NTC files PIL on parl secys, advisers
D I M A P U R , AU G 3 1 (NPN): Nagaland Tribes Council (NTC) has filed a PIL in the Gauhati High Court Kohima bench against the state of Nagaland for removal of “unconstitutional” posts of parliamentary secretaries and Advisors after the Governor of Nagaland P.B. Acharya failed to respond positively to the demand. NTC had issued a seven-day ultimatum on the Governor to remove the above posts in the light of the July 26,2017 landmark Supreme Court judgment in the PIL against appointment of parliamentary secretaries in Assam, ruled that states have no power to enact any law for appointment of parliamentary secretary and deemed “The Government of Assam had made the appointments through enactment of the Assam Parliamentary Secretaries (Appointment, Salaries, Allowances and Miscellaneous Provisions) Act, 2004” as unconstitutional. According to NTC media cell, the PIL which was filed against appointment of “nine unconstitutional advisors and 26 parliamentary secretaries”, was heard on August 31, 2017.
The court posted the matter to September 11, 2017 for further order and hearing, NTC said. Earlier on August 18, NTC in a representation submitted to the Nagaland Governor through the chief secretary, urged upon the Governor to examine the matter and initiate appropriate action in terms of the Supreme Court Judgment dated July 26, 2017 within seven days from the date of receipt of representation. NTC reminded that as per the 91st Constitutional Amendment and Article 164 (1A) of the constitution of India, there should be only 12 ministers in the State of Nagaland, including the chief minister. However, NTC said that the chief minister, vide notification dated 26.07.17, unconstitutionally appointed nine advisors and 26 parliamentary secretaries under Rule 5 of the Rule of Executive Business (REB) for the Government of Nagaland. D I M A P U R , AU G 3 1 (NPN): Cyber Crime Police Station, PHQ, Kohima have reportedly arrested a person for allegedly posting sexually explicit/obscene picture of a girl on Facebook. According to an official bulletin, PRO Police headquarters, M.Tungoe, said that the accused and the victim had come to know each other from Facebook and had a relationship. Later, the accused, suspecting the victim of having other relationships, had posted intimate pictures taken while they were together. Meanwhile, PRO has warned that under IT Act, 2008, publishing or transmitting of sexually explicit act/obscene picture in electronic form is a punishable offence with a minimum of 3 years imprisonment and up to Rs.5 lakh fine. In many social media groups of state including Facebook, Whatsapp, Instagram, Twitter etc., it has been observed that such posting/forwarding/copy pasting of sexually explicit/obscene material is being done randomly. Therefore, the public have been advised to refrain from posting/forwarding/ copy pasting any such materials in electronic form, as it will attract penalty action.

D I M A P U R , AU G 3 1 (NPN): Eastern Naga Students’ Federation (ENSF) on Thursday served an ultimatum on the Department of School Education (DoSE) to implement state government notification dated January 9, 2009 in the recruitment of mathematics and science graduate teacher (GT) under school education on or before September 7, 2017. In a press release, ENSF president, Sepili L Sangtam, and general secretary, Imti Choba Chang, said that the decision to serve ultimatum was unanimously taken at the presidential meeting held August 30, 2017 and urged the responsible authority to fulfill the demand of the federation within stipulated time. Failure to fulfil its demand, the federation cautioned that it would “strive to seek for justice through
advisors and parliamentary secretaries, but was for allocation of portfolios to the ministers by the Governor on the advice of the chief minister.” NTC maintained that the July 26, 2017 Supreme Court order was a blanket judgment in the matter of appointment of unconstitutional parliamentary secretaries in the States of India wherever it exists. Ministers resign as PM Narendra Modi plans major Cabinet reshuffle NEW DELHI, AUG 31 (AGENCIES): Ahead of the reshuffle in the union council of ministers, as many as six ministers- including Rajiv Pratap Rudy, Mahendra Nath Pandey, Uma Bharti, Kalraj Mishra and Sanjiv Baliyan resigned on Thursday night at the behest of Prime Minister Narendra Modi and BJP chief Amit Shah. Sources say ministers Radha Mohan Singh and Giriraj Singh too have quit. More resignations are likely by Friday, say sources. The ministers met Shah on Thursday and gave their resignations. Rudy resigned from the post of Minister of State (I/C) of the Skill Development Ministry. MSME Minister Kalraj Mishra has resigned from his post as he had crossed the 75-year mark set for all union ministers. He is likely to be made a Governor and will most likely occupy the Bihar Raj Bhavan. Six Governor posts are vacant at present. Minister of State for HRD Mahendra Nath Pandey has resigned from his post. The Chandauli MP has been appointed as BJP UP unit chief.

Water Resources Minister Uma Bharti resigned on health grounds. She has been keeping indifferent health for the past few months and reportedly wants to work for the Namami Gange project as well as work for the BJP. Finance Minister Arun Jaitley is likely to be divested of the Defence Ministry portfolio, of which he is holding additional charge. Suresh Prabhu is likely to be moved out of the Railway Ministry. Health Minister J P Nadda is a front-runner for the post of Himachal Pradesh CM candidate from his party. It is not clear if he will resign or continue till the elections in December.

Nationwide programme to test all TB patients Deadline for Aadhaar-PAN NEW DELHI, AUG 31 (AGENCIES): Beginning this month, health authorities will commence a nationwide programme to test every Tuberculosis (TB) patient for signs of resistance to first-line drugs. Other than providing a realistic assessment on the scale of resistance to commonly-available tuberculosis drugs, experts said this could also reveal a large number of hidden tuberculosis patients, as well greater numbers of those with multiple infections of TB and HIV (human immunodeficiency virus). Even as India tops the world in the number of tuberculosis cases, the WHO (World Health Organisation) estimates that possibly as many as a million Indians with TB could be outside government scrutiny. In 2015 alone, nine million Indians were tested for suspected tuberculosis and about 900,000 were con-
firmed to be ailing from it. Nearly 3% of new TB cases and 18% of prevalent cases are believed to be drug resistant, though independent analyses peg these numbers as much higher. The new policy, called the Universal Drug Sensitivity Test, which was formalised earlier this month, will be implemented using a molecular diagnostic test called GeneXpert, a US-developed technology tool being used worldwide since 2010. It can detect the TB bacterium as well check for resistance to rifampicin, one of the standard key TB drugs, within 90 minutes. Conventional tests take at least a day or more and require well-trained personnel for similar results. States that will first see this policy being implemented include Arunachal Pradesh, Bihar, Goa, Manipur, Meghalaya, Mizoram, Nagaland, Odisha, Sikkim, Tripura and Uttarakhand.

linkage extended till Dec 31 NEW DELHI, AUG 31 (PTI): Centre on Thursday extended by four months the deadline for linking PAN with biometric identifier Aadhaar till December 31, a source said. The deadline for linking PAN with Aadhaar for taxpayers was to end on August 31. This comes at a time when the government has granted a similar extension for furnishing of Aadhaar for availing the benefits of various social welfare schemes. Also, the Supreme Court is hearing petitions challenging the government’s decision on Aadhaar and has posted the matter for next hearing in November. And so, the extension was in line, the source said. Section 139 AA (2) of the Income Tax Act says that every person having PAN as on July 1, 2017, and is eligible to obtain Aadhaar, must
intimate his Aadhaar number to the tax authorities. However, those categorised as non-resident Indians as per the Income Tax laws, people who are not citizens of India, those above 80 years of age and residents of the states of Assam, Meghalaya and Jammu and Kashmir had been exempt from the requirement. The source further said that people who do not have Aadhaar can file their IT returns, but their returns will not be processed till they submit their Aadhaar number. The tax department had on July 31 stated that “unless a finding is made that Aadhaar is constitutionally not valid, tax return filers will need to link their PAN with Aadhaar by August 31, 2017.” Incidentally, December 31 is also the deadline for people to link their bank accounts with Aadhaar.
DIMAPUR, AUG 31 (NPN): Emuloto Public Organisation (EPO) has set a 15-day deadline for the state government to initiate the process of developing CoCo-Doyang road from Khubokita to Khitsakita (18km) via Atoizu ADC HQ under Zunheboto district, which remained unattended for more than a decade. In a representation addressed to the chief secretary, EPO chairman, Abeto Sumi, and secretary, Vikato I Chishi, cautioned that in the event the responsible department/government failed to act within the given time, EPO would resort to its own course of action deemed fit until such time the demand was fulfilled. EPO pointed out that the road was in a pitiable condition and the citizens were facing untold miseries and hardships The organisation also pointed out that the public have been maintaining the said road at their won expenses from time to time. However, it said that due to the lack of machinery tool and modern equipments, the repaired roads cannot sustain for long. Further, EPO said that the public would not, however, be in a position to maintain the said road time and again. “The general consensus is that the government should provide commendable service in respect for the demand made by the public,” EPO said. Over the years, it said the condition of the road has rapidly deteriorated due to complete negligence and lack of proper strategies to tackle the problem by the responsible department.
