crisis: Khango, Isak agree Lokayukta dismisses plea against HM NSCN(K) to reconcile; to sign agreement today
DIMAPUR, SEP 19 (NPN): Nagaland Lokayukta justice Uma Nath Singh while dismissing the petition filed against Y. Patton, deputy chief minister in-charge home by one Vicca S. Aye reportedly a vice president of NDPP youth wing has also made significant observations and recommendations to the Governor with respect to the Nagaland Lokayukta Act 2017 and framing of rules, state police in relation with the Special Responsibility of the Governor over law and order under Art.371A(1) (b) and also the incumbent Advocate General (AG) of Nagaland. The observations and recommendations assume significance in the light of the petition filed with the Supreme Court by the state government against the Lokayukta for curtailment of power and removal. While dismissing the petition against Patton through his order dated September 18, the Lokayukta said the complaints were found to be devoid of substance in the absence of any prima facie evidence to connect him with such allegations and to engage the attention of the Lokayukta. The order further said that the complaint was submitted in haste with deficient facts.
NPCC ready if by-polls are held: Therie
It said the Lokayukta was not supposed to “ indulge in roving enquiry with a view to fish out materials and evidence to prove non-specific, bald and omnibus allegations made in the complaint” therefore it deserved to be rejected and is accordingly dismissed. The order was contained in 31 pages which also mentioned about assigning the preliminary inquiry to the chief minister and the lack of response to hold preliminary inquiry on the petition. The Lokayukta explained that since the chief minister (CM) and the complainant (Vicca) belonged to one party namely the NDPP and the Dy CM, a senior member of the BJP, a prominent constituent of the Nagaland coalition government; the CM should strike a balance and without being influenced by the either, provide a correct picture as to why his own party man has submitted the complaint against his senior most cabinet colleague in his coalition government. Observing that since the CM was one of the highest state constitutional functionaries, the Lokayukta in the order stated that his (CM) report should carry the credibility much higher than that of a police officer particularly in

Lokayukta Police, as a police organisation, is not free from the influence of the state Home department particularly in respect of policy matters connected with the state police which is under the control of the deputy CM who is also the Home Minister. Further, it was observed that the Lokayukta Police Organisation is not being headed by an IPS officer who, like in other states ought not to be below the rank of DGP and who can resist any external influence or pressure. Lokayukta stated that the
KOHIMA, SEP 19 (NPN): Despite government’s directive to teachers to remain in their respective place of posting amidst the lockdown, the Department of School Education (DoSE) has said that attendance of teachers was not satisfactory. Speaking to Nagaland Post, principal director school education, Shanavas C, pointed out that teachers have to be more sincere and be present at their place of posting to help the students in continuous learning. As the state government has decided partial reopening of schools for higher section, he said that teachers should go back to their schools as there were no issues concerning interdistrict movement. Shanavas informed
chief minister was appointed to conduct this enquiry in the special facts and circumstances of the case. But, the Lokayukta said that the chief minister had “disappointingly” “failed” to assist the Lokayukta “for the reasons best known to him”. By ignoring to conduct the preliminary inquiry with all the means at his command and all the records under his control, the Lokayukta stated that the chief minister had “left a wrong impression that he keeps a veiled contempt for the Rule of Law.” (Cont’d on p-6)
Lokayutka puts role of AG Nagaland under scanner The Lokayukta also raised the issue of the conduct of the Advocate General of Nagaland, who was referred to take up the matter by the chief minister. The Lokayukta said that the AG was supposed to come to Kohima in connection with the matter, but due to the present pandemic/ COVID-19 and also, the restriction of movement, he could not come from Delhi. It pointed out that when the Governor and Chief Minister could travel frequently to Delhi, “then why not the Advocate General who may
be much younger to them.” Lokayukta said that there was a “general complaint that if the state government wants to delay any matter, it simply refers the case to the AG in Delhi who sits over such files for months and in some cases over a year. May be, the file of the Deputy Chief Minister was also referred with such motive to the A.G.” Citing Article 165 of the Constitution, which governs the appointment and duties of the Advocate General for the State, the Lokayukta said that the AG was duty bound

DIMAPUR, SEP 19 (NPN): Correspondent NPCC president K. Therie said as by elections to 14 southern Angami-I and 60 Pungro-Kiphire constituencies are expected by OctoberNovember, it was still not clear whether the bypolls would take place against the backdrop of expected political solution within September and dismissal of the PDA coalition and replace it with a “neutral government” to implement the agreement. Therie reiterated that all indications point that relations between the state government and the Governor were not well even as law and order has collapsed in Nagaland ever since regional political parties adopted a policy “to support and facilitate the peace process” by which they “freed factions” to impose their writ over citizens. He illustrated this by stating that the writ of the state government has diminished and various crimes against society and all government departments subjected to extortion including 24% tax on salary of every government employee. He said as per the party assessment, “Modi will be removed” since people have seen how his government has destroyed the nation’s economy. (Cont’d on p-6)
the peculiar circumstances of this case and that is also well within the scope of Section 11(2) of the Lokayukta Act. “That it is alleged by the complainant that the deputy CM can influence and dictate the course of investigation; that in the absence of Nagaland Lokayukta Rules, the conditions of service of the Nagaland Lokayukta Police are controlled by the department of Personnel & Administrative Reforms presently under the charge of the chief minister.” Justice Singh also observed that the Nagaland
that higher secondary students were faring better, because higher secondary schools were located in subdivisions. However, he said that the primary level mostly located in rural areas was facing many issues. The principal director said that teachers have to be in their place of posting to help the students besides ensuring that there was no break and students were able to cope up when the schools reopen. Urging teachers to reach out to students, Shanavas informed that the department would be launching a teacher’s application to monitor teachers on a day to day basis because they have to be monitored and be present in the station. On partial reopening of schools for students of
Class 9 to 12 from September 21 on voluntary basis, Shanavas said that many parents were still concerned and apprehensive to send their children to school. The principal director, therefore, said that it was up to the parents to decide whether to send their children to school or not. Without written consent of the parents, he said that the schools would be held responsible if something happens. Underling the challenges of online learning especially in rural areas, Shanavas said that the pinch due to lack of connectivity was felt when remote learning was the only way to educate students. Therefore, he said that convergent efforts should be made to improve connectivity in the state.
(i) to give advice to the state government upon such legal matters; (ii) to perform such other duties of a legal character; (iii) as may from time to time be referred or assigned to him by the Governor. Ironically, the Lokayukta said that seat of Nagaland government which is to receive the legal advice is in Kohima, and the Governor who is to refer and assign the legal works from time to time (in case of urgency with special responsibility with respect to law and order under Article 371A(l)(b) at any time) is in Kohima. DIMAPUR, SEP 19 (NPN): NSCN (I-M) has condemned the Indian intelligence agencies for allegedly connecting its general secretary and chief negotiator Th. Muivah to “Chinese factor” in an attempt to question his integrity. In a statement, NSCN (I-M) through its MIP rejected “such manipulative manner of media report targeting Th. Muivah to question his sincerity and commitment.” MIP stated that even as the “Indo-Naga” political talks gained momentum and at the threshold of signing the final deal there was “wild media speculation with vested interests involved.” NSCN (I-M) also termed as “unfortunate” that certain elements were at work to sow seeds of suspicion and undo the hard earned achievement. “We believe this is the handiwork of suspicious mindset emanating from panic analysis of Indo-Naga political talks led by NSCN talk team with general secretary Th. Muivah as the chief negotiator,” MIP said. For building a lasting peace,
MIP said the Government of India and NSCN needed complete faith on each other without giving any room for doubt and “other unfounded Intelligence agencies wild analysis and baseless calculations.” It maintained that “no sacrifice comes too big for the Naga people to pave the way for the final settlement” that was honourable and acceptable. However, for all purpose, MIP said that now was not the right time to “throw in unhealthy opinions with the ulterior motive to fracture the hard earned peace process when the propitious moment is round the corner.” For accommodation convenience, MIP said all members of NSCN involved in the peace talk cannot be made to stay in one location in Delhi. MIP said it was, however, wrong on the part of the media to “build ridiculous conjecture that NSCN members are not of one mind.” NSCN (I-M) said it condemned “such a baseless allegation which is intended to send confusing signal to the outside world.” K Y M C
