30 (NPN): Diphupar Naga Students’ Union (DNSU) on Friday affirmed its support to the NH bandh call given the Co-ordination Committee on Fuel Adulteration (CCOFA) in the event the state government failed to comply with the 15-day ultimatum to constitute a CBI inquiry into fuel adulteration case. In a press release, DNSU, N. Pitovi Achumi, stated that the government’s refusal to constitute a CBI enquiry would only indicate that the state government was “a party to this crime and the public will not remain a mute spectator to that.”DNSU has called upon citizens from all sections of the society to come forward “in support of this cause for common good.” The union expressed dismay over what it called the lacklustre attitude of the state government in spite of the evidences and records submitted clearly indicated rampant fuel adulteration racket in Nagaland. Terming the fuel adulteration as “a broad day-light robbery”, DNSU said such illegal act deprived the people of their right “to get a fair value for their money’s worth.” The union stated that leaving this “drain of wealth” unchecked would “only burden our stagnant economy further”. DNSU therefore asserted that the student community cannot turn a blind eye “when our land and society has become a tool and a play ground in the hands of some few unscrupulous elements.”

Militants ambush AR convoy; officer injured

IMPHAL, SEP 30: Militants actively operating in Kamjong area of Manipur’s Ukhrul district waylaid an Assam Rifles convoy on Friday at around 4.30 a.m., injuring a major. According to reports, the militants ambushed a column of 31 AR, during which Major Mandeep Singh of C-Coy sustained bullet injury. The officer was immediately evacuated to Army hospital at Leimakhong, Imphal by chopper. No other casualty was reported and no group has claimed to have carried out the attack.

DIMAPUR, SEP 30 (NPN): On the eve of the International Day of Older Persons, the Nagaland governor, PB Acharya, has stressed the need to have more libraries, health care centres, parks, etc. for the older people and also proper respect for older people. In his message on International Day of Older Persons, Acharya said the day was marked as an opportunity to highlight and appreciate the important contributions by elderly to society and raise awareness of the issues and challenges of ageing in today’s world. DIMAPUR, SEP 30 (NPN): Renowned Naga writer Kaka D Iralu on Friday lambasted the enforcement of draconian law AFSPA in Nagaland and said that “the Indian democracy under which we are all living today is one where even our very right to life stands nullified through heinous laws like the Armed Forces Special Power act 1958, The Disturbed Area Act 1955 and The Unlawful Activities Prevention Act 1967.” He was speaking as the resource person at the state level seminar “Nagas in transition: from myth to modernity” hosted by Eastern Christian College (ECC), Padumpukhuri here on Friday. Iralu stated that for “our” legal rights, even after seven decades of India’s so called democratic rule, the lives of over two hundred thousand Nagas who have died to preserve our ways of life remains uncompensated and unaddressed. As for “our” legal rights pertaining to day-to-day affairs, Iralu rued that many cases were pending in courts lost in a maze of stay orders where justice was denied and kept in suspension and added

In his concluding remarks, Iralu while acknowledging that one should not remain living a static past of yesteryear in today’s “global village”, warned of dangerous misadventures in plunging into the modern world without a knowledge of “who we are” and “what we are”. KOHIMA, SEP 30 (NPN): Nagaland Law Students’ Federation (NLSF) has alleged that students of the three private law colleges in Nagaland were subjected to severe anomalies in their academic career which begins from low marking system to erroneous mark sheets besides many others coupled by the absence of a government law college in the state. The newly elected NLSF team members for the term 2016-2018 informed this during a press conference held at its office chamber Kohima. NLSF president Imlibenla Lemtur, the first women president of NLSF, pointed out a series of grievous anomalies in their educational system for many past years. While lamenting that delay in declaring results with erroneous mark sheet has become regular for law students

‘Long-term road map for strong infra in the NE needed’

Guwahati, Sep 30 (PTI): Assam PWD (Roads & Buildings, NH) minister Parimal Suklabaidya has called for a policy road map to give a boost to infrastructure for transforming the North East region to a developed area. Focused and special policies are the key to attracting a greater volume of investments in infrastructure in the North East, said Suklabaidya at the CII North East Infra Dialogue here today. “Policy makers need to adopt a long-term road map for building a strong infrastructure in the Northeast. This requires a mindset change among infrastructure stakeholders and the use of latest technologies,” Suklabaidya said. “Addressing infrastructure problems has come to be the key focus areas for Assam gover nment. The long pending Barak Valley issues are now part of the

bigger agenda. It is an agenda of both crisis management and stabilisation of development,” he said. “The Northeast to a large extent still lags in terms of physical infrastructure, which points to our failure to meet the demands in the region. The major challenges plaguing the North East region include poor intra-state connectivity and lack of adequate physical infrastructure needed to connect the region with major parts of the country,” he said. “The Government is aware of the challenges and both the Centre and state government have laid emphasis on building and developing physical infrastructure,” the minister said. CJ of Gauhati HC to visit Mizoram GNLA militant Aizawl, Sep 30 (IANS): Gauhati High Court Chief Justice Ajit Singh will visit Mizoram next week in the wake of a mob attack at Lunglei court and subsequent withdrawal of all judges from there, an official said here on Friday. “Gauhati High Court Chief Justice Ajit Singh would visit Mizoram on October 5 to study the situation arising out of the mob attack in Lunglei District and Sessions Court on September 22. After the incident, the High Court Registrar General had withdrawn all the three judges of the court,” a Mizoram Law Department official said. “The Mizoram government requested the Gauhati High Court Chief Justice to rescind the order withdrawing the judges. The Chief Justice, in a letter to Chief Minister Lal Thanhawla, assured to consider the request,” he added. Meanwhile, Mizoram Home Minister R. Lalzirliana said that a magisterial inquiry has been instituted to probe the incident. A mob had attacked the Lunglei district court buildings on September 22 and ransacked the official residence of a civil judge, after a 26-year-

old youth was produced before the court by police for allegedly killing another in the Zohnuai locality of Lunglei district on August 27. The crowd had demanded to see the accused youth, but police turned down their demand, leading to the mob attack. The Union Home Ministry has also sought a report from the Congress-ruled Mizoram government over violence on Lunglei district court premises. “Describing the mob attack on the district court building in Mizoram as a ‘dark chapter’, Gauhati High Court Chief Justice Ajit Singh has urged the Chief Minister to take stringent action against the culprits,” the official added. He said that the Chief Justice in his letter to the Chief Minister noted that unless strict action is taken at once, the incident would encourage future similar adversities. High Court’s Registrar General H.K. Sharma, in his order, had also asked Lawngtlai district Senior Civil Judge-cumChief Judicial Magistrate not to hold any circuit court in Lunglei district until further orders from the High Court.

Itanagar, Sep 30 (PTI): Arunachal Pradesh Chief Minister Pema Khandu chaired a review meeting of the department of hydropower development to restructure and improve policy decisions including the functioning of the department to overcome various hurdles in development of hydropower in the state and made introspections. Though Arunachal with its 58,000 MW power generating capacity, boasts of being the emerging ‘power house’ of the country, the state’s own hydropower generation was a meager 15-16 MW, the chief minister observed during the meeting held here last night, an official communiqué informed here today. “It’s a matter of shame that we failed to make optimum use of the generous funding,” he said. “Public are true in asking -- if we are unable to manage small projects, how do we with big projects?” said Khandu and noted that the government today is unable to reply to people on this matter. The chief minister observed that policy deficiencies, slow decision making process and lack of pro-active measures by state government had caused delay in hydropower development. He also observed that execution of hydel projects took serious beating due to inefficiency in the department. Taking serious view of such setbacks, Khandu issued strict directive that henceforth funds utilization for development of all hydel projects will be strictly monitored. He asked the department officials to conduct proper feasibility study and proper site selection so that the site has the required power generating capacity and is safe from flood water or erosion. The chief minister also asserted that the government wouldl not hesitate to take action against any misappropriation or erring officials. “Unless people’s cooperation is guaranteed, we cannot go ahead with projects. It should be in full confidence of the people and agreeable to them,” he said and announced that the state government will revisit and revise the hydropower policy to assure maximum benefit to the local people. Correspondent Shillong, Sep 30: A Garo National Liberation Army (GNLA) militant, wanted for several kidnappings and killings, was on Friday killed in an encounter with the security forces in Meghalaya’s East Garo Hills district, police said. Acting on intelligence inputs, Swift Weapons and Tactics (SWAT) commandos of the state police ambushed a group of 15 to 20 GNLA militants in the outskirt of Dawanengja area under Williamnagar police station. As the commandos approached the camp they were fired upon, police said. In retaliatory fire, one of the militants, who was in the camp, was shot dead. The deceased has been identified as Balmit Ch Marak @ Morek, who was wanted in kidnappings and killings of police personnel, Davies Marak, the district police chief of East Garo Hills said. Principal, teacher in police custody for raping students

Shillong, Sep 30: The Principal and a senior teacher of Kendriya Vidyalaya Central School, Tura in Meghalaya was Friday sent to five days’ police custody for raping two school students, police said. Yogesh Joshi, 32, from Churu village in Rajasthan and Deep Jyoti Das, 25, from Tezpur in Assam were arrested on Thursday after the parents of the two victims lodged an FIR accusing the duo of raping their daugthers. “We have produced both the accused before the Court of Chief Judicial Magistrate Isormon Rymbui and the Court has granted them five days’ police custody,” Mukesh Kumar Singh, the district police chief of West Garo Hills said. Singh said that the investigation was already on following the FIR. “We have booked both the duo under POSCO Act and Section 376 of the Indian Penal Code,” he said. The Principal and the teacher had allegedly raped the two girls studying in Class XII students on the evening of September 3 after they were invited along with some senior students to celebrate Joshi’s birthday. The victim’s parents said that the two teachers had spiked the fruit juice served for the two girls with alochol. (Correspondent)

Surgical strikes: Shah lauds Indian army

NEW DELHI/SRINAGAR, SEP 30 (Agencies/PTI): Surgical strikes by the Indian Army across the LoC to hit terrorist launch pads came as a huge relief for BJP that had been on the backfoot since the Uri attack. BJP hailed the PM and Indian Army, terming the action appropriate revenge for the Uri terror attack in which 18 Indian soldiers were martyred. “Today’s strikes signal the rise of a new India where the government doesn’t get cowed down by nefarious designs of terrorists,” reacted BJP chief Amit Shah on Thursday. “I again salute the valour of Indian Army for giving befitting reply to those attacking innocent Indians & ensuring zero tolerance on terror,” the BJP chief said. The BJP chief said it is for the first time, in a frontal fight against terrorism, India is feeling secure under the leadership of Modi. “Indian Army has inflicted heavy damage on terrorists, without any casualty and it reaffirms the Army’s valour and commitment to nation’s security,” said Shah. There was concern that India’s diplomatic and other responses would not be seen to be strong enough to satisfy an enraged public. It was also felt that BJP needed to live up to its “Bharat Mata” and “Tiranga Yatra” campaigns. In the public rally at Kozhikode in Kerala, first after the Uri attack, Modi had directly held Pakistan responsible for the terror strike and warned that perpetrators will not be spared. The Army action could

be crucial even electorally with the BJP set to make noise about how it has broken the shackles that held back past governments and avenged the killing of Indian jawans. It has come as a morale-booster for the party workers in light of the looming assembly polls in five states including electorally significant Uttar Pradesh. BJP national general secretary Ram Madhav, who hogged the headlines for his “jaw for tooth” comment after the Uri attack, was delighted at the success of the surgical operation. He claimed, “Prime Minister Narendra Modi has walked the talk.” “Punishing the perpetrators of terror from across has begun,” Madhav wrote on twitter. The BJP leader took a dig at Pakistan for downplaying the surgical strikes. J&K CM concerned over escalation of situation

In the wake of cross-LoC surgical strike by Indian army, Jammu and Kashmir Chief Minister Mehbooba Mufti today voiced grave concern over the escalation of situation along the borders and warned that confrontation could lead to a “disaster of epic proportions” for the state. Calling for restraint and de-escalation of the “war-like situation”, she said India and Pakistan must open the channels of communication realizing the dangerous consequences of any escalation of ongoing confrontation along the borders. undergone enormous tragedies because of the bloodspattered violence in the state, she said while commenting on the surgical strike. “We in J&K have suffered immensely because of the violence and know very well its dangers and consequences,” Mehbooba said.

Afghan envoy says Surgical strikes needed

Afghanistan supports India’s strikes in “self-defence” to neutralise terrorists inside Pakistan, Kabul’s envoy Dr. Shaida M. Abdali said on Friday. Addressing the media a day after the Indian army carried out “surgical strikes” targeting “launch pads for terrorists”, he argued for taking the war on terror to the “safe sanctuaries” of terror across the border. “Terrorism will threaten us all if we do not combat it. Therefore we feel that the time has come for tough action against terrorists. There will be risk and cost involved in such measures but we have to undertake them because the time has come for us to combat this force. If terror groups continue violence, then the actions taken (by India) will continue,” Abdali said in support of the Indian army’s actions that killed a number of terrorists. The Afghan envoy was one of the twenty-two diplomats who were briefed by India on Thursday regarding the strikes and said that the Indian actions prove Pakistan’s complicity in terror attacks that target neighbouring states.

Karunanidhi said although Apollo hospital, where the Chief Minister is recuperating from fever and dehydration, was issuing bulletins about her health, “some unwanted rumours” were deliberately being floated by “some persons.” “Some persons are spreading unwanted rumours about her health on the social media and to put an end to these, proper information about the Chief Minister’s health must be made available to the people,” he said in a statement. Karunanidhi suggested that photographs of the Chief Minister be released through the media to quell any kind of rumours being circulated about her health. Jayalalithaa (68) was admitted to the hospital on September 22 after she complained of fever and dehydration. She has been advised to stay for a few days at the hospital. NH further expressed surprised to learn that NU, for the past four-five years, had been surrendering plan money allocated for development of the under-developed university. It said the latest was the Rs. 1.69 cores surrendered during the August 9, 2016 Finance committee meeting. Patna, Sep 30 (PTI): In a setback to the Bihar government, the Patna High Court today quashed the government notification completely banning liquor in the state, saying it is ultra vires of the Constitution. A division bench of the court comprising Chief Justice Iqbal Ahmed Ansari and Justice Navaniti Prasad Singh quashed the April 5 notification of the state government to stop consumption and sale of alcohol in the state. The April 5 notification is ultra vires to the Constitution, hence not enforceable, the court said in its verdict. The same bench had on May 20 reserved its order on

a batch of writ petitions filed by Liquor Trade Association and many individuals challenging the liquor law in Bihar brought by Nitish Kumar government with stringent penal provisions. The Nitish Kumar-led Grand Secular Alliance government had first banned the manufacture, trade, sale, consumption of country-made liquor since April 1, but later imposed a blanket ban on all types of liquor including foreign liquor in the state. The Court today quashed the April 5 notification of the state government which had completely banned trade, manufacture and consumption of alcohol, Indian

Made Foreign Liquor (IMFL) as well spiced and domestic liquor. On the basis of experience in course of implementation of the Excise law, the state government had incorporated some additional provisions by way of Amendments enhancing duration of jail term, amount of penalty, arrest of adult members of a family in the event of recovery of liquour from home and community penalty among others. The amended liquor legislation, after passage from both houses of the Bihar Legislature during recently concluded Monsoon session, was approved by the state Cabinet.

It has got consent of Governor Ramnath Kovind too. The Amended Liquor law was expected to be notified on October 2 next. Asked about the fate of Amended Liquor legislation expected to be notified on October 2, Additional Advocate General Lalit Kishore said the court today quashed the April 5 notification. “I would be able to talk more on the subject only after seeing the order of the court,” he said. Excise Commissioner A K Das said, “I cannot say anything at this moment as I have not seen the court’s order”.

Noted lawyer Rajiv Bhawan had appeared on behalf of the Bihar government on May 20 to defend the liquor law. Senior Advocate Y V Giri, who had appeared on behalf of Restaurant and Bar Association, had argued that the Amended Act was itself “unconstitutional” because it creates unreasonable restrictions on choice of livelihood of a person which is protected under Article 21 of the Constitution. The content of the petitions filed on behalf of Liquor Trade Association and some individuals were also on similar lines.

here is no doubt that the humiliation and frustration being felt after the series of terror strikes in India by Pakistani-sponsored terror groups has turned into deep hatred and anger. Indians are angry because Pakistan continues to deny these terrorists were from its territory and reject all evidences provided by India to take action against those terrorists who had committed murder and mayhem inside India. The September 18 terror attack on an Army camp inside Jammu and Kashmir’s Uri area of Baramulla district when Pakistani fidayeen militants stormed an Army camp and killed 17 soldiers proved to be the proverbial last straw on the government of India’s back. Despite India’s patience against retaliation and its deep desire to strengthen relations with Pakistan so that democratic forces in that country would be strengthened; the Pakistani civilian set up continues to play a double game. Pakistan’s double game, On one side, suggests that it wants bi-lateral dialogue to normalise relations and trade and on the other side, Pakistan continues to train, arm and promote terrorism in Kashmir. The response on September 30 by India is more than justified; ehether it was the attack on the Indian parliament on 26/11, the Mumbai train explosions, Pathankot or Uri, where each time India’s ruling politicians were gripped by a sense of helplessness and hopelessness The surgical strike launched by the Indian Army’s Para Commando brigade in the early hours of September 30 deep beyond the Line of Control(LoC) was a huge success in many ways. Posterity will be a better and truer judge, but Thursday’s surgical strike by the Indian army was a game-changer both in terms of how Indians view themselves and how the world sees India. One- it should serve as a lesson to Pakistan that when it comes to shove, India will no longer allow itself to be a victim of Pakistani terror attack. Secondly, the surgical attack on Pakistan should also change the dialogue from being confused to being clear that terror and talks will not be accepted. Thirdly, the strike has greatly enhanced India’s image as one of the nation’s in the front in fighting terrorism. Fourthly, India should not over gloat on the success of the strike as it could only increase the number and decibel of war mongers on both sides of the international border. Fifthly, the strike has also brought many nations to finally make up their mind about Pakistan being a terror exporter and a threat to peace. The BJP will certainly leave no stone unturned to extract political mileage from the September 30 strike especially in the election campaign for the UP assembly in 2017. UP is a very crucial state for the BJP since it had given the maximum number of Lok Sabha seats in 2014 where it won 72 out of 80 seats. The assembly election in 2017 is seen as the mother of battles for the BJP since capturing UP from the SP will ensure that the party will be able to rule the state that gives the highest number of Lok Sabha seats for it to retain power in 2019. India should continue to wage peace to strengthen democracy in Pakistan but at the same time, be prepared to act at any time to protect its interests.

We take our own spiritual consecration and try to make it into a call of God, but when we get right with Him He brushes all this aside. Then He gives us a tremendous, riveting pain to fasten our attention on something that we never even dreamed could be His call for us. And for one radiant, flashing moment we see His purpose, and we say, “Here am I! Send me” (Isaiah 6:8). This call has nothing to do with personal sanctification, but with being made broken bread and poured-out wine. Yet God can never make us into wine if we object to the fingers He chooses to use to crush us. We say, “If God would only use His own fingers, and make me broken bread and poured-out wine in a special way, then I wouldn’t object!” But when He uses someone we dislike, or some set of circumstances to which we said we would never submit, to crush us, then we object. Yet we must never try to choose the place of our own martyrdom. If we are ever going to be made into wine, we will have to be crushed—you cannot drink grapes. Grapes become wine only when they have been squeezed. I wonder what finger and thumb God has been using to squeeze you? Have you been as hard as a marble and escaped? If you are not ripe yet, and if God had squeezed you anyway, the wine produced would have been remarkably bitter. Post-mortem Opinion: Nagaland Petroleum & Natural Gas Regulations S

COPE AND AMBIT On 22.09.2012 the Nagaland Legislative Assembly passed the Nagaland Petroleum and Natural Gas Regulations, 2012 (hereinafter referred to as “Regulation 2012”). The following opinion pertains solely to the question of the legal validity of the said Regulation, and as such does not delve into the merits of any pending legal cases or comment on matters of fact, except where it relates to Regulation 2012. LEGISLATIVE CHAIN OF EVENTS In order to examine Regulation 2012, it is first necessary to set out the relevant provisions of related legislations. Section 3(1) of the Nagaland (Ownership & Transfer of Land and its Resources) Act, 1990(hereinafter referred to as the “1990 Act”) states that: No person shall undertake any prospecting or mining operations in any area in the State except under, and in accordance with, the terms and conditions of a prospecting licence or, as the case may be, a mining lease granted under this Act and the rules made thereunder Section 2(g) of the 1990 Act defines “mining operations” as: …any operation undertaken for the purpose of winning any mineral Further, Section 2(e) defines “minerals” as: …all substances which can be obtained from the earth by mining, digging, drilling, dredging, hydraulicing, quarrying or by any other operation, and includes mineral oils (which in turn include crude oil, natural gas and petroleum) Section 64 (1) and (2) of the 1990 Act state that: Whenever any land in the State is proposed to be acquired for the purpose of conservation, development, exploration or exploitation of any land and its resources…such acquisition shall be deemed to be needed for a public purpose…The provisions of the Nagaland (Requisition and Acquisition) Act, 1965 shall apply to every acquisition of land for the purposes specified in Sub-section (1)… Therefore the 1990 Act occupies the field with regard to mining operations in the State of Nagaland, including the mining of petroleum and natural gas. While the 1990 Act sets out the substantive basis for acquisition of land for mining operations, the procedural aspects of such acquisition were as detailed in Sections 9 to 11 of the Nagaland Land (Requisition and Acquisition) Act, 1965. In 22.09.2012, the Nagaland Legislative Assembly passed Regulation 2012, the intent of theRegulation as expressly declared in its introduction was to: …re-state the customary practices of Nagas in regard to “ownership of land and its resources” particularly in relation to petroleum and natural gas within the territory of Nagaland… In passing Regulation 2012, the Legislative Assembly purported to be exercising its powers under Article 371A(1) (a) of the Constitution of India. The introduction to the Regulation further referred to a discussion in the Lok Sabha in March 2011 where the concerned Ministry noted that: …the State of Nagaland has the power to frame rules for governing matters relating to petroleum and natural

gas within the territory of Nagaland… Critically, Section 3(2) of Regulation 2012 states that: No Act or Rule or any other instrument of the Government of Nagaland which is in conflict with the customary law position as enshrined in article 371-A (1) (a) of the Constitution of India in regard to “land and its ownership” in relation to petroleum and natural gas within the territory of Nagaland shall be deemed to have become void since the date of enactment of such Act or Rule or any other instrument notwithstanding their presence in the statute book and regardless of previous acts of commissions and omissions… As stated above, the only instrument of the Government of Nagaland in force with regard to land and ownership, in the context of petroleum and natural gas extraction is the 1990 Act. However the said Act, having been legally promulgated by the Nagaland Legislative Assembly in exercise of its powers under Article 371A(1)(a)(iv), is not in conflict with the customary law position enshrined in Article 371A (1) (a), and therefore cannot be deemed void should Regulation 2012 be found a valid enactment with powers to repeal an existing statute. The 1990 Act therefore remains in force irrespective of the legality of Regulation 2012. Further, Section 3(3) of Regulation 2012 states that: Only these Regulations… and any other Rules that may be framed by the Government of Nagaland in accordance with the provisions of these Regulations, shall apply to matters relating to petroleum and natural gas within the territory of Nagaland. This provision, read in conjunction with Section 3(2) above, leaves no doubt that the intent of the Legislative Assembly in passing the said Regulations is that the said Regulations would apply to all cases of petroleum and natural gas extraction in Nagaland, to the exclusion of all other legal instruments in force. We shall now proceed to examine the powers of the Nagaland Legislative Assembly under Article 371A. ARTICLE 371A: MAKING A LAW Art 371A (1) (a) mandates that: Notwithstanding anything in this Constitution, no Act of Parliament in respect of: i. religious or social practices of the Nagas, ii. Naga customary law and procedure, iii. administration of civil and criminal justice involving decisions according to Naga customary law, iv. ownership and transfer of land and its resources, shall apply to the State of Nagaland unless the Legislative Assembly of Nagaland by a resolution so decides… The scope of this provision is very clear. There is a long and detailed history of this provision which has been set out by the Hon’ble Supreme Court in State of Nagaland vs Ratan Singh (1967 AIR SC 212).It seeks to ensure that no Central Act shall apply to Nagaland, unless the Nagaland Legislative Assembly so desires. Here it is important to pay close attention to two phrases mentioned in this Constitutional provision: “no Act of Parliament” and “unless…by

a resolution”. These phrases reveal that a Central Act or law can apply to Nagaland in certain situations. The provision specifies the manner in which the Legislative Assembly can convey its decision to abide by a Central law, i.e. by a Resolution. Therefore a Resolution in this scenario acquires the character of a legislative instrument in the event that it is passed under Article 371A (1)(a), but only when it is used to apply a Central law to Nagaland. This is the special power endowed to the Nagaland Legislative Assembly under this provision, to be used in this specific instance. Outside of applying a Central Act to Nagaland, if the Nagaland Legislative Assembly seeks to create a law, it has to follow the legislative processes underlined in Articles 196 to 200, which are applicable to all State Legislatures. No State Legislature can create a law solely by passing a resolution, in the absence of compliance with Articles 196 to 200,as shall be further detailed below. To further clarify, if the Nagaland Legislative Assembly seeks to create a law, whether under Article 371A(1)(a) or otherwise, it will need to comply with Articles 196 to 200. A resolution can only serve to adopt an existing Central Act in order to apply it to Nagaland. In fact the 1990 Act is an exercise in creating legislation under Article 371A (1)(a), and in doing so it has complied with the legislative processes prescribed under Articles 196 to 200, including the consent of the Governor. Further, it is necessary to clarify that the question here is not solely one of nomenclature. The term “regulation” by itself does not strike at the competency of a legislation, and the meaning of the term shall differ according to the context [GK Krishnan vs State of Tamil Nadu (1975 AIR SC 583)]. The Nagaland Land and Revenue Regulation (Amendment) Act, 1978 refers to itself as a Regulation and an Act. The preamble to the said legislation mentions that it has received the assent of the Governor and thereafter published in the Gazette. Thus complying with the Constitutional legislative processes, the said legislation, irrespective of terminology, becomes a law.We shall now examine whether Regulation 2012 is a law as passed by the Nagaland Legislative Assembly. REGULATION 2012: MAKING A VALID LAW The doctrine of separation of powers between the executive, legislature, and judiciary is embedded in the basic structure of the Indian Constitution as found by the Hon’ble Supreme Court in Kesavananda Bharati vs State of Kerala [(1973) 4 SCC 225] and Indira Nehru Gandhi vs Raj Narain [1975 Supp SCC 1]. The principle that each branch of government has its specific duties and shall not encroach on the other is applied so as to preclude the exercise of arbitrary power (Black’s Law Dictionary, 7th Edition, 1999; Advanced Law Lexicon, P.Ramanatha Aiyar, 3rd Edition, 2005). The matter for consideration here is whether the Nagaland Legislative Assembly in passing Regulation 2012 exercised its legitimate legislative power, and in effect created a valid law. It is necessarily the case that the Legislative Assembly is the competent authority to enact laws. This is enshrined in the Constitution:

Art.245(1): Subject to the provisions of this Constitution…the Legislature of a State may make laws for the whole or any part of the State. However the Constitution not only ascribes legislative authority to the State Legislature, but also prescribes,through Articles 196 to 200, how this legislative authority must be exercised. A five-judge bench of the Hon’ble Supreme Court has produced a detailed commentary on the exercise of legislative power: Broadly speaking, lawmaking is exclusively the function of the Legislatures (seeArt.79 and Art.168). The President and the Governor are a part of the Union or the Legislatures of the States.As far as the Parliament is concerned, the legislative process is complete as soon as the procedure prescribed by Art.107 of the Constitution and connected provisions are followed and the Bill passed by both the Houses of Parliament has received the assent of the President under Art.111. Similarly, a State legislation becomes an Act as soon as a Bill has been passed by the State Legislature and it has received the assent of the Governor in accordance with Art.200...Thus, irrespective of the date of enforcement of a Parliamentary or State enactment, a Bill becomes an Act and comes on the Statute Book immediately on receiving the assent of the President or the Governor, as the case may be, which assent has got to be published in the official gazette. [State Of Kerala vs Mar Appraem Kuri Co. Ltd.(2012) 7 SCC 106)] Regulation 2012has complied with the requirement of having been passed by the State Legislature. However it has not received the assent of the Governor, as required under Article 200 of the Constitution. The legislative process constitutionally prescribed in order to create a state law is not complete in this case. The said Regulation is therefore not law. Further, as per Article 300A of the Constitution: No person shall be deprived of his property save by authority of law While Article 300A is not a fundamental right, it is a constitutional right of a citizen of India[Jilubhai Nanbhai Kachar vs State of Gujarat (AIR 1995 SC 142)]. When the owner of land, under which there are minable resources, transfers such land to a company, whether this is for a specified period or otherwise, the owner of the land is deprived of his property during the said period. Regulation 2012 having no force of law as established above, therefore violates Article 300A of the Constitution in seeking to authorize the transfer land belonging to individuals and/or village councils to mining companies. RE G ULAT I O N 2012:EXECUTIVE INSTRUMENT The question now arises as to what the nature of Regulation 2012 is, if it is not a legislative enactment. One proposition would be that it is an instance of subordinate legislation. The Hon’ble Supreme Court notes that: Subordinate legislation is made by a person or body by virtue of the powers conferred by a statute…The words “rules” and “regulations” are used in an Act to limit the power of the statutory authority...

A citizen has a moral duty towards environment protection

(From previous issue) We are failing on our part in replacing the trees that we have cut or cleared the thick forest/jungle around us either for development or construction of roads and in order to fight for the menace of global warming, vigorous efforts should be made such as to discourage activities or development or business such as stone quarry, stone crusher, etc. which caused damages to environment. Water has become increasingly short in supply as the human population soars. An abundant of safe, clean water is a necessary for all life. By protecting rivers and their related ecosystems as well as searching for new sources of water, even in the form of preserving trees in the jungle and rocks in the rivers, we can assure ourselves of a substantial supply of this crucial substance in the future while still protecting important fish and wildlife habitat. We are aware of the natural disasters that are occurring such as landslides, soil erosion and floods but more seriousness is the short supply of water. Why, are all these things happening? It’s because of our cruelty. We are not taking up our duty. We are

not looking after the beautiful creation of God. Together, let us save our land and our people. Man made global warming is the biggest scam in the history of mankind to fulfill his greed with the uncontrolled excessive use of fossil fuels. Nuclear exploration and unnecessary excessive use of artificial goods with the advent of the standard of living. In doing all these, we are not only polluting our natural environment, but we are also creating social, economic and political problem as well. When we harm the natural environment there arises the problems the problems like crimes, illiteracy, poverty, overpopulation, homelessness, traffic and most importantly our health both physically and mentally. Some of the major problems facing in Nagaland due to negligence and lack of civic sense is the ongoing menace of solid waste management, lack of proper drainage system and the recent raise in temperature during the last two years. Concerning Environmental protection, most of the citizens have the thinking and focuses on the role of government, legislation and law enforcement, however, in its

broadest sense protection must be the responsibility of the people, for every single person on this earth is solely dependent on the basic needs of our existence i.e food, air and water. It is not only the duty of environmentalist and nature activists to protect our environment, indeed, we all are entitled to the protection of our environment. To take a great example, the Kohima Ao Baptist Arogo (KABA) under its community service project ‘Creating Awareness for Restoration of Environment” (CARE) has indeed taken a great step towards protecting, spreading awareness and cleaning the Environment. Every one has a moral duty to protect our environment, for without environment, life itself is not possible. Therefore, our main act and goal is to protect our environment and create awareness among our community, culture and society, for the security, preservation and cleaner, greener environment as a legacy and gift to our future generation. Any action of such bodies in excess of their power or in violation of the restrictions placed on their powers is ultra vires…[Sukhdev Singh & Ors vs Bagatram Sardar Singh (1975 AIR 1331)]. Regulation 2012 does not claim its authority under any existing statue. On the contrary it avers that it shall be the only instrument in force within the State of Nagaland on the subject of petroleum and natural gas extraction, thus making it amply clear that it is not an instrument of subordinate legislation. An alternative proposition would be that it is an executive instrument, passed by the executive branch of the State of Nagaland. By virtue of this executive instruction, the State of Nagaland purports to decide on matters relating to transfer/ acquisition of land for the purpose of mining petroleum and natural gas, when there exists a valid law in force in the same field, i.e. the Nagaland (Ownership & Transfer of Land and its Resources) Act, 1990. Section 3 and 64 of the 1990 Act mentioned above clearly lay down the process for issuing permits and acquiring land for mining purposes. By prescribing an alternate procedure for issuing mining permits and acquiring land for extraction, the executive instruction, i.e. Regulation 2012 is in conflict with the 1990 Act. It is a settled legal proposition that executive instructions cannot override statutoryprovisions. This has been upheld by the Hon’ble Supreme Court in various judgements [State of Madhya Pradesh & Anr. vs G.S. Dall and Flour Mills (1991 AIR SC 772); Union of India & Anr. vs Amrik Singh & Ors. (AIR 1994 SC 2316);GlaxoSmithKline Pharmaceuticals Ltd. vs Union of India (2014) 2 SCC 753)]. Executive instructions may provide guidelines in certain circumstances, but they do not have force of law [The Joint Action Committee of Airlines Pilots Associations of India & Ors. vs The Director General of Civil Aviation & Ors(2011)5 SCC 435)]. In the case of the State of Madhya Pradesh & Anr. vs G.S. Dall And Flour Mills (1991 AIR SC 772) the Hon’ble Supreme Court laid down the order of priority with regard to legislative and executive enactments: Executive instructions can supplement a statute or cover areas to which the statute does not extend. But they cannot run contrary to statutory provisions or whittle down their effect. In the above statement, the Hon’ble Supreme Court states legal position in the event that there is a conflict between an Act and an executive enactment. To further clarify the above statement, let us refer to an Act as A and executive instruction as B, i.e: Act = A Executive instruction = B The Hon’ble Court rules that in case there is a conflict between an executive instruction and a statute, the provisions of the Actwill supersede the executive instruction. In such a situation the Hon’ble Court declares that: A>B In the present case there are no statutory rules issued under the 1990 Act. It has been learnt that rules under the 1990 Act are awaiting assent of the Governor. As held in

Purushothaman Nambudiri vs The State of Kerala [1962 AIR SC 694] the Constitution does not prescribe a time limit for the Governor to grant his assent, and as such the proposed rules under the 1990 Act are not in force. Regulation 2012 is not a set of rules issued under the 1990 Act, but a separate instrument. Since there is a discernible conflict between Regulation 2012 and the 1990 Act, the former being an executive instrument and the latter being an Act, there is clear legal precedent to uphold the view that the 1990 Act prevails over Regulation 2012. Further, the Hon’ble Supreme Court in the M/s GS Dhall judgement above notes that an executive instruction cannot amend or supersede a statutory provision. It cannot run contrary to the provisions of an Act or reduce its scope. Regulation 2012 in seeking to amend earlier Acts, provide an alternative procedure for mining petroleum and natural gas, and for transfer of land for this purpose, directly interferes with the operation of the 1990 Act. Regulation 2012 thus overreaches itself, and seeks to exercise powers it does not possess. CONCLUSION The above sections have detailed that, in light of the provisions of Articles 371A (1)(a) and Articles 196 to 200, Regulation 2012 is not a valid legal enactment of the Nagaland Legislative Assembly. The Regulation does not derive its authority from a statute and is, at best, an executive instrument. Additionally the said Regulation is directly in conflict with an existing statute which occupies the field, being the 1990 Act. That being the case, Regulation 2012 has no force of law. In Ram Ganesh Tripathi vs State of U.P. [AIR 1997 SC 1446], the Hon’ble Supreme Court considered a similar controversy and held thatany executive instruction/ order which runs counter to or is inconsistent with statutory rules cannot be enforced, rather deserves to be quashed as having no force of law. As established earlier, Regulation 2012 runs counter to an existing law, i.e. the 1990 Act. That being the case, the Regulation seeks to dispense with personal property in a manner contrary to the provisions of the 1990 Act and Article 300A of the Constitution. In a case where a person was invalidly deprived of his property, the Hon’ble Supreme Court held: …This is a case where we find utter lack of legal authority for deprivation of the respondent’s property by the appellants who are State authorities. In our view, this case was an eminently fit one for exercising the writ jurisdiction of the High Court under Article 226 of the Constitution [State of UP and others vs Manohar(2005 2 SCC 126)] Given these circumstances, it is reasonable to conclude that Regulation 2012 is an invalid instrument, ultra vires of the Constitution of India and therefore has no authority to deprive a person of his property. An appeal to private schools

At the very outset, I would like to acknowledge that the article bears no personal grudges towards any individual or institution. However it feels that the issue which may inadvertently sound petty nevertheless needs to be examined in all rationality and make amends as necessary. The ever rising cost to educate a child in today’s age is an open book and a nightmare to every parent which of course is a burden to the respective parents. However to make things worse, it has been noticed that almost all private learning institutions have been charging exorbitant amount of fees apart from all other actual and necessary fees, viz. development fee, which in all rationality makes no sense at all. The private schools should either give a solid and valid reason as to the significance of such fees levied on the students or stop this day light robbery altogether at once. It is sad that instead of focusing on imparting quality education to the students and moulding the leaders of tomorrow, the learning institutions have more or less become another business entity. The writer has had the privilege of visiting various schools and even met many parents regarding the issue of nonsensical fees such as development fees and learnt that although all the parents object to such fees, the fear of adverse consequences that may/will befall their children in the school if they do so, has zipped their lips. Therefore, the writer would like to make an appeal to all the private learning institutions to refrain from such unjust exercises. It is also my humble request to the concerned public authority, related NGOs and student bodies to check on such matters as it has become increasingly difficult for the parents to cope up with the ever rising demands made by the private institutions for the sake of educating their children. World Heart Day observed across Nagaland

PEREN: Along with the rest of the world, World Heart Day was observed in Peren on September 29 with the theme “Power your Life” at CHC Jalukie. Chairing the program DVPO, NVBDCP, Dr. K. Limatula Ao welcomed the participants and also delivered the keynote address. She spoke on the significance of World Heart Day and why it was observed. Dr. Limatula stated that the aim was to inform people about cardiovascular diseases and to promote its preventive measures and also to improve health globally by encouraging people to make lifestyle changes and promoting education internationally about the ways to be good to your heart. Also speaking on the occasion, Tguori informed that diseases could be cured and protected if ‘we’ are aware and

conscious and remarked that people tend to live an unhealthy lifestyle because of ignorance leading to premature deaths. Dr. Thangmang, Thomson, MD, Medical Officer, Athibung PHC, spoke on healthy heart, its risk factors, prevention and management. He highlighted the symptoms of heart disease, the main types of heart disease, the risk factors for cardiovascular diseases and its prevention. The program concluded with a vote of thanks by Dr. D. A. Newmai, SMO CHC Jalukie. A total of 70 patients availed the services. Also, 12 persons were diagnosed with diabetes and 22 with hypertension cases. Apart from free health checkups and distribution of free medicines, 50 persons availed counseling on health promotion and prevention of non communicable

Resource person Dr. Hokugha Jakhalu, speaking on the seminar emphasized on diabetes, its risk factor and prevention control. He also elaborated the causes of cancer and treatment.

Kohima: With the rest of the country, the celebration of U-DISE Day 30th September-cum-sensitization on implementation of student data collection in-Sync with U-DISE 2016-17 was held at Ura Academy Hall Kohima organized by district mission authority SSA Kohima on Friday. DIMAPUR, SEP 30 (NPN): Deputy Commissioner (DC) Dimapur cum DMA-SSA chairman, Kesonyu Yhome IAS, on Friday described Unified-District Information System for Education (U-DISE) as an informed architecture for school education in the state. “UDISE has been the base for undertaking many schemes and programmes for developing the education sector in the state and the country by the Ministry of Human Resource Development and School Education Department as well”, he said. Speaking as chief guest at the launching of UDISE organised by District Mission Authority (DMA) Dimapur at IMC hall here on Friday, Kesonyu said every scheme and every policy mooted by school education and Ministry of Human Resource Development (HRD) was based on the information from U-DISE. He however lamented the practice of late and inaccurate submission of information by schools. In this regard, Yhome appealed to all head of institutions and data entry operators to display every data saying “we are not dealing with data and statistic but with the life of the society/life of young children, so definitely it is not a responsibility that we can debate.” DC further called upon

all sections of the society to understand the importance of U-DISE information. SSA, deputy mission director, Talitemsu Jamir spoke on the meaning and role of education. Mumbai, Sep 30 (IANS): The upcoming fourth bimonthly monetary policy on October 4 will be the first to be decided on the recommendations of the newly formed Monetary Policy Committee (MPC). It will meet on October 3 and 4 for the review, the Reserve Bank of India (RBI) said here on Friday. “The Monetary Policy Committee will meet on October 3 and 4, 2016, for the fourth bi-monthly monetary policy review for 2016-17,” the RBI said in a statement. “The resolution of the MPC will be placed on the website at 2.30 p.m on October 4, 2016,” the statement said. The central government had notified the constitution of the Monetary Policy Committee on Thursday. Three academics from the country’s top institutions have been named the government nominee members to the Monetary Policy Committee. The committee has been mandated to ensure the country’s retail inflation stays within a band of four per cent, plus or minus two percentage points. Mumbai, Sep 30 (IANS): As India plans to become completely self-sufficent in energy security in view of the changing circumstances, the government is worried about how to dispose off the country’s excess coal production, Union Minister for Power Piyush Goyal said here on Friday. He said that two years ago, when he had announced a target of one billion tonnes of coal production, “it was an off-the-cuff remark” to tackle coal shortages prevalent then. “Now, after two years we have come a point where we have surplus coal and we are worried how to sell it,” Goyal said, addressing the annual convention of Indian Electrical & Electronics Equipment Manufacturers Association (IEEMA) today. He said India will have to plan to become completely self-reliant and should not be import-dependent on energy. “In today’s world, national security encompasses cyber, food and social security,

The US and Russia have been trying to negotiate a ceasefire in the war-torn nation, but Secretary of State John Kerry said “the bombing of Aleppo right now is inexcusable”, NBC news reported. “I think we are on the verge of suspending the discussion because it’s irrational in the context of the type of bombing taking place,” Kerry said at an event in Washington, D.C. on Thursday. Kerry on September 9 announced that the US and Russia had reached a ceasefire agreement that could lead to joint military coordination between the two nations against terror groups like the Islamic State (IS) if the ceasefire held for seven days. Under the agreement, Russia was to ensure the Syrian government led by President Bashar alAssad stuck to the ceasefire, Kerry said at the time. SEOUL, SEP 30 (IANS): South Korea announced on Friday that it would install the THAAD anti-missile system in a more remote region than initially planned. The initial plan to deploy the US anti-missile system in Seongju county had to be scrapped after it faced strong opposition from residents of the area, EFE news reported. THAAD, scheduled for deployment in 2017, will now be set up in an area, currently occupied by Lotte Skyhill Country Club, 18 km north of Seongju city and around 300 km southeast of Seoul, a Defense Ministry spokesperson

told EFE. While selecting a new spot, Seoul considered factors such as operational effectiveness, well-being of residents, infrastructure, security, cost, and time for construction and preparation, according to the spokesperson. Duterte issued his latest threat against drug dealers and users early Friday on returning to his hometown in southern Davao city after visiting Vietnam, where he discussed his anti-drug campaign with Vietnamese leaders and ways for their governments to fight transnational crimes, including illegal drugs. Duterte has said his public death threats against drug suspects are designed to scare them into stop selling drugs and to discourage wouldbe users. But his latest remarks took that crime-busting approach to a different level. “Hitler massacred 3 million Jews ... there’s 3 million drug addicts. There are. I’d be happy to slaughter them,” Duterte said, referring to a Philippine government estimate of the number of drug addicts in the country. The Indian Motion Picture Producers Association passed a resolution yesterday to ban Pakistani actors from the industry in the wake of the Uri attack. The resolution came after Indian Army announced that seven terror launch pads were targeted across the LoC by special forces during a ‘surgical strike’. “Pakistani artistes are just artistes and not terrorists. Terrorism and art are two different subjects. Artists come to our country after acquiring a visa, and it’s our government who allows them with the work permit in our country,” Salman said when asked about his take on banning the actors from Pakistan. The actor said the action (surgical strike) taken by the Indian Army is proper as it was against terrorism, but he would prefer to have a situation of peace and harmony.
